Perbicaraan kes Kong Choy ditangguh 31 Oktober

KUALA LUMPUR: Perbicaraan kes tipu bekas Menteri Pengangkutan Tan Sri Chan Kong Choy berkaitan skandal Zon Bebas Pelabuhan Klang (PKFZ) di Mahkamah Tinggi di sini ditangguhkan ke 31 Oktober depan selepas pihak pendakwaan memohon penangguhan.

Timbalan Pendakwa Raya Datuk Nordin Hassan memberitahu mahkamah bahawa pejabat peguam Negara masih belum membuat keputusan mengenai representasi pihak pembelaan dan memerlukan masa yang lebih panjang untuk membuat keputusan muktamad berhubung permohonan tersebut.

Hakim Datuk Zamani Abdul Rahim, yang juga hakim Mahkamah Tinggi Pulau Pinang yang ditugaskan mengendalikan perbicaraan kes itu berkata mengikut rekod mahkamah, ini merupakan permohonan penangguhan kali ketiga.

"Dengan ini, mahkamah menetapkan tarikh 31 Oktober sebagai tarikh terakhir. Selepas ini, saya tetap akan menjalankan perbicaraan sekiranya keputusan representasi yang dibuat tidak memihak kepada pihak pembelaan," katanya.

Zamani juga dengan sinis berkata beliau tidak mahu sesiapa mempunyai tanggapan bahawa beliau 'makan angin' setiap kali hadir di mahkamah Kuala Lumpur berikutan terpaksa menangguh perbicaraan tersebut.

Sembunyi fakta

Mahkamah juga menetapkan tarikh yang sama untuk mendengar permohonan pihak pembelaan supaya beliau menarik diri daripada mendengar perbicaraan kes itu, dan satu lagi permohonan Chan supaya salah seorang daripada tiga hakim Mahkamah Tinggi Jenayah Kuala Lumpur untuk mendengar kes berkenaan.

Chan dihadapkan ke mahkamah pada 28 Feb 2011 terhadap tiga pertuduhan menipu bekas Perdana Menteri Tun Abdullah Ahmad Badawi dengan memperdayakan Abdullah bagi meluluskan Kuala Dimensi Sdn Bhd (KDSB) sebagai pemaju siap guna untuk menjalankan pembangunan projek hab penghantaran di Zon Bebas Pulau Indah dan kerja-kerja pengubahsuaian di tapak PKFZ antara 2004 dan 2006 bernilai RM1.9 bilion.

Chan, 57, didakwa dengan curangnya menyembunyikan fakta pembiayaan kos pembangunan akan dibiayai melalui bon oleh KDSB melalui Transshipment Megahub Berhad dengan sokongannya sebagai menteri pengangkutan.

Bekas menteri itu dituduh melakukan kesalahan itu di tingkat empat blok utama di pejabat Perdana Menteri di bangunan Perdana Putra, Putrajaya.

Chan boleh dihukum penjara lima tahun atau denda atau kedua-duanya bagi setiap tiga pertuduhan mengikut Seksyen 417 Kanun Keseksaan, jika sabit kesalahan.

Should the people allow BN to recapture Selangor?

Why is Selangor so darn important to BN? These guys are sparing no effort in trying to recapture the state. It is as if BN has lost their most important marbles and trying very hard to get them back. Why can't BN maintained their focus and strengthen their presence in other states? There are only 22 Parliamentary seats in Selangor and that is a small fraction of the total number of parliamentary seats in Malaysia (222). Is it about servicing the people? Based on my observation, perhaps in the last 4 years Selangor was extremely well served by the politicians. They have become the center of attraction and have been rewarded by a lot of goodies. Therefore I would say perhaps servicing the people is the real reasons. Could it be that UMNO has invested heavily in Selangor and worried that they could no longer hold these investment under shroud for long? Could it be that UMNO and BN only see Selangor as their milking cow?

In my humble opinion, for the people to continue to enjoy the benefits that they are getting now, we must maintain this balance of power. We must keep PR in Selangor. Only then we, the people become important to the politicians. Only then we will continue to be showered with attention. Returning Selangor back to BN will not help the people. It will only allow BN to strengthen its position and will allow UMNO to clean its investment. What are these investments? People can speculate at this stage as everything is under the veil. I suspect water business, Telco structures, Parking business are some of the UMNO investment in Selangor. However I must amplify the fact that this is my suspicion only.

In the case of parking business, it is tightly bound in legal agreement that the present SSG is unable to break them. In the case of water business, it simply does not make sense why the FG does not want to cooperate with SSG. Instead we see that FG had bailed out PN with soft loans. Why is that the FG is bent not allowing SSG from controlling the water distribution business in Selangor?  What will happen if they chose to allow the SSG water deal to go through and let TR get burned in the process? What secrets are TR keeping that UMNO is giving priority to one-man business and not the entire Selangor population? As for the Rakyat, I believe BN need to put in their mandate clearly on the water rates issue. They have been silent on this subject. I am more keen to know if they are planning to raise the water rates if they are back in power? For those who has forgotten, the SSG manage to have a higher state reserves and give the people RM11.50 discount on their water bill.

PKR trio in court tomorrow over Bersih 3.0

PETALING JAYA: PKR de facto leader Anwar Ibrahim and his deputy Azmin Ali have been summoned to the Kuala Lumpur Court Complex at Jalan Duta tomorrow morning where they are expected to be charged over their participation at the Bersih rally on April 28.

Azmin's special officer Hilman Idhan said that police have handed over to him a writ of summons asking his boss to attend court over two criminal charges.

According to documents, Azmin has been informed that he would be facing one charge under the newly gazetted Peaceful Assembly Act 2012 for participating in a "street protest" and another for going against an order by a public servant.

In the first document, Azmin is alleged to have participated in a street protest, between 2.30pm to 3pm along Jalan Tun Perak, on April 28, 2012 that went against a court order given out by the magistrate court under Section 98 of the Criminal Procedure Code.

The court order, which was given out on April 27 by magistrate Zaki Asyraf Zubir, prohibited any gathering at Dataran Merdeka– including the land bordered by Jalan Sultan Hishamuddin, Jalan Raja, and Jalan Kelab any time between April 28 to May 1.

The charge falls under Section 4(2)(c) of the Peaceful Assembly Act 2012 which prohibits organising or participation in a street protests. If convicted under this section, Azmin could be fined up to RM10,000.

The second document stated that Azmin, together with five others still at large, have abetted with R Tangam, G Rajesh Kumar, Farhan Ibrahim @ Alias to breach the court order.

The second charge comes under Section 188 of the Penal Code, for "disabodience to an order duly promulgated by a public servant" and is read together with Section 109 and Section 34 of the Penal Code for abetting.

If convicted under this charge, Azmin could face up to six months prison or fined RM2,000 or both.

A PKR source said that Anwar would face similar charges with Azmin.

Chegubard summoned as well

Meanwhile, Rembau PKR division chief Badrul Hisham Shaharin, or better known as Chegubard, also confirmed that he has received papers asking him to turn up in court tomorrow.

"The first charge is under the Peaceful Assembly Act and the second is Section 188 of the Penal Code," he told FMT.

Commenting on the matter, Chegubard said he would attend court and follow due process of the law, but said this would not divert him to fight for Bersih's cause, which is for electoral reforms.

"This is yet another form of harassment to divert us from the real issues, trying to slow us down. This is merely a panic response from the government, who have made use of the police as their
tools," he said.

When asked about eye-witness accounts alleging that he had called for protesters to charge into Dataran Merdeka, Chegubard said they were untrue.

"The videos are clear. Anwar was asking us to go back to Jalan Tunku Abdul Rahman. I had then asked people to be calm and we were asking them to move towards the right. The truck which we used to stand on was already going to the right," he said.

The police, when contacted, confirmed that only these three PKR leaders had been summoned to appear tomorrow.

Peningkatan denggi di Selangor bukan kerana sampah

PETALING JAYA: Kerajaan Selangor mendakwa sampah bukan punca utama peningkatan kes denggi sebaliknya berpunca tapak perumahan terbengkalai, rumah kosong kawasan sekolah dan pejabat serta premis kerajaan di negeri itu.

Exco kerajaan negeri, Dr Xavier Jayakumar dalam kenyataan meda berkata, isu pungutan sampah telah berjaya ditangani oleh Pihak Berkuasa Tempatan (PBT) dengan berkesan sejak beberapa bulan kebelakangan ini.

Beliau menuduh isu itu diperbesarkan dan seterusnya diputarbelitkan oleh media perdana pro Umno/BN saban hari.

Menteri Kesihatan, Datuk Seri Dr Liow  Tiong Lai dilaporkan sebagai berkata, punca utama peningkatan kes denggi di Selangor disebabkan oleh pungutan sampah yang tidak mengikut jadual ditetapkan.

"Kerajaan Selangor merasa kesal apabila Dr Liow menuding jari kepada kerajaan negeri sedangkan Kementerian Kesihatan / Kerajaan Persekutuan sendiri telah gagal menurun peruntukan dana menyediakan peralatan dan  tenaga kerja tambahan.

"Kerajaan negeri melalui PBT dengan kerjasama Jabatan Kesihatan Negeri dan Daerah telah bersungguh-sungguh menjalankan aktiviti dan program-program pembasmian denggi di seluruh 12 PBT di Negeri Selangor," kata beliau.

Bercakap kosong

Dr Xavier menyelar kenyataan Dr Liow kerana memberikan kenyataan yang mengelirukan dan berbau politik itu.
'Sampling' di hotspot tersebut jelas menunjukkan bahawa ianya tiada kena mengena dengan isu pungutan sampah seperti yang dibangkitkan oleh Dr Liow.

"Kita sarankan  beliau agar bersikap lebih professional dan janganlah terikut-ikut perangai buruk pemimpin Umno/BN yang membangkitkan pelbagai isu sejak kebelakangan ini untuk memburuk-buruk pentadbiran Kerajaan Pakatan.

"Harus diingat bahawa pejabat Dr Liow  sendiri iaitu Kementerian Kesihatan Malaysia terletak di Putrajaya dan Putrajaya sendiri adalah antara kawasan panas wabak (hotspot) tertinggi kes pembiakan nyamuk denggi," tegasnya.

Dr Xavier mencabar Menteri Kesihatan itu padang dan menunjukkan kepada saya di mana longgokan sampah di bawah selian PBT setempat yang menjadi lokaliti 'hotspot' kes denggi tersebut.

Kegagalan beliau berbuat demikian akan mengesahkan kepada umum bahawa beliau hanyalah bercakap kosong dan isu yang sedang hangat dibangkitkan adalah merupakan propaganda politik.

Votes for aid: What about non-Malay businesses?

PETALING JAYA: Chinese and Indian businessmen are wagging their tongues over a Malay business organisation's offer of votes to Barisan Nasional in return for capital grants.

They wonder how the government would react if a non-bumiputera organisation were audacious enough to offer a similar deal. They note that there has been no report of the government accepting or rejecting the offer from the Bumiputera Manufacturers and Service Industry Association, made in a speech last Thursday by its president, Abdul Rahim Abu Bakar.

"Of course we wish that the government would provide support to Small and Medium Enterprises (SMEs) and Small and Medium Industries (SMIs) without regarding issues like race," said Leong Kai Hin, who sits in the national council of the Associated Chinese Chambers of Commerce and Industry of Malaysia (ACCCIM), which represents close to 30,000 businessmen.

He told FMT that ACCCIM was not objecting to the Bumiputera association's offer and refused to pass judgment on whether it was appropriate.

"As businessmen, we try not to get into all these debates," he said. "We can't make things turn racial, but we (Chinese businesses) simply ask that we are also given this opportunity to dialogue with the state and federal governments. Regardless of race, we all need funds for growth."

The Malaysian Indian Business Association (MIBA) said it would be a "waste of time" for Indian businesses to seek financial support from the government.

"MIBA doesn't want to provoke or offend certain quarters, but we feel that the culture of pleading for government aid is just wrong," MIBA president P Sivakumar said. "Businesses should not be given short cuts, but we should have in place policies to really address matters."

MIBA's membership consists of 700 small and medium businesses.

Sivakumar said the government should not spoon feed businesses with handouts or provide them with shortcuts, but should provide opportunities to entrepreneurs willing to work hard and take risks.

"Those who want to take risks should be given ample chances," he said, adding that he disapproved of demands for money "just because an election is coming".

Real policy needed

He said Malay businesses should have little to complain because "most of the time, they get things on a silver platter".

"We Indians have always been pleading. We ask and ask and we're not given. They (Malays) are given even if they don't ask."

Sivakumar said government aid for Indian businessmen would require political intervention most of the time and would often be poorly channelled.

"Usually it is through agencies that are originally for Bumiputera needs, but are forced to open up a little for Indian businesses after political parties get involved. And, usually, it is channelled to sources that are not even really involved in business," he said.

If Indian businessmen were successful, Sivakumar said, it would be through their own efforts.

He called for a "real policy" to help the Indians.

"Everything in this country is based on appeals by organisations," he said. "There is not a policy to restructure the Indian community based on their needs. Where is the sincerity of the government?

"Now we have Teraju and Ekuinas, but these don't help the Indians. Yes, we have Tekun, but it was only after 20 years of its existence, in 2008, that it began to give to Indians. But that's a good start."

Attempts to contact the Malaysian Associated Indian Chambers of Commerce and Industry were unsuccessful.

Abdul Rahim offered his deal to BN at his association's annual general meeting, which Deputy Prime Minister Muhyiddin Yassin attended.

He said many of the association's 1,200-odd members were struggling to grow and needed a total amount exceeding RM25 million.

He assured BN that his group was not "taking advantage of the general election (being) around the corner".

"But we would like to take this opportunity," he said. "If we don't do it now, then when can we? You have our votes. Who else will support you if not the Malays?"

Malaysia-Australia Free Trade Agreement (MAFTA): Malaysia's Democracy Sacrificed for Free Trade?

Tomorrow, 22 May 2012, the Malaysia-Australia Free Trade Agreement (MAFTA) will be signed after 7 years of closed door intermittent negotiations.

In those 7 years, the vast majority of Malaysian citizens have not been included as stakeholders – especially in Parliament – on the terms of this 21-chapter agreement.

This unfortunate exclusion from discussions, debates or any other form of participation let alone the entire process of obtaining a Parliamentary ratification denies the public their right to oversight and scrutiny of international treaties and agreements, be they bilateral or multilateral, which could affect national interests and sovereignty. Although the Government is allowed to enter into international agreements and treaties without having to obtain Parliament's approval, the signing of this bilateral MAFTA is evidence of the Barisan Nasional Government's penchant for unilateral actions without seeking public opinion, or being attentive to their concerns and sentiments.

While we in KEADILAN support any FTAs if all stakeholders are involved in the process, alongside with Parliamentary review and ratification, all FTAs nevertheless must be premised on "fair trade" principles without compromising the socio-economic sphere, environment, cultural domain, labour rights, public safety and national security.

KEADILAN is particularly concerned by the increasingly growing trend of transfer of potentially environmentally hazardous industries to Malaysia from countries with more stringent environmental standards.

MAFTA, shrouded in secrecy and dogged by a lack of transparency and full disclosure, will certainly bring to the fore the Lynas controversy. The Lynas Advanced Materials Plant (LAMP) in Gebeng, Pahang, scheduled to commence operations in the 2nd quarter of 2012, will import raw rare earth materials from Western Australia to be processed in this refining facility. KEADILAN demands a conclusive answer to the question of whether Australia, under MAFTA, will accept the export of waste and by-products as a result of processed rare earth materials from LAMP which can be designated as a "trade product".

KEADILAN also demands to know whether the Australian Government, to comply with the anti-corruption rules under MAFTA, will retroactively require Lynas to disclose if there were bribes, kickbacks or any other forms of corruption in obtaining the Malaysian Government's approval to set up LAMP in Malaysia.

In the same vein, KEADILAN asks if Australia would demand Malaysia to:
- guarantee a free press to ensure timely and accurate information to facilitate free trade;
- guarantee free and fair elections to ensure that the Australian Government deals with a legitimate Malaysian Government in enforcing all the terms and conditions of MAFTA;
- protect labour rights such as the right to form trade unions, which is almost non-existent at present in Malaysia, as one of the pre-conditions for Australia to accept goods and services from Malaysia.

KEADILAN insists on both Governments to urgently address the deep-rooted negative perception with the recent controversies vis-a-vis the LAMP project as well as the failed 'Malaysia Solution' asylum seeker immigration initiative as cases in point.

Finally, KEADILAN strongly believes in and demands that the legislative role and democratic rights of the Malaysian Parliament to review and ratify all treaties and subsequent legislative amendments needed to comply with such treaties be restored with immediate effect. History has shown in many occasions how the executive branch has failed miserably to protect our national interest and sovereignty for instance the territorial dispute cases of Pulau Batu Putih (with Singapore) and Block L and M (with Brunei), the Water Agreement (with Singapore) and the Singapore Tanjong Pagar KTM land deal (with Singapore).

KEADILAN deeply regrets that Australia has clearly missed a golden opportunity to make these Parliamentary and democratic reforms as one of moral prerequisites before even going to the negotiation table with Malaysia on MAFTA. Wouldn't that have been a truly fair trade deal for the citizens of both countries – Democracy for Free Trade?

‘Jangan campur tangan keputusan Suruhanjaya Sekuriti’

KUALA LUMPUR: Persatuan Anak Peneroka Felda Kebangsaan (Anak) memberi amaran kepada kerajaan supaya tidak mencampuri urusan Suruhanjaya Sekuriti (SC) mengendalikan isu Felda Global Ventures (FGV) Holdings Berhad.

Presiden Anak Mazlan Aliman mendakwa pihaknya mendapat maklumat wujudnya tangan ghaib yang cuba mempengaruhi keputusan SC berkenaan borang pinjaman pembelian saham FGV oleh tujuh bank yang terlibat.

Ini berikutan tindakan Anak dan 20 peneroka lain yang menghantar memorandum kepada SC 10 Mei lalu memohon supaya borang pinjaman pembelian saham yang ditawarkan tujuh bank itu ditarik serta-merta.

Mazlan berkata, pihaknya yakin SC mampu membuat keputusan yang adil kerana jelas wujudnya unsur penyelewengan dalam proses menandatangi borang pinjaman pembelian saham.

Antaranya borang perjanjian yang ditulis dan bahasa Inggeris selain tidak menyatakan nilai serta jumlah saham yang ditawarkan.

Ini berikutan maklum balas yang diberikan SC kepada pengadu melalui surat bertarikh 11 Mei lalu.

"SC telah memberikan respon dengan memanjangkan hal ini kepada Pengarah jabatan Konsumer dan Amalan Pasaran Bank Negara Malaysia untuk perhatian dan tindakan sewajarnya," katanya dalam sidang media di Pejabat Agung PAS di sini hari ini.

Saman Najib

Sementara itu, beliau sekali lagi menegaskan tidak teragak-agak  mengenakan tindakan saman terhadap Perdana Menteri Datuk Seri Najib Razak sekiranya gagal memohon maaf secara terbuka kepada peneroka.

Katanya, peguamnya akan menghantar satu notis tuduhan supaya Najib menarik balik perkataan 'haram jadah' dan memohon maaf secara terbuka.

"Kita tunggu Najib pulang dari Amerika Syarikat.

"Kalau tiada respon selepas tujuh hari notis dikemukakan kita akan saman," tegasnya.

Beliau turut menyatakan kekesalannya kerana perkataan 'haram jadah' yang dilemparkan Najib memberi impak negatif kepada pemimpin BN lain dan peneroka.

Katanya, ini dibuktikan apabila beberapa pemimpin BN lain turut mencemuh peneroka yang menentang penyenaraian FGV namun dalam masa yang sama mengambil 'durian runtuh' yang ditawarkan kerajaan.

Should the people allow BN to recapture Selangor?

Why is Selangor so darn important to BN? These guys are sparing no effort in trying to recapture the state. It is as if BN has lost their most important marbles and trying very hard to get them back. Why can't BN maintained their focus and strengthen their presence in other states? There are only 22 Parliamentary seats in Selangor and that is a small fraction of the total number of parliamentary seats in Malaysia (222). Is it about servicing the people? Based on my observation, perhaps in the last 4 years Selangor was extremely well served by the politicians. They have become the center of attraction and have been rewarded by a lot of goodies. Therefore I would say perhaps servicing the people is the real reasons. Could it be that UMNO has invested heavily in Selangor and worried that they could no longer hold these investment under shroud for long? Could it be that UMNO and BN only see Selangor as their milking cow?

In my humble opinion, for the people to continue to enjoy the benefits that they are getting now, we must maintain this balance of power. We must keep PR in Selangor. Only then we, the people become important to the politicians. Only then we will continue to be showered with attention. Returning Selangor back to BN will not help the people. It will only allow BN to strengthen its position and will allow UMNO to clean its investment. What are these investments? People can speculate at this stage as everything is under the veil. I suspect water business, Telco structures, Parking business are some of the UMNO investment in Selangor. However I must amplify the fact that this is my suspicion only.

In the case of parking business, it is tightly bound in legal agreement that the present SSG is unable to break them. In the case of water business, it simply does not make sense why the FG does not want to cooperate with SSG. Instead we see that FG had bailed out PN with soft loans. Why is that the FG is bent not allowing SSG from controlling the water distribution business in Selangor?  What will happen if they chose to allow the SSG water deal to go through and let TR get burned in the process? What secrets are TR keeping that UMNO is giving priority to one-man business and not the entire Selangor population? As for the Rakyat, I believe BN need to put in their mandate clearly on the water rates issue. They have been silent on this subject. I am more keen to know if they are planning to raise the water rates if they are back in power? For those who has forgotten, the SSG manage to have a higher state reserves and give the people RM11.50 discount on their water bill.

Muzakarah: Nik Aziz, Hadi bercanggah

KUALA LUMPUR: Walaupun Datuk Nik Aziz Nik Mat setuju mengadakan muzakarah dengan Umno, Presiden PAS Datuk Seri Abdul Hadi Awang menafikan sebaliknya.

Menurut Abdul Hadi, muzakarah dengan Umno adalah satu agenda politik,  kerana (Umno) bukannya ikhlas.

"PAS tidak akan bermuzakarah dengan Umno kerana ia mainan politik apabila menjelangnya pilihan raya umum sejak tahun 80-an," katanya.
Abdul Hadi menegaskan demikian dalam sidang media di Pejabat Agung PAS di ibu negara hari ini.

Kenyataan itu bertentangan dengan Nik Aziz yang juga Mursyidul Am PAS yang menyatakan kesediaan bermuzakarah dengan Umno.

Sebaliknya, menurut menurut Presiden PAS itu, ia hanya untuk NGO bagi menjelaskan dakwaan sebelum ini yang menuduh PAS sudah tersasar daripada matlamat perjuangan Islam sebenar.

Perbincangan dengan NGO

"Masa tu saya nyatakan PAS sedia mengadakan perbincangan dengan NGO yang menuduh PAS dengan tuduhan itu tetapi telah disalah tafsir.
"Muzakarah dengan Umno itu tidak timbul," katanya lagi.

Namun katanya gagal dilaksanakan selepas tamatnya pilihan raya kerana keengganan Umno untuk meneruskannya walaupun beberapa NGO Islam termasuk ABIM dan Arqam pernah menawarkan diri untuk menganjurkannya.

"Ini cerita lama kita tak mahu ulang balik," katanya yang hanya mahu PAS tumpukan perhatian melawan Umno sahaja dalam pilihan raya nanti.

Menurut Hadi, beliau lebih senang jika perbincangan dengan Umno tertumpu kepada isu pilihan raya yang bersih mengikut etika demokrasi sebenar.

Sementara itu, Setiausaha Agung Umno Datuk Mustafa Ali berkata PAS akan mengadakan program seminar kepada semua NGO dan parti termasuk yang bukan Islam tentang persepsi sebenar parti itu.

Katanya, seperti yang diputuskan mesyuarat biro politik tadi PAS akan menjelaskan tentang Islam dan perananya dalam membangunkan masyarakat dan negara dalam masa yang akan ditentukan nanti.

Hadi kekal bertanding

Sementara itu, Abdul Hadi ketika ditanya pemberita turut menyatakan pendirian untuk kekal bertanding dalam PRU13.

Katanya, keputusan itu dibuat berdasarkan kehendak parti dan bukan atas kapasiti peribadi.

"Semasa (akhbar) The Star temuramah dua bulan lalu memang pada ketika itu hasrat mahu undur diri.

"Tetapi parti telah bermesyuarat dan putuskan Abdul Hadi perlu bertanding," tegas Mustafa.

BN S’gor persoal penggunaan air lombong atasi krisis air

SHAH ALAM: Barisan Nasional (BN) Selangor mempersoalkan cadangan penggunaan air mentah dari bekas lombong oleh kerajaan negeri bagi menampung keperluan air di Lembah Klang.

Koordinator BN Selangor, Datuk Seri Ir Mohd Zin Mohamed berkata rawatan merawat air lombong memerlukan kos yang tinggi.

Malah soal beliau, adakah rakyat mampu menggunakan air lombong yang didakwa tidak mampu disalurkan dengan baik.

"Kerajaan Pakatan lebih suka berpolitik dari memikirkan soal kebajikan rakyat. Mereka lebih takut jika BN mendapat 'mileage' hasil Loji Rawatan Air Langat 2 sehingga Tan Sri Abdul Khalid Ibrahim mengakui mereka akan menggunakan air lombong jika masalah air di Selangor masih berterusan.

"Soalnya, bukankah untuk merawat air lombong juga memerlukan kos yang tinggi? Dan sanggupkah kita menggunakan air lombong yang langsung tidak disalurkan dengan baik? soal beliau.

Pada minggu lalu, Pengerusi Jawatankuasa Tetap Kesihatan, Pekerja Ladang, Kemiskinan dan Kerajaan Prihatin negeri, Dr Xavier Jayakumar berkata kerajaan Selangor akan menggunakan air mentah dari bekas lombong di negeri itu bagi menampung keperluan air di Lembah Kelang

Krisis air

Beliau berkata kerajaan negeri juga bercadang merawat dan menapis air dari bawah tanah, hujan dan sungai yang dilihat lebih banyak memberi manfaat serta menjimatkan berbanding projek membangunkan infrastruktur pemindahan air dari Pahang.

Katanya, jika dilaksanakan dakwaan pihak tertentu akan berlaku krisis air di Lembah Kelang krisis air 2014 adalah tidak tepat.

Projek Penyaluran Air Mentah dari Pahang ke Selangor (PPAMPS) dan pembinaan Loji Rawatan Air Langat 2 masih tergendala selepas isu penyusunan semula industri air negeri itu melalui perbincangan dengan Kerajaan Persekutuan masih gagal mencapai penyelesaian.

Namun Mohd Zin menegaskan isu penstrukturan air, kenaikan harga air dan pembinaan loji pembersihan air di Hulu Langat merupakan perkara berasingan.

Beliau turut menuduh bahawa kerajaan negeri Selangor sengaja mempolitikkan isu air ini sedangkan ia melibatkan kepentingan awam.

Ujarnya BN Selangor berjanji akan memastikan masalah ini segera selesai sekiranya mereka kembali memerintah.

‘Racist’ teacher transferred

GEORGE TOWN: The secondary school teacher embroiled in an alleged racial row with Form five students of the George Town school is all set for a transfer to another school.

This morning the teacher, Sabariah Ramli, 29, packed her belongings in SMK George Town and drove out of the school at 11am.

Last week the state education department said that Sabariah has agreed to a transfer to another school probably in her hometown Kuala Terengganu.

Previously the department claimed Sabariah requested for a transfer because she could not face the same students, who accused her of uttering the words "Hindu Pariah" at them.

Sabariah apparently uttered the term, considered offensive and sensitive by the Indian community, against Form Five "Tabah" students after an examination on May 9.

But the department claimed Sabariah had only uttered the word "India" and had duly apologised for it.

Meanwhile, this morning, school principal Farah Syikh Abd Rahman refused to accept a five-point memorandum from a group of former George Town school students.

An ex-student R Revinthiran said that Farah told them to handover the memorandum to the education department instead.

"She was more interested to know who incited them to submit a memorandum.She was not interested to look into out grouses," Revinthiran told FMT.

In the memorandum, the ex-students have criticised Farah's "mishandling" of the whole affair and demanded for Sabariah to be suspended immediately.

They ticked off the school's senior assistant in charge of students' affairs, Lau Siew Ho for not investigating students' complaints against Sabariah.

The memorandum called on the state education department to probe the students complaints .

Bukit Gelugor MP Karpal Singh, Seri Delima assemblyman RSN Rayer, Hindraf Makkal Sakti's P Waythamoorthy and several Indian NGOs all have criticised Sabariah for the alleged racist remarks.

Although they demanded for Sabariah to be suspended pending an investigation, the department did not take any disciplinary action against her.

Karpal and Waythamoorthy have also called on the police and Attorney General to charge the teacher for sedition.

Anwar, Azmin didakwa di mahkamah esok...

Datuk Seri Anwar Ibrahim dan Timbalan Presiden PKR, Azmin Ali akan didakwa esok berhubung perhimpunan BERSIH 3.0.

Satu kenyataan pejabat Azmin menyebut beliau menerima writ saman untuk hadir ke Mahkamah Majistret Jalan Duta, Kuala Lumpur atas dua pertuduhan di bawah Akta Perhimpunan Aman 2012 dan Kanun Keseksaan.

Beliau diminta hadir ke Mahkamah pada jam 9 pagi esok.

Writ saman tersebut diterima oleh Hilman Idman yang merupakan pegawai Khas Azmin di Tingkat 1, Ibu Pejabat PKR Damansara.

Menurut writ saman tersebut, Azmin dituduh melanggar Seksyen 188 Kanun Keseksaan yang dibaca bersama dengan Seksyen 109 dan Seksyen 34 kanun yang sama.

Dia dituduh bersama penyokong BERSIH 3.0 yang melebihi lima orang yang masih bebas, dalam mencapai niat bersama, telah bersubahat dengan Tangam a/l Raju, Rajesh Kumar a/l Gejinder dan Farhan bin Ibrahim @ Alias, telah mengingkari perintah yang dikeluarkan oleh Majistret Zaki Asyraf Zubir pada 26 April.

Azmin dituduh bersubahat dan menghasut Tangam, Rajesh dan Farhan membuka sekatan besi halangan di Dataran Merdeka.

Oleh itu, beliau dituduh melakukan kesalahan yang boleh dihukum di bawah Seksyen 188 dibaca bersama Seksyen 109 dan Seksyen 34 Kanun Keseksaan (Akta 574).

Anwar, Azmin to be charged over Bersih 3.0...


azlan PKR's top two leaders - Anwar Ibrahim and Azmin Ali - are expected to be charged tomorrow in relation to the Bersih 3.0 rally.

According to a notice that was served to Azmin, he is accused of violating Section 188 of the Penal Code, read together with Section 109 and Section 34 of the same law.

Section 188 refers to "disobedience to an order duly promulgated by a public servant", while Section 109 and Section 34 refer to abetment.

The notice to Azmin said he and five others who are still at large, had conspired with R Tangam, G Rajesh Kumar and Farhan Ibrahim @ Alias to breach a court order issued by Magistrate Z! aki Asyr af Zubir on April 26.

Azmin is accused of abetting and inciting Tangam, Rajesh Kumar and Farhan to breach the barricade surrounding Dataran Merdeka.

The notice also stated that the breach could have caused a riot or clashes in the area.

A separate notice stated that Azmin had participated in a street protest with the intention of protesting against Zaki Asyraf's court order.

The notice said that this constitutes an offence under Section 4(2)(c) of the Peaceful Assembly Act 2012, and is liable to a maximum fine of RM10,000 described in Section 4(3) of same law.


Hand gestures


It is understood that Anwar is facing similar charges. This will make the duo the first persons to be charged under the newly-passed Peaceful Assembly Act 2012.

Another person who have received a similar notice is prominent Negri Sembilan PKR activist Badrul Hisham Shaharin. At the time of writing, the details of the notice have yet to be confirmed.

The charge is believed to be in relation to the infamous hand signal exchange between Anwar and Azmin seconds before the first breach of the barricades.

Badrul Hisham was behind Anwar at the time.

Various videos circulating on the Internet depicted Azmin gesturing and pointing over his back while Anwar was depicted gesturing to the former with both hands in a rolling motion.

Seconds later, while Azmin was trying to get down from an elevated platform after the exchange, a man standing behind him appeared to have lifted a metal barricade.

The man behind Azmin was later identified as Tangam, who has been charged on May 3 under Section 143 of the Penal Code for participating in an unlawful asse! mbly, wh ich was read together with an alternative charge of breaching a court order under Section 188 of the Penal Code.

Tangam was the first to be charged over the rally. Two others who have been charged for similar offences are lawyer Rajesh Kumar Gejinder Nath and Farhan, who is also a PKR Youth exco member.

Anwar and Azmin have denied claims that the exchange of hand gestures had anything to do with the breach.

Anwar claimed that his hand signals were instructions for Azmin to negotiate with the police, while the later claimed he gestured back to inform him that the negotiations were completed.

Attorney-General's Chambers prosecution head Tun Abdul Majid Tun Hamzah confirmed that Anwar, Azmin and Badrul Hisham (Chegubard) will be the only ones charged tomorrow.- malaysiakini

‘Why the haste in wanting to investigate me?’

PETALING JAYA: Tenaganita chief Irene Fernandez today lambasted the police for wanting to investigate her over comments she made in the Jakarta Post on migrant workers in Malaysia.

The speed in which the police responded to reports lodged against her by several groups on Thursday has Fernandez perplexed. The police said she may probed for sedition on Friday.

Fernandez said it seemed that the police are deflecting attention from the real issue of abuse of migrant workers rights by going for her.

"We have made 15 police reports thus far this year. An additional 10 reports were made by the migrants themselves but the police are slow to act on these reports.

"Why are they wasting their time investigating me when they should be out there investigating these cases. This is a waste of taxpayer's money," said Fernandez.

She said that in the past five months, the reports made involved employers or agents holding back migrant's passports and reports of abuse and violence.

"Thirty-five percent of 43 cases registered with us revealed that the maids were denied proper food and 36% of the same number of cases showed alleged sexual assaults.

"These are serious cases which needed to be investigated in order for justice to be served," she said, adding that there were more reports of abuse not recorded by Tenaganita.

The Sedition Act, she said, was an archaic law which has been used in the past to intimidate people. "Why is the government targeting whistleblowers?" asked the veteran activist.

Investigating officers unknown

Abdul Aziz Ismail of the Anti Human Trafficking Council Selangor, said that he was puzzled as to why Fernandez was targeted by the authorities.

"We have lodged 30 police reports on matters relating to human trafficking but no action has been taken.

"When I approached Bukit Aman to get an update, the Investigating Officers (IO) in some of these cases were not known," he said.

He added that he had approached the MACC on alleged corruption involving officials from government departments pertaining to human trafficking, but these reports were ignored.

The MACC is also investigating Fernandez over the interview in the Indonesian daily.

It is investigating her for saying that several Malaysia employers have resorted to "paying the police" or "buying court verdicts" to ensure no action is taken against them.

Fernandez, however, clarified that she was misquoted and that the Jakarta Post has agreed to publish corrections.

She said that it was shameful for Malaysia to sit on the United Nations Human Rights Council (UNHRC) without a proper framework to deal with discrimination faced by migrant workers.

"You have a seat in UNHRC and you silence human rights defenders. That is what is contradictory with the government of the day," she said.

To Deputy Prime Minister Muhyiddin Yassin's reported comment that she was immoral in criticising government policies, Fernandez said that the government should learn to value constructive criticisms.

UMNO ulama's racism is revolting

The riot at Merlimau, Melaka by anti-Bersih, UMNO inspired youths is evidence of the increasing degree to which intimidation and violence is becoming a frequent strategy by certain players in the ruling power structure.

It was clear that the threat and intimidation were aimed against  those who were merely exercising their democratic right to voice their opinions on the policies of the current government.

Reports indicate the presence of police officers at the location and yet why did they not stop the riot from happening? Is it not their duty to ensure the safety and security of all citizens, regardless of their party affiliations?

Will Malaysia's Muftis who so willingly spoke out against Bersih also speak out against the Merlimau riot? Why do we not hear these Muftis now nagging about the limits of freedom and the importance of law and order in Islam?

Or, are the Merlimau rioters somehow exempted from the standards of good conduct simply by virtue of their racist-fascist beliefs and ethno-nationalist party affiliation?

Will we hear condemnation and obsession of what happened in Merlimau by the mainstream media? Or will their pages and airtime be channeled entirely towards demoinizing the hard work of Malaysians from all races who are demanding genuine democratic reforms?

Those who are more alert to the real workings of Malaysian politics will rightly read those questions with cynicism. The point that cannot be denied is that we are witnessing is systematic terrorization to quell democratic dissent.

Bersih was a clear set of demands for electoral reforms that have yet to be met. What happened in Merlimau - preceded by butt exercises, sexist and racist intimidations and harassments against innocent Malaysian citizens - is fascist inspired catharsis from unruly insecure thugs.

It does not require anyone the slightest minute of education to be racist and anti-democratic, and yet racism and anti-democracy have been the central values that have been constantly espoused by the ruling party.

It is also clear that the goal is not so much the enlightenment of Malaysian citizens but their subjugation in ignorance so that the elite of t! hat part y can continue to govern and enrich themselves with impunity.

Racism was even legitimised by a scholar of Ulama' Muda UMNO recently who said that Prophet Muhammad was racist. It is not surprising then to see the escalation of prejudiced attitudes and policies that favour a certain race over others since that is now endorsed by UMNO religious scholars themselves.

As an Islamic organization we are deeply saddened and outraged at the complicity of certain religious figures in tolerating UMNO's constant recourse to thug violence and intimidation. Marx said that religion is the opium of the people. In Malaysia, we can now see who the dealers are.

Tarikh perbicaraan tipu pengarah NFC kekal Julai

KUALA LUMPUR: Mahkamah Sesyen akan meneruskan perbicaraan kes ahli perniagaan Datuk Shamsubahrin Ismail, yang didakwa menipu bekas pengarah Perbadanan Fidlot Nasional (NFC) Datuk Seri Dr Mohamad Salleh Ismail sebanyak RM1.755 juta, pada 16 hingga 27 Julai depan.

Hakim Rozilah Salleh mengekalkan tarikh perbicaraan itu, yang ditetapkan sebelum ini, selepas diberitahu Ketua Unit Pendakwaan Suruhanjaya Pencegahan Rasuah Malaysia (SPRM) Datuk Abdul Razak Musa bahawa surat representasi daripada pihak pembelaan untuk mengkaji semula pertuduhan terhadap Shamsubahrin ditolak oleh Jabatan Peguam Negara.

Pada 14 Mac lepas, pihak pembelaan yang diwakili peguam Zarina Ismail telah menghantar surat representasi itu supaya pihak pendakwaan mengkaji semula pertuduhan berkenaan.

Abdul Razak juga memaklumkan kepada mahkamah bahawa beliau memerlukan masa untuk mengemukakan beberapa dokumen kepada mahkamah berkaitan kes itu termasuk dokumen yang belum diterima daripada syarikat telekomunikasi.

Mahkamah juga menetapkan 12 Jun ini untuk sebutan semula kes.

Perkhidmatan rundingan

Pada 30 Disember lepas, Shamsubahrin, 46, dituduh menipu Mohamad Salleh, yang kini merupakan pengerusi NFC, iaitu dengan sengaja menjanjikan suatu perkhidmatan rundingan dan nasihat bertujuan memperdayakannya sehingga mendorong Mohamad Salleh bersetuju membayar wang perkhidmatan kepadanya.

Mengikut kertas pertuduhan, Shamsubahrin, yang juga Ketua Pegawai Eksekutif Resources Sdn Bhd, dituduh melakukan kesalahan itu di sebuah restoran di Bukit Tunku di sini pada 6 petang, 20 Nov tahun lepas.

Dia juga dituduh menipu Mohamad Salleh dengan memperdayakan beliau bagi menyerahkan cek bernilai RM1.755 juta.

Kesalahan itu didakwa dilakukan di Solaris, Mont Kiara di sini antara 25 Nov dan 6 Disember tahun lepas.

Kedua-dua pertuduhan dibuat mengikut Seksyen 420 Kanun Keseksaan yang membawa hukuman penjara maksimum 10 tahun dan dengan sebat serta denda, jika sabit kesalahan.

‘Uthayakumar could be doing BN a favour’

PETALING JAYA: Human Rights Party's pro-tem secretary general P Uthayakumar had always professed that his heart was with Pakatan Rakyat. But now he could play the spoiler's role in the Sri Andalas state seat and Kota Raja parliamentary seat .

His entry is likely to split the Indian votes in favour of Barisan Nasional.

Uthayakumar will be contesting as an independent as the Human Rights Party is not registered as a political party.

The Hindraf de facto leader announced yesterday that he would contest both seats in the coming general election and for the Sri Andalas seat, his entry is expected to make the fight five-cornered.

Sri Andalas state representative Dr Xavier Jayakumar, from PKR, said that he was expecting at least a five way contest.

"There are rumours that a Malay candidate would be fielded as an independent.

"Kita is also eyeing this seat," said Jayakumar when asked to comment on Uthayakumar decision.

Jayakumar however is confident of retaining his seat. In 2008 he defeated MIC's A Kamalam with a majority of 10,203 votes.

"I have served my constituency well. My record speaks for itself. The people are matured and will make wise decisions," said Jayakumar who is also Selangor exco for health, plantation workers, poverty and caring government.

PAS' Kota Raja MP Dr Siti Mariah Mahmud feels that Uthayakumar's plan to contest in Kota Raja would only split the votes in favour of BN.

In the last election she defeated SA Vigneswaran (MIC) by a majority of 20,751 votes.

"Uthayakumar and Hindraf would only get votes from the Indians. He would split the votes in favour of BN," said Siti Mariah.

She added that it would be impossible for Uthayakumar to win the seat even if the entire Indian community in Kota Raja voted for him.

Indians make up 28% of voters in Kota Raja. Prior to 2008, both the seats were held by MIC.

Former Kota Raja MP and BN's Sri Andalas constituency coordinator Vigneswaran meanwhile dismissed Uthayakumar's foray in the election.

"The battle will be BN against Pakatan," he said.

Vigneswaran also added that Uthayakumar had contradicted himself

"He allowed Pakatan to take advantage of the Indians and now claims that Pakatan is not performing," said Vigneswaran who is a former MIC Youth leader.

UMNO ulama's racism is revolting

The riot at Merlimau, Melaka by anti-Bersih, UMNO inspired youths is evidence of the increasing degree to which intimidation and violence is becoming a frequent strategy by certain players in the ruling power structure.

It was clear that the threat and intimidation were aimed against  those who were merely exercising their democratic right to voice their opinions on the policies of the current government.

Reports indicate the presence of police officers at the location and yet why did they not stop the riot from happening? Is it not their duty to ensure the safety and security of all citizens, regardless of their party affiliations?

Will Malaysia's Muftis who so willingly spoke out against Bersih also speak out against the Merlimau riot? Why do we not hear these Muftis now nagging about the limits of freedom and the importance of law and order in Islam?

Or, are the Merlimau rioters somehow exempted from the standards of good conduct simply by virtue of their racist-fascist beliefs and ethno-nationalist party affiliation?

Will we hear condemnation and obsession of what happened in Merlimau by the mainstream media? Or will their pages and airtime be channeled entirely towards demoinizing the hard work of Malaysians from all races who are demanding genuine democratic reforms?

Those who are more alert to the real workings of Malaysian politics will rightly read those questions with cynicism. The point that cannot be denied is that we are witnessing is systematic terrorization to quell democratic dissent.

Bersih was a clear set of demands for electoral reforms that have yet to be met. What happened in Merlimau - preceded by butt exercises, sexist and racist intimidations and harassments against innocent Malaysian citizens - is fascist inspired catharsis from unruly insecure thugs.

It does not require anyone the slightest minute of education to be racist and anti-democratic, and yet racism and anti-democracy have been the central values that have been constantly espoused by the ruling party.

It is also clear that the goal is not so much the enlightenment of Malaysian citizens but their subjugation in ignorance so that the elite of t! hat part y can continue to govern and enrich themselves with impunity.

Racism was even legitimised by a scholar of Ulama' Muda UMNO recently who said that Prophet Muhammad was racist. It is not surprising then to see the escalation of prejudiced attitudes and policies that favour a certain race over others since that is now endorsed by UMNO religious scholars themselves.

As an Islamic organization we are deeply saddened and outraged at the complicity of certain religious figures in tolerating UMNO's constant recourse to thug violence and intimidation. Marx said that religion is the opium of the people. In Malaysia, we can now see who the dealers are.

'Pasar malam' depan rumah Ambiga: DBKL 'OK' kah...


Pengerusi Biro Kerajaan Tempatan KEADILAN, Hee Loy Sian mendesak Dewan Bandaraya Kuala Lumpur (DBKL) bertindak tegas terhadap penjaja yang mahu membuka gerai di hadapan rumah Pengerusi Bersih, Datuk S Ambiga.


Beliau berkata, tindakan peniaga tersebut jelas menyalahi Undang-Undang Kecil Pelesenan Penjaja dan Gerai (Wilayah Persekutuan Kuala Lumpur) 1989 apabila menjaja di kawasan yang tidak sesuai.


"Kalau mereka mahu berniaga, perlulah mendapatkan lesen daripada DBKL. Persoalannya, adakah DBKL akan meluluskan lesen itu kerana ia jelas menyalahi undang-undang kerajaan tempatan," katanya dihubungi Keadilan Daily.


Beliau mengulas sekumpulan 60 penjaja dilaporkan merancang berniaga di depan rumah Ambiga di Bukit Damansara pada Khamis dan Jumaat ini.


Tindakan itu kononnya bagi menampung kerugian mereka akibat perhimpunan pada 28 April lepas.


Sebelum ini, sekumpulan bekas tentera 'membuang tabiat' melakukan senaman lucah dengan membongkok dan menggoyang-goyangkan punggung mereka ke arah kediaman Ambiga.
Rumah bekas Presiden Majlis Peguam itu turut menjadi sasaran tindakan dangkal sekumpuan peniaga yang membuka gerai burger.


Mengulas tindakan itu, Loy Sian yang juga Ahli Dewan Undangan Negeri (Adun), Petaling Jaya Selatan berkata, tindakan protes seumpama itu perlu dihentikan kerana khuatir akan menjadi budaya balas membalas.


"Sekarang ini di rumah Ambiga, esok atau lusa di rumah Perdana Menteri pula. Kalau ia tidak dicegah, sampai bila-bila pun ia tidak akan berkesudahan," katanya.


Justeru, beliau mengesyorkan mereka yang tidak berpuas hati boleh berdemonstrasi sepuas-puasnya di tempat terbuka seperti di Dataran Merdeka.- keadilandaily.! com< /b>


Gerakan objects to stalls outside Ambiga's house...

Gerakan has urged petty traders to shelve their plan to set up stalls in front of Bersih co-chairperson Ambiga Sreenevasan's house on Thursday and Friday to protest alleged loss of trade during the Bersih 3.0 rally in Kuala Lumpur on April 28.


Raising concern in a statement today, vice-president Mah Siew Keong (left) said holding demonstrations in front of private residences "should be stopped as it is not part of Malaysian culture".


"I am happy to note that the 'thosai protest' outside the house of the deputy inspector-general of police (has been cancelled). If such practices continue, then we  may have protests throughout the country in front of somebody's house every week," Mah said.


All similar protests, including the 'butt exercises' in front of Ambiga's house and mock funeral in front of Penang Chief Minister Lim Guan Eng's house,"should be condemned", he said.


Kuala Lumpur Petty Traders Action Council chairperson Jamal Md Yunus said yesterday they were calling the protest 'Bersih 4.0 - mencucikan Bersih 1,2,3' (Bersih 4.0 - cleaning up Bersih 1,2,3).


The action council will be visiting the site opposite Ambiga's house in Damansara today to mark out the trading zones.


It also expected to seek a trading permit from Kuala Lumpur City Hall tomorrow and Jamal said the traders would carry out their planned protest even if the permit is denied.


According to Jamal, the traders would be operating stalls selling household goods, food and drinks from 3.30pm to 8pm on both days.
However, Mah urged the police and local authorities to ensure tight security to avoid any "untoward" incidents.


There were "other more constructive and positive ways" to display their dissatisfaction, he added.- malaysiakini

There is a piece of very scary news on the front page of The Sun today. It is titled "Presumed guilty" and is about the recent amendment (No.2) to the Evidence Act. Doesn't mean anything to you? Not worth bothering about? You could be in for a rude shock. If you have a blog, use Facebook or just have a broadband WiFi account you could land in big trouble.

If "someone posts content said to be offensive on your Facebook wall, or if someone piggybacks your WiFi account and uploads a controversial document, you will be immediately deemed the publisher of the content and subject to prosecution under the relevant laws such as the Sedition Act."

So, say you post an essay of your personal experience at Bersih 3.0 then someone who claims to support you comments in your post that he/she/they think that Najib Razak is a bumbling, corrupt asshole. They can technically come and haul YOUR ass to jail!!! Until you can prove to them that you are innocent of the 'wrongdoing'.

Scared now? You should be.

A) How did they pass this amendment in Parliament without debate? 
B) How did it miss the attention of The Bar Council?
C) How come the Opposition MP's did not protest such a draconian amendment?

A) = Remember that day when Parliament sat right th! rough th e night until 3AM? And passed 8 (I think) laws in one day? This amendment was one of them.
B) = They were probably asleep.
C) = -ditto-

And you've been thinking that the Barisan Nasional government has been putting efforts into some sort of 'liberalising' of life in Malaysia? Freedom of expression in Malaysia now has a different meaning. Sure. They can freely say that you are guilty of a crime. Until YOU can prove your innocence. Innocent until proven guilty? Nope. This is not American television. This is life in Malaysia la.

Remember those days when, at mamak stalls discussing or just plain belly-aching about life in Malaysia, you would look over your shoulder first and lower your voice before you mention the name Mahathir? Life could return to those "good" old days. Unless......

You make your voices heard NOW. Call your Member of Parliament and complain. Write in Najib's blog, Facebook page, Twitter page. Write in your Blog, Facebook page, Twitter account that as a Malaysian you, as a Malaysian, are NOT happy about the amendment to the Evidence Act.

Muzakarah: Kenapa tolak Islam?

"Tukar kebangsaan dengan Islam", nasihat Mursyidul Am PAS Datuk Nik Abdul Aziz Nik Aziz kepada golongan ultra Melayu-Umno sebagai syarat utama untuk bermuzakarah.

Kata Menteri Besar Kelantan itu, kalau Umno nak bersatu (dengan PAS), tukar dasar kebangsaan dia, bubuh (letak) Islam. Bukan buat keputusan secara berseorangan, tetapi perlu buat secara rasmi bahawa Umno tukar dasar kebangsaan kepada Islam.

Beliau menyarankan demikian apabila isu muzakarah di kalangan orang-orang Melayu dibangkitkan semula oleh orang-orang Melayu dalam parti perkauman itu yang berusaha mencari jalan untuk menyambung tali hayat mereka pasca pilihan raya umum ke13.

Menurut mantan Perdana Menteri Tun Dr Mahathir Mohamad, orang-orang Melayu kini sudah berpecah menjadi tiga puak – PAS, PKR dan Umno.

Semalam Pengerusi Badan Perhubungan Umno Kelantan Datuk Seri Mustapa Mohamed meminta PAS tidak mengenakan sebarang syarat untuk bermuzakarah bagi perpaduan umat Melayu-Islam.

"Jika benar-benar Ikhlas untuk berbincang, PAS diminta tidak meletakkan syarat bagi muzakarah dengan Umno," katanya selepas merasmikan Seminar Kejururawatan sempena sambutan Hari Jururawat Sedunia peringkat Negeri Kelantan, di Kota Baharu.

Maka di sini kita lihat syarat yang diletakkan oleh Nik Aziz sangat mudah untuk dilaksanakan kerana kita menyedari bahawa hampir 100 peratus orang Melayu di negara ini beragama Islam.

Apa yang susah sangat untuk kita berfikir sebagai seorang Islam terlebih dahulu dari berfikir sebagai seorang Melayu terlebih dahulu dan kemudian Islam.

Nik Aziz bukan menyuruh kita menukar agama. Beliau hanya mahu kita berfikir sebagai seorang yang beragama Islam berbangsa Melayu dan bukan seorang Melayu beragama Islam.

Selisih faham

Al Quran menganjurkan kita supaya kembali kepada Allah dan Rasul jika berselisih faham dan bercanggah pendapat kerana yang demikian lebih baik dan lebih elok kesudahannya.

Firman Allah dalam Surah An-Nisaa', ayat 59 bermaksud:

"Kemudian jika kamu berbantah-bantah (berselisihan) dalam sesuatu perkara, maka hendaklah kamu mengembalikannya kepada (kitab) Allah (Al Quran) dan (Sunnah) RasulNya – jika kamu benar beriman kepada Allah dan hari akhirat. Yang demikian lebih baik bagi kamu dan lebih elok pula kesudahannya."

Maka apa yang susah sangat untuk menerima Al- Quran sebagai asas perbincangan (dalam hal muzakarah ini) jika kita benar-benar ikhlas ingin bersatu padu dalam segala perkara atau aspek kehidupan.

Sayyid Muhammad Husayn at-Tabatabai dalam kitaf tafsirnya al Mizan menyebut ayat ini ditujukan kepada orang-orang yang beriman jika berselisih dalam sesuatu perkara.

Perintah Allah ini katanya, ada kaitan dengan keimanan seseorang. Percanggahan dalam diri seseorang akan terserlah. Sungguhpun seseoang itu percaya kepada Allah dan Rasul, ketidakyakinan tersembunyi disebalik hati orang-orang yang tidak beriman.

Nik Aziz juga menyatakan bahawa muzakarah memang dianjur oleh Islam dan sepatutnya adalah untuk kebaikan semua pihak dengan niat yang benar-benar ikhlas.

Maka permintaan Nik Aziz supaya kita kembali kepada Islam untuk bermuzakarah sebenarnya bukan sesuatu yang sukar dilakukan.

Tetapi yang menjadi batu penghalang ialah semangat kebangsaan yang masih menebal melebihi kecintaan kita kepada Allah dan Rasul serta hari akhiratnya.

Battle-ready DAP sounds war drums

GEORGE TOWN: DAP's top brass to grassroots leaders and campaigners are all set to do battle with Barisan Nasional for state supremacy in the 13th general election.

They are firmly united to help Pakatan Rakyat retain Penang and capture other states, and win the ultimate prize, the Putrajaya holy grail.

The Penang DAP election machinery was launched to much fanfare yesterday at the Komtar Dome by the DAP top brass.

National chairman Karpal Singh, DAP secretary-general Lim Guan Eng, Penang DAP chairman Chow Kon Yeow, elected representatives and grassroots leaders were all pumped up.

"We are ready for the election. The DAP and Pakatan are ready for the battle with BN," proclaimed Karpal.

He called on his party comrades to work hard to hammer the final nails in the coffins of MCA, MIC and Gerakan in the next polls.

Referring to the 2008 general election, in which the three parties were all wiped out from Penang, he said MCA, MIC and Gerakan were now virtually dead and buried.

"Make sure that they don't come out from their graves anymore," said the senior parliamentarian as he rallied his troops.

He also threw a challenge to recently appointed state BN chief Teng Chang Yeow to prove his mettle by taking on either Chief Minister Guan Eng or Chow in the coming polls.

"Teng can also contest Bukit Gelugor … I'm ready to face him," said Karpal. Teng was formerly Padang Kota assemblyman between 1995 and 2008.

He won the seat on his election debut by defeating Karpal but lost to Chow in the last election.

In the last general election, DAP won all its seven parliamentary and 19 state seats in Penang to helm the Pakatan state government.

Although many expect DAP-led Pakatan to retain Chinese-majority Penang, some observers predicted the victory would not as big as 2008.

Pakatan now has 29 seats against BN 11 in the state assembly.

Beware of BN's tricks

Even Lim in his speech indicated that the next general election would be tougher than the previous one.

He called party members not to underestimate their opponent, reminding them that BN was capable of coming up with 'magical tricks' to regain Penang.

At least one-third of the state's 40 state constituencies are considered "hot spots."

Lim predicted the next election to be held at least by July as the country would be affected badly by the expected European economic downturn in six months' time.

He said that BN has activated election operation centres in all constituencies, a sign that the coalition was in a hurry to hold a snap poll.

But Karpal thinks it would be in June because Prime Minister Najib Tun Razak must obtain his own people's mandate to legitimise his premiership.

He said Najib also must come out from the shadow of former premier Dr Mahathir Mohamad.

But some DAP local reps speculated a September poll.

They said Najib can use the Ramadan fasting month, Hari Raya Puasa festive season and Aug 31 Merdeka celebrations to galvanise Malay voting population to back Umno and BN.

"He can use these events to stir Malay nationalism and revitalise Umno's weakened hold on Malay voters," they argued.

But 'godfather' Karpal is unperturbed by all these run-up talks to the election.

"The war drum has been sounded. The DAP is ready for the war," declared the veteran politician, who has seen many electoral battles before.

Sometimes I do agree with lameduck MCA President Dr Chua SL...

In my humblest of opinions, although I am an Oppositionist, I do give credit to MCA leaders when they say or do the right thing. I had written more than once how Dr Chua Soi Lek in his heydays as Health Minister, was the best performing Minister. I will search my archives and extract ONE GOODE EXAMPLE if you, my esteemed readers, behave yourselves and don't do that "butt dance" in front of Desi's midnight cyber-home, OK! I don't serve Burger or Nazi Lemak for thy performance:(!

Now in The Star today, page 10, the report headlined "Do DAP and PKR know?", the following extract is significant:

"On the resignation of DAP vice-chairman Tunku Abdul Aziz Ibrahim, Dr Chua said he was surprised that it took the former senator so long to see the DAP's true colours.
"I am shocked Tunku Aziz said DAP is a racist and autocratic party because he is an intellectual and should have understood that before joining the party.
"I was shocked when he entered the party and when he left ... because he took so long to find out," Dr Chua said, adding that although the party claimed to be multi-racial it only contested in Chinese-majority constituencies."

OR have you been another poor version of RipVanW(R)inkle(D) sudddenly woken up by polituical stirrings that he began to sing the praises of UMNO and its unelected chief, and by default,mbecoming Prime Miister Najib Tun Razak,  Lofty "transformation programmes" indeed, my foot! (it hurts just listening to Tunku Aziz's UMNOspeak on ntv7 and subsequent propaganda in the MSM the following days, EVERY DAY. Yes, Like RPK, now Tunku Aziz is flavour of the month of the well-regarded mainstream media iuncluding the NST where he was a weekly columnist daming DS Anwar Ibrahim in the few weeks before joing DAP four years ago!
