Masing: If we tell you to walk backwards, do it

When most Malaysian cabinet ministers open their mouths to talk, you might not expect much in the way of reasoned debate or intelligent conversation.

But James Masing, rejoicing under the stupendous title of Senior Minister (for land) in Abdul Taib Mahmud's Sarawak cabinet, ought to be different.

He has a PhD in anthropology. He was once a dissident, a leading light in the opposition Parti Bansa Dayak Sarawak (PBDS).

PBDS was a 'pan-Dayakism' party that nearly toppled Taib in 1987, but then crumbled under the prolonged and canny pressure of Taib's iron fist. Eventually, nearly all PBDS leaders were bought over to BN, by Taib's promises of power and timber concessions.

james masingMasing himself has now been accused of profiting from his wife Corinne Bua Nyipa's extraordinary good fortune. According to the website Sarawak Report, a gadfly to Taib's cabinet, Masing's wife enjoys a huge logging concession (although she has no obvious credentials as a lumberjack).

She is a prominent shareholder and director of companies that have been showered with government contracts worth RM100 million to build roads and rural classrooms, and to run electricity generators in Kapit's deprived schools.

Sarawak Report has systematically exposed the skeletons in Taib's cabinet in recent weeks. The website has run shocking stories on BN ministers and elected representatives, buried to their eyeballs in government largesse and conflict of interest.

Perhaps this helps explain Masing's outburst a fortnight ago. He told voters: "Jangan lawan tauke" – warning them not to go against the boss.

Politics in reverse

Masing later spoke out to defend his view, brandishing textbooks of political science. He insisted that elected representatives are 'the bosses' during the five or so years after each election.

"The confusion, it appears, is on the role of the legislature – which is the elected representatives or YBs. All YBs are elected by the people/voters. During the polling day, the 'rakyat' (people) who have been registered as voters are the boss. The power is invested on the 'rakyat' by the legislature, to elect who should be the administrator/boss of their lives for the next five years," he was quoted as saying by the Borneo Post.

"Once they have elected their YBs or the administrators, the role changes. The elected representatives become the administrators/boss of the 'rakyat', while the 'rakyat' plays a subservient role and will seek assistance from the YBs from time to time.

"If their YBs, for instance, pass a law which tells the 'rakyat' to walk backward, the 'rakyat' must walk backward… Within the period of five years, the elected representatives have the freedom to decide what is best for the 'rakyat'. If one or two people feel being neglected by their administrators/YBs, they have to wait for five years to change their elected representatives."

As retired MP Sim Kwang Yang has pointed out before, Masing surely understands the principle of the social contract espoused by Locke, Rousseau and Hobbes.

This is, of course, not the witless and racist "social contract" imposed on Malaya by the departing British. The social contract is a mutual agreement: the population gives up certain individual liberties to the state, in order that the government exists to provide security and services to the people.

"A government is legitimate morally as long as it looks after the personal security, the prosperity, and the natural rights of citizens," Sim wrote in 2009, in an open letter to Masing.

"When that government fails in its duty to the governed, then the people have the right to change the government – by a revolution even, according to Locke."

In his erudite history 'The Age of Revolution', Eric Hobsbawm remarked on the 'birth certificate' of modern democracy in the French Revolution – the seminal constitution established by the Jacobin regime in 1793.

"The people were offered universal suffrage, the right of insurrection, work or maintenance, and – most significant of all – the official statement that the happiness of all was the aim of government and the people's rights were to be not merely available but operative," Hobsbawm observed.

Distraction by hyperbole

Two centuries later, Masing continues to pretend modern democracy begins and ends with regular elections every five years, where votes are paid for out of the taxpayers' own money.

Masing gets full marks for using highly publicised, overtly stupid political statements, in an attempt to deflect attention away from the torrent of Sarawak Report articles exposing the huge contracts awarded to companies fronted by wealthy ministers' families.

But can this smokescreen hide the allegations of corruption indefinitely?

The Securities Commission (SC) has been urged to investigate Prime Minister Najib Abdul Razak's second son Nazifuddin for share price manipulation.

In a statement today, DAP publicity secretary Tony Pua (left) said Nazifuddin's recent involvement in two companies whose share prices greatly fluctuated is highly suspicious.

In the first case, Harvest Court Industries Bhd's share prices shot up by 2,575 percent after Nazifuddin joined its board of directors late last year, only to crash after he quit a month later.

NONEThe latest case involves ACE market listed company Supercomnet Technologies Bhd, which saw share prices rise 362 percent after the company announced that Nazifuddin was given an option to acquire 18.66 percent of its shares.

Supercomnet's share prices collapsed two days later after the company announced that Nazifuddin had rejected the share offer.

Pua, who sold a successful Singapore listed-company in 2007 before turning to politics, said the rise and fall of Supercomnet's share price smacks of massive manipulation.

NONE"(It is) outright negligence on the part of both the existing shareholders and Nazifuddin (right) in ensuring material information is made available to investors on a timely basis.

"Nazifuddin's downright bizarre U-turn on the acceptance of the 'option to purchase' 18.66 percent of the company, only to reject it within 48 hours is clearly suspicious and must be immediately investigated," he said.

Pua argued that the SC must now probe Nazifuddin and other parties without fear or favour over these two incidents because the Malaysian stock market has been brought to disrepute.

"The question must be asked as to who made tonnes of money from the entire exercise – by buying up the shares before the option agreement was announced on Monday evening and subsequently selling the shares before the rejection of the offer was announced on Tuesday morning," said Pua.

Conduct mock elections, EC urged

PETALING JAYA: The Election Commission (EC) has been urged to conduct mock elections to ensure that new changes made to the electoral process such as the introduction of the indelible ink are implemented smoothly.

K Shan, the acting chairman of The National Institute for Democracy and Electoral Integrity (NIEI), said this at the launch of a report on national voter registration audit (2011) here today.

"A mock election should be held and scrutinised by the public and the media. There are many problems with the implementations of the indelible ink.

"When we were observing the Afghanistan election recently, there were different methods used by different officers. Some painted one line on the nail, some dipped the finger, while some even stained the ballot paper and it became a spoilt vote," he said.

He added that a mock election would ensure the changes that EC has introduced for the impending 13th general election would be done smoothly and not be an impediment.

After much public pressure, the indelible ink was gazetted in mid-February. Although specific guidelines have been laid out on how the markings will be made – before a person votes – this will be the first time that the ink will be used in a Malaysian election.

The use of the ink is not the only change the EC has announced for the upcoming polls. About 242,294 postal voters consisting of police and army personnel will vote as advance voters in the upcoming election.

The EC said that the process for advance voting will be exactly like ordinary voting but only carried out in the barracks. However, detailed implementation of the procedure is yet to be available.

These changes were part of recommendations made by the Parliamentary Select Committee (PSC) on electoral reforms. The full report of the committee is scheduled to be tabled on April 2. There may be other changes recommended for the EC to fulfil before the election takes place.

Shan said that in view of this, the election should be postponed until all the recommendations are implemented.

"The date of the election should not be kept a mystery. There should be a clear indication. If it is planned for June, then it should postponed for three months [giving time] for all the recommendations to be implemented," he said.

The voter registration report titled, "Creating a Robust and Transparent Electoral Process in Malaysia Together" was a joint effort with pollster, Merdeka Center and the Center for Independent Journalism (CIJ).

MCLM-backed dentist to re-join PKR

KAPAR: The last standing Barisan Rakyat Independence candidate (BRIC) Dr V Nedunchelian today announced that he will not contest in the 13th general election.

The Malaysian Civil Liberties Movement (MCLM)-backed candidate also revealed that he would re-join PKR.

At a press conference here today, Nedunchelian said he had decided to re-join his former party in order to serve the public.

"I have already submitted my application to the PKR headquarters and am waiting for a reply," he told reporters at PKR Kapar MP S Manikavasagam's office.

Manikavasagam and other Kapar PKR division leaders were also present.

The dentist said he left PKR when some "insiders" misled him but now realised that the Anwar Ibrahim-helmed party was the best platform to serve the people.

In January this year, MCLM, headed by controversial blogger Raja Petra Kamaruddin, a friend- turned-foe of Anwar, introduced Nedunchelian as its candidate for Kapar.

Meanwhile, Manikavasagam, who backed Nedunchelian's plan to re-join PKR, also warned party members to be cautious of those who were attempting to destroy the party.

"Like what Nedunchelian said, there are some 'agents' in the party who are misleading the members," he added.

According to him, these agent provocateurs were persuading party members to become election candidates and therefore creating internal friction.

"After the 2008 election, everyone wants to be a candidate because of these agents," he added.

As for the Kapar constituency, Manikavasagam said that currently there was another dentist eyeing the seat despite the latter not having support here.

"This is unhealthy for the party," he said, advising members to put party interests above self- interests.

Ex-serviceman: BN losing military votes

PETALING JAYA: It is Barisan Nasional and not the opposition which is witnessing a decline in support from those serving the military, said the Royal Malaysian Air Force Veterans Association.

Its president Shahrin Osman said the government's silence over the controversies surrounding military procurement could result in an electoral backlash.

"The more the opposition tells these stories, the more army men and ex-army men will vote for the opposition," said the former flight sergeant.

"The government should counter these claims by proving to the public what they are doing is right. But the problem is there is no approach from the government at all to address this," he told FMT.

He was responding to Deputy Defence Minister Abdul Latiff Ahmad who told Parliament yesterday that politicising the issue of military procurement would hurt the feelings of servicemen and result in them supporting BN.

Shahrin also said that most of the ex-armed forces personnel do not trust the mainstream media, especially the Umno-owned Utusan Malaysia.

"I just spoke to some of them, and they are saying they don't read Utusan now. It only carries 'sweet stories' (about the government)," he said.

Opposition blows things up

On the same note, Shahrin also pointed out that the opposition had a tendency for blowing things out of proportion.

"Not all their allegations are totally false but the opposition tends to exaggerate. If the story is 10% real, usually they'll add another 30% of fiction.

"But it is not wrong for them to raise questions. When we were in the armed forces, we knew the prices and we knew the prices become higher when it comes to buying," he said.

Shahrin said the government should go down to the ground to explain to the people the truth.

"This is what my association is doing. We organise programmes asking ministers to clarify their actions and what benefit it does for the people," he added.

Shahrin said that the government's treatment of retired armed forces personnel was also not helping the situation.

"Many things are not fulfilled. Many of us feel cheated by the government. The pensions are also too little for these men, who find it hard to adapt to civilian life and normal jobs," he said.

Vote an individual right

Commenting on the same issue, Malaysia ex-Army Association (PBTM) president Muhammad Abdul Ghani said that a vote was an individual right.

"I believe that a vote is a personal right. Military men should think properly on whether an issue is true or not, differentiate between lies and truth. If it is just baseless allegations, we should not take them into account," he said.

"I'm sure that many of the ex-servicemen are smart enough to evaluate. The more they mention about these issues, the better," he said.

However, Sarawak Veteran Armed Forces Association president Thomas Ling said that he fully supported the deputy minister on this matter.

"We cannot accept politicians, especially those from the opposition, simply releasing statements to accuse our people of misconduct. I believe all ex-servicemen are loyal to our leaders under the prime minister who leads us," he added.

In recent years, Pakatan Rakyat had questioned the government's procurement of defence equipment.

These included salvos against the Scorpene submarines, RM9 billion for six Littoral Combat Ships (LCS), an estimated RM2 billion for a Mindef IT project, RM7.55 billion for armoured carriers and other matters.

NGO berdemo lagi desak PAS nyatakan pendirian terhadap Anwar

KUALA LUMPUR: Kira-kira 100 peserta daripada 20  NGO hari ini berkumpul di hadapan Pejabat Agung PAS bagi menyatakan bantahan terhadap PAS yang selama ini berdiam diri terhadap kenyataan Ketua Pembangkang Datuk Seri Anwar Ibrahim menyokong keselamatan Israel.

NGO terbabit, antaranya Persatuan Kerabat DiRaja Kedah, Ikatan Program Melayu Gombak, (IPMG), Kelab Merdeka Muda Kuala Lumpur dan Selangor (KeMUDA), Persatuan Veteran Malaysia mula berkumpul di depan Pejabat Agung PAS di Jalan Raja Laut, di sini kira-kira 11 pagi tadi.

Mereka yang berbaju merah, membawa bendera Malaysia dan beberapa keping kadbod dan kain rentang 'Anwar boneka Zionis, pembohong, penipu', 'singkirkan pengkhianat antarabangsa' dan turut menyanyikan lagu patriotik 'Inilah Barisan Kita'.

Difahamkan, ini merupakan demonstrasi sama kali kedua kumpulan berkenaan selepas menyerahkan memorandum kepada Pejabat Agung  PAS menuntut isu yang sama pada bulan lalu.

`Lupakan ideologi politik'

Presiden IPMG, Mohammad Nazlee Aziz ketika ditemui berkata, pihaknya akan terus mendesak PAS membuat pendirian rasmi terhadap kenyataan Anwar dalam Wall Street Journal (WSJ) Februari lalu.

"Selagi PAS tak buat kenyataan kita akan terus buat beberapa demonstrasi susulan kerana ia membabitkan isu agama.

"Kita seru PAS lupakan ideologi politik (dengan Pakatan Rakyat) tapi bila faktor yang menentukan hidup mati Islam kita perlu bersatu," katanya.

Kumpulan terbabit bagaimanapun bersurai dengan aman dan keadaan dikawal polis dengan baik selepas berdemo kira-kira setengah jam kemudian.

Flawed voter roll: Fraud only one of causes

PETALING JAYA: Fraud is only one of many causes of irregularities in the electoral roll, according to research carried out by the National Institute for Democracy and Electoral Integrity (NIEI).

NIEI's report says other causes include inertia on the part of the Election Commission (EC), disinterest among voters, rapid urbanisation and what it calls the "problem of cluster voting", referring to the bulk movement of voters.

The report, titled Creating a Robust and Transparent Electoral Process in Malaysia Together, was disclosed to the media today by NIEI acting chairman K Shan. The research was done with the help of the Centre for Independent Journalism (CIJ) and the polling organisation Merdeka Centre.

"It is not fraud per se," Shan said in reference to causes of irregularities. "We are not in the best position to make such a statement. But the irregularities concern rapid urbanisation, changes in technologies, changes in demographics and such."

According to the report, 92% of addresses sampled were identifiable. Of the addresses that could not be identified, most were concentrated in urban areas.

"This is due to the rapid development, especially in KL, where urban settlers are constantly moving," said Shan.

The study also found that only a third of the voters with identifiable addresses were still residing there.

This would present a problem to those wanting to determine whether these were authentic voters, Shan said.

"This problem can also be caused by cluster voting, where political parties from both sides transfer voters in bulk to an area to ensure their victory. These are desperate measures taken by all political parties."

Shan also said that some voters just do not have the time to change their voting addresses to their current addresses. "The EC is also not proactive in working with the local council to verify and rectify these changes."

The study was based on the electoral roll of 2010, before the Bersih rally in July 2011, in which thousands took to the streets demanding free and fair elections. Since then, the registration of voters has rapidly increased.

In 2011, more than one million new voters were registered.

The researchers interviewed 2,400 people nationwide for the study, which was done with the consent of the EC.

Other points made in the report include:

  • Only two voters shared the same MyKad number. Most voters listed in the electoral roll and their MyKad details were accurately captured, although there were typographical errors
  • Only 6% of those polled could not find their names on the electoral roll. More than half had not checked their registration status.
  • Selangor topped the list of states with unidentifiable voters. Out of 306 polled, 77 cases could not be identified. Kuala Lumpur came second, with 57 cases and Johor third, with 50 cases.
  • Muslim Bumiputeras formed the highest number of unregistered voters at 23%, followed by non-Muslim Bumiputeras in East Malaysia (17%).
  • Those aged between 21 and 30 were the largest group of unregistered voters (30%).

NGO demontrasi mahukan Lim jelaskan isu tapak masjid

GEORGE TOWN: Lebih 50 orang ahli pelbagai NGO menyertai demonstrasi secara aman di sini hari ini mendesak Ketua Menteri, Lim Guan Eng memberi penjelasan mengenai dakwaan kerajaan negeri telah menjual tapak masjid di Bayan Mutiara di sini.

Mereka berarak sejauh satu kilometer dari Masjid Simpang Enam selepas solat Jumaat dan berkumpul di perkarangan Komtar membawa sepanduk dan kain rentang yang tertulis pelbagai kata-kata desakan.

Antara tulisan yang dilihat ialah 'Kembalikan Tanah Masjid di Bayan Mutiara' ,'Rakyat Mendesak Tanah Masjid Bayan Mutiara Diwakafkan' dan 'Pulangkan Tapak Masjid".

Antara NGO yang terlibat dalam perhimpunan itu ialah Pertubuhan Peribumi Perkasa Malaysia (Perkasa), Suara Anak-anak Malaysia, Pertubuhan Kebajikan Al-Ehsan Islamiyah Malaysia, Persatuan Anak Jati Melayu Islam Pulau Pinang dan Badan Bertindak Rakyat Tertindas Pulau Pinang.

Beberapa wakil pertubuhan itu kemudian naik ke tingkat tiga bangunan Komtar yang menempatkan pejabat pentadbiran kerajaan negeri sebelum menyerahkan memorandum bantahan kepada Pembantu Khas Ketua Menteri, Marziah Mohd Mukhtar.

Tidak puas hati

Jurucakap penganjur perhimpunan itu, Mohd Rizuad Mohd Azudin berkata mereka tidak puas hati dengan jawapan 'tiada komen' yang sering diberikan Lim jika isu mengenai tanah itu dibangkitkan.

"Kami minta Ketua Menteri Pulau Pinang dapat memberikan jawapan secara bertulis dalam tempoh tujuh hari. Buktikan slogan 'Competency, Accountability dan Transparency (CAT)' yang selalu dilaungkan oleh kerajaan negeri tidak sekadar retorik politik semata-mata.

"Rakyat berhak tahu perkara sebenarnya," kata Mohd Rizuad ketika ditemui pemberita di lokasi perhimpunan itu.

Kontroversi tanah Bayan Mutiara timbul selepas kerajaan negeri dilaporkan  menjual tanah seluas 41.5 hektar itu kepada sebuah syarikat pemaju dengan harga RM1.07 bilion.

Tanah itu dianggap berharga dan lokasinya strategik kerana letak berdekatan Jambatan Pulau Pinang, Zon Perdagangan bebas dan Lapangan Terbang Antarabangsa Bayan Lepas.

Bishop Ng: Seminar content must change

PETALING JAYA: Tomorrow's seminar for Johor teachers remains hurtful to Christians despite the organisers' decision to remove any reference to Christianity in the wording of its theme.

Bishop Ng Moon Hing, chairman of the Christian Federation of Malaysia (CFM) said in a media statement today that Christian feelings would be soothed only if the content and structure of the forum were changed as well to remove any implication that Christianity was a threat to Muslims in the country.

He was commenting on statement by Johor state assemblyman Maulizan Bujang that the title of the seminar would be changed following protests from non-Muslims.

When the seminar was announced recently, the organisers gave it the unwieldy title of "Strengthening the Faith, the Dangers of Liberalism and Pluralism and the Threat of Christianisation of Muslims. What is the Role of Teachers?"

A Bernama report quoting Maulizan did not give the new title. It only said that the reference to Christianity would be removed.

The seminar is organised by the Education Ministry, the Johor Education Department and the Johor Mufti's office.

"Even though there has now been an attempt to re-name the title of the seminar, the intent of the seminar has been clearly exposed for all to see," Ng said.

"We condemn the Johor State Education Department's action. It is insufficient to rename the seminar without changing the content and structure of the seminar."

He added that seminars organised by government agencies must not "foment tensions among our peaceful and harmonious peoples."

Religion as a dividing tool

He said the attempt to paint Christianity as a threat to Islam was unfounded and unjustified.

"Religion must never be used to divide our country, destabilise its harmony and destroy its unity."

He also said the seminar would run afoul of Prime Minister Najib Tun Razak attempt to showcase Malaysia as a moderate Muslim country, as evident in his speeches before international audiences .

Referring to the Prime Minister's speech at the "Global Movement of Moderates" conference in Kuala Lumpur early this year, Ng said: "Najib has called on all Malaysians to work together on the basis of our common religious principles and values of moderation in nation building."

He urged the government to take "immediate and concrete steps" to stop painting Christianity as a threat.

"Government departments must not be seen to be working at—and should not be allowed to work at—cross purposes to the government's aims by instilling hatred and ill will between religious communities.

"Such contradictory objectives will only serve to divide the nation rather than unite it."

My wish list for electoral reforms

If anyone thinks that general elections in Malaysia are free and fair, he or she must either be blind or totally daft.

We only go through the motions of taking part in the general elections without satisfying the prerequisites, which are the hallmarks of a truly democratic and progressive country. The shortcomings in the Malaysian electoral system are indeed shameful.

Below is my wish list for electoral reforms:

  • Amend the Constitution to make the Election Commission a totally independent body with powers to act against all forms of corruption and malpractice.
  • Implement the 2:1 rural/urban weightage in the delineation of constituencies as was provided for in the Reid Commission's recommendations.
  • Stop all gerrymandering which has allowed the Barisan Nasional so often to get about 50 per cent of the popular vote but take 80 per cent of the seats in the state assemblies and Parliament.
  • Introduce proportional representation.
  • Introduce local council elections to create a participatory democracy.
  • Make 18 the voting age.
  • Control strictly the amount candidates spend on their election campaign.
  • Provide development funds to all 222 parliamentary constituencies. Stop the barbaric practice of giving RM1m to only the Barisan-held constituencies.
  • Stop all corrupt practices before and during the election campaign period. Once Parliament is dissolved, prevent the caretaker-government from providing so-called development funding for constituencies – paving roads, giving school uniforms and bicycles to schoolchildren, giving rice and clothes to the poor, buffet dinners during rallies and bribing voters with cash.
  • Clean up the electoral roll of phantom voters, illegal immigrants as voters, the registration of dozens and even hundreds of voters under a single address. There should be no manipulation of the electoral roll to give the ruling party a very unfair advantage.
  • Ensure voters are allotted to voting centres nearest to their homes. Under no circumstances should voters be moved out of their constituencies without their permission.
  • Fix polling day always on a Sunday to ensure that voters are free to vote.
  • Ensure that the campaign period for the general election is at least 30 days so that voters have a chance to understand the issues involved.
  • Provide equal time and space in the electronic and print media to both the ruling party and the Opposition.
  • Insist that the Election Commission ensures that civil service and government facilities – government vehicles, boats, planes, helicopters etc. – are not used by BN ministers, assembly members and supporters during the campaign period.
  • Use indelible ink to prevent multiple voting by a single voter.
  • Insist that the Election Commission ensures that the police are neutral and professional in the discharge of their duties. Police vehicles should not be parked nearer than one kilometre from the polling station to enable voters free access to voting centres without fear.
  • Stop counting ballots at voting centres. This enables the ruling party to know which areas are pro- or anti-government. This helps the ruling party in gerrymandering.
  • Give equal protection to all candidates participating in the elections.
  • Deal severely with anyone intimidating the public and voters by creating fear of racial trouble like May 13, 1969. Remember, a stupid ex-PM held a public order exercise in KL the day before election and telecast it 'live' to create fear. Also, act against the Defence Minister who is prone to meet the chief of the army, navy and air force before polling day – as he did before the Bersih 2.0 Walk for Democracy.
  • Make postal ballots available to all citizens residing overseas as well as to only personnel on security duty in the jungle or border areas.
  • Allow observers, both local and international, to commence work once Parliament is dissolved and to end their duties after polling day.
  • Do not permit the malpractice of padding opposition-held constituencies with soldiers, police personnel, members of Rela, Perkida, Wataniah, etc on the pretext of maintaining security.
  • Implement automatic registration of voters.
  • End dirty politics during the general elections.

Without these electoral reforms we cannot call ours a democratic country, let alone  the world's best democracy.

Even pilgrims’ fund Tabung Haji not spared: Najib accused of selling out to Robert Kuok

Corporate Malaysia is starting to look really grubby as the Najib administration gears up for the nation's 13th general election widely expected to be called before the end of this year, with shady and dubious deals galore bulldozed through on an almost weekly basis.

GE-13 is expected to be the mostly tightly contested, with Opposition Leader Anwar Ibrahim and his Pakatan Rakyat coalition believed to have an even chance of taking the federal government from the Umno-BN, which has ruled the country for 55 years.

Knowing this, Najib who is also the Finance minister, has hammered in a slew of mega-deals that pundits say were obviously over-priced and aimed to help Umno-BN and its cronies cash out. Recent examples include a RM7.1 billion 60-year toll road concession and the sale of Maju Expressway for RM1.5bil, reaping its owner an RM1.2 bil profit as the majority of the costs were financed from government grants.

Tabung Haji also not spared

Now the latest concern is the purported sale of pilgrimage fund Tabung Haji's oil palm plantations to a company believed to be controlled by Malaysia's richest man, Robert Kuok, the former sugar king.

Pakatan leaders have demanded a clarification from Najib as to why the alleged deal was rushed through and concluded in secrecy. They believe that it is linked to Najib's prized IPO, the share sale of Felda Global Ventures Holdings, which has hit a speed bump due to objections from the land settlers themselves.

"This action is suspicious because there was no explanation from Tabung Haji and the Prime Minister Department as to why such a valuable asset sold in desperation," Harakahdaily reported PAS vice president Husam Musa as saying on Wednesday.

Desperate action that benefits Umno-BN but exposes the Malays to financial erosion

Both the Felda – a national land settlement scheme – and Tabung Haji have huge impact of the lifestyles ad financial well-being of the Malay community – largest electorate in the country.

The Felda settlers have objected to the FGVH IPO on fears that Umno and Najib were only trying to reap short-terms gains while exposing their lands to the possibility of a takeover action should foreign planters corner the Felda shares in the the market should the listing be allowed to proceed.

As for Tabung Haji, Hussam said its oil palm plantations covered an area of 83,000 hectares in Riau, Indonesia, yielding a total of RM3million per day for the pilgrimage fund and its main depositors – the everyday Malay folk.

"We were informed that this sale was made in a hurry to a company owned by Tan Sri Robert Kuok," said Husam, who is also an executive councilor in the PAS-led Kelantan state government. PAS together with PKR and DAP form the tripartite Pakatan coalition.

"We are of the view that this is one of BN's desperate measures to cash out of the assets owned by the agency or corporation involving the national interest and the public. And this is probably the second step after the step of listing them in FGVH was disrupted."

At 89, Kuok is on the Forbes list of the world's wealthiest men. Disenchanted by the racial favoritism policies promulgated by the Umno-BN, Kuok left for Hong Kong and China in the 70s and struck it big. The majority of his fortune comes from his overseas assets, but he still maintains close ties with the ruling regime in Malaysia, helping them to sew deals with his international connections and stable of companies.

As for the controversial Felda IPO, this is believed to be the brainchild of Najib's close adviser Omar Mustapha, a Petronas director whom Umno insiders say is slated to become the next Mentri Besar or chief minister of Johor if Najib succeeds in getting his way in Umno.

Christians the sacrificial lambs to deflect attention from Najib’s and the BN’s corruption

It looks like the Umno-aligned media is all out to divert the people's attention from issues of endemic corruption engulfing Prime Minister Najib Razak's administration, and as usual, Christians have once again been picked to be the sacrificial lambs for him and his Umno-BN coalition to cleanse themselves on.

"This is the same issue over and over again, using religion for political end. The proof of the pudding is in the eating and with so many laws to protect the Muslims, why should there be threat of Christianization. These are acts that are not in line with path of moderation as prescribed by our Prime Minister Najib Razak or his 1 Malaysia," Ramon Navaratnam, a Christian lay leader and prominent civil society leader, told Malaysia Chronicle.

"It is best to deal with how to move the nation forward, to look at economic and transparency issues. Improvements here will show real results rather than engaging in negative politicking and prolonging ethnic bickering that serves no purpose."

Race and religion to deflect attention from corruption and a weakening economy

Indeed, under Najib, Malaysia has seen some of the most extremist groups emerging, Perkasa and now Jati. The most recent brouhaha stirred up was over news that religious teachers from national schools in Johor would be compelled to attend a government-sanctioned seminar this Saturday to prepare them to counter the "threat of Christianisation".

Organized by the Johor Education Department and the Johor Mufti Department, the seminar is entitled "Pemantapan Aqidah, Bahaya Liberalisme dan Pluralism Serta Ancaman Kristianisasi Terhadap Umat Islam. Apa Peranan Guru?" or Strengthening the Faith, the Dangers of Liberalism and Pluralism and the Threat of Christianity towards Muslims. What is the Role of Teachers?.

"No point to get excited over it or to demand that the Najib administration stops it because he won't. GE-13 is around the corner and Johor is a vulnerable state. For sure, Umno will go all out to try and brainwash the Malay voters into being afraid of the Christians so that they will re-elect Umno as defenders of Islam," PKR vice president Chua Jui Meng told Malaysia Chronicle.

"But in reality, what Johor people should do is to wake up to the type of nasty politicking used by Umno. Instead of the reform message that Pakatan brings, Umno-BN sends only a message of hate. To the Christians, I say, hold your horses. Don't waste your thoughts and emotions on such a cheap stunt. It demeans Christianity, and Christians voters in Johor should know what to do. Other faiths and Muslims too should take note of how ruthless Umno and BN are. They will do anything, even using God's name in vain, to protect their vested interests so that they can continue their corrupt ways and steal the people's money."

Perkasa, Anwar and MCA

Meanwhile, Perkasa has already fired off the first salvo to retaliate against the criticisms of various Christian groups.

"Why is Chin so alarmed? Is it because the seminar will actually make it difficult for certain parties to Christianise Muslims?" said Perkasa secretary-general Syed Hassan Syed Ali. He was referring to Council of Churches of Malaysia youth moderator Chrisanne Chin who said she was "shocked and in disbelief" over "the fact… the state department is lending support to this thinking that there is a threat against Islam."

Pundits expect the Umno propaganda mills to go into overtime over the next few months as Najib prepares to dissolve Parliament and call for the 13th general election.

Apart from baiting the Christians, who form 10% of Malaysia's 28 million population, Umno-BN has already begun its gutter politicking against Opposition Leader Awar Ibrahim, while BN component MCA appears to be using rising activism by Chinese education groups to frighten the Malays back to the Umno fold.

Next week, PKR leader Rafizi Ramli will be exposing more scandals related to the RM250million NFC corruption debacle involving several top Umno leaders including Najib himself, his deputy and Education Minister Muhyiddin Yassin, Wanita chief Shahrizat Jalil, former premier Abdullah Badawi and Youth chief Khairy Jamaluddin.

Jawapan Menteri dalam isu hospital mengundang banyak lagi persoalan.

Dalam persidangan Dewan Rakyat minggu ini telah dibangkitkan pertanyaan mengenai status pembinaan Hospital Rembau. Menteri Kesihatan berkata bahawa proses tender telah siap pada 27 Mac dan kos projek ialah RM 122.6 juta dibina atas tanah seluas 45 ekar. Semakin banyak fakta yang mengelirukan mengenai projek ini.
Pertama : Jika rujuk laman web JKR , tender yang telah siap pada 27 Mac hanyalah Fasa 1, iaitu Kerja-kerja Tanah.
Kedua : Jika kos projek ialah RM 122.6 juta telah diumumkan awal, tidakkah ini menjejaskan proses tender Fasa 2 iaitu pembinaanBangunan Hospital?
Ketiga : Menteri Kesihatan mengatakan projek dibina atas tanah seluas 45 ekar (RM 43.1 juta), sedangkan Menteri Besar Negeri Sembilan mengatakan tanah dibina atas tanah seluar 20 ekar (RM 19.1 juta) pada harga yang dipohon oleh PKNS sebanyak RM 22 sekaki persegi atau RM 958,320.00 seekar.
Keempat : Jika tanah yang terlibat ialah 45 ekar (RM 43.1 juta), bermakna 35 peratus kos projek, ialah kos tanah. Jika tanah yang terlibat ialah 20 ekar (RM19.1 juta) bermakna 15.5 peratus kos projek ialah kos tanah.
Kelima : Menteri Besar Negeri Sembilan pada laporan 25 Jan 2012 menyatakan antara faktor kelewatan projek ini ialah kontraktor swasta yang mahu mengambil keuntungan pembinaan sehingga RM80 juta. Kemudian laporan 15 Mac 2012 MB berkata antara faktor kelewatan projek ialah PKNS membuat bantahan di Mahkamah Tinggi kerana tidak bersetuju dengan harga itu kerana mahu menjualnya pada harga RM22 sekaki. Yang mana satu faktor kelewatan projek yang sebenarnya.
Keenam : Pada tahun 2008 projek ini dianggarkan kosnya ialah RM 100 juta. Kontraktor mana yang hendak untung sampai RM 80 juta tersebut? Adakah ianya melalui proses tender terbuka?

KUALA LUMPUR: The government will kick-start the Rembau District Hospital project in May to fulfil a promise made during the 2008 general election campaign.
Health Minister Liow Tiong Lai, who made the announcement in Parliament today, said the project would cost RM122.6 million.
Liow said the hospital would be built on a 45-acre site and would have the capacity for 76 beds and a surgery room. About a dozen doctors would be stationed there permanently, he added.
"We completed the tender process on March 27 and construction works will start by the end of May," he said. "We expect the project to be completed in three years' time."

SENAWANG, 25 Jan 2012 – Hospital Rembau yang di pohon oleh penduduk Rembau telah diluluskan pembinaanya melalui Rancangan Malaysia ke-9 (RM ke-9). Namun ketika itu, pembinaan hospital ini di berikan kepada kontraktor swasta yang mahu mengambil keuntungan pembinaan sehingga RM80 juta.
Selepas persetujuan itu, Kerajaan Negeri juga telah mendapatkan lokasi hospital yang akan di bina di tanah PKNS seluas dua puluh ekar di tanah industri Chembong.
Menurut Menteri Besar lagi, "tender pembinaan hospital Rembau akan di buka pada bulan April 2012 dan orang ramai tidak perlu gusar lagi t! entang i su hospital yang di bangkitkan pembangkang."

Projek itu pada mulanya dirancang dilaksanakan pihak swasta, namun Kementerian Kesihatan mahu ia diletakkan di bawah kendalian Jabatan Kerja Raya (JKR) dan perubahan itu menyebabkan rombakan semula memakan masa.
Berikutan itu, Kementerian Kesihatan membuat perjanjian dengan PKNS untuk pembelian tanah berkenaan. Bagaiamanapun, masalah harga tanah pula timbul dan menyebabkan projek itu tertangguh lebih dua tahun apabila kementerian hanya membayar RM16 sekaki, sedangkan harga kos ditanggung PKNS adalah RM18 sekaki.
Berikutan itu, PKNS membuat bantahan di Mahkamah Tinggi kerana tidak bersetuju dengan harga itu kerana mahu menjualnya pada harga RM22 sekaki.

REMBAU 7 Mac 2008 - Hospital Daerah Rembau yang boleh menampung 76 katil akan dibina di sini dengan kos RM100 juta ! untuk me mberi kemudahan kesihatan yang lebih baik kepada 60,000 penduduk, kata Menteri Besar Datuk Seri Mohamad Hasan di sini hari ini.

MENGUMUMKAN PROGRAM JELAJAH DEMI RAKYAT NS 2012 - TINGKAT KESEDARAN DAN KENYAKINAN RAKYAT NEGERI SEMBILAN UNTUK MELAKUKAN PERUBAHAN

Pilihanraya Umum sudah terlalu hamper. Dalam pada masa yang sama manipulasi media terus berlaku dalam keadaan melampau. Masalah rakyat seperti kenaikan kos kehidupan kerana kenaikan harga barang, kos perubatan, kos pendidikan dan seumpamanya cuba dialihkan dengan isu rekaan seperti perkauman dan seumpamanya. Negeri Sembilan kini semakin hilang daya saing. Senarai projek terbengkalai, projek tertangguh, salah guna kuasa memparahkan lagi keadaan. Negeri yang berpotensi untuk 'menjadi hebat' ini hilang serinya kerana pentadbiran kerajaan yang lemah dan tidak cekap. Begitu juga kerajaan di peringkat pusat.

Pilihanraya 2012 dilihat ramai sebagai peluang terbaik untuk rakyat melakukan perubahan bagi menyelamatkan negara dan negeri ini. Cuma kadangkala permainan media! melampa u sedikit mengelirukan rakyat.

Maka dengan ini dimaklumkan akan diadakan Program Jelajah Demi Rakyat N.Sembilan 2012 ke arah mempertingkatkan kesedaran rakyat N.Sembilan.

Matlamat program ini :

  • Meningkatkan kesedaran rakyat terhadap kegagalan Barisan Nasional mentadbir Kerajaan Negeri Sembilan termasuk kerajaan pusat dengan menerangkan kelemahan dan penyelewengan yang wujud.
  • Menyakinkan rakyat mengenai alternatif terbaik (Pakatan Rakyat) dengan menerangkan mengenai tawaran seperti Buku Jingga dan Manifesto Tunggak Nan 9. Juga dengan menerangkan 'success story' kerajaan di bawah Pakatan Rakyat sedia ada.
  • Mendaftarkan dan mengumpulkan seramai mungkin sukarelawan.
  • Mengenengahkan set pemimpin yang berwibawa kepada masyarakat.
  • Mendekati masyarakat secara terus dan cara yang menarik.

Program ini mengandungi 'Jelajah Ceramah', pengedaran risalah, siri pendedahan, program kebajikan dan seumpamanya. Tidak ketinggalan program dalaman seperti latihan jentera parti.

Mengenengahkan Motto "sepakat – beradat – selamat" memberi kempen ini kea rah rakyat sepakat (menyatukan) membentuk kerajaan beradat (mengangkat undang – undang adil) maka melahirkan sebuah negeri yang selamat (sejahtera) untuk rakyat. Pendekatan kempen mempunyai tema dan mascot yang istimewa ini akan berbentuk mesra rakyat dan julung kali diadakan dengan menampilkan tokoh nasional dan tempatan.


Kesemua siri program jelajah ini akan mengajak rakyat untuk bersama dalam program kemuncak. Kemuncak program jelajah ini ialah pada 29 April 2012 di Seremban dan dijangka akan dihadiri oleh puluhan ribu rakyat negeri ini bagi menunjukkan ikrar dan kesediaan bagi mengubah kerajaan ke arah menjadikan negeri ini benar – benar berdaya saing ke arah kesejahteraan hidup rakyat. Himpunan Kemuncak ini akan menjadi himpunan rakyat terbesar Negeri Sembilan dan akan diadakan dalam suasana meriah dengan semangat penyatuan semua rakyat kea rah membentuk kerajaan baru dengan harapan baru. Seketeriat hari ini akan ke Majlis Perbandaran Seremban bagi menghantar permohonan untuk menyewa Padang MPS di tengah Bandar Seremban bagi mengadakan acara kemuncak nanti.

‘Native’ case shows state’s selective persecution

KOTA KINABALU: Sabah DAP has described the recent revocation of the native certificate of its chairman Jimmy Wong by the state government as a politically-motivated selective persecution.

"We know that it is part of Umno's strategy to selectively persecute those who are a stumbling block to its political ambitions in Sabah," said its secretary Dr Edwin Bosi.

"For Wong and the other DAP Sabah leaders, it is an occupational hazard. We will continue to stand up against injustices without fear or favour."

He said Sabah DAP was made aware of the amendment to the Native Court Enactment 1992 which provides for the establishment of a board by the head of state to investigate and validate all native certificates that have been issued.

The amendment was primarily aimed at checking and curbing abuse in the issuance of native certificates but it was stopped in 1982 by the government.

"There are many complaints about native certificates in the hands of unqualified persons and yet the authorities have has done little after the formation of the board," said Bosi.

"Wong, the sole DAP representative in the state assembly, and a 'thorn in the side' of Chief Minister [Musa Aman] has now become the first victim of the amended Act.

"What else could we call this but selective persecution by Umno," Bosi said, adding that Wong has yet to be issued a formal letter revoking his native status.

He urged State Local Government and Housing Minister Hajiji Mohd Noor to expedite the issuance of the letter so that Wong can seek justice in the court.

Hajiji had recently said the board's decision has been presented to the Kota Kinabalu Native Court (KKNC) to cancel Wong's certificate.

He, however, conceded that the board's decision can only be implemented in the near future as the court was only gazetted in December last year.

"Without the letter of revocation from the KKNC, Wong is left high and dry. We therefore urge Hajiji to deliver the revocation letter as soon as possible," Bosi said.

The Sabah DAP secretary also called to attention the timing of invalidating Wong's native certificate against the backdrop of the impending 13th general election.

'Section 10(2) needs clarification'

Bosi said that while the amendment had a noble objective, the party was concerned that it could be abused by those in power.

"The same goes for the Land Acquisition [Amendment] Enactment 2012 Bill which was fast-tracked at the Sabah state assembly sitting recently. Wong and the other two opposition representatives did not have the chance to debate the Bill," he said.

"They do not have objection to the amendment except for the part where under the new Section 10 (2), the land will be reverted to the original owner or those interested in the land.

"This section needs clarification from the government. There is also a need for a time-frame on this acquisition and development," he said.

"The two cases give an insight as to what the government can do and how it will achieve its objectives. We cannot allow ourselves to be held to ransom.

"What has happened to Wong can happen to anyone of us. The time is ripe to give Pakatan Rakyat a chance to be the government," he said.

Meanwhile, the government's decision to disqualify Wong has already had an impact on the thousands in Sabah who have been issued such native certificates.

A local newspaper reported that a police report was lodged against two landowners in Sandakan on the east coast for owning native title land.

Villager Abdullah Japar of Kampung Suan Lamba in Sukau made a report claiming that the landowners who are brothers purchased thousands of acres of native title land in Kinabatangan using their native certificates.

According to the police report, the KKNC had issued the document to the brothers in 1979 as they claimed to be of Sino-Kadazan descent but records of the National Registration Department showed that their father was a Chinese from Singapore.

Local NGO, the Native Cultural and Welfare Association, called on authorities to take action against all those who had acquired native titles as they are not entitled to own such lands following the government's ruling against Wong.

Has Najib’s confidence of a sure win in 13GE been shattered by Mahathir’s repeated gloomy warnings?

For the past three weeks in his intensive electioneering campaign in Selangor and Perak in the build-up to an expected 13th General Election date in June, the Prime Minister Datuk Seri Najib Razak has been exuding increasing confidence of a sure win in the next general election, including taking back Selangor state government from Pakatan Rakyat.

Najib's popularity has been on the rise, surging 10 points to 69 per cent following his role as Santa Claus with RM500 cash handouts to low-income earners and a slew of multi-million ringgit approvals and allocations in line with his "I help you, you help me" philosophy – but the Prime Minister's high personal approval rating is not matched by the ruling coalition component parties.

Only last week, Najib said "strong winds are blowing towards Barisan Nasional", public feedback "very encouraging" and people have been telling him that BN has regained public support since the 2008 polls.

The stage seems all set for 13GE in June.

But something very strange has happened in the past few days as if all the momentum for a June elections have suddenly faltered.

Has Najib's confidence of a sure win in the 13th General Election in June this year been shattered by former Prime Minister, Tun Dr. Mahathir Mohamad's repeated gloomy warnings?

Mahathir delivered his latest warning to BN of "No easy wins ahead" yesterday, telling Barisan Nasional not to believe that it would enjoy any guaranteed electoral victories, saying Pakatan Rakyat is an opposition unlike those from his days as prime minister.

As Mahathir told Bernama Online:

"What is certain, it won't be easy for BN to get two-thirds majority this time. The opposition now is not like that of the past, and the current situation is rather confusing."

A day earlier, Mahathir had dropped another bombshell for UMNO to pulverise its sense of confidence when he admitted that UMNO does not have quality and talented leaders to form a capable government as "For decades, Umno has 'not allowed' the smart ones to join the party".

Mahathir is now advocating that UMNO should field outsiders in the coming general election, put up "good candidates, whether they are UMNO members or not" and abandon the practice of only picking divisional leaders to contest.

With the evaporation of the earlier UMNO confidence of a sure win in the 13GE, even winning back Selangor and retaining Perak state governments, the stage seem to be set for Najib, on the eve of his third anniversary as Prime Minister, to do another "flip-flop" to push off the 13GE to a later date.

Native status: Opening a Pandora’s Box

Sri Tanjung state assemblyman, Jimmy Wong, has finally been stripped of his native certificate – Sijil Anak Negeri – by the Kota Kinabalu Native Court as revealed in the State Legislative State Assembly on March 27.

Although the certificate was found to be genuine, it was not genuinely issued and/or alternatively fraudulently/mistakenly issued by the Native Court since Wong, the Sabah DAP chairman, was on the face of the matter not eligible to hold it.

No date has been set so far for the implementation of the decision, although it was gazetted in December last year, the Sabah state assembly observed.

Apparently, Wong's mistake, if any, was to claim that he was a Sino-Kadazan.

State Local Government and Housing Minister Hajiji Mohd Noor told the state assembly that a special board appointed by the governor in 2010 found that Wong "did not have even a drop of Kadazan – urban Dusun – blood in him but based on the fact that both his parents were listed as Chinese in his birth certificate".

Wong had previously claimed in the media that his grandmother, either maternal or paternal, was Kadazan.

He had further claimed that his native certificate was obtained by his elder brother on his behalf, from the Native Court, while he was still studying in England.

It's not known what supporting documents, if any, were used for Wong to claim native status. The only basis for Wong to win native status from the Native Court would have been his grandmother's status as a Kadazan, as documented, and not on mere hearsay.

Native land

It's not known what further punitive measures, if any, will be taken by the authorities or the Native Court against him. Hajiji is leaving the matter in the hands of the Native Court.

Wong has allegedly used his native certificate to hold native land, among others, but it's not known to what extent.

If it's true that Wong does not have even a drop of Kadazan blood in him, his mistake may have been in applying for native status on the basis of him being a Sino-Kadazan or Sino, as such claimants generally like to call themselves.

Perhaps the word "Kadazan" sticks in their collective throats.

The Native Court from recorded instances in the past, rare and far between, has declared non-natives who are Momogun as natives (Pasok). There's even a case law from several decades ago on a pure Chinaman, from China, winning native status in the Native Court on the basis of being a Momogun.

Only non-natives living with and among natives, whether married or otherwise to the latter, can possibly be considered Momogun.

One theory postulated by some adat experts in the past is that it's merely enough for a non-native to live in the land of the Pasok, that is, Sabah to be considered a Momogun and not in fact live with and/or among the natives.

However, barring exceptional or special circumstances like being married to a Pasok, it's highly unlikely that anyone who claims to be a Momogun would succeed in law and adat unless he or she lives with and/or among the Pasok, can speak at least 200 words of KadazanDusun (in the standard speech form), and demonstrate that they habitually practise Pasok culture, customs and traditions.

Political hot potato

Wong's fate mirrors that which awaits thousands of others like him in Sabah who claim to be Sino-Kadazans and similarly hold native certificates from the Native Court. It's also said that there are thousands of forged native certificates floating around in the state.

However, the onus is not on native certificate holders to prove their eligibility unless challenged like in the case of Wong. His troubles arose when Sekong Samsudin Yahya repeatedly brought up the allegedly dubious status of Wong's native certificate over a period of six to seven years. His persistence eventually paid off.

The issue of whether Samsudin himself is a native has been raised but so far nothing has come out of it. No doubt this matter, as in Wong's case, would take another six or seven years to find closure but only if someone persists in raising it in the state assembly. The fear is that a Pandora's Box may open up here.

It has been alleged during political campaigning in the past and in cyberspace that various personalities were in fact not what they pretended or claimed to be and may have found their way into the state assembly, Parliament and even the governor's palace in the past on the basis of less than candid revelations and declarations.

Again, this remains a Pandora's Box to be opened.

Alternatively, the state government could declare an amnesty for all those holding native certificates to which they are either not entitled, forged, or holding it on the basis of applying for native status without claiming to be Momogun.

Those who surrender their native certificates should not be prevented from applying, if eligible, for native status as Momogun.

This is a political hot potato but an issue which needs final resolution considering the "freeze" for many years by the state government on the issuance of native certificates by the Native Court for alleged abuses in the past.

Valid grounds

It has been previously suggested by Federal Minister Bernard Giluk Dompok that only the Native Court, and not the state government, could freeze the issuance of native certificates but only on valid grounds in law.

The decisions of the Native Court are appealable in law to the High Court which functions as the appellate court for the former and, on land matters, for or against the Collector of Land Revenue at the Land Office.

Either way, the Sino-Kadazans in particular and other part-natives by blood are up in arms and want the Native Court to resume the issuance of the Sijil Anak Negeri as soon as possible.

At present, eligible applicants rely on a letter from the Local Government and Housing Ministry, upon recommendation by the Majlis Hal Ehwal Anak Negeri, to claim any benefits as natives.

The National Registration Department (NRD), acting in concurrence with the state governments of Sabah and Sarawak, has meanwhile decided by administration that part-natives will henceforth not be listed as such in their birth certificates and by extension other personal documents. Sino-Kadazans, for example, would have to decide whether they want to be Kadazan or Chinese. They can't claim to be both.

The part-natives have been lucky so far that no native has had the heart to take the matter to court by way of a judicial review through an order of certiorari to squash the administrative ruling.

Sino-Kadazans, unlike other part-natives, have come out strongly against the recent administrative ruling. They insist on retaining the Sino, to identify with their Chinese heritage as well, and at the same time be accepted and recognised as natives. They have since formed an association to push their cause. It's as if they want to have their cake and eat it too.

The Native Interpretation Ordinance, like a similar law in Sarawak, and the Federal Constitution have a clear listing of ethnic groups recognised as natives.

Burning question

In Sabah, the natives of the Sulu Islands, once one with the eastern seaboard of Sabah, and the natives of Malaya, Singapore, the Indonesian Islands, Brunei and Sarawak can qualify as natives "provided not subject to immigration restrictions".

The Federal Constitution does not state the Malay-speaking communities, collectively referred to as Malays, are natives. The Sabah Ordinance clearly refers, among others, to the Orang Asli in Peninsular Malaysia.

Local Muslims in Sabah who had mistakenly had themselves classified as Malay for some strange reason have suddenly found themselves out in the cold when they realise that they can no longer be considered natives of Sabah. Local Muslims are either Dusun, Bajau, Suluk, Irranun, Barunai and similar groups. Except for the Barunai from Brunei and the Dusun, the others are immigrants from the Philippines who came as far back as 300 years ago but many after Malaysia in 1963.

Generally, those classified in Sabah by the NRD as Malay are Muslims from the Philippines, Indonesia and the Indian sub-continent, that is, if they are not listed as they are in their original documents. From having no Malays in Sabah back in 1960, the statistics showed 303,500 Malays in Sabah by 2000, according to the book "Lest We Forget" by anti-illegal immigration activist Dr Chong Eng Leong.

In reality, adat, constitutional conventions and politics will prevent anyone from outside Sabah, except perhaps Sarawak, from being listed as a native.

Former Sabah chief minister Harris Salleh paid a high price in 1985 when he came up with the term "Pribumi", under the Native Interpretation Ordinance, to include illegal immigrants from across the border as natives of Sabah. His Berjaya Party was humiliated in state polls that year by the 45-day old Parti Bersatu Sabah (PBS) led by Joseph Pairin Kitingan, also the Huguan Siou (Paramount Chief) of Sabah.

Sino-Kadazans, like other part-natives and Malays, are not listed as natives in the Native Interpretation Ordinance and there's nothing that can be done about this under the law. Non-natives cannot be legislated into law as natives more so since it involves the burning question of native land.

The Sino-Kadazans, for one, are demanding that the Federal Constitution be amended to accommodate their demands. They are barking up the wrong tree. The question is who will bell the cat?

How do I love thee? Numbers tell all in book
TOKYO - When a man thinks his partner is cheating on him, chances are fifty-fifty that he's right.
But if a woman suspects her nearest and dearest of being unfaithful, she's correct a whopping 85 per cent of the time.
Special intuition? No, simply numbers - as compiled in "Love by Numbers," a wide-ranging and sometimes wacky look at the figures and trends behind how and who people love, drawn up by Australian statistician John Croucher as a tongue-in-cheek way, so to speak, of making sense out of romance and sex.
"Ask men what makes their blood run cold when your partner says it to you and number one in all the surveys I've seen is,'We have to talk.'
Men don't want to talk and if she does she's either going to leave him, found somebody else or found something out about him," said Croucher, a professor at Macquarie University, as an example.
"The second one was 'Who was that woman I saw you talking to?'
I think for women it was 'What's for dinner?'"
Among the many tidbits in Croucher's book, the result of years of research plus a study of people's behaviour in speed dating, are things as disparate as the fact that 68 per cent of men think a woman's invitat! ion to h ave coffee is really an invitation to have sex, or that 11 per cent of respondents in the United States have ended a relationship because of a cat.
Given that some 60 to 90 per cent of physical communication between humans is due to unspoken signals, a sizeable chunk of the book is devoted to how to translate that body language in the most useful way.
Guys, want to look attractive to women?
Wear a red shirt and chat up another woman - or better yet, two women.
But if you're a woman, men find you more appealing if you're alone.
A woman who flips her hair or crosses her legs is trying to get a man's attention, as is one who strokes a rounded object like her drinks glass.
But if she puts her purse behind her this is not a good sign - the bag is an extension of herself, and she's hiding.
Though Croucher acknowledges that some of the answers, particularly those dealing with sexual partners, are subject to some adjustment, many are a useful guide to how humans think.
"It just tells us about human nature, I suppose... It's like asking a man how tall he is, he'll add on 2 to 3 cm - but if you ask a woman her weight she'll take off 3 kg," he said.
"It's a fun thing but it's also a serious thing because you can actually look at the way the rest of the world behaves and their attitudes and human nature and relationships."
One of his personal favourites? The question about whether people would marry their current partner if they knew then what they know now - which in some cases yields negative replies from up to 70 per cent of women.
"They ask people do you still believe in love at first sight and do you think you married your soulmate, and only 39 per cent of people think they've married their soulmate," he said.
"Twenty-one per cent thought they'd married their soulmate but turned out to be wrong, and 32 per cent were sure that they didn't. So fewer than 2 in 5 married their soulmate."
Oh, and to answer another one of a relationship's more treacherous questions: 52 per cent of men say they would lie if asked by their partner, "Does my bum look big in this?"
