Nalla waiting to reveal all in court

KUALA LUMPUR: Malaysian Indian United Party president Senator S Nallakaruppan has handed over a video tape to his lawyer, claiming it contains evidence pertaining to a RM100-million libel suit filed by Opposition Leader Anwar Ibrahim against him.

He handed over the tape to Muhammad Shafee Abdullah about 2pm, at the Jalan Duta Court Complex here today.

"I have given the video tape to my lawyer as evidence in the libel suit. Whatever evidence I have, I have given it to my lawyer. I want them to open the video in court. Let the court decide," he said.

Nallakaruppan, however, refused to reveal the contents of the video tape, saying it was up to the court to decide on the matter.

He also maintained his stand that Anwar was a bisexual in nature.

"I stand firm on my facts, I will not run away, I already gave the evidence to my lawyer. I am waiting to tell the truth in court," he said, adding that he wanted the case to be heard in court soon.

He also challenged Anwar to sue him for RM500 million as the current RM100 million suit was insufficient.

On March 26, Anwar filed the suit against Nallakaruppan over the latter's derogatory remarks in a statement published on the front page of the Utusan Malaysia newspaper dated March 20.

He also named Utusan Melayu (Malaysia) Bhd as second defendant and the newspaper's group chief editor, Abdul Aziz Ishak, as third defendant.

Anwar claimed that the libellous words contained in the newspaper article were false and baseless, and published with malicious intent.

Stateless Indians – No need for the blame game

FMT LETTER: From Harish Subramaniam, via e-mail

Largely drawn by its attention-grabbing headlines, I read with interest and a big pinch of salt Dr Paraman Subramaniam's sensationalist article in CPI Asia on stateless Indians in Malaysia. Since his title posed a question I have answered it in mine.

The good doctor started by tugging at the heartstrings in citing the UN Declaration of Human Rights as if to paint the plight of Indian Malaysians like the Hmong refugees in Thailand, Europe's Roma or the Kurds in Turkey.

Institutionalised discrimination against Indians in Malaysia by the government (which historically included large numbers of Indian civil servants) seems to be the thrust of Subramaniam's piece. This is clearly an exaggeration or the author's artistic licence designed to draw the attention of the reader.

He then launches into a series of numbers and figures which are at best historical and at worst plucked out of thin air. 450,000 is the number he has built his central argument around. The ridiculousness of this number can be immediately disproved by a quick check on UNHCR's website.

On its page on Malaysia, the UNHCR says that as of January 2011, there were 216,900 people whom it lists as "people of concern". These include refugees, asylum-seekers, stateless people and others of concern. Of this, the grand total of all stateless people is 41,000.

Maybe it was a printing error that caused the doctor's numbers to swell by an extra zero, but if so, it was an oft-repeated mistake. Or maybe he allowed himself to be swayed by Hindraf's unsubstantiated claims and took their number to be gospel. He would have us believe that this extra 409,000 must have slipped through the cracks in the UNHCR count but wasn't he relying on UN numbers in the first place?

I shall not go into the sheer folly of basing one's argument on historical population projections which were subsequently proved inaccurate. Saying that "the figures could represent an unbiased clearer picture of the Malaysian population today" merely because it was included in a UN report is idealistic at best.

Furthermore, it is simplistic to say that, in 1975, Malaysia's chief statistician in the Census and Demographic division, R Chander (an Indian in the highest levels of the civil service!) could not have made a mistake. To take his figures as gospel would be foolish, just as condemning him for being wrong would be churlish.

It could quite easily be argued that, Chander did the best he could given the resources he had and the data-collection methods of that time. To say he was right 2 out of 3 times (for Malays and Chinese) and wrong only with Indians (off the mark by a mere 175,000) and to then construct a conspiracy theory around this would be plain childish.

Let me state quite clearly, that I do not dismiss Dr Subramaniam's claims altogether. It is clear that unregistered Indians in Malaysia are a blot on the nation and previous governments may not have given the issue its due attention. I am, however, disputing his inflated numbers and the methods at which he arrives at them.

Without sounding like a sycophant, I am glad that the Najib administration has recognised this problem and has taken action to redress this historical wrong. As a people who have been invaluable to the nation-building effort in Malaysia, Indians who have resided in Malaysia for generations and their descendants should be granted full citizenship and all its attendant rights and privileges along with it.

Shafie: RM1.5m payout to Zahida ‘completely untrue’

KUALA LUMPUR: A week after he was openly linked with a popular local artiste Zahida Mohamed Rafik, Rural and Regional Development Minister Mohd Shafie Apdal today denied making any hefty payments to her.

He warned that he would be taking legal action against anyone "who continues to defame me and link me with this issue".

"I have been following closely various reports in the media and blogs that have linked my name to a police report dated March 13, 2012, by a person named Noor Azman Azemi, who claims to be under my employ as a driver, linking me with the payment of a large amount of money to an artiste by the name of Zahida Mohamed Rafik.

"I wish to state that everything that has been mentioned in the police report is completely untrue and that the subsequent comments by individuals who have distributed copies of the police report is with bad intent and politically motivated," said the Umno vice-president in a statement today.

On April 18, PKR parliamentarians held a press conference at the parliament lobby where they revealed the details of Noor Azman's police report.

Payments totalling RM1.5 million

In the report, Noor Azman had claimed that he was hired by the minister to be the artise's personal driver.

He claimed that the minister told him to keep tabs on the actress and help him channel the funds into the actress' personal account.

He further claimed in the report that the minister met the actress each week in hotels around Kuala Lumpur.

"At every meeting, he would hand over RM100,000 to RM200,000 to the actress," alleged Noor Azman.

He said he resigned on Feb 29 this year, as he could not manage the pressure of working for the minister.

At the same press conference, Ampang MP and Wanita PKR chief Zuraida Kamaruddin had alleged that the actress had received RM58,000 last October, RM112,000 in November and RM330,000 in December, as well as RM510,000 in January this year.

'Wait for the good news'

Following the press conference, PKR reps gave Shafie a week to reveal his source of income.

Days after the press conference, Zahida Rafik said on her Twitter that she had consulted her lawyers to take legal action against those implicating her.

"I am not keeping quiet. My lawyers are in the midst of settling the matter. So let them handle it.

"Wait for the good news," she had said in her tweet.

The minister and the actress have previously denied any ties to each other. However even before the PKR press conference last week, several blogs had written about the alleged relationship between the two.

Giving with one hand and grabbing it back with the other

FMT LETTER: From Pensioner, via e-mail

The BN government puts on a big show of being concerned about pensioners who are struggling to make ends meet. It is all 'wayang kulit'. They just do not care. The recent huge pay rise given to senior civil servants when compared to the pittance given to pensioners is a prime example.

For some pensioners living in Kuala Lumpur, the paltry rise  is just enough for taxi fare to collect the pension and perhaps have a snack at a teh tarik stall. Certainly not enough for exclusive designer clothes, diamond rings and elegant hotel stays!

Recently, I accompanied a friend who was hoping to collect the death benefits promised to pensioners. Imagine the shock and despair my friend felt when he was told that his mother was not eligible.

My friend's father died a few years after he retired  and did not get to enjoy the death benefit for funeral expenses. His mother also only got her husband's pension benefits for a few years.

Now, the family who is in severe financial straits is being denied these benefits. The BN government obviously is not aware of the reality of living in need. The spiraling cost of living has affected funerals too.

The Prime Minister should send his aides to check out how much a 'no frills funeral "costs!

We sincerely hope the government will reconsider this refusal. If a government retiree did not get to enjoy this benefit, it should be passed on to his spouse, whether she is a government employee or not.

At the same time, the Selangor government which also pays death benefits bereaved families  on production of the death certificate is also not paying out in full but in phases

Mr Prime Minister , please do not talk about 'transformation'. You have only blighted the lives of many pensioners who have served the country with dedication and loyalty for the better part of their lives.

Mr Prime Minister, you who treat pensioners and their families so callously should not expect pensioners' votes or those of their family members in the coming elections! No" namibikei' on you or your promises!

Traumatic experience at Sri Lankan High Commission

FMT LETTER: From Traumatised Malaysian Employer, via e-mail

The Malaysian immigration allows Malaysians to bring in Sri Lankan maids without using agents. Some Malaysians do this through friends and acquaintances in Sri Lanka, or through friends who have already employed Sri Lankan maids.

The immigration also states that we have to pay the maid RM750 per month.

But I am not sure why we have to go to Sri Lankan High Commission to get them to sign the papers after they have been signed by and passed by the Malaysian Immigration Department.

It is when bona fide Malaysian employers go to the Sri Lankan High Commission that we are given a hard time. And this is after our papers have been approved by the Malaysian Immigration Department.

The Sri Lankan High Commission insists we sign an agreement with them that we will pay the maids RM850, even though we have signed an agreement with the Malaysian Immigration Department to pay RM750. In the final instance, which agreement is applicable?

The Sri Lankan High Commission gives Malaysian employers a grilling why we have not used an agent. They are deaf to explanations the Malaysian Immigration Department does not require us to do so. The officer in charge, a Mr Y is particularly rude and arrogant

There even have been cases where the Sri Lankan High Commission insists that we use an agent in Malaysia to get the signature from them and we are required to pay the RM3,000; though we have sourced the maid on our own and have paid for the ticket, passport, etc. on our own.

Something is very fishy. It would be helpful if the Malaysian Immigration Department could clarify the issue

Northern Europe or North Korea? — Tay Tian Yan

APRIL 22 — There are two kinds of country offering free tertiary education in the world.

The first kind is wealthy countries like northern Europe countries, including Denmark, Sweden, Norway and Finland.

Another kind is impoverished or communist countries, like North Korea, Cuba, Sri Lanka, and Greece.

It is indeed interesting. It turned out that wealthy countries can do it, and so can impoverished countries. Therefore, some people shouted, "Why can't Malaysia since even North Korea and Greece can?"

Malaysia can, of course, do it. However, cost must be taken into consideration.

Northern Europe countries are wealthy and strong, with US$ 40,000 to US$ 50,000 per capita income.

In addition to free education, they can also afford to give child allowances, paternity leave, free medical care and unemployment relief funds. Senior citizens enjoy even more benefits, like pensions and weekly visits from government social workers.

In short, if you are fortunate enough to be born in one of these countries, you would not have to worry about giving birth, ageing, illness and death.

However, there are always costs behind free services.

Tax rates in these countries hit as high as 60 per cent and, generally, half of the income of the middle class has contributed to the Treasury, in exchange for various benefits.

In fact, they pay for what they enjoy. Northern Europeans have the ability and are willing to pay the cost.

Some impoverished countries like North Korea, are also providing free tertiary education. North Korea is even able to launch rocket.

Of course, it also has to pay the cost.

The quality of life in North Korea is very low. People do not have enough food to eat and some have even starved to death. There is no national development and the land is barren.

Therefore, economists are asking, should the North Korea's limited national budget be used in providing free but low-quality tertiary education or to feed the people and for economic development?

Apparently, the North Korean government prefers to provide free tertiary education and launch rockets. Thus, those who have starved to death are the cost they pay.

In comparison, Greece is not as poor as that. Its per capita income is more than double of Malaysia.

The Greek government's budget provides the people with many benefits. In addition to various allowances, it also provides free tertiary education.

However, the deficit has been worsening over the past few years and the accumulated debt has surpassed its gross national product (GNP). It would surely have gone bankrupt if the European Union did not save it.

Until today, many people are still arguing why we cannot provide free tertiary education since it is a long-term investment.

If Malaysia were as wealthy as northern Europe countries and the people are willing to contribute half of their income for taxes, of course we can consider giving free education.

However, Malaysia is still a developing country. It is lagging very far behind developed countries and has even been sliding on the list of emerging countries.

Once we provide free tertiary education, would we be closer to northern Europe countries, or North Korea instead?

Of course, there are other reasons explaining why we should not provide free tertiary education:

• When all universities provide free education, students from poor families will certainly benefit. However, students from middle class and wealthy families will also enjoy this unearned benefit.

• Good universities will receive allowances, but so will the bad ones.

• Of course, distinguished students will be rewarded, but mediocre students will be rewarded, too.

Is it fair? — mysinchew.com

3.1m dubious voters on list for a decade, says Bersih

By Shannon Teoh
The Malaysian Insider
Apr 23, 2012

KUALA LUMPUR, April 23 — Bersih accused the Election Commission (EC) today of failing to investigate 3.1 million voters whose identity card (IC) addresses differ from that in the electoral roll despite having the information since 2002.

Speaking at a press conference called by the electoral reform movement, independent polls analyst Ong Kian Ming said the EC was given this information for all states in the peninsula and also Kuala Lumpur in 2002 and the figure made up 37 per cent of the 8.3 million voters registered then.

The project director for the Malaysian Electoral Roll Analysis Project (MERAP) said he has had the information given by the National Registration Department (NRD) to the EC before the implementation of the new registration system where all voters have to be registered according to the constituency indicated by their IC addresses.

"The EC has failed to act on this… to clean up the electoral roll even though the presence of these non-resident voters contravenes Article 119 1(b) of the Federal Constitution which says a voter must be a resident in the constituency he is voting in," he said.

Bersih steering committee member Maria Chin Abdullah also said this "shows serious problems in the electoral roll which is the role of the EC to correct."

"They say they are cleaning it up, so why are these findings still emerging? The EC team should resign en bloc and let a new team step in to clean up the roll," she added.

Ong also said his research found 65,455 "foreigners" in the electoral roll, almost 90 per cent of whom had IC numbers which showed they were Malaysian-born.

Another 106,743 voters were deleted and 6,762 added to the electoral roll without public display between the end of 2010 to the third quarter of 2011, he added.

The UCSI lecturer also said the supplementary roll for the last quarter of 2011 did not contain the usual information about the number of voters added or subtracted due to death or enrolment in security forces.

He said that given the average of 20,000 deaths and the third Q3 2011 roll showing an unusual spike in police and armed forces enrolment to 9,000, this could add another 30,000 to 50,000 dubious names.

"Including the 100,000 identified by MERAP previously, there are at least 3.4 million cases or about 27 per cent of the current electoral roll which needs to be further investigated," he said.

EC chairman Tan Sri Abdul Aziz Mohd Yusof had said last week Malaysia's electoral roll was the cleanest in the world, as only 42,000 out of 12.6 million voters, or 0.3 per cent, were considered unverifiable.

But Ong said Abdul Aziz should have checked the 100,000 already identified by MERAP as having ages above 85 years old, gender inconsistent with their ICs, same names and similar birthdates, born overseas, Klang Valley voters who do not have house addresses, postal voters with regular ICs, spouses of policemen who are postal voters, spouses of army and police voters who have the same gender, army and police voters above retirement age and army and police postal voters who are above recruitment age.

The credibility of the electoral roll has been widely questioned since a Parliamentary Select Committee was set up late last year to look into electoral improvements.

The panel completed its six-month tenure and submitted its findings to Parliament last week but the opposition and civil society have criticised it for lacking specific recommendations on how to clean up the voter registrar.

Bersih, a coalition of 84 NGOs, then announced it would hold a third rally for free and fair elections on April 28.

Prime Minister Datuk Seri Najib Razak had announced the formation of the bipartisan polls committee in August 2011, after being condemned in the international press for his administration's clampdown on Bersih's July 9 rally which drew tens of thousands to the streets of the capital.

Bersih still eyeing Dataran, but…

KUALA LUMPUR: Bersih 3.0 is determined to hold its April 28 rally at Dataran Merdeka, but will have to relent if the 85 NGOs that make it up vote for a change of venue.

"We will have an emergency meeting tonight to discuss the NGOs' concerns and we will then make an informed decision," said Subramaniam Pillay, a member of the Bersih Steering Committee.

He told a press conference today that the committee was not mandated to make the decision on behalf of the NGOs.

Maria Chin Abdullah, another member of the committee, said the mandate now was to rally at Dataran Merdeka "pending discussions".

Kuala Lumpur City Hall (DBKL) has rejected Bersih's application to have the sit-in rally at the iconic site.

The police too today have formally disallowed Bersih 3.0 to hold the peaceful sit-in rally at Dataran Merdeka, citing "safety" concerns.

On the weekend, Home Minister Hishammuddin Hussein urged DBKL to offer an alternative venue.  He said he was willing to assist in securing Stadium Merdeka or Stadium Bukit Jalil as the alternative.

Today KL mayor offered the Kuala Lumpur Football Stadium, or the Kuala Lumpur Badminton Stadium, or Stadium Titiwangsa in Taman Tasik Titiwangsa for the sit-in rally

Dataran is the place

Over the last two weeks, Hishammuddin has twice said the government would not hinder the protest because it did not consider it a threat to national security.

Poet A Samad Said, who shares the Bersih chair with S Ambiga, said neither of them would budge from insisting on Dataran as the venue if it were their decision to make.

"Me and Ambiga share the point of view that Dataran is the place," said the national laureate.

"But we have to be reasonable. The committee has to refer to the NGOs. If you ask me, we would like to keep Dataran as the venue. We're not asking to use it for long hours, only two hours."

DBKL's reason for rejecting Bersih's application to use the public square was that the protest, in its opinion, was not a "national event".

A different reason

However, at today's press conference, Bersih pointed out that Dataran had often been used for functions that could not be considered national events.

"They held Barisan National Youth Ride Fest 2012, Nestle's 100th year celebration, OCBC Cycle Malaysia, Standard Charted KL Marathon 2011," said Maria.

Kuala Lumpur mayor Fuad Ahmad Ismail reiterated this morning that DBKL would not allow Bersih to use Dataran, but this time the reason he gave was that the rally would have "political or dissenting elements".

At the Bersih press conference, Maria responded to former PAS deputy president Nasharudin Mat Isa's statement yesterday that Ambiga was not fit to lead Bersih because she supported the cause of the the lesbian, gay, bisexual and transgender community.

A clearly irritated Maria said: "It is not for him to decide who will be our leader. That is decided by the 84 NGOs that make up Bersih."

Suara peneroka Felda Sabah

Konvensyen selama sehari anjuran Persatuan Anak Peneroka Felda Kebangsaan (Anak) dirasmikan bekas Menteri Penerangan, Tan Sri Kadir Sheikh Fadzir.

Turut hadir Presiden Anak, Mazlan Aliman; Timbalan Presiden PAS, Dato' Husam Musa; Sasterawan Negara, Dato' A Samad Said;

KL Mayor threatens action against Bersih over use of Dataran Merdeka

Tapi, Hishamuddin cakap....

The Home Ministry does not see the April 28 Bersih sit-in at Dataran Merdeka as a security threat, as it has "little traction" with the people.

Speaking to reporters today, Home Minister Hishammuddin Hussein (left) said the only threat would be to organisers, who have to face "negative public perception" as a result.

"It's nothing much really, just some people who want to gather. If it's about parliamentary democracy, we had the parliamentary select committee on electoral reform...

Demonstrations "are normal in democracy today" and have become a "global culture" and the government dealt with these through the "proper and progressive way".

"Whether this will be good for the country's future is up to the people to decide," Hishammuddin said.

He also said that the police would not crack down on demonstrations, unless the organisers "end up doing more" than what they had promised.

Update on Forum: “How Clean will the 13th General Elections be?”

http://delcapo.files.wordpress.com/2011/08/no-election-cleaning-in-progress.jpg

On 19th Apr 2012, Tindak Malaysia invited the Election Commission Chairman, Tan Sri Dato' Seri Abdul Aziz Mohd Yusof, to an open forum entitled How Clean will the 13th General Elections be? to be held at the PJ Civic Centre Auditorium, at 8.30pm Tuesday April 24, 2012

So far, we have not met with a response from the Election Commission. Possibly, the Chairman was too busy rushing the
Election Offences Act through Parliament, during its last day of sitting on 19 th Apr 2012.

It is therefore with deep interest that we read in Malaysiakini on 21st Apr, 2012 the following:
"Despite numerous complaints over the electoral roll, Election Commission chief Abdul Aziz Mohd Yusof declared that Malaysia has the cleanest electoral roll in the world.

In an interview with Sin Chew Daily published yesterday, Abdul Aziz repeatedly stressed that the existing electoral roll is clean and no country in the world has a cleaner one than ours."

Losing you, over all or nothig

Monday blues
I went to look for you

to under the old angsana tree
its cover shady even on a hot malaysian afternoon
but you were not there

so i went elsewhere
here there everywhere
i dare

no familiar faces
even at those familiar places

by the gardens fountain
at our favourite mamak stall
next to the cendol and rojak stall

i did not finf ye
neither did you try to find me i think

i looked for all of ye
found nothin' at all

so i went me alone back to my bed
hard and unfeeling because of my dread
i went into a stupour

have i lost you
mGf?
i 'm losing sleep
and most of all
i'm losing you
all or nothin'?

59,000 foreigners ‘registered as voters’

KUALA LUMPUR: Some 59,000 foreigners have been registered as voters in Malaysia due to "gaps" in their details, according to the Malaysian Electoral Roll Analysis Project (MERAP).

MERAP project director Ong Kian Meng said there were "gaps" in their registration details and this has raised suspicion over their status as voters.

He said this today while speaking of his finding at a Bersih-held press conference.

"If you are a Malaysian born abroad, you will have a code '71′ in your IC. If you don't have a '71′, that means you are a foreign-descent born in Malaysia," he said.

He added that the presence of 59,000 voters raises suspicion as their IC numbers did not contain the "71″ code and they were too old to be born in Malaysia.

"These voters were born before the 1980s but they don't have the old IC numbers," he said.

Adding to the suspicion, Ong said that in the Kudat constituency in Sabah, these foreigners did not have any addresses attached to them.

These data was collected from the electoral roll as at December last year.

"What is more troubling is the fact that 49,000 of these 'foreign' voters can be found in Sabah, where problems with foreigners being given fake ICs have long been documented," he said.

Is there an alternative purpose?

Ong said that this information was obtained from the "race of the voter" category in the Election Commission's (EC) list.

He said he obtained this detailed list from his sources as the usual voter roll for the public did not contain this category.

He pointed out that there were 65,455 foreigners in the roll including descendants from the Philippines, Indonesia, Afghanistan, Spain, Malta and Slovakia.

Admitting that these cases may be genuine Malaysian voters who are foreigners, Ong said: "I am not saying that there is something wrong with all these voters, but why would the EC be tracking the race of these voters comprehensively? Are they being tracked for an alternative purpose?"

Ong also highlighted cases where names were deleted or added to the voter list without the knowledge of voters.

Analysing both the 2008 and 2010 electoral rolls and cross-referencing with the December 2011 roll, he said that his team had found about 110,000 names which were either deleted or added to the roll without display.

He said that 106,743 names were deleted and 6,762 new ones were added.

"There is a category which indicates why your name is removed or added. For example, if you have passed away, or are now a qualified postal voter.

"But for these names, there were no reasons stated [for deletion or addition]," he said.

EC downplaying cases

Ong also cited the case of 3.1 million non-residential voters, saying the voting constituency of the voters did not correspond with the voters' IC address.

This is an offence under Article 119 1 (b) of the Federal Constitution, which states that a voter must be a resident in the constituency which he or she is voting in. The law came to effect in 2002.

However, Ong said the EC has a loose interpretation of this law.

He said that this must be cleared; otherwise, the non-residential voters may be registered as phantom voters.

He said that a comprehensive study was conducted by the National Registration Department (NRD) over this matter 10 years ago and the results were given to the EC.

A sampling of about 200 of that data shows that these cases still persist, according to Ong.

"The point is that the EC has all these comprehensive data; so why is it not tackling these problems?

"It raises suspicion that this [problem of irregularities] is larger than what the EC makes it out to be," he said.

Making Labuan the centre of shipping business

By Siti Nafsiah Ahmad Shaffie

Most people know that Labuan is a major international business financial centre in the Asian region.

What does Labuan have to attract and assure the foreign ship owners that Malaysian flag is the right choice to avail with?

The island of Labuan is strategically located in the middle of Asia-Pacific region and an increasingly popular choice of International Business Financial Centre jurisdiction.

It is also located in the waters of the South China Sea where it is close to major shipping routes, free from natural disasters such as typhoons and hurricanes.

Labuan also has a good port, which has deep anchorage of about 11 to 21 meter draft. The port is well maintained by Labuan Liberty Port and offers top facilities to any vessels using their port.

Apart from the nature of Labuan itself, there are also other facilities which can attract ships or vessels owners to use Labuan for the Malaysian International Ship Registry (MISR) registration purposes, such as follows:

  • Labuan has excellent infrastructures such as hotels, communications services and transportation services;
  • World class shipping support services such as shipyard, ship care, floating repair, hull cleaning within Labuan water, direct supply of food, fuel supply to vessel and garbage disposal services; and
  • Competent and professional Marine Department officers to handle the registration and other matters related to the ships or vessels.

Other benefits

  • There are also other benefits that ship or vessel owners can enjoy when using Labuan for the MISR registration purposes:
  • Labuan is one of the safest place to visit in the region, as it is near to the Malaysian Navy base and air force base;
  • Labuan is Malaysia's most established duty free island. A host of value-adding and manufacturing activities can commence in Labuan.

Labuan has been declared as one of the country's oil and gas hub. This will further boost the oil and gas industries in Labuan;

The Malaysian government has introduced many incentives for businesses conducted through the island of Labuan. These include a reduction or exemption of income tax and stamp duty fees for individuals and companies doing business in Labuan;

Setting up a company is a quick and simple exercise, and approvals come from a one-stop regulator, the Labuan Financial Services Authority (Labuan FSA);

Ship owner may enjoy the tax regime of 3% tax from net profit or a flat rate of RM20,000. To enjoy the said tax treatment, the shipping activity comply with the Labuan Business Activity Tax Act 1990;

Labuan is the centre of International Business Financial Centre (IBFC) in Asian region. This has put Labuan as one of the premier IBFCs in Asia Pacific.

With an attractive tax regime and incentives, competitive cost for the formation of Labuan company without sacrificing quality, with access to expertise and world-class infrastructure and competitive ship registration fees, Malaysia International Ship Registry (MISR) has the potential to attract shipping companies to use Labuan IBFC as the centre for their shipping business.

For more information about Labuan shipping activities in Labuan, you can log on to www.labuanfsa.gov.my and www.labuanibfc.my.

Tindak Malaysia's founder, Wong Piang Yow, urged the EC Chairman to attend the forum to substantiate his claim to ackknowledged specialists in the field of electoral rolls. "The EC Chairman should not miss such an opportunity to prove the cleanliness of the electoral roll", stressed Wong. Otherwise, the public may be left with the impression that the EC Chairman's claims are without substance.

The EC Chairman can also take this opportunity to explain the rationale behind the changes to the Election Offences Act which was just passed by Parliament and why the position of Barung Observer was cancelled.

The invited guests are from the Election Commission, BERSIH 2.0 Steering Committee, academician and political analyst, Dr Ong Kian Ming, and the Election Commission Chairman, Tan Sri Dato' Sri Abdul Aziz Mohd Yusof.

The moderator will be Syahredzan Johan, the Chairperson of the Bar Council Constitutional Law Committee.

Let’s just get back to basics

FMT LETTER: From May Chee Chook Ying, via e-mail

Let's forget about trying to break into the Guinness Book of World Records and stuff. Let's just get back to basics. Let's just go back to square one; what it means to be a democracy, what it means to uphold the constitution. Let's remember the pledge of the Rukunegara, first mooted in 1970. For those who have forgotten about it and for those who do not know anything about it, it goes like this:

"Our Nation, Malaysia, is dedicated to: Achieving a greater unity for all her people; maintaining a democratic way of life; creating a just society in which the wealth of the nation shall be equitably distributed; ensuring a liberal approach to her rich and diverse cultural tradition, and building a progressive society which shall be oriented to modern science and technology.
We, the people of Malaysia, pledge our united efforts to attain these ends, guided by these principles:

  • Belief in God
  • Loyalty to King and Country
  • Upholding the Constitution
  • Sovereignty of the Law; and
  • Good Behaviour and Morality

Seen or felt any of the above lately? Am I the only one sorely missing the spirit of the Rukunegara? Can we drown out the din, please, and get back to living with dignity, the way decent human beings deserve to?

Eight bills passed through in one day. Time stood still, so someone said. I wished. I wished we could go back to the time when I was only in Standard 4, when the Rukunegara was first mooted for our well-being and that of the nation, at large. I remember that fateful day when some of us were chosen to recite the Rukunegara during our school assembly. I was afraid I couldn't pronounce the word "technology", though during my school days, my memory was eidetic. Now, you can tell me any secret; I'll forget it the moment you finish speaking! So, I digress, like RPK would say.

Anyway, I would think that living in the "best democracy" in the world, when those 8 bills were passed in such haste, it was for our own good, as if tomorrow might never come! Or is it a case of "Necessity is the plea for every infringement of human freedom. It is the argument of tyrants; it is the creed of slaves…William Pitt". We live under a tyranny and we are slaves? How come? You could have fooled me!

I thought we were living in a Parliamentary Democracy where we, who are qualified to vote take part in elections and choose politicians to represent us in a Legislative Assembly. We choose these politicians. We, and they, these politicians, see to it that our best interests are taken care of. They, these politicians are supposed to be elected by us, us, so that they can redress our grievances. How is it that those amendments bulldozed through when time stood still were not done in our best interests?

How come there's more room for cheating now? For slandering? No way to check the identity of voters or that they voted only once? And who's that dope who pronounced that we have the cleanest electoral register in the world? Please-lah, we are already the greatest laughing stock in the world for tagging ourselves the best democracy in the world, now you want the international community to die laughing, calling our electoral register the cleanest in the world? Don't just say anything to get into the Guinness Book of World Records-lah! These Guinness people will have to come and verify, no? Can they come and verify for sure we are the best democracy in the world and that we have the cleanest electoral register in the world? Can? Maybe, that will be good!

Can they come and verify that we have the freedom of expression, freedom of speech and freedom of the press, so that we, Malaysians, are adequately informed and able to vote according to our best interests as we see them? Or will they come and see that some people are voting from beyond the grave, voting more than once, or those unqualified get paid to vote for some unscrupulous people? Or Malaysia is so "free" a country that some of the posters or banners strewn all over are not a sight for sore eyes, instead, they are an eye-sore?  Malaysia Boleh, huh, now?

Let's not try to get in the news for all the wrong reasons. Let's just get back to basics. Let's just go back to square one. We are supposed to have voted in, an egalitarian form of government. One, in which all the citizens (as in live ones, ok?) of our nation together determine policies, laws and actions of the state that will preserve peace, harmony and unity of our beloved nation. One, that will preserve the spirit of the Rukunegara.

One, that will preserve equality and freedom where all citizens are equal before the law and have equal access to legislative process. One, where the freedom of its citizens is secured by legitimized rights and liberties which are protected by our constitution. (For that matter, let's claim back our constitution which has been hijacked, lately!) One, that will preserve the sanctity of our vote.

Till then, I'm appealing to all right-minded Malaysians, let's "Jom, Duduk Bantah". Make your vote count. See you guys there, I'll be at the Malacca version. Come and say "hi".

Ibrahim 'the Katak' Ali & geng nak 'tibai' Anwar di Permatang Pauh...

Penghinaan Terhadap Anwar Tidak Memberi Bekas...

Sayuti Omar, msomelayu.blogspot

Perkasa to launch campaign against Anwar
Malay rights group Perkasa will launch a campaign to "expose" opposition leader Anwar Ibrahim, said its president, Ibrahim Ali.

Blaming Anwar for putting the Malay political power in disarray, Ibrahim said the opposition leader's antics were also damaging to PAS, but benefited the DAP.

He was speaking to reporters at the launch of the 'Tolak Individu Bernama Anwar Ibrahim' (Tibai) roadshow in Kuala Lumpur last night.

Meanwhile, Ibrahim said he was willing to stand against Anwar in the Permatang Pauh parliamentary constituency in the next general election if he was given the opportunity to do so.

! He said Tibai was made up of 28 member groups.- malaysiakini

cheers.

Testimonial siapa yang lebih baik? Tunku dan Hussein Onn atau yang lain-lain?

—Aspan Alias
The Malaysian Insider
Apr 23, 2012

Lagu "Selamat Hari Raya" hanya berkumandang semasa kita menghampiri Hari Raya Puasa. Lagu-lagu ini datangnya bermusim. Bila habis Hari Raya hilanglah lagu selamat Hari Raya. Begitu jugalah lagu nyanyian Najib.

Death of Burmese migrants in the custody must be probed

FMT LETTER: From Mekong Migration Network, via e-mail

On April 17, while the people of Thailand were enjoying the long holidays for the New Year and Songkran water festival, two Burmese migrants were found dead in the back of a deportation vehicle.

Maungg Soe (25), and Ms Ma Mi Lar (36) were two of 62 migrants being deported from the Sadao Immigration office, in Songkhla Province, southern Thailand to Burma via the Mae Sot border crossing.

While the breaking news reports suggested that the migrants died as a result of having been crammed into an overcroweded truck during hot weather, the exact causes of death have yet to be verified.

Subsequent enquiries by the Mekong Migration Network (MMN) with the Mae Sot immigration as well as police departements confirmed that the deportation vehicle left Sadao on April 16, and arrived at Mae Sot the following day.

The immigration officer responsible for overseeing the operation at the time of writing have yet to be interviewed in relation to the incident. A Mae Sot police source also said that the bodies of the two dead migrants and the other deportees, including the relatives of the deceased, had already been deported from Thailand.

The MMN is deeply concerned over these tragic deaths and the subsequent actions of the Thai authorities. The deaths raise serious questions about the safety and treatment of migrants held in Thailand's deportation process.

Between 2005 and 2008, MMN conducted collaborative research on the use of Arrest, Detention and Deportation (ADD) in the six Mekong countries. In this study we found that migrants are commonly held for unacceptably long periods aboard vehicles used in the deportation process and that they generally have very limited access to medical care.

Thailand is party to a number of international treaties pertinent to the treatment of persons in detention. They include the International Covenant on Civil and Political Rights (ICCPR) and the Convention Against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment (CAT).

Furthermore, in accordance with the UN's Body of Principles for the Protection of All Persons under Any Form of Detention or Imprisonment: "All persons under any form of detention or imprisonment shall be treated in a humane manner and with respect for the inherent dignity of the human person".

In July 2010, MMN made urgent representations to the office of the Special Rapporteur on the Human Rights of Migrants to draw attention to four separate incidents in which 23 vulnerable migrants lost their lives in immigration detention or during enforcement action carried out by the Thai authorities.

MMN is not aware that any steps have been taken to prosecute the officers responsible for these tragic incidents. In response to the latest tragedy, MMN urges the Royal Thai Government to:

  • Immediately conduct a full and impartial investigation of this tragic event including the situation of detention of the migrants prior to deportation, the health care and treatment received by the migrants who subsequently died and the conditions of transportation;
  • Urgently support autopsies of the two migrants who died to establish the cause of death;
  • Facilitate access to justice for the families of the victims including compensation;
  • Provide medical checks, treatment and care including voluntary access to counselling for all the migrants who were in the vehicle and who may also be sick and/or traumatised;
  • Ensure that all those whose actions or negligence caused or contributed to the deaths of the two migrants are punished according to the law.
  • Review the arrest, detention and deportation procedures to ensure that they protect the rights of migrants and respect their dignity.
  • Take immediate steps to ensure that the deportation of migrants is governed by laws that are in compliance with international standards.

The Mekong Migration Network is a sub-regional network of 39 NGOs working on migration issues in the Greater Mekong Sub-region.

‘SUPP died because of Taib’

KUCHING: Sarawak's Chief Minister Abdul Taib Mahmud's long tenure in office has been cited as one of the reasons behind Sarawak United Peoples Party (SUPP) loss of 13 seats in the April 2011 state election.

This is the claim made by former deputy chief minister George Chan in his book entitled 'What Now?' which was launched by Prime Minister Najib Tun Razak in December last year.

Chan who stepped down as SUPP president in December following his defeat in the Piasau seat said: "Another election issue that the opposition had brought up was the long tenure of Chief Minister Pehin Sri Abdul Taib Mahmud.

"His refusal to step down and appoint a successor became an unnecessary diversion from our achievements.

"The issue was further exacerbated by unfounded allegations of (Taib) amassing a huge fortune while in office which were posted in numerous websites especially the Sarawak Report," he said.

Chan revealed that he had earlier been warned by a leader of Movement for Change Sarawak (MoCS) leader Francis Siah urging SUPP to abandon Taib or else the party would be buried, but he ignored it.

The warning was carried out widely in the local and national media as well as online newspapers.

The former DCM quoted Siah as saying that "SUPP must not be blind to the writing on the wall.

"For too long, the party has (had) an image of being a mere stooge of the Chief Minister. To continue supporting Taib now will seal the fate of SUPP. The others have enough of Taib".

SUPP was warned

Siah said that SUPP had been barking from the inside for the past 40 years, and the party had been ineffective in looking after the interests of the Chinese.

"Only a few top SUPP leaders have benefited and had become immensely wealthy after barking inside for 40 years.

"So to the Chinese community, barking inside or outside does not make any difference.

"In fact the Chinese should now start barking against Taib from all corners – inside, outside, upside and down-size," Siah said.

"Looking back, it seems what Siah said turned out to be factual. SUPP was almost buried after the April 16 election," Chan said, referring to the loss of 13 out of 19 it contested.

Four of the seats were won by Dayak representatives of the party.

Chan who took over the leadership of the party from Wong Soon Kai after the 1996 state election also cited other reasons for the loss of 13 seats.

These reasons include weak party organisation and publicity, SUPP perceived as weak partner in the state government, fuel hike, land lease issue, state government contracts, open tender, and Chinese language education.

On government contracts, Chan said many Chinese businessmen were increasingly concerned about the lack of transparency and accountability on the awarding of the contracts.

Several large infrastructure projects were awarded without notice or an open tender.

"We have to remember that business is the lifeline of the Chinese community and any perception of a lack of transparency and accountability in government contracts will cause them to turn against us," he said.

Issues exploited by opposition

He suggested that state government contracts which were not complicated and complex in nature be awarded by way of open tender.

Referring to the Chinese language education, Chan said that for many years now, the issues relating to the continued funding for Chinese schools, government support, building of new Chinese schools, new licences or relocation of existing Chinese schools and using English to teach mathematics remain unresolved.

"These issues were fully and effectively exploited by the opposition, and the party was perceived to be weak, ineffective and unable to correct the unpopular policies implemented or to be implemented by the state government," he said.

Chan also warned the government that it should ensure that no community should be sidelined or victimised, especially in the opposition-controlled areas; otherwise there would surely be additional retaliation in the 13th general election.

"So we need to win them back. The Barisan Nasional needs to show that it also feels and cares for the urban voters," he said.

On the book, he said that it reveals the happenings in Sarawak's oldest political party in recent times, including tribulations it has gone through and which it is still going through, and the things it should do, – and not do – to stay relevant.

"My purpose of authoring this book is not to point the finger at anyone but to tell members and readers – from my perspective – the direction the party has to take from now.

"What Now?, is a must read for the younger readers and the busy people who might not have had the luxury of time to go through scores of newspaper articles about SUPP," he said.

SUPP’s Chin warns party dissidents

KUCHING: The six state assemblymen and one MP of Sarawak United Peoples Party (SUPP) who failed to abide by the party decisions and continue to undermine party unity and interest may face disciplinary actions and end up like the now partyless former 'SPDP 5'.

The former 'SPDP 5' or G5 (group of five) consisting of Tiki Lafe ( MP for Mas Gading) and elected representatives Peter Nansian (Tasik Biru), Sylvester Entri (Marudi), Rosey Yunus (Bekenu) and Paulus Gumbang (Batu Danau). All five were expelled from Sarawak Progressive Democratic Party (SPDP) in November last year for gross insubordination.

The six SUPP assemblymen likely to go the same way are Wong Soon Koh (Bawan Assan), Lee Kim Shin (Senadin), Jerip Susil (Bengoh), Ranum Mina (Opar), Francis Harden (Simanggang), Johnichal Rayong (Engkilili) and the MP for Lanang Tiong Thai King.

SUPP president Peter Chin issued a general warning to errant members after chairing the party's Central Working Committee (CWC) meeting yesterday.

"If any such group of members or member carries out activities prejudicial to party interests, we will not hesitate to institute disciplinary action against such members or groups responsible irrespective of their positions," he said.

Chin did not name any SUPP members, but it was obvious that he was referring to the group led by Wong, who is the chairman of SUPP's Sibu branch and state's Second Minister of Finance.

The seven have not only failed to attend the CWC meetings since the triennial delegates conference in December last year, but have also refused to recognise Chin as the president of the party.

Wong and team alleged that Chin was elected through irregularities and manipulations of party elections.

Two sets of names

Wong is said to have submitted the list of his parliamentary candidates to Chief Minister Abdul Taib Mahmud and Prime Minister Najib Tun Razak, bypassing Chin.

'We will not like to see that there are groups of party members either championing for themselves or claiming to be SUPP candidates.

"Anybody can put up any candidates, but SUPP can only have one candidate for one seat. If they are talking about nominating candidates, if there is any movement by party members who campaign or lobby against our candidates, we will not hesitate to take disciplinary action.

"That I am very clear," he said, pointing out that the BN procedure is that those candidates who pass through SUPP are the official candidates.

"It is our wish that the party performs credibly to win these seats and all party members must work together to support the party candidates.

"As I have said we are going to institute disciplinary action against any member irrespective of their positions if they are found to be campaigning against our candidates," he said.

SUPP has been allocated seven parliamentary seats – Serian, Stampin, Bandar Kuching, Sarikei, Lanang, Sibu and Miri – to contest.

Chin announced that Richard Riot would be nominated to defend the Serian seat, while the incumbent MP for Sarikei Ding Kuong Hiing would be for Sarikei, and SUPP Youth Chief Tan Kai for Bandar Kuching.

Candidates to be decided

As for Stampin, Chin said that a committee comprising himself, party secretary-general and its treasurer-general would go through the list of six candidate submitted by Batu Lintang, Batu Kawah and Kota Sentosa branches.

"Once we have perused the list, then we will recommend to the CWC for a decision," he said.

On the Miri seat, Chin who is the incumbent MP said that the branch would be meeting very soon to decide who would be the candidate.

As for the two seats of Sibu and Lanang, Chin said that the CWC had not officially received the names of the candidates for the two seats, and because of that the CWC could not make the decision.

Chin hoped to receive the names from the Sibu and Lanang liaison committee chairmen before April 30, 2012, but declined to answer when asked what he would do if the two chairmen failed to submit their recommendations to him.

"We will cross the bridge when we come to it," he said.

He said he would personally hand over the list to the Prime Minister for his endorsement.
