TBH - 3 MACC officers cleared of wrongdoing by AG...

NONEThree Malaysian Anti-Corruption Commission officers implicated by the Teoh Beng Hock royal commission of inquiry have been cleared of wrongdoing.

In a Parliamentary written reply,
de facto Law Minister Nazri Abdul Aziz said the trio have been cleared by the Attorney-General's Chambers.

"Thus, no action will be taken against the three officers," he said.

Nazri was responding to a question by Gopeng MP Dr Lee Boon Chye, who asked the government to specify what kind of action has been taken against the trio.

The three-member RCI led by former Court of Appeal judge Steve Shim had found the three MACC officers' aggressive interogation tactics have contributed to Teoh's suicide on July 16, 2009.

The trio are then-Selangor MACC deputy director Hishammuddin Hashim, assistant enforcement office Arman Alies and assistant superintendent Mohd Ashraf Mohd Yunus.

They were suspended in July last year pending investigations. Hishamuddin has since been promoted to Negeri Sembilan MACC director while the current status of Arman and Mohd Ashraf is unknown.

Mere disciplinary infraction

In the final RCI report recommended MACC to take action against the trio, whom they
described as Arman "the bully", Mohd Ashraf "the abuser" and Hishammuddin "the arrogant leader".

azlanNazri said that the Attorney-General's Chambers have examined statements presented by the police who investigated the three based on evidence adduced during the inquest and RCI.

Following this, the Attorney-General's Chambers found that the trio did not commit a crime based on Penal Code or the MACC Act 2009.

He added that the MACC's special investigation team had also cleared the trio of violating the Civil Service Regulations (Behaviour and Disciplinary) 1993, MACC Act 2009 and the commission's internal rules.

"Based on this investigation, it was concluded that only one disciplinary charge can be made against (the trio) - a charge of failing to supervise the witness being investigated," he said.

In a related development, Nazri was asked by Serdang MP Teo Nie Ching what was the result of investigations against the trio under Section 304A of the Penal Code (death caused by negligence) and Section 120A of the Penal Code (concealing a design to commit an offence).

In his written reply to Teo, Nazri said a
police report based on the quoted laws have been made by Teoh's sister.

"The investigation papers have been referred to the state prosecution chief and the Attorney-General's Chambers for investigations and advice," he said.

To tutu or not to tutu

Fearing a riotous backlash from Malaysia's hyper-sensitive, albeit slightly blur, rakyat, the Malaysian Bureau of Riotous Eccentricities & Delusions (BORED) had yesterday decided to ban tutus or any performances involving tutus anywhere in Malaysia.
Tutus, apparently, from now on, are deemed riotously indecent as it may cause a proclivity to immense sexual desires which in turn may result in an increase of illegal shagging, which ultimately, will end in baby dumping, change of faith (especially among the Muslims) and an inexplicable – and highly undesirable -  liking for Barry Manilow's songs.
It remains hazy – as it always is in Malaysia around April every year – whether short skirts, tight hot pants, bikinis, swim suits, g- strings, kebaya nyonya and tight kain batiks as well as Aznil Nawawi are going to be deemed indecent anytime soon.
Speaking on the condition of absolute anonymity, a spoke person of the Organisation of Malfunctioning Governmental Shit-Heads (OMGosh) – a new NGO established to defend riotous edicts by various governmental agencies – said yesterday that tutus are Christian Zionists' propaganda tool which is insidiously aimed at the sub-conscious zone of every person, especially males of between 13 to 84 years of age. Tutus are thus malevolent agent! s of the Christian Jews who are hell bent on destroying the rakyats through sex, sex and sex.
Says the spoke person (quoted verbatim):
"We iz very the worried at diz tootoo coz dey iz work below the otak and the rakyatz not realise wen dey see tootoo dey all become like zombie like dat, dey no realise dey being converted by diz jahat evil Kristian Zionis. We at OMGosh tink diz tootoo is same with der tattoo which last month dat Erika Badu wanted to use to brainwash the rakyats."
OMGosh, according to the spoke person, has a 42 minute video (in HD) to prove its allegation that the poor and very weak Malaysian rakyats are being cock-and-bull- washed by tutus. It is estimated that to date, 17000 rakyats have been totally "turn-around upside down" by the tutus.
Meanwhile, another NGO, Centre for Complete Kookooness (COCK) today releases the result of a recent survey involving about 300 males who watched the uncensored version of Black Swan in  controlled environments, including their bedroom and toilets. The survey reveals a shocking 5 of them having a complete hard on during the full duration of the movie, even during the scene where Nina-the-ballerina-in-a-tutu was lying bleeding.
That proves that tutus are indecent, says the Chairman of COCK.
The Chairman further says that although he is definitely not racist or anti-Semitic, the fact that Natalie Portman, who plays the leading ballerina in that movie is Jewish did not escape his attention. According to him:
"Dat ah, pruf ferder dat der tutu and der Juice are axiz of evil."
As of the time of writing, it remains unclear – as is usual here – whether Dato' Nicol David will be allowed to play squash in Malaysia wearing a short skirt as she usually does in every other tournament around the globe. It also remains completely a mystery whether in the next SEA games, Malaysian body builders are going to have to perform in kain pelikat and oversized baju batik.
Meanwhile, in an unrelated, but most probably connected, news, the organisers of a public forum on "Christian Aqidah – are we threatened by Dong Zong?" today announce that they are seeking a clarification whether the tutu ban will affect Bishop Desmond Tutu's visit to Malaysia next week. He is supposed to deliver a key-note address at the forum.
Ternama News Agency: 5th April 2012 (four days after April Fool's day).

Filial daughter

Pictures: 12-year-old girl takes care of her brain-damaged father alone

In a remote village of Guanling County, Guizhou Province, a 12-year-old girl, named Huang Puli, was forced to leave primary school to take care of her father, who suffered a severe brain damage from falling a tree last year on December 19. Huang's mother has never come back after she left home three years ago.
That is a poor village, lack of basic infrastructure and facilities. Huang's family is even poorer. It is no exaggeration to say that she has nothing, but walls, and an elderly grandmother and a "vegetable" father now.

For such an utterly-destitute family, high medical costs have become a great burden. Huang Puli has borrowed 110 thousand yuan to pay the neurosurgery department of Anshun City People's Hospital of Guizhou Province where her father is receiving the treatments.
Every morning at around 6:00am, the first thing that Huang Puli does after waking up is to help her father to do exercises in bed, and then practice massage to him.
At 7:00am, she goes to cook porridge to feed her father herself.
From 9:00am to 12:00am, she sends her father to undego oxygen therapy.
After lunch, the girl begins washing her father and repeats body massaging. Sometimes, her granny is there to help her too.
She has to suck out the sputum from her father through a tube when necessary.
At 5:00pm, when the vegetable vendors start their business, Huang heads to buy some vegetables and meat to cook dinner for her father.
The father needs to change the clothes regularly. Under help from the nurses, Huang changes the clothes for her father.
And before Huang Puli goes to bed, she washes her father's body again and applies medicine to his wounds too. The next day, the little girl repeats the same job.
Huang Puli's story has moved everyone who knows about her. The primary school has helped raise 50,000 yuan to her, and the village also collected a donation of 1,800 yuan.
March 25, a netizen, nicknamed Journalist Min Yunxiao, tweeted the story to the Tencent microblog, causing a strong reaction on the Internet too. Netizens started donating their moneyto the little filial girl.

Massive deception and propaganda campaign afoot that PSC majority report complies with seven of ...

Lim Kit Siang

A massive deception and propaganda campaign is afoot, making full use of public funding and mobilising the mainstream media and Barisan Nasional cybertroopers, to create the impression that the majority report of the Parliamentary Select Committee (PSC) on electoral reform complies with seven of the eight Bersih 2.0 Demands for clean, free and fair elections when in actual fact, only one is being implemented.

The only one of the eight Bersih 2.0 Demands which is being implemented is Bersih 2.0 Demand 3 on "Use of Indelible ink" while the other seven Bersih 2.0 Demands are either given partial and unsatisfactory responses, or mere lip-service and meaningless recognition or outright rejection as in Bersih 2.0 Demand 4 on "Minimum 21 days campaign period".

The eight Bersih 2.0 Demands that motivated 50,000 Malaysians transcending race, religion and region to support the historic July 9, 2011 Bersih 2.0 rally were:

  1. Clean the electoral roll

  2. Reform postal ballot

  3. Use of indelible ink

  4. Minimum 21 days campaign period

  5. Free and fair access to media

  6. Strengthen public institutions

  7. Stop corruption

  8. Stop dirty politics

The best example of the failure of the PSC majority report to address the core demand for a clean, free and fair election is Bersih 2.0 Demand 1 on "Clean the electoral roll", which states:

"The electoral roll is marred with irregularities such as deceased persons and multiple persons registered under a single address or non-existent addresses.
"The electoral roll must be revised and updated to wipe out these 'phantom voters'. The rakyat have a right to an electoral roll that is an accurate reflection of the voting population."

This is also why Pakatan Rakyat parties of DAP, PKR and PAS fully supported the three Pakatan Rakyat MPs on the PSC, Loke Siew Fook (Rasah), Mohamed Azmin (Gombak) and Dr. Mohd Hatta (Kuala Krai) in their effort to append a minority report, as the PSC majority report had failed to deal with the crux of the problem to ensure clean, free and fair elections and guarantee a clean, comprehensive and legitimate electoral roll in the 13th general election.

The fatal weakness of the PSC majority report is its failure to acknowledge the many problems in the electoral r! oll and the total absence of a commitment to address all of these problems before the 13GE since they can affect the balance of power in the upcoming General Election.

The fact that there are significant problems with the Malaysian electoral roll is not something new. Allegations of phantom voters and illegal immigrants being given fake ICs in order to register themselves as voters have been well documented. For example, the election results in the state seat of Likas in the 1999 Sabah state election was declared invalid by the Election Court because of the presence of phantom voters in the electoral roll.

Given these past problems with the electoral roll, it is highly inappropriate for the PSC majority report to only highlight just one problem to do with the electoral roll which is addresses which have more than 50 registered voters.

The PSC majority report blatantly ignores the other problems with the electoral roll which have been discovered including:

  1. Over 31,000 names which have been shifted from state and/or parliament constituency to another without their knowledge as a result of the 'stealth correction' of boundary lines of state and parliamentary constituencies by the Election Commission which is illegal and unconstitutional

  2. The failure of the Election Commission to delete over 42,000 names of voters whose citizenship status cannot be verified by the National Registration Department (NRD).

  3. The failure of the Election Commission to verify the status of over 65,000 voters aged 85 years and above including over 1000 who are more than 100 years old.

  4. Over 15,000 names whose IC numbers show a different gender than the Election Commission records.

  5. Over 4500 names of spouses of police who are registered as postal voters when they are clearly not entitled to this right.

Pakatan Rakyat has provided concrete evidence of all these prob! lems bu t they have not been recognized in the PSC majority report.

The total number of voters associated with these problems adds up to over 150,000 and many of them are located in marginal or swing constituencies that will be closely contested in the next general election.

More worrying is the high possibility that these problems are only the tip of the iceberg underneath which hides massive electoral fraud.

Sabah after the 1990 election and Terengganu after the 1999 election are just two examples where there were sudden increases in the number of voters in the electoral roll in the states to enable the BN to win back the state government from the Opposition.

Now we see the same pattern being repeated in the state of Selangor leading up to the 13th general election.

The number of voters in Sabah increased by 17.6% from 1990 to 1995 compared to the national average of 13.0%. This was after PBS left the BN coalition prior to the 1990 Sabah state elections and was in charge of the state government from 1990 to 1994.

In the state of Terengganu, the number of voters increased by a whopping 17.7% from 1999 to 2004 compared to a national average of 7.3%. Again, it is noteworthy that the state of Terengganu had fallen to the opposition during the 1999 general elections.

In 1999, the opposition won 28 out of 32 state seats and all 8 parliamentary seats. In 2004, after this massive increase in the number of voters, the opposition won only 1 parliamentary and 4 state seats, an almost total reverse of the 1999 general election results.

In Selangor, according to the 4th quarter 2011 electoral roll, the number of voters has increased by over 340,000 to more than 1.9 million voters since the 2008 general election.

This represents an increase of 21.8% compared to a national average of 16.3%. Some of these increases have occurred in areas which limited increases in the number of new housing estates and population inflows. For example, the seat ! of Hulu Selangor, a marginal parliamentary seat, saw an increase of more than 17,000 voters or 27.1% from the 2008 general election to the 4th Quarter 2011 electoral roll.

It was reported that over 1,100 voters Permanent Residents were included in the electoral roll in Selangor including one 'Mismah' whose status was quickly upgraded from PR to Citizen upon the discovery of her inclusion in the electoral roll.

These examples highlight the possibility of large scale systematic cheating with the intention of recapturing the state government of Selangor. Again, what has been discovered so far may only be the tip of the iceberg.

The Minister in the Prime Minister's Department Datuk Seri Nazri Aziz had argued in Parliament that the fact that five state governments fell to the opposition in 2008 was proof that the electoral rolls are not tainted. One should ask whether the opposition could have won control of more states and perhaps even the federal government if the electoral roll were totally clear of phantom voters.

BN is fighting for its political survival and would do anything to remain in power including padding the electoral roll with phantom voters using various tricks and strategies. It is essential that the electoral roll be clear of these phantom voters to ensure that the upcoming 13th general election does not turn out to be a massive electoral fraud in the making.

The exclusion of the highlighting of these problems in the PSC Report on Electoral Reform makes a mockery of the intent to deliver a freer and fairer electoral system to Malaysians.

Tobias Lars ~ Reawakening the Heart

EXCERPT FROM AWAKENING SOULS BY TOBIAS LARS

In a divided, schizoid, creation where the Male and the Female wage the 'war of the sexes' with each other…with the heart, caught in the middle, being hung on the cross to bleed, and in a very real danger of having the whole Earth experiment go down the drain.

Nymphs, Garden Devas, Rock Beings & Wind Dragons

Yes, so now here we are in a twisted creation of 'fallen' divided, schizoid, Jekyll & Hyde, un-wholy beings who are for the most part severely out of touch with their feelings, disconnected from their intuition, with not much joy or power left, addictively-obsessively trying to find nourishment in over eating, over thinking, over working, over exercising, over 'being positive,' over indulging in media, etc. We can't even hear or see the Devic Kingdoms anymore, the Nature Spirits. Can you feel or see the water nymphs, the garden devas, the rock beings, the wind dragons? No, the vast majority of us can't and when our kids do we tell them they're 'imaginary' and that they'd better stop doing it or we'll give them Ritalin or Prozac. We're almost completely out of touch with our Selves and rapidly killing our selves, the animals, plants and Mother Earth.

A while back, after a particularly powerful Activation Session for a client, I walked outside and felt the earth, the fruit trees, the wind as part of me. I felt like I was permeable, transparent to everything around me. I was pulling a garden hose towards an apple tree to water it. As I pulled I heard a loud 'STOP' inside my mind. I turned around and saw that a small 12" 'baby' apricot tree was in danger of being hurt by the hose I was pulling towards the apple tree. I turned momentarily to put the hose down. I saw in my minds eye, the third eye, the center for Christ Consciousness, a gnome, about 2 ft tall, lift the hose over the baby apricot tree and place it on the other side. I turned around and the hose had somehow 'miraculously' lifted itself over the little apricot tree and was laying now on the safe side where I could pull on the hose as much as I wanted and not have it push against the baby tree! Wow. I felt happy, giddy, full of joy.

I realized as I asked God, why couldn't I have seen the gnome-friend physically, that I wasn't quite ready to view them fully embodied. Being able to see and feel and allow other dimensions to fully manifest it seems that one needs to be fair-ly (thanks fairies!) pure in order to be able to fluidly move between dimensions. Later I tried to share this experience with some friends and I 'd watch their eyes glaze over somewhat. So it is, only those who are at the cusp themselves can feel and know the truth of these experiences.

The Findhorn Community in Scotland started by Eileen Caddy and two friends, started out by their talking with Pan, the God of the Earth, and growing vegetables in sand with practically no water. Today she's been honored by the Queen of England and there's a large eco-community and spiritual center established. There's a woman in Michigan at Lily Hill Farm, that allows people to come and visit and connect with Pan, the fairy kingdom, and devas. She met Pan physically in her grape orchard, the fairies would come visit her physically. She was a straight laced librarian, her husband an engineer when this started.

These worlds are all around us, if we are open. These worlds are part of the Original Plan for Earth, we can't just wipe them out by denying them, or suppressing them, or deciding mentally that they 'aren't real'. Feeling our emotions and cleaning-clearing our judgments-misunderstandings-past emotional stuck traumas will open our abilities to perceive again.

From the original judgment against the Emotional Body came the model that to reach 'enlightenment' one must successfully 'kill' the 'lower' emotions that we've labeled hatred, envy, greed, lust, anger, etc. Or more sophisticated: to 'rise above them,' to 'let them go' through 'non attachment' to have 'no judgment' on them.

Ex-communicating parts of our Souls

How do you think a child feels when its parents 'lets it go,' lets them loose as they are hanging from a ledge over the bottomless Abyss, we let our grip loose and let them fall into the Pit? "Goodbye sweetheart, it is for your own good," we say as they fall screaming in terror into the black, empty, cold, Void. How would they feel? This is 'loving'? That is what we have all done to those parts of ourselves that we've labeled 'wrong,' 'base,' 'lower'. We have literally abandoned parts, chunks, bits of our Souls because we labeled them 'bad', 'unspiritual,' 'reactive,' 'counterproductive,' 'lower,' etc. So we have 'let them go.' We have sent them to hell, banished them to the ends of the universe with our 'prayers' and 'exorcisms,' and much of our spirituality. Is it any wonder that some of these 'orphans,' these rejected aspects of our Larger Self are a bit pissed off? And that they don't exactly trust us anymore because almost all our healing modalities have at their root still a wanting to get rid of these pesky, irritating, 'wrong,' 'evil,' or again more sophisticated, 'unproductive' feelings?

Look around - most of the 'healing techniques' out there are about 'rising above,' 'letting go,' 'trans-cending' (sending into a trance!), becoming 'clear,' etc.

This is a basic delusion – misunderstanding, that there are 'bad', 'dirty' parts of ourselves that we can simply abandon, 'let go,' and somehow become enlightened. You can outrun them for a while, pretend you don't have them, but they are connected to us by a spiritual umbilical cord and they need to be 'healed' – wholed – reintegrated – welcomed home, taken back into you. Don't run from them, try not to think about them, stay busy to avoid, avoid, avoid, but turn and face them and transform them back into what they are meant to be. Soul Retrieval is a practice, if done correctly, that does this. All our 'designer diseases' today – cancer, Alzheimer's, Parkinson's, Chronic Fatigue, etc., etc., are all diseases of the Soul, parts of our Souls that need to be welcomed back, transformed and healed.

Dismissal of headman TR Eri quashed by Court

HU Editor

TR Eri ak Ajok is the Tuai Rumah of Kampung Emplas situated at Simunjan, Sarawak and taking care of a longhouse consisting of about 35 pintus. Encik Eri Ak Ajok was chosen by the villagers of Kampung Emplas as the Tuai Rumah since 1961 after he succeeded from his father, TR Ajok ak Mambu and was officially appointed by the Resident of the First Division on the 14.04.1982.

On 30.06.2011, TR Eri was given two letters written by the District Officer of Simunjan and the Director of Human Resource Management Division of the Chief Minister's Department by a resident from his longhouse, Berandah anak Leben informing the Plaintiff that he was terminated as a Tuai Rumah since 01.04.2011. The Plaintiff was not given any reason whatsoever as to his termination of service as Tuai Rumah despite the Tuai Rumah still having the support of 20 pintus that he is to continue as the Tuai Rumah.

The Tuai Rumah courageously against all odds filed this application for judicial review and the learned High Court Judge, Datuk Rhodzariah Bujang today allowed the Tuai Rumah application and gave declaration that the letters of Termination of Service as a Tuai Rumah by the 1st and 2nd Defendant are unlawful, illegal, null and void and of no effect and therefore the decision of the District Officer to terminate the service of the Tuai Rumah is effectively quashed.

In delivering her judgment, Datuk Rhodzariah stated that the Circular Memorandum dated 2.10.1980 proves that the applicant's appointment as a Tuai Rumah is contractual and is clearly stated to be at the pleasure of the State Government. However, the learned Judge observed that it cannot be denied that in the days of old, prior to this Circular, a Tuai Rumah was appointed by way of 'adat' or tradition based on the support the appointee enjoyed from the majority of the household in the longhouse, such consideration is no longer the determining factor in the post Circular period. The terms and conditions in the Cirucular therefore bind the Tuai Rumah and the prerogative of the appointment lies solely with the State Government even though there is a probability that the Tuai Rumah still enjoys the support and confidence of the majority of the households in his longhouse.

However, the learned Judge found that the Tuai Rumah was only informed of his termination 2 ½ months after the termination took effect and he was paid the honorarium 4 ½ months later and therefore the inordinate delay in conveying the decision on the termination is in complete defiance of reason and logic.

The learned Judge opined that the decision to terminate the Tuai Rumah must logically and of necessity be communicated to a Tuai Rumah before the effective date of termination or at the very least, on the very day of the termination itself and ideally, the honorarium be paid at the same time as when the decision is communicated.

The learned Judge also stated that: "What is the use and where lies the logic of telling a man that he is no longer the anointed leader long after his appointment has been revoked? It is not only unfair to the Tuai Rumah but to the community he serves for there are ramifications following such a delay. A Tuai Rumah in that same position the applicant would and could have happily performed his official duties as Tuai Rumah such as the common act of certifying or verifying documents for his people when in fact he was no longer holding the post as one. Therefore, the act of notifying him of the termination only so many months after the effective date, even if one were to excuse the delay in payment of the honorarium has rendered the termination bad in law and the letter of termination null and void.

The learned Judge ordered that the Tuai Rumah be paid the arreaers of his honorarium from April 2011 until to date and that the termination is illegal, null and void and of no legal effect.

PKR: Keluarga Shahrizat cuba lupuskan aset NFC

Gobind upset A-G ‘vindicated’ MACC

PETALING JAYA: DAP lawyer Gobind Singh Deo said today that he felt "very upset" that the Attorney-General's (A-G) Chambers has cleared the three Malaysian Anti-Corruption Commission (MACC) officers implicated in the death of former political aide Teoh Beng Hock.

"I think this decision flies squarely in the face of the Royal Commission of Inquiry [RCI] report. The findings by the RCI were clear: there was sufficient basis for action to be taken, including disciplinary action as well as criminal charges," said Gobind, the Puchong MP, who has been the Teoh family's main legal representative.

Earlier in Parliament today, Minister in the Prime Minister's Department Nazri Abdul Aziz said in a written reply to Gopeng MP Lee Boon Chye that the A-G had found that the MACC officers had not committed any offence either under the Penal Code or the MACC Act.

Gobind said that this latest announcement shows that the government does not respect the findings of the RCI at all.

"What the A-G has done clearly reflects very badly on the RCI proceedings. If we have spent time and effort in establishing a RCI, which investigated the matter and made certain findings based on evidence and sworn witness statements, it should have been acted upon," he said.

He also criticised the A-G for not supplying any concrete reasons for the case to be closed.

"There is no reason for the three persons named [in the RCI findings] to be cleared. All we have is a very general statement stating say there was no evidence. I have asked but they could not tell me who was being investigated or what was being investigated," Gobind said.

He said he had previously suggested that the A-G could use Section 330 of the Penal Code for the offence of "voluntarily causing hurt to extort confession…" to charge those men with driving Teoh to suicide.

When contacted, Teoh's fiancée Soh Cher Wei, who married Teoh posthumously in 2009, only said: "No comment. I'm so sorry."

Open verdict

Teoh, 30, was the political aide of Selangor executive council member Ean Yong Hian Wah. He was found dead on July 16, 2009, on the fifth-floor corridor of Plaza Masalam in Shah Alam after he was questioned overnight by the MACC officers on the 14th floor.

Teoh was a witness into investigations of alleged abuse of state funds by Ean Yong, who had since been cleared of any wrongdoing by the MACC.

The RCI, which was set up after a coroner's court returned an "open verdict", found that excessive aggression in interrogation methods drove Teoh to commit suicide.

Inspector-General of Police Ismail Omar had said that there are no laws to charge the three MACC officers, while the MACC said it would deal with them internally by setting up a special investigative team.

The five-man RCI panel, headed by then federal court judge James Foong, had singled out the three officers who were involved in the interrogations. They were Selangor MACC deputy director Hishamuddin Hashim and his subordinates Mohd Anuar Ismail and Mohd Ashraf Mohd Yunus.

Contrary to the RCI report which named the three men, the Bar Council – which actively participated in the RCI – had recommended that five MACC officers be investigated for culpable homicide.

The five officers include Hishamuddin, Mohd Anuar and Mohd Ashraf as well as Selangor MACC investigations chief, Hairul Ilham Hamzah, and Klang MACC assistant enforcement officer Zulkefly Aziz.

The Bar had recommended that the five be investigated under Section 304A of the Penal Code for causing the death of Teoh via negligence.

On Oct 24 last year, Nazri said that Attorney-General "was not compelled" to pursue the case, due to lack of evidence and witness accounts, but will do so if new evidence surfaces.

Azmin-baiter Isa sacked last month

KUALA LUMPUR: Isa Mohd Saidi lost his position as Ampang PKR's information chief last month and was therefore not representing the division yesterday when he made provocative statements against Gombak MP Azmin Ali, who is also PKR deputy president.

Ampang PKR chief Zuraida Kamaruddin told a press conference today that Isa was dismissed from his post on March 26 because he was the subject of several police reports alleging criminal breach of trust.

The party also found out, after a search at the Insolvency Department last January, that he was a bankrupt, she added.

"Party rules do not allow a bankrupt to hold party positions," she said.

At yesterday's press conference, Isa, along with former Ampang PKR vice chairman Tan Hua Meng, alleged that Azmin and some members of his family owned RM8.5 in corporate shares.

They also challenged Azmin to deny allegations that his wife and PKR chief Anwar Ibrahim had an illicit affair that produced a daughter.

Zuraida said she had received reports that Isa had been fraternising with Umno members since he lost his position.

"His actions are not unexpected," she added.

Zuraida, who heads PKR's women's wing, said she would recommend to the party's disciplinary committee to dismiss from the party both Isa and Tan as well as others who took their side at yesterday's press conference.

Isa was an Umno member who joined PKR in June 2010.

Zuraida also announced the appointment of Hamza Djabir as Isa's replacement in Ampang PKR.

She said the allegations against Azmin were baseless, noting that he defended himself last month at a ceramah in Taman Kosas.

She also noted that the authorities had cleared him of the allegations, as explained in Kalsom Taib's book, The Shafee Yahaya Story.

Sindiket IC: Siasat pegawai tinggi kerajaan

KDN, SPR, JPN terlibat?

"Penafian mereka membuktikan dakwaan saya benar. Mereka boleh menafikan, biar RCI siasat," katanya dalam sidang media di lobi Parlimen.

‘Hanya yang buta dan tuli percaya fitnah itu’

Sekitar Dewan Rakyat

KUALA LUMPUR: Timbalan Presiden PKR Azmin Ali enggan melayan tuntutan PKR Cabang Ampang yang mencabar beliau menjelaskan mengenai pemilikan saham bernilai jutaan ringgit.

Dakwaan itu awalnya ditimbulkan Pengerusi Yayasan Pembangunan India Malaysia, S A Vickneswaran, namun menyebut nilainya mencecah RM8.5 juta.

Pak Samad ready for Bersih 3.0, ‘disturbed’ by lagging reforms

By Clara Chooi
The Malaysian Insider
Apr 05, 2012

KUALA LUMPUR, April 5 — National literary icon Datuk A. Samad Said made headlines last year when it was his slightly-hunched, barefooted frame that was seen leading a group of Bersih 2.0 marchers to deliver a memorandum on electoral reforms to the Yang di-Pertuan Agong.

Today, he is "disturbed" that no real electoral reforms have taken place since the chaotic July 9 event.

The soft-spoken septuagenarian told The Malaysian Insider repeatedly that he was "not happy" with the 22 recommendations put forward by the Parliamentary Select Committee (PSC) on polls reform in its report tabled in Parliament on Tuesday.

The government's and PSC's failure to suggest total reform, he said, was "good reason" why Bersih 3.0 "should" be held.

"I'm not happy with what has happened. I'm not happy. Not happy," the bearded poet said yesterday, shaking his shock of white hair.

"So that's why I think, because of what's happening, it is very disturbing as far as I'm concerned.

"That's a good reason why we should have this (Bersih 3.0)," he said.

Samad or "Pak Samad" as he is fondly known, was speaking to The Malaysian Insider after co-chairing a press conference earlier yesterday afternoon with Bersih 2.0 chief Datuk Ambiga Sreenavasan and the election watchdog's other steering committee members.

The group had just announced "Bersih 3.0", its third rally for free and fair elections, which is scheduled for April 28 from 2pm to 4pm at Dataran Merdeka here.

Making the case for "Bersih 3.0", Samad continued that any reforms to the election process, whether put forward by the PSC or others, "must" be done before the coming 13th general election.

He complained that the PSC's report, passed in the House without debate, had not expressly indicated a timeline for all its 22 reform recommendations.

The panel, he said, should have done better.

"They should do better, actually. Because they did not even say when they will have these things (recommendations) [implemented].

"Because, what we care about [is that] all these things must be done (implemented) before the election," he said.

Failing which, Samad added, the PSC's six months of meetings and investigation would be rendered "meaningless".

He expressed the hope that more Malaysians would take up Bersih's cause and join the group this April 28 for its "sit-in protest".

"I hope, I hope (that more will join). Because it is not only in KL but also in other states and around the world," he said.

Despite his advanced years, the 76-year-old Samad appears unfazed at the thought of another massive march that could turn out as chaotic as last year's event.

Instead, he is ready again to lead thousands for "Bersih 3.0", which he predicts will be attended by at least 500,000 people worldwide.

During Bersih 2.0 last July 9, Samad had to traverse barefooted for a long distance amid the heavy bombardment of tear gas canisters and water cannons fired at protestors.

He had lost his shoes in the confusion but was later offered a pair of slippers by an unknown individual to protect his feet.

After the event, political analysts called Samad an "icon" for Bersih, saying that despite him not being a politician, his involvement had helped the group shed any element of partisan politics within it.

The award-winning literary giant, they said, had instead sparked a spirit of nationalism and unity among Malaysians across races.

How Malaysia imports palm oil from Israel

Malaysia importing palm oil? But is Malaysia not one of the biggest exporters of palm oil, apart from Indonesia?

Malaysia also is 15th largest trade partner with Israel, ahead even of Singapore.

Now here's an interesting conversation I had with a Moroccan. I was intrigued to learn that that Morocco is a monarchy. Our conversation was rather political thus leading this Moroccan to start cursing his king and placing him together with other Muslim leaders like Hosni Mubarak, the late Gadhafi, the horrific situation in Syria, the repressive administration in Saudi Arabia and so on. However, he had to take his hat off to Tehran.

He lamented how all these 'stupid' (as he described them) Muslim leaders were all puppets of the Western powers such as the USA, Great Britain, and the entire European Union. He finally had to admit too that that these Western powers ultimately danced to the tune of the Jewish puppet master.

Here, I had to interject to correct him, 'Zionist', not Jew.
Still venting his frustration, he described a Zionist modus operandi. Say I am offered RM1.00 for an orange, which will then be sold to another Zionist for RM1.50, then to another for RM2.00. Finally, a Moroccan will buy it for RM2.50.

So, the story continues. I remember reading somewhere quite recently about how the Zionist regime messed up with then President Jimmy Carter, I think it had something to do with a peace plan that the Zionists felt was too much in favour of the Palestinians. So, the President punished the Zionists by cutting off American soy oil supply. Apparently they have since then been on the lookout for an alternative edible oil supply.

Lo and behold, they have found it. Where? Right in the middle of a Muslim archipelago dominated by the world's most populous Muslim nation, Indonesia.

So, is an Indonesian President going to make right what an American President did wrong? No, the answer lies a little more to the east. It is the Malaysian prime minister who shall be the saviour of Israel.

The Zionists have found themselves a new Hosni Mubarak in this little Muslim country of 27 million where only 60% of the population is Muslim.

I once remember! reading that when Hosni Mubarak was overthrown and exposed, he turned out to be the richest man in the world, beating even Bill Gates.

So, it seems like the Malaysian prime minister wishes to follow in the footsteps of this richest man in the world. Why not? With Zionist backing it shouldn't be too difficult.

What about us Malaysians? Is the wealth of the next richest man in the world expected to trickle down and turn us into high-income citizens?

To answer that, we will have to refer to the "Moroccan process" described earlier: We sell our palm oil to the Zionists, say at RM2.00 per kilogramme (at present, the government controlled retail price is RM2.50 per kilogramme). The Zionist will then sell it to another Zionist at RM3.00 per kilogramme. Then to another at RM3.50 per kilogramme. Finally the Malaysian will pay RM4.00 per kilogramme.

The packaging might even have "Imported from Israel" stamped on it. Wait a minute. Is not Malaysia a Muslim nation with no diplomatic ties with Zionist Israel like its big brother Indonesia?

So, I suppose palm oil exported to Malaysia will be labelled differently so as not to inflame Malaysian Muslim sentiments.

PSM: Semenyih ours if BN doesn’t cheat

KUALA LUMPUR: Parti Sosialis Malaysia (PSM) is confident of winning the Semenyih state seat in a free and fair election, but is concerned by what it sees as evidence that Barisan Nasional is preparing to cheat in the coming polls.

There has been a 28% increase in the number of voters registered there, according to PSM secretary general S Arutchelvan.

"The election will be decided by how BN can cheat," he told a press conference here. "A 28% voter hike is abnormal. Normally it is about 5% to 10%."

Arutchelvan contested for the Semenyih seat in 2008 but lost to Johan Aziz of Umno. However, he said he would win in the coming election if honesty and fair play prevailed.

Support for him had grown overwhelmingly in the constituency, he said without elaborating.

He also claimed that there had been a 35% rise in voter numbers in the Kota Damansara state constituency, now held by PSM chairman Nasir Hashim.

These dramatic increases follow a trend that opposition parties have been highlighting for several weeks. They suspect something fishy, but Barisan Nasional has shrugged off allegations that it is counting on phantom voters to win in certain areas.

Arutchelvan said this was one of the "dirty BN tactics" that gave PSM reason to participate in the Bersih rally scheduled for April 28.

Answering a reporter's question, he said he did not foresee any trouble at the rally "unless the government does not allow it to go on".

The public would blame the authorities if anything untoward were to happen, he added.

The press conference was held at the Kuala Lumpur and Selangor Chinese Assembly Hall, where Selangor state and town legislators from PSM declared their incomes in the wake of recent salary increases.

All legislators from PSM contribute 40% of their salaries to the party.

Let's march to our own Tahrir Square

As the excitement for the 13th general election and the barometer of political awareness rise among citizens, it is now clear that any attempt to halt Bersih 3.0 will only result in a massive backlash to the government in power.

We don't need to have a Malaysian version of Tunisian Mohamed Bouazizi who set himself ablaze in protest of the tyranny against him, sparking the Arab Spring. We are more than happy to bring reform in a graceful manner.

Even Suhakam in its statement last year in response to the Bersih 2.0 assembly reiterated that "it is the right of members of the public to assemble and to express their views in a peaceful manner, as provided under Article 10(1)(b) of the Federal Constitution, as well as Article 20(1) of the Universal Declaration of Human Rights (UDHR)."

It is therefore interesting to see the landmark steps taken toward democracy in Myanmar, once criticised for harsh treatment against civilians and the opposition, and which last year mooted a more democratic law than Malaysia's to manage peaceful assemblies. Then, in March, its leader Aung San Suu Kyi was able to make her campaign speech on state‐controlled media channel, under a government provision that allows parties contesting the elections to be given 15‐minute slots on television and radio, a significant departure in the country. In addition, their doors were opened to foreign election observers.

Back in our lawn, there is no room for any legitimate opposition parties to make a debut on national television to air their campaign speeches. Public‐funded media channels serve not as a tool for the information of the electorate but for deceiving people and serving the interest of the ruling government.

Meanwhile, despite six months of heated discussions and at least six public hearings, the parliamentary select committee (PSC) on electoral reforms has failed to meet its objectives and has neglected to address fundamental issues surrounding the country's election system.

! To quote the former US treasury secretary William E. Simon, "Bad politicians are sent to Washington by good people who
do not vote".

I find no excuse for me not to support Bersih 3.0 to express our disappointment with a government that continues to manipulate the electoral system to their advantage.

Perhaps, the selection of Dataran Merdeka (Liberation Square) is apt, as it will be the focal point and symbol of freedom, not unlike its Egyptian counterpart at Midan al-Tahrir (Liberation Square).

Indeed, it is set to turn into a feast against tyranny.

Tetapi ingatlah wahai para pembaca sekelian, jangan kerana PTPTN habis kita kena PTPTIPU.

SAPP against police uniforms for Rela members

KOTA KINABALU: The  federal government's proposal to allow the People's Volunteer Corps (Rela) members to wear police uniforms has come under attack in Sabah.

Sabah Progressive Party (SAPP) described the proposal as "dubious", saying it would have a 'far-reaching' impact on Sabah which is already grappling with thousands of legalised illegal immigrants.

The party's information chief Chong Pit Fah claimed that if implemented, such a move would create more problems rather than help the security forces like the police to maintain law and order.

Chong said this was in view of the presence of a great number of 'dubious citizens' who are originally illegal immigrants from the neighbouring countries, who now have obtained their Malaysian citizenship through the infamous "Project IC" and through false statutory declaration.

He claimed to have reliably learnt that many of them had joined Rela.

"What will happen if this group of bogus citizens-turned-Rela members decline to apprehend illegal immigrants and start harassing the locals instead?"

"Do we want these people to harass the locals in the near future? Only mindless leaders would allow this to happen," he pointed out.

Chong was responding to the Home Ministry's plan to table a new law governing Rela at the next session of the Dewan Rakyat, which among others, would allow Rela members to wear police uniforms with Rela badges.

Deputy Home Minister Lee Chee Leong had told reporters in Alor Setar that the ministry was still discussing the matter with the attorney-general. Rela was established under the Emergency Ordinance which has since been repealed.

Lee said there are almost three million Rela members throughout the country.

Get priorities right

Chong feared that this might cause confusion among the general public, citing that it would be difficult for them to differentiate between a police personnel and a Rela member wearing police uniforms.

He stressed that the federal government should get its priorities right.

He urged the government to expedite the setting up of the Royal Commission of Inquiry (RCI) on the perennial issue of the continuous presence of a huge number of illegal immigrants in the state and its related issues such as the 'Project IC' and 'dubious citizens' issues.

Chong, who is also SAPP Kepayan CLC chairman, also endorsed the Bar Council's recommendation, recommending for the dissolution of Rela, so that the government's financial resources can be better utilise to strengthen the police force.

He added that it was timely for the government to reconsider the relevance of Rela after the Emergency Ordinance was repealed in December last year.

He said there was no need to enhance Rela's power when they are not even an enforcing body.

He also concurred with the Bar Council's human rights committee chairperson Andrew Khoo's statement that the federal government should disband Rela, as it would be deemed an illegal body after June 30.

"Under Article 150 of federal constitution, laws which were put in place under the Emergency Ordinance are deemed to cease six months after the ordinance is repealed," Khoo had pointed out.

Chinese schools: Teachers shortage reduced since 2009

KUALA LUMPUR: The increasing number of teachers employed in Chinese schools every year has helped reduce the shortage, said  Deputy Education Minister Wee Ka Siong said.

Speaking to the Dewan Rakyat today, Wee said: "I want to tell you, when I came into the ministry (in 2009), we were short of 4,991 [teachers].  In 2010, [this dropped] to 3,043 (and reduced further to) 2,720 in 2011 and now (it is) 1,874 this year."

"This is not something which came from the sky."

Wee said that Chinese schools were not the only schools in the country that were suffering from a shortage of teachers, and that Tamil as well as national schools were facing the same problem.

Adding to this was Deputy Speaker Wan Junaidi Tuanku Jaafar, who said that Sarawak was short of 683 teachers.

Wee was replying to a supplementary question by Petaling Jaya Selatan (PKR) MP Hee Loy Sian, who criticised Wee for not being effective at his job.

In response to this, Wee said that the PKR MP was more than welcome to take over his portfolio, if Pakatan Rakyat were to win in the next general election.

He added that at the moment, the Cabinet had formed a committee to address the shortage, and that the ministry was working hard to solve the matter.

The Education Ministry has been in the spotlight for supposedly failing to resolve the shortage of trained teachers in Chinese schools.

On March 25, the deputy minister attended a Dong Zong (United Chinese School Committees Association) rally in Kajang, which saw over 5,000 people attend.

The rally allegedly turned unruly and Wee had reportedly made a quick exit. He had later reportedly told newsmen that someone tried to punch him, and that newspapers and plastic bottles were thrown at him.
