Isu Kedah: Golongan ulama’ sambut baik mahabbah

PETALING JAYA: Golongan ulama' dalam PAS menyokong penuh dialog dan mahabbah antara Menteri Besar Kedah, Datuk Seri Ustaz Azizan Abdul Razak dan Ahli-ahli Exco Kerajaan Negeri, Wakil-Wakil Rakyat PAS dan Ahli Badan Perhubungan PAS negeri itu.

"Kaedah dialog dan mahabbah ini bertujuan untuk mendapatkan penjelasan bagi apa sahaja isu yang dibangkitkan akhir-akhir ini," kata

Ketua Dewan Ulama' PAS Pusat Ustaz Harun Taib dan Ketua Dewan Ulama' PAS Kedah, Syeikh Mohamad Abdullah dalam satu kenyataan bersama hari ini.

Kata mereka, hal ini berlandaskan arahan Allah SWT bermaksud: "Dan segala urusan mereka berlaku dengan perbincangan sesama mereka." (Surah al-Syura ayat 38).

Para pemimpin tertinggi PAS akan bermusyawarah dalam konsep "mahabbah" di Alor Setar malam ini bagi mencari jalan penyelesaian terbaik berhubung krisis dalam parti di Kedah melibatkan Azizan dengan dua bekas exco, Datuk Phahrolrazi Mohd Zawawi dan Dr Ismail Salleh.

Ketiga-tiganya dilaporkan bersetuju untuk bersemuka malam ini dan Phahrolrazi diarahkan untuk "tutup mulut" supaya tidak mengeluarkan apa-apa kenyataan lagi.

Menurut kenyataan itu, Dewan Ulama' PAS Kedah dan Pusat sentiasa istiqamah untuk mempertahankan Kerajaan PAS Negeri Kedah bersama-sama dengan ahli dan kepimpinan parti.

Naib Presiden Salahuddin Ayub berkata pucuk pimpinan pusat terpaksa memainkan peranan utama dalam isu ini memandangkan krisis ini bukan hanya isu Kedah.

"Matlamat kami ialah untuk menyelamatkan kerajaan pimpinan Pakatan," kata beliau yang akan mengetuai pasukan yang akan merundingkan krisis ini bagi mencari jalan penyelesaian yang dijadualkan malam ini.

Sementara itu, Pengerusi Jawatankuasa Perumahan, Kerajaan Tempatan, Kerja Raya dan Bekalan Air Kedah, Datuk Amiruddin Hamzah berkata, beliau telah membalas surat PAS Kuala Kedah berikutan tindakannya menerima pelantikan semula jawatan Exco kerajaan negeri walaupun telah diarahkan tidak menerima tawaran dilantik.

Sehubungan itu, beliau menganggap kes yang membabitkan dirinya dalam isu PAS kawasan Kuala Kedah itu selesai setelah menjawab surat yang dihantar oleh Setiausaha PAS kawasan itu semalam.

"Saya tak jangka akan ada masalah mengenai jawatan saya dalam PAS.

Saya anggap perkara itu sudah selesai dan saya juga telah membalas surat itu kepada mereka," katanya kepada pemberita selepas merasmikan Ekspo Pendidikan Kedah Ketiga di Stadium Sultan Abdul Halim di sini, semalam.

Warkah Biru buat Tun Dr. Mahathir

"Secara rendah diri saya merasakan bahawa Tun Dr. Mahathir perlu mendalami pengajian ilmu Islam melalui bimbingan alim ulama' yang mendalam ilmu mereka dalam perkara ini. Saya dapat lihat dengan jelas bahawa Tun benar - benar keliru terhadap hukum Allah swt ini lalu Tun mempunyai pra sangka yang buruk terhadapnya."

Kembalilah kepangkal Jalan.

Terlebih dahulu saya memohon berbanyak maaf atas kehadhiran warkah terbuka ini jika ia menganggu keselesaan Ybhg Tun Dr Mahathir. Saya utuskan warkah ini, bukan sahaja bermaksud untuk tatapan Ybhg Tun tetapi juga untuk pengetahuan umum bagi menjernih kekeliruan dan kecelaruan fikir masyarakat awam mengenai hukum hudud.

1. Kenyataan Tun Dr. Mahathir Mohamad di Konvensyen Kebangsaan Politik dan Patriotisme di Universiti Malaysia Sarawak [UNIMAS] pada 26 Feb 2012  baru - baru ini adalah suatu kenyataan yang cukup mengelirukan dan berpotensi memesong pemikiran orang ramai khasnya ummat Islam terhadap kesucian dan ketulenan agama Islam.

2. Cara Tun Dr. Mahathir memahami Hukum hudud khasnya dan Islam amnya adalah suatu yang sangat asing [gharib] dari disiplin ilmu Islam malah apa yang diutarakan oleh Tun Dr. Mahathir dalam konvensyen tersebut bahawa Hukum Hudud adalah ciptaan ahli Feqah dan ianya tidak terdapat di dalam Al Quran adalah merupakan fitnah yang sangat dahsyat terhadap Kalaamullah Al Quranul Karim.

3. Hudud ialah kategori kesalahan dan hukumannya telah ditentukan oleh Allah swt dalam Al Quran dan RasulNya saw di dalam hadis baginda. Ianya merupakan hak Allah yang tidak boleh ditukar ganti, diubah suai ataupun dipinda. Malah hukumannya tidak boleh dimaafkan oleh sesiapa pun bagi pihak Allah swt.  Sebagaimana hukum ini telah ditetapkan oleh Allah swt, demikian juga kita telah diperintah oleh Allah swt untuk melaksanakannya. Firman Allah swt :

وَأَنِ احْكُم بَيْنَهُم بِمَا أَنزَلَ اللَّهُ وَلَا تَتَّبِعْ أَهْوَاءَهُمْ وَاحْذَرْهُمْ أَن يَفْتِنُوكَ عَن بَعْضِ مَا أَنزَلَ اللَّهُ إِلَيْكَ فَإِن تَوَلَّوْا فَاعْلَمْ أَنَّمَا يُرِيدُ اللَّهُ أَن يُصِيبَهُم بِبَعْضِ ذُنُوبِهِمْ وَإِنَّ كَثِيرًا مِّنَ النَّاسِ لَ! فَاس ِقُونَ

Dan hendaklah engkau menjalankan hukum di antara mereka dengan apa yang telah diturunkan oleh Allah dan janganlah engkau menurut kehendak hawa nafsu mereka, dan berjaga-jagalah supaya mereka tidak memesongkanmu dari sesuatu hukum yang telah diturunkan oleh Allah kepadamu. Kemudian jika mereka berpaling (enggan menerima hukum Allah itu), maka ketahuilah, hanyasanya Allah mahu menyeksa mereka dengan sebab setengah dari dosa-dosa mereka; dan sesungguhnya kebanyakan dari umat manusia itu adalah orang-orang yang fasik.

Surah Al Maaidah : 49

4. Kesalahan hudud yang wajib dijatuhkan hukuman khusus telah jelas disebut oleh Allah swt dengan lafaz yang sorih [nyata] di dalam Al Quran dan juga Hadis Nabi saw. Bagaimana Tun Dr. Mahathir begitu yakin dan konfiden mengatakan ia adalah ciptaan ahli feqah dan tidak terdapat di dalam Al Quran.

a] Kesalahan Zina iaitu persetubuhan suka sama suka tanpa nikah yang sah. Hukumannya disebut dalam surah an Nuur ayat 2.

b] Kesalahan Qazaf iaitu menuduh orang berzina. Hukumannya disebut dalam surah An Nuur ayat 4.

c] Kesalahan Minum arak atau minuman yang memabukkan. Hukumannya disebut dalam hadis nabi saw yang diriwayatkan oleh Imam Muslim dari riwayat Saidina Ali bin Abi Talib Karramallahuwajhah.

جلد رسول الله صلى الله عليه وسلم أربعين و أبو بكر أربعين و عمر ثمانين و كل سنة و هذا أحب إليَّ

d] Kesalahan Mencuri. Hukumannya disebut dalam surah al Maaidah ayat 38.

e] Kesalahan Murtad. Hukumannya disebut dalam hadis Nabi saw yang diriwayatkan oleh Imam Bukhari dari riwayat Ibnu Abbas rha.

من بدَّل دينه فاقتلوه

f] Kesalahan Merompak. Hukumannya disebutkan dalam surah al Maaidah ayat 33 dan 34

g] Kesalahan Bughah atau memberontak kepada Ulil Amri yang adil dan serta menjalankan hukum Allah swt yang berdalilkan Al Quran dan Sunnah. Hukumannya disebut di dalam! surah a l Hujurat ayat 9.
[ kategori ini ~ bughah ~ menjadi khilaf dikalangan ulama' , samaada ia termasuk dalam kesalahan hudud atau tidak ]

5. Jika kita melafazkannya dengan sedar dan bertujuan menafikan bahawa hukuman hudud ini bukan dari al Quran sedang nyata ianya termaktub di dalam al Quranul Kareem, maka ucapan itu boleh membatalkan aqidah. و العياذ بالله نعوذ  عياذا بالله

6. Mendustakan ayat - ayat Allah swt pula berlagak angkuh kononnya hukum yang Allah cipta tidak adil sangat besar risikonya sehingga kelak mereka yang mendustakannya dinafikan hak dan peluang menduduki syurga Allah swt. Firman Allah swt :

إِنَّ الَّذِينَ كَذَّبُوا بِآيَاتِنَا وَاسْتَكْبَرُوا عَنْهَا لَا تُفَتَّحُ لَهُمْ أَبْوَابُ السَّمَاءِ وَلَا يَدْخُلُونَ الْجَنَّةَ حَتَّىٰ يَلِجَ الْجَمَلُ فِي سَمِّ الْخِيَاطِ وَكَذَٰلِكَ نَجْزِي الْمُجْرِمِينَ

Sesungguhnya orang-orang yang mendustakan ayat-ayat (perintah) Kami dan yang angkuh (merasa dirinya lebih) daripada mematuhinya, tidak sekali-kali akan dibukakan bagi mereka pintu-pintu langit dan mereka tidak akan masuk Syurga sehingga unta masuk di lubang jarum dan demikianlah Kami membalas orang-orang yang melakukan kesalahan.

Surah al A'araf : Ayat 41

7. Saya melihat Ybhg Tun Dr. Mahathir juga sangat keliru bagaimana mahu memahami kedudukan hukuman hudud di dalam Islam. Apabila Ybhg Tun menegas bahawa untuk melakukan sesuatu mesti rujuk kepada Al Quran, tetapi dalam masa yang sama, Ybhg Tun menganggap hukum hudud tidak ada di dalam al Quran. Jika benar tindakan dan ucapan dirujuk kepada al Quran, Ybhg Tun pasti menemui hukum hudud termaktub di dalam al Quranul Karim.

8. Secara rendah diri saya merasakan bahawa Tun Dr. Mahathir perlu mendalami pengajian ilmu Islam melalui bimbingan ali! m ulama ' yang mendalam ilmu mereka dalam perkara ini. Saya dapat lihat dengan jelas bahawa Tun benar - benar keliru terhadap hukum Allah swt ini lalu Tun mempunyai pra sangka yang buruk terhadapnya.

9. Sebagai contoh menganggap hukum hudud tidak adil hanya kerana hukum hudud tidak dikenakan ke atas non muslim lalu Ybhg Tun membuat perbandingan yang dangkal bahawa muslim mencuri dipotong tangan lalu kudung sedang non muslim mencuri hanya dipenjara dan tangannya tidak kudung. Jika saya menjawab dengan perbandingan serupa bahawa muslim wajib solat, puasa, zakat dan haji sedang non muslim tidak diwajibkan ke atas mereka untuk melakukan semua itu, apakah Tun akan berkata bahawa Islam juga tidak adil ? Allah juga tidak adil ? Cara Tun berfikir kini sangat jauh tersasar.

10. Pengecualian non muslim dari perlaksanaan hukuman hudud adalah suatu pengecualian yang bersumberkan wahyu sebagaimana Firman Allah swt :

سَمَّاعُونَ لِلْكَذِبِ أَكَّالُونَ لِلسُّحْتِ فَإِن جَاءُوكَ فَاحْكُم بَيْنَهُمْ أَوْ أَعْرِضْ عَنْهُمْ وَإِن تُعْرِضْ عَنْهُمْ فَلَن يَضُرُّوكَ شَيْئًا وَإِنْ حَكَمْتَ فَاحْكُم بَيْنَهُم بِالْقِسْطِ إِنَّ اللَّهَ يُحِبُّ الْمُقْسِطِينَ

Mereka sangat suka mendengar berita-berita dusta, sangat suka memakan segala yang haram (rasuah dan sebagainya). Oleh itu kalau mereka datang kepadamu, maka hukumlah di antara mereka (dengan apa yang telah diterangkan oleh Allah), atau berpalinglah dari mereka; dan kalau engkau berpaling dari mereka maka mereka tidak akan dapat membahayakanmu sedikitpun; dan jika engkau menghukum maka hukumlah di antara mereka dengan adil; kerana sesungguhnya Allah mengasihi orang-orang yang berlaku adil.

Surah al Maaidah : ayat 42

11.  Menilai hukum hudud dan kesannya ke atas ummah tidak boleh dinilai hanya m! elalui a qal semata - mata, tetapi selaku seorang yang mengaku muslim, Ybhg Tun mesti melihatnya dengan kaca mata Islam dan Iman. Ertinya Tun mesti menilai sehingga tembus ke ruang akhirat. Jangan hanya menilai hukum hudud dalam dinding sempadan dunia semata - mata.

12. Akhirnya saya sekali lagi menasihati diri saya sendiri pula dengan rasa rendah hati menasihati Ybhg Tun Dr. Mahathir Mohamad bahawa hukuman hudud adalah ketetapan Allah swt. Kalaupun kita tidak mampu melaksanakannya, janganlah kita menafikannya apatah lagi mempersendakannya dengan fitnah kononnya hukum hudud adalah cipta ahli feqah.

13. Ybhg Tun, marilah kita baca beberapa penegasan Allah swt di dalam Al Quran agar kita insaf dan patuh pada perintah Allah swt. Pertama, bacalah dengan bahasa Arab kerana al Quran tidak boleh dibaca dalam bahasa lain kecuali dengan bahasa ia diturunkan iaitu bahasa Arab. Faham atau tidak, al Quran mesti baca dalam bahasa arab. Adapun terjemahannya bolehlah dibaca dengan apa jua bahasa yang kita faham dan selesa.

a] Firman Allah swt dari Surah an Nisaa' ayat 13.

تِلْكَ حُدُودُ اللَّهِ وَمَن يُطِعِ اللَّهَ وَرَسُولَهُ يُدْخِلْهُ جَنَّاتٍ تَجْرِي مِن تَحْتِهَا الْأَنْهَارُ خَالِدِينَ فِيهَا وَذَٰلِكَ الْفَوْزُ الْعَظِيمُ

Segala hukum yang tersebut adalah batas-batas (Syariat) Allah. Dan sesiapa yang taat kepada Allah dan RasulNya, akan dimasukkan oleh Allah ke dalam Syurga yang mengalir dari bawahnya beberapa sungai, mereka kekal di dalamnya; dan itulah kejayaan yang amat besar.

b] Firman Allah swt dari surah an Nisaa' ayat 56.

إِنَّ الَّذِينَ كَفَرُوا بِآيَاتِنَا سَوْفَ نُصْلِيهِمْ نَارًا كُلَّمَا نَضِجَتْ جُلُودُهُم بَدَّلْنَاهُمْ جُلُودًا غَيْرَهَا لِيَذُوقُوا الْع�! �ذَا� �َ إِنَّ اللَّهَ كَانَ عَزِيزًا حَكِيمًا

Sesungguhnya orang-orang yang kufur ingkar kepada ayat-ayat keterangan Kami, Kami akan membakar mereka dalam api neraka. Tiap-tiap kali kulit mereka masak hangus, Kami gantikan untuk mereka kulit yang lain supaya mereka dapat merasa azab sengsara itu. Dan (ingatlah) sesungguhnya Allah adalah Maha Kuasa, lagi Maha Bijaksana.

14. Semoga Ybhg Tun diberikan keafiatan dan punya masa terluang untuk membaca warkah ini dengan tenang. Beri masa pada diri untuk berfikir tanpa sebarang prejudis terhadap hukum Allah swt. Jua tidak didorong rasa dendam kepada PAS lalu menolak syariat yang diperjuangkan oleh PAS. Menganggap hudud itu adalah hudud PAS.

15. Saya harap Ybhg Tun dapat mengkajinya sendiri, dengan membuka helaian al Quran lalu membaca dan mentadabburnya dengan cermat. Jika Ybhg Tun tidak jelas memahaminya, boleh dirujuk kepada alim ulama' yang mukhlisin. Bukan merujuk kepada penasihat 25 % yang hanya merosakkan masa depan Ybhg Tun.

16. Salam hormat dari saya. Insyaallah, kiranya diizinkan oleh Allah swt. saya bersama rakan - rakan exco Dewan Pemuda PAS Malaysia ingin benar bertemu dengan Ybhg Tun untuk bermuzakarah mengenai hukum Allah swt yang suci lagi adil ini. Harap Ybhg Tun juga berlapang dada dan sedia bertemu dengan pihak kami. Insyaallah, kami akan memilih masa yang sesuai dan munasabah untuk menghantar surat rasmi kepada pihak Ybhg Tun untuk tujuan tersebut.

Najib should present White Paper to Parliament to present government case to justify a third bailout of RM840 million for Tajudin Ramli

RM840 million for Tajudin Ramli and previous RM12 billion double bailouts

The Prime Minister, Datuk Seri Najib Razak should present a White Paper to Parliament when it reconvenes on March 12 to present the government case to justify a third bailout of RM840 million for former Malaysian Airlines (MAS) chairman Tajudin Ramli – as well as reasons for the previous RM12 billion double bailouts for Tajudin.

The latest round of bailout revolves around the out-of-court settlement of Tajudin's RM589 million debts which Pengurusan Danaharta Nasional Bhd had obtained in a Kuala Lumpur High Court judgment in December 2009.

The Minority Shareholders Watchdog Group (MSWG) described the judgment as probably the largest sum awarded in Malaysian legal history and computed that the total amount would have ballooned to RM840 million as the judgment allows Danaharta to charge an interest of two per cent over the base lending rate on the outstanding sum from Jan 1, 2006.

It raised questions all Malaysians are asking and which must be answered by the Prime Minister in Parliament, viz:

·      What could have prompted Danaharta not to exercise its legal right to collect the outstanding amount?

·      Why the government resorted to an out-of-court settlement despite winning the case in court?

The government write-off of RM840 million judgment debt due from Tajudin would at least be the third bailout of Tajudin using public funds, the first time involving RM1.8 billion bailout of Tajudin in December 2000 paying RM8.00 per share for his 29 per cent stake in MAS or more than double its market price then; and the second bailout in taking over the some RM10 billion losses suffered by MAS after Tajudin's take over from 1994-2000.

What public interests could Najib plead to justify a third bailout for Tajudin?

It is time for Najib to come clean with Parliament and the nation whether there is any truth to Tajudin's claim that he was directed by former Prime Minister Dr Mahathir Mohamad and former Finance Minister Tun Daim Zainudin in 1994 to buy a controlling stake in MAS to bail out the government as a "national service" - to partly "bail out" Bank Negara from its RM30 billion foreign exchange scandal in 1992/1993 - and that there was an "Overriding Agreement" to indemnify him against any losses suffered.

Is it because what Taju! din was the truth despite the denial by Mahathir that was the reason for the series of Tajudin bailouts, including the current third Tajudin bailout of RM840 million?

If Tajudin's claim is baseless, as asserted by Mahathir, then Tajudin had committed perjury in making a false affidavit. Why then had no criminal action been instituted against Tajudin?

Whatever the truth, Parliament and the country are entitled to know the facts especially on why the Government of Malaysia has to embark on further billion-ringgit bailouts of Tajudin after the RM12 billion double bail-outs after the disastrous six-year "privatisation" of MAS to Tajudin from 1994-2000!

Mositun’s criticisms are actually compliments on Jeffrey

Believe it or not, there are times in your political life when you think you are criticizing someone but in reality you are actually complimenting him or her. This is what Datuk Johnny Mositun had done when he criticized Datuk Dr. Jeffrey Kitingan a few days ago. He said that Dr. Jeffrey "is deliberately playing on the people's sensitivities and parochial sentiments."
By saying these, Mositun actually admit that Dr. Jeffrey is a doing the right things in politics – appealing to the sentiments and sensitivities of the people. What are the people's sentiments and sensitivities? Well, for Mositun's information, these are just a few of them: (1) The people want their leaders to defend their rights, (2) The want what were promised to Sabah in 1963, (3) They want the power to decide on their own fate without having to be subjected to the wills and fancies of the leaders from Malaya, (4) They want their leaders to be courageous, speaking and demanding for them, and not be subservient to a Malayan party like Umno, (5) They want their leaders to have guts and not cowards and pak turuts, traitors, and stooges just for the sake of their salaries, allowances, perks and kickbacks.
 
These are the people's sentiments now. And Dr. Jeffrey is not playing on them – he is raising them to the forefront of political issues because he knows this is what the people want and this is what they feel for very deeply. He empathizes with the people and the people are happy because someone is fighting for them. And about parochial sentiments (or sentimen kenegerian) – what is so bad about this? This is the most powerful issue that is making the people stand up and shout, "Ini kalilah!" The 7-Point Borneo Agenda, Sabah for Sabahans, 1Borneo, the Borneo Alliance, the United Borneo Front, Tea Parties, the Semporna Declaration, RCI, NCR – these are all the issues and terminologies which are now waking up the people with a new spirit. They now realize that PBS is not doing what they should be doing, but keep attacking the leaders who are trying to achieve what they want in their hearts, for their children and grandchildren. What happened to the spirit of 1985? It died in PBS and is now coming out alive and kicking in STAR!
 
Mositun also said that Dr. Jeffrey "takes an issue and turns it into a! n academ ic exercise because he knows such things have public appeal, just to keep himself in the limelight." Well, hooray, Dr. J! I mean how many leaders can actually turn issues into academic exercises and yet people understand it so very, very clearly. This is not just because of Dr. J's skill in elaborating things but because what he is saying has long been in the heart of the people for many, many years. All he is doing is say it in a very brave way, and they naturally respond with excitement. In fact he is not even leading the people; he is following the people, by echoing their desires and frustrations! And what he is doing is exactly the same things a lot of great leaders in history had done. When London was attack by German's blitzkrieg, Winston Churchill went on radio and said, "we shall fight on the beaches, we shall fight on the landing grounds, we shall fight in the fields and in the streets, we shall fight in the hills; we shall never surrender!" The whole of England woke up to a new fighting spirit. When Martin Luther King Jr. delivered his "I have a dream" speech in Washington D.C. he was also "playing to the people's sentiments and sensitivities for public appeal" and so was the case when JFK made the historic speech during the Cuban missile crisis. 
 
My question is: Does PBS still know the meaning of struggle for the people anymore? What PBS is doing now is to please its Malayan political bosses, not pleasing the rakyat. Don't you people have any conscience? What is Tan Sri Pairin going to say to the people during the PBS anniversary celebration on March 5? Mositun said Pairin will address several thousand party leaders and delegates and talk on details of the party achievements and direction, but what is PBS real direction? To help Umno to continue its colonialistic rule over Sabah? To empower PERKASA to repress the non-muslim and christian. I am sure Pairin will go to endless lengths on why PBS will conti! nue to b e loyal to BN and saying the people still need development, development, development, but it will all be lame, and defeatist because he will only be bowing to Umno. Is he going to say again that we don't need the opposition in Sabah? What he needs to do is to listen to the people, and do what they expect from a Huguan Siou.
 
On the part of Dr. J, he is not trying to be smart or to be clever. He just wants to tell the truth, to speak for the people. If he is only playing up nonsense issues, the people would tell him off. But that is not happening. People are happy and excited, and coming to the STAR gathering by the thousands! If Dr. J is talking nonsense does Mositun think they wouldn't know? Is Mositun saying the people are really stupid because if someone tell them lies and nonsense they would still believe and follow like they are zombies?

Malay courtesy under threat

MARCH 3 — The spectacle of Penang Chief Minister Lim Guan Eng being subjected by some Malay thugs to public harassment and humiliation on February 26 as he was leaving the anti-Lynas rally at Padang Kota in Penang caused a great deal of genuine pain to the sensibilities of men and women of goodwill in this nation.

Is this what the notion of "the new Malay" is really all about? Have they totally abandoned the natural courtesy and graciousness of their forebears? What has happened to the "adat", or have they forgotten that too?

We may not like his politics but was that appropriate behaviour towards another human being? Lim is the head of government and must be shown all the courtesies attendant upon that position. That, in my book, is the norm of a civilised society, and anything less is unacceptable.

I attended a similar rally in Kuantan on the same day. It was a joy to see a well-behaved crowd of mainly young people from all over the country, including some from overseas, lending support to an important environmental concern without resorting to unruly and obnoxious behaviour.

The Kuantan police deserve the highest praise for their professionalism. They were there when needed, but otherwise remained in the background.

The Penang police, by comparison, were a disgrace to their uniform. They stood there, taking it all in but did absolutely nothing to stop the rowdyism that was showing all the signs of developing into violence.

Based on the video clips I watched, they did not go to the aid of the chief minister when he needed their intervention. This is the kind of attitude and behaviour that the police must change if they want to earn our respect and support. The police must be non-partisan.

The Lynas flip-flop

MARCH 3 — For a government which is sure that the Lynas rare earth plant is safe, the flip-flops of the past 48 hours have been illuminating. After saying that the Lynas plant was scientifically and factually safe, Najib Razak did an about-turn and said that Lynas will be asked to store/bury the waste away from the local communities in Kuantan.

Oh let me see, where do we start? Which position should we accept as representative of the Najib administration's stand on this investment from Australia?

The Atomic Energy Licensing Board aka official spokesman for Lynas (and a regulator which is participating in revenue share with Lynas): the waste from the rare earth plant is safe and can be stored in Gebeng.

Liow Tiong Lai, Maximus Ongkili and a couple of other ministers, obviously concerned with the political fallout rather than health concerns of residents: the waste must be shipped back to Australia. Never mind that the Green Party which keeps Julia Gilliard government in office would never allow the import of any waste.

Najib Razak: Lynas will be asked to store the waste away from Gebeng.

This flip-flopping and verbal gymnastics only serve to confirm what many of us believe: the government's knowledge about this investment is sketchy at best and now that they have approved this investment they feel they can't undo the damage completely without upsetting Australia.

Never mind that Australia is becoming synonymous for exporting their rubbish to us: Rio Tinto pollution-spewing smelter in Sarawak, Lynas rare earth plant and the controversial plan to send us some dodgy political asylum-seekers.

Najib may think that he has found a solution to the Lynas problem. He has not. He has only shown us another side to the incompetence of the government and its inability to protect us.

Mositun’s criticisms are actually compliments on Jeffrey

Believe it or not, there are times in your political life when you think you are criticizing someone but in reality you are actually complimenting him or her. This is what Datuk Johnny Mositun had done when he criticized Datuk Dr. Jeffrey Kitingan a few days ago. He said that Dr. Jeffrey "is deliberately playing on the people's sensitivities and parochial sentiments."
By saying these, Mositun actually admit that Dr. Jeffrey is a doing the right things in politics – appealing to the sentiments and sensitivities of the people. What are the people's sentiments and sensitivities? Well, for Mositun's information, these are just a few of them: (1) The people want their leaders to defend their rights, (2) The want what were promised to Sabah in 1963, (3) They want the power to decide on their own fate without having to be subjected to the wills and fancies of the leaders from Malaya, (4) They want their leaders to be courageous, speaking and demanding for them, and not be subservient to a Malayan party like Umno, (5) They want their leaders to have guts and not cowards and pak turuts, traitors, and stooges just for the sake of their salaries, allowances, perks and kickbacks.
 
These are the people's sentiments now. And Dr. Jeffrey is not playing on them – he is raising them to the forefront of political issues because he knows this is what the people want and this is what they feel for very deeply. He empathizes with the people and the people are happy because someone is fighting for them. And about parochial sentiments (or sentimen kenegerian) – what is so bad about this? This is the most powerful issue that is making the people stand up and shout, "Ini kalilah!" The 7-Point Borneo Agenda, Sabah for Sabahans, 1Borneo, the Borneo Alliance, the United Borneo Front, Tea Parties, the Semporna Declaration, RCI, NCR – these are all the issues and terminologies which are now waking up the people with a new spirit. They now realize that PBS is not doing what they should be doing, but keep attacking the leaders who are trying to achieve what they want in their hearts, for their children and grandchildren. What happened to the spirit of 1985? It died in PBS and is now coming out alive and kicking in STAR!
 
Mositun also said that Dr. Jeffrey "takes an issue and turns it into a! n academ ic exercise because he knows such things have public appeal, just to keep himself in the limelight." Well, hooray, Dr. J! I mean how many leaders can actually turn issues into academic exercises and yet people understand it so very, very clearly. This is not just because of Dr. J's skill in elaborating things but because what he is saying has long been in the heart of the people for many, many years. All he is doing is say it in a very brave way, and they naturally respond with excitement. In fact he is not even leading the people; he is following the people, by echoing their desires and frustrations! And what he is doing is exactly the same things a lot of great leaders in history had done. When London was attack by German's blitzkrieg, Winston Churchill went on radio and said, "we shall fight on the beaches, we shall fight on the landing grounds, we shall fight in the fields and in the streets, we shall fight in the hills; we shall never surrender!" The whole of England woke up to a new fighting spirit. When Martin Luther King Jr. delivered his "I have a dream" speech in Washington D.C. he was also "playing to the people's sentiments and sensitivities for public appeal" and so was the case when JFK made the historic speech during the Cuban missile crisis. 
 
My question is: Does PBS still know the meaning of struggle for the people anymore? What PBS is doing now is to please its Malayan political bosses, not pleasing the rakyat. Don't you people have any conscience? What is Tan Sri Pairin going to say to the people during the PBS anniversary celebration on March 5? Mositun said Pairin will address several thousand party leaders and delegates and talk on details of the party achievements and direction, but what is PBS real direction? To help Umno to continue its colonialistic rule over Sabah? To empower PERKASA to repress the non-muslim and christian. I am sure Pairin will go to endless lengths on why PBS will conti! nue to b e loyal to BN and saying the people still need development, development, development, but it will all be lame, and defeatist because he will only be bowing to Umno. Is he going to say again that we don't need the opposition in Sabah? What he needs to do is to listen to the people, and do what they expect from a Huguan Siou.
 
On the part of Dr. J, he is not trying to be smart or to be clever. He just wants to tell the truth, to speak for the people. If he is only playing up nonsense issues, the people would tell him off. But that is not happening. People are happy and excited, and coming to the STAR gathering by the thousands! If Dr. J is talking nonsense does Mositun think they wouldn't know? Is Mositun saying the people are really stupid because if someone tell them lies and nonsense they would still believe and follow like they are zombies? 
 
My friend, the people are no longer stupid. They know what they want, they know what they have lost, they know their future is dead under the present system. They know it is time for change and they see this chance in STAR.

RM100 juta untuk usahawan bumiputera di Koridor Utara

GEORGE TOWN: Unit Peneraju Agenda Bumiputera (Teraju) memperuntukkan RM100 juta daripada Dana Mudah Cara yang berjumlah RM2 bilion untuk pembangunan usahawan bumiputera di Koridor Utara mendapatkan sumber pembiayaan.

Menteri di Jabatan Perdana Menteri Tan Sri Nor Mohamed Yakcop berkata dana itu diperuntukkan bagi membiayai perniagaan dalam sektor pertanian, pembuatan, pelancongan dan logistik bagi tempoh dua tahun.

"Daripada RM100 juta itu, sektor pelancongan dan logistik masing-masing akan diperuntukkan RM15 juta, sektor pembuatan pula RM40 juta sementara RM30 juta untuk sektor pertanian," katanya kepada pemberita selepas melancarkan program Jejak 2012 di sini hari ini.

Turut hadir ialah Ketua Eksekutif Teraju Husni Salleh dan Ketua Eksekutif Koridor Utara Datuk Redza Rafiq.

Nor Mohamed berkata Jejak 2012 merupakan inisiatif Teraju yang menumpukan kepada usahawan bumiputera seluruh negara yang bermula di Koridor Utara.

Jejak 2012 akan mengembangkan sayapnya ke Sarawak pada 6 dan 7 Mac, diikuti oleh Johor, Sabah dan Wilayah Ekonomi Pantai Timur.

Nor Mohamed juga melancarkan Teraju@Koridor yang merupakan pusat sehenti wilayah Teraju yang pertama di Koridor Utara bertapak di Pulau Pinang dan akan disusuli oleh pusat-pusat di Sarawak, Johor, Sabah dan Wilayah Ekonomi Pantai Timur.

Beliau berkata kerajaan pusat akan lebih senang mencapai usahawan-usahawan bumiputera dengan wujudnya pusat sehenti Teraju di lima koridor itu di mana setiap pusat akan menawarkan sokongan setempat yang diterajui oleh pegawai-pegawai tempatan yang amat memahami mengenai pasaran utama di kawasan tersebut.

Turut diumumkan pada majlis tersebut ialah usaha bersama Teraju dengan ECE Technologies Sdn Bhd (ECE) untuk menubuhkan program pembangunan vendor.

ECE terlibat dalam perniagaan mereka bentuk, membangun, mengeluarkan, memasang, memasarkan dan mengedarkan alatan audio visual dan perkakas rumah kepada pasaran tempatan dan antarabangsa.

Dengan pendapatan RM7 juta pada 2010, ECE merupakan syarikat induk dalam program Teras yang berperanan membantu menyediakan lebih banyak peluang untuk syarikat-syarikat kecil bumiputera ke arah menjadi juara korporat bumiputera.

Setakat ini, ECE berjaya melantik empat syarikat bumiputera sebagai  sebahagian daripada program pembangunan vendornya.

Is MACC really walking the talk?

PETALING JAYA: Anti-graft watchdog Transparency-International Malaysia (TI-M) has given the Malaysian Anti-Corruption Commission (MACC) a nod of approval following the recent conviction of Sabak Bernam MP Abdul Rahman Bakri.

Abdul Rahman was sentenced to six years' jail and fined RM400,000 last week after being found guilty for making false claims amounting to RM80,000 four years ago.

TI-M president Paul Low said that the graft busters have begun to shed the negative perception that arose following the deaths of political aide Teoh Beng Hock and Selangor Customs assistant director Ahmad Sarbaini Mohamed at the MACC offices.

"I think they are at least learning to be more effective. They are becoming much more capable of gathering evidence and putting together a case in court," Low said.

However, he said that MACC still suffered from an "organisational problem" which could be solved if the Attorney-General's Chambers worked more closely with the commission.
"Rather than having the A-G and MACC sending investigation papers back and forth, they should work together," he said.

Low warned that despite a more positive perception towards the MACC, there were still a number of cases up in the air.

"Like in the Port Klang Free Zone (PKFZ) case, there are still people believed to be responsible who were not brought to court. We also have the Alstom case (Alstom has denied that a RM133 million fine by the Swiss authorities was for bribery, saying it was not being investigated in Malaysia), Bank Negara polymer bank note issue (a former Bank Negara assistant governor
has been charged with accepting bribes over a note printing contract), and the various allegations against Sarawak Chief Minister Taib Mahmud" he said.

Low said that in several instances, the overseas authorities had taken action but the local anti-corruption enforcement seemed to be lacking.

"But to be fair, I believe some things need time… like the gathering of evidence."

Low applauded recent proposals about asset declaration made by the MACC, saying that "it appears that the MACC panels are becoming more upfront in influencing authorities to make changes".

Meanwhile, a vocal consumer rights activist expressed his scepticism over MACC's effectiveness and supposed reforms.

Consumer Association of Subang and Shah Alam (CASSA) president Jacob George said that except for Abdul Rahman and former Selangor menteri besar Dr Khir Toyo (who was sentenced to one year in jail for corruption over the purchase of his Balinese mansion), there seems to be a lack of "big sharks" being prosecuted.

"You see a conviction (in the case of Khir), but it is still open to appeal and people are watching closely. I don't see real political will here and the feeling on the ground is that it is mere
sandiwara (theatrics)… unless they [MACC] can… go after the big sharks and not small timers," he said.

George said people have been talking about how so much has been exposed on the National Feedlot Centre scandal but there has been no concrete action.

"The NFC is a clear-cut case. Look at the agreement and a first-year law student can see that they [operators] have breached their contract," he said.

George also said that the case of former MAS executive chairman Tajudin Ramli also raised many questions on the sincerity of the authorities.

"There are also cases related to procurements by the Defence Ministry… the submarine deals… the various irregularities mentioned in the Auditor-General's report. Nobody will take them seriously unless they [the authorities] take action against the heavy-weights."

All system go for SPDP triennial general assembly

MIRI: The Sarawak Progressive Democratic Party's (SPDP) triennial general assembly in Bintulu this month is expected to be a smooth affair.

Its deputy secterary-general Paul Igai said based on the feedback from divisional meetings so far, no divisions were facing trouble.

"It's quite surprising because the meetings went quite well (and) the preparations for the minutes of the meeting seemed to be more efficient than before," he told Bernama here today.

Speculation had been rife about the likelihood of trouble in five constituencies which used to be represented by SPDP elected representatives but who had either quit the party or were sacked for insubordination.

The five are Sylvester Entri (Marudi), Peter Nansian Ngusie (Tasik Biru), Rosey Yunus (Bekenu), Paulus Palu Gumbang (Batu Danau) and Mas Gading MP Datuk Dr Tiki Lafe. They have now formed the Barisan Nasional Club to pursue their political career.

On the upcoming triennial general assembly, Igai said it would, among other things, focus on strengthening unity within the party.

"We are moving forward positively, leaving all the sad episode behind," he said.

Apart from the SPDP, the other Sarawak BN component parties are Parti Pesaka Bumiputera Bersatu (PBB), Sarawak United People's Party (SUPP) and Parti Rakyat Sarawak (PRS).

RM840 million for Tajudin Ramli and previous RM12 billion double bailouts

The Prime Minister, Datuk Seri Najib Razak should present a White Paper to Parliament when it reconvenes on March 12 to present the government case to justify a third bailout of RM840 million for former Malaysian Airlines (MAS) chairman Tajudin Ramli – as well as reasons for the previous RM12 billion double bailouts for Tajudin.

The latest round of bailout revolves around the out-of-court settlement of Tajudin's RM589 million debts which Pengurusan Danaharta Nasional Bhd had obtained in a Kuala Lumpur High Court judgment in December 2009.

The Minority Shareholders Watchdog Group (MSWG) described the judgment as probably the largest sum awarded in Malaysian legal history and computed that the total amount would have ballooned to RM840 million as the judgment allows Danaharta to charge an interest of two per cent over the base lending rate on the outstanding sum from Jan 1, 2006.

It raised questions all Malaysians are asking and which must be answered by the Prime Minister in Parliament, viz:

·      What could have prompted Danaharta not to exercise its legal right to collect the outstanding amount?

·      Why the government resorted to an out-of-court settlement despite winning the case in court?

The government write-off of RM840 million judgment debt due from Tajudin would at least be the third bailout of Tajudin using public funds, the first time involving RM1.8 billion bailout of Tajudin in December 2000 paying RM8.00 per share for his 29 per cent stake in MAS or more than double its market price then; and the second bailout in taking over the some RM10 billion losses suffered by MAS after Tajudin's take over from 1994-2000.

What public interests could Najib plead to justify a third bailout for Tajudin?

It is time for Najib to come clean with Parliament and the nation whether there is any truth to Tajudin's claim that he was directed by former Prime Minister Dr Mahathir Mohamad and former Finance Minister Tun Daim Zainudin in 1994 to buy a controlling stake in MAS to bail out the government as a "national service" - to partly "bail out" Bank Negara from its RM30 billion foreign exchange scandal in 1992/1993 - and that there was an "Overriding Agreement" to indemnify him against any losses suffered.

Is it because what Taju! din was the truth despite the denial by Mahathir that was the reason for the series of Tajudin bailouts, including the current third Tajudin bailout of RM840 million?

If Tajudin's claim is baseless, as asserted by Mahathir, then Tajudin had committed perjury in making a false affidavit. Why then had no criminal action been instituted against Tajudin?

Whatever the truth, Parliament and the country are entitled to know the facts especially on why the Government of Malaysia has to embark on further billion-ringgit bailouts of Tajudin after the RM12 billion double bail-outs after the disastrous six-year "privatisation" of MAS to Tajudin from 1994-2000!

Empower rural women through agri-business, says Rosmah

NEW YORK: Rosmah Mansor, wife of Prime Minister Najib Tun Razak, said agri-business is another avenue besides education to empower rural women.

She said there is a need to expand cottage industries producing food products and handicraft through encouragement and assistance, besides establishing a complete and efficient supply chain, including marketing of quality products, which will benefit them and assist them in securing fair prices.

There is also a need to provide rural women with resources to generate sustainable income that will increase their savings and enable them to start their own businesses, hence giving them economic independence, she said in a luncheon address on the occasion of the current sitting of the United Nations' 56th Session of the Commission on the Status of Women (CSW) here yesterday.

The talk was based on CSW's theme this year of "Empowerment of Rural Women and Their Role in Poverty and Hunger Eradication: Development and Current Challenges", and was attended by United Nations secretary-general Ban Ki-moon and UN executive director Michelle Bachelet, who is also the UN undersecretary-general, and more than 150 representatives from UN member countries and agencies.

Improving access to bank loans and micro-financing can perhaps be a public-private venture, Rosmah said, adding that today it is seen to be driven by governments.

"Innovative delivery channels and social networks can reduce costs and make financial services more readily available to rural women," she said.

She said that to fully capitalise on the financing facilities, rural women must be equipped with the right knowledge, and they must be taught business-making skills, marketing, basic accounts and how to deal with customers.

Governments and the private sector need to jointly invest in labour-saving and productivity-enhancing technologies and infrastructure to increase participation of women in rural areas, she said.

Rosmah said half of the more than 3.4 billion people living in rural areas today are women, and they also comprise 43 percent of the agricultural labour force in developing countries, while in East and Southeast Asia and sub-Saharan Africa, women form almost 50 percent of the agricultural workers.

Although agriculture is a means of economic empowerment for these rural women, they often work as unpaid family workers or farm help and even when in wage employment, they are more likely to be in part-time, seasonal or low-paying jobs, she said.

Eradication poverty

Touching on Malaysia, she said the country's experience has enabled it to make headway in not only empowering women in rural areas, but also eradicating poverty.

"Although we have been successful in elevating the well-being and status of rural women, our task is far from complete. In fact, there is still a lot more to be done. Measuring poverty by the level of income alone is insufficient," she said.

Rosmah said the scope of welfare in Malaysia is being broadened from just a measure of income to include health, education, nutrition and quality of life.

In addition, other constraints are being dismantled to optimise women's contribution to agriculture and the rural sector, she said.

She added that in 2010, the Malaysian government launched its Government Transformation Programme (GTP) with one of the areas of focus being raising the living standard of low-income households.

The Malaysian government has targeted 4,000 new women entrepreneurs, including from the rural areas.

"In modernising rural transformation, the government has made available Rural Transformation Centres (RTCs), which provide facilities that would link rural development to urban growth. In other words, it provides market access to rural businesses," she said.

She said rural folk, especially those in the agriculture industry, will be able to improve their business opportunities and, subsequently, their income through this newly introduced RTCs by cutting through the age-old problem of middle persons.

Thus, the economic empowerment of rural women serves as an important step for a broader social development of a just, balanced and equitable society, she added.

US university confers highest award on Rosmah

NEW JERSEY: Stevens Institute of Technology, a premier private co-educational university focused on research and entrepreneurship and committed to exploring the frontiers of engineering, science, and management, yesterday bestowed its highest award on Rosmah Mansor, wife of the Prime Minister Najib Tun Razak.

The university's president, Dr Nariman Farvardin, presented the "Distinguished Service Medal" to Rosmah in recognition of her public service, especially in the areas of empowering women and gender equality, and the important role she plays in enforcing early education among Malaysians.

Rosmah also plays an active role in non-governmental organisations, such as Children's Hope, Malaysian Nature Society, Malaysian AIDS Council, Heart Foundation, and played an important role in establishing the Permata Early Childhood Education and Care (ECEC) Programme, which has established more than 600 Permata childcare centres around Malaysia, besides passionately talking publicly on the need to preserve the natural heritage of the country for the future generations, he said at a function held at the university in Hoboken, here.

Farvardin said the university bestowed the award only on those who have made a significant impact on the welfare of society.

Rosmah, who was at the university to attend an evening with more than 200 Malaysian students, said in her speech that the award is very meaningful because Stevens is noted for its distinctive educational research and commercialisation programmes.

Stevens is recognised as one of the more successful American universities in bringing technology to the market, she said.

Rosmah said the university is currently collaborating with Universiti Kebangsaan Malaysia (UKM) to share its expertise in the creation of wealth from research innovations through entrepreneurship.

"Many Malaysian universities have emulated Stevens' model of launching start-up companies as a means of technology transfer and are currently actively conducting online entrepreneurship with UKM's first-year students," she said.

Rosmah said universities must play a leading role in developing innovative systems to build human capital in a holistic way, encompassing the acquisition of knowledge, particularly in science and technology, values and skills including entrepreneurial capabilities.

At the function, 30 young talents of Permata Seni – dance, choir and music – put up of a colourful and energetic cultural performance which received encouraging response from the guests.

RM840m Tajudin settlement puzzles shareholders’ group

The Minority Shareholders Watchdog Goup (MSWG) is puzzled by last month's out-of-court settlement between several government-linked companies (GLCs) and former Malaysia Airlines chairperson, saying the unpaid debt would now have ballooned to RM840 million.

"A rough calculation shows that this amount would have ballooned to RM840 million. What could have prompted Danaharta tnot to exercise its legal right to collect the outstanding amount? We are somewhat perplexed by the out-of-court settlement," Bushon said.

She also said it was unclear why the government resorted to an out-of-court settlement despite winning the case in court.

Established in 2000, MSWG is part of a broader capital market framework to protect the interests of minority shareholders through shareholder activism.

It is one avenue of market discipline to encourage good governance among public listed companies, with the objective of raising shareholder value over time.

The Court of Appeal on Feb 22 recorded Tajudin's withdrawal of his appeal against the 2009 judgment and his RM13 billion counter-claim in an out-of-court settlement. The terms of the settlement are being kept secret.

Much criticism on the settlement

This move has received a lot of criticisms, with Petaling Jaya Utara MP Tony Pua also claiming that Tajudin's Danaharta debt was written off as part of the settlement.

Among the litigants involved in the lawsuit are Telekom Malaysia Bhd, Naluri Corporation, Celcom (M) Bhd, Atlan Holding Bhd and CIMB Group, besides Danaharta.

Suspicions over the settlement arose after Minister in the Prime Minister's Department Nazri Abdul Aziz in a letter dated Aug 8 last year directing all the GLCs involved in the matter to settle their suits with Tajudin out of court.

Tajudin, a former MAS chairperson, had in his affidavit dated Feb 10, 2012, filed with the Court of Appeal, described Nazri's letter as a directive for a settlement.

Asked about his letter, Nazri said it was merely an advice and not a directive to the GLCs.

The Kuala Lumpur High Court will on Monday decide on the government's application to strike out Tajudin's RM500 million counter-claim, and Tajudin's move to strike out the MAS suit against him over an arbitration case in Germany, in which the national carrier had to pay RM174 milion.

The Lynas flip-flop — Sam Peh

MARCH 3 — For a government which is sure that the Lynas rare earth plant is safe, the flip-flops of the past 48 hours have been illuminating. After saying that the Lynas plant was scientifically and factually safe, Najib Razak did an about-turn and said that Lynas will be asked to store/bury the waste away from the local communities in Kuantan.

Oh let me see, where do we start? Which position should we accept as representative of the Najib administration's stand on this investment from Australia?

The Atomic Energy Licensing Board aka official spokesman for Lynas (and a regulator which is participating in revenue share with Lynas): the waste from the rare earth plant is safe and can be stored in Gebeng.

Liow Tiong Lai, Maximus Ongkili and a couple of other ministers, obviously concerned with the political fallout rather than health concerns of residents: the waste must be shipped back to Australia. Never mind that the Green Party which keeps Julia Gilliard government in office would never allow the import of any waste.

Najib Razak: Lynas will be asked to store the waste away from Gebeng.

This flip-flopping and verbal gymnastics only serve to confirm what many of us believe: the government's knowledge about this investment is sketchy at best and now that they have approved this investment they feel they can't undo the damage completely without upsetting Australia.

Never mind that Australia is becoming synonymous for exporting their rubbish to us: Rio Tinto pollution-spewing smelter in Sarawak, Lynas rare earth plant and the controversial plan to send us some dodgy political asylum-seekers.

Najib may think that he has found a solution to the Lynas problem. He has not. He has only shown us another side to the incompetence of the government and its inability to protect us.

Learn from AirAsia, Dr M tells MAS

KUALA LUMPUR: Dr Mahathir Mohamad has urged Malaysia Airlines (MAS) to study AirAsia's cost-cutting measures and management structure for it to return to the black.

Now was the best chance to understudy and see why the national carrier had plunged into a deep fiscal crisis while the budget airline was making profits, the former prime minister told Bernama.

The swap deal between Khazanah Nasional Bhd and key shareholder of AirAsia should tie them together, he said.

In August last year, MAS and AirAsia entered into a collaboration agreement that was strengthened by Tune Air Sdn Bhd and Khazanah Nasional – the major shareholders of AirAsia and MAS respectively – swapping their shares.

This resulted in Tune Air holding 20.5 percent equity interest in MAS and Khazanah owning 10.0 percent of AirAsia, and also Tune Air founder and co-founder Tony Fernandes and Kamarudin Meranun joining MAS' board.

"Given that both the airlines operate from the same country, there is no reason for MAS to fail. They have to team up with AirAsia," Mahathir said.

"AirAsia is making plenty of money. They are making profit even though their fares are very low.

"So there is something MAS can learn from AirAsia in terms of management, cutting down costs and therefore, making profit," he said.

MAS posted RM2.52 billion net loss for its financial year ended Dec 31, 2011 – the biggest-ever in its corporate history, on the back of RM13.9 billion revenue.

AirAsia, meanwhile, reported a net profit of RM564.1 million on the back of RM4.47 billion record revenue.

Asked whether Khazanah Nasional should divest its shares in MAS if the crisis continues, Mahathir said: "Well, I would not be able to say on that."

Kembalilah kepangkal Jalan.

Terlebih dahulu saya memohon berbanyak maaf atas kehadhiran warkah terbuka ini jika ia menganggu keselesaan Ybhg Tun Dr Mahathir. Saya utuskan warkah ini, bukan sahaja bermaksud untuk tatapan Ybhg Tun tetapi juga untuk pengetahuan umum bagi menjernih kekeliruan dan kecelaruan fikir masyarakat awam mengenai hukum hudud.

1. Kenyataan Tun Dr. Mahathir Mohamad di Konvensyen Kebangsaan Politik dan Patriotisme di Universiti Malaysia Sarawak [UNIMAS] pada 26 Feb 2012  baru - baru ini adalah suatu kenyataan yang cukup mengelirukan dan berpotensi memesong pemikiran orang ramai khasnya ummat Islam terhadap kesucian dan ketulenan agama Islam.

2. Cara Tun Dr. Mahathir memahami Hukum hudud khasnya dan Islam amnya adalah suatu yang sangat asing [gharib] dari disiplin ilmu Islam malah apa yang diutarakan oleh Tun Dr. Mahathir dalam konvensyen tersebut bahawa Hukum Hudud adalah ciptaan ahli Feqah dan ianya tidak terdapat di dalam Al Quran adalah merupakan fitnah yang sangat dahsyat terhadap Kalaamullah Al Quranul Karim.

3. Hudud ialah kategori kesalahan dan hukumannya telah ditentukan oleh Allah swt dalam Al Quran dan RasulNya saw di dalam hadis baginda. Ianya merupakan hak Allah yang tidak boleh ditukar ganti, diubah suai ataupun dipinda. Malah hukumannya tidak boleh dimaafkan oleh sesiapa pun bagi pihak Allah swt.  Sebagaimana hukum ini telah ditetapkan oleh Allah swt, demikian juga kita telah diperintah oleh Allah swt untuk melaksanakannya. Firman Allah swt :

وَأَنِ احْكُم بَيْنَهُم بِمَا أَنزَلَ اللَّهُ وَلَا تَتَّبِعْ أَهْوَاءَهُمْ وَاحْذَرْهُمْ أَن يَفْتِنُوكَ عَن بَعْضِ مَا أَنزَلَ اللَّهُ إِلَيْكَ فَإِن تَوَلَّوْا فَاعْلَمْ أَنَّمَا يُرِيدُ اللَّهُ أَن يُصِيبَهُم بِبَعْضِ ذُنُوبِهِمْ وَإِنَّ كَثِيرًا مِّنَ النَّاسِ لَ! فَاس ِقُونَ

Dan hendaklah engkau menjalankan hukum di antara mereka dengan apa yang telah diturunkan oleh Allah dan janganlah engkau menurut kehendak hawa nafsu mereka, dan berjaga-jagalah supaya mereka tidak memesongkanmu dari sesuatu hukum yang telah diturunkan oleh Allah kepadamu. Kemudian jika mereka berpaling (enggan menerima hukum Allah itu), maka ketahuilah, hanyasanya Allah mahu menyeksa mereka dengan sebab setengah dari dosa-dosa mereka; dan sesungguhnya kebanyakan dari umat manusia itu adalah orang-orang yang fasik.

Surah Al Maaidah : 49

4. Kesalahan hudud yang wajib dijatuhkan hukuman khusus telah jelas disebut oleh Allah swt dengan lafaz yang sorih [nyata] di dalam Al Quran dan juga Hadis Nabi saw. Bagaimana Tun Dr. Mahathir begitu yakin dan konfiden mengatakan ia adalah ciptaan ahli feqah dan tidak terdapat di dalam Al Quran.

a] Kesalahan Zina iaitu persetubuhan suka sama suka tanpa nikah yang sah. Hukumannya disebut dalam surah an Nuur ayat 2.

b] Kesalahan Qazaf iaitu menuduh orang berzina. Hukumannya disebut dalam surah An Nuur ayat 4.

c] Kesalahan Minum arak atau minuman yang memabukkan. Hukumannya disebut dalam hadis nabi saw yang diriwayatkan oleh Imam Muslim dari riwayat Saidina Ali bin Abi Talib Karramallahuwajhah.

جلد رسول الله صلى الله عليه وسلم أربعين و أبو بكر أربعين و عمر ثمانين و كل سنة و هذا أحب إليَّ

d] Kesalahan Mencuri. Hukumannya disebut dalam surah al Maaidah ayat 38.

e] Kesalahan Murtad. Hukumannya disebut dalam hadis Nabi saw yang diriwayatkan oleh Imam Bukhari dari riwayat Ibnu Abbas rha.

من بدَّل دينه فاقتلوه

f] Kesalahan Merompak. Hukumannya disebutkan dalam surah al Maaidah ayat 33 dan 34

g] Kesalahan Bughah atau memberontak kepada Ulil Amri yang adil dan serta menjalankan hukum Allah swt yang berdalilkan Al Quran dan Sunnah. Hukumannya disebut di dalam! surah a l Hujurat ayat 9.
[ kategori ini ~ bughah ~ menjadi khilaf dikalangan ulama' , samaada ia termasuk dalam kesalahan hudud atau tidak ]

5. Jika kita melafazkannya dengan sedar dan bertujuan menafikan bahawa hukuman hudud ini bukan dari al Quran sedang nyata ianya termaktub di dalam al Quranul Kareem, maka ucapan itu boleh membatalkan aqidah. و العياذ بالله نعوذ  عياذا بالله

6. Mendustakan ayat - ayat Allah swt pula berlagak angkuh kononnya hukum yang Allah cipta tidak adil sangat besar risikonya sehingga kelak mereka yang mendustakannya dinafikan hak dan peluang menduduki syurga Allah swt. Firman Allah swt :

إِنَّ الَّذِينَ كَذَّبُوا بِآيَاتِنَا وَاسْتَكْبَرُوا عَنْهَا لَا تُفَتَّحُ لَهُمْ أَبْوَابُ السَّمَاءِ وَلَا يَدْخُلُونَ الْجَنَّةَ حَتَّىٰ يَلِجَ الْجَمَلُ فِي سَمِّ الْخِيَاطِ وَكَذَٰلِكَ نَجْزِي الْمُجْرِمِينَ

Sesungguhnya orang-orang yang mendustakan ayat-ayat (perintah) Kami dan yang angkuh (merasa dirinya lebih) daripada mematuhinya, tidak sekali-kali akan dibukakan bagi mereka pintu-pintu langit dan mereka tidak akan masuk Syurga sehingga unta masuk di lubang jarum dan demikianlah Kami membalas orang-orang yang melakukan kesalahan.

Surah al A'araf : Ayat 41

7. Saya melihat Ybhg Tun Dr. Mahathir juga sangat keliru bagaimana mahu memahami kedudukan hukuman hudud di dalam Islam. Apabila Ybhg Tun menegas bahawa untuk melakukan sesuatu mesti rujuk kepada Al Quran, tetapi dalam masa yang sama, Ybhg Tun menganggap hukum hudud tidak ada di dalam al Quran. Jika benar tindakan dan ucapan dirujuk kepada al Quran, Ybhg Tun pasti menemui hukum hudud termaktub di dalam al Quranul Karim.

8. Secara rendah diri saya merasakan bahawa Tun Dr. Mahathir perlu mendalami pengajian ilmu Islam melalui bimbingan ali! m ulama ' yang mendalam ilmu mereka dalam perkara ini. Saya dapat lihat dengan jelas bahawa Tun benar - benar keliru terhadap hukum Allah swt ini lalu Tun mempunyai pra sangka yang buruk terhadapnya.

9. Sebagai contoh menganggap hukum hudud tidak adil hanya kerana hukum hudud tidak dikenakan ke atas non muslim lalu Ybhg Tun membuat perbandingan yang dangkal bahawa muslim mencuri dipotong tangan lalu kudung sedang non muslim mencuri hanya dipenjara dan tangannya tidak kudung. Jika saya menjawab dengan perbandingan serupa bahawa muslim wajib solat, puasa, zakat dan haji sedang non muslim tidak diwajibkan ke atas mereka untuk melakukan semua itu, apakah Tun akan berkata bahawa Islam juga tidak adil ? Allah juga tidak adil ? Cara Tun berfikir kini sangat jauh tersasar.

10. Pengecualian non muslim dari perlaksanaan hukuman hudud adalah suatu pengecualian yang bersumberkan wahyu sebagaimana Firman Allah swt :

سَمَّاعُونَ لِلْكَذِبِ أَكَّالُونَ لِلسُّحْتِ فَإِن جَاءُوكَ فَاحْكُم بَيْنَهُمْ أَوْ أَعْرِضْ عَنْهُمْ وَإِن تُعْرِضْ عَنْهُمْ فَلَن يَضُرُّوكَ شَيْئًا وَإِنْ حَكَمْتَ فَاحْكُم بَيْنَهُم بِالْقِسْطِ إِنَّ اللَّهَ يُحِبُّ الْمُقْسِطِينَ

Mereka sangat suka mendengar berita-berita dusta, sangat suka memakan segala yang haram (rasuah dan sebagainya). Oleh itu kalau mereka datang kepadamu, maka hukumlah di antara mereka (dengan apa yang telah diterangkan oleh Allah), atau berpalinglah dari mereka; dan kalau engkau berpaling dari mereka maka mereka tidak akan dapat membahayakanmu sedikitpun; dan jika engkau menghukum maka hukumlah di antara mereka dengan adil; kerana sesungguhnya Allah mengasihi orang-orang yang berlaku adil.

Surah al Maaidah : ayat 42

11.  Menilai hukum hudud dan kesannya ke atas ummah tidak boleh dinilai hanya m! elalui a qal semata - mata, tetapi selaku seorang yang mengaku muslim, Ybhg Tun mesti melihatnya dengan kaca mata Islam dan Iman. Ertinya Tun mesti menilai sehingga tembus ke ruang akhirat. Jangan hanya menilai hukum hudud dalam dinding sempadan dunia semata - mata.

12. Akhirnya saya sekali lagi menasihati diri saya sendiri pula dengan rasa rendah hati menasihati Ybhg Tun Dr. Mahathir Mohamad bahawa hukuman hudud adalah ketetapan Allah swt. Kalaupun kita tidak mampu melaksanakannya, janganlah kita menafikannya apatah lagi mempersendakannya dengan fitnah kononnya hukum hudud adalah cipta ahli feqah.

13. Ybhg Tun, marilah kita baca beberapa penegasan Allah swt di dalam Al Quran agar kita insaf dan patuh pada perintah Allah swt. Pertama, bacalah dengan bahasa Arab kerana al Quran tidak boleh dibaca dalam bahasa lain kecuali dengan bahasa ia diturunkan iaitu bahasa Arab. Faham atau tidak, al Quran mesti baca dalam bahasa arab. Adapun terjemahannya bolehlah dibaca dengan apa jua bahasa yang kita faham dan selesa.

a] Firman Allah swt dari Surah an Nisaa' ayat 13.

تِلْكَ حُدُودُ اللَّهِ وَمَن يُطِعِ اللَّهَ وَرَسُولَهُ يُدْخِلْهُ جَنَّاتٍ تَجْرِي مِن تَحْتِهَا الْأَنْهَارُ خَالِدِينَ فِيهَا وَذَٰلِكَ الْفَوْزُ الْعَظِيمُ

Segala hukum yang tersebut adalah batas-batas (Syariat) Allah. Dan sesiapa yang taat kepada Allah dan RasulNya, akan dimasukkan oleh Allah ke dalam Syurga yang mengalir dari bawahnya beberapa sungai, mereka kekal di dalamnya; dan itulah kejayaan yang amat besar.

b] Firman Allah swt dari surah an Nisaa' ayat 56.

إِنَّ الَّذِينَ كَفَرُوا بِآيَاتِنَا سَوْفَ نُصْلِيهِمْ نَارًا كُلَّمَا نَضِجَتْ جُلُودُهُم بَدَّلْنَاهُمْ جُلُودًا غَيْرَهَا لِيَذُوقُوا الْع�! �ذَا� �َ إِنَّ اللَّهَ كَانَ عَزِيزًا حَكِيمًا

Sesungguhnya orang-orang yang kufur ingkar kepada ayat-ayat keterangan Kami, Kami akan membakar mereka dalam api neraka. Tiap-tiap kali kulit mereka masak hangus, Kami gantikan untuk mereka kulit yang lain supaya mereka dapat merasa azab sengsara itu. Dan (ingatlah) sesungguhnya Allah adalah Maha Kuasa, lagi Maha Bijaksana.

14. Semoga Ybhg Tun diberikan keafiatan dan punya masa terluang untuk membaca warkah ini dengan tenang. Beri masa pada diri untuk berfikir tanpa sebarang prejudis terhadap hukum Allah swt. Jua tidak didorong rasa dendam kepada PAS lalu menolak syariat yang diperjuangkan oleh PAS. Menganggap hudud itu adalah hudud PAS.

15. Saya harap Ybhg Tun dapat mengkajinya sendiri, dengan membuka helaian al Quran lalu membaca dan mentadabburnya dengan cermat. Jika Ybhg Tun tidak jelas memahaminya, boleh dirujuk kepada alim ulama' yang mukhlisin. Bukan merujuk kepada penasihat 25 % yang hanya merosakkan masa depan Ybhg Tun.

16. Salam hormat dari saya. Insyaallah, kiranya diizinkan oleh Allah swt. saya bersama rakan - rakan exco Dewan Pemuda PAS Malaysia ingin benar bertemu dengan Ybhg Tun untuk bermuzakarah mengenai hukum Allah swt yang suci lagi adil ini. Harap Ybhg Tun juga berlapang dada dan sedia bertemu dengan pihak kami. Insyaallah, kami akan memilih masa yang sesuai dan munasabah untuk menghantar surat rasmi kepada pihak Ybhg Tun untuk tujuan tersebut.

Fresh crisis brewing in Kedah

ALOR SETAR: Kedah Menteri Besar Azizan Abdul Razak is facing a fresh crisis as two rebel state executive councillors are said to have gained substantial support in a bid to remove their leader.

It is learnt that the duo – Phahrolrazi Mohd Zawawi and Dr Ismail Salleh – have garnered support from members of the PAS central working committee

There are 38 members in the working committee headed by president Abdul Hadi Awang, whose decisions must receive the blessing of spiritual adviser Nik Abdul Aziz Nik Mat.

Nik Aziz is the one who ratifies any decisions made under Islamic principles.

The "mahabbah" (brotherhood and love) meeting tonight here is aimed at finding a resolution to the dispute which broke out last month when Azizan needed to reappoint his 10 state executive council members.

The row received wide publicity but Azizan managed to deflect it with the help of PAS vice-president Mahfuz Omar, who is expected to have a key voice on the issue.

Mahfuz and PAS deputy president Mohamed (Mat) Sabu are two national leaders who carry clout in Kedah due to their past contributions.

Under Kedah's guidelines, a state executive councillor's term of office is for 12 months. It can be renewed for another 12 months subject to the consent of the menteri besar.

Two issues

Party insiders in Kedah, who spoke on condition of anonymity since there is a gag order now over the issue, said there are two issues confronting PAS.

The first is that since 2008, Hadi has allowed two movements whose ideologies are distinctively different to gain ground in the party.

One is the conservative group headed by the ulama (clerics) and the other is the progressives who are largely influenced by Opposition Leader Anwar Ibrahim.

Azizan is said to have the backing of the ulama while Phahrolrazi has the support of the progressive faction.

The ulama is more inclined to promoting the concept of Muslim unity while the progressive group is more interested in fighting and toppling Umno.

The second issue is that Azizan is said to be unwell even before 2008 and after a heart attack last year, his own key performance indicator is said to be rock bottom.

"Azizan does not chair meetings eloquently and at times, comes across as slouchy and erratic. Most people attribute it to his ailing health. This has unnerved a number of state executive council members," the insiders claimed.

The insiders revealed that PKR and DAP were supporting Phahrolrazi and were agreeable to the idea that the latter be appointed as acting menteri besar to allow Azizan to recuperate.

But Azizan shot it down because he suspects that this was a move to remove him permanently.

Low-profile witchhunt

Azizan is believed to have embarked on low-profile witchhunt and had warned PKR executive council members and DAP not to interfere in PAS affairs, thus the "elegant silence" from the two parties.

It is believed that this witchhunt had angered Phahrolrazi and Ismail, who, in a show of defiance, wrote in formally, asking not to be reappointed into the state government.

The entire issue is expected to be resolved at the crucial meeting tonight, where a right decision may salvage the state government but a wrong one may see Pakatan out of power in the state.

Hadi is once again expected to preach his message of moderation, unity, brotherhood and love in a bid to get both Azizan and Phahrolrazi to close ranks for the sake of PAS and the state government as well as the long-term prospects for Pakatan.

His message would also be about preparing for the next general election as Pakatan has a tough battle ahead to defend the state.

Kedah has 36 state seats of which Pakatan has only 19 (PAS-16, PKR-two and DAP-one), while Barisan Nasional (BN) 15. There is one Independent, previously from PKR.

Azizan does not enjoy a two-thirds majority in Kedah, while he is also up against former prime minister Dr Mahathir Mohamad, who remains highly repected in the state.

Kedah Kita chairman Zamil Ibrahim said Kedah may emulate Perak if PAS does not handle the crisis well because both BN and Pakatan do not have the two-thirds majority.

Perak fell back to BN control in 2009 after three Pakatan representatives defected.

Zamil said if Azizan follows his conscience, he should consider seeking royal consent from the Sultan of Kedah to dissolve the State Legislative Assembly, paving the way for a fresh state election.

"Kedahans are confused over what is happening. The state machinery has stopped functioning since the trouble began," he said.

To be fair to the people, Azizan should seek the royal consent to dissolve the state assembly, expel the rebels and field a new line-up, who can serve the state if they win back the mandate,

instead of bickering among themselves now, Zamil added.

He said for the first time in Kedah's political history, there are rebels within the state government trying to oust a sitting menteri besar, adding that Azizan should put a stop to it.

3 MAC — Apa kata kalau Timbalan Presiden PAS terdiri dari seorang bukan Islam seperti yang dikatakan dilontarkan oleh Dr Dzulkefly Ahmad, Ahli Jawatankuasa PAS Pusat dalam satu wacara di Sinar Harian baru-baru ini?

Betulkah dia berkata begitu atau ia sekadar tanggapan tidak tepat pemberita?

Tentulah ia suatu yang mengejutkan dan suatu yang tidak pernah difikirkan oleh sesiapa.

Kemungkinan seperti yang diberitakan itu suatu yang tidak akan berlaku sekurang-kurangnya dalam masa 20 tahun atau tiga puluh tahun akan datang.

Dr Dzul sendiri pun tidak memikirkan ia akan berlaku mungkin dalam usianya sendiri. Mungkin dia mati dulu sebelum ia menjadi kenyataan.

Sama ada ia betul begit atau suatu yang diada-adakan, ia tidak lebih dari satu lontaran kepada PAS dan masyarakat Malaysia setelah perkembangan yang terjadi di Mesir apabila parti Islam yang ditaja oleh Ikhwan Muslimin menerima seorang Kristian Kibti menjadi Timbalan Presidennya sekarang.

Dia bukan Timbalan Presiden Ikhwan Muslimin. Ia Timbalan Presiden parti yang  ditaja Ikhwan Muslimin bagi mendepati politik memerintah Mesir sekarang. Ikhwan dikira ibu kebanyakan parti Islam di dunia sekarang, mempunyai sikap dan disiplin Islam yang jelas. Apa yang berlaku di Mesir itu adalah memperlihatkan keterbukaan politik Ikhwan dalam iklim politik sekarang.

Apa yang terjadi di Mesir itu satu kejutaan dan ia suatu yang diterima.

Dr Dzulkefly adalah antara orang yang boleh menerima perkembangan jika keperluannya ada. Saya sendiri belum nampak ia boleh berlaku dalam PAS dalam waktu yang terdekat, tetapi dalam pemikiran baru pejuang Islam sekarang sudah ada orang berfikiran terbuka seperti itu.

Maka kita mesti menerima bahawa dalam PAS mungkin sudah ada orang berfikiran terbuka seperti itu. Ia adalah menggambarkan bahawa rata-rata pemimpin PAS dan penyokongnya adalah orang yang berfikiran terbuka cuma kebanyakannya belum tiba ke tahap kemajuan seperti yang dilontar itu.

Pandangan itu telah mendahului zaman yang belum dicapai oleh rakan-rakan yang lain tetapi ia adalah perkembangan tentang kemajuan PAS yang amat terbuka dalam pemikiran politik tetapi tetap tidak sampai bertolak ansur dengan Islam liberal.

Ada beberapa masalah yang menghalang beberapa jawatan penting dalam PAS bagi disandang oleh orang bukan Islam. Jawatan Presiden, Timbalan Presiden dan satu dua lagi memerlukan kelayakan ilmu dan kemahiran berpolitik. Ketinggian ilmu Islam tanpa kemahiran politik adalah bermasalah. Kemahiran berpolitik dengan ilmu yang terhad juga ada masalah.

Pemimpin penting parti Islam mesti memilik kelayakan yang secukupnya. Kelayakan itu hanya ada pada orang Islam saja. Politik Islam itu melibatkan perkara hukum, ibadat dan lain-lain. Ia tidak dapat dipenuhi oleh orang.

Polemik yang berterusan  dalam PAS sekarang ialah tentang dua jawatan penting dalam parti — Presiden dan Timbalan — wajar atau tidak terdiri dari ulama? Amalan selama 30 tahun lalu dua jawatan itu mesti ulama kerana mereka perlu duduk dalam Majlis Syura Ulama yang keanggotaannya semua ulama.

Jika kedua penjawat jawatan itu bukan ulama sukar bagi mereka menjadi anggota Majlis itu. Wakil jawatankuasa pusat dalam majlis syura adalah wajib. Jika mereka tidak ulama, mereka tidak boleh jadi ahli Majlis Syura dan Majlis Syura akan diwakili oleh jawatankuasa pusat yang kurang kanan.

Dari segi teori Timbalan Presiden akan memangku Presiden jika Presiden berhalangan. Jika Timbalan Presiden seorang bukan Islam, PAS akan dipimpin oleh bukan Islam kiranya berlaku sesuatu pada Presiden. Suasana itu akan menjadi satu perkara baru menyebabkan parti boleh bergelombang.

Malah keadaan sekarang apabila Timbalan Presiden yang dipegang oleh Mohamad Sabu yang bukan ulama, nescaya ada gelombang kiranya Presiden berdepan sesuatu masalah. Maka yang terbaik kedua-duanya mesti ulama. Gelombang akan lebih kiranya Timbalan Presiden itu pula bukan Islam.

Demi keselesaan jamaah yang terbaik ialah calon Timbalan Presiden itu memeluk Islam dulu dan membuktikan dia lebih layak dari muslim yang lain dalam parti itu.

Apapun pandangan yang dikatakan dari Dr Dzulkefly adalah satu percambahan fikiran yang sihat dan baik. Pemikiran demikian dapat membantu parti dilihat sebagai berfikiran maju dan berlapang dada. — harakahdaily.net

Beranikah Noh Omar Menghadiri Persidangan SELCAT?

Soalan ini sedang berlegar2 di kepala ramai orang. Beberapa minggu yang lepas Noh Omar sebagai Timbalan Ketua Perhubungan UMNO Selangor begitu serius mahukan sebuah Suruhanjaya Diraja bagi menyiasat penyelewengan hasil pasir di Selangor.

Dari gaya percakapan Noh Omar itu, tampaknya seperti Noh Omar mempunyai berguni-guni bukti berlakunya penyelewengan hasil pasir di Selangor.

Maka, Noh Omar diminta untuk menghadiri sidang SELCAT yang akan dipancarkan secara siaran lansung di TVSelangor.

Di situ Noh Omar bebas mendedahkan segala bukti yang beliau ada berkaitan dengan penyelewengan hasil pasir.

Biar rakyat Selangor yang menilai benar atau tidak berlakukanya penyelewengan hasil pasir di Selangor.

Walaubagaimanapun, sekiranya Noh Omar tidak menghadiri persidangan terebut bererti Noh Omar hanya bercakap kosong. Dengan kata lain, Noh Omar telah bersikap seperti tin kosong.

Harap bunyi sahaja yang kuat tapi isi tiada.

Itu tak termasuk dosa fitnah Noh Omar di atas tuduhan2 penyelewengan yang telah beliau utarakan.

Tulang Besi yakin Noh Omar tidak akan berani tampil di majlis SELCAT. Baru-baru ini MB telah menghantar wakil Transparency International yang turut duduk dalam Lembaga Pengarah KSSB untuk bertemu Noh Omar, namun Noh Omar tidak mahu bertemu.

Inikan pula mahu menghadiri sebuah persidangan terbuka seperti SELCAT. Jauh panggang dari api.

Inilah dia perangai UMNO Selangor serta UMNO keseluruhannya. Kuat ketuk gendang dalam perkara yang tidak wujud.

Mengapa tak tanya mana duit peruntukan subsidi padi yang sepatutnya dikeluarkan oleh Noh Omar yang tidak keluar2 tu?

RM65m spent fighting HIV over 10 years

PETALING JAYA: Nearly RM65 million has been spent by the government on HIV/AIDS-related social work in the last decade.

This amount, according to Health Ministry director-general Dr Hasan Abdul Rahman, was almost RM25 million more than what it originally agreed upon back in 2003.

"From 2003 to 2011, a total of RM59,589,500.00 has been disbursed to Malaysia AIDS Council (MAC)."

"… actually [it] exceeded the amount that the government had committed to give through a Memorandum of Understanding signed in 2003 for a period of 10 years with the amount of RM40 million," he said in a press statement.

Hasan added that 27 HIV/AIDS-related projects had been approved this year, amounting to a total allocation of RM5.30 million.

He said this number was also RM50,000 less than the total allocation spent last year.

"Thus, including 2012 budget, the total fund given by the government from 2003 has reached RM64,889,500.00; a surplus of about RM25 million or 65%," Hasan said.

He was referring to claims that the ministry was supposedly cutting back on its funding to HIV/AIDS social outreach programmes.

These programmes are managed by local NGOs, which engage in activities such as counselling sex workers, transgenders and children born with HIV/AIDS. They also hand out lubricants and condoms to some of these affected groups.

These NGOs indirectly rely on the ministry for funding. Every year, the ministry hands over a certain amount of funds to MAC.

The MAC then distributes this money to the NGOs that come under its purview.

Poor progress reports

This year, however, a number of NGOs alleged that the ministry had stopped its funding for many of them, forcing them to cut back on their staff.

This claim, however, was denied by Health Minister Liow Tiong Lai recently, who said that some of the projects were delayed.

According to Hasan, proposals from HIV/AIDS-related NGOs for cash this year were looked at by a Technical Review Panel (TRP), which met on 9 to 10 Jan 2012.

The panel, he added, consisted of government departments including the Women, Family and Community Development Ministry, Malaysia Department of Islamic Development (JAKIM) and the Health Ministry's Finance Division.

Various medical experts were also part of this panel.

Hasan said that a total of 74 proposals were received by the panel, adding that out of this, 34 were "existing" projects, while 40 were "new" ones.

However, he said that only 27 projects were approved. Of this number, 22 were "existing" projects, while five were "new" ones.

According to him, some of the existing projects sent "poor" progress reports, while some did not send their reports at all.

"For the existing projects, only 22 projects submitted the full reports and all of them were approved for funding."

"Some of the existing projects were poor in sending progress report and some did not send any report at all, making it difficult for the TRP to evaluate and support the project," he said.

MAC's responsibility

Hasan said that the ministry was still waiting for the other 12 "existing" projects to submit their reports for the panel's evaluation.

He added that these 12 were given about RM1.5 million in 2011.

Many of the "new" proposals brought up by the HIV/AIDS-related NGOs also appeared too expensive for the ministry to handle.

"For the new projects, some of them did not have value for money, in other words, extremely costly as compared to similar project managed by other NGO, hence was rejected," Hasan said.

He added that the "results and comments" from these evaluations were given to the MAC.

"It is the responsibility of MAC to further inform their partner organisation about the decision of the funding."

"Furthermore, a meeting between MAC and the deputy director-general of health on Jan 26 was convened to achieve consensus agreement prior to the approval."

He said this because NGOs and their workers, whom FMT had spoken to, complained that they did not know why their funds were suddenly cut.
