Human rights at KLCC: no money no talk

Yellow Mob goes shopping for human rights

Fadiah Nadwa Fikri, a human rights lawyer, spent RM55 on the book You Cannot be Neutral on a Moving Train at the peaceful protest inside KLCC Suria shopping centre yesterday.

KLCC sees a yellow peril

On Thursday, KLCC management threatened to obtain an injuction to stop another Yellow Mob gathering, after two previous peaceful gatherings at KLCC Park, and said they would hold the organisers personally liable for any losses or damage suffered by tenants of the shopping centre. KLCC alleged that the past two gatherings had "eroded and impeded the regular shoppers and visitors and members of the public to the premises" and had disrupted business operations at the shopping centre.

Activists later said the law firm of Zul Rafique is owned by the brother of former federal territory minister Zulhasnan Rafique, the MP for Setiawangsa and a member of the Umno Supreme Council.

The protest gatherings, with people turning up dressed in yellow, are being held against the government's repressive Peaceful Assembly Bill now before the Senate.

Last week, national laureate A Samad Said recited his poem Missing Space to about 400 peaceful protestors after KLCC workers cordoned off the water fountain area fronting the Suria shopping centre. The previous week, protestors were showered with water after workers turned on the sprinklers.

Two DAP leaders get death threats

GEORGE TOWN: An assemblyman and a branch leader have received death threats for supporting the DAP's Indian grassroots members' uprising against Penang Deputy Chief Minister P Ramasamy.

DAP's Seri Delima assemblyman RS Nethaji Rayer has been receiving death threats repeatedly from the same unidentified caller since 9pm last night, while Datuk Keramat branch vice-chairman A Krishnan received the same threat at 11.20am today.

Rayer said he has identified the mobile number from which the death threats were made to him by a male caller speaking in Tamil.

"The caller told me not to talk about Ramasamy at the state convention if I wanted to see my family alive," he told FMT.
Rayer has been vocal against the embattled Ramasamy who recently called DAP national chairman Karpal Singh a godfather.

Krishnan said he received the death threat today while he was chatting with friends at coffee shop in Butterworth for going against Ramasamy.

"The caller told me in Tamil I will be finished if I spoke up against Ramasamy," said Krishnan, who is also the state DAP Indian bureau vice-chairman.

Police reports

On Tuesday, Krishnan and several other party ethnic Indian grassroots leaders and members called on Ramasamy to make a public apology to Karpal over his 'godfather' remark.

Krishnan said the caller used vulgarities on him for teaming up with assemblymen RS Nethaji Rayer (Seri Delima) and A Tanasekharan (Bagan Dalam) to criticise Ramasamy,.

Both Rayer and Krishnan will lodged police reports at the Datuk Keramat police station this evening.

Batu Kawan MP and Prai assemblyman Ramasamy is under fire for his announcement in Tamil daily Makkal Osai on Nov 28 on the party's Indian candidates for the 13th General Election.

Karpal, the Bukit Gelugor MP, rapped Ramasamy for acting like a warlord and the latter returned fire by calling the party to get rid of godfathers, in an apparent reference to Karpal.

Party grassroots are angry that Ramasamy, who joined the DAP only six months before the last general election in March, 2008, for his insolence.

They also felt that Ramasamy had gone overboard and usurped the power of the party's highest decision making body, the central executive committee (CEC).

They called on Ramasamy to publicly apologise to Karpal and the party's senior leaders. Ramasamy has thus far remained defiant and has not heeded the call.

The fiasco is set to take the central stage at the convention.

‘Jangan politikkan perpustakaan’

Anything but UMNO? Have we gone bonkers!

  • I saw ABU (Asalkan bukan UMNO) press release on Malaysiakini TV. There was a strong a strong chill in my spine. I felt nauseated. It reminds me of Khir Toyo announcement that he plans for "Sifar Pembangkang" or "zero Opposition" in Selangor prior to 2008 election. That was the last time I sensed the same chill feeling in my spine. Personally I disagree with the NGO that is backing this ABU plan. It is simply unpalatable.
  • Clearly UMNO is being targeted because PR wants to split the cohesion of BN. By targeting the key member of BN, they are sizing their fight. We can see that since UMNO has been under attack, the other component party members have been relatively silent and watching from the sideline. For anyone to damn UMNO in such a manner, he must also damn almost all ex UMNO members that are in PKR today. They are same man without spines who had switch camp without principles. I have more respect for the fresh PKR member than this ex UMNO members.
  • Is it fair to damn UMNO in such a manner? Is it fair to condemn 3 mill UMNO members in such a manner? It is like damning Toyota or Honda because there are some lousy models out there. I firmly believe there plenty of self centered people in both UMNO and PKR whose main interest is not the nation. Hasn't this been proven with several PKR characters that have jumped ship? For the record there are thousand of guys in PKR that is the same. Shouldn't the target be PKR where they must clean their house? The de-facto leader shook my hand and says that we should not worry and say he will help in UKB. Nothing happened since that day. One character lied and misled thousand of house buyers and the MB still does not have the courtesy to reply my letter or give me an appointment.
  • I have met some very good and honest people in UMNO in the last few years. I have met some hard working people in PR also. For the record I have met and dealt with ass-holes in both sides of the camp. Frankly speaking, we as the voters must think and don't simply condemn a brand. Look at the candidates. Balance of power is important. Are we blinded by this hatred? Will the ABU plan backfired as what happened with KT "zero opposition" plan?  My crystal ball says it will.

Not too late for Najib to heed opposition to Peaceful Assembly Bill, withhold it from Senate and set up instead a PSC to conduct full consultation on Bill

After the Prime Minister, Datuk Seri Najib Razak's boast and claim during Malaysia Day celebrations this year to make Malaysia "the best democracy in the world", Malaysia should stand tall today to celebrate the International Human Rights Day.

But this is not the case.

Just like yesterday's International Anti-Corruption Day, the Malaysian Government is quite sheepish and quite guilty-conscious about the event.

Result: no word or message by Najib whether on International Anti-Corruption Day or International Human Rights Day!

On yesterday's International Anti-Corruption Day, there was nothing the crow about as it was about a week ago that Malaysia suffered the nation's worst international report card on its anti-corruption front, when Malaysia suffered the worst Transparency International (TI) Corruption Perception Index (CPI) for the year 2011 – ranked No. 60 with score of 4.3 when Malaysia was ranked No. 23 in 1995 and scored 5.32 in 1996.

For today's International Human Rights Day, Malaysia has also nothing to crow about despite the Prime Minister's promise in September on Malaysia Day to usher in a whole series of democratization and "political transformation" like repeal of the draconian Internal Security Act and review of the undemocratic Section 27 of the Police Act "taking into consideration Article 10 of the Federal Constitution regarding freedom of assembly and so as to be in line with international norms of the same matter".

This is because all the hoopla and euphoria of a Najib "democratic spring" had been nullified by the indecent haste with which the Peaceful Assembly Bill had been drafted and rushed through the Dewan Rakyat, without giving all stakeholders, whether political parties, MPs, human rights groups, NGOs and the civil society adequate time to be consulted to ensure that we have a legislation which genuinely facilitate the expression of the fundamental right of freedom of assembly by Malaysians instead of an even more restrictive and repressive law hampering the freedom of assembly by the citizenry.

As has been cynically pointed out, Rudolf the red-nosed Reindeer and Christmas caroling may be required under the Peaceful Assembly Bill to get police permits before making their annual rounds to spread Christmas cheer!

For the first time in the nation's history, a whole phalanx of United Nations human rights rapporteurs have ganged up to denounce the Peaceful Assembly Bill as a grave threat to human rights.

UN Special Rapporteur on the rights to freedom of peaceful assembly and of association Maina Kiai voiced "deep regret" that the Human Rights Commission of Malaysia (Suhakam) or civil society was not meaningfully consulted in the drafting of the Bill.

He said the Bill contains a vague definition of assembly and also places broad restrictions and conditions on gatherings, giving "excessive authority" and power to law enforcement officials and the home minister.

"Many of these restrictions are not justifiable under international law. It also gives discretion to the police to make any form of recording of assemblies," he said.
Another Special Rapporteur, Margaret Sekaggya said she is alarmed by the provision prohibiting citizens below 21 years of age to assemble.

"Political and social participation through peaceful protests are not only an educational experience for children, youth and students but also an investment for society as a whole," she said.

Frank La Rue, another Special Rapporteur on the right to freedom of expression, has urged the Malaysian government to seriously reconsider the adoption of the Bill.

"The ability of all individuals to express themselves freely, including in the form of peaceful assemblies, is a litmus test for the level of democracy in any country."

Fracois Crepeau, a Special Rapporteur on the human rights of migrants, called for an urgent review of the Bill.

"Everyone has the right to freedom of assembly and association, without distinction of any kind, including nationality," said Crepeau.

The Prime Minister must be mindful that Malaysia is a member of the UN Human Rights Council until 2013 and we should be setting an international example of compliance, respect and promotion of the universally-recognised human rights in international covenants.
It is not too late for Najib to heed the opposition of Malaysians and UN human rights experts to the Peaceful Assembly Bill, withhold it from Senate and set up instead a Parliamentary Select Committee to conduct full and nation-wide consultation on the Bill.

This will really make International Human Rights Day 2011 meaningful and memorable.

Sepatutnya Najib arah Sharizat bercuti bukan Pengarah Besar Felda...

"Kalau dikatakan beri peluang Datuk Zul sambung belajar, belajar apa?

No flashmob but protest against Bill continues

KUALA LUMPUR: About 100 people gathered peacefully at  Kuala Lumpur City Centre (KLCC) today despite the threats of legal action from the shopping mall's management.

The organisers of the campaign against the Peaceful Assembly Bill were forced to switch plans from holding a flashmob to shopping for yellow items instead.

The KLCC management said opponents of the Bill had on two previous occasion disrupted business operations of the tenants in KLCC and threatened legal action to stop them today.

Renamed, 'Malaysians Can Go Shopping & Pose with X'mas Trees without Police Permit', today's gathering saw many in yellow outfits congregating in front of huge Christmas trees on display at the centre of the mall.

Some were also seen displaying receipts of their purchases made in the mall  to show that the assembly also benefited businesses in the premises.

Sporting no banners or placards, the group snapped pictures and chanted, "Kill The Bill", "Happy Human Rights Day" under the watchful eyes of security personnel.

The protesters also sang songs including  a Christmas carol, "Jingle Bells", "Happy Birthday" to a participant celebrating his birthday today and the national anthem "Negaraku".

Human Rights lawyer, Fadiah Nadwa Fikri who was one of the protesters said that the gathering was to show the public what it meant to assemble peacefully.

"We are here to show our resistance to the repressive Bill. We are here to show that we can practice our rights peacefully.

"We have the right to be here…we are showing the public that this is what peaceful assembly means," she said.

'A leaderless movement'

The KLCC management, had on Thursday, urged the organisers to discourage 3,555 people who were invited via Facebook from gathering today.

They threatened the organisers with an injunction, seven of whom were named in the legal letter, including activist Wong Chin Huat.

Wong, however was not seen today. Vienna Looi, one of the organisers of the event, said that she was tied-up with training programme today.

Asked if she was a disappointed for not being able to join the gathering, she said that the movement need not have a 'clear leader'.

"It is a people's movement, a leaderless movement. We don't want to have a ring-leader. We merely want to make this a persistent movement," said the first-year law student.

She added the movement wanted to illustrate to the public that a peaceful assembly can take place regularly and wanted to make it a new trend in Malaysia.

Commenting on the threat of legal action, she said that she did not think the management of KLCC were behind the legal notice.

"There are other parties pushing for this," she said without elaborating.

Today, coincidentally, is International Human Rights Day.

NGOs laud inclusion of aerobridges at KLIA2

PETALING JAYA: Imagine yourself wheelchair-bound, staring down from an airplane doorway to the ground almost five metres below. You have to negotiate a dangerous gap if you want to get onto an ambulift which will lower you down.

This is what Danny Tan, who has muscular dystrophy and wheelchair-bound, has had to endure whenever he wanted to fly. But sometimes it was even worse for Tan, whose limbs are stick-thin and his bones fragile due to his condition.

"Earlier this year I returned from China, it rained heavily when I touched down at the LCCT Terminal and they told me the ambulift was not available and asked if they could carry me," said Tan, who take flights 4-5 times a year.

However, Tan told the crew only his wife knew how to lift his body correctly without injuring his brittle bones.

"I believe they just wanted to save time by not providing the ambulift. My wife had to walk down the staircase while the air hostess held an umbrella over me," said Tan, who is chief coordinator for the Shuang Fu Disabled Independent Living Association.

Such inconvenient and stressful situations are commonplace for disabled and that is why they have been especially vocal about having aerobridges for the impending KLIA2.

Today, a group of 10 NGOs fighting for the disabled held a press conference to welcome the decision made by Malaysia Airports Holding Berhad (MAHB) to install aerobridges at KLIA.

"We thank MAHB for taking into consideration the voices of the people including us, persons with disabilities," said Barrier-free Environment and Accessible Transport (BEAT) pro-tem president Christine Lee.

The disabled community, including BEAT, has been lobbying for the inclusion of the aerobridge, and has held two protests – once in August and another in October, asking MAHB and the government for it.

Lee had also personally met with Transport Minister Kong Cho Ha over the matter in September. He thanked Kong, the cabinet, as well as politicians from both divides.

On Nov 29, MAHB confirmed that the new LCCT in Sepang (KLIA2) will include 80 aerobridges, when it is due to be completed in April 2013.

MAHB managing director Bashir Ahmad had said aerobridges would help those with restricted movement, expectant mothers, young children and the elderly.

'We deserve to be accorded equal rights'

However, AirAsia CEO Tony Fernandes, who has been a vocal opponent of the use of aerobridges, said his planes will not be using the aerobridges even if they were built at KLIA2. He claimed it was a waste of money as customers did not want them.

"We are disappointed that AirAsia is not going to use aerobridges when KLIA2 is completed. We urge AirAsia not to disregard the needs of its passengers especially persons with disabilities, people with reduced mobility, elderly, pregnant women and children," said Damai Disabled Persons Association of Selangor and Federal Territories Malaysia, V Murugeswaran.

Murugeswaran said Aerobridges were not only necessary but crucial to ease mobility, enhance the safety and security and comfort of all passengers in all weather conditions.

"As full paying consumers, we deserve to be accorded equal rights to enjoy basic public facilities and services that are convenient and safe for us to use.  An aerobridge could determine whether we can fly or not.

"We call on the government to ensure that all newly built airports be equipped with aerobridges. We also urge the authority to come up with regulations to make it mandatory for all airlines, including budget air carriers, to use aerobridges at airports where provided," said Murugeswaran.

Asked about the view that aerobridges were too costly and ambulifts were sufficient for the disabled community, Murugeswaran said that the extra cost incurred by MAHB were not from the aerobridges.

"When they announced that KLIA costed about RM2billion, the plan already included aerobridges, and they initially scrapped it just because one airline was against it," said Murugeswaran.

Lee said that ambulifts were not the solution for disabled people.

"Ambulifts are problematic and dangerous and furthermore, with the increasing volume of flying customers, it would not be enough.

LCCT currently only has two. Aerobridges would be much safer and more convenient, for all, not only for us," said Lee.

"Asal Bukan UMNO"....Idamanku

Atas sebab itulah begitu marah kepimpinan UMNO apabila kempen "Asal Bukan UMNO" dilancarkan semalam.

Ia bakal mengagalkan propaganda terbaru UMNO yakni "undi UMNO = Pertahan Kekuasaan Melayu".

Umno K’tan siap senarai awal calon

Healing house turns killer inferno

Last September, there was a minor electrical short-circuit inside a theatre at the Venice International Film Festival. In 30 seconds, just every exit was opened, and journalists and delegates walked out. Of course, there was no fire or smoke, but a faint smell of burning rubber that alerted volunteers and others inside the auditorium.

I was amazed at this phenomenal efficiency – and the enormous concern for human safety.

In India, on the contrary, doors are always locked making it difficult or impossible to escape in the event of a fire.

In 1997, 59 men and women died and over 100 were grievously injured during a fire at Uphaar cinema in New Delhi's upmarket Green Park. A then colleague of mine at The Hindu who was watching the film (a patriotic Hindi work, Border) could flee the theatre only because a staffer helped her out. The others were trapped inside the hall, because the exits were locked from the outside, and the staff ran away without opening the doors!

There have been other fire tragedies in India – and sadly most casualties arose, because people could not run out, and died of suffocation.

In 1995, 360 men, women and children died at a school function in Haryana's Dabwali.

In 2004, 91 children were burnt alive in a school at Kumbakonam in Tamil Nadu.

On Friday, in the very early hours of the day, 84 patients and four staffers died when the plush AMRI Hospital in Kolkata turned into a burning inferno.

Here again, the exits were locked, and people died because of asphyxia. Despite the pleas of local residents, who first noticed smoke rising from the hospital, and the relatives of patients, the security guards in the building refused to open the doors.

Some relatives had even urged the doctors on duty to allow evacuation of patients, but permission never came.

Yet, the doctors, the nurses and other employees, except for four, abandoned their posts and fled to safety later when they saw things getting out of control.

Unsafe basement

The hospital staff took the fire lightly in the beginning, waking up to the life-threatening situation 45 minutes after the blaze broke out in the hospital basement. The fire-brigade was alerted almost an hour after the blaze began, and the first engines arrived 20 minutes after that, an inordinate delay in covering a distance of four km at 2.30 in the morning on deserted roads.

The victims, mostly patients with minor health problems, died because of causes entirely preventable.

Tragically, the victims did not die from burns, but choked to death in the thick smoke that engulfed the hospital interiors. The windows were all locked, the door closed, turning the house of healing into a house of death.

In September, the hospital had been told to clean up its basement stocked with highly inflammable materials, including oxygen cylinders. The basement, meant for parking vehicles, was being used as storage space – clearly in violation of fire safety norms. The hospital did not clear the basement.

The fire reportedly began in the basement and spread rapidly through air-condition ducts.

Although six directors of the hospital have been arrested, one has seen in the past – and on innumerable occasions — how those responsible for such horrendous tragedies escape with shockingly light punishments.

In the Uphaar case, the sentence turned out to be a couple of years in jail.

Ultimately, what needs to be addressed and sorted out is the tendency to cut costs by having inadequate fire-safety equipment and measures. Faulty wiring, ineffective fire extinguishers and abysmal lack of knowledge in the case of something as catastrophic as fire are very common in India.

As newspapers reported on Saturday, there are hundreds of hospitals, cinema theatres and other public places that can turn into virtual death traps if there is a fire. These public places are waiting for calamities to happen, it seems.

The Saturday edition of The Times of India screamed in its front page headline: 89 people gassed to death…

If such roguish callousness on the part of the hospital management and staff was not enough, the Kolkata police tried resorting to a lathi charge when the crowd became hysterical at the sight of West Bengal Chief Minister Mamata Banerjee, who visited the hospital hours after the fire.

There could not have been a greater moment of shame then. How indifferent we are to loss of life, how heartlessly unfeeling, how notoriously shameless — driven as we are by the single motive of profit, greater profit and still greater profit.
