Expressway deal places heavy toll on rakyat — Aliran

JAN 31 — The government is morally obliged to explain the rationale behind the award of the controversial RM7.1 billion West Coast Expressway deal to a subsidiary of Kumpulan Europlus Bhd.

WCE Sdn Bhd was awarded the concession to build and operate the 316km Banting-Taiping highway for an astounding 60 years.

The government must reveal the full details and explain the rationale for what appears to be a lopsided deal. The details revealed so far indicate that a heavy financial burden will be placed on the government and taxpayers while the concessionaire amasses profits relentlessly with little effort on its part.

The concessionaire has reportedly been showered with generous financing and terms:

• RM2.2 billion government soft loan at only 4 per cent interest beginning from 2013;

• An interest subsidy of three per cent on commercial loans for 22 years;

• RM1 billion in land acquisition costs to be borne by the government; and

• a record concession period of 60 years.

Without doubt this project smacks of cronyism that definitely does not benefit the rakyat. The rakyat (via the government) are expected to bear the heavy burden of the financing cost, which could run into billions of ringgit. They will have to pay toll for 60 years.

This doesn't seem to be a strictly business deal with the usual risks and opportunities. The government has gone out of its way to ensure the firm will not suffer any loss or face any difficulties in raising loans. Everything is facilitated so that profits will continue to be reaped for a very long period.

What is equally disturbing is the firm reportedly has no experience in highway construction, which gives rise to concerns about highway safety and financial prudence. Was there an open tender? Why was this company chosen for this project? Who are the key players behind the concessionaire and what is their connection with the leaders of the nation?

Sweetheart deals such as this reminds us repeatedly that privatisation — especially those with closed or negotiated tenders and lucrative terms — of any national project invariably leads to the bleeding of national coffers.

Given this harsh reality, Aliran calls on the government to be transparent and to review this highly questionable deal. The government cannot continue to play a reverse Robin Hood role, i.e. robbing the poor to help the rich! That is certainly not the role of a government that pretends to be deeply concerned about the plight of the poor and powerless. — aliran.com

Rebranding Rela into BN’s vanguard — Bob Teoh

JAN 31 — Under the Government Transformation Programme (GTP), Rela is to be rebranded as part of a police "omnipresence." But its massive build-up has raised suspicions that it may instead become Barisan Nasional's (BN) vanguard or even an additional vote bank.

"When the chips are down, Rela will be with this government to defend the country. Do not cause havoc in this country because the 2.8 million Rela members will not stand idly by and watch the country descend into chaos," he thundered to the noisy approval from a crowd of 30,000 Rela members gathered in Kuala Lumpur last Saturday.

Najib Razak seems at variance with his minister in charge of the GTP, Idris Jala. The GTP roadmap for combating crime requires Rela to help police keep "omnipresence" in 50 identified crime hot spots in the Kuala Lumur, Selangor, Johor and Penang.

 But Najib talks about using Rela as a vanguard or vigilante when Umno or BN's chips are down, and he wants Rela to contain demonstrators out to create public disorder.

How do we expect a rag-tag army of volunteers to rein in demonstrators when even the specially-trained, red-helmeted FRU could not handle the peaceful Bersih 2.0 Rally last year without resorting to brutality? And Bersih 2.0 was not even out to create public disorder, at that.

There is hardly any time or resource to train a volunteer army. According to the GTP roadmap, fewer than 400 Rela/JPAM personnel were trained and deployed in Kuala Lumpur and Selangor in August and September 2009; about 280 personnel were trained and were deployed in Penang and Johor in October and November 2009. That's a tiny drop in the ocean of 2.8 million Rela volunteers. If it takes just ten hours to train one Rela member, it would take 3,240 man-years to train all of them round the clock! What we likely to get is a largely untrained vigilante force sanctioned by BN.

The recruitment of volunteers for this auxiliary security force shot up almost five-fold, from 600,000 to the current 2.8 million, within two years. It is the biggest peace time civilian mobilisation and is 25 times bigger than the country's standing army as well as that of the police force.

The bulk of the new Rela recruits are from frontline states. Selangor has half a million, Penang (220,328), Kelantan (222,910), Perak (271,396), Sabah (258,162) and Sarawak (199,991) as at July 31, 2011. This works out to be two-thirds of Rela's total membership. Given that in the 2008  general election, some marginal seats were won or lost by less than 50 votes, the extraordinary Rela presence in these states is more than a concern.

This massive build-up seems extraordinarily strange especially when Malaysia already has a better police personnel-to-population ratio than even industrial countries. For every 100,000 citizens, Malaysia has 301 policemen. According to UN criminal justice statistics, this is higher than Denmark (196), Canada (200), South Korea (202), Japan (203), Sweden (206), US (229) and Australia (247).

On top this, the country also has its civil defence force of 67,000 as well as the Police Volunteer Corp, both of which are much more disciplined and experienced than Rela.

Rela has a bad reputation, having drawn flak from foreign observers for its alleged human rights abuses when nabbing aliens without valid entry permits for a bounty of RM80 per head.

In 2007, Human Rights Watch called for Rela to be disbanded.

"The government has set up what's little more than a vigilante force to target foreigners. Given Rela's repeated abuses, it should be disbanded right away "said Brad Adams, its director for Asia.

In that same year, the Malaysian Bar Council passed a resolution at its annual general meeting, calling for the repeal of the legislation that established Rela and extended the powers of the corps' officers to, amongst other things, enforce immigration law.

Ikatan Relawan Rakyat Malaysia (Rela) or the Peoples' Volunteer Alliance was established on January 11, 1972 under the (Essential Powers) Emergency Act 1964 – Essential Rules (Ikatan Relawan Rakyat) (Amendment) 2005.

This law presumably will be defunct within six months after the repeal of the emergency declarations by Parliament last September and is to be replaced by what Najib calls a new Rela Act, presumably in March. But he gave no details.

Another worrisome sign is that the Home Ministry has recently installed a RM6.65 million high-tech virtual shooting range for Rela youth cadets or teenagers to handle simulation firearms. The centre at the Rakan Muda Complex in Kuala Lumpur can cater to up to 14,400 trainees a year. The virtual firing range will run on South Korea's Intelligent Marksmanship Training Simulation System (IMTS) for its police force.

Adding to this is the claim by Perkasa, the extreme Malay right wing group, that a Rela subgroup called Briged Setia Negara had been established by Selangor Perkasa chief, Abdullah Mansor, in December last year. This was later denied by Rela.

Rela is also a strain on the Home Ministry budget as it would cost millions to maintain such a big and superfluous outfit. Najib has also proposed to increase Rela allowance by RM2 per hour. This will effectively double the full time volunteer allowance for non-officers to between RM800 and RM900 a month, which is more than what a ketua kampung or longhouse tuai rumah gets.

UIA out to embarrass me, says Aziz Bari...

NONEConstitutional law expert Abdul Aziz Bari claims Universiti Islam Antarabangsa's (UIA) public announcement today that his 'professor' title will be dropped is an attempt to embarrass him.

"I feel ashamed and saddened by UIA's attitude, it is apparent that it is being made a tool of others," he said in a statement to
Malaysiakini.

He said that UIA's comments showed it was ignorant of the relationship between the 'professor' title and knowledge.

"The fact is many retired professors, even though they are not given the 'emeritus' title, are still addressed as 'professor' because people are confident of and respect their knowledge.


"Many professors have retired from UIA, not one has been attacked by UIA like I am being attacked now. Is UIA following Umno's agenda?" he asked, adding that no university has ever made such a public announcement.

 
"UIA can withdraw my title but it cannot take my knowledge, my expertise will remain with me," he said.

He added that he had never requested for the position of professor.


"Unlike others, I did not apply for professorship but I was asked by UIA at the end of 2002, to apply for the position," he said.


Abdul Aziz, who will leave UIA tomorrow, was responding to
Utusan Malaysia's report today ! on UIA� �s announcement that his 'professor' title will be dropped.

The report was in response to a letter to the Umno-owned daily, questioning Abdul Aziz's recognition as a constitutional law expert.


"The unofficial title of 'constitutional law expert' was given by the media including
Utusan Malaysia, Berita Harian and other Umno-owned media but after 2008, they became uneasy and Utusan began to question the title," said Abdul Aziz.

PKR declares Aziz Bari as its candidate


UIA's statement today comes shortly after Abdul Aziz Bari was declared by PKR as its candidate in the next general election.


"Last Thursday, (PKR supremo) Anwar Ibrahim announced me as a candidate for the Sabak Bernam parliamentary seat at the Sabak Bernam mini-stadium before a crowd of 6,000," he said.


He added that UIA's statement would only draw attention to other controversial professors and will reflect badly on them.


"There are those who created problems but their titles were not withdrawn, for example the professor who said Malaysia was never colonised... or the professor who said Hang Tuah never existed."



'UIA boleh ambil profesor, tapi bukan ilmu saya'



Pakar perlembagaan Dr Abdul Aziz Bari hari berkata, beliau tidak kisah gelaran sama ada gelaran profesornya ditarik balik oleh Universiti Islam Antarabangsa (UIA) atau tidak kerana kepakaran yang dimiliki teta! p bersam anya.

"UIA boleh tarik gelaran itu tapi UIA tak boleh ambil ilmu saya. Kepakaran saya akan terus bersama saya.

"Saya tidak boleh sekat orang panggil saya profesor; apa pun saya saya tidak kisah ada gelaran atau tidak. Saya tetap saya," katanya.


Dr Aziz (kiri) hari ini dilaporkan tidak boleh lagi menggunakan status profesor kerana ia gugur secara automatik setelah menamatkan perkhidmatan dengan UIA.

Menjawab pertanyaan pembaca Utusan Malaysia, Bahagian Komunikasi Korporat UIA berkata, Abdul Aziz masih boleh menggunakan status profesor jika ada universiti lain melantiknya ke jawatan itu.

Dalam kenyataannya kepada Malaysiakini, Dr Aziz berkata, beliau sedih dengan gelagat UIA yang didakwa jelas menjadi "alat orang lain" dengan mengeluarkan kenyataan memalukannya, hanya kerana pertanyaan sepucuk surat pembaca "yang jahil" tentang ilmu dan gelaran profesor.

"Nampak macam UIA hendak ikut sama memalukan saya supaya saya sukar menghadapi hari-hari yang mendatang.

"Negara sudah tahu saya tidak lagi berkhidmat di UIA; jadi perlukah UIA membuat kenyataan begitu?" katanya.

Dr Aziz juga berkata, secara faktanya, ramai "profesor pencen" masih dipanggil profesor kerana orang yakin dan hormat dengan ilmunya dan setakat ini tidak ada universiti di Malaysia yang membuat kenyataan umum seperti UIA itu.

Beliau juga berkata tidak kisah atas tindakan itu kerana kegiatan akademik awamnya bermula sejak saya belum bergelar profesor lagi.

"Dengan itu apa yang mereka lakukan tidak akan memberi kesan kepada saya," katanya.

Menurut Dr Aziz juga berkata, gelaran profesor itu pun dipohonnya sebelum ini atas permintaan UIA sendiri melalui surat rasmi daripada rektor sepuluh tahun lalu.

"Tidak seperti orang lain saya tidak memohon, Saya diminta oleh pihak UIA, hujung 2002, untuk memohon jawatan profesor.


"Mungkin kerana ketika itu tulisan dan autoriti saya mengatasi rakan-rakan lain dalam fakulti dan mereka mahu saya 'masuk' dulu," katanya.

Cuepacs steps up fight against new scheme

KUALA LUMPUR: Cuepacs has set up an action committee as its latest step in its fight against the Public Service New Remuneration Scheme (SBPA).

A 15-member team, led by Cuepacs deputy president, Azih Muda, will present a paper on its recommendations to Prime Minister, Najib Tun Razak, by early March.

These recommendations were compiled during a two-day workshop on SBPA which was attended by all Cuepacs officials.

Cuepacs president, Omar Osman, told the media this afternoon that the paper would be based on the five items that Cuepacs has already submitted for review by the SBPA task force.

"The prime minister introduced the SBPA in the hope that it would be better than the Malaysian Remuneration Scheme (SSM) but instead it is the worst scheme we have ever seen," he said.

"And this is because the Public Services Department (PSD) never consulted us in drafting the scheme and then kept the details a secret from us."

Among the recommendations is a review of the Civil Service Premier Post (JUSA) level. Omar stated that of the current 36 posts, only seven are qualified for a Premier classification.

He listed the seven as the Chief Secretary to the Government, Secretary-General of Treasury, Director-General of Public Services, Treasury Auditor-General, Attorney-General, Chief Justice and Accountant-General of Malaysia.

Omar also slammed the mismatch of job titles and functions under the SBPA. Under the scheme, "drivers" will now be known as "operations manager", "hostel supervisor" as "administrative supervisor" and "nursing trainer" as "health trainer".

"There is a complete imbalance here," he pointed out. "The reasoning behind the title change it to supposedly add prestige to the job but there are better ways of doing this."

Lopsided salary adjustments

Omar confirmed earlier claims by PAS vice president, Mahfuz Omar, that those in the Premier group had already been given offer letters and that some of them are already receiving the new salary under the SBPA.

"Who authorised this?" he demanded. "I also have text messages from pensioners who have received as much as RM9,800 in pensions under the SBPA."

"These are the surprises that we are being subjected to because of the SBPA's lack of transparency."

Omar also maintained his earlier threat to pull out from the SBPA task force if no additional Cuepacs representatives are included on the panel.

He has asked for Azih Muda, secretary-general Lok Yim Pheng and financial secretary Jaafar Mansor to also sit on the task force as he alone cannot represent 1.3 million members.

The head of the SBPA task force, Ismail Adam, yesterday said that he had no objections to the three coming on board but that the power to make appointments rested with the Chief Secretary to the Government, Sidek Hassan.

"We have no heard anything on this matter yet but if the three are not invited to the second task force meeting on Feb 8 then I will officially resign on that day," Omar said.

The SBPA was meant to be implemented on Jan 1 but has been delayed due to strong objections over the lopsided salary adjustment between senior government officials above Grade 54 and those below.

Cuepacs is conducting a roadshow until April on the SBPA and civil servants have until Feb 15 to submit their protests on the scheme.

Call on Tan Sri Koh Tsu Koon to declare if the WCE Concession is consistent with Najib's Government Transformation Programme

The Prime Minister Dato' Seri Najib Razak started his premiership with much fanfare over his transformation programmes, starting with the "Government Transformation Programme" (GTP) launched in December 2009.

One of the key "National Key Result Area" (NKRA) contained within the GTP is to fight against corruption. The GTP admitted that "the perception of corrupt practices has risen in recent years, evidenced by Malaysia's declining ranking in Transparency International's (TI) Corruption Perception Index (CPI). In 2009, Malaysia's ranked dropped 9 places from 47 to 56."

Najib's administration has since failed its own transformation objectives with Malaysia falling to its lowest level ever in TI CPI in 2011 at 60th place. The fall in rankings doesn't come as a surprise at all scandals being exposed hard and fast over the past two years including the RM12.5 billion Port Klang Free Zone project, RM9 billion naval patrol vessel and RM7.55 billion armoured personnel carrier acquisitions, the RM330 million "cows and condos" fiasco and now a RM7.07 billion West Coast Expressway privatisation concession.

To stop the rot, PEMANDU Chairman Tan Sri Koh Tsu Koon must declare if the latest mega-highway concession has been awarded according to the principles and policies set out by the GTP to meet the Prime Minister's goals on "transformation".

The GTP promised that "we will reduce leakages of funds allocated for national development and operational expenditure and ensure transparency in the award of contracts."

It further added that "it is well established that transparency is crucial for a fair and efficient government procurement process. This is because transparency increases public scrutiny on the procurement process and helps ensure that accountability and well-defined policies, regulations and procedures have been put in place and followed closely."

However the award of the RM7.07 billion 60-year highway concession to Europlus flies in the face of GTP's promises, especially with the unexplained increase in cost by 134% from RM3.02 billion and extension of concession period by 27 years from the original 33 signed in 2007.

PEMANDU must demand that the Prime Minister's Office (PMO) disclose all details including the concession terms in the award to Europlus especially since the award was made via direct negotiation. It has been more than 5 days since the announcement made by Europlus on Bursa Malaysia and yet the Government has been steadfast in its refusal to shed light on the project.

PEMANDU must ensure that PMO is transparent and accountable by explaining the projected profits of the concessionaire, the future toll burden to be bourne by commuters. As the agency in-charge of GTP which promised "people first, performance now", PEMANDU must ensure that lightning will not strike multiple times on the same spot as per previous BN government privatisation agreements. What's more, the Government had to extend a RM2.24 billion soft loan and up to 3% in interest subsidy to Europlus commercial loans to undertake the WCE project.

The rakyat has been "taxed" mercilessly with lopsided concession agreements signed with independent power producers, highway operators such as the North South Highway (PLUS) and the Lebuhraya Damansara Puchong (LDP) as well as utility companies such as water suppliers.

Will Tan Sri Koh Tsu Koon have the audacity to demand that the WCE project be suspended pending review to ensure that Malaysia recovers from the pits of the TI CPI or will he chicken-out by shirking his responsibility as the chairman of PEMANDU?

Umno, MCA, NATO after Perkasa insult

SO, THE Umno-linked Perkasa's insult of giving away "white funeral ang pows" to the Chinese community during the Chinese Lunar Dragon Year has attracted the attention of our 1Malaysia Prime Minister Najib Abdul Razak.

Finally, after two days of silence, Najib saw the seriousness of the stunt pulled by his Umno-linked Perkasa.

However, it was a terrible let down from the premier. All he said were:
1. The use of "white envelope" angpow had nothing to do with the Barisan Nasional (BN) federal government;
2. "I think that as long as we can have a better understanding of Chinese culture and promote sensitivity to cultural taboos, such controversial events can be avoided; and
3. "We all know that ang pow means a red envelope, dominated by red rather than other colours," Najib said, adding that the incident can be used as a social experience.

Ibrahim "Perkasa" Ali's stunt to insult the Chinese during the communnity's Lunar Year celebration was deliberate, nothing short of mindless provocation aimed at worsening race relations.

If it was a stunt by a non-Malay aimed at the Malays during Hari Raya Aidil Fitri, will Najib still respond the same? All Najib is trying to do is to quell the Chinese community's anger to save Ibrahim's hide (skin is too polite a word to describe this animal).

And now, the MCA "adulterer" president's son, Chua Tee Yong, also wants to pit in his meaningless and worthless say. All Tee Yong had to say in response to the insult which was co-sponsored by a MCA division and branch leader is: "Perkasa cannot be excused for giving out white ang pows at a Chinese New Year gathering on Sunday. Perkasa should have been aware. They should have learnt the practices of another race before organising such an event, so that they did not upset anyone."

Tee Yong, who is also MCA Young Professionals Bureau chief, is displaying much "pride and professionalism" in taking care of the interest of the Chinese community and defending the insults from Ibrahim the past few months. He is doing it by showing his elders the way to bootlick Umno and its cronies. Like father, like son.

There were also quotes attributed to Tee Yong saying that Ibrahim must apologise to the Chinese community. That's all? We are expected to accept and forget the incident.

If ! I use a hearse to deliver something to Tee Yong's house or place a coffin in front of his house, can I just apologise and forget the incident?

Enough is enough. Ibrahim has been spewing racial and sensitive and seditious remarks against the non-Malays the past few months and getting away with it because Perkasa is backed by former premier Dr Mahathir Mohamad and BN-Umno.

What we want from Najib and MCA is action to be taken against Ibrahim and to stop the garbage coming from his mouth. We don't want NATO (No Action Talk Only).

Anything short of punitive action and legal prosecution for public mischief or nuisance is to condone Ibrahim's shameless behaviour as a Malay and Malaysian and he will continue to spew more venom to destroy unity among Malaysians.

Israel: Mari Lihat Apa Sebenarnya yang Dikata oleh Anwar

MAJORITI orang Melayu hanya membaca laporan dari harian2 milik UMNO dan media milik UMNO dalam isu ini.

Kebanyakan media2 ini adalah dalam bahasa Melayu. Soalnya, bagaimanakah laporan mereka itu boleh dikatakan benar kerana kenyataan Anwar Ibrahim adalah dalam bahasa Inggeris.

Dari artikel yang saya baca, kenyataan Anwar yang keluar dari mulut beliau adalah seperti berikut:

"Some refuse to recognize the state of Israel," he said, "but I think our policy should be clear – protect the security [of Israel] but you must be as firm in protecting the legitimate interests of the Palestinians."


TERJEMAHAN: "Ada sebahagian yang menolak pengiktirafan negara Israel. Tetapi polisi kita mesti jelas - menjaga keselamatan (Israel) tetapi mesti mempunyai ketegasan yang sama di dalam menjaga kepentingan orang2 Palestine"

Anwar tidak pernah MENGIKTIRAF kewujudan Israel serta negara Israel.

Apa yang Anwar kata kita boleh sokong Israel dalam menjaga keselamatan mereka tetapi mesti pada waktu yang sama menjaga hak orang Palestin.

Jadi soal Tulang Besi adalah, apa mas! alaahnya dengan kenyataan Anwar ini?

Ia akan memaksa negara2 Barat untuk lebih komited terhadap keselamatan dan hak orang2 Israel.

Adakah kita mahu membunuh serta membuang kesemua orang Yahudi yang sedang bermastautin di Israel sekarang ini?

Apa yang Tulang Besi nampak, kenyatan Anwar menguntungkan orang Islam, rakyat Palestine dan agama Islam secara amnya.

Ia menunjukkan kita tidak menyokong pembunuhan beramai-ramai orang Yahudi, kita juga sanggup bekerjasama untuk mencari solusi yang menguntungkan kedua-dua belah pihak serta kita memberi peluang kepada Negara Barat untuk bersama dengan kita di dalam isu Palestine-Israel ini.

Malahan, kalau rancangan "Dua-Negara" ini tidak dipersetuji dengan cepat, lebih banyak tanah2 rakyat Palestine aakan hilang kerana dirampas Israel.

UMNO cuba nak bising pasal kenyataan Anwar padahal UMNO sendiri mengambil APCO yang Zionis Yahudi sbg konsultan mereka.

Dr Mahathir sendiri adalah kawan baik Yahya Cohen.

Pig’s head found at Rawang mosque

RAWANG: A roasted pig head was found at the steps of the Nurul Iman Mosque at Batu 18 here early this morning.

While speculation awas rife on the motive of the culprits, police and PKR leaders have called for calm.

At 5.15am, mosque caretaker Nadzlan Ambak stumbled upon the object when opening the gates of the mosque.

"I saw something yellow, then when I moved closer I saw the head. Neatly placed, facing me," said Nadzlan, 70.

Police have classified the case under Section 295 of the Penal Code for desecrating a place of worship. However, no suspects have been identified so far, Selangor police chief Tun Hisan Tun Hamzah said this afternoon.

Tun Hisan also said a motive was being ascertained.

The police had arrived at 7.30am and left about two hours later with the pig head as evidence for further investigation.

PKR Rawang assemblyperson Gan Pei Nei urged quicker police action and said inaction will simply lead to more of such incidents.

"The message we seem to be getting, if nobody is arrested, is that such acts are condoned," Gan told reporters at the mosque.

Provocative acts

Gan said in Rawang's history, there has not been such provocative acts. "Such acts should not be tolerated. I'll continue to do what I can and follow up with the mosque and police".

Earlier, he told an online news portal that the actions were probably politically motivated as the 13th general election was around the corner.

PKR's Selayang MP William Leong said: "We deplore the irresponsible, despicable and provocative act done by irresponsible person. Police should arrest and, upon conviction, use the maximum penalties allowed by law

"We've had too much. The cow-head stomping in Shah Alam, the burning of churches, stone throwing at a Sikh temple and now pig heads."

"If there's politics, we should debate about policies, we should never use religion or race to incite violence. No one can gain from it," said Leong.

Mosque committee member Azman Mohd Noor said the mosque is shocked at the action as they have been friendly to the surrounding community.

"We have Chinese-Muslims and Indian-Muslims and we have no enemies. Anyone with problems should come talk to us," he said.

The last time pig heads were also found in a mosque was in Johor, where five pig heads were discovered at the entrance of Al Falah mosque in Taman Desa Jaya, Johor Baru.

Pig heads were dumped at mosques in 2010 during the same time the controversy surrounding the usage of the word "Allah" was still raging. During that time, mosques and churches were also vandalised.

Cuepacs steps up fight against new scheme

KUALA LUMPUR: Cuepacs has set up an action committee as its latest step in its fight against the Public Service New Remuneration Scheme (SBPA).

A 15-member team, led by Cuepacs deputy president, Azih Muda, will present a paper on its recommendations to Prime Minister, Najib Tun Razak, by early March.

These recommendations were compiled during a two-day workshop on SBPA which was attended by all Cuepacs officials.

Cuepacs president, Omar Osman, told the media this afternoon that the paper would be based on the five items that Cuepacs has already submitted for review by the SBPA task force.

"The prime minister introduced the SBPA in the hope that it would be better than the Malaysian Remuneration Scheme (SSM) but instead it is the worst scheme we have ever seen," he said.

"And this is because the Public Services Department (PSD) never consulted us in drafting the scheme and then kept the details a secret from us."

Among the recommendations is a review of the Civil Service Premier Post (JUSA) level. Omar stated that of the current 36 posts, only seven are qualified for a Premier classification.

He listed the seven as the Chief Secretary to the Government, Secretary-General of Treasury, Director-General of Public Services, Treasury Auditor-General, Attorney-General, Chief Justice and Accountant-General of Malaysia.

Omar also slammed the mismatch of job titles and functions under the SBPA. Under the scheme, "drivers" will now be known as "operations manager", "hostel supervisor" as "administrative supervisor" and "nursing trainer" as "health trainer".

"There is a complete imbalance here," he pointed out. "The reasoning behind the title change it to supposedly add prestige to the job but there are better ways of doing this."

Lopsided salary adjustments

Omar confirmed earlier claims by PAS vice president, Mahfuz Omar, that those in the Premier group had already been given offer letters and that some of them are already receiving the new salary under the SBPA.

"Who authorised this?" he demanded. "I also have text messages from pensioners who have received as much as RM9,800 in pensions under the SBPA."

"These are the surprises that we are being subjected to because of the SBPA's lack of transparency."

Omar also maintained his earlier threat to pull out from the SBPA task force if no additional Cuepacs representatives are included on the panel.

He has asked for Azih Muda, secretary-general Lok Yim Pheng and financial secretary Jaafar Mansor to also sit on the task force as he alone cannot represent 1.3 million members.

The head of the SBPA task force, Ismail Adam, yesterday said that he had no objections to the three coming on board but that the power to make appointments rested with the Chief Secretary to the Government, Sidek Hassan.

"We have no heard anything on this matter yet but if the three are not invited to the second task force meeting on Feb 8 then I will officially resign on that day," Omar said.

The SBPA was meant to be implemented on Jan 1 but has been delayed due to strong objections over the lopsided salary adjustment between senior government officials above Grade 54 and those below.

Cuepacs is conducting a roadshow until April on the SBPA and civil servants have until Feb 15 to submit their protests on the scheme.

31 JAN — Kawan kawan saya dalam Umno bercakap mengenai rasa cemas bila kerajaan yang di pimpin oleh Umno menabur wang begitu banyak kepada rakyat. Bayaran RM100, RM200, dan sekarang ini RM500 sedang rancak di jalankan. Tapi apa yang hendak di risaukan? Bukankah ini hasil pejuangan Umno dan bukti Umno dan BN amat perihatin kepada rakyat?

Mereka bertanya kepada saya, bayaran2 ini, adakah ianya meningkatkan peluang Umno dan kerajaan BN menang? Saya cakap sudah tentu ia meningkat peluang- peluang untuk rakyat merasa sakit hati. Bila rakyat sakit hati, bertambah ramailah musuh2 Umno.

Hah? Macam mana itu berlaku? Saya menyatakan bahawa dalam hal beri memberi ini, Umno selalu menghadapi masaalah. Siapa yang menentukan siapa dapat RM100, RM200 dan RM500? Selalunya yang menentukan ialah ketua kampung.

Ketua kampung punya keutamaan ialah menyenaraikan adik beradik, saudara-saudara terdekat, dan geng-geng yang sebulu dengan mereka. Golongan yang terpinggir ramai daripada yang dapat imbuhan. Ini memang resam sesetangah ketua kampong. Semasa saya jadi ADUN dahulu, saya mempunyai masaalah dengan ketua-ketua kampung yang seperti inilah juga — yang jadi pagar yang memakan padi.

Kalau buka kawasan pembesaran kampung, lot-lot tanah di sapu mereka dan keluarga mereka sendiri. Kalau ada rumah rakyat, rumah PPRT, sanak saudara di dahulukan. Bahkan lot-lot tanah di beri kepada suku-sakat mereka yang tidak pun tinggal dalam kawasan pemberian tanah.

Apabila saham Felcra di beri oleh kerajaan, yang sepatutnya di beri kepada kepala keluarga, pemimpin kampung mendesak di beri kepada anggota isi rumah. Kalau keluarganya ada lima orang, mereka mahu saham Felcra di beri kepada ke lima-lima ahli keluarganya. Apa akan jadi bila perkara seperti ini di biarkan? Ianya bermakna lima ketua keluarga yang lain di nafikan peluang untuk dapat saham Felcra.

Nah, sekarang perkara yang serupa berlaku apabila pentadbiran Najib Razak membayar wang kepada rakyat. Ramai orang menerima wang tersebut tapi bilangan yang di nafikan hak untuk menikmati rezeki dari Najib Razak juga kian bertambah.

Jadi saya suka sangat Najib Razak buka lebih banyak fronts kebencian rakyat. Ini melanggar nasihat yang dia selalu beri kepada rakan-rakan dan ahli Umno. Jangan open up fronts terlalu banyak untuk orang membenci kita.

Dan saya harap ada orang membawa perkara ini kepada mahkamah. Adakah pemberian wang ini suatu bentuk sogokan dan rasuah untuk mendapatkan undi rakyat? Kepada saya, ianya satu bentuk rasuah yang di lakukan dengan terang. Duit dan wang ini bukan Umno yang punya. Ianya duit yang datang dari hasil pendapaatn kerajaan. Operasi menyampaikan wang tersebut sepatutnya di lakukan melalui pejabat pejabat daerah. Kenapa wang tersebut di sampaikan oleh ketua bahagian Umno dan bakal-bakal calun dari komponen BN?

Di Sentul Kuala Lumpur, penyampaian wang RM500 ini menonjolkan bakal calun dari parti Gerakan yang akan menentang Tian Chua dalam PRU 13 nanti. Tapi jangan risau, kita sudah tahu outcome PRU tersebut.

Tian Chua yang berani membaringkan diri di hadapan jentera dan kenderaan polis tidak mungkin di kalahkan oleh rasuah Gerakan dan Umno.

Sukalah saya mengingatkan dalam soal beri duit dan wang ini, ianya bukan lah suatu perkara yang luar biasa. Bahkan, inilah bukti yang saya suka sebut sebagai satu-satunya cara dan kaedah yang DS Najib tahu dan gunakan untuk menyelesaikan masaalah. Caranya ialah membayar sana sini. Itu dianya, cara parti Umno dan pemimpin tertingginya menyelesaikan masaalah.

Elok kita biarkan Umno mengamalkan cara merasuah rakyat. Sebab sebuah parti seperti Umno yang sustain sokongan kepada nya melalui merasuah rakyat tidak akan kekal lama. Ini berbanding dengan parti politik yang mencerna dalam diri penyokong nilai nilai, keyakinan dan kepercayaan kepada seruan perjuangan.

Saya mahu orang Melayu sedar bahawa Umno tidak mempunyai seruan perjuangan. Alif Ba Ta Umno (Agama, Bangsa dan Tanah Air) sudah lama di singkirkan dan di gantikan dengan perjuangan kepentingan peribadi dan kelompok.

Adakah Umno berjuang untuk kepentingan bangsa Melayu?

Ianya hanya suatu metos yang di bina oleh pemimpin-pemimpin haprak Umno. Apabila keadaan cemas dan sesak, ketika itulah Umno akan menjerit sana sini, bahawa hanya merekalah yang melindungi kepentingan bangsa Melayu, Agama dan Tanah Air.

Berhentilah dari menipu bangsa Melayu.

Jika Umno berjuang untuk kepentingan Melayu, maka tidaklah mereka menafikan hak bangsa Melayu mendapat royalty minyak di Kelantan dan Terengganu. Penduduk dalam dua negeri ini majoritynya Melayu tapi mengapakah royalty minyak tidak di beri secara lansung kepada rakyat kedua negeri itu secara lansung?

Rakyat Kelantan di nafikan hak mendapat royalty hanya semata mata rakyat negeri itu menyokong parti PAS. Dalam kes negeri Terengganu, orang Umno sendiri tidak percaya kepada pemimpin Umno negeri untuk mengendali pemberian wang royalty minyak. Orang Umno tak percaya kepada orang Umno sendiri kerana mereka tahu, jika royalty minyak Terengganu di kendalikan oleh Mat Said dan geng-geng, wang tersebut akan masuk kedalam poket orang lain.

Makanya, Umno bukanlah memperjuangkan kepentingan bangsa Melayu secara keseluruhan. Pertama, orang Melayu yang di maksudkan oleh Umno itu tidak termasuk Melayu yang bukan dalam Umno. Melayu yang di maksudkan oleh Umno ialah Melayu dalam Umno itulah jua. Dalam kamus Umno orang Melayu hanya ahli Umno yang tiga juta itu sahajalah yang layak di gelar Melayu. Orang Pahang, bila tidak bersetuju dengan sesuatu pendapat akan berkata — kepala bapak awaok! Maka bila orang Umno kata mereka berjuang untuk orang Melayu, saya orang Pahang akan berkata, kepala bapak awaok!

Kedua, daripada tiga juta ahli itu, Umno berjuang untuk kumpulan terpilih. Jika cawangan Umno mempunyai 50 orang ahli, ketua cawangan akan berjuang untuk 30 orang sahaja. Itu terdiri dari yang sekabilah dengannya. Amalan ini di lakukan di peringkat cawangan, bahagian dan seterusnya pada peringkat induk.

Bayangkan sebuah parti yang membina kekuatan nya diatas perpecahan yang bermula di peringkat cawangan lagi adakah parti seperti ini layak bercakap mengenai perpaduan dan bersatu?

Dasar yang ada dan di amalkan oleh Umno ialah dasar Bumiputera — yang berada di hadapan mengaut dan memonopli segala hasil peuangan ialah putera-putera pemimpin, putera raja, putera ahli politik, putera ketua cawangan, putera ketua bahagian, putera ahli MKT Umno dan putera-putera orang berkuasa dan bernama. Land tribunal ‘judges’ must know ‘native adat’

KUCHING: Chief Judge of Sabah and Sarawak Richard Malanjum's proposal for the authorities to set up a land tribunal in Sabah to hear native land-related cases must ensure that the body is bestowed with full "powers", a prominent native customary rights (NCR) lawyer here said.

Baru Bian, who is also state PKR chairman, while lauding Malanjum's suggestion, said the more important factor in setting up such a tribunal is its composition and authority.

"This is very encouraging news which is line with our earlier proposal. Now the most important thing is the composition and power of the tribunal.

"The basic requirements and qualifications of a High Court judge are that he is familiar with natives 'adat' and culture.

"They must be independently appointed," Bian said.

He was responding to a statement by Malanjum that a native land tribunal should be set up in Sabah to provide a more effective alternative to resolving disputes involving native land.

Malanjum said that a dedicated body, similar to the Waitangi Tribunal in New Zealand, would be more flexible and therefore able to settle disputes faster and more efficiently.

He has suggested that it "may be time for the state to consider setting up such a commission, instead of just throwing native land dispute cases to civil courts".

"In some cases, judges from Peninsular Malaysia, who may not be that familiar with Sabah's native customary land rights, have to preside in local cases and as a result, these cases may be decided as they would have been in similar land cases in the peninsula," Malajum reportedly said.

Pakatan's idea

Bian said Pakatan Rakyat Sarawak comprising PKR, DAP and PAS had, in the last election, included the setting up of a land commission in its manifesto.

Among others, the commission would assist the state and the natives to solve the increasing problems connected to NCR land.

Bian, who is Ba'Kelalan assemblyman, had raised the proposal at the State Legislative Assembly in its June meeting last year and urged the government to set up the land commission.

He had argued that establishing a land commission was "crucial" because the court and the state government had different ideas on NCR land.

The government is of the view that NCR land covered only areas farmed before Jan 1, 1958.

But the court had ruled that NCR land also included "pemakai menua" and "pulau galau".

Bian's suggestion was rejected outright by the state government.

Currently, there are more than 200 NCR land cases pending hearing in the High Court, and many have been in the court for more than five years.

"Lately there has been some improvement. With the setting up of the tribunal, many of the cases can be expedited," Bian said.

PAS jangan terkilan MB jaga Islam — Subky Latif

31 JAN — Saya tidak fikir Menteri Besar Selangor, Tan Sri Khalid Ibrahim ada agenda sendiri apabila beliau mengambil portfolioa Agama Islam dan tidak mengambil Dr Rani sebagai Exco baru sedang Dr Rani adalah ketua PAS Selangor.

Saya fikir Khalid dan keduanya Datuk Seri Anwar Ibrahim tidak mengenepikan PAS dan ketuanya dalam membuat keputusan itu. Bodohlah Khalid jika dia tidak berbincang dengan Dr Rani dan PAS sebelum keputusan itu dibuat. Dan saya percaya MB Selangor itu sudah ada maklum balas dari pimpinan PAS apabila keputusan itu dibuat.

Jangan ditanya mengapa Dr Rani tidak jadi Exco baru. Biarkan ia menjadi rahsia antara Khalid dan Dr Rani dan antara Anwar dan Ustaz Hadi.

Memandangkan Khalid adalah ahli tadbir yang cekap dan tempoh pilihan raya umum adalah dekat, maka dia tahu banyak tentangan pentadbiran agama yang tidak jelas apa yang telah dibuat sejak tahun 2008 dulu.

Dengan kuasanya sebagai ketua kerajaan dan kecekepannya sebagai pentadbir, dia tuntu dapat imbangan apa yang tidak dapat dibuat dulu dengan apa yang patut dibuat dalam waktu singkat nanti.

Dalam waktu yang singkat ini Dr Rani sebagai Pesuruhjaya PAS Selangor perlukan penuh masa dan tenaga untuk menggembleng tenaga bagi membangun tenaga dan semangat PAS penghadapi pilihan raya. Dia mesti buat apa yang tidak dibuat dulu.

Tidak sempat dan tidak cukup tenaganya untuk membuat dua kerja penting dalam masa kurang dari setahun atau sekadar beberapa bulan lagi saja bagi meletakkan PAS yang tempat yang terbaik.

PAS mesti capai keputusan lebih baik kali ini. Tetapi Dr Rani cuma ada waktu yang singkat untuk memenuhinya. Kalau dia tidak dapat buat lebih baik dari tahun 2008, dia mesti jangan kurang dari pencapaian sekarang.

Saya percaya Dr Rani dan Khalid Ibrahim telah berkongsi pengetahuan bagi memastikan Selangor dapat dipertahankan dengan keputusan yang lebih baik.

Khalid dan Anwar tahu bahawa kemenangan Pakatan di Selangor dan di seluruh negara antaranya adalah atas penyertaan padu dan kekuatan PAS. Jika diketepikan PAS, maka rugi besarlah Pakatan. Tidak sampailah ia ke Putrajaya.

Jangan fikir Anwar dan Khalid begitu lemah untuk memahami suasana politik di negara ini.

Cuma bagi Dr Yunus yang diberi tanggungjawab atas Adat Istiadat Melayu, Belia dan Sukan dalam waktu yang singkat sekarang berdepat dengan cabaran untuk menyuntik cara bekerja dan berfikiran Islam dalam pentadbiran.

Bagaimana adat Melayu itu dapat menjadi adat Islam supaya semua adat itu sesuai dengan kemahuan ibadat? Jangan lagi adat itu terus bersalut dengan kerja tahyul, kurafat dan gejala jahiliyah.

Dr Yunus diberikan satu corak belia yang diketahui sedang dilanda oleh gejala dan gelombang keruntukan akhlak. Belum lagi dasar belia nasional dapat menangani isu keruntukan akhlak itu. Dr Yunus diberi satu tanggungjawab besar bagi menyelesaikan masalah di negerinya sedang ia tidak dapat dan belum dapat diselesaikan oleh Kementerian Belia dan Sukan.

Dr Yunus diberi tanggungjawab itu bukan sekadar untuk menyusun dan mengadakan program belia bagi menjadikan belia ssebagai produk dinamik dalam pasaran buruh, tetapi adalah untuk menyuntik watak dan ruh Islam di kalangan belia. Bagaimana belia bukan Islam dapat dijinakkan dengan cara hidup dan berfikiran Islam?

Bagaimana ahli sukan dan belia Budha, Hindu dan Kristian boleh menyesuikan pegangan agamanya dengan cara hidup dan pemikian Islam mereka ada saksiah Malaysia yang tidak sama dengan belia di Vietnam, Thailand dan Myanmar tetapi tetap sebagai ahli sukan dan belia yang dinamik.

Kerja membudayakan Islam dalam alam dan masyarakat belia dan sukan adalah sama penting dengan mendinamikkan pentadbiran Islam di MUIS dan JAIS. Jangan fikir peranan Islam amat kecil di jabatan-jabatan yang dijaga oleh Dr Yunus dan fungsi di Jabatan Agama.

Pahala seorang Exco yang menjadi berbagai portfolio yang dapat membawa cara bekerja Islam di tempat masing-masing adalah lebih ketara dari orang yang tidak dapat menjalankan kerja Islam di Majlis dan Jabatan Agama Islam. Belum tentu menghalang orang yang tahu agama bercakap di surau kerana tiada tauliah suatu yang berpahala.

Menyekat gejala murtad berpahala tetapi menyekat pendakwah tanpa tauliah belum tentu berpahala. Maka jangan fikir tempat Dr Yunus sekarang bukan termasuk bidang penting bagi Islam. Yang penting di mana PAS dilempar, dia boleh bawa Islam itu. — harakahdaily.net

Saya percaya Dr Rani dan Khalid Ibrahim telah berkongsi pengetahuan bagi memastikan Selangor dapat dipertahankan dengan keputusan yang lebih baik.

Bagaimana belia bukan Islam dapat dijinakkan dengan cara hidup dan berfikiran Islam?

Kerja membudayakan Islam dalam alam dan masyarakat belia dan sukan adalah sama penting dengan mendinamikkan pentadbiran Islam di MUIS dan JAIS. Jangan fikir peranan Islam amat kecil di jabatan-jabatan yang dijaga oleh Dr Yunus dan fungsi di Jabatan Agama.

Pahala seorang Exco yang menjadi berbagai portfolio yang dapat membawa cara bekerja Islam di tempat masing-masing adalah lebih ketara dari orang yang tidak dapat menjalankan kerja Islam di Majlis dan Jabatan Agama Islam. Belum tentu menghalang orang yang tahu agama bercakap di surau kerana tiada tauliah suatu yang berpahala.

Menyekat gejala murtad berpahala tetapi menyekat pendakwah tanpa tauliah belum tentu berpahala. Maka jangan fikir tempat Dr Yunus sekarang bukan termasuk bidang penting bagi Islam. Yang penting di mana PAS dilempar, dia boleh bawa Islam itu. — harakahdaily.net

MACCgiven two weeks to act against NFC head...

NONEPKR has given the Malaysian Anti-Corruption Commission (MACC) two weeks to arrest and charge National Feedlot Corporation (NFC) chairperson Mohamad Salleh Ismail over a bribery allegation..

Failing this, the opposition party has threatened to pressure the government to set up a royal commission of inquiry (RCI) into the possibility that the MACC is protecting NFC.


Yesterday, PKR had revealed a police report in which businessman Shamsubahrin Ismail (left) had claimed to have been pressured to pay bribes to put the police off investigations into scandals involving the NFC. While Shamsubahrin has named Salleh as having instigated this, the latter has dismissed the claim.
                    
Taking this further, PKR Subang MP R Sivarasa and Wanita chief Zuraida Kamaruddin lodged a report today at the Kuala Lumpur MACC office.Their report is based on claims by businessman Shamsubahrin Ismail that Salleh had asked him to bribe the police as inducement to call off the on-going probe into the NFC.

 
Zuraida said the MACC, which had arrested Shamsubahrin on Dec 22 last year, has been holding his mobile phone in which text-messages from Salleh are stored.

She therefore questioned the MACC's failure to act against Salleh up to now.


PKR, she added, will next lodge a report at the MACC headquarters n Putrajaya.


'Cops should be probed as well'


Sivarasa claimed that several other personnel of  NFC had repeatedly sent text-messages to Shamsubahrin, ordering him to bribe the police. However, he declined to reveal the names of those allegedly involved.

NONEHe said the RCI, if set up, should also investigate the conduct of the police.

"We put a challenge to MACC to investigate Salleh (left) just as Shamsubahrin was investigated, and to arrest and charge Salleh," he told reporters.

Sivarasa said PKR supports DAP leader Lim Kit Siang's intention to set up a RCI to look into alleged abuse of a RM250 million government soft loan to NFC, if Pakatan Rakyat takes over Putrajaya.

Shamsubahrin, who has been charged with four counts of cheating, is being remanded at Sungai Buloh prison as he has refused to post bail for reasons of personal safety.





NFC tolak memo NGO


Usaha sebuah NGO menghantar memorandum kepada National Feedlot Corporation berhubung dakwaan perbelanjaan kredit kad RM600,000 yang didakwa menggunakan wang daripada dana kerajaan hanya sampai di muka pintu.

Rombongan kira-kira 10 aktivis JINGGA 13 pulang hampa apabila kehadiran mereka di Kuala Lumpur gagal mencapai matlamat apabila pegawai syarikat itu enggan menerima memorandum itu.

"Walaupun Saudara Fariz Musa selaku ketua koordinator menyatakan bahawa JINGGA 13 mewakili kehendak rakya! t untuk dapat penjelasan, namun pegawai itu bertegas untuk mengikuti arahan atasan dengan alasan NFC adalah 'entiti perniagaan'," kata setiausahanya Saifuddin Shafi Muhammad.

Menurut Saifuddin, pegawai itu juga menyatakan tidak mahu mengganggu tugas pihak polis yang sedang menyiasat kes itu walaupun pengarah eksekutifnya Wan Shahinur Izmir Salleh didakwa berkali-kali membuat kenyataan menafikan dakwaan itu.

JINGGA 13 sebelum ini membuat laporan polis terhadap empat anggota menteri pembangunan wanita Datuk Seri Shahrizat Jalil yang didakwa membelanjakan hampir RM600,000 pada tahun 2009 dengan kad kredit yang wangnya dari dana NFC.

Dalam kenyataannya hari ini, NGO yang dekat dengan PKR itu juga mempersoalkan keistimewaan kumpulan pendesak Melayu PERKASA dan 11 NGO yang dijemput khas untuk diberi penerangan oleh NFC sebelum ini.

Justeru, Saifuddin mempersoalkan kenapa JINGGA 13 yang melaporkan perkara itu kepada polis dan Suruhanjaya Pencegahan Rasuah Malaysia (SPRM) tidak dilayan jika benar tiada fakta mahu disembunyikan.

Dr. Mahathir’s intended mishap malady with PERKASA

Seriously, do you think Perkasa has even an iota of intelligence to organize a CNY celebration to counter the skepticism of the Non-Malay community in Malaysia.

PERKASA is nothing but a bunch of field soldiers at the helm of Dr. Mahathir, the leader of the '3M' to rock the boat for Najib Abdul Razak.

Even a normal citizen like me, knows that an ang pow is never given in any other color other than red for the Chinese community, what more for seasoned politicians who keep licking the ass of the voters when they need their voters.  

This is a very clever plot initiated to taint Najib Abdul Razak, for he is seen to condone and blessed with the antic of PERKASA for the benefit of the '3M'. Dr Mahathir is not just an ordinary personality, this is the guy who wielded the iron shield to protect only his interest and his agenda.

PERKASA is nothing but a tool for Dr Mahathir as we now see the statement by the MCA Youth Secretary-General Dato' Chai Kim Sen in detesting  the act of PERKASA in handing out white envelopes for CNY, courtesy of Najib.   

Najib should be wary as the knives are out there in the form of Dr Mahathir, as the enemy within his own UMNO will ensure his demise.

The power struggle of the UMNO political hegemony is not new, then it was window dressed, these days, it is pretty obvious as seen in this episode.

PERKASA unlike HINDRAF, a movement of people's conscience is a toothless tiger without Dr Mahathir, yet the friction is to place the pawns in their right places to achieve only what Dr Mahathir wants. That is the trade of this man and his field soldiers. There is no loyalty or conscience, only loyalty is power to the great Dr. Mahathir's agenda.   

I maybe wrong in my analogy, but what the hell, Malaysians are full of gossip, let this be one for the Kedai Mamak kopi time.

Court sets April 4 for trial in NFCorp case

KUALA LUMPUR: The Sessions Court here today set two days from April 4 for the trial of businessman Shamsulbahrin Ismail who is charged with cheating National Feedlot Corporation (NFCorp) director Mohamad Salleh Ismail of RM1.755 million.

Judge Rozilah Salleh set the date when the case came up for mention today.

Malaysian Anti-Corruption Commission (MACC) prosecution unit chief Abdul Razak Musa told the court that the prosecution will call 15 witnesses.

Shamsulbahrin, 46, is charged with cheating Mohamad Salleh by purposely promising a consulting service with the intention to dishonestly induce Mohamad Salleh, who is NFC executive chairman, to agree to pay for the service.

Shamsulbahrin, who is chief executive officer of Samsulbahrin Resources Sdn Bhd, is charged with committing the offence at a restaurant in Bukit Tunku here at 6 pm on Nov 20 last year.

He is also charged with cheating Mohamad Salleh by deceiving him into surrendering cheques worth RM1.755 million. The offence was allegedly committed at Solaris Mont Kiara here between Nov 25 and Dec 6 last year.

Both the charges were made under Section 420 of the Penal Code which provides for imprisonment of up to 10 years, with whipping and a fine, upon conviction.

Shamsulbahrin was represented by Zarina Ismail.

White ‘ang pow’ nothing to do with govt, says Najib

KUALA LUMPUR: The use of white envelopes along with the customary "ang pow" red packets at Perkasa's Chinese New Year gathering last Sunday has nothing to do with the government, said Prime Minister Najib Tun Razak.

He said leader of the NGO, Ibrahim Ali, is an independent member of parliament. Perkasa is a Malay right-wing group.

"As such, the while packet distributed at the Chinese New Year function should not be construed to be acceptance by the government," Najib said in a posting on his Chinese-language "Ah Jib Gor" Facebook page.

"I think that as long as we can have a better understanding of Chinese culture and promote sensitivity to cultural taboos, such controversial events can be avoided.

"We all know that 'ang pow' means a red envelope, dominated by red rather than other colours," he said, adding that the incident can be used as a social experience.

Yesterday, Perkasa was asked to apologise for insulting the Chinese community by using white envelopes as "ang pow" packets at its first Chinese New Year "open house". White envelopes are reserved for funerals in Chinese custom.

Gerakan vice-president Mah Siew Keong had said that giving cash in white envelopes during Chinese New Year, which is meant to be a prosperous and joyful festival, showed that Perkasa chief Ibrahim Ali is "greatly insensitive and insincere".

MCA Youth secretary-general Chai Kim Sen had said that Perkasa's action was disrespectful to Chinese culture and custom.

He said Ibrahim should act in the people's interests and understand the multi-cultural society and the taboos and prohibitions of each ethnic group and religion.

Perkasa deputy president Abdul Rahman Bakar had explained that due to the large turnout at the open house at the Sultan Sulaiman Club in Kampung Baru, the red "ang pow" packets ran out and white envelopes were used instead.

Gerakan wary of Sabah polls reception

KOTA KINABALU: Sabah Gerakan is in two-minds over the coming general election. While it is ready to make its presence felt in Sabah for the first time, the party however harbours fear that it's bid may backfire.

The peninsula-based party wants its state Barisan Nasional partners to assist them in ensuring victory for the ruling coalition and indirectly cement their place in state politics.

Warning BN partners to stop quarrelling for seats, Sabah Gerakan chairman Gordon Leong said: "It is our humble opinion that no one else, except we, BN component ourselves, who could cause a serious upset to BN's performance in Sabah in the coming general election, if we start fighting among ourselves.

"We should better focus our energy and efforts to work together solidly and proactively as a single cohesive force to fight against our political enemies which are the opposition parties, as constantly advised by our state and national leaderships, Musa Aman and Najib Tun Razak respectively," he stressed.

Leong was responding to remarks made by BN partner, Liberal Democratic Party (LDP) president VK Liew on Sunday that Gerakan is an outsider in Sabah.

Gerakan, which has been in Sabah for the last 17 years, has left it to the BN leadership to decide its role in the coming general election.

"The best and the right thing for us to do now is to offer ourselves to serve the people.

"We shall concentrate our energy and efforts to continue to listen to and help solve the people's plights, instead of fighting among ourselves for seats," Leong said.

Leong refused to be drawn into the problem of seat allocations among BN parties and said the party maintained cordial relations with all its BN partners including LDP.

42,000 dubious voters struck off the list

GEORGE TOWN: A total of 42, 025 dubious voters would be removed from the electoral roll when the Election Commission verification process on the voters' list ends at midnight today.

EC chairman Abdul Aziz Mohd Yusof said the EC could not verify these voters after coordinating with the National Registration Department (NRD) to authenticate them for the past three months.

The EC has displayed names of total 42,051 dubious voters for public verification since Oct 27 last year. It extended the dateline for the verification process from last Dec 31 to Jan 31.

Of the names, only 26 were able to be verified while the rest remained unverified and dubious, thus would be deleted from roll.

"We have given enough time for all names to be verified.

"The unverified names will be deleted," Abdul Aziz told newsmen after an EC state-level briefing session for election returning officers and agents here. Also present was state election director Morat Pora.

The verification was invoked by demands set by electoral reform coalition Bersih 2.0. The first of Bersih's eight-point demand to EC was to clean up the electoral roll of dubious voters.

As of the end of last year, the country has 12,400,437 registered voters out of the 16,131,571 eligible citizens above age 21.

Abdul Aziz called on the remaining 3,731,134 or 23 per cent eligible citizens to exercise their rights by registering themselves immediately.

Of these three million citizens, he said Malays formed the biggest group, followed by Chinese, Indians and others.

"Registration process is simple and easy.

"You just have to take your identity card, go to the nearest post office and register yourself … even the form would be filled up by the staff," he said.

Penang has 803,304 registered voters, with 157,618 or 18.5 per cent eligible citizens yet to be registered.

The EC's record shows that an average 300,000 people are registering as new voters in each quarter.

Foreign voters

On overseas Malaysians' right to balloting, Abdul Aziz said the country's foreign office, Wisma Putra, has declined to undertake the task to conduct an open balloting process for them due to its complications.

Among the reasons given were that the 'foreign' Malaysians were staying all over the world and some were frequently shifting places.

Moreover, Abdul Aziz said the question on who should be eligible for voting must also be determined.

He raised question on whether those long-staying Malaysians of 15 to 20 years in foreign countries shall be allowed to vote when they had already lost touch with Malaysia.

He said the EC would accept those Malaysians, who are working overseas for past three to five years as they would still be attached to the country.

As for now, he said the EC has decided that early postal voting would be the right answer to the problem.

The fracturing of the Malay community

Umno's interaction with "multiracial parties" has so far been with Anwar Ibrahim's PKR – ostensibly a multiracial party but for the most part, an organisation filled with ship-jumping Umno rejects – and the Islamic PAS, often used as a bogeyman by Umno to keep the non-Muslims in line.

That Umno considers PKR a threat to its power has more to do with the fact that it was always perceived to be the third moderate way of the Malay polity and not for any multiracial reasons.

Umno is fighting a battle on two fronts, against vocal liberal Malay voices of PKR and the more religious tones from PAS.

In both these cases, the fight for the Malay soul is confined within the Malay community and the non-Malays have been collateral damage in the ongoing shadow war that will determine the fate of this country.

NONESo it should come as no surprise that Umno Youth chief Khairy Jamaluddin (left) is concerned over the possible influx of moderate Malay voices into the routinely demonised DAP.

If more Malays enter this political party, the Malay vote will be further fractured into a diverse range of political aspirations that don't neatly fit in the bigoted ethnocentric agenda of the ruling Umno regime.

If the point of the Umno game is to limit the choices of the Malay population then any attempt to provide avenues for different forms of political expressions is a threat to the natural order of their reality.

There can be no plurality of voices when it comes to expressing Islam. Anything which is a threat to Malay unity, which should be read as Umno hegemony, should be shot down in a hail of racial, religious or cultural bullets.

Unfolding DAP dilemma

Just as Umno fears the breaking away of Malays form the three manufactured roads made available to them, the DAP should take into consideration that with an influx of Malay members into their party, they are finally achieving a possible majoritarian mandate.

This is a rather ominous possibility considering the multicultural demographic of this country.

The political landscape would also change, since it is now possible for the DAP to achieve a certain degree of influence without the need of its coalition partners.

The reality is that the Malays (constitutionally created or otherwise) are the largest demographic and in the end, it is the Malay vote – either in unison with a coalition or by themselves – which will determine the form of governance this country will have.

dap convention shah alam 080112 nga kulasegaranAny successful multiracial party which is reflective of the aspirations of this multicultural demographic would have to comprise a sizeable Malay voting base.

This is an axiom that is rarely acknowledged by opposition parties for various political reasons.

A fractured Malay community free from the vicious grip of Umno is exactly what this political landscape needs and the possible influx of Malay members into the DAP should be encouraged but carefully watched.

If the DAP is truly to be a multiracial party (and I have argued that it is many times) then the reality is that it should prepare itself (if it is not doing so already) for a time when it becomes a Malay-dominated party or rather for a time when it becomes so successful in attracting Malay membership because of its ideological perspective, that the racial make-up of the party changes.

We speak the language of race

The possibility of Malays dominating this venerable party no doubt fills the hearts of non-Malays with dread and rightly so. Of course, we conflate the aspirations of the Umnoputras and the larger Malay community.

But when we understand how non-Malays have been marginalised not only from the political process but also education opportunities and other social programmes, our voices stifled by the system, is it any wonder that we view the Malay community, which has benefitted the most from the ruling Umno regime, as detrimental to the liberties we are desperately fighting for?

We, of course, forget that when it comes to the social policies of Umno, everything is smoke and mirrors, be it the gilded cages that they use to ensnare the urban Malay population or the stagnating Felda settlements that house the disenfranchised rural Malay population kept going with promises of fortune from the taxes of the much-maligned non-Malays.

dap conference shah alam 080112 aspan aliasMalays who join the DAP should be fully aware that they are not only bound to whatever Islamic principles they hold true but also to the egalitarian principles of the party.

This should not be a difficult proposition since there is nothing in the political agenda of the DAP which is at odds with core Islamic values or any other religion, for that matter.

And since the language of race is the only way this country has communicated for so long there will no doubt be communal problems within a large multiracial party that is dominated by Malays, just like there is in the PKR, where non-Malays have felt they have been excluded from the political decision-making process within the party.

The inconvenient truth

However, what the DAP has going for it is a long history of political opposition within a fairly secular framework, unlike say the Islamic PAS.

It is a polyglot of class-based interest that has felt the shift in political fortunes over many years of fierce just opposition unlike say the fairly recent PKR, which is dominated by the personality of one man and the baggage of an Umno mindset of most of its members.

malay bloggers join dap 080112 03This would mean that non-Malay communal interests (which the DAP has rightly championed over the years) would have to be replaced by a broader Malaysian perspective, one that encompasses the rights and aspirations of all communities.

This should not be a problem because the core philosophies of the DAP already embraces such a concept of Malaysia-ness.

It would however be an uncomfortable situation for the non-Malays and Malays because this would mean that the Malays would have to abide by the egalitarian principles established by the DAP, principles that are in conflict with long cherished state sanctioned racialist policies and the non-Malays would have to live with the fact that DAP would no longer be perceived by the larger Malay electorate as a Chinese (mostly) based entity because the Malays would probably have a big influence on how the party is run.

As long as all members are faithful to the ideals and constitution of the party, then any short-term tensions would subside in the long run and this country would be better for it.

This perhaps is the only measure of success that really means anything when it comes to the reality of political life here in Malaysia.

That is to say that an influential political party would have the memberships of a sizeable fraction of the Malay population, able to attract votes based on not only its coalition relationships with other "Malay-based" parties but on its own.

This is an inconvenient truth about an end game that most observers wish to ignore.

A new kind of mindset

We have been stuck in this mindset that a ruling coalition of race-based parties is the future of this country despite the fact that the past 50-odd years of a post-Merdeka landscape has proven that this formula for ruling this country has had a deleterious effect on the citizens of this country.

If we continue down this road of race-based parties or rather parties closely associated with race, then we will stagnate politically and the minorities in this country will never truly be a part of the political process.

We will continue claiming little victories and slide deeper into a possible racial clash between the Malays brought upon by the machinations of a corrupt federal government.

What needs to be done right now is a concerted effort not only by the DAP but also PKR into establishing multiracial parties in substance rather than form and be cognisant of the fact that Malays would naturally make sizeable voting blocks of such parties but not necessarily lead these political organisations.

What the DAP offers is an alternative to both the personality-driven PKR and the Islamic PAS, with its democratic socialist roots the anchor for a new kind of mindset that hopefully will take root first amongst the urban Malays and then the rural communities.

The DAP will then truly become a multiracial party reflective of the demographic of this country.

The DAP has said that no member of its party will ever have aspirations to the office of prime minister and perhaps this could be starting point where Malays who join this party acknowledged this dubious concept of 'Kepimpinan Melayu' put forward by the honourable gentleman from Rembau and constrain their aspirations for the highest office in the land until the day any member of their party, regardless of race, can occupy that seat

Ibrahim Ali and the Deathly Angpows

Ibrahim Ali, MP for Pasir Mas in Kelantan, and president of the small Malay supremacy movement Perkasa, cuts an unfamiliar figure for most Sarawakians.

This is not a bad thing, since this 'umno-friendly' independent MP is among the lowest political life forms in the Malayan jungle.

He represents umno's political orifice, through which a steady stream of racist rhetoric pours out. His prime motivation is to keep umno in power.

Amidst this effluent, you may recall a pattern of typically silly, far-fetched publicity stunts.

There was the pledge to wage 'jihad' on Christians, as part of a preposterous fantasy of a DAP-Christian plot to take over the country.

'Comical Ali' also issued a warning to Chinese people to stay at home and stockpile food during the Bersih 2.0 rally, a reminder of the ghosts of the May 13 killings.

His threat failed miserably: Bersih 2.0 demonstrators were defiantly multi-racial and peaceful.

Perkasa is a subcontractor for Umno. This self-proclaimed 'NGO' is responsible for making incendiary statements, urging Malays to hate and fear other ethnic groups.

Umno hopes that, by devolving some of its most pungent racial rhetoric to Perkasa, Najib would appear able to mouth platitudes to non-Malays like '1Malaysia' and 'I help you, you help me', even though all the while umno is feverishly ramping up insecurity among Malays.

This preaching of different messages to different constituencies is umno's only strategy in its desperate efforts to avoid being voted out of power in the 13th general election.

Perkasa virtually invisible in Sarawak

Ibrahim Ali is the clown in Najib Razak's court, dancing and singing fascist tunes.

It is hard to take Ibrahim Ali seriously, when U-turns and inconsistency have been his trademark throughout his chequered years in Umno, Semangat 46, PAS and now Perkasa.

Perkasa branches have been established in Sarawak, but this brand of shrill racism has, happily, been largely ignored. Most Sarawakians treasure our decent race relations.

The dogma of Malay racial supremacy, a typically Malayan form of politicking peddled by Umno and Perkasa, has never caught on in Sarawak.

Perkasa's publicity stunt

As a rule, I ignore anything Ibrahim Ali says or does, even when he invites ridicule – as he did when he reneged on his promises to hold 'counter-demonstrations' against Bersih 2.0 and the 901 rally at Anwar Ibrahim's verdict.

But Perkasa's latest publicity stunt, holding an 'open house' for Chinese New Year, seems to have been engineered to create even more racial mistrust, and to spit in the face of our traditional
open house hospitality.

Malaysians of all races cannot accept that Perkasa could suddenly have a change of heart in relations with other races, when they have been spewing racist poison since they were launched by former premier and lifelong bigot Dr Mahathir Mohamad in March 2010.

This explains the anger over Ibrahim
Ali giving out cash in white envelopes at Perkasa's so-called open house – only practised during funerals.

Some have said the insult was intentional, meant to degrade the Chinese at the open house. Other Chinese people point out that all races – Chinese, Malay and lain-lain – share a common trait of poor understanding of others' culture. Indeed, all of us rarely make the effort to find out about others' cultures.

Our children stand to be the real losers

This sorry episode highlights the seething racism that permeates Malaysian society, beneath the pretence of Asian courtesy and emphasis on 'face'.

This open house fiasco was an argument over nothing. It played into the hands of the racists in Perkasa.

The real losers in this sordid squabble were not the lower-income Chinese happy to receive ten ringgit, nor the corpulent Ibrahim Ali, or the flabby First Couple.

We Malaysians and our future generations stand to be the real losers. The thieves running Malaysia are hoping that racial animosity will drive us to seek false security, by voting for racist parties like Umno, MCA and PBB in the upcoming general election.

If we continue to vote along racial lines, Umno will remain in power and continue draining our public funds, while throwing a few coins in the direction of hired mouthpieces like Ibrahim Ali.

Racism is a curse on our country. In addition to 'imagined communities', many Malaysians cling to an imagined racial superiority.

Some of us consider 'race' – a cultural construct – such an important issue that we would risk our children's future on our witless quarrels.

Only by rejecting racial politics can we rid Malaysia – and Sarawak – of racist parasites.

Perhaps we can take hope in the observation that many Malaysians have changed. Most of us no longer fall for racial taunts like those issuing from Ibrahim Ali before Bersih 2.0 and at the 'open house'.

The co-operation and racial
solidarity we witnessed in Bersih has changed many Malaysians forever. We need to spread this change to everyone else.
