Post-Mortem on Sodomy II ~ by M. Bakri Musa

Anwar interviewed after his acquittal on 9 January 2012 (The Malaysian Insider)

Hold The Accolades!
M. Bakri Musa

Zabidin Mohd Diah:
Malaysian justice on trial
Now that Judge Mohamad Zabidin Diah has acquitted Anwar Ibrahim on his "Sodomy II" charge, there is no end of praise heaped upon the judge specifically and the system of justice generally. Prime Minister Najib was quick with his smug assertion that "neither politics nor politicians have any influence over the dispensation of justice." Foreign governments too have been effusive with their praises. Some now brazenly call for Anwar Ibrahim to apologize for his earlier criticisms of the system.

Hold the accolades! This sordid trial reveals everything that is rotten with the Malaysian system of justice. This case should never have been prosecuted in the first place. That it was reflected the level or more precisely lack of professionalism on the part of these career prosecutors. As for the trial, there were many instances where the judge could have thrown the case out, as when the physical evidence was introduced. Now the learned judge used that as the reason for acquittal.

As for Anwar Ibrahim, he and his family are rightfully grateful for the verdict, but hold on to your apology. Forgiveness, yes, as he said recently; that is always praiseworthy. He rightly cautioned that one court decision does not a judicial spring make. Besides, there is still the monumental task ahead to clear up the mess, and not just in the system of justice. Najib's much-ballyhooed "transformation" is a charade concocted by his exorbitantly-paid consultants.

Doing Away With Anwar

The decision to do away with Anwar was made a long time ago. In opting for this particular route, they had hoped that whatever the outcome Anwar would be irreparably damaged by the smear. How they misjudged! The public remains convinced that the charge was politically motivated, and crassly at that, right from the very beginning.

The tragedy here, apart from the agony and humiliation Anwar and his family had endured, is that a delayed-adolescent college flunkey desperate for his 15 minutes of fame was being exploited. They used the poor boy as a battering rod, pardon my metaphor, to do in Anwar.

There is only one possible redeeming value to Judge Zabidin continuing this trial in its squalid entirety, and that is to expose the pathetic lack of professionalism of not just the prosecuting team but also the other professionals involved. This included the police officers and crime investigators to the forensic scientists tasked with the crucial DNA analysis and the senior specialists who examined Anwar's accuser.

 Hospital Kuala Lumpur's
Dr S Jeyaindran: happy to
help his buddy, PM Najib

Consider those medical specialists. They failed in their duty to inform and educate the court; they owed the court their individual professional judgment, not a committee report. Unlike paid experts, those government doctors were not beholden to the accuser or accused, only to uphold the truth. If they had doubts they should so inform the court. Likewise those chemists; before they performed the DNA analyses they should be satisfied of the integrity of the specimens. If they were forced to perform tests on specimens of questionable integrity, they clearly should have informed the court of their doubts.

Those specialists were based at the General Hospital Kuala Lumpur, an apex institution in the government's healthcare system; thus presumably they must be the best. They should also have known that this was a very high-profile case and that their performance would come under global scrutiny. It should have been an opportunity for them to showcase their talent and professionalism. Instead the judge singled out the inadequacy of the physical evidence, as reflected in their reports and testimonies, as the reason for acquittal.

  1. Gula: RM1.45/kg (Jan 2010) kepada RM2.30 (Mei 2011) - 58% dalam 18 bulan.

  2. Telur: Greg B RM9/30biji (Sep 2010) kepada RM10/30biji (sekarang).

  3. Tarif Elektrik: kenaikan purata 7.12% pada bulan Jun 2011.

  4. Teh Tarik dan Kopi Susu: Kenaikan RM0.10 hingga RM0.20 (9.1% hingga 18.2%).

  5. Roti Gardenia: Kenaikan 5-14% (2011).

  6. Cukai Perkhidmatan: Kenaikan 1% (cukai tambahan RM720 juta untuk Kerajaan Persekutuan).

  7. Bawang: Kenaikan 17% (Dis 2010).

  8. Milo: Kenaikan 5% pada suku pertama 2011, 4% pada setengah tahun kedua 2011.

CORRUPTION WITHIN CORRUPTION: CHAPTER 3 THE UNKNOWN CONCORD

As usual, I’m evoking The Whistleblower Protection Act 2010, Act 711, gazette on 10 June 2010 for myself, my sources and informers. For now I will need to postpone the Phoenix Project Chapter exposé instead I will go with something else that involves the same businessman and a former minister but still a Member Of Parliament.

By Whistleblower 711

Greetings and salutation to all,

Before I continue any further, pardon me for the delay. As originally mentioned on my previous posting, I will come out with another exposé on 23rd December 2011. But alas, current situations and time does not permit me to do so. I hope everyone would understand that I also have my daily commitments and juggling between my own schedules and this blog in my spare time is not an easy thing for an ordinary Joe like myself. All work and no play is not healthy

In light with the current development, it seems that there are many issues needed to be satisfied. BUT THAT IS NOT MY MAIN CONCERN AND OBJECTIVE WHEN I SET UP THIS PAGE. THIS LITTLE BLOG IS NOT MEANT TO SLANDER ANYONE OR TO TARNISH THEIR IMAGE, BUT MERELY EXPOSING THE FACT AS IT IS AND THE IMPROPER CONDUCT OF THOSE IN IT.

IT IS IMMATERIAL IF THIS BLOG IS POLITICALLY MOTIVATED OR ALIGNED.

I WOULD BE GLAD TO EXPOSE ANY IMPROPER CONDUCTS OF ANY PERSON, POLITICIANS OR NOT, WITH SUFFICIENT EVIDENCE. WHAT IS WRONG REMAINS TO BE, NO MATTER THE EXCUSES OR POLITICAL AFFILIATION AND ALLIANCES YOU MIGHT HAVE. SHOULD ANYONE HAVE ANY INFORMATION AND EVIDENCE, AND THE AUTHORITIES ARE RELUCTANT TO ACT ON THAT EVIDENCE, LETS WORK TOGETHER TO EXPOSE IT AND GET THE ATTENTION OF THE AUTHORITIES AND TO GET THE AUTHORITIES TO ACT ON IT ACCORDINGLY. I CARED NOT ABOUT WHAT OTHERS ARE SAYING OUT THERE, AS STATED AGAIN AND AGAIN, MY INTENTION IS TO EXPOSE THE FACT AS IT IS. PEOPLE CAN SPIN WHATEVER THEY WANT, BUT THE FACT REMAINS WHICH NO ONE CAN DENY.

Dato’ Seri Abu Kassim Mohamed

Email received from Dato' A after my second exposé with a message from SPRM Cheif Commissioner.

“SPRM will  definitely take actions”, Dato’ Seri Abu Kassim Mohamed, Ketua Pesuruhjaya, Suruhanjaya Pencegahan Rasuah Malaysia.

What, when and how remains unknown to me. Only Dato’ Seri Abu Kassim knows the answer best.

Thank you the email Dato' A, at least I know that you are really concern about this.

Now get down to business. Let’s divert the attention to another member of parliament. This member of parliament also received monies from Dato’ Yahya Abd Jalil companies (AMPMSB). The mode of thetransaction is pretty straight forward. Perhaps it is meant for social programs in the Member of Parliament constituency. Who knows for sure except for the giver and the receiver. The Member of Parliament meant here was the former Minister of Youth and Sports Malaysia from March 2004 until March 2008 and also the former Minister of Tourism Malaysia from March 2008 until April 2009. The Member of Parliament is none other than YB Dato’ Sri Azalina Othman Said, Member Of Parliament Pengerang, Johor. She has received “contributions” of RM 300,000.00 on 07/04/2011 thru a cheque number 872045 (here) belonging to AMPMSBAs I said, the true nature of the “contribution” is only known to the giver and the receiver. Perhaps it is best to let Dato’ Sri Azalina Othman make a statement just like her counterpart has. Perhaps SPRM also can have a closer look at this.

I have the record of the donations including who are the giver and the recipient of the contributions. I also have a dedicated officer to look after that account.
Principally, there are peoples that contributed. There is no problem for anyone to donate. Except for those with personal interest i.e. to gain a contract. As a Deputy Minister, I have nothing to do with contract awards.” Senator Dato Dr. Awang Adek Hussin.
If I’m not mistaken the conduct of Senator Dato' Dr. Awang Adek Hussin in this instance is similar to the 1976 graft case of the late Dato’ Seri Harun Idris former Menteri Besar of Selangor (1964-1976).

"Thank You! Rakyat Malaysia" from Anwar's children...

An emotional Datuk Seri Dr Wan Azizah Wan Ismail said Datuk Seri Anwar Ibrahim's acquittal of his sodomy charge yesterday finally ended the pain and suffering she and her family have had to endure for the past two years.

The PKR president said she would not have been able to handle it if the High Court had delivered a guilty verdict on Anwar, and that the highly-publicised trial had left her emotionally drained.

Anwar was yesterday acquitted of a charge of sodomising his former male aide Mohd Saiful Bukhari Azlan.

"To be honest I was too tired for a repeat of the sad episode of 1998. I was tired from being dragged into (a) long sadness... if abang Nuar (Anwar) was convicted, even though the kids have grown up, there would be no difference to our pain.

"It would have doubled," she was quoted by Sinar Harian as saying.

"How could it not, (this) body which has grown with age, physique and soul is not as strong as before. The sad news would have washed away all feeling," she said.

Recounting the moments before the verdict was read out in court yesterday, Wan Azizah said she constantly prayed to God not to allow her to be separated from her husband.

"For 2½ years we lived under pressure, dying slowly. Slander is a poison that kills," she she said bluntly! .

The presence of all her six children as well as their spouses gave her some strength and courage as it was rare of all of them to gather together except on special occasions.

"Our hearts were one, our souls were together," she said.

The 59-year-old grandmother recalled how nervous she was on the way to the Kuala Lumpur High Court, passing by the sea of supporters before entering the familiar-looking courtroom.

She said she was speechless and cried when the verdict was read out, amid shouts of joy from friends, relatives and the public.

"I held Abang Nuar close. Abang Nuar held me. I could not say anything but thank Allah.

"At that moment, all the pain left my body. The suffering left my soul," she said, and that the whole family stopped by the Segambut mosque for prayers after leaving the High Court.

"I thanked Allah for allowing us to leave the court with a happy heart.

"Allah, thank you. You have ended our pain."

Saya sekadar memerhatikan.

Mata menatap sayu. Hati berdetik. Mungkinkah ini sarapan pagi terakhir kami bersama?

"Ya RABB. Jauhilah kami dari berita duka itu."

Abang Nuar seperti dapat membaca kata hati saya.
< br>"Apa juga keputusan mahkamah, keluarga kita tetap bersatu. Hati kita tetap bersama."

Abang Nuar tenang. Saya semakin pilu.

Amat berat.

Namun saya tetap yakin, ALLAH menduga setakat mampu umatnya.

Anwar's acquittal a victory for justice but not yet a triumph for the justice system

Media statement by Lim Kit Siang in Kuala Lumpur on Tuesday, 10th January 2012:

Anwar's acquittal a victory for justice but not yet a triumph for the justice system

I had in my first response to Datuk Seri Anwar Ibrahim's acquittal from Sodomy II charges yesterday said that it was a victory for justice.

There was immediate response from detractors accusing me of double standards, alleging that I would regard the justice system as fair and just when Anwar is freed but the opposite if Anwar is imprisoned.

These detractors have got me wrong. Anwar's acquittal was a victory for justice but not yet a triumph for the justice system.

Just as a swallow does not make a summer, the justice system in Malaysia has a very long way to go despite the Anwar Sodomy II acquittal to restore national and international confidence in its in efficiency, independence and integrity.

In acquitting Anwar, Judge Mohd Zabidin Mohd Diah cited the possibility that the DNA samples were compromised and the lack of corroborative evidence. On these grounds alone, Anwar should never had been charged in this first place. Furthermore, Anwar's defence should not have been called at the end of the prosecution case.

Deputy Prime Minister Tan Sri Muhyiddin Yassin today joined the Prime Minister, Datuk Seri Najib Razak and the Information, Communications and Culture Minister Datuk Seri Dr. Rais Yatim to proclaim that Anwar's acquittal was proof of the independence of the judiciary in Malaysia and would increase the confidence of Malaysians and international community in Najib's transformation promises.

Such claims and proclamations are most fragile.

Firstly, it will not be easily forgotten that the crisis of confidence in the independence of the judiciary and the rule of law reached a new climax under Najib's premiership, when he orchestrated the unconstitutional coup d'etat and power grab in Perak state which was given legitimacy by compromised and subservient judiciary.

Secondly, such claims would be instantly destroyed if Anwar is subject to new and further persecutions, whether in a decision to appeal against Anwar's acquittal or to harass him with new charges.

I call on Najib to end all gutter politics and character assassination of political opponents and the politics of lies and hate, which of late has poisoned Malaysian politics and the nation-building process – as for instance the incessant lies trying to portray the DAP as anti-Malay, anti-Islam and anti-Malay Rulers.

Let the battle for the hearts and minds of the voters be on policies and programmes and not on character-assassination, lies and falsehoods.

Anwar's acquittal yesterday has given hope that the decay of key national institutions have not reached the point of no return and that it is possible to effect changes and reforms from within the present system – although there can be no better surety of fundamental reforms of key national institutions than to bring about a change of federal power in Putrajaya in the next general elections.

Anwar's acquittal is likely to affect Najib's time-table for the holding of the next general elections as the possibility of dissolution of Parliament immediately after the Chinese New Year has receded into the background.

This is probably why Parliament has announced the dates for the new Parliamentary calender this year – with official opening of Parliament by the Yang di Pertuan Agong on March 12 starting a 20-day meeting for Dewan Rakyat from March 12 to April 12, 2012; a second parliamentary meeting of 12 days from 11th June to 28th June and a 34-day 2013 Budget meeting from Sept. 24 to Nov. 27, 2012.

As of now, I expect the March meeting of Parliament to be held but not the June meeting, as otherwise the "feel good" feeling generated from Najib's 2012 Budget "goodies" would have been completely dissipated.

Anwar’s problems are not over yet

By Sakmongkol AK47 | 10 January 2012

Anwar has been acquitted. I don't wish to douse the flames of enthusiasm that was evident on the faces and response from his supporters. Family members and friends were elated. I am watching out for possible landmines.

In an interview with Al Jazeera, Anwar said, this present case shouldn't be considered as a landmark case representing the independence of the judiciary. The only concession he made was to recognize the courage of the presiding judge to arrive at this particular verdict. It will be interesting to watch what happens in the coming months.

The future of Malaysia will depend on what happens within one or two weeks after the Anwar verdict. He has been acquitted. However I do not think he is out of the woods yet. Despite being acquitted Anwar is circumspect about the judiciary. His acquittal does not prove the judiciary is independent he says. Now, that is somewhat ominous. Why would Anwar say that?

Anwar knows this. He is let off the hook this time- that's what the government MAY want the public to think. So that they can say, this is proof that the judiciary is independent. DR Mahathir says it before the sitting PM does. Dr Mahathir says Anwar's acquittal is proof that the judiciary in independent. The information Minister said the same thing too. Finally the PM joined in saying the same thing. It's almost like preparing the ground to justify that if Anwar is charged and convicted for some other offences, it is not possible for people to accuse the judiciary of being not independent. It is the same judiciary that acquitted Anwar in this sodomy 2 case.

What if, Anwar is charged for other offenses? And he is convicted there because the evidence is so overwhelming. Anwar isn't able to say the judiciary is independent now because if he is indeed convicted on another instance, he can't turn around to say, the judiciary is not independent. That would be contradictory. So despite being acquitted, Anwar can't say the judiciary is independent.

He can be charged for making a false report about the video showing a man resembling Anwar having sex with a China doll. Having sex is not a crime but making a false report is. Anwar is charged once more because the prosecution has the omega watch, the Chinese national in their custody and the video is proven as authentic by forensic experts. Anwar can then be charged and may be found for committal.

So, he is still not out of the woods yet. Even in the present case, the prosecution can appeal. Dr Mahathir will order DS Najib to appeal. Dr Mahathir would rather have UMNO lose than allow Anwar to be PM. He knows if Anwar ascends to the chief executive office, Mahathir and all those on the same ship are finished. So Anwar must be stopped at all cost.

We must move this country beyond Anwar. Much energy and resources have been spent on the Anwar Saga. While Anwar and his supporters will shout of fitnah and of lies perpetrated, the public is also wasted with the tiring claim of conspiracy. It's been 14 long and bloodletting years.

Anwar's salvation actually lies in changing the government. And that is possible through the next general elections.

Keputusan Kes Liwat : Najib dan Peguam Negara harus letak jawatan

10 Januari 2012

Kenyataan Terbuka SAMM

Maka cabaran masih menanti didepan gerakan kesedaran rakyat seharusnya diperhebatkan. Sela! ku pengg erak anak muda, SAMM akan terus komited dengan gerak kerja menumpukan kesedaran rakyat agar bangkit menyelamatkan negara.

It could’ve been worse for blast victim Ng

KUALA LUMPUR: "I was there to buy a burger when the explosion happened," said Ng Kian Siang, one of the victims of yesterday's bomb blasts outside the Jalan Duta courts.

Ng, 33, requires surgery on his right arm.

"The doctors said I was lucky that the ball bearings from the explosives narrowly missed the bone in my forearm," he said.

Ng, a father of two, is the vice chairman of Johor PKR Youth. He was among the thousands who gathered at the court complex yesterday to hear the verdict in the sodomy case against Anwar Ibrahim. The three explosions came in succession soon after the judge delivered his not-guilty verdict.

Ng was among the five who were injured badly enough to be hospitalised. All of them, except lawyer Keith Christopher Yeoh Min Kit, are PKR members.

Ng will be transferred today from the Kuala Lumpur General Hospital (HKL) to the Segamat General Hospital, which is closer to his home. The surgery will be done there.

"The doctors told me it may take two to three weeks after the surgery for my arm to heal," he said.

Ng said he lost his hearing for some moments after the second blast and was dazed. However, he managed to dash to the other side of the road for safety.

"I ran without thinking and later felt numb in my right hand. That was when I realised it was bleeding profusely. The next thing I knew, I was lying on the ground."

People around him tried to keep him comfortable until an ambulance arrived to take all five victims to HKL.

Inhaling fumes

Ng said he did not notice any suspicious character before or during the blast that injured him. "The only thing I remember is hearing a loud click before the explosion."

He said many Pakatan Rakyat leaders had visited him at the hospital, including PKR vice president Nurul Izzah Anwar and Taman Medan assemblyperson Hanizah Talha.

Another blast victim, 45-year-old Isaiah Jacob, said he fainted after suffering breathlessness as a result of inhaling fumes from the explosion.

"The only thing I remember was waking up at HKL," said Jacob, who heads Batu PKR's welfare bureau. He sustained a minor injury in his back, caused by his fall to the ground during his faint.

Jacob has heart disease. On his request, HKL today discharged him so that he can consult a physician of his choice.

"But I have yet to receive a clean bill of health," he said. "It depends on my check-up with my cardiologist. I don't know what I inhaled yesterday."

Like Ng, Jacob was injured by the second blast, which occurred near a hamburger stall on Jalan Duta Mas.

DPP has another dig at PM&his wooden Cab...

bin Et!

Especially on one who had vowed his had "burnt" his bridge to UMNO forever when joinging Tengku Razaleign once upon a time when they still had "semangat"... Maybe they should join RPK in his abode nigh London Bridge reportedly fallin' down ... yet has not reached the seabed. It awaits the UMNO bridge to hit rock bottom first. And Lais Yatim the orphan rejoined Najib's cabinet and once a while, comes out like a worm to sing the Master's voice song. Pathetic until the same-olde-UMNO crumbles and then Lais Yatim might just goback to Negeri Sembilan to revive his state politics. If Mohamed Isa can, surely Lais Yatim with a Law master's degree candu! And Desi joins DDP in raising the tehtarik cuppppps: Bottoms Up Mateys!

or "INDEPENDENT MALAYSIAN JUDICIARY?" YOU GOT TO BE KIDDING!

Brothers and Sister of Malaysia,

I had wanted to open my writing on this historic day in Malaysian with what it was like to breathe the hill air in the Car Park at the Jalan Duta Court Complex this morning and what it meant to me and my friends when news of Dato Seri Anwar Ibrahim's (DSAI) acquittal filtered through to the crowd of 10,000 there.

But let me digress a wee bit lest we let our serially lying Prime Minister and his Minister for MsInformation, Goebbels Tim Rice Anak Yatim Piatu and his cohorts run off at the mouth (and pink lips) and make all sorts of wild claims that this acquittal has firmly established that our Judiciary always was and truly is, independent of influence, especially by the Executive. Let me categorically state this:

Today's decision by High Court Judge Mohamed Zabidin bin Mohamed Diah to acquit Dato Seri Anwar Ibrahim (DSAI) of sodomising his ex-aide Mohamed Saiful Bukhari Azlan on 29 June 2008 DOES NOT BY ONE JOT mean the Malaysian Judiciary is truly independent of the manipulating tentacles of this UMNO/BN Government or of one that may succeed it. ****No way does one swallow a summer make. Nor does it, as opined by Bridgette Welsh, a professor at Singapore Management University and a long-term observer of Malaysian politics who was on hand to attend the verdict, and who spoke to the Wall St. Journal, mean:

"It shows that Mr Najib ! is willi ng to step away from interfering in the judiciary."

No Siree! It does not mean any such thing! Not by a very long, long way!

****(Interject DPP can? I used the same metaphor - so izzit DPP working inconsort wit' Desi~~ or a case of GreAt Minds Think Alike? ~~ Desi)

I am also incensed (well, actually, fucking pissed off) that all these foreign "experts" on Malaysian politics and Press were allowed entry into Judge Zabidin's courtroom while we, the taxpaying Rakyat (citizens) were deliberately denied our Constitutional right to bear witness to the court proceedings by an army of our very own policemen.

THE SLATE WILL NOT BE CLEAN until Barisan Rakyat takes over the reins of Government and we have an open Royal Commission of Inquiry (RCI) where all the relevant judges, magistrates, Attorney Generals, Chief Secretaries to Government, Ministers, Chief Ministers, Inspector Generals of Police, Generals and even the odd Sultan or two are subpoenaed to testify on the peculiar decisions they made regarding State coups, various deaths in police custody and elsewhere as well as cases of financial misdeeds by our home grown Fraudtrepreneurs and "Corpo-rat Captains of Industry," general endemic corruption and about corruption charges levelled at judges. Some of these cases are-:

1. The Teoh Beng Hock "suicide."
2. Ahmad Sarbaini Mohamed "suicide."
3. Deaths in police custody of Francis Udayappan, Ananthan Kugan, Gunasegaran Rajasundram and scores of others.
4. A former Chief Justice (an an ex-Atto! rney Gen eral) who was caught candidly on camera holidaying with lawyers who paid for his travelling expenses and who appeared in front of him in more than one court case. That same CJ was also identified by witnesses testifying under oath at the same RCI as having gone hunting for a $ 1 million house with a local business tycoon. The lawyer involved was accused of fixing some court cases and the appointment of judges with the CJ and others such as Mahathir.
5. Perak State coup.

In particular, I would like to grill over flaming coals a couple of Federal Court judges, if they are still alive, how in Sodomy 1 they could honestly write an opinion that the accuser, Azizan Abu Bakar had blatantly lied about various relevant issues under oath, but nevertheless were "convinced" that DSAI had committed sodomy on him as testified to solely by Azizan!

This is not about revenge, but about transparency and accountability, and most of all, integrity. It is also to send a clear message to those titled personages and others holding high office in Government and Government Linked Concerns (GLC's) that with fancy salary packages, perks and privileges, not to mention inflation proof index-linked pensions and chauffeur driven Mercedes Benz cars, comes 'in loco parentis' or duty of care. They cannot just walk away from administrative and $ million and $ billion financial scandals which burgeon under their watch, or which involves them or their cronies/families while they foam at the lips with tag lines like 'People First, Performance, Now! (Accountability, Never!).'

Note that a Malaysian born CEO (of 9 years standing) of Singapore MRT resigned last week after t! wo major MRT breakdowns in train service. Here in Malaysia, a certain once Minister of Agriculture and now Deputy Prime Minister refuses to take responsibility and resign in the wake of alleged massive corruption and Criminal Breach of Trust (CBT) involving a $ 250 million Government 25- year Loan dished out to the husband of Minister of Cows & Condos (and the odd $ million Mercedes cars, or two or maybe, three).

Here still, another former Minister shamelessly continues as Chairman of a commodities driven Public Limited Company (Plc) which since an infamous merger, for which a merchant bank led by PM Najib's brother is reputed to have earned professional fees of about $ 500 million, has lost some 50% of its share value, declared sapping losses of over $ 2 billion and after blaming it all on the Plc's CEO, has now suspiciously, despite the Plc having its own award winning property arm, forked out a whopping $ 750 million (60% over its quoted market price) for control of another listed property company. Wtf, you may well ask! The list is almost endless.

So, integrity is somewhat is short supply here, where it matters most.

No Siree! The moment Prime Minister Najib smirked "Who is Anwar" and mocked him in Parliament about his injuries sustained in the Bersih rally and then fought tooth and nail to successfully set aside (by Judge Zabidin) a subpoena issued by DSAI's lawyers for Najib (and his wife Rosmah) to testify in the Sodomy 2 trial, we know Najib and his band of 40 thieves will NEVER "step away from interfering in the judiciary." Because, for the past 30 years, undermining and destroying the ideals of ! the Sepa ration of Powers, a Mahathir formulated initiative, has been the KEY strategy of UMNO/BN in clinging on to power.

And this is where Judge Zabidin comes in. How did he rule that PM Najib and Rosmah had nothing relevant to testify to when Saiful had testified under oath that he had met them in their home courtesy of Najib's aide. Najib had even placed a telephone call about it to then IGP Musa Hassan BEFORE the alleged sodomy act took place!

Especially since Najib first lied in public that he had ever met Saiful, back-tracked on it when caught out, then lied again that he had only met him about a scholarship Saiful was lobbying for and only when finally cornered by the Opposition, did he (reluctantly) own up?

Do remember too that Zabidin and the judiciary repeatedly blocked Anwar's request for witness list and other discover documents to facilitate to the maximum Solicitor General Mohamed Yusof Zainal Abiden's ambush tactics. At the end of the prosecution's case, he even ruled that Saiful was a credible witness! He also first ruled DNA material gathered when DSAI was in a prison cell was inadmissible (at which point the entire SG's case fell apart and it was game over) and then on some flimsy appeal by the SG, reversed it!

So, when everything pointed to a conviction, what gave?

My guess is that when faced with judgement and widespread condemnation by the international press like the Washington Post and Wall St. Journal which had the attention of Obama, and the leaders of half the western world as well as Turkey, Oz and NZ had pronounced misgivings over the long drawn out case which the SG should not even have filed in the first place, he exercised discretion over valour and passed the buck back to PM Najib and the politicians who conspired and conjured it up in the first place.

Were the integrity of the DNA samples compromised to such a degree that Zabidin had reasonable doubt to acquit DSAI? That much is certain. When faced with the idiocy (did the midwife drop him on his head at birth) of a Chief Inspector of Police who illegally removed the samples from the safe custody of the Chemistry Department, claimed to have them stored in a cupboard in his air-conditioned office and checked on their integrity by sticking his hand in the cupboard to verify that it was at an equable temperature, what choice did Zabidin have? I mean which police station in this country runs its air-conditioning units at zero or sub-zero temperatures? More than that, there was that utterly damaging testimony by that defence DNA expert from Oz that had our scientist from the Chemistry Department been his students, he would have failed them all!

Bu! t in an other era, that of Mahathir "the benevolent dictator" and Judge Augustine Paul (passed away in 2010) and Judge Ariffin Jaka (passed away end 2011) much of the defence evidence and testimony would have been oh, so conveniently declared "irrelevant" and "expunged" from the court records forever, and even a Mother Teresa convicted of dildo-sodomising nuns and the poor.

So, High Court Judge Mohamed Zabidin bin Mohamed Diah today did what was the only course of action open to him if he did not wish to be pilloried for his remaining days by the court of public opinion, local and international.

HE SCREAMED "CATCH!" IN UTTER PANIC AND THREW THE BALL AND BUCK BACK TO PM NAJIB AND UMNO/BN!

Najib and UMNO/BN give up on meddling with the judiciary? After manipulating the appointment of their party legal adviser, Tun Zaki Tun Azmi as CJ in 2008 over the heads of so many senior judges? NEVER! After wantonly throwing way $ 100 million to APCO USA and $ 58 million to FBC Media in UK to prop up his image by PR misdirection and drivel? NEVER! Because misinformation and now and then plain lying is the credo of this leadership.

And so when the acquittal verdict was confirmed and I breathed in that cool morning air atop the Jalan Duta Court Complex hill, freshened by early morning showers, an old confidence surged in my bones. It suddenly flashed across my mind as I hugged my friend Bernard and looked across at the weeping and laughing and cheering PKR, PAS and DAP old, young and rejuvenated men and women:

THE END IS NIGH FOR NAJIB AND THIS BREED OF UMNO/BN LEADERS AND POLITICIANS. IT WILL DO THEM A WORLD OF GOOD TO BE IN OPPOSITION FOR A COUPLE OF TERMS OR UNTIL THEY LEARN THAT CONTINUALLY LYING TO THE CITIZENS AND CHEATNG THEM WILL GET THEM NOWHERE. BE WARY. DO NOT BE FOOLED BY PR MANIPULATION AND SNAKE OIL SALESMEN MASQUERADING AS CARING POLITICIANS,

BARISAN RAKYAT'S TIME HAS FINALLY ARRIVED. THE SUN HAS SET FOR NOW ON UMNO/BN. WE ARE DESTINED TO SEIZE THE UPPERHAND.

WE ARE ALL OF 1 RACE, THE HUMAN RACE!
