Guan Eng Concealed Full Truth

When Penang Chief Minister Lim Guan Eng claimed that the Penang state government had sliced RM600 million or 95% off the state's debt since taking over in 2008, he was craftily deceiving voters into thinking that the Pakatan Rakyat-run government had reduced the state's debts.

But the truth which Guan Eng conveniently forgets to reveal is that, on 2 June 2011, the Perbadanan Bekalan Air Pulau Pinang (PBAPP), a state-owned company had entered into a water restructuring agreement with the federal government via Pengurusan Aset Air Bhd (PAAB), a company under the Ministry of Finance. The water deal saw Penang's outstanding loan of RM655.24mil owing to the federal government to be converted into a grant.

In short, the federal government has shouldered the debt of Penang State government. Thus, the real scenario is that the Pakatan Penang state government has thrown the debt to the federal government. When Pakatan Rakyat blamed the federal government for the federal RM 20.5 billion debt, they opted not to inform that actually RM 600 million of the debt hailed from the Penang state government.

Perak, not Penang with the highest volume of debt reduction

The Penang state government claimed that it is the state which has highest reduction in debt but that is a misinformation.

In reality, it is Perak under the Barisan Nasional administration which has the highest reduction in debt. Penang reduced its debt by transferring this burden from RM600mil to RM29mil with huge publicity! But Perak reduced its debt from RM970mil to RM78mil with no self praise nor fanfare.

Pakatan's surplus a continuation of BN's surplus

The Pakatan Rakyat state government of Penang keeps saying that Penang never had surpluses before, but based on the state's financial report for the respective years, the previous Penang state government under BN before 2008 also recorded surpluses. Details are as followed:

2004 – RM28 million surplus

2005 – RM 83 million surplus

2006 – RM 10 million surplus

2007 – RM 43 million surplus

Hike in operating expenditure

The Penang state government adopts "CAT" in governance i.e. Competency, Accountability and Transparency. They should reduce the expenditure, but their operating expenditure increased from RM 252 million in 2007 to RM299 million in 2009.

Promise not inserted into Buku Jingga

Pakatan Rakyat also claims that they want to abolish prepaid mobile user service tax. But such a promise is not mentioned in the Buku Jingga or Pakatan Rakyat Alternative Budget 2012.

MACC should go after the culprit not CPU and documents...

NONEThe Malaysian Anti-Corruption Commission (MACC) raided National Feedlot Corporation's (NFC) office today over the cattle project scandal involving cabinet minister Shahrizat Abdul Jalil's family.

Eight enforcement officers from the MACC arrived at the office at upmarket surburb, Solaris Mont Kiara, in Kuala Lumpur at around 2.50pm and entered its premises.

The officers were in plainclothes, while the leader was dressed in formal wear although his MACC tag was under his jacket.

Around 30 reporters who had been camped at the premises an hour earlier, waited outside.

MACC had announced yesterday the setting up of a special team to look into the scandal, led by investigation director Mustafar Ali.

NONEWhen asked if MACC's visit was a raid, Mustafar replied with a terse, "Yes".

NFC, run by Shahrizat's husband Mohamed Salleh Ismail and their children Wan Shaninur Izran and Wan Izzana Fatimah Zabedah, has been in the spotlight since the Auditor-General's Report 2010 described the Feedlot project's accounts as being in a "mess".

NFC has been accused of abusing a RM250 million government loan for the cattle project for various unrelated expenses, including the purchase two luxury condominiums in Bangsar.

CPUNONE and documents confiscated

The officers, led by MACC operations officer Wan Abdul Rahman Wan Mohd Salleh left the premises at about 5pm.

Abdul Rahman refused to reveal what was confiscated but officers were seen leaving with a central processing unit (CPU) and several documents in four envelopes in the two-hour raid.

When queried by reporters, Abdul Rahman declined to comment but stated that they had interviewed some of the NFC's staff.

"We met several NFC staff and they had all cooperated," he said.

Despite being swarmed by reporters, he refused to disclose further information or how many people had been questioned, hurriedly leaving the premises.

The NFC' office, housed on the fourth floor of an eight-storey office block, oversees a Meatworks outlet which also allegedly belongs to Shahrizat's family.

Pegawai berkenaan dilihat keluar daripada premis berkenaan kira-kira dua jam kemudian.

Semalam, SPRM mengumumkan penubuhan pasukan khas untuk menyiasat skandal tersebut yang diketuai pengarah siasatan SPRM Datuk Mustafar Ali.

Projek NFC yang diusahakan suami Shahrizat, Datuk Dr Mohamad Salleh Ismail dan juga anak-anak mereka, meraih kontroversi apabila projek berkenaan ditimbulkan dalam laporan Ketua Audit Negara 2010.

NFC didakwa menyeleweng pinjaman mudah RM250 juta itu untuk perbelanjaan tidak berkaitan, termasuk membeli dua unit kondominium mewah di Bangsar.

Is Mahathir really the brave Malay hero who does not fear the US or the Jews?

Truth is not what matters to Mahathir but perception, in particular what the Malays perceive him to be. This is why Mahathir is vehemently denying that he had asked for loans from the World Bank (an institution he had labelled, together with the IMF, as being "Zionist, American Imperialist, etc."), even though it is apparent to all that Malaysia HAD RECEIVED loans from the World Bank AFTER Anwar's sacking in Sept. 1998.

If the majority of the Malays even suspect that Mahathir had approached the World Bank for any help, that would destroy the image that he had so craftily and cunningly built up over decades, as a brave and defiant "Malay" who dared to take on even the most powerful nation in the world, the US.

There is ample evidence, however, to show that Mahathir, in reality is anything but anti-US.

The US was and is one of the biggest investors and trading partners of Malaysia. Mahathir launched the billion dollar MSC on the strength and support of major US companies such as Microsoft, Oracle, IBM, Cisco, Dell, AMD, DHL, etc.

Malaysia spent billions of dollars on military purchases from the US during Mahathir's tenure as PM. Mahathir engaged and consulted American economic advisors and writers such as Jeffrey Sachs and Naisbit.  

Mahathir loves the Western life style - he stayed on a "Precinct" (that's as American as you can get) in Putrajaya when he was PM and now lives in a "Swiss" mansion in the Mines.  

Mahathir secretly allowed the US military to conduct exercises on Malaysian soil when he was PM (see Barry Wain's "Malaysian Maverick").

Openly, however, Mahathir has been a vitriolic critic of the US. But secretly he has been not just a close ally but a lackey of the US. That is why Mahathir is still around because he remains a lackey of the US and is of use to the US in global Islamic matters and the super-power's interests in Malaysia and the region.

Just consider this. Who is Mahathir compared to the Marcos and Suhartos and other notable dictators of the world in terms of strength, control and influence? They fell, or rather the US allowed them to fall, when they were no longer of use to the US or their continued dictatorships were no longer tenable.

It would have been kid's play for the US to destroy Mahathir, the PM of a country which has marginal influence on the world stage in terms of military, politic! al, stra tegic or economic power. The US's track record shows that they would have most certainly done so in response to Mahathir's regular and often ridiculous out-bursts against the US, unless he served a greater purpose for the US and the open criticisms were merely distractions from the truth that he, Mahathir, was a US lackey.

In order to hide his close links with the US, Mahathir often diverted the people's attention through his harsh and often illogical rhetoric against the US and would subsequently make up with the US when the rhetoric goes beyond the limits – e.g. Mahathir's million dollar payment to the Heritage Foundation to meet George Bush in 2002 to "normalize" relationships (http://www.democraticunderground.com/discuss/duboard.php?az=view_all&address=364x480020). 

Furthermore, Mahathir, despite his open vitriol against the Jews, is in fact also a close friend of the Jews.

Mahathir's reason for the open animosity for Jews is the same as that applicable to his diatribes of the US - the open animosity is a diversion so that Mahathir's close relationship with the Jews will not be apparent, and he can continue to deceive the Malays and the Islamic world.

Let us look at the facts. Mahathir was a close buddy of Soros (a Jew) in hedge-fund deals and currency manipulation, later blamed Soros for the financial crisis of 1997/1998 and called him a "moron", and subsequently absolved Soros of any responsibility for Malaysia's financial crisis when Soros visited him after his retirement (http://minaq-jinggo.fotopages.com/?entry=1017436 ).

Was Mahathir a hypocrite, lambasting first then later embracing and absolving Soros? Mahathir had engaged Saatchi & Saatchi, Goldman Sachs and other Jewish firms for various projects and tasks during his tenure as PM. ! In fact, he engaged Salmon Smith Barney, a Jewish firm, to advise him on how to manage the financial crisis and implement currency controls in 1998.

Mokhzani, Mahathir's son, worked for Lehman Brothers, a Jewish firm. Another of Mahathir's son, Mirzan, worked for Salomon Brothers, another Jewish firm. Prof Jeffrey Sachs from Harvard, one of Mahathir's top economic advisors, is a Jew. Mahathir (ok, some unknown person) engaged Abramoff, a Jew, to arrange the meeting between Mahathir and George Bush mentioned above. Could Mahathir make an enemy of the Jews (who, according to Mahathir himself, control the world) and still survive, unless he had been granted leeway? 

Mahathir's October 16, 2003 speech at the OIC meeting contained some of the most outrageous statements any leader of a country has made publicly against the US and the Jews. Mahathir explicitly labelled the US and Jews as the enemy of Muslims and said that Muslims need "guns and rockets, bombs and warplanes, tanks and warships for our defense." 

How is it that Mahathir is still alive and kicking and can even visit the US after having seriously offended the most powerful nation in the world (the US) and the most powerful people in the world (the Jews), not once but repeatedly? Something to think about. Something that must be clearly explained to the Malays so that they will know the real Mahathir.

6P fiasco: ‘Which ministry is in charge?’

KUALA LUMPUR: Another controversy has reared up over the government's 6P amnesty programme to register all legal and illegal foreign workers in the country.

This time, it is over the Home Ministry's alleged 'bypassing' of the Human Resources Ministry requirement for approval before the foreigners can be fully legalised under the second phase of the 6P.

The issue caused great confusion this morning when 6P agents received news that there was no longer a need for a JobsMalaysia (formerly known as Jobs Clearance System) certificate issued by the Human Resources Ministry. Previously only with the certificate can a foreign worker be "legalised" by the Home Ministry.

Those at the immigration offices in Putrajaya this morning were shocked to see notices stating "Sijil JobsMalaysia (JCS) bagi proses pemutihan dikecualikan" (the JobsMalaysia certificate for the amnesty process is no longer required).

"We're confused now and we're not getting any firm answers from the relevant departments," said a source from one 6P management agency.

"Why did the Home Ministry totally bypass another ministry? This is clearly an inter-conflict between two ministries,  by the Home Ministry superseeding the Human Resources Ministry's role.

"They have lost control and lost direction over this 6P programme. Is this abuse being done just because someone wants to make money?" he asked.

The source said that the new ruling would mean that the Human Resources Ministry, which is in charge of the country's labour force, would not know how many foreign workers are there in the country.

"Yes, we earlier asked for the requirements and paperwork to be relaxed, but you can't totally remove them, that's disastrous and totally defeats the purpose of having 6P," he said.

Another 6P agent said the sudden removal of JobsMalaysia certificate requirement would not be fair to local workers, as the function of JobsMalaysia certificate was to ensure that human resources, both local and foreign, are utilised most optimally.

"Locals might be deprived of jobs because of this removal of the Human Resources Ministry approval. Who manages the labour resources of a country? Home Ministry or Human Resources Ministry?" asked the agent, who declined to be named.

Home Ministry: Making the process easier

However, National Smallholder Association Malaysia (Teluk Intan branch) chairman Tan Tang Seong said for the 1,000-plus vegetable farmers that he was registering, it was better that the Human Resources Ministry's JobsMalaysia approval be abolished.

"A lot of them can't produce the legal documents, such as titles for their farms. That's why we suggested the removal of the JCS requirement.

"But the news about it being abolished today is very vague, we are still very confused," said Tan, who is also an authorised 6P agent.

It is learnt that the Human Resource Ministry was not properly informed over today's new decision.

Labour Department director-general Sheikh Yahya Sheikh Mohammed told FMT he was in the dark about the matter.

"I don't know about this. This is the first time I'm hearing it. Ideally we should be consulted before a decision is made about this. We need to know what is the reason the Home Ministry decided to bypass us," he said.

Meanwhile, Home Ministry secretary-general Mahmood Adam told FMT that it was untrue that the Human Resources Ministry approval was no longer needed.

"This was a Cabinet decision. But anyway, we still need the Human Resources Ministry approval. We are simply making the whole process easier by shortening the 7-day waiting to only one day. Now you get it within 24 hours," he said.

(The Cabinet Committee on Foreign Workers and Illegal Immigrants is chaired by Deputy Prime Minister Muhyiddin Yassin).

Mahmood added that there are certain sectors, such as security, that comes directly under Home Ministry and does not even require a Human Resources Ministry approval.

"So there should not be any problems. Why are these agencies making noise?" he asked.

Numerous complaints

The 6P programme is an initiative by the Home Ministry to register legal and illegal immigrants in the country.

Under the programme, illegal immigrants get to gain amnesty through "6Ps", which stands for– registering, legalising, pardoning, monitoring, enforcing and deporting illegal immigrants.

6P is also being initiated to help check human trafficking and trans-border crimes including drug smuggling and money laundering.

As of Aug 31, more than 2.3 million foreign workers and illegals were registered using the biometric system under the first phase of the 6P amnesty progamme. Home Minister Hishammuddin Hussein said the number comprised 1,016,908 legal workers and 1,303,126 illegals.

The 6P programme had not been free from controversy. There were numerous complaints of the programme being exploited by several unscrupulous parties, including bogus agents, management companies overcharging fees, and legal immigrants taking the opportunity to abscond from their employers.

PKR Wanita chief Zuraida Kamaruddin even claimed that illegal immigrants registered under programme have been made to swear an oath that they and their families will vote for Barisan Nasional (BN) come polling day.

Under the second phase of the 6P programme, "legalisation" has started since October.

Why the hell should he apologise for his actions when there is a legitimate reason behind it?

The 22-year-old Universiti Pendidikan Sultan Idris (UPSI) student, Adam Adli Abdul Halim, who lowered a flag depicting Najib Abdul Razak at the Umno headquarters at the Putra World Trade Centre, said he would not apologise to the prime minister for his actions.

Telling Sinar Harian in an exclusive interview today, Adam said his actions were to drive a point that the present situation in the country was getting worse and hoped his actions would create awareness.

"I will never apologise (to the prime minister). Since the thing had happened till today, now I am asked to apologise. I will never do that. How about my friends and the struggle? " he asked.

"I do not want my friends to be demoralised if I apologise. It is not that I will never apologise at all, as maybe someday I may have to say sorry to some people for my actions," he said when asked whether he will apologise to the prime minister.

I'm glad this young man knows to stand his ground.

I can imagine all those fools urging him to apologise are saying what a rude (biadap) thing it is to lower the flag and how Najib's feelings would be hurt.

If you ask me, Najib should apologise.

Profusely.

He should apologise for letting this nation get to such a sorry state.

He should apologise for all the taxpayer money he has used indiscriminately.

He should apologise for the stupid things he has done, like the Scorpene deals and Altantuya.

But I don't he! ar a wor d out of him.

Why millions paid to agents in navy purchase...

NONEThe emergence of invoices totaling millions of ringgit in relation to the purchase of the six naval patrol vessels raise the concern of kickbacks, echoing the Scorpene submarine deal.

According to invoices leaked to Kita president Zaid Ibrahim, three 'agents' were paid a total of RM11.36 million for "technical assistance" in connection with the purchase from French arms dealer DCNS.

"Why can't the navy determine what is required by the navy, instead of these consultants? Unless this is necessary to channel corruption money," he said when met in Tropicana today.

Refusing to reveal his source, Zaid said the companies had received payments in Euro to foreign currency accounts in Singapore from 2010 to April 2011.


According to a Oct 25, 2010 invoice, Sousmarin Armada, received 935,000 euros for "technical services fees for system infrastructure configuration, system engineering and evaluation, commercial negotiation and selection of design partners for the Second Generation Patrol Vessel project."


The invoice was made out to Boustead Naval Shipyard Sdn Bhd, which won the contract for the six vessels, by the company purportedly based in Paris. The amount was paid in two parts on Oct 28 and Nov 1, 2010.


Based on leaked documents, the same company issued anther invoice for the same service on Nov 3, 2010 for 986,000 euros and was paid the same month.

Setaria Holdings Limited, said to be based in Brussels, had last February invoiced Boust! ead Nava l Shipyard 850,000 euros for "technical evaluation and integration parameters of equipment and systems... for the second generation patrol vessels".

Setaria also issued two other invoices to Boustead Naval Shipyard for 832,000 euros and 725,000 euros respectively.

Both Setaria and Sousmarin Armada cannot be independently verified.

Singapore bank accounts

Another company, JSD Corporation Pte Ltd said to be based in Singapore, invoiced Boustead Naval Shipyard for 312,000 euros in April this year.

According to the invoice, the service provided was "technical evaluation for MRG, SRG, SAM, SSM, hardware system, subsystems and completeness, software items, auxiliary or subsystem hardware, deliverable and completeness, test specification, modularity, redundancy and open architect for the second generation patrol vessels".

The company's website reveals that it provides technical service for aviation maintenance, repairs and overhauls, specialising in the Boeing 747, 737 and non-military Kazaan helicopters.

Incorporated in 1989, JSD also sells toy cars, boomboxes and remote keychain luggage finders.

All three companies, despite two being based in Europe, received payment through foreign currency accounts in the Singapore branches of Standard Chartered Bank and OCBC.

"Somebody has to stop this practice... as this is t! he reaso n our security is compromised. The army and naval forces have no say over the purchases and we pay too much for equipment that don't work," Zaid said.


He added that if Boustead wanted to buy from DCNS, it could have gone straight to the suppliers and not through these middlepersons, adding to the final price.

"Boustead is paying these agents, but they will recoup this through the price quoted to the government," he said.

"Until today, we still don't know how the price of the six vessels had gone up from the initial RM6 billion to RM9 billion."





'Mengapa bayar kepada ejen untuk kapal tentera?'

NONEPresiden parti KITA, Datuk Zaid Ibrahim hari ini mendedahkan butiran pembelian enam kapal peronda tentera oleh kerajaan – didakwa dibuat melalui orang tengah yang mengaut jutaan ringgit daripada urusniaga tersebut.

Menurut Zaid, tiga ejen berkenaan dibayar sejumlah RM11.36 juta untuk "bantuan teknikal" berhubung pembelian kapal tentera berkenaan daripada firma Perancis, DCNS.

"Mengapa tentera laut tidak dapat menentukan apa yang diperlukan oleh mereka, dan bukannya perunding ini? Lainlah ianya perlu untuk menyalurkan wang rasuah," katanya ketika ditemui di Tropicana, Damansara har! i ini.

Zaid yang enggan mendedahkan sumber maklumat itu mendakwa, firma perunding itu menerima bayaran dalam matawang euro melalui akaun di Singapura daripada 2010 hingga April 2011.

Menurut satu invois bertarikh 25 Oktober 2010, salah satu daripada firma berkenaan didakwa menerima 935,000 euro sebagai bayaran "perkhidmatan teknikal."

Dokumen itu menyenaraikan perkhidmatan berkenaan, termasuk konfigurasi infrastruktur, kejuruteraan dan penilaian sistem serta rundingan komersil untuk projek "Second Generation Patril Vessel."


Invois daripada sebuah syarikat yang didakwa berpengkalan di Paris itu dialamatkan kepada syarikat Boustead Naval Shipyard Sdn Bhd, yang memenangi kontrak bagi enam kapal berkenaan.

Bayaran berkenaan didakwa telaazlanh dibuat dalam dua bahagian, masing-masing pada 28 Oktober dan 1 November tahun lalu.

Berdasarkan dokumen tersebut, syarikat yang sama didakwa telah mengeluarkan invois untuk perkhidmatan sama pada 3 November 2010 untuk jumlah 986,000 euro dan dibayar pada bulan tersebut.

Satu lagi syarikat, Setaria Holdings Limited, didakwa turut menghantar invois berjumlah 850,000 euro kepada Boustead Naval Shipyard.

Syarikat yang dikatakan berpengkalan di Brussels itu juga didakwa mengeluarkan dua lagi invois kepada Boustead Naval Shipyard untuk bayaran berjumlah 832,000 euro dan 725,000 euro.

Modus operandi membalun duit rakyat hampir sama saja. Rakyat jelata terutama orang2 Melayu sikit punya takut hilang kuasa lalu dirayu agar pangkah BN/UMNO, tapi jebon dan musang UMNO atasan sikit punya sakan dok rembat duit rakyat berkat sokongan orang2 Melayu bingong.

Rasuah secara sistematis ini akan berterusan selagi UMNO berkuasa...

Where’s the beef – Holding the bull by the other horn (Part XI)

  • In my previous post of the same topic, I wrote about holding the bull by the horn where I wrote about reviving NFC. I didn't want to touch on the issue mismanagement and SJ the wife of NFC Chairman. She is "only the wife of the chairman" and "mother to the CEO and Executive Director".  Since RR continuous and trickling expose, I guess the power brokers in BN realized that PR probably has a lot more than what they had thought. For that a series of sequential action, press release and drama took place. MACC who was initially a reluctant observer suddenly swung into action. I quote Kit Siang (LKS) tweet "MACC major casualty of Shahrizat/ CattleGate scandal – living proof it is not independent professional until political masters signals probe" Why do I sense that LKS is probably right?
  • Over the last 48 hours, MACC announced a task force, the RMP made a press release that a "Dato" has been nabbed, Khir Toyo found guilty and NFC office has been raided. Khir Toyo said that he has been made a scapegoat. I agree with him. Clearly he had to be sacrificed to save the pack. With unsettling Felda issues, it is obvious that NFC issue has to be resolved. Earlier this week, PM office had to release a denial that SJ had resigned and that happened before NFC swung into action. I guess since the fellow UMNO member's advice to SJ has not been heeded, and then the power brokers have to make another sacrifice. Obviously it wont is a cattle. It is better to lose one lady and one man than to lose the entire country.
  • The walls are closing in fast on SJ. In this case I believe the investigators would not be able to link the "wife to the business of the husband" but to save BN/UMNO they have to sacrifice SJ. The way to do is threatening to hang the husband and children high and dry. No mother will just look and do nothing. It's a matter of time and I predict, SJ will step down as Minister and will maintain as Wanita Chief until GE 13. She might not even be field as a candidate. A bit unfortunate though but that is the life in politics. The question is who will pull out the knife first? In this case, someone already pulled the knife and it is not SJ.

Felcra short-changing padi farmers, says PKR

PASIR SALAK: PKR has urged Felcra chairman Tajuddin Abdul Rahman to investigate complaints by padi farmers in Seberang Perak that the government owned company is buying their produce at a price far below the market rate.

Abdul Razak Ismail, the PKR coordinator for the Pasir Salak parliamentary constituency, said the farmers reported that Felcra was paying them RM1,050 per tonne of padi, which was RM200 to RM250 below the market rate.

There are about 6,000 padi farmers in Seberang Perak. Abdul Razak reckons that each farmer was losing about RM2,800 every time they harvest. According to him, this translates to an income of less than RM700, which is below the official poverty level.

"Felcra should not concern itself solely with profit," he said. "It has a social obligation to help increase the income of farmers participating in its schemes."

Felcra Bhd, the former Federal Land Consolidation and Rehabilitation Authority, was corporatised in 1997. Tajuddin became its chairman in 2008.

Abdul Razak acknowledged that the padi farmers could supplement their income by working on the oil palm land allotted to them. However, he said, the income from this source was swallowed up by the high cost of fertilisers they had to buy and the high rental of machinery.

Citing the construction of a RM1 billion office-and-residential complex in Jalan Semarak, Kuala Lumpur, Abdul Razak said Felcra had strayed from its original objective of developing the agricultural sector.

He urged Felda to use some of the "huge funds" available to it to absorb the costs incurred by padi farmers.

Abdul Razak also asked Tajuddin to pressure the Ministry of Agriculture and Agro-based Industry to speed up the release of funds under a government scheme to encourage higher rice production.

According to the Auditor-General's report released last October, the ministry still owed RM110.67 million to more than 70,000 farmers under the scheme.

Malaysia: Revoke Law Banning Same-Sex Sexual Relations

Drop Case against Ex-Deputy Prime Minister Anwar Ibrahim

(New York) – The Malaysian government should revoke its colonial-era law criminalizing consensual sexual acts between people of the same sex, Human Rights Watch said today. The authorities should drop their criminal case alleging consensual "sodomy" against opposition leader and former deputy prime minister Anwar Ibrahim, who is awaiting the verdict in his trial that began in February 2010.

"The Malaysian government uses its outdated sodomy law to slander political opponents and critics," said Phil Robertson, deputy Asia director at Human Rights Watch. "Whether or not Anwar Ibrahim engaged in consensual 'sodomy' is irrelevant. It's time to reject this law and end the farcical political theater that promotes discrimination based on sexual orientation and destroys people's lives."

On June 28, 2008, Mohd Saiful Bukhari Azlan, then a 23-year-old aide to Anwar, filed a police complaint accusing Anwar of having forcibly sodomizing him two days earlier. The charges were later changed to consensual sodomy, after the authorities determined that Anwar, a 60-year-old with a bad back, was physically incapable of compelling the young man to engage in acts against his will. The complainant avoided being charged because he had reported the incident and asserted he needed protection. 

Anwar is being tried under section 377 of the Malaysian penal code, which prohibits "carnal intercourse against the order of nature." This so-called sodomy law is a relic of British colonial rule dating back to the mid-19th century. Conviction could result in a sentence of up to 20 years in prison. Leading members of the Commonwealth of Nations, to which Malaysia belongs, called for the abolition of sodomy laws during the recently concluded summit meeting in Brisbane, Australia.

As a member of the United Nations Human Rights Council, Malaysia has agreed to "uphold the highest standards in the promotion and protection of human rights." Revoking the sodomy law would be consistent with Malaysia's undertakings as a Human Rights Council member, Human Rights Watch said.

In 1994, the Human Rights Committee, the UN body of experts that monitors civil and political rights, held that sodomy laws violate the right to privacy and non-discrimination. The Yogyakarta Principles, a set of international legal princ! iples on the application of international law to human rights violations based on sexual orientation and gender identity, call on states to, "Repeal all laws that criminalize consensual sexual activity among persons of the same sex who are over the age of consent." A November 2011 report by the UN high commissioner for human rights, which will be presented to the Human Rights Council in March 2012, recommended that UN member states "repeal laws used to criminalize individuals on grounds of homosexuality for engaging in consensual same-sex sexual conduct."

Appeals to cultural or social exceptionalism do not overrule international human rights standards. The Vienna Declaration and Programme of Action, which was adopted by consensus at the World Conference on Human Rights in 1993, provides that, "It is the duty of States, regardless of their political, economic and cultural systems to promote and protect all human rights and fundamental freedoms." In his 2010 Human Rights Day statement, UN Secretary-General Ban Ki-moon rejected discrimination based on sexual orientation and gender identity and said that, "Where there is a tension between cultural attitudes and universal human rights, rights must carry the day."

This is the second time Anwar Ibrahim has been arrested on allegations of sodomy. His previous trial for sodomy, which resulted in a conviction in 2000 and a nine-year prison sentence, was marred by rights violations throughout. Upon being arrested on September 20, 1998, Anwar was beaten by the police chief at that time, resulting in severe facial injuries. Due process violations included lack of access to legal counsel; witness intimidation; harassment of his lawyers; and major problems with the prosecution's evidence. The conviction was overturned in 2004.

"Laws punishing consensual sexual relations between adults of the same sex are an unjustifiable invasion of the rights to privacy and personal security," Robertson said. "They foster a climate in which disc! riminati on and abuse takes place. These rights cannot be willed away by selective appeals to cultural tradition and religious belief."

Geli hati saya membaca pelbagai jenis cemuhan yang dilemparkan kepada Adam Adli, ada yang minta hantarnya ke Palestin, tak cukup dengan ludah, tampar, lempang, nombor telefon disiarkan di Internet dan segala macam penghinaan, ada yang hadir ke Bukit Aman semata-mata untuk "mengajar" Adam Adli yang dikatakan "kurang ajar".

Maka di Malaysia sudah jadi satu ke-"kurang ajar"-an jika menurunkan muka pemimpin, walau hanya untuk lima minit. Wah, kalau guna duit kerajaan 250 juta yang sepatutnya untuk urus lembu tapi beli kondominium, tidak "kurang ajar" kah?

Ernst Cassirer dalam "The Collected Papers of Albert Einstein" (Princeton University Press, 1987) menegaskan: "Teori fizik relativiti tidak mengajarkan bahawa apa yang dilihat oleh setiap orang adalah benar baginya, tetapi sebaliknya teori itu memperingatkan (agar berhati-hati) dengan petunjuk-petunjuk yang hanya dapat dilihat pada suatu sistem partikular.."

Hal relativiti ini, atau sebagaimana yang dikatakan "invarian" oleh Felix Klein dan Arnold Sommerfield, mirip konsep etika Nietzsche "Beyond Good and Evil" (Mozlowski, 1921). Konsep "invarian", yang khusus berfungsi untuk memperingat dengan hati-hati (turun gambar muka 5 minit) akan petunjuk yang dapat dilihat (guna duit kerajaan 250 juta). Saya cuma beri perbandingan, saudara boleh fikir sendiri yang mana lebih buruk kesannya kepada masyarakat.

Realpolitik "Malaysian Style"

Saya tidak peduli dengan Adam Adli. Saya lansung tidak berminat dengan insiden "turun muka 5 minit". Saya sebenarnya lebih berminat jika kiranya "Adam Adli and the gang" boleh buat demo di pejabat Naval Boustead Shipyard, kerana kenaikan kos pembuatan kapal hingga mencecah 30 bilion, atau jika boleh demo di pejabat Kementerian Kewangan susulan pendedahan pengaliran wang haram keluar dari negara sehingga 150 bilion pada 2009, kerana kedua-dua kes ini melibatkan duit rakyat yang besar.

Bayangkan berapa ramai warga negara berpendapatan rendah dan sederhana yang akan mendapat manfaat, kiranya ketirisan wang kerajaan boleh dipulihkan? Tetapi malangnya melalui real-politik "Malaysian-style", sebuah video klip berdurasi 1 minit 07 saat berjudul "Panglima Ludah Muka" boleh menenggelamkan semua isu masyarakat, hatta persoalan kondominium mewah untuk "lembu".

Saya fikir ini serius. Kini bukan lagi masa kita untuk berdebat soal sopan dan santun, kurang dan ajar. Masa untuk kita berbincang hal budaya sudah lepas, jati dan diri perlu dahulu kita gali sebelum menentukan sesuatu justifikasi berkait hal sopan dan santun, atau kurang dan ajar.

Ini adalah masa untuk kita berbincang hala dan tuju masyarakat, generasi muda terutamanya. Ini menarik, jarang saya kira di negara kita mahasiswa, golongan muda terpelajar yang terpilih memasuki universiti di negara ini, bercakap, berbincang malah mematerialkan secara fizikal isu berkait hala dan tuju negara. Saya cadangkan, kita melihat secara subjektif hal demonstrasi ini.

Adam Adli hanya sebuah sosok. Dia terpilih hanya kerana ketelanjurannya dalam insiden "turun muka 5 minit". Cuma perkara menarik yang perlu kita beri perhatian adalah sikap yang tertonjol melalui sosok Adam Adli tersebut. Adam Adli, berjaya menonjolkan sebuah sikap, kepercayaan yang dipercayainya benar dalam lingkungan pemikirannya.

Materialisasi sikap inilah perkara yang paling penting dalam fasa pertumbuhannya sebagai seorang anak muda. Sikap dan keyakinan, menjadikan seseorang mahasiswa, tidak lagi bersikap neutral terhadap ilmu. Kita boleh ada sehingga 5 juta warga muda, tetapi jika 5 juta tersebut semuanya tidak bersikap, tidak berani menyatakan pendapat, tidak mempunyai pandangan terhadap negara, tidak endah dengan isu semasa, tidak peduli dengan perkara yang menggeluti bangsa dan negaranya, jangan bercakap soal masa depan negara.

"Ideologi" dan ilmuan moden

Galileo dalam "Warkah Christina" (sewaktu memuncaknya peristiwa Copernicus dalam tahun 1615) menyatakan bahawa pertentangan antara agama dan sains tidak lain adalah sebab dicipta oleh profesor dalam bidang falsafah.

Malah ketika paderi Dominican yang berdarah panas mempersenda-sendakannya di mimbar gereja, Galileo lansung tidak menyalahkan paderi tersebut. Menurutnya, orang di belakang paderi tolol tersebut adalah profesor falsafah, yang mentafsir ayat Injil secara salah seraya mencipta bidah baharu. Galileo, lantas menyalahkan tabii manusia, bukannya agama.

Ali Syariati dalam bukunya Ideologi terjemahan Farid Gaban (1984) menyatakan "Ideologi" adalah ancaman yang besar buat kekuatan yang sedang berkuasa serta sistem kapitalis. Ilmuan moden menurutnya, selalu mempercayai bahawa keyakinan sudah mati, iaitu keyakinan hanyalah milik zaman kuno, zaman aristokrat mistik yang hdup pada abad pertengahan.

Ilmuan jenis ini katanya, seringkali mengingatkan diri mereka bahawa mereka harus bersikap objektif dan neutral dalam abad analisis ini. Oleh sebab mereka harus patuh kepada keobjektivian tersebut,objektiviti telah meneutralkan ilmu lantas menjadikan mereka sifar ideologi.

Ilmuan moden ini menurutnya lagi, menjual diri mereka kepada pemerintah untuk mendapat gaji besar dan kemewahan. Untuk melawan status quo ini menurut Ali Syariati adalah melalui ideologi. Mempunyai ideologi menurutnya adalah mempunyai suatu keyakinan kuat tentang bagaimana untuk mengubah status quo. Hanya ideologi yang mampu mencabar status quo yang lengkap dengan sejarah, tingkat sosial serta pengikut politiknya.

Bukan mudah untuk mendapat kesedaran ideologi sebegini. Aristotle dan Plato malahan, tidak mempunyai kesedaran sebegini. Tiada satu pun gerakan sosial atau revolusi yang digerakkan oleh mereka, untuk membantu golongan yang menderita pada zamannya. Yunani malah, jika mempunyai 1000 Ptolemeus sekalipun, tidak akan berguna kerana kehidupan mereka akan tetap sama seperti sebelumnya. Apa yang diperlukan Yunani bukanlah falsafah mahupun ilmuan, tetapi ideologi aktif yang diperlukan untuk memperbaharui dan mengubah nasib masyarakat bawahan yang sentiasa menderita.

Mise en Scene

Tidak sukar untuk kita faham meta naratif yang sedang berjalan kini. Mise en scene-nya cukup menarik; "set design"-nya saya kira grand, mana lagi jika bukan kawasan tiang bendera di PWTC. "Lighting"-nya dahsyat, lihat saja bagaimana "intensity" media yang dilimpahkan, tidak cukup YouTube, Facebook, blog, keluar pula di Utusan Malaysia, Berita Hairan, paling mutakhir Sinar Harian. Perhati pula bagaimana "space-presentation" yang diberikan, sehingga mempengaruhi "mood" para penonton.

Di Upsi sendiri, masih tidak berhenti demo-demo kecil diadakan di sekitar kawasan pusat pentadbiran. "Costume"-nya mengalahkan Maharaja Lawak Mega, panglima-panglima berperut boroi keluar beramai-ramai dengan modal "ptuih"-nya.

Persembahan lakonan masing-masing juga hebat, dimulai dengan babak turun bendera oleh Adam Adli, terdapat variasi sejarah dan budaya dapat kita saksikan terutamanya seni naturalistik oleh Adam Adli serta seni melodramatik oleh panglima ludah muka.

Galileo, tidak menyalahkan paderi ketika konfrontasinya dengan gereja, tetapi menyalahkan tabii manusia. Einstein malah menekankan teori relativitinya bergerak dari petunjuk-petunjuk yang hadir dari "second thought".

Adam Adli lahir dari sebuah sistem  yang rosak. Tidak guna kita memaki, meludah atau melempangnya. Hal seperti SBPA dan PPSMI, yang dilaksanakan tanpa rundingan tidak akan selesai jika kita memenjarakan Adam Adli sekalipun. Sebegitu banyak masalah berkait bangsa dan negara, masalah pendidikan, masalah kakitangan awam, masalah ketirisan wang negara, masalah lembu negara, masalah pengangkutan awam, tidak akan selesai hanya melalui ugutan lucah terhadap Adam Adli.

Masalah hanya akan selesai melalui revolusi dan reformasi pemikiran. Di mana segala macam jenis ilmuan negara ini, yang hanya diam dan menurut perintah ketika negara benar-benar memerlukan mereka untuk mengatasi sekalian banyak masalah berkait bangsa dan masyarakat?

Masalah ilmuan moden sebagaimana yang dihurai oleh Ali Syariati di atas, sebahagian besarnya adalah akibat dari perancangan halus AUKU. AUKU secara halus, telah memenjarakan ilmuan moden di dalam penjara kebebasan akademik yang dinding tebalnya adalah pintu pagar universiti.

Ilmu ditinggalkan di dalam kampus dan di fakulti-fakulti sahaja. Ilmu tidak lagi mampu menjadi penyelesaian masalah kepada masyarakat. Jika ilmu dibawa keluar dari pintu pagar kampus, dikhuatiri akan dikenakan tindakan sebagaimana yang telah terjadi kepada Abdul Aziz Bari.

Kita wajar untuk tidak menyalahkan Adam Adli di atas keterlanjuranya dalam "insiden turun bendera 5 minit", kerana saya percaya sistem yang telah membentuk pemikiran Adam Adli adalah sistem yang rosak. Ilmuan kita, disebab penjara AUKU yang membelenggu lebih dari 30 tahun, tidak mampu mengajar lebih dari ilmu dan sikap yang berguna buat mahasiswa. Lebih menyedihkan, ilmuan kita, tidak mampu menunjukkan sikap mereka ketika masyarakat tertindas.

Adam Adli telah menzahirkan sikap dan keyakinannya. Hakikat bahawa tindakan Adam Adli mungkin salah, ya. Tetapi bukan kerja kita untuk menentukan kebenaran di sebalik tindakannya. Inilah zamannya untuk bereksperimentasi dengan ideologi dan kebenaran itu sendiri. Dia perlu bertanggungjawab terhadap konsekuen dari pilihannya tersebut.

Yang perlu kita khuatiri kini adalah ribuan mahasiswa lain yang masih terpinga-pinga di antara ideologi diri, pegangan, serta sikap dan keyakinan yang mereka pilih. Tidak guna kita sibuk menghukum Adam Adli, ketika ribuan mahasiswa lain di seluruh negara sibuk bergembira, melahirkan anak luar nikah, serta seribu satu masalah sosial yang lain.

Kepada panglima-panglima ludah muka, saya ucapkan syabas dan tahniah di atas lakonan anda yang begitu memberansangkan. Kerana ada pelakon hebat seperti andalah, mahasiswa kini lebih gemar Maharaja Lawak Mega daripada Syarahan Perdana Prof. Al-Attas. Kepada Adam Adli, hanya sepotong frasa Greek yang dapat saya sampaikan kepada anda; "Pathei mathos"; iaitu kebijakan datang daripada kesakitan.

Dan kepada anda yang bijak membaca dan melihat lapis kedua dan ketiga disebalik "The Chronicles of Panglima Ludah Muka and Adam Adli"; sandiwara ini tidak lain dan tidak bukan diadakan hanya untuk menarik perhatian rakyat, daripada isu sebenar yang terhasil akibatnya.

Isu kebebasan akademik dan penjara ilmu dikalangan ilmuan moden kita, masih tidak terselesai.

DBKL inconsistent with its policy declarations

I refer to the story on "DBKL stays mum on hawker's plight". I am happy at the stand taken by DBKL, contrary to popular opinion, but disappointed at their actions.

I'm happy that 'Rasheed's application was rejected on the grounds that the site was a pedestrian walk…'

I am disappointed that DBKL is unable or unwilling to make this policy declaration work. The result is that someone else is operating a stall on the same spot.

How can this billion-ringgit bureaucracy manage bigger issues if it cannot get hawkers off the city's pedestrian walkways?

The hawker faces no "plight". He has been operating for years illegally where he should not have. It is high time he obeyed the laws.

There are enough laws and regulations in place. Hawkers have designated places to operate. Drivers have designated places to drive and to park. Buses and taxis have designated lanes.

Pedestrians have designated walkways. There are designated places to dispose of household waste and even places where one can ease oneself.

The reality is quite different and pedestrians, meaning people, face the greatest plight. Walkways are usually unusable: Drivers park there; motorcyclists ride there freely; garbage and construction material are dumped on them; and last, but not least, hawkers set up shop there. Just walk around Brickfields and see.

Not surprisingly for a car-centric city, roads are cleaner and better maintained than walkways.

DBKL has made many noble policy declarations, like "we want a cleaner city". Waving a magic wand is not enough.
To the extent that City Hall is unable to implement its policies, Kuala Lumpur will remain a chaotic, people-unfriendly and 'third-world' city.

I do not see any "people first" in this; and "performance" is more than three years late.

Malaysia Airlines cuts more routes to stem losses

KUALA LUMPUR: Flag carrier Malaysia Airlines today said it would cut four more routes in Asia, a week after announcing a suspension to some global destinations as it tries to return to profit.

The airline, which has struggled to stay in the black in recent years, unveiled a business plan last week aimed at becoming profitable by 2013 that would include a route "rationalisation" but did not name the affected routes.

It said it would put a halt to trips from Kota Kinabalu to Osaka and Haneda in Japan, to Perth and to Seoul. The carrier added that the suspensions would come into effect between January and February.

"This suspension is until further notice and is part of our regional network consolidation involving single-aisle aircraft operations," Ahmad Jauhari Yahya, the airlines' chief executive officer, said in a statement.

The airline last week said routes servicing Rome, Johannesburg, Cape Town, Buenos Aires, Karachi, Dubai, the Saudi Arabian city of Dammam, and the city of Surabaya in Indonesia, will be dropped from January.

It plans to instead bolster services to major destinations in Asia that have better prospects.

In the third quarter of this year, the airline posted its third straight quarterly loss, owing to high fuel costs and increased competition.

Adam Adli


There are many Malaysians like myself who are in support of Adam's action of taking  down the flag in PWTC. Especially Najib's.  Since sitting at the Premiership Najib has done nothing concrete for the citizens of this country beside giving more and more projects, lands and loans to UMNOputras.
What more in the history of Malaysia, there is no-one except Najib who has fine tune the art of BRIBE GIVING AND LEGALIZING IT.
After numerous tongue twisting and flip flopping undertakings, Najib now known as the man who does not keeps his words and promises, will he dare face the people at the 13GE or will there be an emergency so created by Perkasa, Hasan Ali and Malay Extremists, not forgetting that 86 years old Kutty who still believes he is running the show?
I understand there will be a showdown of power in January with the help of Police and Armed Forces against the Rakyat.
Will all Malaysians especially the students and Malays rise to protect this country from the corrupted BN?
Time will tell.
In the meantime nature will take its course in an unusual way to end the year 2011.

In the last few weeks Jimmy Wong Sze Phin has been bringing up allegations and issues pertaining to Sabah Air Aviation. Allow me to clear the air over the issues he has raised. The Audit Report by Jabatan Audit Negara was submitted in February 2011 to the shareholders and the Audit Exit Conference was held on June 24, 2011.

The report was discussed, clarified, at the conference and necessary steps were taken to address all matters pertaining to the audit report queries. Necessary steps were taken in the immediate aftermath, with the appointment of a new leadership in July 2011. The requisite restructuring and process updating was initiated immediately.

The company is in fact now embarking on operating process overhaul and updating its procedures to meet future requirements in the aviation field, such as getting international quality standards approvals (AS/EN9110) and other process approvals, with an aggressive view on the potential long term future of the company.

The company made a profit of RM 1.6 million for the year 2010. Sabah Air Aviation would like to address some of the specific allegations that were brought up in the media recently, for the benefit of the public at large, and Jimmy Wong Sze Phin.

RM 1 Lease Agreement with Eurocopter

The said agreement was an above board arrangement with Eurocopter to cover the cost of participating in LIMA'11. The aircraft was transferred to Subang Base for Hangarage and technical support (while away from main operating base). The participation in LIMA '11 was covered by Eurocopter (in terms of expenses).

The main reason for Sabah Air to bring this model to LIMA '11 was to highlight its superior capabilities to Ministry of Health senior officials on a potential new contract for nationwide Emergency Medical Services (EMS).

The total expenses for the entire event were in the range of RM800,000, which was translated into a major saving for Sabah Air. While the aircraft is under the aegis of Eurocopter, the standard procedure is to ensure the insurance coverage for the aircraft is also passed to them, which has to be done on the basis of a Lease Agreement for RM1. The aircraft has a few more jobs in Peninsular Malaysia and Singapore before coming back to Sabah in mid-March.

Sabah Air would like to stress at this stage the following:

a) The EC-145 belongs to Sabah Air, and is been currently operated out of Eurocopter Subang Base.

b) Main reason for this is to assist in the company's campaign with the customer on the potential EMS contract.

c) Once the pre-determined commercial and non-commercial (e.g. demonstration flights to potential customers) are completed the helicopter shall be coming back to its home base (Kota Kinabalu).

d) It is a common practice in the aviation sector for such collaborative efforts between the operator and the OEM.

e) The ownership of the aircraft still and will always remain with Sabah Air.

Sabah Air in disarray

On the topic of three spokesmen for the company indicating the company is in disarray, Sabah Air would like to point out the following,

a) Sabah Air Aviation is in the midst of a transitional management, and the issues referred to the Audit Report overlapped across two different management.

b) Hence it was in the best interest of the public for the past and present management to be addressing the issue.

c) Sabah Air would also like to point out that the issues were addressed by the management itself, rather than an appointed spokesperson to show its seriousness in addressing public interest on the subject matter.

"In the business of saving lives"

The business of saving lives is a profitable one. The Medical Care industry is a multi-billion dollar industry. Sabah Air is in the logistics sector of this industry vertical; which is a vital infrastructure in region such as Sabah with its unique geography. The Flying Doctor Services, EDEVAC and the Emergency Medical Services are all paying services, not just in Malaysia but all over the world.

Sabah Air was one of the pioneering Aviation companies in the country to start the Flying Doctor Services. Over the years, substantial portion of the company's revenue was derived from this sector. Hence, we at Sabah Air would like to reiterate the fact that we are in the business of saving lives.

This was also one of the main reasons the company was approached by the United Nations in the immediate aftermath of the Aceh Tsunami Tragedy to provide vital air services. The services offered is on the basis of Government Tender and paid for by the government. Occasionally we have also undertake mercy missions on humanitarian grounds as a service to the poor citizens of the state, which sometimes do not fall within the purview of the stated contract. Such flights are considered as the Corporate Social Responsibility of the company, without damaging the financial stability of the company, which is evident in the profit the company made last year.

Meetings with Department of Civil Aviation, Malaysia

In the business of Aviation; whether General Aviation, MRO or Airlines, liaising with the Department of Civil Aviation on matters concerning regulations and safety are normal and mandatory requirements. To recent reports on Sabah Air personnel going to meet with DCAM is true and there is nothing unusual about it.

Such meetings will normally cover all aspects of the company (aircraft, flight crew and engineering). Hence, the general public need not be alarmed on such meetings. Sabah Air would also like to point out that the allegation that the Chairman attended the meeting in DCAM on the Dec 6, 2011 is not true. The meeting was attended by the CEO along with senior company personnel.

Certificate of Airworthiness

Sabah Air has one of the oldest Air Operator's Certificates in the country. Our team is experienced in the task of maintaining the required Airworthiness Documentations for all types of aircraft that is operated and or owned by the company. Some of these certificates and or documents are based on calendar renewal while some others are valid on different time scales, depending on the DCAM or company requirements. As per current status, all

Sabah Air aircrafts are fully certified for any type of flights and it is usual for the certificates to run its term before been renewed again on the basis of specific regulatory requirements.

Aircraft Registration

On the issue off 9M-CMD and 9M-MOH registration, Sabah Air would like to state that the issuance of the same by DCAM was random, which was accepted by Sabah Air. Any links to any agencies or personalities, as suggested in the media are purely coincidental and has nothing to do with any preferences as mentioned in the media. The Government or Sabah Air shareholders were not involved in this routine task for new aircraft registration in any manner and does not interfere in such decisions which is entirely up to the management.

Crew Movement

As for the media reports on pilots leaving Sabah Air, we would like to highlight the fact that unlike other industrial or service sector, the aviation sector has a highly mobile workforce.

Such mobility is higher in the aviation industry as it is very much an internationalised industry and people can and are free to move around within as well as outside the country.

At the same time, Sabah Air is also attracting a lot of new talents. Hence pilots leaving and joining the company is normal, as it is for licensed engineers. Nevertheless, the new management has identified weaknesses in the Human Resources management and took corrective actions to address the same.

Conclusion

The allegations brought out in the recent days on the company and its customers have had a negative impact on its operations and on-going business campaigns.

It was also unfortunate that these issues got highlighted in the media when the next Flying Doctor Service contract tender (2012 to 2015) process got into a critical decision-making stage for the customer.

Two out of the three potential contractors were highlighted by Jimmy Wong Sze Phin in a negative light. Hence, the timing of this issue been brought up in the media is highly questionable as potentially giving an unfair advantage to certain quarter of the competitive landscape of the said contract.

Sabah Air shall not be addressing the media again on these matters till the said tender process is concluded successfully by the customer, as we consider it highly prejudiced otherwise. The company also has more important issues to address and chart its future to become a regional leader in this industry, in accordance with our business plan. We belief all issues are clearly elucidated now for the public to read and understand.

End harassment, threat and intimidation against student activist!

Suara Rakyat Malaysia (Suaram) condemns the ongoing harassment, threat, intimidation and misrepresentation of facts from the authorities and pro-government groups and media against student activist Adam Adli. We call for an end to the continued harassment, threat and intimidation against student activists, which became apparent after a recent student-led protest.

On Dec 17, 500 students from various universities marched to the Umno headquarters at Putra World Trade Centre, Kuala Lumpur, demanding greater academic freedom and called for the repeal of the controversial Universities and University Colleges Act 1971 (UUCA) which curtails the freedom of expression of students both in and out of campus.

At the protest, Adam, a second-year student at Universiti Pendidikan Sultan Idris (UPSI), had lowered a flag bearing Prime Minister Najib Razak's portrait to replace it with a flag which bears the words 'Academic Freedom'. Reports said the protest flag was raised for five minutes, taken down and the flag with the PM's face was raised again. Many Umno supporters denounced the action, targeting their fierce criticism at Adam.

Since then, Adam has been attacked and threatened by some group of individuals via sms, phone calls and videos. On Dec 19, Adam lodged a police report at the Bukit Aman police headquarters in regard to the said harassment including threats to his personal safety. After speaking to police officials about the harassment, he held a press conference at the entrance to the Bukit Aman headquarters.

A minor scuffle broke out, during which an unidentified man who later introduced himself to be Ruslan Mokhtar tried to punch Adam. Adam suspected that the assailant was a plainclothes policeman who was present when Adam met with the police officers earlier. He also noted that none of the uniformed personnel tried to break the scuffle.

He lodged a report with the Tun HS Lee police station in regard to the scuffle as well as the harassment he and his family in Penang are facing.

In view of the above, Suaram urges for:

1 An Immediate Investigation on threats against Adam Adli:

His symbolic gesture of lowering the flag does not harm anyone and it is a constitutional right of freedom of expression enshrined under the Federal Constitution of Malaysia. The police must investigate Adam's report on the assault against him and charge the assailant if there is evidence of wrongdoing, notwithstanding that he is a former policeman.

2 A guarantee for Adam's safety and well-being.

Given the multiple threats against him and well-documented in the media and on social media platforms, the police must take steps to ensure he and his family is free from harm.

3 A stop to any action taken against student protestors.

We urge the UPSI and other university/colleges to stop any further threat of action against Adam and other student activists who participated in the march on Dec 17. The students assembled peacefully and did not resort to any form of violence.

4 The media to practice journalism ethics.

Media's role is to inform readers by giving accurate information, not through reporting of one-sided versions of events with no right of reply for the person accused of a wrongdoing.

5 A repeal of the UUCA.

The government must recognise students' right to participate in the democratic processes and any right guaranteed to all under the Malaysian Constitution. It must also bear the primary responsibility of ensuring that acts of intimidation and violence against student activists are not tolerated and perpetrators will be punished under the law.

Masing dangles ‘carrot’ at Entri & Co

KUCHING:  Concerns over the possible threat of the defiant five in Sarawak Progressive Development Party (SPDP) joining the opposition has compelled Parti Rakyat Sarawak (PRS) to offer them the 'keys' to its doors.

Said PRS president James Masing: "I am not going to interfere in their squabble. They are big enough to look after themselves."

"(But they should know that) as a member of BN, we are certainly concerned with what is happening in SPDP."

"Let them settle their own problem first within SPDP and then we'll talk about 'keys' to the door (to PRS)."

Masing was refering to the recent sacking of SPDP deputy president Sylvester Entri.

Entri, who is Marudi assemblyman and now partyless, also heads two state portflios.  He is the assistant Minister of Public Utilities (water supply) and Agriculture.

The other four elected representatives who form the SPDP 5 were stripped of their respective party posts.The four are Mas Gading MP Tiki Lafe and  assemblymen  Peter Nansian (Tasik Biru), Paulus Gumbang (Batu Danau) and assemblywoman Rosey Yunus (Bekenu).

While SPDP still considers them as its members, they however have 'kicked' themselves out of the party.

Sarawak BN is now saddled with the upheaval in SPDP and the deepening dissent within Sarawak United Peoples Party (SUPP).

'Political frogs' within BN

This is not the first time that Masing has expressed concern over what is happening in SPDP as it 'the problem' may affect the performance of the BN in the coming general election.

Of immediate concern to Masing and other BN leaders are the four parliamentary seats which are allocated to SPDP – Mas Gading, Saratok, Baram and Bintulu.

Due to the internal squabble in SPDP,  Mas Gading and Baram are in deep 'trouble'.

Both SPDP and the 'errant' five are claiming the right to contest the two seats.

Tiki Lafe who is the MP for Mas Gading has declared his intention to defend the Mas Gading seat.

But Mawan has said that he has identified at least two persons to replace Lafe.

Similarly in Baram, Mawan has nominated Jacob Dungau Sagan to defend the seat, while Entri wants his own man to contest the seat.

Their dispute over the seats is deeply dividing onground support BN.

"This is Masing's main worry. Nothing more, nothing less," said his aides who are defending Masing against claims that he is involved in the affairs of SPDP.

Several SPDP leaders including Mawan have accused certain BN leaders of having a hand in stirring discord in SPDP.

Mawan described these BN leaders as 'political frogs' which have been instigating disunity in SPDP.

No decision yet

Meanwhile questions loom over whether SUPP will be ready to face the 13th general election.

SUPP is being investigated by the Registrar of Society over complaints of irregularities during the party polls at branch level.

The ROS is yet to conclude its probe.

At stake for Sarawak BN is SUPP's  seven parliamentary seats. Currently, the four state BN component parties — Pesaka Bumiputra Bersatu (PBB), SUPP, PRS and SPDP — are in control of 29 out of 31 parliamentary seats in the state.

The remaining two seats, Bandar Kuching and Sibu, are held by the opposition DAP.

The PBB has been allocated 14 parliamentary seats, SUPP has seven, PRS received six and SPDP has four.

PAS: Solat Jumaat di dua masjid dalam satu mukim angkara Umno

PETALING JAYA: Solat Jumaat di dua masjid dalam satu mukim  yang masih berlaku di Terengganu angkara Umno, dakwa Timbalan Pesuruhjaya PAS negeri, Saiful Bahri Mamat.

Beliau mendakwa, apabila orang Umno gagal menguasai masjid, mereka mendesak supaya membina masjid sendiri.

"Ini berlaku di  Kampung Pinang Merah, Kampung Nyior dan Kampung Tebing Tembah – semuanya di daerah Dungun," katanya.

Beliau mengulas titah Sultan Terengganu, Tuanku Mizan Zainal Abidin  yang kecewa kerana masih berlaku solat Jumaat di dua masjid dalam satu mukim di Terengganu.

Dilaporkan ada 11 masjid di Marang, Setiu dan Besut masih melakukan dua solat Jumaat dalam satu mukim  berbanding 23 masjid sebelum ini.
Saiful  juga mendakwa  pemimpin Umno sendiri memulau masjid-masjid semasa pemerintahan PAS di Terengganu dari 1999 hingga 2004.

Juga berlaku di Felda

Katanya, ini berlaku kepada masjid Sura Lama dalam DUN Paka.

"Masjid yang dibina dan dikuasai oleh orang-orang PAS itu menimbulkan rasa tidak puas-hati pimpinan Umno-BN . Mereka berusaha supaya masjid itu ditutup dan dibina masjid Sura Baru hanya beberapa ratus meter daripada masjid Sura Lama.

"Hasrat sebenarnya ialah orang Umno tidak bersedia bersembahyang di masjid yang dibina oleh orang PAS," tambahnya.

Saiful mendakwa perkara serupa juga berlaku di Felda Kerteh 2 dan Kerteh 3.

Dakwanya, masjid baru dibina walaupun kedudukan masjid tu sejengkal sahaja tetapi ia tidak menjadi isu kerana kawasan ramai penyokong Umno dan ianya satu projek untuk Umno.

Najib umum bonus insentif produktiviti peneroka Felda

KUALA LUMPUR: Datuk Seri Najib Tun Abdul Razak hari ini mengumumkan Felda akan membayar bonus insentif produktiviti antara RM400 dan  RM1,200 kepada peneroka tanah rancangan itu pada tahun ini, kadar yang sama seperti tahun lepas.

Pembayaran bonus insentif berjumlah RM102.6 juta itu yang bergantung kepada penghantaran hasil, melibatkan 95,949 daripada 112,635 peneroka Felda bagi menghargai sumbangan mereka terhadap kemajuan industri sawit dan getah negara serta insentif menghantar hasil melalui Felda, kata Perdana Menteri dalam satu kenyataan.

Bonus insentif itu akan dibayar di pejabat rancangan Felda pada akhir bulan ini.

"Kerajaan berharap pemberian bonus ini akan menjadi perangsang kepada peneroka untuk berusaha lebih gigih untuk meningkatkan produktiviti masing-masing," kata Najib.

Beliau berkata peneroka yang menghantar hasil melalui pengurusan rancangan dinilai berdasarkan penghantaran hasil dari Januari hingga Oktober tahun ini. agi peneroka sawit, kelayakan minimum ialah 8.01 tan/hektar manakala ganjaran maksimum ialah mereka yang menghantar hasil melebihi 19 tan/hektar.

Bagi peneroka getah pula, kelayakan minimum ialah 600.01 kg/hektar dan ganjaran maksimum diberi kepada mereka yang menghantar hasil melebihi 1,400 kg/hektar.

Peneroka yang terlibat dalam penghantaran hasil sawit dan getah adalah seramai 32,865 orang terdiri daripada 27,069 peneroka sawit dan 5,796 peneroka getah.

60, 584 peneroka

Najib berkata seramai 60,584 peneroka menanam semula bersama Felda dan akan menerima bonus maksimum RM1,200 seperti tahun lepas.

Katanya Felda turut memberi pertimbangan khas kepada peneroka yang prestasi hasilnya rendah akibat tanaman tidak produktif serta menunggu giliran untuk tanaman semula melalui cara mengambil kawasan kebun mereka untuk tujuan pembangunan.

Mereka yang terlibat dalam kategori itu ialah tanaman peneroka yang hasilnya rendah disebabkan serangan musuh tanaman.

Kira-kira 2,500 peneroka yang terlibat dan kadar bayaran ialah RM400 seorang.

Najib berkata seramai 16,686 peneroka didapati tidak layak menerima bayaran insentif kerana tidak menghantar hasil kepada Felda dan hasil kurang daripada hasil minimum yang telah ditetapkan.

Peneroka yang menguruskan sendiri kebun mereka dan tidak menghantar hasil juga tidak dibayar bonus insentif, katanya.

"Saya menyeru warga peneroka agar menyertai program bersama Felda selaras dengan usaha berterusan agensi itu untuk meningkatkan paras pendapatan peneroka melalui bimbingan dan khidmat nasihat yang disedikan," kata Perdana Menteri.

Khir Toyo guilty of graft...

NONEAfter a trial lasting more than a year, the Shah Alam High Court today found former Selangor menteri besar Dr Mohd Khir Toyo guilty of graft.

Justice Mohtaruddin Baki said the prosecution has managed to prove the case against the 46-year-old Sungai Panjang assemblyperson beyond reasonable doubt.

Presently, Mohtaruddin is hearing mitigation from Khir's lawyers before passing sentence.

While the prosecution applied for the multi-million-ringgit property in question to be forfeited, the defence appealed to the judge for Khir to be bound over on good behaviour.

Khir is charged under section 165 of the Penal Code, which is the lesser graft charge, compared to charges under the Prevention of Corruption Act and the new Malaysian Anti-Corruption Commission Act.

Khir is staring at the possibility of a two-year jail term or a fine or both.

If the fine is in excess of RM2,000, Khir may lose his eligibility to be an assemblyperson and banned from contesting in the coming elections.

Also present in court to hear the verdict was his wife Zaharah Kechik and about 40 of his supporters, some seated and others standing in the packed courtroom.

Khir is represented by a team of lawyers led by Jahaberdeen Yunoos, M Athimulan and Kamarul Hisham Kamaruddin. DPP Abdul Wahab Mohamed represented the prosecution.

Khir arrived in court as early as 9.15am, with scores of his supporters in tow.

Second Selango! r MB cha rged with corruption

khir toyo mansion 060709 06Khir was charged on Dec 4 last year, with corruption for obtaining for himself and his wife Zahrah Kechik, two lots of land and a house at No 8 & 10, Jalan Suasa 7/1L, from Ditamas Sdn Bhd director Shamsuddin Hayroni, at RM3.5 million - a lower price than the RM6.5 million Ditamas paid for it in 2004.

The former Selangor MB allegedly entered into the transaction with the knowledge that Shamsuddin had dealings with him in his official capacity as the state's chief executive at that time.

The Sungai Panjang assemblyperson allegedly committed the offence at the Selangor menteri besar's official residence at Jalan Permata 7/1, Section 7, Shah Alam on May 29, 2007.


He is the second Selangor menteri besar to be charged with graft after the late Haron Idris, who spend three years in prison in 1977.

Khir in one of his blog postings this year alleged that three federal ministers had wanted him jailed for graft following the charge. Without naming the ministers, Khir claimed one of them was said to have told the two others that to get back Selangor, he (Khir) must be charged.

"Are they powerful enough to control a judge? I don't believe they can direct a judge nor will a judge listen to this ! group,� � wrote Khir in the blog, resulting in spiralling speculation on the identity of the three.


Twenty-five prosecution witnesses and five defence witnesses, including Khir, testified at the trial.

Mahkamah dapati Khir Toyo bersalah tuduhan rasuah

Mahkamah Tinggi Shah Alam hari ini mendapati bekas menteri besar Selangor, Dr Mohd Khir Toyo bersalah atas tuduhan rasuah. Hakim Datuk Mohtaruddin Baki berkata pihak pendakwaan telah berjaya membuktikan kes terhadap ADUN Sungai Panjang itu tanpa sebarang keraguan yang munasabah.

Pada masa ini, Hakim Mohtaruddin sedang mendengar rayuan dari peguam Khir sebelum menjatuhkan hukuman. Khir didakwa mengikut seksyen 165 Kanun Keseksaan - tuduhan rasuah yang lebih ringan, berbanding dengan tuduhan di bawah Akta Pencegahan Rasuah dan Akta baru Suruhanjaya Pencegahan Rasuah Malaysia.
Khir berdepan dengan kemungkinan hukuman penjara dua tahun atau denda atau kedua-duanya. Jika denda itu melebihi RM2,000, Khir boleh hilang kelayakannya sebagai ADUN dan tidak boleh bertanding dalam pilihan raya akan datang. Turut hadir ialah isterinya, Zaharah Kechik dan kira-kira 40 penyokongnya - ada yang duduk dan ada yang berdiri di dalam bilik mahkamah yang padat.

Khir diwakili oleh pasukan peguam yang diketuai oleh Jahaberdeen Yunoos, M Athimulan dan Kamarul Hisham Kamaruddin. DPP Abdul Wahab Mohamed menjalankan pendakwaan.

Khir tiba di mahkamah seawal jam 9.15 pagi.

Khir, 45, didakwa mendapatkan untuk diri dan isterinya, Zahrah Kechik, 45, dua lot tanah dan sebuah rumah di No. 8 & 10, Jalan Suasa 7/1L, daripada pengarah Ditamas Sdn Bhd, Shamsuddin Hayroni pada harga RM3.5 juta sedangkan ia dibeli oleh Ditmas pada 23 Disember 2004 dengan harga RM6.5 juta.

Perbuatan itu didakwa dilakukan dalam keadaan Dr Mohamad Khir mengetahui bahawa Shamsuddin mempunyai hubungan dengan tugas rasminya sebagai Menteri Besar Selangor pada ketika itu.


Dr Mohamad Khir, yang juga ADUN Sungai Panjang, didakwa melakukan kesalahan itu di kediaman rasmi Menteri Besar Selangor di Jalan Permata 7/1, Seksyen 7, di Shah Alam, pada 29 Mei 2007.

Pada 8 Ogos lalu, Hakim Mohtaruddin memerintahkan Khir membela diri atas tuduhan itu selepas mendapati pendakwa sudah membuktikan kes prima facie ke atas pemimpin politik itu.

Dua puluh lima saksi pendakwa dan lima saksi pembela, termasuk Khir, memberi keterangan dalam perbicaraan tersebut.
