Abuse of democracy and freedom — Lim Mun Fah

MAY 23 — Deputy Inspector-General of Police Datuk Seri Khalid Abu Bakar said that under the Peaceful Assembly Act 2011, everyone has the right to hold a gathering and therefore, the burger seller who opened his stall in front of Bersih co-chair Datuk Ambiga Sreenevasan's house in Bukit Damansara did not break any laws.

The Deputy IGP might have just wanted to show off his sense of humour, but the remark seems to have turned out as an encouragement.

Therefore, after the burger seller, another group of former army veterans went for "butt exercise" in front of Ambiga's house.

It was then followed by WargaAMAN, a group of 20 Indian non-governmental organisations, planning to set up thosai stalls in front of Khalid's house in Ampang.

The plan was cancelled, but another group wants to go to Ambiga's house.

The group, claiming to be traders of the Kuala Lumpur Petty Traders Action Council, plan to stage the "Bersih 4.0" protest by opening up stalls in front Ambiga's house tomorrow and Friday.

They also threatened that if no one is willing to compensate the losses they suffered during the Bersih 3.0 rally on April 28 after May 25, they would upgrade the protest into an occupy campaign, namely to camp outside Ambiga's house.

These remarks and actions seem to be legitimate and sound sensible, but are in fact irrational. They have also become more and more ridiculous, absurd and repugnant.

Only fools would believe that all these antics are completely unrelated to politics.

If these are political acts, then who is the manipulator behind the acts?

I believe that no political party would be stupid enough to claim these pranksters, as it will not earn points for the party, but transform the party into the best campaigning staff of the confronting party instead.

In fact, opening a burger stall would not only bring a great loss in terms of money, but also in terms of votes.

Similarly, having a butt exercise in front of Ambiga's house did not seem to have helped improve health, but it might cause injuries instead, as well as the loss of votes.

The reason is very simple. For voters, all these behaviour patterns are just little tricks causing harm to others, as well as themselves.

Such unscrupulous antics have reached a limit too ghastly to look at.

Such a malicious confrontation has gone beyond the people's bottom line of toleration.

Democracy should not be like this. This is an abuse and an attrition of democracy instead!

If the antics go on, our society will continue to sink until justice disappears and rogues come to power.

Members of the public should no longer keep quiet and let one after another scene of incomprehensible absurdity stage before our eyes.

Which one threatens the state, Lady Gaga or hardliners? — Yoes C. Kenawas

MAY 23 — The National Police (Polri) stated that they would not issue a permit for Lady Gaga's concert scheduled for Jakarta on June 3, 2012, for, among other reasons, fears that the Grammy Award winner would exploit her sensuality in a manner which could harm the moral of Indonesian youths.

This statement is more or less in line with the same tune as that of the Islam Defenders Front (FPI), which previously said that Lady Gaga would "bring the faith of Satan to the country and thus would destroy the nation's morals" (The Jakarta Post, May 16, 2012).

Whether the police's decision is right or wrong does not matter. The most serious problem, however, lies in the fact that a small group of people can influence the process of interpreting threats within a state institution like the police by using their "religious" agenda. It is interesting to notice that in post-Soeharto Indonesia, state institutions are submissive, if not controlled, by some hard-line groups in this republic.

In a democratic country, the power of the state comes from the people's votes through elections. In this context, the state should never discriminate against its citizens when a conflict erupts between such groups. Instead, the state remains neutral and adherent to the Constitution and law when managing the differences among conflicting parties. The state, through law enforcement institutions, has the power to maintain public order and security, enforce the law, provide protection and serve the public interests. State institutions have the mandate to take action to keep the public interests from all forms of threat.

There are several types of threats, namely direct and indirect as well as actual and potential threats. However, threats are also about perception, particularly if we talk about threats on the level of concepts or ideas.

Because the public is not a single entity, threats directed at a particular group are not necessarily a threat against another group. In this case, the law enforcement agencies, e.g., the police, should carefully assess each type of threat, whether actual or potential, direct or indirect; which party or group that will be harmed by the threat; and how it will affect society as a whole. Therefore, they can take necessary actions based on the threat assessment. Nevertheless, the police must handle each assessment in a careful manner. Miscalculating the threat could send the wrong signal to the general public.

In the case of Lady Gaga's concert and Irshad Manji's book launching, as well as in other cases such as GKI Yasmin Christian congregation or Ahmadiyah Islamic minority sect, state institutions seemed to fall under the influence or are unable to deal with threats that come from religious hardliner groups.

In those cases, the hardliner groups clearly stated that they would launch physical attacks on other parties. Through their actions, the hardliners were actually presenting more potential, and in some cases, actual threats to other groups.

The irony, however, is that state institutions, which ideally must stay neutral to protect the well-being of all people, are aligning with the hardliner groups. Instead of overcoming potential threats, the state apparatus chooses to cooperate with the side that has launched the threat.

The state in post-Soeharto Indonesia has been co-opted by some groups that are capable of influencing state policy through various means, including threats.

It is indeed the irony of democracy that they freely increase their power and consequently influence and determine the state's policy. The most concerning issue is not necessarily their threat to attack others, but their attack on the freedom of expression and pluralism, which characterises the nation.

Worse, they can promote their agenda by intimidating the state. If the state does not comply with their demands, for example, the ban against Lady Gaga's performance, they will not hesitate to intimidate others, including state institutions.

For whatever reason, including maintenance of public order, the police's option to accommodate the threat rather than to overcome it is a stark display of a thug-controlled state. It constitutes the tyranny of a minority over the majority. In the end, it will jeopardise Indonesia's reputation as a democracy. Indonesia's billing as the third largest democracy in the world will be just a myth, or actually, democracy is already new myth of Indonesia.

Indonesia today is watching the radical groups win another battle-of-discourse over those who are supporting democracy, freedom of speech and plurality. The country needs someone like Gus Dur who dared to challenge the hardliner's agenda.

As long as the state complies with particular groups' agenda, then it is hard to deny that Indonesia is transforming into a homogenous society. It depends on Indonesian society whether or not they are determined to advance plurality. — The Jakarta Post

John Terry: Dedicated follower of fashion — Mark Meadows

MAY 23 — Despite all the bling, the big watches and fast cars, the brand management and media training, there is still one thing that, without fail, can expose the true nature of soccer players.

Winning.

As Didier Drogba stroked home the winning penalty against Bayern Munich in Saturday's Champions league final and the blue-clad parts of the stadium exploded, the studied cool of the young Chelsea millionaires went out the window.

Shirts came off. Spain's Fernando Torres wrapped a scarf around his head, looking for all the world like a British tourist trying to avoid the worst effects of the sun on the Costa Del Sol.

David Luiz donned a T-shirt and a blue-and-white stovepipe hat; curls flowing from under it, the effect was that of a soccer-playing Slash, the former Guns 'n Roses guitarist.

Others wrapped themselves in the flags of their nations thrown to them by the crowd.

For men whose images are usually so tightly controlled and exploited, it was a remarkable display of youthful exuberance, reminiscent of Cafu raising the World Cup with joyous messages scribbled on his Brazil shirt by his team-mates.

But perhaps most remarkable of all was the costume change of one John Terry.

Suspended for the final after a red card against Barcelona in the semis, Terry watched anxiously from the stands, stylishly clad in his club suit together with the rest of his banned team-mates.

But by the time the celebrations began, he was down on the pitch in full Chelsea kit.

Was this dedicated follower of fashion trying to fool us into thinking he had played?

Or was he trying to help the photographers he sometimes tries to avoid by not ruining the aesthetics of their pictures?

Either way, it was a bizarre change for a man not involved in the game.

By the time the press conferences came around, the air of cool was restored again and the players were back to giving stock answers to reporters questions.

But the photographers still have the evidence of the night that Chelsea won the Champions League, David Luiz's wild curls were tamed by a fluffy hat, and John Terry celebrated victory in a match kit that shone almost as brightly as the trophy itself. — Reuters

Batal Bersih 4.0 jika boleh tuntut kerugian

KUALA LUMPUR: Para peniaga Kuala Lumpur sedia mempertimbang membatalkan cadangan untuk mengadakan protes Bersih 4.0 di hadapan rumah Datuk S Ambiga jika mereka dapat menuntut ganti rugi.

Pengerusi Majlis Bertindak Peniaga-Peniaga Kuala Lumpur Datuk Jamal Md Yunos berkata mereka sedia membatalkannya sekiranya tahu kepada siapa mereka boleh menuntut kerugian yang didakwa dialami ketika perhimpunan Bersih 3.0 di Dataran Merdeka 28 April lalu.

"Sekiranya kami dimaklumkan mengenai pihak yang boleh kami tuntut kerugian tersebut sebelum pukul 4 petang esok, kami akan membatalkan hasrat berniaga di Jalan Setiakasih 1, Bukit Damansara," kata Jamal dalam satu sidang akhbar yang diadakan di Restoran Ikan Bakar Sekinchan miliknya itu.

Majlis tersebut bercadang untuk menganjur protes berniaga yang dinamakan Bersih 4.0 di sepanjang Jalan Setiakasih sebagai bantahan mereka terhadap pengerusi bersama Gabungan Pilihanraya Bersih dan Adil (Bersih).

Seramai 60 peniaga akan memprotes dari pukul 4.00 petang hingga 8.00 malam esok dan lusa.

Ketika ditanya samada mereka akan turut menyaman jawatankuasa bertindak seperti yang dibuat kerajaan hari ini, Jamal menolaknya kerana belum pasti mengenai pihak yang bertanggungjawab.

Buang masa


"Kemungkinan kami akan buat tuntutan pada pihak bertanggungjawab. Fail saman sekarang buang masa saja," kata Jamal yang mempunyai 18 cawangan kedai ikan bakar dan sebuah syarikat jualan kereta.

Jamal turut mengumumkan rancangan menghadiahkan kereta mewah untuk meningkatkan sokongan kepada mereka melalui laman sosial Facebook.

"Pengunjung restoran yang menjadi rakan Facebook ke 150,000 akan menerima sebuah kereta BMW 530 keluaran tahun 2005 yang bernilai RM220,000.

"Pengunjung yang ke 1 juta pula akan menerima Lamborghini Gallardo keluaran tahun 2009 bernilai RM1.2 juta," kata Jamal.

Menurutnya lagi, mereka yang berminat juga harus makan di kedai ikan bakarnya dan akan menerima diskaun sebanyak 30%.

Ketika ditanya samada pihaknya akan bertanggungjawab sekiranya berlaku kekecohan ketika protes, Jamal bersikap lepas tangan.

"Kami buka gerai untuk berniaga. Kalau orang ramai datang buat kecoh itu bukan masalah kami," kata Jamal.

Time Traveller


It all happened on the afternoon the 30th of August. It was a beautiful day and I was on my way home from a job in Färjestaden. When I got home, I found water on the kitchen floor. Somehow there was a leak. I got my tools and opened up the doors to the sink. And started to work. 

When I reached in to examine the pipes, they seemed to be further in than I remembered. I had to crawl inside the cabinet, and as I did so, I discovered that it just continued. So I kept on crawling further and further into the cabinet. In the end of the tunnel I saw a light, and when I got there, I realized I was in the future. I meet myself as 72 years old, the year was 2042. I did a lot of tests on him to see if he was really me. And the strange thing is that he knew everything about me. Where I hid my secret stuff when I was in first grade, and what the score was in the soccer match against Växjö Norra in the summer of 88.! He knew it all. 

We even had the same tattoo, although he's was a little faded. He told me some of the stuff that will happen, but not so much. And I promised not to tell anyone. I made a film with my mobile phone. Unfortunately the quality is not the best. But it's what I have got. Actually I don't care if people thinks I am a liar. I know I'm not. I met myself in the future, and I was fine. That's all I know. 

But if it happened to me it probably must have happened to someone else.

Ex-DCM eyes Tasik Gelugor seat

TASEK GELUGOR: Former Penang Deputy Chief Minister Mohd Shariff Omar plans to return to active politics and is hoping that Umno and Barisan Nasional will give him a chance by letting him contest in the coming general election.

He is eyeing the Tasek Gelugor parliamentary seat.

"I feel healthy and perhaps handsome still for politics," he told newsmen at a Perkasa function. "And Tasek Gelugor was my stronghold. I helped develop it for 20 years."

In the 2008 general election, Tasek Gelugor was one of the two parliamentary seats in Penang that BN managed to retain, the other being neighbouring Kepala Batas.

The current MP for Kepala Batas is Minister in the Prime Minister's Department Nor Mohamed Yakcob, who was an election debutant in 2008. There is speculation that he is quitting politics and will not contest in the coming election.

Shariff, 64, said he made way for Nor in 2008 on prime minister Abdullah Ahmad Badawi's request. Nor told him then that he would serve for only one term, he added.

After the 2008 polls, Shariff suffered another political blow when, as the incumbent in the contest for the Tasek Gelugor Umno chairmanship, he lost to Permatang Berangan assemblyman Shahbudin Yahaya. He had held the position for more than 20 years.

Penang Umno's deputy chairman, Musa Sheikh Fadzir, believes that Shahbudin would accept Shariff's candidature for the Tasek Gelugor seat.

"Shahbudin is a party man," Musa told FMT. "He will accept it."

However, he said Shariff's announcement surprised him. "I did not see it coming."

Shahbudin could not be reached for his comment.

Sungai Dua assemblyman Jasmin Mohamed believes Shariff is a winnable candidate for Tasek Gelugor because he has strong grassroots links there. It is his hometown.

Shariff was Permatang Berangan assemblyman and state executive councillor between 1982 and 1990.

He became a MP in 1990 and was appointed parliamentary secretary to the Agriculture Ministry. In 1995, he returned to Penang to take up his position as deputy chief minister. In 1999, he returned to Parliament and became a deputy minister.

Civil Suit against Ambiga and several members of the BERSIH 2.0 Steering Committee

This evening (23. May 2012), a civil suit by the government has been served on Dato' Ambiga, including eight more members of the BERSIH 2.0 Steering Committee an a former committee member. The government claims RM 122,000 for demages during Duduk Bantah.

S’gor mahu rampas hartanah pemilik rumah urut

SHAH ALAM: Kerajaan negeri Selangor akan mengambil tindakan tegas termasuk risiko merampas hartanah pemilik rumah urut jika membenarkan premis mereka terus digunakan untuk menjalankan perkhidmatan tersebut.

Menteri Besar Selangor, Tan Sri Abdul Khalid Ibrahim berkata tindakan merampas hartanah dan premis operasi rumah urut itu boleh dilaksanakan mengikut undang-undang sedia ada.

Beliau menegaskan tindakan berkenaan bukan sahaja ditanggung oleh pengendali perniagaan rumah urut malah pemilik premis rumah urut tersebut juga boleh dikenakan tindakan.

"Kita tegaskan jika mereka melanggar undang-undang bukan sahaja bisnes itu sahaja yang disita, malah bangunan, hartanah akan turut dirampas.

"Jadi risiko untuk menjalankan perniagaan ini mestilah di tangan semua pihak iaitu mereka yang menjalankan perniagaan dan yang memiliki premis tersebut," katanya pada sidang media selepas mesyuarat mingguan Exco di sini hari ini.

Abdul Khalid berkata, pertemuan akan diadakan pada minggu depan bersama pihak berkuasa tempatan (PBT) untuk membincangkan kaedah pencegahan rumah urut yang semakin berleluasa di Selangor.

Bagaimanapun, beliau menjelaskan kerajaan negeri menghadapi masalah membabitkan penguatkuasaan undang-undang sedia ada untuk membanteras berleluasanya premis haram ini.

"Isu besar yang dihadapi dalam pentadbiran kerajaan negeri ialah ruang pemisah antara polisi dan undang-undang dalam pelaksanaannya.

"Kedua-duanya perlu disatukan.Tak ada makna kalau kita buat polisi tapi ia tak dilaksanakan dengan baik," katanya.

Jumlah rumah urut yang semakin bertambah di Selangor membimbangkan banyak pihak terutama pertubuhan bukan kerajaan (NGO) yang mendakwa pusat-pusat urut tumbuh bagai cendawan sehingga merebak ke kawasan penempatan setinggan sejak kebelakangan ini.

Menurut mereka, di kawasan Pandan Indah sahaja, terdapat lebih 80 pusat urut, di Klang lebih 200 manakala berpuluh-puluh lagi di Kuchai Lama, Damansara dan Ampang Jaya.

Sementara itu, kerajaan negeri turut mempelawa Menteri Tenaga, Teknologi Hijau dan Air Datuk Seri Peter Chin Fah Kui dan pemimpin pembangkang negeri untuk melawat empangan air bagi membuktikan kadar rizab air berada di tahap yang selesa.

Beliau menjelaskan laporan terbaru oleh Lembaga Urus Air Selangor (Luas) semalam menunjukkan simpanan air mentah di Selangor pada bulan Mei 2012 adalah melebihi 100 peratus.

Dalam pada itu, kerajaan negeri akan menganjurkan Forum Air pada 12 Jun depan di Pusat Konvensyen Shah Alam untuk mengupas isu air di Selangor.

Sambil menyifatkan kumpulan itu sebagai "samsengan", A Samad mengaku malu dengan tindakan mereka kerana ia "bukan cara untuk mewaraskan demokrasi".

Bercakap dalam wawancara dengan Malaysiakini semalam, tokoh yang lebih dikenali sebagai Pak Samad menegaskan, serangan membaling batu hujung minggu lalu "bukan caranya dan mereka memilih cara lain" untuk menunjukkan bantahan mereka.

Pak Samad yang juga terkenal dengan novel Salina itu turut menyindir pihak yang melakukan "senaman punggung" dan peniaga yang mahu menjaja di hadapan rumah Ambiga esok dan lusa.

"Kita sudah 50 tahun merdeka dan budaya serta budi bahasa kita adalah punggung. Dan selepas itu guna samsengan cat rumah orang. (Apakah) itu budaya kita," katanya.

NONESelepas perhimpunan BERSIH 3.0, Majlis Bertindak Peniaga-peniaga Kuala Lumpur (MBPKL) dan Persatuan Veteran Tentera Melayu (PVTM), masing-masing mahu berniaga di depan rumah Ambiga dan melakukan senaman punggung di hadapan rumah Ambiga.

Ia dibuat sebagai menunjukkan bantahan kepada Ambiga yang juga seorang peguam terhadap penganjuran perhimpunan BERSIH 3.0 yang didakwa menjejaskan pendapatan peniaga dan merosakkan imej negara.

Tindakan mereka itu mengundang kemarahan dan bantahan pelbagai pihak termasuk Ketua Pemuda Umno Khairy Jamaluddin Abu Bakar.

Bersih won’t hesitate to sue DBKL, police

PETALING JAYA: Bersih 2.0 will not hesitate to take legal action against both Kuala Lumpur City Hall (DBKL) and the police should any untoward incident occur during the protests in front of the home of Bersih co-chairperson S Ambiga.

Bersih today sent two separate letters to the Inspector-General of Police Ismail Omar and City Mayor Ahmad Fuad Ismail voicing its concerns over the inaction of the authorities in dealing with these protesters who have been harassing Ambiga for the last two weeks.

"We are fully aware that [you] do not support the activities of Bersih 2.0 and was against Bersih 3.0 gathering…

"However, opposition to these activities cannot lead [you] to silently acknowledge and endorse the harassment and criminal intimidation being perpetrated here," the letter to Omar stated.

Both letters were signed by its co-chairperson, A Samad Said.

The letter to Omar added that Ambiga, like any other citizens, expects the police to ensure her safety.

Bersih said that it was deeply concerned over the failure of the police to take any "remedial or preventive" action as this may be deemed as endorsing such activities.

The series of protests outside Ambiga's residence do not show any signs of ceasing. Yesterday, Kuala Lumpur Petty Traders Action Council said that it was going go ahead with its "pasar malam" protest despite not getting permits from DBKL.

Ahmad Fuad said that if he were to give the green light to these 60 petty traders, there will no end to the protest.

He said that although it was all right to protest peacefully outside Ambiga's residence, he had to draw the line when it came to erecting stalls as it went against local by-laws.

Medical emergency

Earlier, the petty traders had written the words "Bersih 4″ in yellow paint on the road opposite her house in an symbolic attempted to sell that space as a "lot" for their night market.

On May 10, a group of burger sellers staged a protest in front of Ambiga's house by distributing 200 burgers. Malaysia Small and Medium Entrepreneurs Alliance (Ikhlas), the NGO which organised the protest, said that it was doing so because burger stall owners had suffered losses amounting to RM200,000 as a result of the rally..

Five days later, a group of 15 army veterans carried out butt flexing exercises facing her house.

Last week, Ambiga said that since people know where she lives, they have been constantly coming to her house and asking her for free burgers at her gate.

The disturbance caused to the residents in the neighbourhood was highlighted in Bersih's letter to the mayor today.

"Not only do these activities interfere with the free flow of traffic on the stretch of the road, they constitute either or both a health and safety hazard," the letter stated.

It added that the mayor should be concerned that people have no space for recreational activities and so have resorted to carrying our "butt exercises" in residential areas.

"We are also concerned that if any of these army veterans were to suffer a medical emergency [while doing their exercise outside Ambiga's home]… it may not be easy [for an ambulance] to locate them."

They urged Ahmad Fuad to take "immediate and strenuous action" against these "unauthorised and unlicensed" activities.

There was Hang Tuah then, now Hang Samseng...

During the glorious days of the Malacca sultanate, the legendary warrior Hang Tuah, leading his four other 'Hang' companions, stood out as a symbol of pride for the Malay kingdom.

But in modern Malacca,  'Hang Samseng' (gangster) have emerged, lamented Bersih co-chairperson A Samad Said, in reference to the violence targeting his colleague Ambiga Sreenevasan in Merlimau, Malacca, last Saturday.


"When! Ambiga was going to Merlimau... There were around 200 gangsters waiting there. Ambiga was invited by PAS to explain Bersih's struggle. This is democracy.


"But before she could arrive, our friends there called and asked her not to come because there already were gangsters in the land of Hang Tuah.

 
"Think about it, in the land of Hang Tuah, there is 'Hang Samseng'," added the national laureate, fondly known as Pak Samad.

While Hang Tuah is highly regarded in Malay culture, Pak Samad, 77, described the 'Hang Samseng' as an "embarrassment".


"I feel ashamed. This is not the way we strengthen our democracy, more than 50 years after we achieved independence... (they should) choose a better way" he said in an interview yesterday.


Last Saturday, a hi-tea event which was supposed to feature Ambiga was blocked by protesters and two DAP state assemblypersons, Khoo Poay Tiong and Tey Kok Kiew, were pelted with eggs and stones as they were leaving.


The incident
damaged several vehicles, including Tey's, which was left with severe denting, a punctured tyre and a broken side mirror.

Perkasa
and Umno have admitted to being part of the protest but have both denied that they were responsible for the subsequent violence.

 
'Is shaking butts our culture?'

The Merlimau violence was preceded b! y a seri es of bizarre protests outside Ambiga's house in Kuala Lumpur, including a 'butt exercise' which made the international news headlines.

This, Pak Samad sarcastically suggested, appears to have become a new culture.


"We have achieved independence for more than 50 years, and our culture and manners appear to be butts. And then they hired gangsters to paint outside people's house. Is this our culture?" he asked.


Last Tuesday, a group of army veterans shook their
posterior in front of Ambiga's house in protest against what they said was the smearing of the country's name by Ambiga, who they descirbed as an "enemy of the nation".

Five days before that, a group of traders set up stalls and served
free burgers, including beef burgers, outside the house of Ambiga, who is a Hindu and vegetarian.

On Monday, a group of traders painted
yellow lots for trading along the road outside Ambiga's house in preparation of a 'mini market' they plan to set up tomorrow and Friday.

The bustle outside her house comes as a series of counter-protests by traders claiming they had suffered losses during the Bersih 3.0 protest in Kuala Lumpur last month.- malaysiakini

NGO willing to provide security for Ambiga

PETALING JAYA: Admist reports that Bersih 3.0 chairperson S Ambiga's house will continue to be targeted by certain quarters, a NGO has offered to provide her with around-the-clock security.

Since the police and Kuala Lumpur City Hall (DBKL) were not offering her protection, Persatuan Kebajikan Sosial Gemilang Puchong president V Rameshwaran said he was prepared to mobilise his men for the task if requested.

Speaking to FMT, the businessman, who runs a security firm, said that his organisation consisted of 2,000 members.

"As a citizen, if she cannot be accorded proper protection by the police, then perhaps as fellow citizens it is our duty to give her that protection.

"I am both disturbed and disappointed by these different groups targeting her house. She is a highly respected person with international credentials," he added.

Rameshwaran said Ambiga was not a politician but a civic-minded individual who fought for the rights of all Malaysians and wanted to do something good for this nation.

"She was the former Bar Council president and a successful lawyer. She could have minded her own business but she chose to fight for all of our rights. And this is how you treat her?" he added.

Act of cowardice

Furthermore, the businessman said that it was an act of cowardice to harass a woman.

If these groups wanted to prove their might, he said they should have brought their supporters on April 28 to Kuala Lumpur to show who could muster a bigger crowd.

"They were sitting at home during the Bersih 3.0 rally but now after the rally, they are targetting a woman. They should be ashamed of themselves," he added.

Rameshvaran said the continued harassment of Ambiga was bound to backfire on Barisan Nasional, especially with regard to the non-Malay voters.

"The people are angry that the authorities are allowing these abuses to continue and letting it take a racial twist. The anger will be reflected in their votes," he added.

Ambiga's house in Bukit Damansara had been the target of several protests, namely by traders who claimed to have incurred massive losses during the rally.

Some traders are also planning to hold a night market outside her house tomorrow and Friday.

Slow economic growth hampering Najib’s plans

KUALA LUMPUR: Slow economic reform is stalling the Najib administration's aim to transform Malaysia into a high-income country by 2020, the World Bank said in its biannual East Asia and Pacific economic update.

Malaysia was told to hasten several key initiatives including dismantling its hefty subsidy regime and widen its tax base if Putrajaya is earnest in achieving its goal but noted politics was a major hurdle.

Prime Minister Najib Tun Razak was forced to delay spending cuts amid soaring cost of living as his ruling coalition faces its toughest election yet, but the bank pointed that Putrajaya must go beyond "quick wins" if it is to flesh out its 2020 ambition.

The bank also warned that Malaysia's export-oriented economy will likely be affected by the global recession, predicting a 4.6% growth and 5.1% next year.

Combined this with the snail-paced reform, the country's required target of a consistent annual 7.5% growth to reach a high-income nation status in eight years' time is in jeopardy.

The report also echoed the views of various opposition leaders who called on Najib to focus and precipitate key structural reforms needed to boost the economy.

ETP progress

But while detractors claim the premier's reform was heading nowhere, the bank said Najib's Economic Transformation Programme (ETP) has "registered notable progress".

"The challenge now is to go beyond quick wins and accelerate the implementation of more difficult – but critical – structural reforms that lie at the core of boosting the economy into high-income levels," it said, adding that putting reform in place could easily be accelerated.

Fear of a potential voter backlash stalled Najib's plan to implement the goods and services tax (GST). Analysts say the new tax scheme was key to broaden Malaysia's tight revenue stream. The unpopular plan for subsidy cuts was also delayed.

Political observers say the prime minister will first need a stronger mandate in the upcoming polls to carry on with the stringent economic measures.

Yesterday, Second Finance Minister Husni Hanadzlah conceded that it will be tough to meet the 5% to 6% growth projection from Budget 2012.

He said China's cooling growth, weak economic recovery from the US and a prolonged eurozone crisis dragged Malaysia's export sharply, while the World Bank said the ongoing risks to the global recovery constitute risks for Malaysian growth.

Anwar to contest in Nibong Tebal?

GEORGE TOWN: Several grassroots leaders have proposed to the party leadership to field Opposition Leader Anwar Ibrahim in the Nibong Tebal parliamentary constituency in the next general election.

In a move to strengthen PKR position in Penang, they want Anwar to seriously consider shifting from his traditional Permatang Pauh to the southern seat bordering Perak.

Nibong Tebal PKR divisional leaders are said to have "invited" Anwar to contest the parliamentary seat.

Permatang Pauh is widely considered as a safe PKR bastion.

Party grassroots members said if Anwar were to contest Nibong Tebal it would not damage PKR's prospects in Permatang Pauh, which comprises the state seats of Penanti, Permatang Pasir and Seberang Jaya.

With Pakatan Rakyat going for Putrajaya, party insiders said it was important for PKR to field strong personalities to contest hot seats, and Nibong Tebal is considered as one.

"We need a strong candidate to contest Nibong Tebal… Anwar could be the right man," a PKR source said.

Sources said Anwar has been discussing and listening to various views on the possible move.

"Anwar has not rejected the idea… it could be a last-minute decision," an insider said.

Nibong Tebal is considered a semi-urban mixed constituency comprising the state seats of Sungai Acheh, Sungai Bakap and Jawi.

In 2008, the seat had 47,540 registered voters with ethnic Malays making up 43.6%, Chinese 40.5%, Indians 15.9% and others 0.1%.

Anwar factor

Party insiders believe Anwar's move to Nibong Tebal would boost the party's chances to regain the seat, retain Sungai Bakap and win Sungai Acheh.

They also expect the Anwar factor to boost DAP's chances to retain the Jawi seat, which is being much coveted by MCA.

Ironically, if Anwar were to contest Nibong Tebal, he is returning to his birthplace, Sungai Bakap.

If the speculations were true, Penangites can expect an interesting "Battle of Nibong Tebal" between the PKR supremo and Umno state chief Zainal Abidin Osman.

Umno is expected to again field Zainal Abidin, who lost the same seat to then PKR's Tan Tee Beng in the 2008 general election.

Tan, who polled 20,210 votes to defeat Zainal, who garnered 17,123 votes, has since defected to become a Barisan Nasional-friendly independent MP.

PKR grassroots leaders felt Tan's defection could have some negative effect on Nibong Tebal constituents.

But they believe Anwar's candidacy can neutralise such sentiments.

Sungai Bakap assemblyman is PKR's Maktar Shapee while DAP's Tan Beng Huat is Jawi incumbent representative.

Maintaining the status quo

Umno's Mahmud Zakaria managed to win Sungai Acheh in 2008 with a slim 250 vote-margin win over PKR's Azhar Ahmad.

Pakatan has already decided to maintain the status quo on seat arrangement in Penang, with the ruling DAP contesting seven federal and 19 state seats, PKR four and 16 and PAS two and five, respectively.

Besides Permatang Pauh and Nibong Tebal on mainland Seberang Perai, PKR will contest Bayan Baru and Balik Pulau federal seats on the island.

Besides Sungai Acheh and Sungai Bakap, PKR will contest the state seats of Machang Bubok (Bukit Mertajam); Bukit Tengah and Bukit Tambun (Batu Kawan); Penanti and Seberang Jaya (Permatang Pauh); Teluk Air Tawar (Tasek Gelugor); Bertam and Pinang Tunggal (Kepala Batas) on the mainland.

On the island, the party will field candidates in Kebun Bunga (Bukit Bendera); Batu Uban, Pantai Jerejak and Batu Maung (Bayan Baru); Teluk Bahang and Pulau Betong (Balik Pulau).

PKR has already shortlisted candidates for its four federal and 16 state seats and a source said almost 90% of the candidates have been finalised.

Most incumbents are expected to be retained. But some changes, like shifting constituency, could happen.

For instance, Pantai Jerejak assemblyman Sim Tze Tzin may move to contest the Bayan Baru federal seat to allow the PKR divisional deputy chairman Mohd Rashid Hasnon to contest the state seat.

PKR's then state chairman Zahrain Md Hashim won Bayan Baru in 2008, only to defect two years later to become a BN-friendly independent MP.

‘BN’s clear and present danger’

KUALA LUMPUR: A divided Barisan Nasional may spell the end of Prime Minister's Najib Tun Razak reign in Putrajaya.

And this warning to the Barisan Nasional comes from non-other than Umno-owned Utusan Malaysia.

The paper quoting party leaders says sabotage is a very clear and present danger and could lead to the BN losing more seats than in 2008.

At the Umno's 66th anniversary two weeks ago, Najib put on a brave face and touched on the gathering as a show of support that the party is not divided and that they are ready to face the elections.

Some 60,000 members had congregated at the Bukit Jalil National Stadium here in the gathering which party sources said was meant as a "loyalty test" apart from propping up the party's machinery and mobilisation strength.

Najib joked that the display of unity gave him enough confidence to hold elections sooner than expected.

Threat real

But Abdul Aziz Rahman, the president of the former BN Lawmakers Council, said the threat of internal sabotages is real and the ruling coalition could see itself battered if the problem is not contained.

"This election is momentous time for BN. If party members are not united then we will see the black episode (of 2008) repeating itself.

"BN's victory will depend on the unity of all members and component party members," he was quoted by Utusan Malaysia today.

Internal power tussle was one of the major factors that led to the ruling coalition's loss of its customary two-thirds Parliamentary majority in the 12th general election. It also lost five states to the opposition.

Then premier Abdullah Ahmad Badawi's effort to consolidate his position by replacing majority of the candidates with his men, sidelining powerful "warlords" along the way, saw Umno members protesting by voting for the opposition.

Abdul Aziz said BN could see a similar recurrence where candidates left out by Najib may sabotage the ruling coalition's campaign .

Umno vice-president Ahmad Zahid Hamidi had warned yesterday that the prospect of a repeat is there.

BN may not only see a repeat but could also see more states falling into opposition hands, Zahid added. The Defence Minister also did not discount the possibility of losing federal power.

Meanwhile Umno veteran Aziz Shamsuddin told Utusan Malaysia that the party leadership must be quick to act and contain the division.

A repeat of 2008 will see Najib's future in Umno hanging by a thread, observers predict.

He is now facing stiff opposition to his economic liberalisation plans and political reforms from within his own party.

PETALING JAYA: Tokoh korporat terkemuka, Tan Sri Rozali Ismail tidak dicalonkan untuk mewakili Umno dalam pilihanraya umum ke 13.
Perkara ini disahkan oleh Ketua Umno Hulu Selangor, Datuk Mohamed Ideris Abu Bakar hari ini.

Umno  akan bertanding dua kerusi Dewan Undangan Negeri – Hulu Bernam dan Batang KaIi – kedua-duanya dimenangi dalam pilihanraya umum 2008.

Desas desus tersebar, Rozali, tauke Puncak Niaga Berhad yang menguruskan bekalan air Selangor akan bertanding di salah kerusi DUN berkenaan.

Kerusi Parlimen Hulu Selangor merupakan milik MIC.

Hantar 10 nama

"Kita telah menghantar 10 nama bagi setiap DUN dan tidak ada nama Rozali dalam senarai tersebut.

"Bagaimanapun, keputusan terakhir untuk menentukan calon dibuat oleh Perdana Menteri, Datuk Seri Najib Tun Razak yang juga Presiden Umno.

"Jadi kita tunggu saha siapa yang dipilih menjadi calon untuk DUN Hulu Bernam dan Batang Kali," tambah Mohamed Ideris.

Beliau juga mengakui kerusi Hulu Bernam dan Batang Kali merupakan kerusi yang paling selamat bagi BN dan Umno di Selangor.

Katanya, tidak ada unsur-unsur sabotaj yang dibuat ahli parti menjelang pilihanraya sejak dahulu lagi.

"Saya memberitahu mereka, supaya mengutamakan kepentingan parti (Umno dan BN. Kita mesti mengutamakan kepentingan parti dari individu.

"Sehingga ini saya tidak mendengar ada usaha kumpulan tertentu yang menentang kepimpinan parti," tambah Mohamed Ideris.

The recent proliferation of international schools in this country and their liberal enrolment of rich Malaysian students also make a mockery of the government's claim to implement a National Education Policy (specifying Malay as the main medium of instruction) for all Malaysians. Why does the English-language have priority over the mother tongue of Malaysians?

The Education Minister Tan Sri Muhyiddin Yassin maintains that his "hands are tied" over the demand by the community for an independent Chinese school in Kuantan "unless there is a change in the education policy or the Education Act." (The Star, 23.5.2012:12)

This statement by the Education Minister at least explains why, despite the constant claim by the government that they support mother tongue education, the number of Chinese and Tamil schools has been decreasing. The politics of education policy in Malaysia certainly flies in the face of logic and consistency.


We Had More Chinese and Tamil Schools in 1957

For the uninitiated, at Independence we had 1350 Chinese primary schools, more than 800 Tamil primary schools and 78 Chinese secondary schools. There were at least six Chinese secondary schools in Pahang then. Today, with our population doubled, there are only 1285 Chinese primary schools, 550 or so Tamil primary schools and 60 Malaysian Independent Chinese Secondary Schools (MICSS).

In fact when the Education Act 1961 was legislated, the number of Chinese secondary schools shrunk to just 14 because the rest had to give up their mother tongue education system since they could not survive without government aid. From the seventies, the number of MICSS grew steadily to sixty.

The most obvious question Malaysians might want to ask is, how did the education policy and Education Act 1961 allow the number of MICSS to grow to sixty between 1961 to 1980?

The next obvious question to ask is: how did the policy and the law suddenly insist that there cannot be one more MICSS once the sixtieth school had been built by the end of the seventies?

Obviously, the Education Minister has not thought carefully about the implications of his statement. If he values critical thinking among Malaysian students, these are the questions they would be likely to ask:


Which Education Policy?

When th e Education Minister refers to the education policy, we presume he is referring to the 1956 Razak Report which proposed: "the ultimate objective of educational policy…in which the national language is the main medium of instruction…whilst preserving and sustaining the growth of the language and culture of other communities living in the country."

Clearly, until the Education Act 1961 was legislated, this education policy (embodied in the 1957 Education Ordinance) allowed the 78 Chinese secondary schools to exist.

We all know that the law overrides government policy but the education policy the Education Minister is referring to – embodied in the Razak Report – did allow the state-run Chinese Secondary Schools to exist right up to 1961!

 
Which Education Act?

Of course, this is a rhetorical question. We all know the latest law in question is the 1996 Education Act. However, many Malaysians including lawyers are not aware of the nuances of the education law in this country.

Before the 1996 Education Act, the mother tongue lobby had protested against Section 21(2) of the 1961 Act which stipulated that the Minister of Education "may at any suitable time convert all national-type primary schools to national primary schools."

When the 1996 Education Act came in, as expected, Section 21(2) of the previous law was no longer there. However, under section 17.11 of the new law, ALL schools in the National Education System have to use Bahasa Malaysia as the main medium of instruction. (Note that under the 1961 Act, only primary schools were affected.)

There were only two exceptions to this provision: (i) schools which are given exemption by the Minister; and (2) the "national-type schools" to be established in future under section 28.

The National Education System covers all educational institutions, viz. government, government-aided as well as private educational institutions. (s.16) It pract! ically c omprises all types of schools providing pre-school, primary, secondary, post-secondary and higher education, but not expatriate schools. (s.15)


Double Standards over English-language Schools

The recent proliferation of international schools in this country and their liberal enrolment of rich Malaysian students also make a mockery of the government's claim to implement a National Education Policy (specifying Malay as the main medium of instruction) for all Malaysians. Why does the English-language have priority over the mother tongue of Malaysians? If the government can allow hundreds of institutions in the country to use the English language, what is the problem with allowing one more MICSS school in which BM and English are compulsory subjects?


What Happened to Reform?

Of late, the government under Prime Minister Najib has been appealing to the people to believe in their determination to reform the country. Now if they are committed to support mother tongue education, why cannot the policy and the law be amended to allow the free development of mother tongue education? If laws relating to national security can be changed, why cannot educational laws be changed?


The Contributions of MICSS to National development

The 60 MICSS have been surviving all these years through the support of the community which subsidizes their tuition fees. Although the Unified Examination Certificate (UEC) is recognized round the world, our own government still refuses to recognize it.

Despite being treated like step children, graduates from the MICSS have been contributing to Malaysia's development and growth. The inventor of the thumb-drive is a product of the MICSS and he has since come back to invest in this country. The Chinese community has been paying double taxation while also nurturing these 60 schools since they have been forced to be self-financing.

Certain states, such as Pahang need at! least o ne MICSS or their students have to travel to other states to study at other MICSS schools.

At this day and age, while the country is talking about educational reform and support for mother tongue education, surely ONE independent school in Kuantan is not too much to ask?

A Far-Sighted and Fair Education Policy

For the 13th general election, let us make this demand on all political parties and candidates:

1. Reform the national education system to promote quality holistic education, equal opportunities, social justice, creativity, critical thinking as well as scientific and technological knowledge required for research & development and vocational skills;

2. Abolish discrimination on the basis of ethnicity, religion, age, gender or creed relating to entry into educational institutions;

3. Uphold the spirit of the Education Ordinance 1957 by supporting mother tongue education, building Chinese and Tamil schools in areas where they are needed, ensuring proportionate financial support and training of adequate teachers for these schools;

4. Recognise the Unified Examination Certificate and provide financial support for the non-profit mother tongue secondary schools so that the students can enjoy free education as in other secondary schools;

5. Promote the preservation and development of the indigenous peoples' mother tongue language and education.

For the past few days, we can see in news that the traders have mention that they will be coming to open their stall "pasar malam" in front of Ambiga house on 24th and 25th May 2012. They mention in their PC that they will be opening their stall from 330pm until 8.00pm. Therefore now, we the BERSIH 2.0 secretariat hopes that all of you may come forward and support Ambiga tomorrow as to show the traders that Ambiga is not alone in facing them. PENGERANG INTEGRATED PETROCHEMICAL PROJECT, JOHOR-ANOTHER FOREIGN EIA FAILED PROJECT MAKES ITS WAY TO MALAYSIA?

Whenever pro-BUMNO bloggers and children associated with a certain Maha Firaun wax lyrical about $ 62 billion Oil&Gas projects rising up to a stupendous $ 170 billion in investments and 40,000 local jobs, you always get a creepy feeling. The blood chills and the atmosphere gets very cloudy. You know there's got to be a catch somewhere.

But to get an independent view and a broader picture of what has happened so far, we need to go elsewhere, to the real world, where "clean" projects like Lynas are stripped bare to their naked essentials so we can make a proper and fair judgement.

LSG's main concerns are:

1. This was a project originally REJECTED by the Government of Taiwan because it failed the Environment Impact Assessment (EIS) test in 2008! In 2011, President MaYing-jeou of Taiwan withdrew his support for the project. So, why is our Government rushing in where angels fear to tread?

2. The project was rejected in Taiwan because it would have consumed 400,000 tons of water per day, thus affecting wetlands, land and waters earmarked for food production.

3. To quote LSG of MI, "In addition, it was estimated that 339 to 565 people would die of cardiovascular diseases and lung cancer, while patients of respiratory diseases would also increase due to the PM2.5 pollutants released into the air."

4. 20,000 jobs would have been created in Taiwan, but the social costs would have escalated to NT100 billion EVERY YEAR in Taiwan!!!!!!!

Expert and public opinion were consulted, and research conducted for 6 years before the Taiwan Government decided to say no.

Now, let's fast forward to the truly Asia fascia world of Malaysia! , where transparency and accountability are often, er, temporarily suspended, of course, in the genuine interest of our fellow citizens, for the sake of expediency.

1. Does anyone recall experts and public opinion being gauged on the pros and cons of this project or its location in Pengerang, Johor?

2. Is anyone aware of any EIA Report commissioned, and if so, what it's findings were? What are the annually projected social costs vs commercial benefits in ringgit billions?

3. What will be the short term and long term effects on the livelihoods of farmers and fishermen in Pengerang, Johor and on wetlands and nearby coastal areas and seas? Where will all the toxic waste from the project be stored, dumped or pumped out to?

4. Why is this project, like bedevilled Lynas (12 years), given Pioneer (Tax Free) Status of 10 years? What exactly are the respective role of Petronas, Diolog Plc, Taiwan party and the Johor State Government in this mega project?

5. Who sold the land (22,500 acres) to whom at what valuation, if any? Has Johor State or the Federal Government and/or Ministers issued "letters of support" which can be misconstrued (by mysterious bodholders) as cast iron GUARANTEES? If so, for how much? We don't want another $ 12.5 billion ringgit fiasco as per the Port Kelang Free Trade Zone to erupt in our face, do we?

6. Most importantly, who will be left carrying the baby if the project is fucked and far away from home or up the shit creek without a paddle or left with an unwanted bunny in the oven or..............(fill in the blanks for your favourite expression for the Malaysian taxpayer).

This seems to be the modus operandi of BUMNO/BN. Sign the directly negotiated contract and incur billions in start-up costs. Pollution, cancer, lung-related diseases? Toxic chemicals and effluents? Belakang Kira (We'll deal with it later)!

The devil is always in the details, which is perhaps one reason why the details are always classied under "Official Secrets" in 1Malaysia?

Unique approach offers addicts second chance

There is something wonderful happening in Kuala Lumpur. For a city some view as detached, dispassionate and demanding, the little clinic nestled discreetly in the confines of the Ar-Rahman Mosque in Universiti Malaya proves otherwise.

Billed as the world's first drug clinic in a mosque, the endeavor is headed by Dr Rusdi Abdul Rashid who is also the chief coordinator of Centre for Addiction Sciences in University of Malaya (Umcas).

According to Rusdi, the idea of the clinic germinated from Prof Dr Mohamad Hussain Habil of UM's Department of Psychological Medicine.

Mohamad, who is now Umcas' programme director, was at the time looking for an effective and compassionate solution to help addicts.

And thus Umcas was born. Umcas is perhaps one of the better examples of how faith and science can work cohesively together.

Incidentally, the clinic is recognized by the World Health Organization (WHO).

In a country with two separate codes of law, the lines of justice are more often than not blurred.

Rusdi said that it was because of this reason that setting up the clinic within the confines of the mosque was something of a challenge.

He said one of the challenges was the fact that several mosque-goers themselves found it disconcerting that 'drug addicts' walked freely in their midst.

"When we first set up the clinic two years ago, we decided to do it quietly because we didn't know how the various religious authorities would respond to it.

"We invited Jakim, Jawi and a few other Islamic organisations and we had three meetings together. When they saw the intention and the way in which the treatment would be carried out, we received their support, especially after they were convinced that what were trying to do was in accordance to faith tenets," said Rusdi.

Methadone therapy

The Ar-Rahman Mosque clinic provides methadone, a legalised synthetic analgesic to substitute morphine and heroine used to treat addiction, for drug addicts seeking help.

Rusdi admitted that methadone is frowned upon by many who do not understand understand its effectiveness.

"We always explain that methadone is not an addictive medication. It's used to help the recovering addict get through what is already a challenging time by helping to stabilise their moods and behaviour so they can function like regular people on a daily basis," he explained.

Among those who shun methadone are doctors who choose to help heroin addicts rid the habit by giving them milder replacement drugs.

Although the treatment Methadone Drug Substitution Therapy – was approved by the government in 2003, many of these doctors view methadone as supporting the problem rather than helping the addicts.

The treatment, which suppresses the craving for the "high" found in heroin, also helps to control the spread of IUV/AlDS, hepatitis and other diseases through needle sharing.

In a 2009 Bernama report, Mohamad said that doctors running private clinics expressed concern over people's perception over frequent visits by drug addicts seeking methadone therapy at their clinics.

He added that the public were not aware that drug addicts were actually seeking methadone therapy to overcome their heroin addiction.

"They (the public) are not aware of methadone's function and the therapy provided by private clinics to help kick drug addiction.

"They instead report the constant visit of drug addicts to politicians and police. The police then raided a number of clinics based on such reports and this has caused hardship to both the clinics and drug addicts who wished to kick the habit," Mohamad reportedly said.

Higher success rate

According to Rusdi, the success rate of the methadone treatment has been very reassuring.

"There is a 90% retention rate after one year of treatment and after two years, it stands at 80%.

"Compare this to Pusat Serenti which has a 10% retention rate and I believe we have some something very good coming out of this programme," added Rusdi.

He also shared that the addicts who come for treatment at the mosque are very well-behaved, calmer and more respectful compared to other available centres.

This makes it easy for the staff administering the medication and Rusdi strongly believes that integrating spiritual and medical elements make for a better longer lasting outcome.

"After all it's about getting the addicts weaned off the drugs and on to independence from it," he said.

There are currently about 50 patients who come to the clinic for methadone treatment and some of the newer patients are required to consume a dose of the pink liquid in front of the person administering it.

Rusdi said that the Health Ministry has been supporting these efforts by way of supplying the methadone for free.

This helps greatly in keeping costs down – even as the clinic looks to expand.

Operational costs are kept at a bare minimum with the doctors being paid RM50 an hour compared to the RM80 minimal paid at private clinics.

Plan to expand

The Ar-Rahman Mosque clinic which cost RM100,000 to set up, also retains the services of a clinic assistant who receives a RM1,000 montly stipend.

"We would like to expand this treatment service to other mosques and so far the Masjid Wilayah, the mosques in Section 14 Petaling Jaya and one other in Taman Datuk Harun have expressed their interests," he disclosed.

In the next three years, Umcas plans to develop similar clinics in 6,000 mosques around Malaysia.

Malaysia currently has more than 350,000 drug addicts.

There are also other services that the hopeful Rusdi would like to make readily available to the patients.

Counseling is high on the list of priorities.

He said the National Drug Agency has offered to assist with counseling services but that didn't pan out as planned as they claimed a lack of resources.

"The Malaysian AIDS Council has been very helpful in getting our efforts out to the media and for that, we are grateful.

"We would also like to begin a mobile Methadone service and have put out a request for vans to be donated.

"We're waiting for this to transpire. We hope that it will be soon because there are so many people who could be getting back on the right track as they rightly deserve – a second chance at life."
