Jeffrey’s back to active politics

KOTA KINABALU: Maverick Jeffrey Kitingan, who has been without a party since he left PKR one year ago, has now joined a reactivated 16-year-old Sarawak party, Sarawak Reform Party (STAR).

STAR president, Dripin Sakoi, presented Kitingan a membership card and document empowering him to lead a Sabah chapter of the party in time for the 13th general election.

Four other Jeffrey allies in Sabah, who also received their membership cards from Sakoi today, are Guandi Kohoi, Rubin Guribah, Jeffrey Telado and James Aik.

Sakoi, who took over the presidency from STAR founder Patau Rubis in March, surprised everyone in the packed hall of a restaurant in Penampang, near here, when he invited the five to come forward and received their STAR cards while he was giving a short speech after Jeffrey finished his.

"We in STAR fully subscribed and support the Borneo Agenda of UBF (United Borneo Front) and it is time now for us to unite… I am calling on Jeffrey to come forward and receive his membership. He is now to lead the Sabah chapter," Dripin said amidst applause from the some 300 supporters of UBF and guests.

FMT learnt that Jeffrey will tonight be meeting with his people to set up an organising committee for the launching of STAR Sabah on Jan 6.

It is understood that that Hongkod Koisaan hall, which is the headquarters of the Kadazandusun Cultural Association (KDCA), has been booked. The 4,000-capacity hall will be the site for Jeffrey's clarion call to gather together the much-touted third force.

Earlier in his press conference, Jeffrey did not mention joining any party. Neither did he say anything about it his hour-long speech.

In his speech, he reiterated his frequent call for the people to unite and see the reality of false hope and broken dreams spun by the then regime.

"We have been duped because we were too young to comprehend then (1963).

"They exploited us until we became just one of the 13 states in the federation, until we have become the poorest in this country.

"We must put a stop to this and the only way is to unite once again to fight for our independence and our rights," Jeffrey said.

STAR on the lookout

Over the past year, Jeffrey has been travelling all over Sabah holding hundreds of tea-parties to explain and galvanise people to support his Borneo Agenda.

Badaruddin Datu Mustapha Harun, son of a former chief minister, was the only other speaker at the event.

Badaruddin urged all the three major native communities in Sabah – Muslims, non-Muslims and Chinese – to unite and vote Umno and Barisan Nasional (BN) out of Sabah at the next general election.

"I have this message for Prime Minister (Najib Tun Razak): 'kalau anak jantan, kasih daftar parti Usno sekarang…'" said Badaruddin, whose challenge to Najib was met with thunderous applause from the floor.

Badaruddin is the pro-tem president of Usno Baru which has thrown its support behind Jeffrey's Borneo Agenda.

Among the guests who witnessed the event were Sabah Progressive Peoples Party (SAPP) adviser, Mohd Noor Mansor, and the party's deputy president Amdi Sidek, former Suhakam commissioner Simon Sipaun, activists Patrick Sindu and Kalakau Untol.

The event was to celebrate the first anniversary of UBF which was launched a year ago in this same venue. Today is also the date of STAR's 16th anniversay.

Meanwhile, Rubis, who is now the party's permanent chairman, has dismissed any links between the party and UBF.

He said STAR was now looking for strategic partners to continue its struggle.

The way we were in 1957 — Kua Kia Soong

NOV 16 — It is now 54 years since we became independent, and with the 13th general elections approaching, it is time to count the cost of BN rule since 1957. Many draconian and unjust laws did not exist at independence and Malaysians should seriously reflect on the way we were and how many reforms being proposed today merely represent the status quo in 1957, nothing more. Malaysia in fact needs to undergo much deeper reforms to survive the 21st century.

Let us first examine the situation at independence to see how our country has regressed under BN before we consider further reforms. It also brings into perspective the so-called "social contract" frequently brought up by UMNO to justify the status quo. And let us not forget that UMNO has managed to destroy our democratic institutions only with the assistance of all the other BN coalition parties in parliament.

The following are some stark examples of the damage done to our fundamental liberties enshrined in our Federal Constitution in 1957:

1. Equality undermined through the amendment to Article 153 in 1971:

The addition of the new clause "8A" to article 153 in 1971 two years after May 13 has led to the gross racial discrimination seen in admissions to educational institutions such as MARA science schools, colleges and UITM, and the access to public-sector scholarships. In recent years, racial discrimination has been further institutionalised through the routinised usage of "Ketuanan Melayu" (Malay dominance) in common parlance to justify the discrimination.

2. Liberty of the person violated since 1960 to allow detention without trial:

The Internal Security Act that has been used to put away dissidents and the opposition all  these years only came into existence three years after independence in 1960. Under the guise of protecting "national security", it was used to finish off the entire leadership of the Labour Party, the main threat to the Alliance government in the sixties. To date, more than 10,000 people have been detained under this iniquitous law.

The Emergency Ordinance 1969 also allows the BN government to detain Malaysians without trial; it only came in 1969 after "May 13". Purportedly necessary to deal with gangsters and others, this law was recently used against six leaders of Parti Socialis Malaysia using absurd allegations of fact.

The legislation of the Dangerous Drugs Act 1985, which also allows the BN government to detain people without trial, only came into existence in 1985, purportedly to deal with drug dealers and traffickers. In recent years, hundreds of people have been detained under the EO and DDA.

3. Independence of the judiciary in doubt since 1988:

Ever since Mahathir sacked the Lord President and suspended three more Supreme Court judges just before the crucial judgement on the UMNO Team A/Team B judicial challenge in 1988, the Malaysian judiciary's independence has been in doubt.

 4. Unfair constituency delineation since the amendments to the Constitution in 1962 and after:

The original Merdeka constitution provided that in drawing up constituencies, "there shall not be more than a difference of 15 per cent in the number of electors of any constituency to the electoral quota". The "electoral quota", or national average, was defined as the number obtained by dividing the number of electors in the Federation by the total number of constituencies. Section 2 (c) of the Thirteenth Schedule had stipulated that "the number of electors within each constituency ought to be approximately equal throughout the unit of review".

The Constitution was amended in 1962 transferring the power to delimit parliamentary constituencies from the Election Commission to a bare majority of parliament. Professor R.H. Hickling, the first parliamentary draftsman of Independent Malaya commented on this amendment thus:

"The abolition of the powers of an independent commission smacks a little of expediency and expediency can be a dangerous policy…the Federation is intent upon destroying the relics of a paternal policy embedded in the original Constitution, under which a number of independent bodies (in addition to the Supreme Court) shared, with the legislature, the authority of the federation."

A new Thirteenth Schedule set out certain new features permitting a weightage of up to 2:1 in favour of rural constituencies, thus enabling differences of 100 per cent between urban and rural seats. A further constitutional amendment in 1973 took away altogether the original check in the Thirteenth Schedule on there being too great a disparity between urban and rural seats. Today, the absurdity of constituency delineation in Malaysia is exemplified by the contrast between 6,000 voters at Putrajaya federal constituency and more than 100,000 at Kapar, a disparity of 16:1.

5. Suspension of local government elections in 1965:

At independence in 1957, we had elected local government. In fact the Kuala Lumpur municipal elections were our baptism in democracy even before independence. But the government suspended local council elections on March 2, 1965, when the Labour Party was at its strongest, using Indonesia's "Konfrontasi" as an excuse. They promised to restore elected local authorities "the very moment peace is declared and the Emergency regulations are withdrawn". These emergency regulations have been in existence for more than 40 years, allowing the government to continue to suspend local council elections.

6. Mother tongue education stunted since 1961:

At independence, the Education Ordinance 1957 provided for local education authorities as part of elected local councils. These local education authorities provided for surveying, planning and allocating resources for building schools. The number of English, Malay, Chinese or Tamil schools to be built in each locality and the financial allocation they were entitled to depended on the need of the people in the area. It was not something to be horse traded by political carpetbaggers to appease their communalist supporters. Thus at independence there were 78 Chinese secondary schools, 1,320 Chinese primary schools and 800 Tamil primary schools. Even the school-leaving certificate of the Chinese secondary schools was a government examination.

Now we only have 1,285 Chinese primary schools and 550 Tamil primary schools. The government will only allow 60 independent (community funded) Chinese secondary schools and their Unified Examination Certificate is recognised all over the world except in Malaysia!

The 1961 Education Act did away with the Chinese secondary schools and after the suspension of elected local government, education became a federal prerogative and has become an object of communalist politics ever since.

7. The right to peaceful assembly taken away in 1967 and after:

Our right to assemble peaceably under Article 10 was severely circumscribed by the Police Act 1967, giving the police wide discretionary powers to regulate assemblies, meetings and processions by requiring a licence to be obtained for peaceful assemblies. Amendments to the Act in 1987 further extended police powers to stopping and dispersing activities in private places. It also provided the police with power to use force against participants when closing down events, whether in public or private places. Since 2007, section 98 of the Criminal Procedure Code allows the government to use court orders to stop public assemblies. The police have the power to arrest individuals named in court orders if they enter the identified areas of planned assemblies. With the passing of the latest Peaceful Assembly Bill, the right of Malaysians to assemble peaceably has been further circumscribed.

8. Our freedom of expression shackled in 1971 and after:

The Constitution was amended in 1971 making it seditious or criminal to question any rights and privileges relating to citizenship, the national language and the use of other languages, to quotas for Malays and the natives of Borneo, and to the sovereignty of the rulers. The Internal Security Act 1960, the Universities and University Colleges Act (UUCA) in 1971, Official Secrets Act 1972, the Printing Presses and Publications Act 1984 have further restricted Malaysians' freedom of expression. The monopoly of the mainstream media by the component parties of the BN acts as an effective clampdown on our freedom of expression.

9. Our freedom of association restricted since 1959:

We enjoyed relative freedom of association until 1959 when the Trade Unions Act was brought in to impose strict controls on trade union affairs. The Societies Act was introduced in 1966 requiring every organisation to secure a licence. In 1967, the Industrial Relations Act further restricted Malaysian workers' freedom of association. The UUCA clamped down on the freedom of association by academics and students. The Societies Act was further amended in 1981 and in 2011, two respectable associations, namely the Malaysian Medical Association and the Malacca Chinese Assembly Hall, were deregistered.

Thus, it is no big deal to call for the reinstatement of all the democratic institutions that were in place at the time of independence in 1957. If we manage to do that, Malaysians will only be realising the quality of life at the time of independence, such as a relatively more equal society; a more independent judiciary; fairer constituency delineation; elected local government; freedom for mother tongue education to grow; the freedoms of expression, assembly and association respected; no detention without trial for a start.

We would still need a new agenda for concrete reforms to take us through the many challenges we face in the 21st century to deal with racism, racial discrimination and other related intolerances; abuse of powers; law reform and the rule of law; effective prevention of corruption; free and fair elections; more accountable and representative democracy; freedom of information; defending workers' rights and living conditions; upholding women's rights and dignity; protecting the rights of indigenous peoples; a progressive economic policy; an environmentally friendly policy; a people-centred social policy; channelling defence spending into social services and promoting a culture of peace.

REFSA Rojak: Crisps of the Week (10-16 Dec)

Foong Li Mei brings to you another edition of REFSA Rojak, a weekly take on the goings-on in Malaysia by Research for Social Advancement (REFSA).

REFSA Rojak – "trawl the newsflow, cut to the core and focus on the really pertinent. Full of flavour, lots of crunch, this is the concise snapshot to help Malaysians keep abreast of the issues of the day."

The Bill that Gates Jobs across the whole of Malaysia

While the Peaceful Assembly Bill still jangles the nerves of Malaysians – most recently with the Home Minister and the police contradicting each other on whether Christmas carollers need permits to be jolly this season – another Bill is jingling more alarm bells.

Cyber whizzes are crying foul at the proposed Computing Professional Bills (CPB) 2011. Under CPB 2011, only 'qualified' computing professionals and service providers can bid for Critical National Information Infrastructure (CNII) projects. And who decides who is qualified? A new Board of Computing Professionals will be in charge of 'certification'.

REFSA considers the proposed CPB  2011 fundamentally flawed. Firstly, IT industry advances are largely forged by innovative, self-taught geeks.  The Board would necessarily have to rely on academic and vocational qualifications in its 'certification' process. The late Steve Jobs, immortalised as an icon to be emulated in our Prime Minister's blog post, is famously a college drop-out. Would our new Board 'certify' him given his absence of paper credentials? This process would be the death-knell of innovation.

IT practitioners also challenge the ambiguity of the Bill. It's hazy as to which industry will be affected. The drafters of CPB 2011 admitted that there is no agreed definition of CNII yet. Cyber Security Malaysia, however, states that any activity that "impacts on national economic strength, image, defence, public health and safety and the government's ability to function" may be listed as sectors under CNII.

As the lawyers at LoyarBurok point out, whether it is AirAsia's IT provider of its online booking or a self-taught genius who designs a successful multimillion application, they will both be subject to regulations under the Act if their programs are considered as 'vital to the national economic strength and image' of the nation. Hold on a minute. That self-taught genius probably would not even get a look in in the first place, because he wouldn't have the qualifications to be certified!

Political leaders on both sides don't like it either. MCA says it will raise the unemployment rate while DAP calls it "half-baked".

MOSTI (the Ministry of Science, Technology and Information) said CPB 2011 is a means to "raise professional standards by developing and maintaining a code of conduct for computing professionals".

REFSA disagrees and will be publishing our view on this matter. In the meantime, if you feel moved to take action, make yourself heard in the on-line petition against the bill.

Time to enforce some existing laws?

While computing professionals are busy combating unnecessary regulations, citizens elsewhere are desperately seeking enforcement of existing laws. 17 NGOs and activists from Malaysia, Europe and Australia are pressing for the arrest of Sarawak Chief Minister Taib Mahmud and 13 relatives for abuse of power. International environmental groups including Greenpeace and the Bruno Manser Fund accused Taib of "massive graft and plundering of Sarawak's rich natural resources."

Opacity blanketed the alleged cover-up. Reporters were taken aback when barred from entering Wisma Bapa Malaysia, where ministers in Taib's state cabinet held their weekly meeting, prompting suspicion that there is a black-out of Taib-related news.

Who watches the 'non-watchmen'?

While the long arm of law struggles to reach those sitting atop the political hierarchy, it is tightening its grip on ground level with more street patrols. More policing should mean good news to the rakyat; the only thing is it isn't always the police who are doing it.

According to the Home Ministry, trained civil defence and RELA members who are among the 40,000-strong patrolling force will have the same powers as the police when on duty in their uniforms. While REFSA commend the voluntary spirit of the "citizen police", we could not help but wonder – do these RELA officers receive the same stringent training as real policemen? Is it wise to hand so much power to people who do not have the same experience and expertise as trained law enforcers?

And why the need for the rakyat to take the baton? In our Aug 2011 focus paper, REFSA laid out ample evidence that Malaysia has enough policemen. The shortfall arises because 41 percent of them are in management or administration. This means that for every manager/administrator serving, less than two policemen are on active duty!  We need more active police officers, not more officers.

Bad press

It has not been a good week for Malaysia in the international media. Besides the pressure on the Sarawak CM mentioned earlier, UK paper The Guardian asserts that  "Malaysia's democratic reputation will have been critically wounded" as Opposition Leader Anwar's sodomy case draws to a close.

Pulitzer-prize winning New York Times ran a story on how Christians in Malaysia are being "used as political pawns to win support among Muslim voters".

We were also mentioned by Internet giants! Google, Twitter, Yahoo! and eBay have asked the US Congress not to follow Malaysia's footsteps in censoring the internet on the excuse of curbing online piracy.

Looks like Malaysia's reputation needs a good scrubbing, again. Are we using the mighty ol' muscle of political reforms this time, or will we be paying for the image-whitewashing prowess of public relations to make more headlines?

________

Why 'Rojak'? Disparate flavours and textures come together in a harmonious mix to make this delicious but underrated concoction. Our Rojak weekly is much like this mix, making sense of the noise of daily newsflow and politicking.

It is also our ultimate dream that our multi-ethnic melange of communities can be made richer within the unique 'sauce' that is Malaysia. Let's take pride in the 'rojakness' of our nation!

FELDA : The smell of easy money? (Part 1)

  • Until Perkasa demonstrated against Dato' Dzulkifli Abd Wahab, I paid very little attention in issues surrounding Felda. Perkasa action forces to me to interview prominent people read and understand the issues surrounding the organization. Now I know the game plan of the politician. For certainty, the settlers will ultimately be the losers if BN is allowed to rule in the next 5 years, as it appears that they have made their mind on what they want and how they want it to be done. Clearly, the best interest of the settlers is the last thing on the mind of the politicians. To understand the whole issue, one need to understand the structure and the personalities behind Felda.
  • First we have the authority that is called FELDA (Federal Land Development Authority). This is a Malaysian government agency handling the resettlement of rural poor into newly developed areas. It focuses on opening smallholder farms growing cash crops. In the early days, the various resettlements created were made in the form of cooperatives where the settlers do not own the land but own shares in the cooperative. The cooperative, Koperasi Felda (KPS) is the landowner. The scheme change at a later date when settlers insist that they are should be the owners of the land that they had toiled. The office bearers of KPS must be settlers or children of settlers. That is part of the organization charter.
  • On the 6th September 1995, Felda Holdings was incorporated and it became a public company on 3rd October 2003. Under the incorporation arrangement, the cooperative became an investment agency for the settlers. It owns 51% of Felda Holdings. The cooperative is now known as Koperasi Permodalan Felda (KPF). The balance 49% is owned by Felda Global Ventures, a company that is owned by the FELDA, the Authority. The whole structure appears to be confusing because everything from the authority to the cooperatives and the holding is called Felda. The line separating them is very vague.
  • Felda Holdings Bhd is a holding company established on 6th September 1995. Its principal activities mainly in oil palm plantations, palm oil downstream business, manufacturing and services. It managing over 550,000 hectares of land belonging to settlers. It provides technical advisory and support services for all the Felda Group's agricultural pursuits. In total this involves some 300 estates, 70 palm oil mills, 7 refineries, 4 kernel crushing plants, 13 rubber factories, manufacturing plants and several logistic and bulking installations situated throughout Malaysia and in various locations overseas.
  • With ONE aim, Bandai move FELDA Authority and KPS under the PM department. Najib was given the responsibility to supervise the whole operations. In 2011, Isa Samad was made the chairman of FELDA Authority and Felda Holdings. Since there is a strong opposition in KPF, Isa Samad wants to control KPF by being the chairman of KPF. Once this happen, then Felda, as we know it will disappear forever. I will write more about the deceiving plan in the next post? It would be about money!

Mahathir kelentong konon tak minta bantuan Bank Dunia...

Anwar: Mahathir asked World Bank for aid

Opposition leader Anwar Ibrahim made a startling allegation against Dr Mahathir Mohamad, claiming that the former prime minister had written to the World Bank for funds during the financial crisis in 1999.

NONEIn an effort to clear the "US agent" label against him by Umno and Mahathir, Anwar last night told a dinner attended by foreign ambassadors that in 1993, he had written to the World Bank in his capacity as finance minister to reject financial assistance.

"Of course, I had to chair the development committee of International Monetary Fund (IMF) and World Bank.

For that I was portrayed as American agent, but the fact remains it was me in 1993 who wrote to the World Bank to say we are not requiring its funding. "In 1999, the then prime minister Mahathir wrote to the president of World Bank appealing for funds and (to) borrow from World Bank," he claimed.

The dinner was organised by the Selangor state government, at which Anwar delivered a speech titled 'Debunking ETP: Widening Income Gap' to some 150 guests, including foreign ambassadors, economists, academicians, MPs, party leaders and journalists.

Wasn't that a paradox?

Anwar, who is also the Selangor economic adviser, was asked whether Malaysia was prepared to brace itself against the Eurozone crisis, but he digressed from the question and recounted the difference between him and Mahathir during the crisis.

The PKR de facto leader said he was not aware of Mahathir's action as he was jailed in 1999, and only discovered it during his consultancy work for the World Bank after he was freed.

"Wasn't that a paradox? Anwar, who was accused pf being a dependent on the World Bank decided to stop borrowing from the World Bank, but the guy who was anti-IMF and World Bank wrote quietly asking for funds," he said.

anwar ibrahim and dr mahathir mohamadAnwar was the finance minister from 1993 to 1998, under Mahathir's administration. Their mentor-protege relationship collapsed during the 1997 Asian financial crisis, leading to the sacking of Anwar.

He was then found guilty of sodomy and abuse of power, which landed him behind the bars for five years until 2004 after the Federal Court overturned his sodomy conviction.

Mahathir, who has been portraying himself as an anti-Western imperialism leader, accused Anwar of selling out the country by accepting the austerity package prescribed by IMF.

Putrajaya loves cows, but they love Shahrizat more...

Umno has decided to save Shahrizat Jalil and paint her husband as the main actor behind the scandal of the year, the National Feedlot Corporation aka the government's transformation programme (cows to condo).

Leading her defence is the man who helmed the Agriculture Ministry when the NFC project was promoted, Tan Sri Muhyiddin Yassin, best known as a defendant in the Stamford Hills controversy (please Google and read up). His main argument is that why single out the minister when she had no role to play in the NFC.

I suppose that sounds fair except that we still don't why Muhyiddin and his ministry officials approved this project to greenhorns. If the opposition does some digging, it will realise that as early as two years ago government officials felt that NFC was doomed.

Also, as the disclosures by the opposition show, Shahrizat's expenses were paid by funds from NFC and that her husband and children were paid silly money every month. They also set up some restaurants and the beef from the NFC made its way there.

Muhyiddin and friends would like us to believe that Shahrizat was completely in the dark about the financial benefits which accrued to her family after their involvement in the NFC.

I am told that there are vouchers which would make quite a few politicians blush. Maybe this is why Umno is worried! about l eaving Shahrizat out to hang.

Already, you have Cheras Umno leader Syed Ali Habshee clarifying his comments and saying that he did not single out Shahrizat but her husband.

It is clear that the government will appoint some auditors to do some study on the NFC, buy some time and then lump all the blame on everyone, except the minister.

All's well that ends well. Only one small problem, more than RM90 million will be lost for forever. - Gomen Man

Hawker livid over ‘double standard’ DBKL

KUALA LUMPUR: He has seven children, three of whom are in university and the rest in school. His only income comes from running a small foodstall in Taman Sri Sentosa here and he barely makes ends meet.

Previously, Ahmad Rasheed Khan Mohd Kassim, 54, operated a bigger and more profitable stall located opposite his current outlet. But this was torn down by the City Hall (DBKL) in 2003.

When he attempted to re-open the stall three years later, it was torn down again within days and the same reason was given – the stall sat on a pedestrian walk and posed a danger to the public, especially the blind residing in the area.

Left with no choice, Rasheed opened the smaller stall at a shoplot ramp.

As business was slow, Rasheed decided to apply for a license to operate at the old site again but his application was rejected by DBKL on numerous occasions.

However, Rasheed was shocked to discover a new stall operating at the old site last month.

"Whenever I see that stall, I feel like I am being stabbed in the heart. Words cannot describe the pain and anger I feel," he lamented.

Speaking to FMT, Rasheed said the new stall was owned by a woman known only as Siti Mariam, whose workers had told him that they have a licence from DBKL.

"How can this be?" he asked. "They denied me a licence but gave her one."

Accused of being a non-citizen

Adding salt to the injury, DBKL officers had seized several items, including the tables and chairs, from his current stall on Nov 16.

He had begged the officers to stop, saying that his application for a licence was pending at DBKL but his pleas went unheeded.

"When I told them about Siti Mariam's stall, the officers replied that they knew what they were doing. In the end, only my stall was affected, not hers," he added.

According to Rasheed, one of the officers even went to the extent of declaring the former as a non-citizen by writing it on the seizure notice and on one of his tables.

The hawker, who hails from Penang and posseses a valid MyKad, criticised DBKL for their double standards and called its officers inhumane.

"It took only days before DBKL demolished my old stall in 2006 but Siti Mariam's stall is left intact. If they are operating illegally, DBKL should have seized their tables and chairs as well.

"But if they do have a license, how is it that DBKL rejected my application while allowing a new operator to do business there? I was there first," he said.

Rasheed said that all he wanted was to have a license to operate his stall in order to feed his children.

"I'm not expecting handouts from the government. Just give me my license and I will earn a living," he added.

Initially, he alleged, DBKL refused to return the items seized from his stall until he approached Federal Territories and Urban Well-Being Deputy Minister M Saravanan's aide R Nirmalan last month for assistance.

"Even then, some of the items were missing from DBKL's store," he said.

'Friends in Umno and DBKL'

Meanwhile, a lorry driver, who resides in the area, said DBKL should have been fair to Rasheed by awarding him a license to operate at his old site.

"Although I am a personal friend of Siti Mariam, I believe DBKL has done a great injustice to Rasheed. He was there for 20 years.

"While Rasheed's sole income comes from his stall, Siti Mariam's family is rich and owns other businesses. They don't depend on this stall," said the driver, who requested anonymity.

He also claimed that Siti Mariam had close ties with those in Umno and DBKL.

Bukit Bintang MIC youth secretary and former Taman Sri Sentosa resident Yesu Samuel also believes that Rasheed should be given a licence.

"Everyone in the area knows Rasheed, he has been running a stall for a long time. Even I know him for more than a decade," he said.

DBKL's business facilitation and petty traders management deputy director Ibrahim Yusuf could not be reached for comment.

Indian firms to Najib: Help us get TM jobs

KUALA LUMPUR: The Malaysian Indian Telecommunication Contractors Association (MITCA) has decided to seek Prime Minister Najib Tun Razak's help to stop the alleged sidelining of its members by Telekom Malaysia (TM).

MITCA president L Puganesvaran told FMT that TM had not awarded a single contract to any company operated by Malaysian Indians in the last 20 years, and the association was seeking redress by banking on Najib's promise of fairness to all Malaysians.

He said Najib could prove his sincerity by pressuring TM to stop the discrimination.

"There is no point talking about the 1Malaysia policy if giant companies like TM don't support it," he said. "We hope Najib will cater to the plight of MITCA."

Puganesvaran said MITCA's members were especially keen to take part in the national High Speed Broadband (HSBB) project that TM is spearheading, but added that the government-linked company had virtually ignored Indian contractors. "Are Indian companies not good enough for the HSBB projects?"

According to him, TM last year awarded RM1.18 billion worth of contracts to four foreign companies and RM600 million worth to 200 bumiputra companies.

The entire HSBB project is estimated to be worth RM11.3 billion.

"It is a lavish project," Puganesvaran said. "What's wrong if TM channels, say, RM1 billion worth of projects to Indian companies?"

Taib’s sister ordered to pay natives

KUCHING: The Kuching High Court today ordered Quality Concrete Holdings, a company owned by Chief Minister Taib Mahmud's sister Raziah, to pay RM160,000 in damages to Numpang Anak Suntai and Iban landowners in Sebangan and Sebuyau areas.

The other defendants were Loyal Billion Sdn Bhd, the Director of Forests, Director of Lands and Surveys and the state government.

Numpang and 14 other landowners had, on behalf of 276 Ibans, sued the companies and the government for encroaching into 3,305 hectares of forests which they claimed were their native customary rights (NCR) land.

Quality Concrete, which is owned by Raziah Mahmud, is the main licence holder while Loyal Billion is the contractor.

When the case came before Judicial Commissioner Ravinthran N Paramaguru today, lawyers for the defendants told the court that the Director of Forest had agreed to exclude three areas on the western side of the timber licencee (T/8473), which is within the area marked as NCR.

The defence counsel said that there was no more timber licence granted on any part of the area claimed by the natives as NCR land in a marked map which was attached to the statement of claim.

Both lawyers for the natives and defendants agreed to an amicable settlement on damages.

Case against government to proceed

In their suit, the natives had claimed that their land was damaged as a result of the construction of roads and extraction of timber from the land, which is not a licensed area.

They also alleged that the rivers, which are important for their daily needs, have been polluted by the logging activities.

This had also affected their farms, hunting and fishing ground as well as their cultivated gardens.

The natives wanted the court to assess the losses and damages suffered by the people.

In consenting to the order, Justice Ravindran ordered the second defendants to pay to the plaintiffs RM160,000 in damages.

The judge said the consent order shall not in any way affect the natives' claims against the Director of Forest, Director of Lands and Surveys and the the state government.

He ordered the payment of RM160,000 to be made to Baru Bian Advocates and Solicitors.

He also ruled that Quality Concrete and the Loyal Billion cannot submit their application for renewal of timber licence over the said licenced area.

Meanwhile, the Ibans suit against the Director of Forest, the Director of Lands and Surveys and the state government over their claims that 3,305 hectares of the forest are part of their NCR land will proceed next.

Interlok to be scrapped next year?

PETALING JAYA: The government is expected to be pull out Interlok, the Form Five Malay literature textbook which ignited a firestorm of controversy, from schools altogether.

FMT understands that Deputy Prime Minister and Education Minister Muhyiddin Yassin will be making an announcement to that effect soon.

It was learnt that MIC deputy president Dr S Subramaniam had raised the matter at the last cabinet meeting on Wednesday.

Subramaniam said: "I requested the deputy prime minister to ensure that the novel is not used as a textbook in schools next year.

"He responded favourably and was quite positive about it. I hope this would quell the unhappy feeling still felt in the Indian community," said Subramaniam when contacted today.

Asked if he could confirm that the book would no longer be used in schools, the Human Resources Minister said Muhyiddin would make a formal announcement as soon as possible.

The novel is compulsory reading for Form Five students as part of the Malay Literature subject in Selangor, Kuala Lumpur, Negri Sembilan and Putrajaya.

Racially insensitive

Penned by national laureate Abdullah Hussain, the novel, set in pre-independence Malaya, chronicled the daily lives and struggles of three families – a Malay, Chinese, Indian and how each of them contributed to the formation of the country.

It sparked an outrage, especially from the Indian community, as several portions of the text were deemed racially insensitive.

Among several examples, the novel contained "offensive" words such as 'India Pariah', 'Melayu Malas', 'Cina Kuai', 'perempuan totok', 'babi' and 'syaitan putih'.

The book was also criticised for portraying "unhealthy elements" such as "pre-marital cohabitation, infidelity, spirit worship, trading in humans".

Several quarters, including MIC, Gerakan and Pakatan Rakyat, and many NGOs had urged Muhyiddin to, either review, censor or ban the book entirely.

The education ministry subsequently agreed to withdraw the books from schools, and reprint an amended version despite repeated calls for a total ban.

Among others, Muhyiddin announced that the word 'kasta Paria' (Pariah caste) was deleted, replaced with "golongan yang sama" (same group).

Muhyiddin had said with the reprint, the government was satisfied that the Interlok issue has been settled amicably, though the limited amendments did not go down well with many quarters.

However the latest development now appears as though the government has decided to remove the book totally from the syllabus.

Putrajaya having a cow, but Shahrizat saved? — Gomen Man

DEC 16 — Umno has decided to save Shahrizat Jalil and paint her husband as the main actor behind the scandal of the year, the National Feedlot Corporation aka the government's transformation programme (cows to condo).

Maybe this is why Umno is worried about leaving Shahrizat out to hang.

Najib’s split personality

By Mariam Mokhtar | FMT

Najib plays different tunes for political purposes but in the process, it is causing a rift in Umno.

At the Selangor Taoist solidarity dinner on Wednesday night, Prime Minister Najib Tun Razak recalled Tunku Abdul Rahman's long-term vision and praised him for being "far-sighted in administering a complex nation such as Malaysia". His remarks were at odds with the opening speech at the 62nd Umno general assembly, a fortnight ago.

The solidarity dinner saw Najib urging Malaysians to emphasise the similarities in their respective religions, for a stronger and more united Malaysia. He espoused universal qualities like courtesy, filial piety, trustworthiness and diligence as shared values.

"If we can emphasise on the common values, then we will have similarities between us. We can develop good citizens regardless whether they are Muslims, Hindus, Buddhists, Christians, Taoists… what is important is being good citizens who love the nation, are loyal to the country, respect the law and other religions."

At the Umno party conference, Najib was playing a different tune. He told delegates that if Umno were to lose power, the Malays and their religion would be threatened.

Using the favoured "3R" strategy of race, religion and royalty to win over the dwindling Malay support, he warned: "Who will preserve the sanctity of Islam? Who will protect the Malays and its agenda and who will protect the rulers?"

Najib may have adopted a nationalist leaning at the Umno conference, but he played to the crowd at the Taoist solidarity dinner and related his version of events which prompted the downfall of the Malacca empire 500 years ago.

"It f! ell not because Malacca lacked warriors or due to poverty, it was overthrown because there was no unity and there were traitors."

He praised his "1Malaysia" concept of inclusive policies which sought to eradicate poverty regardless of race.

"When the government extended the RM100 (school assistance), every student irrespective of whether he or she is from sekolah kebangsaan, or Chinese, Tamil or religious schools got it, and soon we will give the RM500 assistance to households earning below RM3,000 (per month)".

Ultra-Malay

Political observers slammed him and said that Najib's administration was politicising government aid. In mid-November, PKR Ampang MP Zuraida Kamaruddin claimed that students from a primary school in Ampang had to collect their RM100 aid from the Umno division head, at the Umno building.

Investigations by an online newspaper revealed that a directive had been issued by the secretary- general of the Education Ministry Rosli Mohamed, dated Nov 11, which stated that "elected representatives, including members of parliaments, state assemblypersons or leaders from the federal government" were to be present during the disbursement of the aid. Rosli claimed that the decision had come from a Cabinet meeting on Oct 28.

Pressure has been exerted on Najib to recapture the Malay vote for Umno in the 13th general election (13th GE). Last week, in Shah Alam, Najib openly endorsed the Malaysian Missionary and Welfare Association (Pekida) in exchange for their votes, in scenes reminiscent of his infamous "You help me, I help you" plea in the Sibu by-election.

Around 12,000 Pekida members gave Najib their pledge of allegiance after he had promised to help them build a college in Malacca. Earlier, Pekida's deputy president had openly solicited for funds, to help alleviate its burden and to assist its ayahandas (godfathers) and adik-beradik (lieutenants).

Najib said he was touched by their gesture and urged Pekida's members to! help hi m secure victory in the 13th GE by warning them of what lay in store, if Umno were to lose.

"Pekida must be ready to defend our administration. We cannot allow the Malays diinjak-injakkan (to be stepped upon) on our own land." He might have added, "By anyone but Umno."

Selangor PAS condemned Najib for his ultra-Malay stance and said that he had "forsaken his own wasathiyah (principle of moderation) and "1Malaysia" rhetoric. Selangor PAS deputy commissioner Khalid Samad described Pekida as a "dodgy" organisation which Umno once avoided having official links with.

Khalid said, "His (Najib's) presence at a Pekida function has shown his 'hardline' side, akin to an 'ultra-Malay'. It is a departure from the wasathiyah or moderation that he once espoused."

Extremist rhetoric

Najib is not averse to extremist rhetoric to stoke nationalist feelings, when he deems it politically expedient.

Besides the pressure from Umno infighting, Najib is trying to curry favour with Umno chief supremo, whom younger Umno delegates affectionately term "the don" – Dr Mahathir Mohamad.

Najib seems oblivious that Umno has ceased to be a party which fights for Malay issues. Both Najib and Umno refused to acknowledge that the younger generation and changing times, mean that Malays have begun to embrace the 21st century.

Nowadays, Umno is characterised by a party with several factions, all vying for power and glory – Najib's lot, Deputy Prime Minister Muhyiddin Yassin's bully boys or the militias who still swear allegiance to Mahathir.

They wish to carve up the billions of ringgits in contracts, land grabs and monies siphoned from public institutions, for themselves. They are not concerned about the well-being of the rakyat, nor the interests of the Malays. The party is supposed to uphold the interests of the Malays.

The Malays are only mentioned in passing and come in useful when the leaders need to further their need! s. The n on-Malays make useful scapegoats to rouse sentiment in the Malays.

Najib's inability to deal with his split personality may well hasten the split in Umno, and lead to its demise.

Villagers ask state govt to save temple

BUTTERWORTH: The management committee of a Hindu temple facing demolition wants the Pakatan Rakyat state government to resolve the issue amicably with a developer.

The temple, Sri Siva-Sakti Alayam, located in Kampung Musang, some 100m from the ferry terminal here, has already been issued an eviction notice in August 2010, to pave way for a new township development.

Temple chairman and priest V Sutesh said the temple management committee had requested the developer Chiap Thian Holding Sdn Bhd to maintain the temple on its current site or rebuild it on a viable alternate site.

The developer had originally offered a mere RM18,000 as a compensation to the temple committee.

But the committee turned down the offer. The committee's argument was that it was a more than 50-year-old temple belonging to the Hindu community.

The temple committee, a registered body under the Registrar of Societies, has asked the Bagan Dalam assemblyman A Tanasekharan to help resolve the issue.

But, claimed Sutesh, Tanasekharan had advised the committee to accept the compensation and leave.

Disappointed with Tanasekharan's advice, the temple committee has now turned to the state government for help.

Rama to hold meeting

Deputy Chief Minister II P Ramasamy said the state government would talk to the developer to maintain the templeat the same site.

Ramasamy plans to hold a meeting soon with the developer, together with DAP assemblymen in the area – Tanasekharan, Phee Boon Poh (Sungai Puyu) and Lim Hock Seng (Bagan Jermal), and the temple committee.

"We will talk to the developer to resolve the issue amicably," Ramasamy told FMT.

Sutesh said the temple has been serving Hindus living in the village and surrounding vicinity for more than two generations.

There were some 200 Hindu families once living within the temple vicinity.

Currently many villagers have already shifted elsewhere after accepting the developer's compensation offer, leaving only the temple and a handful of households awaiting compensation and eviction.

The temple sits on a 4,000 sq ft private land, whose previous land owner had sold it to the developer.

Lembaga Zakat Masih Tolak Laporan Audit Dibentang Pada Umum

Begitu bersemangat Pusat Zakat Selangor ingin mempertahankan diri mereka.

Give MACC time to prove its track record

FMT LETTER

From Jeong Chun Phuoc, via e-mail

I refer to the article, 'MACC: Biting the Political Neutrality Bullet', by Lim Teck Ghee and others who shared his views.

I believe in the idiom "Rome was not built in a day" and hence, we must be "constructive not destructive".

At Stage One of the MACC Implementation process, there are bound to be hiccups. These of course  require  time and constructive criticism to iron out unintended consequences – especially from a legal and compliance perspective.

I believe that Malaysia will improve its transparency performance under the various transformation programmes and initiatives.

I believe the opposition parties are also trying their best to work on areas of critical importance.

In a nation building process, all political parties must work together to ensure holistic transformation in all critical areas, and particularly so, in the area of environmental transparency transformation blueprint.

Aziz Bari tak minat politik, bimbang tak diterima

"Kalau jadi ahli politik kena masuk parti.

"Mereka kata saya ketua Pemuda (PAS) paling pengecut! Letak jawatan sahaja lah!

Akhir sekali terdedahlah sikap mereka sebenarnya.

MUSTAFFA : Memang betul Hassan Ali rujuk kenyataan Saari.

jika tak hadir mesyuarat nak tegur macam mana?

selaku Pesuruhjaya PAS Selangor.

Tetapi Nasharudin tak buat macam Hassan lah, dia tak jumpa mana-mana pimpinan.

< /span>
