TG.Nik Aziz minta beri hak rakyat berhimpun...

Mursyidul Am PAS, Tuan Guru Datuk Nik Abdul Aziz Nik Mat, meminta kerajaan memberi hak kepada rakyat untuk berhimpun termasuk pada 9 Januari ini sempena kempen pembebasan Datuk Seri Anwar Ibrahim.

Katanya, perhimpuan itu langsung tidak bersalahan dengan demokrasi, apa lagi kerana peluang berhimpun itu sendiri diajar oleh Islam.

Beliau berkata demikian kepada media selepas majlis penyerahan kunci kediaman penjaga gol bola sepak negara, Khairul Fahmi Che Mat, 23, di Taman Kurnia Jaya, Pengkalan Chepa, tengah hari tadi.

Katanya, Islam tidak menghalang demonstrasi atau berhimpun kerana ianya ada pada agama suci itu sendiri.

"Hari-hari kita berhimpun sebanyak lima kali sehari iaitu di masjid atau sekali setiap minggu, iaitu solat Jumaat," ujarnya yang juga Menteri Besar Kelantan.

Menyentuh tentang masalah yang dihadapi oleh Anwar kini, beliau yakin ketua Pembangkang itu hanya dikhianati.

Tambahnya, lagipun mahkamah belum lagi memutuskan Anwar bersalah.

"Kalau mahkamah putuskan dia bersalah, memang tak munasabah semuanya tu.

"Yalah, di dunia ni kita boleh cipta macam-macam perkara, tetapi akhirat nanti terimalah pembalasannya," ujarnya lagi.


Beliau juga menda! kwa, pun ca utama Umno dan BN bermusuh dengan bekas timbalan perdana menteri itu kerana Anwar kini melawan mereka.

The Subang Singularity and single dads — A. Asohan

JAN 4 — Unbeknownst to many, there are two quantum strings woven tightly together on the topmost floor of a major shopping complex in Subang Jaya, warping space-time sufficiently to create a closed time-like curve. I wandered in accidentally, and was cast back in time.

There is a nice little room there for parents to take care of babies — change their diapers, wash them up and all. I expect the facilities to be top-notch. I have to speculate here, because this wonderful special room is called "The Mother's Room," and its rules and regulations say that ONLY FEMALES ARE ALLOWED IN!!

Yes, I was back in the 19th century. It must have been, because like many 20th century fathers, I changed my kids' diapers, you know? Indeed, when our first kid was born, I had to show the mother how to do it.

Yeah, I fed them and burped them and bathed them. I tucked them into bed and read their bedtime stories. When they were sick, I was the parent who stayed up. When they grew older and could interact more deeply, I was the parent they almost always spoke to first when they had issues, ideas, problems and concerns.

I am not unique a father in this. Many of my generation and even those before have been fully participative parents. We may not be the rule, but neither are we the exception. And speaking on behalf of all of us fathers, I can say that WE ARE FED UP OF BEING TREATED LIKE LESSER, SECOND-CLASS PARENTS.

Yeah, I know: Mothers had their nine months of pain and trauma, culminating in the extreme pain and trauma of labour. Many of us empathised enough that, if we could have, we would have taken on this pain and trauma ourselves … or at the least, shared this burden with you too.

But just because you mothers went through this, it doesn't make you better parents. And while there is scientific basis to that whole "special bond between mother and child" thing, these are not unbreakable bonds.

That Texan parent who drowned her four children in the bathtub? She was a mother. Oh yes, there have been abusive fathers too. Way too many of them, and way too many who get away with it. Those fathers who raped their daughters? Guess who was in the next room pretending nothing was going on? The mothers.

A few years ago, when our daughters were nine- and seven-years-old, their mother left us. She had met an old flame (thank you, Internet!), and went off with him because, apparently, he was the one "I always wanted to start a family with." I was mere chopped liver, fine … but where did that leave our kids?

I was feeling very sorry for them, and for myself too, of course. Then I found out I was more fortunate than most. While going from a double-income family to a single-income family was a challenge, I was financially stable. I met this very helpful couple who told me about another friend of theirs: A married man with four children who came home late from work one day to find a "Dear John" letter. She too had met an old flame; they had run off together. Good-bye, take care.

This man worked his butt off to see all four of his kids graduate with university degrees. He did it single-handedly. Where was the mother? She was never heard from again.

Single fathers are in the news now, thanks to that horrific case in Penang, where police had to rescue two young siblings whose single father had kept chained in the bathroom. I wonder at what was going in his mind, but then I remember how close to the edge I was during the bad years when I realised I had to go it alone.

While it is never going to be sufficient, single mothers at least have more support groups to help them. There seems to be no such thing for single fathers.

I know — all I have to do is look around me — that most mothers are great mothers, dedicated to nurturing and bringing up their children. I know that not enough fathers are just as dedicated. And I know that there are still too many men who think fatherhood is limited to fiscal support and the occasional bounce-on-the-knees while watching the evening news.

But enough already with the "special bond," enough of Father's Day being a mere sop and lesser adjunct to Mother's Day.

Still, you know what? Even if society out there doesn't recognise single fathers, our children do.

A couple of years after largely ignoring my daughters, their mother felt guilty or needy enough to re-engage them. She used that old technique about how they had a special mother-daughter bond because they were all female, and most importantly, they had that special bond because she had carried them for nine months.

They told her, "We love you, Mummy, and we know that you carried us for nine months. But Papa has been carrying us since."

Public viewing of Lynas’s documents — AELB

JAN 4 — As of 4.30 pm on January 3, 2012, a total of 26 members of the public reviewed the two Lynas documents, pertaining to Lynas' application for temporary operating license for consideration by the Atomic Energy Licensing Board (AELB). Each document is 90 pages thick.

At one of the centres located at the Pahang Sate Secretariat building, only 12 people had requested to read the documents while a majority was there as mere bystanders.

Eight people had viewed the documents at the AELB office at the Lynas's site in Gebeng, one at the AELB East Coast Branch office in Kemaman and five at AELB headquarters in Dengkil.

Most of those who viewed the documents represented political parties, non-governmental organisations (NGO), the academia and individuals.

To further facilitate public viewing of the documents, two more sets of documents will be made available at the Pahang State Secretariat building tomorrow.

Members of the interested public in Kuantan are also advised to view the same documents at nearby designated centres that are less congested.

Please be informed that viewing is not limited to one hour should there be no member of the public waiting in line. The one hour limit is placed to ensure maximum participation of the members of the public in the review process.

Cops mount ‘anti-riot’ blitz on Anwar 901 rally

Free Anwar 901 Rally will of course be peaceful, as the Lawyers Match, Bersih, Hindraf, Bersih 2.0 and many other citizens' assemblies and rallies have proved.

Who gave Datuk Seri Anwar the black eyes? Who aimed the teargas canister directed at Datuk Seri Anwar? Who shot the teargas into Tong Shin Hospital? Who knocked the university students unconscious, broken teeth and dislocated cheekbone?

Malaysians are no fools!

Police have mounted a social media campaign against the planned rally over PKR de facto leader Anwar Ibrahim's Sodomy II verdict on Jan 9.

The official police Facebook and Twitter accounts shared photos and videos of past riots, including an ABC News report of the London riots last August.Police captioned the video clip on London riots as: "Is this what you want? Peaceful assemblies that have become riots overseas should be a lesson to us if we want to pursue freedom and right to self-expression."NONEThe video clip, over two minutes long, shows rioters smashing windows, setting buildings and vehicles ablaze and battling with police on the streets of London.

The clip also shows a woman jumping off a burning building onto the arms of rescuers, with the ABC Newsnewscaster describing the scene as "apocalyptic".

One photo shows people climbing onto a police patrol car, while another shows rioters overturning a large van. However, the source of the photos is unclear.

In addition, police have also posted clips of interviews with a 'shopkeeper' and a 'security guard' making negative comments about Monday's planned rally outside the High Court complex in Kuala Lumpur.

"If possible, don't do this 901 rally because it troubles everyone," says the shopkeeper identified as 'Mr Kenny' in a one-minute video clip, claiming that the Bersih rally and Reformasi movement had affected his business.

'Thumbs-down' rating for video clips

"This illegal assembly is pointless, troubles other people, and wastes time. Why should we help someone who doesn't help us?" asks an unnamed 'security guard' in a separate video clip.

"If they help Anwar, would Anwar return the favour if they get into trouble themselves? That's uncertain, so they better not give us trouble," he adds.

As of 2.55pm today, the two video clips had garnered 244 and 666 views respectively. More than two-thirds of the viewers gave both the YouTube video clips their 'thumbs down' and since then, comments on the videos have been disabled.

However, almost all commentators on Facebook spoke in favour of the police message, with just few dissenters.

PKR has declared it will bring 100,000 supporters outside the court complex on Monday, when the verdict on Anwar's Sodomoy II case is scheduled to be delivered.

Why, RPK? — Masterwordsmith

JAN 4 — Many Malaysians have expressed outrage at fugitive blogger Raja Petra Kamarudin's critical remarks against DSAI in recent interviews with Umno dailies Utusan Malaysia and New Straits Times. News portals and blogs are filled with comments of readers who have taken umbrage at this development at a most inopportune time, just before the next GE.

There are a few unanswered questions which he should answer.

1. If at all he intended to make those statements, why did he speak to those dailies that represent the backbone of support of the other side? Why did he not approach online news portals? He has to explain why he chose to speak to the MSM whose reach are pro-status quo instead of the online news portals whose readers are more 'enlightened' and are able to make valid judgements of their own to assess the truth and validity of his statements.

2. With the rumoured GE expected to happen as early as this month, why did he choose to slam DSAI who in all matters regardless of his weaknesses, is still the head of Pakatan Rakyat (PR)? Clearly, the damaging statements have undermined the effort of PR and many other activists. For one who helped PR so much, why did he put PR in bad light? Granted they have many weaknesses, especially of late, but surely there is another channel of communication to sort matters in a less damaging and more constructive manner!

3. DSAI is already under siege and in deep sh**. As a once-upon-a-time respected opinion leader, why did RPK, as one keeps saying ABU ABU, kick Anwar down knowing full well he would smash him utterly and completely for all and sundry to see? Hitting anyone below the belt is certainly not on!

4. Homophobic statements are also NOT on! The verdict has not been given and it is really unfair for him to make statements such as "I don't care. If you say is Anwar gay? I say maybe. But you cannot become prime minister. That is the reality," said Raja Petra in an interview published today the Malay-language Mingguan Malaysia extracted from THIS LINK. 5. According to FMT, "Reform activist and influential blogger Raja Petra Kamarudin believes that Anwar Ibrahim was a victim of a honey-trap, but quickly added that the opposition leader was given a fair trial. (AT THIS LINK). If that is so, RPK should stop calling himself Fugitive Blogger and come home and get his share of a "fair trial" courtesy of Bolehland.

6. Raja Petra had alleged, in an interview with Umno daily Utusan Malaysia, that several Chinese businessmen in Selangor had complained to him that they still had to fork out "under-the-table" money in order to conduct business in the state, and that corruption was still rampant there. Yesterday, The Malaysian Insider reported HERE that the Selangor government demanded that blogger Raja Petra Kamarudin provide evidence to back up his claims of corruption within the state government. To date, he has not responded. Why?

Many supporters are in a daze over this turnaround. Many were going concertedly in ABU ABU fashion and all of a sudden, it is WHAM! BAM! SLAM! and those who supported him morally, financially and other ways are reeling in shock which is worse than the reaction to the TV3 interview for obvious reasons.

Then, many defended him and strongly supported him because they felt he was unfairly derided at that time. However, this time round the perception is completely different. In the past, he had always said 'Perception is everything'. So, it is clear that he did what he did at his own peril!

Haris Ibrahim has resigned as MCLM President while Malik Imtiaz and Sreekant Pillai have disassociated themselves from MCLM because of his statements. Where will MCLM go from here?

As a very intelligent man, did he not consider all these consequences before he met with those reporters from MSM?

RPK with his charisma and clout had garnered a lot of supporters and fans who had supported him through so many trials in his life. Undeniably, RPK was a huge factor in helping Pakatan gain five state governments in the last GE. Did he think his charisma and dwindling fan base could carry him through this storm?

The comments in cyberspace say otherwise.

Some have accused him of being a turncoat or that he has been bought. Others claim he was driven by his ego while some believe he has been listening to the wrong person/s.

Whatever the case, the time has come for him to explain why he did what he did. He certainly has left his supporters in a lurch.

Surely his supporters and faithful friends such as Haris deserve something more than this. After all, RPK is the one who had been steering his followers in the direction of ABU. What he has done is akin to pulling the carpet from under all his supporters and even Pakatan Rakyat which is easily a large percentage of the Malaysian population.

RPK — you may have your grouses with PR and its leaders. So do many. However, we do not need a Brutus in our midst!

If anything at all, this development should gall all of us to stand together and support Pakatan Rakyat.

Do not, I repeat — do not — become a fence-sitter. Many have expressed that they are so fed up that they will not vote. Perish the thought! Your vote counts!!!

Assuming RPK could be a Trojan Horse, I am sure this would move even MORE to support Pakatan Rakyat.

Vote wisely lest we end up on the road to perdition! Not only will it affect us, but also our children and grandchildren.

Is this your way to commit hara-kiri to be the fall guy to wake us up? I don't think any one would do such a silly thing as to ram to the ground everything that has been built in the last few decades.

RPK, your recent interview warrants an explanation to your supporters in MCLM, the ABU, BERSIH and those who stand for a corrupt-free government and to Malaysians who once-upon-a-time looked up to you.

Is there more to what you have said?

I have resigned as MCLM president

From the very first post in this blog to this day, my political viewpoint has been the same.

If we are to transform this into a nation of a single, united people, and to finally start to see a just distribution of the nation's wealth, to offer equal educational and economic opportunities to all our children, and, most importantly, to restore vital institutions of state back to their role as servants of the people, UMNO and BN had to be removed from Putrajaya.

My faith, though, in seeing this realised, has been with an awakening people working with the non-BN political parties who are truly pro-rakyat.

This, too, remains unchanged.

On 30th October, 2010, whilst attending to guests at an SABM dinner, lecture, I received an sms from RPK informing that that very night, in London, at the inaugural meeting of the Malaysian Civil Liberties Movement, I had been unanimously elected as president.

3 weeks later, I was in Manchester where, after much deliberation with RPK, I agreed to accept the position subject to our agreement on several issues.

I will only mention two here that I believe relevant to the difficult decision I have made today.

First, matters of policy and direction of MCLM were to be determined and made after mutual consultation and consensus between us.

Second, RPK would oversee the administrative affairs of MCLM, in his capacity as chairman, as well as look into all overseas matters. whilst I would drive our operations here at home.

In December, 2010, in London, RPK announced the launch of our Barisan Rakyat Independent Candidate Initiative.

In July, last year, MCLM announced the deployment of our first candidate, Dr Neduchelian, in the Kapar consitutuency.

In December, last year, after conferring with RPK, MCLM joined several other groups in issuing a warning to Najib that should he call snap elections without first carrying through the electoral reforms demanded by BERSIH 2.0, he should brace himself for street rallies that might culminate in his government being toppled. I wish to reiterate here that this was no idle threat.

Again, after conferring with RPK, MCLM had, last month, firmly aligned itself with the many NGOs and several political parties that hve given life to the Asalkan Bukan Umno / Anything But Umno (ABU) initiative.

Yesterday, the New Straits Times published an interview with RPK that was conducted in Singapore last week.

I had been informed by RPK whilst I was with him in Phuket over the Christmas holiday that this interview was to take place. I was not, however, fully appraised of all that was to be said in the course of the interview.

The matters spoken of by RPK have been quite wide-ranging.

I only propose to allude here to the two parts that have led me to the decision I have made today.

Under the heading "Rights group not a third force – RPK" that appeared in the NST and is reproduced in full on Malaysia Today, RPK is reported to have said that "MCLM had decided it would not field any candidates for the coming general  election".

I can confirm now that no such decision has been made after due consultation.

And under the heading "RPK – Anwar may become irrelevant", also reproduced in full on Malaysia Today, RPK is reported to have said that "the Egypt-style people's revolution was not an answer for Malaysia due to the delicate racial balance. "They (Chinese voters) don't want Tahrir Square type of change"."

These comments just referred to greatly undermine efforts I am making, albeit through MLCM, in the ABU initiative.

It also saddens me that even as initiatives like SABM and so many others continue daily to undo the ill-effects of UMNO /BN's 40 over years of race-based, divide-and-rule, my friend should continue to see us as Malays, Chinese, Indians, dll.

I remain committed to all efforts to see this a nation of a single people, all equal.

And I am fully committed to the cause of ABU.

In the circumstances, I find it impossible to continue to serve MCLM as its president.

I have communicated my resignation to RPK by email.

I want to take this opportunity to thank the many who have come forward and volunteered their time and energy towards the cause of MCLM. We could not have made it this far without you.

I want to apologise to the funders in UK for this sudden decision of mine and pray that they will understand that my commitment to see change in our country, whether through elections or on the streets, remains unwavering.

To my friends in Sabah and Sarawak, my commitment to your pursuit of the promises of the 1963 agreement and to rid yourselves of the curse that UMNO and BN have become, remain on course.

I am fully committed to the reforms that we have, up to now, been pressing to see introduced by  a new pro-rakyat government in Putrajaya.

God willing, we will, together, plant love, tenderness and respect in this land of ours.

Plagiarism: Judge admits guilt, says Karpal

PETALING JAYA: Appeals Court Judge Abdul Malik Ishak has admitted that he has been guilty of plagiarism, according to DAP chairman Karpal Singh.

"I am taking the refusal by Abdul Malik to sue me for defamation as public admission of plagiarism," he said in a press statement today.

He reiterated his call for Abdul Malik's resignation.

Last week, Karpal asked the judge to respond to allegations that he had plagiarised a judgment made by Singapore High Court judge GP Selvam in 2000. He also challenged Malik to sue him if the allegations were false.

There has been no response from Abdul Malik

"Abdul Malik's position as a judge of the Court of Appeal has become untenable," Karpal said in today's statement. "He knows the truth. He should step down."

Abdul Malik was born in Johor and received his law degree from the University of Singapore. He became a judicial commissioner in October 1992 and was elevated to the position of Judge of the High Court of Malaya in Aug 1994. He was appointed to the Court of Appeal in July 2007.

Karpal first made the allegation of plagiarism in Parliament last October, but the Speaker turned his motion to debate the issue. Subsequently he wrote several letters to Abdul Malik asking him to clarify the issue. Copies of those letters were sent to Chief Justice Arifin Zakaria.

Last month, the Chief Justice responded to the allegation by saying that it had no merit.

Pakatan will grow stronger if I am jailed...

NONEMalaysia's opposition leader believes his party could be strengthened if a court rules against him in a sodomy trial on Monday, with an economic showdown already threatening to damage the ruling coalition with polls expected this year.

Malaysia is bracing for possible unrest after the two-year trial ends, with supporters of opposition leader Anwar Ibrahim hoping to draw 100,000 to a rally outside the courthouse where the verdict in the trial is due to be read on Monday.

The trial has polarised opinion in conservative, majority Muslim Malaysia. The High Court decision could deepen political divisions further as Prime Minister Najib Razak, branded a hardliner by the opposition, weighs whether to call elections this year.

Police have warned people not to gather outside the court. Mass protests could cast doubt on Malaysia's political stability and spook investors, who are vital to achieving Malaysia's target of attracting $ 444 billion of investment by 2020.

Anwar, a former finance minister, told Reuters in an interview that Najib's ruling coalition "has to decide, Anwar in prison, is it better for them or not?"

"I'm not sure whether it's better for them. We've done a lot to explain to the masses. (The opposition) may emerge slightly stronger," said.

Once the rising star of Malaysian politics and a former deputy premier, Anwar's political fortunes have since been marked by long-running legal battles over charges of sodomy - sex between males is illegal in Malaysia - after he was sacked by former Malaysian premier Mahathir Mohamad in 1998.

Anwar, 64, is charged with sodomising a 26-year-old male former aide and faces up to 20 years in prison if found guilty. It is the second time he has faced what he says are politically motivated charges aimed at wrecking his political career and ending his challenge to the government.

In 1998, at the height of the Asian financial crisis, Anwar, then deputy prime minister and heir apparent to Mahathir, was accused of sodomy and corruption, sacked, tried and eventually sentenced to a total of 14 years in jail.

The cases have been marked by lurid details, including a semen-stained mattress produced in evidence, that have mesmerised Malaysians. A conviction that exposes weaknesses in Malaysia's judiciary to wider scrutiny could once again put the Southeast Asian nation under the international spotlight.

Fair elections?


Although elections are not due until 2013, there is widespread expectation Najib will call a snap poll this year. Anwar said he expected elections "sooner rather than later", adding that his Pakatan party should be able to secure a simple
majority in parliament.

"Our concern is how do we ensure fair elections?" he said.

"This is a major problem for the opposition because, although there have been some announcements and some easing, but not (in) media control, not the judicial process, not in terms of any excesses, abuse and corruption and the electoral process," he said.


Anwar said support for the opposition among native Malays increased substantially after his 1998 conviction. He was freed in 2004 after the sodomy conviction was overturned.

"But in 1998, we failed to garner enough support of the Chinese and Indians," he said, referring to two other major Malaysian ethnic groups.

"Society will say: 'Okay, you may disagree with Anwar but you don't need to beat him up or continue to put him in prison.'
This is my third, fourth time, they know it's political," Anwar said of the electorate.

Najib, who took office in with a strong majority after elections in 2009, has seen his approval ratings fall in the past year, in part because of a widening religious divide that has alienated minority non-Muslims.

Stubbornly high inflation and the slow pace of promised political reforms have also been sources of frustration.

"There is greater awareness of the abuse of power, of endemic corruption," Anwar said when asked what had changed public sentiment since 2009.

A weaker economy could also work in the opposition's favour. Malaysia's eco! nomy gre w at a stronger-than-expected 5.8 percent in the third quarter, but a slowdown in global trade will likely crimp growth in the coming quarters.

Malaysia is also vulnerable to sudden capital flight. Foreign ownership of stocks and bonds is larger than the country's foreign exchange reserves. Portfolio outflows jumped to RM23.4 billion in the third quarter, a sharp reversal from the second quarter's 48.1 billion in inflows.

Oh Lord, how soon we forget!

Up to the time of writing this, my post yesterday announcing my resignation drew 147  comments.

If it were not for the fact that I am loathe to censor comments save for the use of colourful or racist language, I would have deleted most of the comments as it was so painful to read how one man who, in my estimation, has done so much for so many of us at great cost to himself and his family, is today alluded to with so much hate and venom.

Unlike most of you, I have had the honour of living at RPK and Marina's home in Manchester.

If I stretched my arms out as I walked through the corridor, I would damage the knuckles on both clenched fists.

It pales in comparison to their bungalow or semi-d in Sungai Buloh.

I spent a week with them in Manchester.

I observed a simple, frugal lifestyle.

Winter was about to kick in then. And I was already missing my sunny homeland. What about them?

Many of you appear to be of the view that RPK has betrayed us, and has sold out.

I think you premise this on his interview with TV3 last March and his latest interview with NST and Utusan.

I do not share this view.

Mine is premised on the man and Marina that I believe I have come to know.

We cannot both be right.

Let us all hope and pray that the error is yours and not mine.

You have my word, though, that should I discover the error to be mine, I will not hesitate to disclose all that I know to you.

Meanwhile, this divergence of view aside, we are all committed to see the end of UMNO and BN's reign of tyranny and rape and plunder.

Let not this difference of opinion distract us from the work before us.

In my last post I had said that by God's will, we will, together, plant love, tenderness and respect in this land of ours.

To those of you who believe that this man who once served us all so selflessly has, for whatever reason, left us, I urge you to let the process of planting love, tenderness and respect begin now.

If you truly believe this, rather than hate, pray that God returns RPK to our course.

Whilst I do not advocate this, if you must hate, save it for all that UMNO and BN do.

For me, I will pray that I will never ever have to say sorry to you for being wrong. You might want to add this in your prayers, too.

Post-CNY elections unlikely

KOTA KINABALU: A much speculated post Chinese New Year general election is unlikely to happen, going by the Sabah Election Commission's readiness.

The Sabah EC said it will only be ready to tackle the 13th general election in "two to three months time". This pushes the likelihood of polls to April-May at the earliest.

State director Md Idrus Ismail said the state EC was currently in the process of updating its new voters list.

"We are now in the process of updating the names of the voters. The new list will be ready for public objection by the end of this month.

"We've also completed most of the essential briefings for the EC personnel.

"This final series of briefings will be conducted in stages. We will be carrying out the briefing from zone to zone starting end of February. We should complete this by March.

"We're not expecting any problems in terms of preparation for the elections. We are ready," Idrus said.

He however declined to speculate on when Prime Minister Najib Tun Razak will call for polls.

Just about ready

Idrus said that apart from EC's own personnel, officers from the armed forces and the police would also be appointed to manage the postal voting centres, both in and outside the state.

He said these personnel who would be stationed outside their voting areas would cast their votes before the actual polling day.

"We have received all the voting forms and equipment from headquarters and everything should be in place and all preparations fully completed in two to three months time," Idrus said.

Idrus however said it was still too early to speculate when the election would be held, saying the government could call for the election earlier or later than expected.

On the number of voters, Idrus said that Sabah had 906,000 registered voters as of November last year.

This, he said included police and military personnel and those who were abroad.

"Kinabatangan and Pensiangan constituencies are the largest voting constituencies in Sabah but both only have between 20,000 to 22,000 voters, " he said.

Meanwhile opposition held Kota Kinabalu ad Tawau constituencies had 40,000 registered voters each.

Kota Kinabalu MP is Hiew King Cheu from DAP and Tawau MP is Chua Soon Bui from Sabah Progressive People's Party.

‘Fed govt persecuting us by not extending NS contract’

PETALING JAYA: Yayasan Selangor said today that it did not use taxpayers' money to renovate a National Service camp.

Yayasan Selangor's general manager Ilham Marzuki said that the foundation used money from its own coffers to renovate the Ampang Pecah National Service (NS) camp.

He said this renovation was done to meet National Training Service Department (NTSD) Schedule of Compliance issued in 2008.

"We generate our own source of revenue through office rentals, oil palm plantations and other joint venture businesses. We earn our keep through hard work," he said in a statement.

"And we strived to meet NTSD's requirements and completed renovation works at the camp by December last year. Naturally, the contract should have been extended," said Ilham.

Yesterday, the Selangor state run foundation came under fire from Selangor MCA liaison secretary Wong Koon Mun for carrying out renovation works worth RM4.04 million on the Ampang Pecah NS camp only to find out later that its contract was not renewed by NSTD.

Wong, who is also Kuala Kubu Baru assemblyman, accused Yayasan Selangor of mismanaging taxpayers' money and urged the Malaysian Anti-Corruption Commission (MACC) to investigate the matter.

Calling Wong's outcry as superficial, Ilham claimed that Yayasan Selangor was being "persecuted" by the federal government by not giving the foundation a contract extension.

"However, we have made an appeal to Prime Minister Najib Tun Razak and Defence Minister Ahmad Zahid Hamidi. Our appeal is also supported by Hulu Selangor MP P Kamalanathan.

"But if the federal government ignores our appeal, Yayasan Selangor will do all it can to meet the income shortfall," said Ilham.

When contacted, Ilham said he has yet to receive any feedback from his appeal to date.

"No point sulking about it. If they don't want to renew our contract, we will just move on to do other things," said Ilham.

Majlis Peguam menyokong kempen demonstrasi jalanan Bebas Anwar 901 yang dirancang 9 Januari ini kerana beranggapan perbicaraan terhadap Ketua Pembangkang, Datuk Seri Anwar Ibrahim bermotifkan politik.

Presidennya, Lim Chee Wee mendakwa, tertuduh (Anwar) tidak diberi perbicaraan adil apabila dilarang melihat dokumen dan maklumat untuk mempertahankan diri.

Malah, katanya, Perlem­bagaan Persekutuan juga tidak menjelaskan sekatan ke atas bantahan terhadap keputusan yang dibuat mahkamah.

"Sama seperti demonstrasi yang pernah beberapa kali berlangsung di Parlimen. Ia tidak boleh disekat walaupun kerajaan mempunyai pelbagai alasan seperti menjaga keselamatan awam.

"Justeru, kami mengambil pendirian ia (bantahan terhadap keputusan mahkamah) tidak salah dan bukan perkara yang luar biasa. Buktinya dapat dilihat pada 8 Januari 2010 yang lalu, orang Islam dibenarkan berkumpul di pekarangan masjid di seluruh negara membantah penggunaan perkataan ALLAH diguna pakai agama lain," katanya.

Beliau mempersoalkan tindakan kerajaan kerana tidak menghentikan bantahan itu walaupun mahkamah telah membuat keputusan pada 7 Januari 2010.

Chee Wee berkata, di Kazakhstan sepanjang empat tahun turut menyaksikan penunjuk perasaan berkumpul setiap Rabu memprotes terhadap sabitan seorang aktivis hak asasi manusia yang menjalani hukuman kerana membunuh.

"Saya juga ! tidak se tuju dengan kenyataan sesetengah pihak yang menganggap bantahan terhadap mahkamah seperti menghina badan itu. Dalam kata lain, mahkamah juga tidak melarang sesiapa yang tidak berpuas hati menyatakan pendapatnya.

"Kami pernah mengadakan perkara sama dalam beberapa keputusan mahkamah, antaranya menyokong peguam Zainur Zakaria dan membantah tindakan mahkamah mengenakan hukuman penjara tiga bulan kerana menghina mahkamah dalam kes liwat Anwar," katanya.


ULASAN

Malaysiaku sememangnya sangat aneh. Rasionaliti tidak menjadi keutamaan kepada rakyatnya.  Laku perbuatan lebih terarah kepada emosi yang tidak terkawal.  Dalam situasi sedemikian, sudah pastilah golongan yang emosional tidak sebulu dengan pengamal undang-undang yang berhujah atas fakta yang sudah pun tersurat.  Hal ini mendorong banyak pihak tertanya-tanya mengapa perkara sebegini perlu dilakukan?  Perkara yang boleh perlu kata boleh.  Janganlah berusaha sedaya upaya untuk menutupi kebenaran.  Tiada gunanya kerana Tuhanlah Yang Maha Berkuasa!!!

The email that blew the whistle on NFC

PETALING JAYA: PKR revealed today what it says is the "source document" that put it on the trail of questionable transactions by the National Feedlot Corporation (NFC).

The party's strategic director, Rafizi Ramli, from whom Federal Commercial Crime Police will record a statement this afternoon, said he would surrender the document and all other evidence to the investigators.

"Since the NFC scandal broke out, the focus of investigations has been to verify the authenticity of the documents that PKR used in exposing misappropriation of funds," he said. "Many have made the accusation that these documents are false. It was as if the investigations would turn against those feeding us the information."

The document, which Rafizi showed to reporters, appears to be a printout from an internal accounting system. It gives the NFC's 2009 expenditures in detail.

Rafizi said an anonymous whistleblower sent the document to him by e-mail and had made no further communication with him. "I don't think we'll ever find out who this person is, but I think he is the Malaysian of the year," he said.

"I believe the public will no longer doubt the authenticity of our information because these are detailed transaction information downloaded from the NFC's own accounting system."

Rafizi once worked as an accountant and auditor.

He said PKR's exposes were based mostly on the document, with additional information gathered through its own investigations.

"I spent nights going through the document line by line. It is all here—the condominiums and all. So if PKR can come up with so much with just this single document, I'm sure the police and MACC (Malaysian Anti-Corruption Commission) would not have any problems finding proof to quickly charge those involved.

"We followed the cash trial. We dug deeper and deeper. Now we have decided to open it for all. Everyone out there can go and dig for more. I am already very tired."

Flawed business model

He urged the authorities to speed up their investigations into the highest reaches of government.

"It is obvious that there is an element of omission and negligence at the highest level," he said. "Deputy Prime Minister Muhyiddin Yassin, who was then the Agriculture and Agro-based Industry Minister, approved the feedlot project without taking into account factors that have led to its failure.

"Muhyiddin approved this without thinking. The business model itself is flawed. You import cattle from Australia although you have a vibrant and successful one in Thailand. The onus and responsibility was on Muhyiddin to make sure that it was a good business model. If he had done so, we would not have such jokes such as cows dying in ships and from eating the wrong grass."

Rafizi said Prime Minister Najib Tun Razak was also responsible in valuing the bids from various companies and awarding the tender for the project. "Of all the companies, they chose to award this to the family of a minister, a family with no experience. This can't be right."

PKR Wanita chief Zuraida Kamaruddin said her group made 13 police reports on Nov 3 and was "more than ready" to provide statements to investigators.

"We have done our work, revealed the tip of an iceberg," she said. "Now we must leave it to others to follow up."

NFC is run by Dr Mohamad Salleh Ismail, the husband of Women, Family and Community Development Minister Shahrizat Abdul Jalil. It came under attack from the opposition parties , particularly PKR, after the release of the Auditor-General's 2010 report, which said the corporation was "in a mess".

PKR accuses Shahrizat's family of misappropriating the RM250 million of public funds meant for NFC in the purchase of a luxury car and luxury condominiums in Bangsar and Singapore. It also claims that the beef produced by NFC was channelled to luxury restaurants owned by Shahrizat's family.

Shahrizat, who heads Wanita Umno, has denied that she was involved in any wrongdoing. However, she faces growing calls to quit as minister, not only from the opposition parties, but from within Barisan Nasional and Umno as well.

Two weeks ago, MACC officers went to the NFC office in Mont Kiara and seized documents and a CPU.

A day before that, police arrested a 45-year-old businessman for allegedly attempting to bribe senior officers who were investigating the NFC scandal.

Last week, Shamsubahrin Ismail, a 45-year-old businessman, claimed trial to the charge of cheating Mohamad Salleh of more than RM1.7 million after promising to provide the NFC chairman with "negotiation and consultation services".

‘Penang sabotaging federal housing aid’

GEORGE TOWN: The nine Kampung Buah Pala residents, who were left in lurch after their houses were demolished in September 2009, have accused the Penang state government of sabotaging the federal government's effort to provide them with double-storey homes on the mainland.

The registered village residents association chairman M Sugumaran alleged that certain state government leaders were behind the misinformation disseminated in an article published by The Star on Jan 2.

The article claimed that the Kampung Buah Pala village was demolished by Syarikat Perumahan Negara (SPN) Bhd.

"How could The Star misinform the public? It's a lie. The whole world knows that Chief Minister Lim Guan Eng's administration was responsible for demolition of the Indian heritage village," said Sugumaran.

Sugumaran has lodged a police report against the article at the Bayan Baru police station today.

He believes there are mischievous hands at work who are sabotaging the federal government's efforts.

"Definitely there are elements of sabotage involved.

"Certain state government leaders know they can no longer lie to ethnic Indian community.

"So they are resorting to dirty tactics to sabotage the federal housing aid to us," Sugumaran told a press conference here this afternoon.

Najib gave us houses

Also present were eight other house owners who were all denied compensation by Lim's administration despite compensating 24 others with double storey homes on the former village site.

Sugumaran claims the Pakatan leaders were envious and unhappy with Prime Minister Najib Abdul Razak's sincere and honest efforts to provide them houses that were denied by Lim's vindictive misrule.

He accused Lim's government of being responsible for demolishing homes of the nine temporary occupation licence (Tol) holders and denying them their rightful compensation.

"Pakatan leaders made empty promises to us," he alleged.

"The state government demolished our houses but did not offer us new homes.

"The question of rejecting compensation never arose because we were never offered compensation anyway.

"Would anyone with a sensible mind reject compensation offers after their houses have been brutally demolished?

"The state government is lying," chided Sugumaran.

He claimed that thus far their numerous attempts to seek compensation have been futile and that the relevant state leaders have turned deaf to their pleas.

The heartache of the nine residents are now partially relieved as they have accepted offers of double-storey houses worth RM220,000 each by SPN in Taman Sejahtera Indah, Teluk Air Tawar.

It's learnt that they will be signing the sales and purchase agreement with SPN soon.

MIC did nothing

He hailed Najib for being caring and sympathetic towards their plight by taking up the responsibility to provide them homes on humanitarian grounds, not as compensation.

"He is the real people's Prime Minister," he exclaimed.

He also praised Bayan Baru MP Zahrain Md Hashim, Penang Indian Development Organisation (PIDO) chairman M Nganasegaran and Najib's special assistant in charge of Indian affairs P Ravin for assisting the nine villagers to secure the houses.

In his police report, Sugumaran also accused Bukit Gelugor MIC branch chairman I Muthusamy of falsely claiming credit for the allocation of houses for the nine.

In The Star article, Muthusamy claimed that he had pushed hard for double-storey houses for the nine families for past two years when all the hard work was done by Zahrain and Ngnanasegaran.

"Obviously Muthusamy is lying," said Sugumaran.

Despite accepting their new homes, he said the nine families would continue with their court battle to secure their rightful compensation from the state government.

He said the nine have documents to prove that the demolished Kampung Buah Pala land belonged to the villagers vis-a-vis the federal government, not the state.

However, he declined to reveal much on the evidence as the matter was pending in court.

"Wait till we reveal it in court," warned Sugumaran.

Kampung Buah Pala, which was known commonly as Tamil High Chaparral due to population of ethnic Indians, cattle and other live stocks, was demolished to pave way for a posh condominium project, the Oasis, by Nusmetro Venture (Pg) Sdn Bhd.

The project is now almost completed.

Noh Omar dinasihat tumpu pada tugas

SHAH ALAM: Ketua Penerangan PKR Selangor Shuhaimi Shafie menasihati Datuk Seri Noh Omar agar menumpukan tugas sebagai menteri dan jawatannya dalam parti daripada terus mengkritik pentadbiran kerajaan negeri Selangor.

Shuhaimi mendakwa wujud seorang tokoh korporat berusia 40-an yang rapat dengan Perdana Menteri Datuk Seri Najib Razak yang diuar -uarkan menjadi orang nombor dua selepas Najib untuk menerajui Barisan Nasional (BN) Selangor.

Noh merupakan Menteri Pertanian dan Industri Asas Tani dan juga Timbalan Pengerusi Barisan Nasional (BN) Selangor.

"Noh Omar perlu teliti perkara mengenai salah laku di kementerian beliau. Dengan masalah baja, padinya…itu patut diberi tumpuan.

"Beliau (Noh Omar) yang sebelum ini dikatakan bakal Menteri Besar Selangor perlu tumpu kerja beliau sebagai Ketua Perhubungan BN

Selangor memandangkan wujud ura-ura seorang tokoh korporat yang rapat dengan Najib bakal menggantikan beliau," dakwa Shuhaimi.

Noh dalam ucapannya ketika Karnival Sayangi Selangor baru-baru ini mengkritik negeri itu sebagai kotor.

Beliau yang juga ahli dewan undangan negeri Seri Muda berkata Selangor menjadi kotor selepas keputusan kerajaan negeri menamatkan kontrak pengurusan sisa pepejal dan pembersihan awam daripada Alam Flora Sdn Bhd dan melantik kontraktor-kontraktornya sendiri.

Shuhaimi walau bagaimanapun menafikan tuduhan Noh sambil menyifatkan rakyat Selangor tahu pengambil alihan proses sampah daripada Alam Flora.

"Tuduhan Noh berunsur sabotaj sebab mereka dapat kontrak pembersihan di kalangan orang Umno. Kenyataan beliau (Noh) menggambarkan kerajaan negeri tidak cekap dalam urusan tersebut.

"Apa yang diucapkan selama ini melibatkan sebahagian kecil kontraktor. Tindakan segelintir kontraktor ini dikesan menghentikan kerja- kerja mengutip sampah di beberapa kawasan. Unsur sabotaj ini dirancang Umno Selangor untuk pastikan aduan itu adalah benar," dakwa beliau.

Sodomy verdict tests Malaysia's political landscape...

NONEWhen the Kuala Lumpur High Court delivers a verdict in the sex trial of opposition leader Anwar Ibrahim Monday, the ruling would mark an end to one of the nation's most controversial cases as well as the beginning of a new political era.

Anwar, 64, faces 20 years in prison if found guilty of sodomizing a 24-year-old former male aide in 2008, a charge he has vehemently denied and claimed was concocted by political foes.

Throughout the trial, which began in February 2010, his lawyers decried what they claimed to be repeated efforts to hamper the defence, such as denying access to testimonies and evidence.

Although the opposition alliance has its fair share of infighting and problems, Prime Minister Najib Abdul Razak is well aware of the threat that Anwar represents.

Many educated, urban voters are increasingly impatient with his government over corruption and soaring inflation.

In the most recent elections in 2008, Anwar's alliance wrested control of five of the nation's 13 states from the government and denied it a two-thirds majority in Parliament.

pak lah arriving at umno 2009 agm 260309 03The upset forced then-premier Abdullah Ahmad Badawi to step down in favour of Najib, and Anwar declared his intention to take over the government, a threat Najib has taken seriously.

The premier has publicly warned his alliance to im! prove it s performance or risk losing power in the next elections, which could be called as early as the first half of this year.

If Anwar is found not guilty, he is likely to pose a real threat to Najib, whose popularity is flagging despite populist policies and attempts to endear himself to younger voters.

But if Anwar is convicted and sentenced to even one year in jail, he would be barred from politics for up to five years, weakening the opposition bloc that has yet to name a successor.

Government not 'sincere'

Rights groups and opposition activists said the government seems intent on removing Anwar as a political foe by using a colonial-era law against sodomy, which outlaws it even when it is consensual.

Phil Robertson, deputy Asia director of Human Rights Watch, charged the proceedings have been conducted unfairly since the outset.

He said the government did not appear "sincere" in its earlier pledge to offer Anwar and his accuser equal rights and treatment.

"Obviously, we cannot really speculate on what the verdict will be, but we do have very serious concerns that he is even being tried on this charge, which should not be considered a crime in the first place," Robertson said.

NONEIn 1998, Anwar was accused of sodomizing his driver and then using his power as then-deputy premier to cover it up, a charge he also claimed was trumped up to prevent him from challenging former premier Mahathir Mohamad.

He was convicted and jailed for six years before being released in 2004 when a Federal Court panel overturned his conviction, saying the main witness against him was unreliable and Anwar should have been acquitted.

Then, as now, the government denied any conspiracy.

"The fact that he has been tried for this 'crime' twice now when thankfully there are very few prosecutions under this antiquated British colonial law also raises the fundamental question of why the government is singling Anwar out," Robertson said.

But just as he defied the odds to rise from political ruin to become opposition leader, Anwar's supporters said it would take more than a conviction next week to remove him or his followers from Malaysian politics.

LB’s 2011 Wishlist, Revisited

You gotta rewind to free your mind.

On 4 January 2011, the most awesome collective known as LoyarBurokkers came up with their wishlist for 2011. It really is worth a re-read.

Anyway, now that 2011 has come and gone, let's take a look back at what happened to the items on that wishlist. Did Lord Bobo grant any of those crazy, idealistic wishes?

1. Repeal of the ISA, UUCA/AUKU and other preventive legislation

Although the Prime Minister has said that the ISA will be repealed, and the Court of Appeal by a majority held that a part of Section 15 of the UUCA was unconstitutional, we aren't holding our breath. The very fact that the Government is appealing the UUCA decision demonstrates that they have no interest in truly developing Malaysian youth to be politically-conscious and aware of their social and political rights. This, from a government dominated by UMNO despite the fact that UMNO encourages and facilitates the setting-up of Kelab UMNO by overseas students in foreign universities.

The repeal of Section 27 of the Police Act and its replacement by the Peaceful Assembly Act 2011 was an eye opener and classic Bait and Switch (as Human Rights Watch described it). And now the mysterious "Race Relations Bill" looms large.

LB did not, unfortunately, conduct any interviews at all with former ISA detainees. Oh well. Even minions of His Supreme Eminenceness have day jobs.

2. A more mature Malaysia

There is a growing maturity and sophistication in how Malaysians are appreciating national and political issues. There is a greater impetus now to examine the issues on the merits instead of simply taking the Pakatan Rakyat or Barisan Nasional camp. We sense a growing courage and realisation that Barisan Nasional are not all powerful and pervasive; there are cracks showing without that is a result from the decay within.

This courage is symbolised most recently by the student leader Adam Adli lowering the flag bearing Najib's image. That is a very, very powerful symbolic statement that will reverberate throughout the country the more learn of it. It is also symbolic from a racial perspective because here you have a Malay educated youth removing the visage of a corrupt, incumbent representation of UMNO. It suggests that the Malays are starting to slowly unshackle themselves from the feudalistic tendencies that have so pervaded and corrupted not just Malaysia but Malay culture itself. So much can be written on that single act.

And yes, we know that what Adam Adli did is debatable. So debate it. Discuss it. Maturely. There are three sides to a coin (really).

The nation is changing. A revolution is coming.

Lord Bobo was everywhere in 2011. Including Siberia.

3. Implementation of principles of the United Nations Declaration of the Rights of Indigenous Peoples (UNDRIP)

Minimal progress via government commission SUHAKAM, which through the leadership of Jannie Lasimbang launched the native land rights inquiry in 2011, covering West Malaysia, Sabah and Sarawak. Forums were held throughout the country to receive land rights complaints / abuses by indigenous communities. The inquiry ended late 2011, and a compiled report based on submissions received by indigenous communities and NGOs will be submitted to the government in 2012.

While it is very commendable that SUHAKAM has undertaken this very important task, it remains to be seen whether the government of the day would take all these complaints seriously and implement the suggestions made by SUHAKAM.

It is still a very top-down approach by the government. In 2011, the Federal Government embarked on transformation policies encompassing government, politics, economy, and rural areas. The Economic Transformation Programme (ETP) aims to fast-track development in Malaysia to create a high-income economy by 2020. ETP focus areas particularly in East Malaysia include palm oil, agriculture, tourism and oil, gas and economy and will involve lands currently occupied and/or claimed as ancestral lands by indigenous peoples. The soon-to-be-affected communities have not been adequately consulted in a free and fair process. The plans are large-scale and will have a negative impact on rural indigenous communities, further eroding their culture and rights to land.

The Federal and State governments, particularly in Sabah and Sarawak, are pushing for large-scale development projects that are not in the interest of indigenous communities, even though these projects carry the name of poverty eradication. Indigenous communities are also marginalised by their own elected representatives, some of whom are from indigenous communities themselves, and do not speak up for the interests of indigenous communities, but rather in favour of their own political party and/or large companies.

4. Recognition of customary land rights of indigenous peoples

There is a lack of (or no) engagement by those who claim rights over land in processes that affect land and resources. Many indigenous communities are not aware of development planning, mainly for cash crop agriculture, until it is too late. The government's top-down approach in deciding how land is used, mainly for large-scale oil palm estates, does not factor meaningful consultation with the communities living on the land, nor factor their needs and requirements.

This year, indigenous communities in Sabah submitted a memorandum to the State Government in protest of the communal land title that was created in 2009, purportedly to answer the call by indigenous communities looking for legal recognition of native customary land. However the spirit of the communal land title is lost, for "participants" are legally required to plant oil palm and/or rubber on the land, and only a very small portion of land is meant for planting of food crops. This lack of complete ownership of the land has led to a loss of traditional way of life for many indigenous communities holding communal titles.

5. More public interest litigation

The LB Public Interest Litigation team takes some credit for the ending of the Emergency. Shortly after we filed a crucial test case asking for a mandamus order compelling the Cabinet to advise the Agong to end the Emergency, the Prime Minister moves his resolutions in Parliament to end the State of Emergency that has plagued our country for more than 40 years. Obviously this was the result of Lord Bobo's whispers into the Prime Minister's ear. Or it's to win over public sentiment ahead of the General Elections. Take your pick.

Other test litigation include a ground breaking challenge to champion the rights of transgendered persons, and a test case to declare the law on sedition unconstitutional. LoyarBurokkers are also involved in inter-religious cases (Indira Ghandi / Zaina Abidin), which are equally important from the spiritual/soul aspect of Malaysia.

6. A more progressive judiciary

There has been little change in the KPI initiative that was forced down our throats by the previous Chief Justice. Although they have recanted formally that haste was not the primary goal of litigation, but informally it still goes on. The Chief Justice had given a speech titled "Access to Justice" which appeared to place great emphasis on expeditiousness as an element of "access to justice". The quality of the judgments have not been improved, and this is reflected in the enormous amounts of appeals to the Court of Appeal. That is an indication of the lack of faith the public has in the adjudication process. This has spurred "rough justice" being meted out where cases are struck out on the court's own motion, and not heard on mere technicalities despite counsels raising no objections.

Furthermore, the KPI system is merely quantitative, not qualitiative. The quality of decisions that have been emanating from the Federal Court have not positively developed the law. The current requirement for leave to appeal is a shambles, and the Federal Court just does as it pleases. There is still a sense that even if there are progressive elements in the judiciary, it will be hindered, if not reversed, in the appellate courts. If at all, the only progress on the part of the judiciary is its sophistication in masking the failure of its duties.

7. A thorough re-evaluation of the Jabatan Hal Ehwal Orang Asli (JHEOA)

There really has been no progress. Again, the Federal Government takes a top-down approach in dealing with Orang Asli affairs. It is indeed strange for a country to deal with its primary indigenous peoples like wildlife, where they do not even have their own autonomy over their affairs. The Federal Government controls Orang Asli affairs in a very "big brother" manner. Orang Asli however are fighting back, and organizing.

Since the historic march in 2010, Orang Asli communities have been protesting in large numbers over the loss of ancestral land. One recently held was on 14 December, where hundreds of Orang Seletar protested against the Johor State Government for giving their ancestral lands to developers of Iskandar Malaysia project along the Johor Straits.

Colin Nicholas, of the Centre for Orang Asli Affairs also received an award from the United Nations, which indicates that while there is a severe lack of attention from the Malaysian government over its own indigenous peoples, the international community are recognising the fight of those who try to give a voice to the Orang Asli. Malaysia should most definitely be ashamed!

8. Halting of projects that result in mass displacement of indigenous people

There was a little glimmer of hope when the Sarawak Government announced that the Baram Dam that would displace 20,000 indigenous peoples and destroy large forested areas, would be postponed this year. However, even the most hopeful would agree that this is likely an election tactic for the upcoming General Election.

There has been no indication since that the Baram Dam, and 11 other large-scale dams planned for Sarawak would be scrapped. There has been much criticism for these dams since Sarawak has excess electricity provision even before the Bakun Dam was built, forcing displacement of thousands of indigenous peoples.

The grand plan for Sarawak is SCORE, an economic transformation plan that would forever change the face of the state. It is worth noting that the displaced communities of Bakun are still waiting for jobs and other promises made by the State Government, and live in a crowded sink town. The communities of Mukah who live near an aluminum plant (another SCORE project) complain of aluminum poisoning. If this is the progress that the Sarawak State Government has envisioned, we shudder for the fate of the rest of the state.

The indigenous communities of Baram are not lying down without a fight, and are currently on an anti-dam campaign for the entire state. Let's cheer them on.

9. Further growth of LoyarBurok

10. Amendment of Sarawak Natural Resources and Environment Ordinance 1994 (NREO 1994)

There has been absolutely no progress. Nada. Zip. Zilch. Tarak langsung.

Sarawak is on a missionary zeal to complete SCORE as soon as possible, and it is very unlikely that any laws would be amended to allow for better public participation for plans to either conserve or develop the state.

Lord Bobo's friends in Sarawak tell us that the state is in a very dire situation, and that meaningful change can only come from the strong will of the local people. Would it be in time, before large-scale development changes Sarawak forever? Would local communities stand up and speak collectively in one voice? As of now, it looks like things have to get a lot worse for thousands of people before they start waking up.

We just hope it won't be too late for Sarawak's ecosystems and rural indigenous peoples fighting for their way of life.

PKR: NFC head attempted to avert probe

PETALING JAYA: PKR wants the Malaysian Anti Corruption Commission (MACC) to charge National Feedlot Corporation (NFC) chairman Dr Mohamad Salleh Ismail for attempting to bribe those investigating NFC.

Last Friday, businessman Shamsubahrin Ismail, 45, claimed trial at the Sessions Court to the charge of cheating Mohamad Salleh of RM1.755million over the failed promise to provide "negotiation and consultation service".

While the charge did not actually specify what the "service" was, PKR strategic director Rafizi Ramli today claimed that he has information that this was clearly an attempt by the NFC supremo to bribe and influence the MACC and police investigators .

Mohamad Salleh is the husband of Women, Family and Community Development minister Shahrizat Abdul Jalil.

"PKR is disappointed with the authorities as it is obvious that they are still protecting Shahrizat and Salleh when he is clearly involved in corruption in trying to cover up the bigger corruption of the NFC," said Rafizi at a press conference at the PKR headquarters here.

"The real case is that Salleh tried to bribe investigators, but it was a middleman who had become the fall guy," said Rafizi.

"This is an insult, a mockery, to our intelligence. Not only he and his family have defrauded taxpayers' money, despite all the limelight, he still had the audacity to attempt to bribe the authorities, this is ridiculous. And the authorities are trying to deflect the blame onto Shamsubahrin. I'm wondering if this is just a public relations exercise," he said.

Rafizi said based on information from reliable sources, Mohamad Salleh had intended to pay investigators through Shamsubahrin, whose "job" was to hand over the bribe to investigators.

"What happened was, two, three weeks ago, comes a person who sat down with the NFC chairman and worked out this plan to camouflage this as a consultancy course and pass the money to investigators. Shamsubahrin had actually approached investigators and the police was honest enough to arrest him," he said.

Rafizi said based on the information from a police report lodged against Shamsubahrin, PKR also found that Mohamad Salleh himself had prepared the cheque and signed it.

"He had the intention to bribe the police and he was working together with Shamsubahrin, who apparently told him that he knew some of the investigators. The parties to benefit from this bribe was NFC and himself, because the RM1.755 million was to influence the investigation of MACC and police," said Rafizi.

'He prepared the cheque'

Rafizi said if Mohamad Salleh himself had allegedly agreed to the suggestion to influence MACC and police investigation into the NFC, he was surely a party to the crime. "If he did not know it, he would not have prepared the money," said Rafizi.

Under the MACC Act, Section 16 & 17, Rafizi said, the law clearly stated that corruption offence is committed when the bribery is also made through a third party.

"We urge the MACC to immediately investigate the NFC chairman and its staff for corruption, through a middleman. Mohamad Salleh is clearly a big party involved in the transaction," he said.

The National Feedlot Centre has come under attack from the opposition, especially PKR, since the release of the Auditor-General's 2010 report, which said the corporation was "in a mess" and had failed to meet targets.

PKR accused Shahrizat's family of misappropriating the RM250 million of public funds meant for NFC.

Among the exposes, PKR 'revealed' that Shahrizat's family owned a luxury condominium worth RM10 million in Singapore. It was revealed that the 2,282 sq ft unit at Anthony Road, Orchard Scotts, was purchased in January 2010, and was registered under the name of Shahrizat's husband and their children.

In earlier revelations, PKR said large sums were used to purchase a luxury condominium in Bangsar and a luxury car. It also claimed that the beef that NFC produced was channelled to restaurants belonging to Shahrizat's family.

Shahrizat, who heads Wanita Umno, denied that she was involved in any wrongdoing. However, she faces growing calls to quit as minister, not only from opposition parties, but from within Barisan Nasional and Umno as well.

Two weeks ago, MACC officers went to the NFC main office in Jalan Solaris in Mont Kiara and seized documents and a CPU.
