September 16 Gagal kerana UMNO Guna ISA - Datuk Nur Jazlan

6. (C) The two PKR officials acknowledged that the government's September arrests of three persons -- a journalist, an Opposition MP and blogger Raja Petra -- under the Internal Security Act (ISA) had sent an effective warning to those MPs considering switching support to Anwar. (let's mention Petra's release today)

(Comment: In early October, UMNO MP Nur Jazlan told Polcouns that the ISA arrests had been "very successful" in achieving UMNO's objective of intimidating MPs who had considered joining with Anwar. End Comment.)

Maka, janganlah puak2 UMNO memainkan isu kononnya Anwar berbohong ataupun Anwar menjual janji palsu.

SUBJECT: ANWAR SHIFTS GEARS, NOT GOALS, SAY AIDES

REF: KUALA LUMPUR 979 - INITIAL REACTION TO U.S. ELECTION

Classified By: Political Counselor Mark D. Clark for reasons 1.4 (b and d).

Summary and Comment

1. (C) Opposition leader Anwar Ibrahim has shifted to a less aggressive posture for now, but his goal remains bringing down the UMNO-led government through parliamentary crossovers prior to Deputy Prime Minister Najib becoming the next UMNO party president and Prime Minister, according to top officials in Anwar's Peoples Justice Party (PKR).

Part of Anwar's strategy entails reaching out to the "losers" in the transition from Prime Minister Abdullah to Najib, including UMNO veteran Tengku Razaleigh. The PKR officials acknowledged that the government's September arrests of three persons under the Internal Security Act (ISA) had sent an effective warning to those considering switching their support to Anwar.

PKR officials and Anwar's lawyers assume! d the so domy prosecution against Anwar would move forward, with a trial phase likely beginning by January. The Opposition was unlikely to support "superficial" reforms that UMNO would try to rush through parliament as part of outgoing PM Abdullah's legacy.

The Ambassador met on October 30 with Tengku Razaleigh, who complained about his inability to compete in the UMNO nomination process due to money politics and contended that the next UMNO president (Najib) would not necessarily become the next Prime Minister.

2. (C) Comment: We currently are witnessing a different tone and pace in the struggle between the Opposition and UMNO following Anwar's unrealized September deadline and the rapid consolidation of UMNO support behind Najib as the next Prime Minister.

While PKR's rationale for wanting to head-off Najib remains in place, Anwar has lost political momentum for the moment and seems to face increasingly long odds in securing future crossovers. Anwar's ability to attract the "losers" from the Abdullah-Najib transition remains theoretical. End Summary and Comment.

Anwar's Less Aggressive Posture

3. (C) Polcouns met separately with PKR Information Chief Tian Chua and PKR Vice President Sivarasa Rasiah on November 3 and 5, respectively. Both PKR officials acknowledged that Opposition leader Anwar Ibrahim has shifted to a lower key approach since the passage of Anwar's public September 16 deadline to bring down PM Abdullah's government through the crossover of 30 or more government MPs.

Compared with September, Anwar is now more focused on conso! lidating the Opposition People's Alliance (Pakatan Rakyat), which encompasses three parties with often disparate political views: PKR, the Chinese-dominated Democratic Action Party (DAP), and the Islamic Party of Malaysia (PAS). As the formal Opposition leader in Parliament, Anwar is devoting attention to Pakatan's actions in parliament and guiding Opposition MPs, most of whom are sitting in the body for the first time.

Crossover Goal Unchanged

4. (C) Despite his less aggressive public posture, Anwar's goal remains bringing down the UMNO-led government through parliamentary crossovers prior to Deputy Prime Minister Najib Tun Razak becoming the next UMNO party president and Prime Minister, Tian Chua and Sivarasa stated.

The time horizon has shifted from December to March 2009, in line with the shift in the UMNO party elections, at which time Najib is set to become UMNO president uncontested. PKR officials reiterated that Anwar and PKR remain focused on preempting Najib's takeover if possible, because they believe Najib would invoke authoritarian measures to scuttle the Opposition before the next national elections.

In the months ahead, PKR would look for opportunities to weaken support for Najib and the government, for example by criticizing GOM measures in the face of a possible dramatic downturn in the economy following the global financial crisis, or by using new information linking Najib to scandals, like the Altantuya case and the Eurocopter purchase.

(Comment: Anwar and other Opposition leaders have taken up such issues in Parliament over the past few weeks. On Novemb! er 4, An war led a walk-out of Opposition MPs to protest Najib's refusal to allow questions during his presentation of revised budget figures. End Comment.)

Attracting the "Losers"

5. (C) Anwar does not have enough ethnic Malay MPs ready to join the Opposition, according to both Tian Chua and Sivarasa, without which the Opposition faces unacceptable risks of a harsh government backlash justified on the basis of Malay nationalism.

Anwar reportedly hopes to attract disaffected UMNO leaders and MPs who are "losers" in the current transition from Abdullah to Najib; most prominent among these is veteran UMNO leader Tengku Razaleigh Hamzah.

Talks with Razaleigh remain inconclusive because Razaleigh continues to insist on the prospective position of Prime Minister, while PKR estimates that Razaleigh could secure the crossover of only four or five UMNO MPs (see notes below from the Ambassador's recent meeting with Razaleigh).

Anwar is also maintaining contact with PM Abdullah at this stage, primarily through son-in-law Khairy Jamaluddin, Tian Chua said. Whether members of Abdullah's circle would consider crossing over to Anwar remained an open question.

ISA as Warning to MPs

6. (C) The two PKR officials acknowledged that the government's September arrests of three persons -- a journalist, an Opposition MP and blogger Raja Petra -- under the Internal Security Act (ISA) had sent an effective warning to those MPs considering switching support to Anwar. (let's mention Petra's release to! day)
(Comment: In early October, UMNO MP Nur Jazlan told Polcouns that the ISA arrests had been "very successful" in achieving UMNO's objective of intimidating MPs who had considered joining with Anwar. End Comment.)

Sodomy Trial Will Remain a Factor

7. (C) Sankara Nair, a prominent attorney for Anwar, told us on November 5 that, regardless of maneuvers in the current Sessions Court, it only a matter of time before the government shifted Anwar's sodomy case to the High Court, a more favorable venue for the prosecution.

Sivarasa, who also serves as one of Anwar's lawyers, believed that the trial phase of the sodomy case would begin in earnest by January.

Neither Sankara nor Sivarasa believed the government would drop the case.

Opposition Unlikely to Support Abdullah's Reforms

8. (C) The Prime Minister's circle -- through Khairy -- has approached Anwar regarding support for judicial reform measures that would be presented in Parliament soon as part of Abdullah's parting legacy, according to Sivarasa and Tian Chua. The Opposition, however, was unlikely to support these measures because they did not represent meaningful changes.

The Opposition believed, for example, the proposed changes to the Anti-Corruption Commission would leave the body under firm executive control. Following the resignation of legal reform Minister Zaid Ibrahim, N! azri Azi z, de facto Minister for parliamentary affairs, led the judicial reform discussions in Parliament, but he lacked credibility.

Anwar and the U.S. Presidential Election

9. (U) Following his initial remarks of November 5 (reftel), Anwar has continued to comment generally positively on Senator Obama's victory in the U.S. presidential election. Time Magazine highlighted Anwar's remarks on President-elect Obama as the first among those of only 11 prominent world personalities.

Anwar wrote that, "In Obama's victory are sown the seeds of great expectations that a truly new chapter will be written in the history of the world." Anwar publicly claimed he had been in contact with Senator Obama.

Ambassador Calls on Razaleigh

10. (C) The Ambassador met on October 30 with Tengku Razaleigh, who, as the only challenger to DPM Najib for the UMNO presidency, had yet to garner a single UMNO division nomination (he now has one). Casting himself as a reformer, Razaleigh said that he wished to bring greater democracy and transparency to UMNO, but that he could not compete in the current nomination race in the face of engrained corruption and money-politics.

Razaleigh said that Najib's coming to power would allow former Prime Minister Mahathir to regain substantial influence within the government. Razaleigh indicated his relations with Mahathir, his former political rival, remained strained.

11. (C) While Razaleigh conceded that Najib would win the UMNO contest, he stressed several times! to the Ambassador that the next UMNO president would not necessarily become the next Prime Minister, but did not further explain this remark.

Razaleigh speculated that there now existed grounds for PM Abdullah and Anwar Ibrahim to work together, for example on reform measures. Razaleigh thought that Khairy Jamaluddin currently acted as the go-between for Abdullah and Anwar. Razaleigh acknowledged, as he has publicly, that he continues contact with opposition politicians, but he did not otherwise signal he planned to leave UMNO.

Najib: Racism is still the most beautiful ?

Najib sounds election war drums, promises to uphold Malay agenda

KUALA LUMPUR, Dec 3 — In what is expected to be his final parting words to Umno delegates before polls are called, Datuk Seri Najib Razak reaffirmed tonight his commitment to uphold the Malay agenda, denying it had ever been sidelined under his 1 Malaysia platform.

“Who says we do not uphold the Malay or Bumiputera agenda?

Najib delivers his closing address at the Umno general assembly in Kuala Lumpur on December 3, 2011. — Reuters pic

“When I started 1 Malaysia, I did not say ‘let’s neglect the Malay agenda’,” he thundered to thousands of delegates at the party’s general assembly at the Dewan Merdeka hall at the Putra World Trade Centre (PWTC) here.

In his fiery speech, the prime minister also urged his troops to ready themselves for what he said would be “the most critical” elections to date, reiterating that it would be a “tragedy” should Pakatan Rakyat (PR) come to power.

He took pains to beat dents into the federal opposition’s armour, claiming its leaders only know to “crow here and there, lie here and there, cheat here and there, play here and there.”

“The biggest lie in the history of Malaysia, what was it? September 16,” he said to jeers from the crowd.

MORE TO COME

UMNO not dominating, not racist?

If Umno is really serious about reformation and transformation for the nation, then it should set an example by becoming a non-race party like PKR and Kita. This step will go a long way towards eradicating racial politics in Malaysia.

DANIEL JOHN JAMBUN

I congratulate the Prime Minister, Datuk Seri Najib Tun Razak for his sterling performance in his speech at the on-going Umno General Assembly. Even Tun Mahathir who had been so critical of Najib all this while was impressed and expressed support for him because now "he is a different man." The speech achieved its purpose of raising the spirit of the delegates and observers. He may even have discouraged certain factions in the party from possibly putting up a challenge to his leadership.

However, there are two points in the speech which I would like to address, i.e. Najib's assertion that Umno is not dominating, and that it is not a racist party. While I appreciate the good intention of these statements, I feel that they are not totally accurate if we look at the real situation today. Najib's reference to not dominating is on the way he handles party elections, i.e. without dominating the party electoral process like what Datuk Seri Anwar Ibrahim had done in PKR's last party election. However, at the BN level, Umno cannot deny that it is the dominating power over all the other components.

It is Umno which decides many things in the country, e.g. it implements the unwritten rule that only the Umno leader can become the Prime Minister and the Prime Minister and several other senior cabinet posts. The national Barisan Nasional Supreme Council very rarely meets because Umno feels it can make all the decisions without consulting the other component parties because Umno's decisions are seldom, if ever, questioned. And this Supreme Council is very much dominated by Umno as well because Umno holds the post of Chairman (Najib), Deputy Chairman (Tan Sri Muhyiddin), Secretary General (Datuk Seri Tengku Adnan Bin Tengku Mansor), and Treasurer General (Dato' Seri Hj. Ahmad Husni Mohd Hanadzlah), Youth Chief (Datuk Khairy Jamaluddin, who is also the Umno Youth Chief) and Women's Chief (Dato' Seri Shahrizat Abdul Jalil, who is also the Umno Wa! nita Chi ef).

The various component party leaders are appointed as Vice Chairmen and their Deputy Chairmen and Secretary Generals as Committee Members. At one time the MCA had questioned this arrangement in which the BN Supreme Council doesn't have any say on the appointment of the Prime Minister and cabinet members. In fact, one can ask what the BN Supreme Council is really for if almost all BN decisions are made by Umno.

At the state level in Sabah, the Umno is also the one dominating all the senior posts, including the Executive Secretary's post. In the same style as the national BN, the state BN also seems to have little purpose because it seldom meets. Because it rarely meets, the component parties have no opportunity to express their views on many issues, and this causes them to voice out all sorts of grievances about their own coalition or about other components through the media.

As to the issue of whether Umno is racist or not, it is quite clear that this time around the Umno is trying very hard to show that it doesn't want to hurt the feelings of other races, like it did a few years ago during which the delegates spokes so angrily about Malay rights that an MCA leader admitted he feeling was hurt. But being racist doesn't mean you hate other races. Racism can also be expressed by too much talk about your own race, to demand rights for your race and your religion.

In this General Assembly, Umno delegates still had not managed to control themselves from doing this. Before the assembly, Perkasa had urged the delegates focus on Malay interests. After all, this has been the tradition of Umno for half a century. As "the" Malay party, it is supposed to keep fighting for Malay rights and interests, because it must also try to upstage PAS in the effort to garner Malay support. So in a lot of sense, Umno is racist and has to be racist, just like MCA and MIC also have to be racist because they are not multiracial parties.

This ma! kes us w onder, if maybe Umno needs to reevaluate its position as a Malay party. As the backbone of the BN, shouldn't Umno be trying to be the leader of all Malaysians regardless of their race and religion? Why should it continue harping on Malay interests, rights and to keep hinting on Malay supremacy as the senior partner in the ruling national coalition? Realistically, it should be a party of Malaysians, not of Malays. If Umno is really serious about reformation and transformation for the nation, then it should set an example by becoming a non-race party like PKR and Kita. This step will go a long way towards eradicating racial politics in Malaysia. If Umno continues to talk about transformation while it continues to be a racial movement, then Umno is just being hypocritical about change and renewal for the country.

Najib urges Malaysians to make sextape en-masse ?

"We Cannot Give Away Our Country to the Opposition"

KUALA LUMPUR, 3 DECEMBER, 2011: Umno President Datuk Seri Najib Tun Razak urged PAS to leave the Democratic Action Party (DAP) if they really wants to fight for Islam.

He said PAS is being foolish because they know DAP has been using them, and yet they still want to work with them (DAP) just for the sake of gaining seats.

"As long as there is a coalition (opposition) that do not have the same principles with one another... we cannot give away our country to them," said Najib during the winding up speech at the 2011 Umno General Assembly at Putra World Trade Centre (PWTC) today.

He said Malaysia will become a developed and high income nation in ten more years under Barisan Nasional's (BN) rule.

"We have let the rakyat down," said Najib who is also the Prime Minister of Malays.

Meanwhile, Najib also described Opposition leader, Datuk Seri Anwar Ibrahim's intention to take over the government on 16 September 2008 as the biggest lie in the country.

He said the planned process of getting 30 BN member of parliaments to cross streams was very undemocratic.

He also said that Anwar had been attacking him endlessly, and that even his wife Datin Seri Rosmah Mansor has also become Anwar's victim of attacks.

"Is this the person who wanted to become the prime minister?" said Najib.

He added that Anwar's party, Parti Keadilan Rakyat (PKR) has also charted a 'world record' with the most people quitting the party.

Najib also admitted that the party had lost because there were some Umno people who had betrayed the party.

"We lost that time because there were those from Umno who had betrayed the party.

"But if we all remain loyal, God willing we can win (the election) anytime," said Najib during his winding up speech at the 2011 Umno General Assembly at Putra World Trade Centre (PWTC) today.

He also asked all Umno members to leave out all dispute among themselves.

"This election is the point that determines whether people want a bright future by choosing Barisan Nasional (BN) or the road towards desctruction by choosing the Opposition," said Najib who is also the Prime Minister of Malaysia.

During his speech, he also said this year's assembly has achieved four things, where the first one is that they had succeeded in proving that Umno is party that is effective and united.

The second one is that the government has gained the support to implement its policies towards a big change for the nation.

The third one is that Umno is ever ready to fight, and the fourth one is that Malaysians still have confidence in Umno for a better future.

Meanwhile, in a press conference after the closing of the assembly, Najib said he had already received few voluntary offers from member of parliaments to pave way for new faces for the next general election.

He described this as a healthy development to the party to ensure that new faces be brought to the front.

"There are those who had met me personally, and I do not need to mention who... but there are those who had responded to make way so that we can submit new faces," said Najib.

During Najib's policy speech at the Umno General Assembly, he had called on party members to carry out self-evaluation on whether they were capable of helping the party to win or causing the party to lose in the next general election.

Earlier in closed door meeting with delegates, he also suggested old leaders to pave way for new faces who are categorized as 'winnable candidates' to contest in the next general election.

Khairy Jamaluddin hinting cheating and bribery are still the best policies ?

"Without Support from Party Machinery, 'Winnable Candidate' can Be 'Losing Candidate'"

KUALA LUMPUR, 3 DECEMBER, 2011: Umno Youth Chief Khairy Jamaluddin today reminds the party members not to be too obsessed with the ‘winnable candidate’ term.

He said, without strong support from the party machinery, the one which is placed as a winnable candidate can be a ‘losing candidate’.

The Rembau MP also added that he believed that the speech given by the party President, Datuk Seri Najib Razak has raised the spirit of every delegate to start working hard in preparation to face the General Election (GE).

“The essence of the President’s speech is to make sure that the party gain success. We must realize that our party's survival lies in the hands of people,” said Khairy.

“The formula is simple, do not be too obsessed with winnable candidate. Winnable candidate alone cannot win. On paper he is winnable candidate but if the party machinery does not provide support, he will turn to be a losing candidate,” he added.

According to Khairy, as the head of the youth wing, he promises to the president that the movement will work harder to attract the younger generation to support the party.

“There is no more time for rhetoric, it’s time to work. We have to support whoever is selected as candidates,” he said.

He also reminded the party’s supporters to never betray the party as he said the country would be destroyed if it is under the hand of the opposition.

UMNO Hypoctites pretend to be loyal ?

As polls loom, Umno delegates swear loyalty to party

KUALA LUMPUR, Dec 3 — The Umno general assembly ended today with delegates taking the “sumpah bai’ah” (oath of allegiance), a symbolic move to prevent infighting and internal sabotage ahead of an election expected soon.

Prime Minister Datuk Seri Najib Razak later told the crowd of 5,477 delegates at Dewan Merdeka that the coming polls would be “the most critical” to date for the ruling party, repeatedly reminding members of the importance of standing united.

“The bai’ah oath led by my deputy (Tan Sri Muhyiddin Yassin) earlier reflects our readiness to put aside differences as well as actions that could threaten the party.

“I hope we can fulfil this promise,” he said during a brief media conference after closing the assembly.

Did Umno show its good side? — Jacob Sinnathamby

DEC 3 — Another year has passed and another Umno assembly is over and I am trying to find some redeeming quality of the Umno politician.

This is not a smart alecky throwaway line but a considered view of someone who was hoping that Prime Minister Najib Razak would give me a reason to continue supporting Barisan Nasional. Instead, I found a party struggling to be relevant and Umno delegates bent on blaming everyone and everything except themselves for the state of the country.

In times past, the assembly was about the problems ailing the Malays, the need to improve and the challenges facing the country, all with some sense of introspection.

The irony is that at a time when the country is facing a whole host of problems like worsening race ties, corruption, abuse of power and an economy caught in the low-cost trap, all we got from Najib and gang was finger-pointing.

It was someone else's fault. The Christians. The Chinese. PKR. PAS. DAP. The alternative media.

How can politicians who refuse to own up to mistakes or face up to real problems in the country be trusted to govern Malaysia?

How can politicians who make light of abuse of power and corruption be trusted to safeguard wealth and resources for future generations?

How can people who throughout the assembly stoked the fires of racial and religious tension be trusted to be peacemakers?

How can the Umno supreme council — most of them tarred with controversy or scandal or, in the words of a prince, some of them leeches — be role models for our children?

This week was Umno's chance to show us its best side. Did it?

Winners and losers at Umno assembly 2011

The Malaysian Insider
Dec 03, 2011

KUALA LUMPUR, Dec 3 — In a few hours, the Putra World Trade Centre (PWTC) will be empty of the thousands of delegates, observers and supporters attending the annual Umno general assembly. The five-day meeting saw a slew of speeches that touched on the issues facing the dominant party in the ruling Barisan Nasional (BN) coalition.

Here are the winners and losers.

WINNERS: Hardliners in Umno because the speeches and tone from this year's assembly suggest that the party has moved further away from the centre. Umno used to be a broad church of opinions from the farmers, religious scholars to the teachers and businessmen and pure political animals concerned about social justice, economy, religion and race.

Today, race is the dominant theme and the supremacy of the Malay race is being used to bulldoze and shut out other voices in the party. The DAP was singled out as the main cause impeding unity talks between the Malay parties. Ironically, PAS was formed by the Umno religious wing in 1951 and both parties only worked together in 1973 to 1977 in the aftermath of the May 13 race riots.

But the DAP gets the blame for the lack of Malay unity and the race riots.

WINNER: Datuk Seri Shahrizat Abdul Jalil. Try as a few Umno delegates did, no one could shake the Wanita Umno chief off her perch because of the National Feedlot Corporation (NFC) scandal involving her family. She stuck to her guns, insinuated that the attack was meant to weaken the wing that is seen as the backbone of Umno.

It also proved that Umno defends its own no matter the degree of the stench. Shahrizat isn't the first and won't be the last Umno leader to be grilled over allegations of misconduct by family members. And she won't be the first to be dumped by Umno immediately too.

She lives to fight another day. It is up to the party to decide whether Shahrizat is a millstone around the party's neck in the coming general election.

LOSERS: Malaysians. Because Umno looks set to win the polls in the next general election but yet looks woefully ill-equipped to lead a multiracial country. Sticking to parochial sentiments to fire up its members is outdated for any party that has been at the helm of a country for more than 50 years. One expects delegates to articulate a vision to continue on its previous success but that did not happen.

Instead, delegates harped on age-old themes of having their culture and faith eroded by political foes taking over the country. That they are the only guarantee of faith and culture. What about the economy? What about the reforms? What about Malaysia?

LOSERS: Chinese, Indians, Kadazandusuns, Christians, Buddhists, etc. After five decades of contributing to the development of this country, Umno still views people from this group with suspicion. That they can only be good if they are subservient to Umno. Everything is centred around Umno. Malaysia fails when Umno falls.

But they didn't articulate the vision for continued success. They didn't talk about public funds being used wantonly in high-impact projects by those related to Umno leaders. Instead, everyone is at fault except those in Umno.

The party lost another chance to clean its stables and start winning the trust of those who abandoned them in Election 2008. And the party lost an opportunity to show they can work with, trust and treat other communities with equality and respect.

To be sure, the Umno annual general assembly this year is an event ahead of a possible general election next year. The party needs to rally its members. But it must also show that it can be a party acceptable to all Malaysians, not just the Malays.

Najib: DAP knows all of Anwar’s secrets

KUALA LUMPUR: Umno president Najib Tun Razak said DAP knows all of Opposition Leader Anwar Ibrahim's "secrets", which explains its alleged rising dominance in Pakatan Rakyat.

The prime minister in his winding-up speech at the Umno general assembly here said Karpal Singh's appointment as Anwar's lawyer in his ongoing second sodomy trial had made it possible for them (DAP) to gain confidential information from the PKR leader.

"He (Karpal) is his lawyer. Of course, he knows everything. That's why DAP is so bold now," Najib said to thunderous applause from the delegates.

Najib pointed out that Karpal, who is DAP chairman, had replaced Zulkifli Noordin, a known Islamic hardliner, who was sacked from the party following a fallout with PKR's moderate leanings.

Zulkifli was among the six PKR MPs who defected which Najib said signalled the party's fragile state.

The prime minister said Anwar had tried to blame Umno for the sodomy (II) charges, and also he and his wife Rosmah Mansor for his problems.

"My wife is sitting there harmlessly and she still gets attacked," he joked.

Anwar had openly accused Najib and Rosmah of masterminding the sodomy charges and planting Saiful Bukhari Azlan, his accuser, to trap him.

Both of them denied the allegation.

Najib said today the charges had nothing to do with Umno.

"This is not between us and them but between Anwar and Saiful," he said.

Pakatan will destroy Malaysia

Najib took the same line as the delegates, saying that Pakatan rule would signal the country's destruction.

He cited PKR's disastrous party polls as a clear indication of what is to come should the opposition wrest Putrajaya.

"Zaid Ibrahim said he cannot withstand the party… he said there were more ballots than there are voters," he said, referring to the disgruntled former PKR leader who quit the party after accusing the leadership of rigging its internal votes.

Ironically, Najib said that PKR and Pakatan are also calling for free and fair elections.

He said the demands for reforms made by polls watchdog Bersih 2.0, with the backing of Pakatan, were only a "scripted" ploy to portray the government as undemocratic.

"It's all a script. They already have a script."

Denying the allegation that the country's election system is unfair, he said the ruling coalition would not have lost the five states (if the election was unfair).

"We would not have given Selangor to them… we would not have allowed PAS to rule Kelantan for 21 years," he said.

Najib, who is Umno's Selangor chief, has made it a personal task to win back the state, the country's most industrialised.

The battle for Selangor is crucial for him to survive in his own party and stay in office.

All in the family: How Taib controls Cahya Mata

"Our most recent revelations are based on the publicly recorded movement of shares within CMS.A probe into publicly available company and stock exchange records on Sarawak's largest public company Cahya Mata Sarawak Bhd (CMS) would be enough to prove that it is under Chief Minister Abdul Taib Mahmud's control, said whistleblower website Sarawak Report.

"These show how huge chunks of the company have been passed round Taib's close family members, providing only one feasible explanation, which is that it is Taib himself who is controlling their ownership.

"To all intents and purposes, therefore, he created the company
and he is the owner," reported the website on Thursday.

Sarawak Report alleged that Taib had created CMS "by privatising key assets that used to belong to the state of Sarawak."

NONE

"As finance minister and chief minister he caused valuable state interests like PPES, Steel Industries Sarawak and PCMS to be sold for knock down prices to CMS and then engineered extraordinary 'share-swaps' with cheap companies belonging to his own family members.

"This enabled the Taibs to take control of the majority of CMS shares by 1996," it said.

The company, it said, has in turn accesss to the massive wealth of the state through monopoly of massive state and public contracts.

All in the family

The website traced the historical share movements and management of the company to show how Taib was implicated.

It said in the initial years Taib's brother Onn Mahmud – the largest shareholder and main Director of CMS at the time – was the CM's business proxy "in Sarawak and abroad, until the
brothers fell out in 2003″.

azlanCiting research available at the London School of Economics, Sarawak Reportsaid Onn in 1989 acquired the family's first 27 percent stake in the publicly-owned CMS in 1989.

By 2002 Onn had 30 percent interest while Taib's two young sons each owned 12 percent, making the Taib family a majority shareholder in CMS.

It notes how in 2003 Onn's shareholdings were reduced to a minority while Taib's sons gained 44,925,102 shares through Majaharta, a company originally owned by Onn, while the remainder of the latter's shares went to Taib's wife Leila.

"The question therefore is why should Onn transfer such a valuable company as Majaharta, with so many CMS shares, to his nephews, rather than say to his own children or indeed selling the shares for a big profit?

"The answer, clearly, is that he only held those shares by proxy," said the website.

By 2007, it said, Taib's two daughters Hannifah Taib and Jamilah Taib had acquired joint ownership of Majaharta giving the four siblings roughly equal share in CMS with Leila owning a significant portion herself.

Meanwhile, other relatives such as Taib's son-in-law Syed Ahmad Alwee Alsree and brother-in-law Robert Geneid were also given key positions in the company.

Lion's share of contracts

S

CMS related party transactions (CMS Annual Report)

arawak Report also traced how the family-controlled CMS had long-term access to lucrative state contracts that it handed to other Taib family-owned companies.

"(From annual reports data) we can see that over the previous year alone RM35 million worth of business went through some 20 companies belonging to Taib family members."
It said a shareholders' attempt at an extraordinary meeting in 2002 to confront the issue of 'recurrent related party transactions' forbidden under Stock Exchange regulations, failed to resolve the matter.

"Unsurprisingly, the extraordinary meeting, called under Stock Exchange rules to review this outrageous situation, voted in favour of keeping these recurring arrangements with related companies.

"After all the Taibs controlled the majority of shares! To this day, despite recent attempts to cover up this in-trading, it can be seen from the Annual Report that the corrupt practice continues," saidSarawak Report.

Amongst these contracts, it said, was property rental paid to Satria Realty Sdn Bhd, that it said Taib himself owned 55 percent share in until 1999.

Such revelations, said the website, proved that Taib's claim that he was not involved in business within Sarawak was false.

"The above information, which is publicly available in company and stock  exchange records, is quite enough for the MACC to issue a warrant for the arrest of Taib Mahmud.

"He and his family have not only done business in Sarawak, they have run Sarawak as a business along the lines of a family mafia, using his political power to extract virtually all the country's wealth."

200 brave water sprinklers to protest Assembly Bill

Nigel Aw | Dec 3, 2011
Malaysiakini

Despite what appeared to be attempts by the KLCC management to cause inconveniences, some 200 people converged at its park off Jalan Ampang in a carnival-like gathering to oppose the Peaceful Assembly Bill.

Instead of being met by police batons and water cannons on its second Saturday afternoon protest, the group of about 200, clad in yellow, were met with water sprinklers.

The group moved close to some trees in the park after the KLCC management, again, cordoned off its compound for a cleaning operation, including the area the protesters used last week.

There, they stood around national laureate A Samad Said, who is popularly known as Pak Samad, as he recited his poems. Then, the complex management turned on water sprinklers on the ground where they stood.

Undaunted, those who were caught in the sprays shielded themselves with umbrellas and continued to listen to Pak Samad, who recited his latest poem in tribute to the occupy movement, Merindu Ruang (Missing Space) after reciting his Bersih poem, 'Unggun Bersih'.

"Let us fight violence with the beauty of literature," declared one of its organisers, Wong Chin Huat, who is also a steering committee member of Bersih.

Top leaders from DAP also threw their weight behind today's rally, with the presence of DAP supremo Lim Kit Siang and several MPs and state assemblypersons from the party, including Teo Nie Ching, Charles Santiago, Tony Pua, Teresa Kok, Ean Yong Hian Wah and Ronnie Liu.

"We must have a parliamentary select committee before the Peaceful Assembly Bill becomes law, we want public consultation. All of us want to give our views in a real democracy," said Lim.

The bill, which was passed by Parliament despite stringent opposition, is seen to be far more draconian than section 27 of the Police Act.

It bans all street protests, imposes far stricter requirements on rally organisers as well as higher fines for more offences and gives blanket powers to the police.

'PM's game changer not enough'

Samad later concluded his poem with the words:

Ada sang perubah permainan
kami perubah kekuasaan
Inilah tekad generasi baru
akarnya keadilan syahdu

(There is a game changer
But we are changers of the powers
This is the young generation's determination
its root is noble justice)

Asked what he meant by "game changer", Samad said he was referring to the prime minister's speech at the Umno general assembly earlier this week.

"The prime minister' speech said he needs a game changer, but what we need is regime change," he said.

The celebrated poet added that he was there to lend a hand in opposing the Peaceful Assembly Bill.

"We saw just now, even when we wanted to recite poem, that we need a letter of permission. That is not democracy. I'm doing this to help create a freer atmosphere."

Protest disrupted by KLCC security

Earlier, when the protesters were taking turns to recite poems at the gathering, a KLCC security officer intervened and said that they needed permission from the management, despite the place being a public park.

When the crowd began to boo, Wong stepped in and queried if the crowd would require permission if they gathered inside KLCC to look at its Christmas decorations, to which the security officer replied: "No".

"Then next week, we will gather inside KLCC to appreciate the beauty of Christmas trees," declared Wong, cheekily.

The crowd later adhered to the demands of the security officer and dispersed in an orderly fashion.

Speaking to reporters later, Wong said the crowd was smaller than last week because the KLCC management had cordoned off their intended location.

However, he brushed aside any intention of ill-will over the move and the fact that water sprinklers were turned on where the protesters had gathered.

"KLCC is secretly supporting Bersih, we are heartened that it has supported our action in the last two weeks," he quipped.

Wong vowed that the protests to oppose the Peaceful Assembly Bill would continue, even after it becomes law.

"Don't expect us to back down. We are waiting to be arrested and put behind bars, and I'm sure enough people are willing to take a stand to defend our freedom to assemble."

Response to comments post CPI ranking by Transparency International — Pemandu

DEC 3 — The GTP is Delivering!

In reference to the recent survey release by Transparency International on the Corruption Perception Index and the Corruption Barometer on 1 December and Chief Minister Lim Guan Eng's recent statement.

Firstly, let's put some factual perspective on the surveys, outline the positives and the learning gained from the surveys.

The Government Transformation Programme (GTP)

Here, we would like to perhaps be a little more reflective of the work done thus far instead of taking a myopic view that the success of the programme has derailed. The Corruption NKRA is but one of the 7 NKRAs identified by the Government.

In the course of the last 24 months since the GTP was implemented, Malaysia has recorded outcomes that has impacted the rakyat very positively across the NKRAs of reducing crime, improving urban public transport, rural basic infrastructure, improving student outcomes and rural basic infrastructure. The results of these were evidently published in the Annual Report in March this year. The Annual Report clearly detailed what was achieved, what was not and some of the challenges the Government needed to tackle moving forward.

In July this year, the Government had also announced a new NKRA to manage the cost of living, with cash aid and book vouchers as initial initiatives being made available to families with school going children.

We are under no illusion that the Corruption NKRA is a challenge but it is a challenge we are not backing down from.

We should be mindful that the CPI is only reflective of one area of corruption occurring in Malaysia, in this case Grand Corruption. It is not a measure of the entire Corruption NKRA and definitely not of the GTP on the whole.

Improvement in Corruption Barometer survey

A large focus of the media and of your publication has been on the Corruption Perception Index in which Malaysia's score suffered a slight dip from 4.4 in 2010 to 4.3 in 2011. However, little has been said about the Corruption Barometer, a public survey that was announced on the same day by Transparency International.

The Corruption Barometer (CB) measures the perception of the public on the Government's efforts to fight corruption. 49% percent answered that they felt that the Government's efforts were effective. This clearly shows there has been increase from 48 per cent in the previous year when the Corruption NKRA was introduced. In that sense the momentum was not only maintained but showed that the Corruption NKRA proved effective, as the CB was only rated at 28% in 2009. This also shows that public perception towards petty corruption, efforts and initiatives implemented throughout 2010 and 2011 are being felt and acknowledged by the public.

Some of the deterrent measures such as the Name and Shame Database, the Whistleblower Protection Act and the establishment of compliance units within the 5 key enforcement agencies are building blocks that have contributed to the positive sway. These initiatives have also hit the right chord with foreign embassies expressing their desire to use the name and shame Database as a reference point when processing visa applications, making the burden on corruption offenders even heavier. As with the Whistleblower Protection Act, enforcement agencies have begun to receive reports and compliance units run integrity testing on all their officers to ensure the highest standards of ethics and integrity.

The CPI Score & Ranking

The total score of 4.3 in 2011 is accumulated from 12 surveys, which is 3 more surveys done in comparison to the 9 done in 2010. The 3 are the Political Risk Services Country Guide, the World Justice Project Rule of Law Index and Transparency International's Bribe Payer Index (BPI).

Benchmarking against the 9 original surveys conducted in 2010, Malaysia has in 2011 increased its scores in 5 of the key surveys. Amongst which, the PERC Asian Intelligence Survey, Malaysia increased from 3.5 in 2010 to 4.5 in 2011. There was also an increase from 4.7 in 2010 to 5.7 in 2011 in the WEF Executive Opinion Survey. The Bertelsmann Transformation Index also saw an increase from 4.5 in 2010 to 4.6 in 2011.

Of the new surveys, the BPI is a survey introduced in 2011 and conducted to measure the propensity of Malaysians to paying bribe to other parties outside of Malaysia. It is also the only one conducted amongst 28 countries instead of all the countries that has been ranked in the CPI. Given that the CPI ranking is made up of an average score across all surveys conducted, the 28 countries in which had the BPI would naturally be impacted either positively or negatively.

The component that was used in the overall CPI was the perception of the businessmen surveyed of corruption in this country. Therefore, we do understand why TI has chosen the BPI and we accept their decision but we also have to examine all the other surveys individually, in order to gauge our progress further in this area.

Moving forward

Throughout 2010 and 2011, we have been able to put in place basic building blocks to effectively address the issue of petty corruption.  As evidenced by the Corruption Barometer (CB) released by TI, there has seen a slight increase over last year's rating.

We realise however a lot more focus is needed on the initiatives to combat grand corruption. If anything, the CPI has clearly shown that we need to address Grand Corruption as it impedes our overall CPI scoring.

This issue requires institutional and structural reforms. The Government recognizes this.  In fact the Malaysian Anti Corruption Commission (MACC) is doing just that under Dato' Sri Abu Kassim, the Chief Commissioner of the MACC. Efforts have already been initiated to combat grand corruption, with the MACC putting in place a transformation programme, which among other things aim to strengthen their forensic investigative capabilities.

We plan to also put more effort on delivering initiatives such as introducing a transparent consultation process for new laws as well as political financing.

We are studying the details of the CPI report and we will continue to work with TI, MACC and all other relevant agencies to drive towards making required improvements.

A point to note is that the TI's Bribe Payer Index (BPI) is an interesting survey as it focuses on the giver, instead of the receiver. This clearly highlights the fact that we need to have greater focus on integrity and the Corruption NKRA will seek to drive the Corporate Integrity Pledge with greater resolve in 2012.

The scoring of the BPI is a clear indication that only when the giving stops, the taking stops. This is the systemic issue which requires all Malaysians to play a part in addressing.

* This is the personal opinion of the writer or publication. The Malaysian Insider does not endorse the view unless specified.

`Kuasa Allah tentukan segalanya’, kata Shahrizat

`Menongkah cabaran'

20,000 contract civil servants may get the axe

TEMERLOH: Cuepacs has given an assurance to continue fighting for about 20,000 contract civil servants who may lose their jobs in January.

Its president, Omar Osman, said Cuepacs had sent a letter to Prime Minister Najib Tun Razak after the announcement of Budget 2012 and hoped their contracts would be extended by two or three more years.

"At the same time, Cuepacs will seek to meet with certain parties such as the Public Service Department to get the best mechanism on the issue," he told reporters after meeting civil servants here today.

He said there was a possibility that the contract of contract civil servants which would expire on Dec 31, might not be renewed.

On another issue, Omar rapped the opposition which wanted to reduce the number of civil servants if it took over Putrajaya in the coming general election.

He said Cuepacs strongly opposed the opposition's move because it was belittling government servants who had contributed to national development.

In a related development, Omar said 1.4 million government servants would soon be enjoying various benefits and incentives through the New Civil Service Remuneration Scheme which would be implemented next year.

He also said civil servants needed to be prepared mentally and physically and willing to accept the technological changes, in line with the change to the retirement age to 60.

Selangor plans to publicise names of business licence holders

SHAH ALAM: The PKR-led Selangor government plans to publicise the names of those who received business licence in the state in a move to curb the practice of renting or subletting business premises to foreigners.

Menteri Besar Khalid Ibrahim believes the move will eliminate the "rentier culture" among the licence holders and ensure only the rightful owners operate their businesses.

"The move to publicise the names of those who received business licence will allow the people to lodge complaints against any firm if it is found to be managed or operated by others apart from the rightful owners or shareholders.

"In doing this, I believe the practice of renting or subletting business premises to foreigners can be reduced.

"Under the current regulations of the local authorities, the legitimate owners of business premises should operate their businesses at least 35 hours a week to enable their licence to be renewed annually," he told reporters after launching the "Selangorku Medicare" programme at Taman Rakyat, Kampung Jalan Kebun near here, today.

Khalid, however, said the state government would give adequate warning to those found subletting their premises to foreigners and that the move to publicise their names would be the last resort.

Meanwhile, commenting on the programme today, Kumpulan Perangsang Selangor Bhd managing director Suhaimi Kamaralzaman said the company contributed a van and a four-wheel-drive vehicle worth RM200,000 to the Malaysian Islamic Youth Movement's health bureau to provide better healthcare to those in need particularly in the rural areas.

He said the move was part of the company's corporate social responsibility programme for those in need of health and medical services including victims of natural disasters.

"The contribution of the 4WD will facilitate the transport of goods and crew to rough terrains, while the van will be used for transporting medical and essentials for the mobile clinic," he said.

PERGI JAHANAMLAH UMNO/APCO-BN

"Umno tiada hak mendesak kecuali jika Nik Aziz melakukan kesalahan besar seperti pemimpin Umno."

KUALA LUMPUR: Malaysian students studying abroad are advised against believing rumour or slanders spread by irresponsible groups via the Internet, said the Prime Minister's wife, Rosmah Mansor.

She said that being in the educated group, they should not easily believe any "news" posted but should use their wisdom to evaluate its validity.

"Don't listen to slanders… they have an opportutnity to study abroad and should utilise this opportunity and use their intelligence to evaluate any issue," he told reporters after attending a closed-door session with members of the Overseas Umno Club, here, today.

"I advise these students to study diligently, bring back whatever is good to assist the Malaysian government and to leave behind what is bad," she said.

Commenting on the closed-door meeting, she said it was held to meet the request of the students who wished to know about various issues including the "Program Permata Negara" under her patronage.

FREEMASON

Perdana Menteri: Tuan Yang di-Pertua, saya faham.

(3) Freemasonry tidak mengakui nama sebarang Tuhan tetapi mempercayai adanya suatu Kuasa iaitu Supreme Being.

Tuan Haji Nik Abdul Aziz bin Nik Mat:

Datuk Haji Abu Bakar bin Umar:

Soalan tambahan.

Tuan Haji Mohd. Idris bin Haji Ibrahim:

Tuan Yang di-Pertua, soalan tambahan.

Tuan Haji Nik Abdul Aziz bin Nik Mat:

Tuan Yang di-Pertua, soalan tambahan.

Perdana Menteri:

Tuan Yang di-Pertua, saya faham.

Datuk Haji Abu Bakar bin Umar:

Soalan tambahan.

Tuan Yang di-Pertua:

Ini kecil badankah atau kecil apa?

Datuk Haji Abu Bakar bin Umar:

Pangkatnya besar.

Tuan Yang di-Pertua:

Sudah dijawab oleh Yang Amat Berhormat Perdana Menteri tadi.

Tuan Mohd. Nakhai bin Haji Ahmad:

Tuan Yang di-Pertua, soalan tambahan.

Tuan Haji Nik Abdul Aziz bin Nik Mat:

Tuan Yang di-Pertua:

Ini soalan Tauhid. Mengikut Standing Order 23 (i) tak bolehlah tanya fikiran. Saya bacakan:

Puan Shariffah Dorah binti Mohammed:

Soalan tambahan. Bolehkah Yang Amat Berhormat.

Tuan Yang di-Pertua:

Ini sudah terkeluar daripada Freemason. Rotary Club dan Lions Club sudah berlainan.
