“Malaysia is at war” with its own citizens, so says our PM

So why is the PM going around canvassing for battle-ready support and killing-machine build-ups? Is this the politics that can transform Malaysia?

If what has been reported is true, then Malaysians have everything to fear. Hopefully we get some immediate clarification from the PM himself.

The Prime Minister Datuk Seri Najib when addressing close to 700 former senior civil servants is reported to have said that the government (meaning the BN political party - without doubt), "we are at war, the mother of all battles."

That is most damaging a statement to make – especially coming from the top leader of a nation. The PM has affirmed that the country is heading for disaster.

In the first place, why does the PM allude to the coming general elections as if a country has to go to war? He even went on to state that there has to be a chain of command.

It is reported that he said "if the general says attack, you must attack at the same time."  Now that is a most intimidating statement would you not agree?

The rakyat are certain to put two and two together and you cannot condemn them for thinking even the worst of the BN coalition, can you?

Elections as enshrined within the sanctified principles of democracy, and as practiced in the civilized world over by good governments is not about "attacks", "war" and "winning at all costs". On the contrary it is about your ability to not only safeguard but to also do all that it takes to deliver humanity from the claws of tyranny, abuse of civil liberties and to provide every citizen a right to life and let live.

So why is the PM going around canvassing for battle-ready support and killing-machine build-ups? Is this the politics that can transform Malaysia?

It is about time that his advisers  told the top most leader of the nation – the PM, to speak and encourage the citizens more like a leader for all and not as a battle-hardened commander out on a killing spr! ee to fi nish-off any opposition to his or his political party's agendas.

If he wants to canvas and recruit militant-like followers who will "attack when the general says attack", then he better step down as the PM of a nation and wear only the hat of leader of his political party. The people will have no qualms even if he screams for blood as political party President.

TAWARAN BUKU JINGGA PENYEBAB UMNO/APCO MEROYAN

Pakatan Rakyat (PR) telah mengemukakan Buku Jingga yang mengandungi program yang dijanjikan untuk dilaksanakan apabila diberi mandat oleh rakyat Malaysia untuk memerintah negara. Reaksi negatif terhadapnya diterima daripada UMNO/APCO-BN. Mereka bukan sahaja menganggapnya tidak realistik malahan juga akan mengbankrapkan negara. 

PR membalasnya dengan mengatakan bahawa kandungan dalam buku itu terlebih dahulu telah dirujuk kepada pakar. Dengan kata lain, bukan syok sendiri. Mereka membidas UMNO/APCO-BN bahawa negara ini akan bankrap disebabkan oleh sikap buruk UMNO/APCO-BN yang boros, korup, menyalahgunakan kuasa, tiris, dan sebagainya. Belum pernah ada negara yang mengutamakan kebajikan untuk rakyat ditimpa musibah seperti itu. Negara berkebajikan akan membahagiakan rakyat dengan keadilan, kesejahteraan, dan dirahmati Tuhan.

Walaupun ditohmah sedemikian rupa, UMNO/APCO-BN rupa-rupanya tidak duduk diam. Mereka mengkajinya walaupun Ahmad Maslan dengan angkuh membakulsampahkannya. Ternyata mereka teruja dengannya. Mulut mereka mencemuh, tetapi hati mereka mengiyakannya. Lantaran itulah mereka mula mencedoknya.

Aspek paling penting yang menyentuh perasaan UMNO/APCO-BN apabila membaca Buku Jingga ialah mengutamakan kebajikan rakyat. Oleh sebab itu, Najib dan Rais sering menyebut ungkapan keadilan sosial dan ucapan-ucapan mereka. Ungkapan tersebut terlalu asing bagi para pemimpin UMNO/APCO-BN sebelum ini. Maka mereka pun mengambil langkah untuk mendekati rakyat. Hendak meniru sepenuhnya mereka malu. Maka dilaksanakanl! ah Klini k 1 Malaysia, Kedai Rakyat 1 Malaysia (KR1M), Menu Rakyat 1 Malaysia, Bantuan Rakyat 1 Malaysia (BR1M), dan sebagainya.

Namun demikian, ketiadaan ketelitian telah menyebabkan program-program itu dicemari kecacatan yang ketara. KR1M bukan sahaja tidak mampu meringankan beban yang ditanggung rakyat akibat kenaikan harga barang malahan juga terlampau terhad jangkauan perkhidmatannya. Adalah lebih baik jika harga barangan diturunkan bagi membolehkan semua rakyat menikmatinya berbanding dengan KR1M yang ada di tempat-tempat tertentu sahaja, dimonopoli oleh syarikat tertentu sahaja, dan menjual barangan yang diragui mutunya. Begitu juga dengan Menu Rakyat 1 Malaysia yang memfokuskan masyarakat bandar dan pinggir bandar sahaja. Riuh-rendah tentangnya ditenggelami cakap tak serupa bikin apabila harganya tidak setanding kualiti dan kuantiti seperti yang dinikmati PM semasa melancarkannya.   

Walaupun UMNO/APCO-BN berusaha dengan bersungguh-sungguh hati menepis tanggapan negatif tersebut, keraguan tetap terpahat dalam hati rakyat. Hal ini terpacul apabila para pemimpin UMNO/APCO dilihat tidak merakyatkan kehidupan mereka secara realitinya. Najib membelanjakan wang rakyat lebih daripada RM400,000 untuk majlis pertunangan anak perempuannya. Walaupun hal ini dinafikan, Najib belum memberi bukti sahih hingga kini. Noh Omar buat projek jeti perikanan tanpa kelulusan (yang besar kemungkinan menjadi gajah putih) bernilai RM20 juta. Najib juga didakwa membelanjakan (wang rakyat?) sebanyak RM79,053 hanya untuk sambutan hari jadinya! Ketiga-tiganya dinyatakan sebagai contoh sahaja. Ada banyak lagi kerja buat UMNO/APCO yang bertentangan dengan konsep wasatiyyah yang Najib sendiri anjurkan.  

Skim Saraan Baru Penkhidmatan Awam (SBPA) dikemukakan pada awal tahun 2012 untuk mengkaunter janji dalam Buku Jingga tanpa persediaan yang teliti. Apabila dikritik hebat, Najib membatalkannya dan kembali menggunakan Skim Saraan Malaysia (SSM). Jelaslah di sini bahawa Najib gagal merancang dengan betul dan sentiasa bersikap flip-flop.

Dr. M juga demikian, Dia melancarkan Pengajaran Sains dan Matematik dalam Bahasa Inggeris (PPSMI) tanpa menghiraukan bantahan banyak pihak. Akibatnya ramai anak Melayu, terutama di luar bandar yang teraniaya. Protes melalui demonstrasi telah menyebabkan projek ini dibatalkan. Namun, sekali lagi UMNO/APCO-BN flip-flop. Desakan PAGE menyebabkan PPSMI diteruskan untuk kohot pelajar yang mengikutinya dalam bahasa Inggeris hingga selesai. Hal ini menyebabkan tuntutan supaya PPSMI dimansuhkan terus dilancarkan baru-baru ini. 

UMNO/APCO-BN dengan bangganya mengumumkan percantuman MAS-AIR ASIA tanpa mengambil kira pandangan kakitangan MAS. Kini telah ada ura-ura penggabungan itu tidak akan dilaksanakan. Di sana sini orang sibuk memuji-muji Najib kerana melancarkan Program Skim Rumah Pertamaku. Hanya seribu lebih permohonan yang diterima. Dari jumlah itu, lebih sedikit daripada 200 permohonan diluluskan. Desas-desus mengatakan bank menganggap orang muda yang berpendapatan kurang daripada RM3,000 tidak layak mendapat pinjaman hingga RM200,000. Sekali lagi projek Najib terbongkang.

Buku Jingga mahu menghapuskan tol. Tersentak dengan janji itu, Najib sendiri mengumumkan tol Kajang-Cheras dikurangkan sebanyak 50%, iaitu dari RM3.80 menjadi RM1.90 pergi dan balik. Anehnya, Najib mendakwa pengurangan itu sebagai perjuangan UMNO/APCO-BN!!! 

Fenomena melancarkan program tanpa perancangan rapi telah menjadi trend pentadbiran ! Najib ga ra-gara ketakutan terhadap kandungan Buku Jingga. Penangan Buku Jingga benar-benar menggelabahkan UMNO/APCO-BN. Itu bermakna segala yang terkandung dalam buku itu realistik, bukan angan-angan kosong. 

Kita percaya rakyat Malaysia sentiasa memerhati dan menilai kerja buat UMNO/APCO-BN itu. Najib sememangnya taksub dengan konsep membeli sokongan dengan duit. Sesudah itu mereka mewar-warkan kepada rakyat bahawa duit itu untuk meringankan beban rakyat. Semua orang tahu selama mana wang yang bernilai RM500 boleh bertahan dalam negara yang harga barangannya cekik darah. 

Reaksi rakyat ialah mereka suka dengan penunaian tanggungjawab  (bukan pemberian) yang hanya dilakukan menjelang pilihan raya itu. Najib benar-benar teruja melihat reaksi rakyat itu kerana dia memang suka dipuji dan dipuja. Perkara yang mungkin dia tidak sedar ialah rakyat sedang menggula-gulakan dia. Mereka mau lagi. Lagi. Dan lagi. Wang itu adalah hak mereka, bukan milik UMNO/APCO-BN. Penanda aras keterujaan Najib ialah janjinya untuk beri BR1M lagi kalau pendapatan negara bertambah. Sekali lagi dia bermain dengan kata-kata. Dia tak perlu kata 'kalau' kerana Malaysia kaya dengan sumber alam dan hasil-mahsul. Buktinya negeri-negeri ditadbir Pakatan Rakyat dapat meningkatkan pendapatan setiap tahun. Mengapa negeri-negeri tadbiran UMNO/APCO-BN tak boleh? Mereka suka membazir,rasuah, tiris, salah guna kuasa, seleweng, dan sebagainya. 

Bagaimana Pakatan dapat membantu rakyat tanpa henti sejak tahun 2008? Tak payahlah dinyatakan lagi di sini. Cukuplah dengan penjelasan positif Ketua Audit Negara terhadap Kedah, Kelantan, Pulau Pinang, dan Selangor. Cukuplah juga dengan penjelasan negatif Ketua Audit Negara terhadap aneka rupa penyelewengan, penyalahgunaan kuasa, dan ketirisan yang berlaku dalam negeri-negeri tadbiran UMNO/APCO-BN, kemente! rian dan jabatan-jabatan kerajaan. 

Rakyat dari pelbagai lapisan masyarakat tanpa mengira kaum, bangsa, dan agama perlu menyelamatkan Malaysia daripada dimusnahkan oleh UMNO/APCO-BN.  Kuasa berada di tangan anda. Berilah kemenangan kepada Pakatan Rakyat dalam PRU Ke-13 untuk melihat pembentukan Malaysia Baru yang adil dan saksama bagi rakyat Malaysia yang tercinta!!!

THE BN’S GOLDEN RULE: KEEP THEM SIMPLE, STUPID!

Recent statements by Sarawak Barisan Nasional's two top Dayak leaders have had a 'sobering' effect on the opposition.

Recent statements by Dayak majority party – Parti Rakyat Sarawak (PRS) and Sarawak Progressive Democratic Party (SPDP) – leaders have exposed the modus operandi of the Barisan Nasional coalition over its voters.

'The rule it appears is to keep the people simple and ignorant at all cost. At all cost, prevent any advancement from reaching them so that they remain grateful to the BN for the little scraps that are thrown at them once every five years," said Sarawak PKR chief Baru Bian.

HE added that the BN startegy had kept the rakyat oppressed for over 40 years and helped the coalition perpetuate abuse.

Citing SPDP president William Mawan's recent discomfort at rumours that the 13th general election may be held June 3, 2012, Bian said the truth of the situation was 'sobering'

Mawan had reportedly said: "If election is held during this time, the young, educated professionals who work in the cities might bring everything that is new that in turn could change the mentality of the people in their kampungs and longhouses."

Responding to Mawan's comment, Bian who is the Ba'Kelalan assemblyman said: "This statement betrays the fear the BN politicians have that the rural folk will one day wake up to the sobering truth that the only people who have benefited from this BN government are the BN politicians themselves and their families and cronies.

"Mawan's desire to keep the rural people as ignorant and unaware as the proverbial frog under a coconut shell suggests that the BN government has no desire at all to help them grow and advance with the times.

"What is it about changing their mentality that frightens the BN so much? How are we ever going to catch up with the developing world if our government prefers to keep the rakyat in the dark ages?

"Is this the reason why healthcare and educational opportunities and facilities are so primitive and inadequate in the rural areas?"

'Shameful legacy by BN'

Bian said that currently up to 500,000 homes in Sarawak are still not connected to any electricity grid, and the majority of the rural population has no access to the internet and other amenities.

"(Knowing this) the government has no business harping about SCORE (Sarawak Corridor for Renewable Energy) and the miraculous riches it will bring to the raykat when it has not provided the basic education and facilities for the people to be able to participate in it.

"To top it off, we are told that bringing 'everything that is new' to the kampung is not a good thing.

"Obviously, encouraging the population to acquire knowledge is detrimental to the BN's health, as with knowledge (and critical thinking) comes the realisation of the people about the power that they wield," he said.

Bian also found PRS president James Masing's recent statement equally astounding.

Masing had allegedly said that the rakyat are the bosses only for one day every five years (during polling day) and that the rest of the days the elected YBs are the bosses and that the rakyat are to be 'subservient', having no right to challenge anything the bosses choose to do.

Masing was quoted to have said that: "If their YBs, for instance, pass a law which tells the rakyat to walk backward, the rakyat must walk backward".

Bian along with many others in Sarawak found Masing remarks 'disturbing'.

Said Bian: "It is extremely disturbing and disappointing that this veteran politician should cite as an example a law which clearly would not advance the welfare of the people and which cannot reflect the will of the people.

"Yet what an apt example for him to put forward – it reflects perfectly the policies of the BN government.

"Keep the rakyat backward and poor while the BN politicians push forward with their self-enriching land-grabbing schemes.

"In fact, the government policies over the past few decades have forced the rakyat to walk backwards – they are actually getting poorer.

"Proof of this is when (state) Welfare, Women and Family Development Minister Fatimah Abdullah said that since 2007, the rate of poverty in Sarawak had increased from 4.2% to 5.3% in 2009

"What a shameful legacy for the BN government."

Twisted reasoning

Bian pointed out that elected representatives are given the privilege to sit in their positions of authority so that they can serve the will of the rakyat.

He said the term 'rakyat' is not defined according to political leanings and even if it is, the will of the opposition may well be the will of the majority, given the gerrymandering and dirty politics practised by the BN government.

"Our elected representatives are not given wholesale power to act on their whims and fancies. Using this twisted reasoning to justify a decision made in an obvious case of abuse of power will intensify the resentment of the people against a tyrannical government.

"His (Masing) perverse defiance in the face of criticism and reproach (even from some BN leaders) does not bode well for him, but has contributed in no small way to building up support for the message of truth and promise of good governance by the opposition," said Bian.

War crimes: BN accused of hypocrisy

KUALA LUMPUR: If there's a war crime taking place in the world today, and if it's not happening in Palestine, don't expect Malaysia to take a stand against it.

This is what Pakatan Rakyat MPs are saying today after the Speaker of Parliament rejected an emergency motion to debate Malaysia's stand on the United Nations resolution calling for investigations into human rights violations during the final months of the 26-year Sri Lanka civil war.

According to Subang MP R Sivarasa (PKR), Putrajaya does not seem to understand the universality of human rights.

"It should not matter if you're Tamil, Singhalese, Muslim, Christian or Buddhist," he told reporters at Parliament House.

"If war crimes have been committed against you, it doesn't matter whether you're Palestinian attacked by Israeli tanks or whether you're Sri Lankan attacked by Sri Lankan tanks. It doesn't make a difference."

"By remaining silent or supporting the Sri Lankan government on this issue, it shows that our human rights position is completely hypocritical."

The resolution on Sri Lanka, moved by the United States, is due for a vote this Friday at a meeting of the UN Human Rights Council. Malaysia is one of the 47 members of the council. The resolution calls on the government in Colombo to probe alleged atrocities caused by both government troops and Tamil rebels.

As many as 40,000 people are estimated to have been killed in the last months of the conflict, which ended in May 2009 with the defeat of the Tamil Tigers. The resolution does not sit well with Colombo, which denies that government troops committed war crimes.

Affecting ties with Sri Lanka

The motion rejected in the Malaysian Parliament was submitted last week by DAP's M Manogaran, the MP for Teluk Intan.

Speaker Pandikar Amin Mulia, who made his decision in chambers this morning, said discussing the matter would affect Malaysia's "good relationship" with Sri Lanka.

Manogaran tried to raise the matter when the Dewan Rakyat was in session, but Deputy Speaker Ronald Kiandee said his motion had already been rejected.

"I'm not raising a question on Sri Lanka," Manogaran told reporters afterwards. "I'm just giving a notice to move the house to be adjourned to debate on the resolution given by the US. I don't agree that it has to do with internal affairs. If we can't debate it here, where can we debate it?"

Sungai Petani MP Johari Abdul (PKR), who visited Sri Lanka a few months ago, said the case of the South Asian nation was no different from that of Palestine.

He deduced, however, that the Barisan Nasional government was less concerned with Sri Lanka because most Malays were oblivious of the sufferings of people there "even though a lot of them are Muslim".

As far as the government was concerned, he said, the Sri Lankans held no political mileage.

Klang MP Charles Santiago (DAP) accused Malaysia of being opportunistic when it came to human rights.

"We all support the Palestinian cause because we believe in the sovereignty of the nation, the people," he said. "That same foreign policy must be extended to be people of Sri Lanka. But when it comes to Sri Lanka, it's really opportunistic foreign policy making."

Manogaran urged MIC to state its official stand on the resolution.

He said Malaysian Indians would want the MIC ministers to raise the issue in the next cabinet meeting, which is this Friday, the same day of the UN vote.

MIC Secretary General S Murugessan said that his party would state its official stand in two days' time.

"We will conduct a meeting this evening to discuss the matter," he told FMT.

Double standards

Manogaran, pointing to the Malaysian support for Muslim insurgents in southern Thailand and the southern Philippines, said: "It is clear that the BN government practises double standards in foreign policy."

He also said Indians in Malaysia would be embarrassed if Malaysia were to vote against the UN resolution.

A political analysist sharing Pakatan's view warned the BN government of a possible backlash if it failed to support the resolution.

A Thiruvengadam, who writes a political column for Tamil dailies, said the coming general election might turn out to be "another political tsunami" brought on by the Sri Lanka issue.

  • I have written several posts about the water issue. Some that I could fish out from my blog archives are listed above. I am in full support of the SSG on the matter related to water since the issue crop up and my position on the matter has not change. One of the commentators is my regular sparring partner and we have resigned to the fact that we should agree to disagree. I decide to write about it today after reading an article in the Edge daily where Minister Chin made a statement that the issue is a very much stalemate where the FG position is that it does not want to talk about operations of Selangor water until the Langat 2 water treatment plant is resolved. The way the FG is treating the SSG is as if it is a different country. I wish the FG had maintained the same kind of vigour when it dealt with Singapore and Brunei on many issues. So far, the FG looks very lame when dealing with our neighbours. The FG treatment of the SSG is simply not right.

  • I cannot understand it why the FG cannot let SSG to take over and manage the Syabas. FG should not have intervened in the business negotiation between two parties. FG intervention is unnecessary and actually raises serious concerns among the people. I for one cannot accept the bailing out of Syabas via the friendly loans. It is not about PKR or PR that is going to manage the water. It is the Selangor Government. The government could be PKR/PR today but might be UMNO/BN tomorrow. One thing that does not change is the government machineries and the people.

  • The PM can go around and saying that the people are fed up with the present SSG. How does he plans to explain to the people that since PR took over SSG has been giving water subsidy to all residential properties in Selangor whereas when they were managing the state, they have been raising water rates on regular basis. How is he going to explain if the state reverts back to Selangor, that the subsidy will be withdrawn and water rates will be raised? Najib better has a strong and good explanation to the people on why the FG prevented the water business in Selangor to fall into the hands of the government? Why is the FG appears to take all measures to ensure that the business stays in the hands of Rozali? Who is more important-Rozali or the government that is elected by the people?  

  • To the ordinary people in the street, they do not appreciate the technicalities on the water issue. They don't care about bonds, cost of treating water and other technical jargon. What is important to them is that they get cheap water supply. Whether it is sustainable or not it is secondary. To the ordinary kampong folk it must be sustainable as the SSG has been giving them subsidy and it still has a lot more money in their coffers compared to what it was in 2008. In this context, BN is perceived as the bad guy who is trying to help one man and the PR-SSG is helping millions. The situation is so bad that the SSG has to resort to seek the opinion of  a Queen Council in deciding their next option. Kesian SSG!

Shamsubahrin’s lawyers: MACC harassing, intimidating us

PUTRAJAYA: The Malaysian Anti-Corruption Commission (MACC) is investigating an allegation by businessman Shamsubahrin Ismail that National Feedlot Corporation (NFCorp) chairman Mohamad Salleh Ismail had instructed him to bribe the police to "close" the controversial National Feedlot Centre case.

However, the lawyers who accompanied Shamsubahrin to give a statement to MACC investigators at the commission's headquarters today claimed that there may be certain "high level people" giving instructions to the anti-graft body to disrupt proper investigation against Mohamad Salleh.

In an 'unusual' move this afternoon, MACC investigating officers hauled up for questioning two of Shamsubahrin's lawyers who sat in with him during his questioning session.

This amounted to an act of harassment that was both "unlawful" as well as an "intimidation", said lawyers Murnie Hidayah Anuar and Latheefa Koya, the two lawyers who were both issued notices to be witnesses into the investigations.

"We are shocked. It's unprecedented. There is no provision for them to do this. There's no such thing when lawyers are just doing their duties as stated in the Federal Constitution," said Murnie, who said she was issued a notice under Section 30(1)(a) of the MACC Act.

"This is clearly an abuse of power by MACC. We ask them to focus on the scandal revolving NFC and Shamsubahrin (and not to harass us). I think they should drop the charges against him too," said Latheefa.

"MACC is still displaying unprofessional behaviour. They are putting up additional pressure on lawyers. This notice says that since we actually sat with Shamsubahrin, we were automatically a witness. We were here in our capacity as lawyers, how can they do this with us? We are thoroughly disappointed," said Latheefa.

She said in her experience, she was always threatened but was never actually issued such a notice. The PKR legal bureau head said she will be filing a complaint to the Bar Council.

"To be fair, we feel there are investigators who are genuine but there may be unseen higher ups officials who are instructing them to do all this nonsense," she said.

Questioned for five hours

Earlier, Shamsubahrin was interviewed for about five hours in regards to SMS messages between him and Mohammad Salleh.

Shamsubahrin, who arrived at about 11am, was asked to explain in detail a total of 50 transcripts of messages which were backed-up in Shamsubahrin's e-mail.

"As far as we're concerned, what he has shown to MACC shows that he didn't do anything wrong, he has not given any money to the police. If you are instructed to pay a policeman, you cannot categorise that as so-called-cheating," said Latheefa.

"He was appointed and paid as a consultant, all he has done is to help improve public relations and the problems facing NFC," she said.

Meanwhile, Shamsubahrin maintained his innocence in the entire case.

"I still stand by what I said previously. I'm innocent. I've done nothing wrong to Mohammad Salleh, NFC, and his family. Today I've explained every detail. Now its up to MACC to act," he said.

Shamsubahrin also kicked up a fuss and complained that one of his cars seized by MACC has been damaged.

The side windows of his Mitsubishi ASX was shattered, and he said MACC must be responsible. The other two cars under MACC custody, a Mitsubishi Triton and Grandis, was undamaged.

MACC head of investigations Mustapha Ali (photo, below) said MACC would repair it, and it was an accident due to pebbles flying up from a grasscutter's blades.

In his last visit to the MACC, Shamsubahrin had handed over to the agency a handphone, some documents including transcripts of SMSes and had a brief statement recorded as well.

His lawyers then were barred from sitting with him while his short statement was taken.

On Dec 30, Shamsubahrin, 45, was charged with two counts of cheating Mohamad Salleh of RM1.76 million for "negotiation and consultation services" that which he did not deliver.

Mohamad Salleh is the husband of Women, Family and Community Development Minister Shahrizat Abdul Jalil. The "services", while not specified in court, were widely speculated to be for the closing of the NFC case.

Shamsubahrin was also charged, while he was warded at the Klang Hospital, with two separate counts of cheating not related to the NFCorp.

On Jan 30, PKR disclosed a police report lodged by Shamsubahrin in which he claimed that Mohamad Salleh had pressured him to bribe police investigators to close the case on NFCorp.

MACC's response

Meanwhile, MACC's head of prosecution from the Attorney-General's Chambers, Abdul Razak Musa said that it was normal practice for MACC to insist that lawyers cannot be present during an interrogation of a witness.

"Malaysian law is not the same as UK or US laws. Except for those accused or suspects, who have the right to counsel, witnesses should not have lawyers," Abdul Razak told FMT when contacted.

He said MACC had already informed Shamsubahrin's lawyers and was puzzled by their insistence.

"The reason for this is we don't want our witnesses later saying later that it was not his words, but the lawyer's. We've had such cases. So we must be clear. A witness must be on his own, not taught by anybody else. Because his evidence is something that would cause someone to charged, its important," he said.

Abdul Razak rubbished claims of harassment of the two lawyers and said this has been practised and was not the first time such notices were issued to lawyers.

"We already warned them. I don't know why they insist on being there. We are open. And if you've come as witness, you have to trust us," he said.

Asked about the example of Teoh Beng Hock who "may not have died if a lawyer was present", Abdul Razak said that it was merely "presumption".

"We already proved that he committed suicide. How can you blame others. Until today, nobody is charged for the incident. The Royal Commission of Inquiry had already ruled that his case was a suicide."

NFCorp CEO in court

The NFCorp issue came to light in October last year after the 2010 Auditor-General's Report revealed that the RM250-million cattle breeding project had failed to fulfil the objectives of its formation, which was to reduce beef imports.

While Mohamad Salleh headed NFCorp, his three children were directors in the company.

Mohammad Salleh is also presently charges under Section 409 of the Penal Code for Criminal Breach of Trust and offences under the Companies Act involving the alleged abuse of almost RM50million in connection with the NFC case. He has pleaded not guilty to the four charges.

Opposition parties, particularly PKR, had made a series of documented exposés linking Shahrizat to allegations of abusing state funds meant for the project.

NFCorp had been accused of misusing parts of the RM250million government soft loan to purchase high-class condominiums, premium land and a luxury car as well as expenses unrelated to cattle farming.

Najib accused of trying to manipulate Felda cases

KUALA LUMPUR: PKR today claimed that Prime Minister Najib Tun Razak was trying to manipulate the court cases involving Felda so that it favours the government.

PKR secretary-general Saifuddin Nasution showed a parliamentary meeting minutes between Najib and the Felda management held in June last year where Najib allegedly made comments akin to "judicial manipulation".

According to the minutes, Najib had purportedly said: "For any of these two court cases which trial is yet to be determined, make sure that the judge and lawyer is given the understanding of the subject and the technical methods to calculate OER… make sure Felda wins this case so it does not interfere with other cases".

Najib's remarks were in regards to two on-going court cases in the Seremban High Court and the Johor Baru High Court on oil retraction rates (OER). The trials for the cases have yet to begin.

The case in Seremban was filed by 766 settlers from Felda Raja Alias and Serting Hilir meanwhile the Johor Baru case was filed by 645 settlers from Felda Maokil.

Saifuddin, who is also the Machang MP, said that Najib's remarks gave the impression that there were elements of manipulation.

"What guarantee can the government give that it will not interfere (with the cases)," he asked reporters in parliament today.

"This is written proof, usually they will hide but now they are so arrogant that they write it in the minutes," he added.

Saifuddin said at present there were 20 pending court cases involving Felda, both as plaintiffs or defendants.

PKR's Subang MP Sivarasa Rasiah, who was also present at the press conference, said that he understood why a lawyer should to be briefed prior to a case but did not understand why the same should be done for the judge.

Sivarasa, who is the lawyer for settlers from the Serting Hilir and Raja Alias, said two more OER-related cases would be filed soon at the Temerloh High Court and the Kuantan High Court. Each of these cases will see about 1,000 settlers suing the government.

"Imagine how would the settlers involved in the court cases feel (looking at this statement)? They'd be thinking how are they going to win their case," he said.

Bersih rally: Six lose student loans

TERENGGANU: Six students who had failed to provide the Terengganu state government with 'satisfactory' reasons for their participation in last year's massive Bersih 2.0 rally had their study loans revoked.

Among the six was a third-year medical student.

Menteri Besar Ahmad Said in announcing the government decision said: "We pay them to study, not to participate in demonstrations or get involved in undesirable situations.

"The state government hopes this serves as a warning to others to not get involved in improper activities."

Ahmad said the six had not only participated in last July's massive rally in Kuala Lumpur calling for electoral reforms but had also protested against the Universities and University Colleges Act (UUCA) earlier this year.

Asked if the six could appeal against the state government's decision Ahmad said: "They can appeal .. we will see".

The state government's decision comes despite promises from Prime Minister Najib Tun Razak-led administration to relax its grip on civil liberties after its clampdown on the Bersih 2.0 rally last year earned international condemnation.

Among his efforts were the Peaceful Assembly Act, which was passed in Parliament last year, and plans to amend Section 15 of the controversial UUCA to allow students to become active members of political parties.

The contentious Bersih rally also saw Najib forming the parliamentary select committee for electoral reforms.

The PSC was tasked to look into ways of improving the country's election process. The committee concludes on April 2.

DAP: PSC on Lynas ‘a sham’

GEORGE TOWN: The DAP has rejected the Parliamentary Select Committee (PSC) on controversial Lynas rare earth processing plant as a sham committee to hoodwink the people.

DAP secretary-general and MP for Bagan Lim Guan Eng said that the party would not be part of the "sham PSC."

He said the DAP would propose to the Pakatan Rakyat leadership not to allow BN to use the presence of opposition MPs in the PSC to legitimatise the Lynas plant.

He said Pakatan will not be part of any environmental disaster that can happen in the future.

"The committee was merely to serve to deliver a fait accompli by endorsing the Lynas plant.

"The PSC is to force a public acceptance towards Lynas without due regards for safety, environmental and health concerns," said the Penang Chief Minister in his blog here today.

Lim said Putrajaya had confirmed that the PSC was a disguise by BN to legitimatise what is essentially wrong and against public interest.

He quoted Prime Minister Najib Tun Razak who said the PSC would not decide on the fate of Lynas, it is merely an engagement process so that the project can be carried out and would not be opposed by the people or create public fear.

Lim noted that the premier has reportedly expressed hopes that the PSC could raise awareness on the project so that "we can achieve comfort in terms of better public acceptance."

Lim said the whole PSC exercise was merely to help the project gain acceptance and to help the BN government convince Malaysians that there is no threat from the Lynas plant and its potentially hazardous radioactive waste.

'Malaysians will not be so easily fooled'

If the PSC cannot decide on the fate of the project, he said it was a complete waste of time for DAP or Pakatan to participate as the PSC was nothing more than a fait accompli to rubberstamp approval of the plant.

He criticised the BN government for valuing profits above all in awarding Lynas a 12-year tax holiday at the expense of public health, especially in Kuantan.

"Malaysians will not be so easily fooled by BN. We demand an answer to the real issue at hand," said Lim, adding that until today, there was uncertainty over where the radioactive waste will be stored.

Initially, he said the Atomic Energy Licensing Board or AELB has claimed that Lynas Corporation would be required to return any radioactive waste to Australia if it fails to set-up a suitable permanent disposable facility here.

But the proposal has been rejected by Australia. The AELB then said that the radioactive waste may be stored in abandoned tin mines in Sungai Lembing.

"This clearly reinforces the fact that the wastes would be disposed in Malaysian soil.

He said his Penang government would reject any Lynas plant or nuclear reactors in Penang and would not compromise on public health and safety.

"DAP will suggest for Pakatan not to participate in the PSC as we should not be used as tools in the BN's bid to fool the people and to justify the setting up of the Lynas rare earth plant," he said.

‘NFCorp will still be investigated’

KUALA LUMPUR: The criminal charges against the chairman of National Feedlot Corporation (NFCorp) will not stop the Public Accounts Committee (PAC) from investigating the corporation.

The PAC said today that it will continue with its investigation even though some matters will be deemed sub judice following the charges against NFCorp chairman Mohamad Salleh Abbas.

"There will be things which are sub judice but this is not the first time that the PAC has looked at things pending in court but there are certain things that we need to know, which Parliament needs to know," PAC chairman Azmi Khalid told reporters today following its second meeting on the NFCorp controversy.

Azmi, the Padang Besar MP, added: "PAC has to look into funds (for the project) which was approved by Parliament. There needs to be some control… some improvement over how these funds are spent," he said.

Last Monday, Mohamad Salleh, who is also the husband of Women, Family and Community Development Minister Shahrizat Abdul Jalil, was charged on four counts, two counts under Section 409 of the Penal Code for criminal breach of trust and another two counts under the Companies Act – involving the alleged misuse of almost RM50 million.

Azmi's view was backed by PAC member, Kota Belud MP Rahman Dahlan who said that there were many "non-criminal" aspects which can be studied from this case in terms of finance management, and government offers to private companies which can assist the government in the future.

PAC deputy chairman, Kepong MP Tan Seng Giaw, insisted that the matter will be looked into regardless of the ongoing court case.

"There is no such thing as we can't ask .We have to ask. That's why we are calling these people,

"The PAC has looked into the Port Klang Free Zone [PKFZ] scandal, which was 100 times bigger than this scandal. We still called the relevant people," he said.

The PAC has looked into the scandal in 2009, where ther costs of the PKFZ project had ballooned from RM1.088 billion to RM4.6 billion in 2007.

The PAC report found that former transport minister Chan Kong Choy and former Port Klang Authority (PKA) general manager OC Phang had breached the Financial Procedure Act 1957 by issuing letters of support and undertaking for the project without the finance ministry's approval.

The PAC found that there were "wrongdoings" but could not determine if corruption had occurred and that the MACC and the police should investigate the matter.

‘Forum did not include Raja Petra at first’

PETALING JAYA: Anwar Ibrahim's chief of staff, Ibrahim Yaacob, claimed that the opposition leader's interview in a forum along with Wikileaks founder Julian Assange had initialy not included Malaysia Today webmaster Raja Petra Kamarudin.

However, Raja Petra maintained that Anwar had requested for him to be dropped.

Commenting on the issue, Ibrahim said: "It was only later that we were told that Raja Petra would be joining in the forum."

"Hence, Anwar stressed that he had only given consent to the original request which was an interview involving him and Assange," he added in a posting on Anwar's official website at www.anwaribrahimblog.com.

According to Ibrahim, the production team – Quick Roll Production – then made an independent editorial decision to continue the show without Raja Petra.

This explanation came in the wake of a report on Friday where Raja Petra claimed that Anwar had snubbed him off from participating in the forum on the global political scenario, scheduled for last Saturday in Kent, England.

Ibrahim also took a swipe at Prime Minister Najib Tun Razak for manipulating the issue by claiming that Anwar was afraid to face off with Raja Petra in a debate.

"We are disappointed that Najib did not speak based on true facts. The question of a debate did not arise because what was agreed by Anwar and Assange was an interview with one another," he said.

Meanwhile, Raja Petra dismissed Ibrahim's statement as a lie.

"This is not true. I was asked by Wikileaks to attend an interview with Assange, which I agreed," he said.

Raja Petra recalled that the interview was postponed and he was told that Anwar would be participating, to which the blogger did not object.

"I replied I had no objections. Finally, Wikileaks called and told me that Anwar did not agree to appear on the same stage as me. So I agreed that Wikileaks drop my name in favour of Anwar.

"If not, then Anwar would not want to do the interview," explained Raja Petra, who is in self exile in Manchester.

Najib campur tangan dalam saman kes Felda...

NONEKerajaan BN didakwa cuba untuk mempengaruhi hakim yang membicarakan kes-kes yang membabitkan Felda, dakwa Setiausaha Agung PKR Datuk Saifuddin Nasution.
 

Katanya, dakwaannya itu berasaskan minit mesyuarat Felda yang dipengerusikan oleh Perdana Menteri Datuk Seri Najib Abdul Razak yang diadakan di bangunan Parlimen pada 27 Jun tahun lalu.

Beliau juga menunjukkan kepada wartawan, satu salinan minit mesyuarat berkenaan dengan tertera perenggan yang kontroversi itu.

"Bagi kes yang melibatkan kadar perahan minyak (oil extraction rate 'OER'), di mana-mana kedua-dua kes masih belum ditetapkan untuk perbicaraan penuh pastikan hakim dan peguam diberi kefahaman subjek dan kaedah teknikal bagi pengiraan OER.

"Pastikan Felda memenang kes ini supaya tidak menjejaskan kes-kes seterusnya."


NONEMenurut Saifuddin, kes yang dirujuk itu membabitkan tuntutan mahkamah yang difailkan oleh 766 peneroka dari Serting Hilir dan penempatan Felda Raja Alias terhadap Felda, di Mahkamah Tinggi Seremban dan satu lagi saman oleh 645 peneroka dari penempatan Felda Maokil, yang difailkan di Mahkamah Tinggi Johor Bharu.

"Membabitkan hakim adalah jelas menunjukkan kes manipulasi mahkamah," katanya pada  sidang akhbar di lobi Parlimen hari ini.


Campur tangan secara jelas

Beliau berkata, arahan Najib seperti terkandung dalam laporan it! u menunj ukkan campur tangan secara jelas pihak eksekutif dalam badan kahakiman negara.

Dengan campur tangan itu, Saifuddin yang juga ahli parlimen Machang bimbang hak peneroka mendapatkan keadilan di mahkamah berkaitan kes-kes melibatkan Felda akan dinafikan.

NONEFelda sejak kebelakangan ini terus berdepan ratusan saman daripada peneroka berkenaan kes dakwaan penipuan OER.

Antara yang memfaikan saman termasuk 400 peneroka Felda Gugusan Chini, 113 peneroka Palong 9 dan sekumpulan peneroka di Felda Kota Gelanggi, Jerantut Pahang.

Selain berdepan dengan saman OER,  Felda juga berdepan beberapa saman daripada NGO berkaitan bantahan penyenaraian Felda Global Ventures Holdings (FGVH) di Bursa Malaysia.


Turut hadir ialah ahli parlimen Subang R Sivarasa  yang mewakili peneroka dari Serting Hilir dan dan penempatan Felda Raja Alias dalam tuntutan mereka.

"Beri taklimat kepada peguam tidak menjadi masalah, tetapi terpulang kepada hakim untuk mendengar hujah daripada peguam, bukan untuk mengikut arahan daripada Perdana Menteri," kata Sivarasa.

'Gov't interfered in lawsuits against Felda'


PKR secretary-general Saifuddin Nasution has levelled the claim that the government has attempted to influence judges presiding over Felda cases.

This, he said, is backed the minutes of a Felda meeting! chaired by Prime Minister Najib Abdul Razak which took place at Parliament House on June 27 last year.


NONEAccording to a copy of the minutes showed to journalists, the contentious line reads:

"For cases involving oil extraction rate (OER), where (the) trial dates have not been fixed, ensure that  judges and lawyers are given understanding of the subject and the technical method of OER calculation.


"Ensure that Felda wins this case so that future cases will not be affected."


Saifuddin said the cases refer to a lawsuit filed by 766 settlers from Serting Hilir and the Raja Alias Felda settlement against Felda, in the Seremban High Court; and another suit by 645 settlers from the Maokil Felda settlement, filed in the Johor Bharu High Court.


"The reference to judges is clearly shows a case of judicial manipulation," he told a press conference at the Parliament lobby today.

 
Prime minister must explain

Saifuddin said this revelation raises concerns about some 20 other Felda cases that are in court, including the high profile case of attempting to block the public listing of Future Global Ventures Holdings Bhd (FGVH).

"I ask for the prime minister to explain in the next question and answer session, what does he mean by 'understanding must be given to judges'," he said.


NONE Also present was Subang MP R Sivarasa (right) who is representing settlers from Serting Hilir and Raja Alias settlements in their lawsuit.

"Briefing the lawyers is not a problem, but it is up to judges to listen to the arguments from lawyers, not to take orders from the prime minister," said Sivarasa.


He adds that this has raised doubts among his client including a third OER case recently filed on behalf of some 1,000 settlers from the Jengka settlement at the Temerloh High Court.


A fourth case, he said, will also be filed soon on behalf of settlers from Chini which is located within the premier constituency, at the Kuantan High Court.


In recent years, Felda and Felda Palm Industries Sdn Bhd has faced a series of lawsuits for allegedly cheating settlers of their palm oil produce.


Sivarasa explained that settlers are paid according to the percentage of extraction from their produce which the companies placed at between 17 and 20 percent.


"But when we conducted an independent study, we found that they were actually at 25 percent to 27 percent," he said.


Sivarasa said that every percent is worth approximate RM35 to RM40 per tonne and a planter would normally be able to produce between eight ando 10 tonnes of oil palm fruits a month.

‘Don’t empower voters, keep them stupid’

KUCHING: Recent statements by Dayak majority party – Parti Rakyat Sarawak (PRS) and Sarawak Progressive Democratic Party (SPDP) – leaders have exposed the modus operandi of the Barisan Nasional coalition over its voters.

'The rule it appears is to keep the people simple and ignorant at all cost. At all cost, prevent any advancement from reaching them so that they remain grateful to the BN for the little scraps that are thrown at them once every five years," said Sarawak PKR chief Baru Bian.

HE added that the BN startegy had kept the rakyat oppressed for over 40 years and helped the coalition perpetuate abuse.

Citing SPDP president William Mawan's recent discomfort at rumours that the 13th general election may be held June 3, 2012, Bian said the truth of the situation was 'sobering'

Mawan had reportedly said: "If election is held during this time, the young, educated professionals who work in the cities might bring everything that is new that in turn could change the mentality of the people in their kampungs and longhouses."

Responding to Mawan's comment, Bian who is the Ba'Kelalan assemblyman said: "This statement betrays the fear the BN politicians have that the rural folk will one day wake up to the sobering truth that the only people who have benefited from this BN government are the BN politicians themselves and their families and cronies.

"Mawan's desire to keep the rural people as ignorant and unaware as the proverbial frog under a coconut shell suggests that the BN government has no desire at all to help them grow and advance with the times.

"What is it about changing their mentality that frightens the BN so much? How are we ever going to catch up with the developing world if our government prefers to keep the rakyat in the dark ages?

"Is this the reason why healthcare and educational opportunities and facilities are so primitive and inadequate in the rural areas?"

'Shameful legacy by BN'

Bian said that currently up to 500,000 homes in Sarawak are still not connected to any electricity grid, and the majority of the rural population has no access to the internet and other amenities.

"(Knowing this) the government has no business harping about SCORE (Sarawak Corridor for Renewable Energy) and the miraculous riches it will bring to the raykat when it has not provided the basic education and facilities for the people to be able to participate in it.

"To top it off, we are told that bringing 'everything that is new' to the kampung is not a good thing.

"Obviously, encouraging the population to acquire knowledge is detrimental to the BN's health, as with knowledge (and critical thinking) comes the realisation of the people about the power that they wield," he said.

Bian also found PRS president James Masing's recent statement equally astounding.

Masing had allegedly said that the rakyat are the bosses only for one day every five years (during polling day) and that the rest of the days the elected YBs are the bosses and that the rakyat are to be 'subservient', having no right to challenge anything the bosses choose to do.

Masing was quoted to have said that: "If their YBs, for instance, pass a law which tells the rakyat to walk backward, the rakyat must walk backward".

Bian along with many others in Sarawak found Masing remarks 'disturbing'.

Said Bian: "It is extremely disturbing and disappointing that this veteran politician should cite as an example a law which clearly would not advance the welfare of the people and which cannot reflect the will of the people.

"Yet what an apt example for him to put forward – it reflects perfectly the policies of the BN government.

"Keep the rakyat backward and poor while the BN politicians push forward with their self-enriching land-grabbing schemes.

"In fact, the government policies over the past few decades have forced the rakyat to walk backwards – they are actually getting poorer.

"Proof of this is when (state) Welfare, Women and Family Development Minister Fatimah Abdullah said that since 2007, the rate of poverty in Sarawak had increased from 4.2% to 5.3% in 2009

"What a shameful legacy for the BN government."

Twisted reasoning

Bian pointed out that elected representatives are given the privilege to sit in their positions of authority so that they can serve the will of the rakyat.

He said the term 'rakyat' is not defined according to political leanings and even if it is, the will of the opposition may well be the will of the majority, given the gerrymandering and dirty politics practised by the BN government.

"Our elected representatives are not given wholesale power to act on their whims and fancies. Using this twisted reasoning to justify a decision made in an obvious case of abuse of power will intensify the resentment of the people against a tyrannical government.

"His (Masing) perverse defiance in the face of criticism and reproach (even from some BN leaders) does not bode well for him, but has contributed in no small way to building up support for the message of truth and promise of good governance by the opposition," said Bian.

MAS-AirAsia: Najib, bapa flip-flop negara?

Lapan bulan lepas, pentadbiran Datuk Seri Najib Razak bukan sahaja meluluskan malah mempertahankan habis-habisan penggabungan MAS-AirAsia walaupun dikritik hebat kerana mempunyai elemen anti-persaingan.

Dalam penggabungan tersebut, saham MAS-AirAsia bertukar tangan di mana pemilik AirAsia mengambil 20 peratus ekuiti di MAS dan Khazanah Nasional mengambil 10 peratus saham di AirAsia.

Perjanjian tersebut disebut-sebut sebagai cara terakhir untuk menyelamatkan MAS, namun ia tidak terjadi, malah prestasi syarikat penerbangan negara itu terus menjunam.

"Sehingga sekarang masih tidak kelihatan jalan keluar," kata ahli parlimen Petaling Jaya Utara Tony Pua dalam satu kenyataannya.

Pada awalnya, pengkritik menyatakan bahawa penggabungan MAS-AirAsia bersifat anti-persaingan di bawah peruntukan Akta Persaingan 2011 sama ada menerusi Kerangka Kolaboratif Komprehensif (CCF) atau sebaliknya kerana ia akan menyebabkan pengurangan penerbangan dan peningkatan harga tiket terbang.

Kerugian MAS pada Disember 2011 sebanyak RM2.52 bilion selepas empat bulan penggabungan telah mengejutkan para pemimpin Barisan Nasional dan Najib.

"Kerugian teruk tersebut kata pengkritik dalaman BN membuktikan kegagalan penstrukturan dan misi ! menyelam atkan MAS dan tekanan diberikan terhadap Najib untuk membatalkan penggabungan tersebut.
"Sekarang spekulasi hangat bahawa Najib sememangnya serius untuk membatalkan penggabungan tersebut yang dimeterai pada Ogos 2011," kata Pua.

Berdasarkan laporan The Malaysian Insider, Putrajaya sedang menimbangkan satu entiti khas untuk mengambil alih MAS daripada pemegang saham tersebarnya, Khazanah Nasional Berhad dan Tune Air Sdn Bhd jika Najib tunduk kepada tuntutan Kesatuan Pekerja M (Maseu)  untuk membatalkan penggabungan MAS-AirAsia.

"Sikap ambil mudah dan tanpa melakukan penelitian di dalam pentadbiran Najib sebelum apa-apa keputusan sebenarnya adalah lagi mengejutkan daripada kerugian yang ditanggung MAS," kata Pua.

Pua bertanya samada Najib berfikiran bahawa pengurusan baru yang mula bekerja secara serius semenjak September 2011 mempunyai kuasa sakti untuk membawa MAS ke era keuntungan semula pada masa 3 bulan.

"Realitinya, dari RM1.28 bilion kerugian yang dicatatkan pada suku keempat 2011,  RM1.09 bilion adalah hasil daripada peruntukan kewangan yang dibuat untuk barangan seperti stok lapuk dan kemerosotan fret.

"Peruntukan ini adalah legasi yang ! ditingga lkan oleh pengurusan lepas, dan mesti ditangani dengan kadar segera. MAS tidak mungkin ada hidup yang baru tanpa menyahkan semua ini daripada akaunnya," kata Pua.

Sikap Najib yang bertukar arah kurang daripada 8 bulan daripada sesuatu keputusan, kata Pua adalah bersamaan dengan pemilik Liga Perdana Inggeris yang menggaji dan memecat seseorang pengurus hanya kerana satu siri kekalahan, kerana mengganggap pengurus tersebut boleh mengubah nasib pasukannya serta merta dengan pemain dan cara yang sama.

"Hakikatnya ialah MAS telah berada dalam keadaan teruk, yang tidak pernah dipulihkan sehingga kini sejak bekas perdana menteri Tun Dr Mahathir Mohamad membuat keputusan untuk menswastakan syarikat penerbangan tersebut kepada Tan Sri Tajuddin Ramli," kata Pua.

Keputusan tiba-tiba untuk melaksanakan pertukaran saham pada Ogos 2011 dan sekarang secara serius pula untuk membatalkannya sebelum pihak pengurusan dapat melaksanakan apa yang dihajatnya menonjolkan sifat Najib yang suka membuat keputusan terburu-buru.

"Sifat terburu-buru ini memang menjadi ciri-ciri pentadbiran Najib yang terkenal dengan beberapa U-turn dalam polisi beliau, termasuk pemansuhan kuota mengikut kaum dalam Model Ekonomi Baru, U-turn dalam slogan Malaysian First dan janji beliau melaksanakan tender terbuka.

"Akibat daripada ini, ramai pelabur dari dalam dan luar negara telah hilang kepercayaan pada kebolehan beliau dalam melaksanakan reformasi yang boleh mengubah politik dan ekonomi negara.
"Sekarang mereka menganggap Najib sebagai kemungkinan perdana menteri yang paling hebat bertukar fikiran dalam sejarah negara," si! ndir Pua .

Penang CM Lim Guan Eng gets a good mark for his manner of governing the state.

GEORGETOWN: Former political detainee Lim Guan Eng wasted no time leaving his mark on Penang after the brash opposition politician won power in the Malaysian state in 2008 general election.

He quickly balanced the books of the former British colonial outpost, which were stained red after a half-century under the control of Malaysia's authoritarian ruling coalition.

He has virtually eliminated its debt, launched a campaign to halt official corruption, and has, by most accounts, injected new vigour and efficiency into the government of the important economic hub.

Today, Penang — a colorful mix of colonial architecture, pre-war Chinese shophouses, tropical beaches and high-tech factories — is on the up, as property values soar and foreign investment rolls in.

With potentially pivotal new elections expected to be called within months, Lim — a 51-year-old ethnic Chinese former banker with slicked-back hair and a wide chin — says the implications of his record are clear.

"If you can show that you can govern well, it will be a model, a showcase… a precursor of governing the federal government," he said, pointing to the possibility of the opposition led by Anwar Ibrahim taking power.

Malaysia's long-ruling Barisan Nasional (BN) coalition faces voter unease over allegations of misgovernance, corruption, and racial tension, the latter often blamed on policies that promote majority Malays over minority Chinese and Indians.

But the BN insists the Anwar-led opp! osition can do no better.

Lim's success in Penang has called that claim into question, however, and his outspokenness mark him as the country's most potent symbol of minority impatience.

Lim earned a one-year jail term in 1998 for sedition after he criticised the dropping of rape charges against a Malay top ruling party politician and he launches regular broadsides against the BN over its frequent financial and other scandals.

His detractors call him a domineering self-promoter who is benefiting from UNESCO's 2008 listing of Penang's capital Georgetown as a World Heritage Site, a bid launched before he took over.

But even opponents acknowledge he gets results.

Bureaucracy more efficient under Lim

"He is very clever, very authoritarian," said Teng Hock Nan, Penang's top official for Gerakan, the ruling coalition partner ousted by Lim's DAP in 2008. "When he gives a directive, it gets done."

One of Britain's oldest Asian settlements, Penang was a cosmopolitan trading hub in its 19th-century heyday before going into what Lim calls a "graceful decline".

Today, run-down Georgetown shophouses — the distinctive rows of buildings seen in parts of Southeast Asia — are being transformed into trendy hotels, cafes and art galleries injecting new life into old neighbourhoods.

A federally-backed grant programme provides seed money for such renovations.

Many credit Lim's attempts to clean up the rampant backroom deals and political patronage that are typical of Malaysia, whose rating by Transparency International on corruption in recent years has steadily sunk.

Lim launched an unprecedented system of open tenders for state projects and his top officials this year took the unheard-of step of declaring their assets.

Business figures privately say once-routine demands for payoffs are now rare and the bureaucracy more efficient.

"What is sad about Malaysia is that things that are the international nor! m (clean government) are abnormal," Lim said.

Foreign investors have signalled their approval. Home to much of Malaysia's high-tech industry, Penang led the nation in luring manufacturing investment the past two years.

Lim's moves have been "very substantive in managing finances, cleaning up the government, and initiating green policies", said Bridget Welsh, a Malaysia politics analyst with Singapore Management University.

"I've gone there for years and can tell you there is a big difference."

Australian investors Karl Steinberg and Christopher Ong, who is Penang-born, have restored an Edwardian bungalow and other decaying heritage properties into boutique hotels, lured by the new energy and official "cleanliness".

"There are places where corruption can make it hard to get things done. Penang is relatively free of that," Steinberg said.

But Lim's directness rubs many raw and he faces criticism for overly fast growth as soaring property prices have worsened a low-cost housing shortage. Plans for huge infrastructure projects have fuelled the concerns.

Gerakan accuses him of stoking racial tensions, and national leaders including premier Najib Tun Razak have warned vaguely of threats to Malay dominance, widely seen as referring to ambitious non-Malays like Lim.

Strong grip of Penang

But Francis Loh, head of independent Penang-based democratic rights group Aliran, says Lim's government has been racially inclusive.

"They represent the opening up of government in Malaysia," he said.

Leading Malaysia pollster Ibrahim Suffian said Lim looks so secure that the ruling coalition likely views Penang as a "lost cause" in the next polls.

Nationally, the picture is less clear.

Lim doubles as national head of the Chinese-dominated DAP, one of three members of the opposition front, including Anwar's multi-racial party and an Islamic party.

The alliance won historic gains over the BN in 20! 08 but r emains fractious and its performance is mixed in three other states — Malaysia has 13 — it won four years ago.

But Lim remains hopeful. He relaxes by reading British historian Niall Ferguson's works on the failures of past national governments through history, in case the opposition wins control.

"If we win… I need to know what are the pitfalls," he said.

19 MAC — Sesiapa saja yang mengenali rapat Ketua Pembangkang Parlimen, Anwar Ibrahim dan fugitive blogger (blogger lari daripada undang-undang) Raja Petra Raja Kamarudin, tentu boleh merasakan keunikan pertikaman lidah yang sedang berlaku antara mereka.

Mereka pernah menjadi rakan akrab lama sebelum Anwar melancarkan gerakan reformasi setelah dipecat daripada kerajaan pada tahun 1998. Raja Petra adalah antara penggerak dan penyokong tegar gerakan itu.

Apabila Abdullah Ahmad Badawi menjadi Perdana Menteri, Raja Petra adalah antara pengkritik utama beliau di kalangan pengamal media baru.

Apabila Abdullah ditekan agar bersara awal dan digantikan oleh Mohd Najib Abdul Razak, Raja Petra dari awal lagi kritikal terhadap Mohd Najib. Beliau melemparkan pelbagai tuduhan terhadap Mohd Najib.

Sekarang beliau menghalakan serangan terhadap Anwar pula. Dalam episod terbaru, beliau menggelar Anwar "chicken" atau ayam betina. Dalam ungkapan bahasa Inggeris, ayam betina adalah seorang pengecut.

Raja Petra menuduh Anwar meminta supaya beliau (Raja Petra) dikeluarkan daripada senarai ahli panel forum mengenai isu global di Kent, England.

Kalau konotasi ayam betina negatif dalam bahasa Inggeris, ia lebih tidak positif dalam bahasa Melayu jalanan. Ayam, dalam lingo jalanan turut dirujukkan kepada pelacur. Justeru itu, ungkapan "a chicken" yang digunakan oleh Raja Petra itu sangatlah tidak elok bagi Anwar.

Soalnya, mengapakah percakaran dua bekas kolaborator itu berlaku?

Adakah Raja Petra tidak lagi komited kepada reformasi Anwar atau beliau cuba mencari dahan baru untuk bergayut?

Dalam berita yang disiarkan oleh akhbar New Straits Times, Raja Petra dipetik sebagai berkata, kalau Anwar takut berbahas dengan beliau, bagaimanakah beliau hendak berbahas dengan Mohd Najib.

Raja Petra mengajak Anwar berbahas dengan beliau dahulu sebelum berbahas dengan Mohd Najib.

Pada akhir-akhir ini Raja Petra melemparkan pelbagai tuduhan berat terhadap Anwar, termasuk rasuah dan salah guna kuasa ketika beliau dalam kerajaan.

Bagi mereka yang tahu perhubungan akrab di antara Anwar dan Raja Petra serta tindak-tanduk Anwar ketika di dalam kerajaan, tuduhan rasuah dan salah guna kuasa itu berat serta tidak membantu Anwar pada saat beliau sedang cuba mengukuhkan kedudukannya sebagai ketua de facto Pakatan Rakyat menjelang pilihan raya umum ini.

Dari sudut pandangan lain pula, perbalahan Anwar-Raja Petra itu tidaklah menghairankan kerana dalam kerjaya politik Anwar, kawan boleh menjadi lawan dan lawan menjadi kawan dalam sekelip mata.

19 MAC — Berurus niaga [muamalat] dengan individu Yahudi atau mana-mana pihak Yahudi yang terhad pada individu atau syarikat Sdn Bhd mereka, seperti Yahudi dari negara Eropah dan lainnya, maka pada hukum asalnya adalah harus justeru Rasulullah saw pernah berurus niaga dgn bangsa Yahudi.

Namun urus niaga dengan Yahudi Israel hari ini, Yahudi yang membunuh ummat Islam Palestine lalu merampas tanah Palestine dan menubuhkan negara haram Israel atas penderitaan dan kesengsaraan ummat Islam Palestine, Yahudi yang mencari dan mengaut keuntungan lalu membina kekayaan mengukuhkan kuasa dan penjajahan mereka keatas ummat Islam Palestine malah membunuh sewenangnya ummat Islam Palestine, maka haram berurus niaga dengan mereka walau apa fahaman yang mereka anut termasuk Zionis.

Ulama' telah banyak memberikan fatwa haram berkait urusniaga semasa dengan Yahudi Israel secara umumnya seperti Dr Yusuf al Qaradhawi, kerana asasnya keseluruhan Yahudi Israel telah melakukan satu jenayah besar ke atas ummat Islam dan ianya masih berlarutan sehingga hari ini.

Fatwa haram urus niaga dengan Yahudi Israel Zionis ini dibina oleh para alim ulama' berasaskan kesan dan perkembangan politik dan ekonomi ummat Islam antarabangsa apabila setiap ringgit atau dollar yang mengalir ke Israel melalui apa jua bentuk urusniaga dengan mereka menghasil sebutir peluru yang telah dan bakal menembusi jantung ummat Islam Palestine yang sedang berjuang mempertahan aqidah dan membebaskan tanahair mereka.

Fatwa itu dibina bukan kerana mereka dilahirkan berbangsa Yahudi tetapi disebabkan mereka melakukan satu jenayah besar ke atas ummat Islam dan jenayah itu masih berlarutan hingga ke hari ini. Demikian adalah hukum yang berkait dengan muamalah atau urusniaga.

Sementara kedudukan Yahudi secara umumnya di mata ummat Islam telah disebut secara jelas di dalam Al Quranil Karim. Bagaimana dendam dan semangat permusuhan mereka terhadap Islam yang didedahkan oleh Allah swt.

"Kamu akan dapati golongan yang sangat tinggi kadar permusuhan mereka terhadap orang - orang beriman ialah Yahudi dan mereka yang mempersekutukan Allah swt".

"Dan sekali-kali tidaklah Yahudi dan Nasara Redha terhadap kamu sehingga kamu mengikut cara hidup mereka".

Banyak ayat seperti ini di dalam Al-Quran dan ia adalah pendedahan serta peringatan Allah swt kepada ummat manusia, khasnya kepada ummat Islam terhadap sikap dan bahaya yang dicetuskan oleh Yahudi berasaskan latar belakang dan sejarah mereka yang sering menipu, khianat, mungkir janji dan berdendam, biar apa pun fahaman yang dianut oleh mereka di sepanjang zaman termasuklah faham zionisme yang sememangnya telah mengisytiharkan protokol mereka yang jelas dan nyata memusuhi serta memerangi ummat Islam.

Justeru tiada pengiktirafan dan persekongkolan dengan Yahudi di atas peta politik dunia hari ini.

Ummat Islam tidak perlu panik dan usah resah dalam mengikuti perkembangan semasa berkait isu Yahudi, lantaran Perbahasan mengenai hukum muamalah adalah suatu yang berbeza dengan siasah. Keduanya mesti diteliti dengan cermat dan jelas.

Walaubagaimana pun terlebih aula dan wajar kita terus berfikir dan merancang untuk terus meningkatkan sokongan moral, politik dan ekonomi kita kepada ummat Islam di Palestine khasnya Hamas untuk mereka terus membina masa depan mereka yang kebih baik berdepan kekejaman Yahudi Israel Alaihi Laknatullah berbanding kita berbincang dan berpolemik mengenai urus niaga kita dengan Yahudi.

Kadir decides, how about others? — R. Jeevan

MARCH 19 — Good on you, Kadir Sheikh Fadzir. Now how about Tengku Razaleigh Hamzah, Ong Tee Keat and other BN politicians who obviously have lost confidence in Umno and other BN component parties.

This is no time for fence-sitting. You are either for the rakyat or you are for the scoundrels masquerading as ruling party politicians. You are either for change or you are part of the status quo.

Kadir has made his stand, he has quit Umno. Arguably it was not an expensive decision for him to make because he does not have any positions to lose. But given that his brother is the prime minister's machai and another brother in Penang is a warlord, this could not have been an easy decision to make.

He has crossed the Rubicon and now must do his best to expose what corrupt practices Umno and BN leaders have done over the years. His redemption can only be complete if he comes clean on how Umno leaders have abused their power and our resources.

Similarly, the likes of Ku Li can no longer stay on the sidelines and take sniper shots at Najib Razak and others. If he wants to be remembered as a statesman or a politician of any calibre, then he must get off the fence and take a position.

After all, if he wants to be a leader, he must lead. We have enough pseudo leaders in Malaysia.

Strategy to win votes — Lim Sue Goan

MARCH 19 — Although the latest Merdeka Center for Opinion Research survey showed that Prime Minister Datuk Seri Najib Razak's approval rating has climbed to 69 per cent from 59 per cent last August, the prime minister continues to fight for votes of young, urban, Chinese and swing voters.

Najib has frequently visited Perak and Selangor recently, including Chinese primary schools and Chinese areas, showing that he has not given up on Chinese votes.

The government recognises 146 institutions of higher learning in China, forms a special committee to address the shortage of teachers in Chinese schools, and the details about the mutual recognition of university degrees between Malaysia and Taiwan might also be released before the next general election. These can all be seen as moves to win Chinese votes.

Meanwhile, letting Datuk Seri Shahrizat Abdul Jalil step down as the women, family and community development minister and setting up a parliamentary select committee (PSC) to study issues related to the Lynas rare earths project are moves to eliminate the ill-feeling of young and swing voters.

However, Shahrizat only steps down as a minister but remains the Wanita Umno chief and the authorities have not clarified whether the RM250 million federal loan has been spent.

At the moment, we cannot conclude what effect the PSC, which might not be joined by Pakatan Rakyat, would have but the anti-Lynas organisation said that the PSC was not necessary, and suspects that it is meant to drag the issue. Therefore, it is planning for Himpunan Hijau 3.0.

The Cabinet might have been inspired from the political effects of the July 9 Bersih 2.0 rally. After the rally, the government formed a PSC on electoral reforms and put forward the proposal to reform the electoral system. It has been accepted by the Election Committee and timely met part of the requirements of the public.

The government then tries the same method on the rare earths refinery plant issue. However, electoral reforms and the rare earths refinery plant are entirely different issues. The former involves the electoral system which indeed has many drawbacks that need to be corrected. As for the latter, it involves the executive power to approve the investment of Lynas.

Under parliamentary democracy, the government can set up a PSC to review a national issue. However, the most direct solution for an issue related to government administration would be get back to the administrative system.

Moreover, the purpose of forming the PSC remains unclear. Minister in the Prime Minister's Department Datuk Seri Mohamed Nazri Abdul Aziz said the PSC would have three months to summarise its findings and suggestions. The prime minister, however, said the PSC was formed to help the public understand the issue and eliminate their worries.

How could the PSC be effective without the power to decide the fate of the rare earths refinery plant?

If forming a PSC becomes the ultimate weapon of the government to solve thorny problems, the government's credibility will be affected. Would the same method be used to address the Jalan Sultan land acquisition issue and the oil and gas complex in Pengerang? Isn't it similar to the moves of setting up Cabinet committees to solve problems during the administration of Tun Abdullah Ahmad Badawi?

It is not necessary to make it so complicated to win swing votes. What they need to do is just change the policy and listen to public opinion. For example, amend the policy related to Chinese primary schools to solve the shortage of teachers.

Only persuasive and effective actions can demonstrate sincerity, establish prestige and win back confidence. By then, votes will also return automatically. Otherwise, all efforts will be wasted. — mysinchew.com
