Subra in stable condition after brain surgery

KUALA LUMPUR: Former MIC deputy president S Subramaniam is reported to be in stable condition after undergoing five hours of brain surgery which lasted until 2am today.

R Balakrishnan, his former secretary and close friend, said the doctors managed to stop the bleeding in his brain and draw out blood from his thrombus.

"Overall, his blood pressure, heart and pulse are stable," he told Bernama when contacted here today.

The veteran politician had warded himself at the Assunta Hospital in Petaling Jaya on Friday night after encountering health problems and was transferred to the Pantai Medical Centre here yesterday morning.

Balakrishnan also said that Subramaniam was taken straight to the intensive care unit (ICU) and that he still remained unconscious after the surgery.

"We are still waiting for his recovery," he said.

Subramaniam is a former Member of Parliment for Segamat (1990 to 2004) and a former deputy minister.

PWD goes silent on overpriced Hospital Shah Alam

More than a month after allegations of! irregul arities surfaced over the Shah Alam Hospital project, the Public Works Department (PWD) has yet to respond to the questions raised.


Last month, Malaysiakini reported source-based claims that the contract was awarded under debatable circumstances and at an inflated price of about
RM500 million to Sunshine Fleet Sdn Bhd, a company owned by a member of the Selangor royalty.

The company has allegedly been skimming off project funds for 'advances' and 'expenses', and also stands accused of harassing companies it had engaged as sub-contractors. It has refused comment, saying that

queries should be directed to PWD which 'owns' the project.




Since then, PWD secretary-general Judin Abdul Karim - who signed the letter awarding the contract - has not been available for comment, despite repeated phone calls to his office.

The matter was referred instead to Judin's special officer Zulakmal Sufian, who requested that the questions be emailed to his boss, with a copy to him.

This was duly done on Dec 10 and Zulakmal confirmed receipt by phone. He later indicated that the questions had been addressed by Judin and that the response would be sent when public relations officer Saipol Anwar Mohd Raji has reworked it.

Among the questions were whether the contract was awarded in an open tender or if it was directly negotiated and why the cost has escalated from the original allocation of RM300 million.


When contacted, Saipol said he is unaware of the email and the response and asked for the questions to be forwarded to him. This was done on Jan 5.

He acknowledged receipt the same day, pledging to revert with a response as soon as possible but has yet to do so.

Prior to this, sources close to the PWD confirmed the existence of an internal report that was commissioned to address the issues, together with a list of answers to Malaysiakini's questions.

However, the source implied that the matter is being held up pending approval by Works Minister Shaziman Abu Mansor.

Yesterday, Saipol said his department has yet to go through the response because the personnel "are busy with more! routine matters".

While he apologized for the delay, he could not say when and if a response can be expected.

Transparency International-Malaysia president Paul Low has
questioned whether the contract was awarded through a fair and open tender process.
"Were there submissions by other contractors? Did the PWD evaluate the submitted tenders in an objective and professional manner? Was the awarding of the project made in keeping with best practices and in the interests of the public?" Low (right) asked.


Malaysian Institute of Corporate Governance president Megat Najmuddin Megat Khas, when contacted, said, "If there is any hint of corruption or abuse of power, then the MACC must step in to investigate. If any fraud is seen, the police must step in.

"We cannot compromise in our fight against corruption and other criminal acts of a financial nature, irrespective of the personalities involved. Nobody is above the law."

The table shows the racial composition and gender of the judges in our superior courts.

As the table shows, there is a fair number of women and non-Malay judges at the High Court level, but not in the appellate courts.

In fact, since Merdeka, only one white, two Chinese, one Indian and one woman were appointed to head the High Court of Malaya.

They were, respectively,
  1. Tun James Beveridge Thomson (1957-1963);
  2. Tan Sri Ong Hock Thye (1968-1973) and Tan Sri Gunn Chit Tuan (1992-1994);
  3. Tan Sri Sarwan Singh Gill (1974-1979); and
  4. Tan Sri Siti Norma Yaakob (2004-2006).
JUDICIAL APPOINTMENTS COMMISSION

Further, the members of our Judicial Appointments Commission comprise:
  1. six Malays,
  2. one Chinese,
  3. one Indian and
  4. one east Malaysia bumiputra, and
  5. only one of the nine members is a woman.
To my mind, the situation could be due to a dearth of non-Malays in the Judicial and Legal Services, but overall women still outnumber men in this sector.

SESSIONS COURT

Currently, in respect of Sessions Court judges, there are:
  1. 119 Malays (56 are women),
  2. two Chinese (women),
  3. five Indians (three are women),
  4. nine east Malaysia bumiputras (four are women) and
  5. one Others (a woman).

MAGISTRATES COURT


For Magistrates, there! are:
  1. 139 Malays (84 are women),
  2. two Chinese (men),
  3. one Indian (woman) and
  4. four east Malaysia bumiputras (all men).
However, there are probably MORE non-Malays serving in the Attorney General's Chambers.

But if other judicial officers such as deputy and assistant registrars are added, women would almost double men.

This is not a new phenomenon as, in the last two years, women have doubled the number of men entering the legal profession.Of course, non-Malay law graduates prefer to enter the legal profession rather than join the Judicial and Legal Services with the view, whether rightly or wrongly, that private practice is more lucrative.

In fact, with the revised remuneration scheme, the current basic pay of a magistrate who is a fresh law graduate is RM1989.45 (with additional perks worth about RM1,000 depending on the location where the magistrate serves).

This, of course, is far better off than his predecessor in earlier days, like in the early 1980s when a magistrate's basic pay was only about RM1,050.

In any event, if the reason for under-representation in the appellate judiciary by NON-MALAYS is due to a lack of meritorious candidates in the Judicial and Legal Services, then resort should be had to the pool of meritorious candidates among senior members of the Bar just like in the case of Jonathan Sumption, QC who recently made history by being the first lawyer to be elevated directly to the Supreme Court of the United Kingdom.

Having said that, let no one mistake me as advocating a quota system or positive discrimination on the grounds of gender, race and religion in judicial appointments because that would go against Article 8(2) of the Federal Constitution.

I am also mindful of the views expressed by some women judges themselves, such as the former justice of the Supreme Court of Canada, Justice Claire L'Heureux-Dubé. She argued that it was not enough to ! have sim ply more women or minorities on the bench. "What we need", as she was quoted by Australian judge, Justice McHugh, "is a change in attitudes, not simply a change in chromosomes."

I disagree.

If there exists a total absence or a huge disproportionate presence of women and minorities at appellate courts, something must be wrong somewhere.

It is my considered opinion that the Judicial Appointments Commission should always encourage a diverse judiciary which is more representative of the make-up of our country.

We must also correct any perception that our judges, who are the arbiters of civil laws, are not fair and independent especially when they adjudicate upon sensitive issues such as race and religion.

It follows that who we appoint to the seat of justice is a matter of life and death.

As one of America's finest trial lawyers, Gerry Spence, put it so trenchantly:

"Who are these judges who wield such power over us, a power reserved for God?

Who are these mere humans with the power to wrest children from their mothers and to condemn men to death or cage them like beasts in penitentiaries? Who possesses the power to strip us of our professions, our possessions, our very lives?

"They make law. They may take away your wife or your good name or your freedom or your fortune or your life. They are omnipotent.

And the question is: To whom have we so carelessly granted that power? Are they the kind who would understand you, who from their experiences would know something of the fears and struggles you have faced? Will they care about you or about justice?"

It is, therefore, my honest view that judicial diversity and meritocracy should go hand i! n hand b ecause a judiciary which does not reflect the society's diversity will ultimately lose the confidence of that society.

In other words, the strength of any judiciary is primarily dependent on public confidence even if seated on the bench are monolithic judges who are most meritorious.

This is achievable if there is the political will, and one only need to look at how successfully Presidents Bill Clinton and Barack Obama did in bringing diversity to the American judiciary.

Jangan terpengaruh fitnah menjelang pilihan raya

BESUT: Rakyat diingatkan agar berwaspada supaya tidak terjerat dengan fitnah yang dilemparkan oleh pelbagai pihak yang ingin meraih simpati untuk memenangi pilihan raya umum ke-13 dan seterusnya memerintah negara.

Penasihat Agama kepada Perdana Menteri, Datuk Seri Dr Abdullah Md Zin berkata pihak yang ingin memenangi pilihan raya kini semakin terdesak hingga sanggup berbuat apa sahaja termasuk mengeksploitasi agama untuk mengelirukan orang ramai.

Katanya, terbaharu pihak-pihak berkenaan membuat tuduhan dengan memfitnah Perdana Menteri Datuk Seri Najib Tun Razak dan isteri, Datin Seri Rosmah Mansor yang pulang awal selepas selesai mengerjakan wukuf di Arafah sebagai tidak sah dan gagal mengerjakan haji.

"Ini satu fitnah dan pembohongan yang dibuat oleh mereka yang jahil dalam mendalami ilmu-ilmu mengerjakan haji semata-mata untuk menimbulkan pandangan serong masyarakat terhadap pemimpin negara," katanya pada majlis sambutan Hari Raya Aidiladha di Kampung Lay Out Padang Luas Dalam dekat Jerteh di sini.

Dr Abdullah yang juga Anggota Parlimen Besut berharap rakyat tidak lalai dengan cerita-cerita tidak berasas di bawa pihak berkenaan selain menilai sendiri usaha yang dilakukan pemimpin yang ada kini dalam memakmurkan negara.

Pada majlis itu, beliau turut menyampaikan 12 buah basikal kepada anak-anak penduduk di kawasan berkenaan melalui peruntukan 'Program Pemimpin Bertanya Khabar Orang Kampung' yang disalurkan khas untuk mereka yang memerlukan.

Writing on the wall and the perils of procrastination

NOV 13 — Silvio Berlusconi, the flamboyant, scandalous media billionaire who practically jumped into Italian politics by organising the People of Freedom party, reigned for seventeen years. He has now resigned. He left Italy with about €1.9 trillion in national debt.

After being so preoccupied with his scandals, both creating them and defending himself from the repercussions, he had procrastinated in dealing with Italy's troubled economy and serious financial problems.

Berlusconi only agreed to the proposal to reduce the deficit in June, when in March his advisers had already literally shouted at him to start taking action.

His government managed to get everything in order only by September this year and got the vote of final approval in the Italian Senate by a margin of 156 to 12 just before his resignation; too little too late.

The final straw is not his scandalous life but the neglected state of the economy and finance in Italy.

With our own version of scandals, mismanagement, complacency, wastage, extravagance and callous spending by the Umno/BN government, Malaysia is not much different from Italy.

Unfortunately the Umno/BN government seems to be oblivious to the so many writings on the wall pertaining to our economy, financial status, deficits, national debts and the road that Malaysia is now on.

The Umno/BN government must rectify these fault by scrapping all the mega projects, take action against all the irresponsible parties that are wasting our money, start with an austerity drive selectively, concentrate on the economy, let the people have more money in their pockets to spend and thus generate the domestic economy which is still within our influence.

Well, we do have many experts to work it out. We cannot depend on the world's economy to prosper or even pick up because time is not on our side and the present situation is just too volatile and unpredictable.

However, the Umno/BN government seems to be preoccupied with trying to build up its deteriorating image and influence for the coming general election. And to win what may be a pyrrhic victory.

Unfortunately the whole nation has to bear the perils of procrastination by the Umno/BN government.

Lagi persatuan pelajar sokong Auku dpinda

KOTA SAMARAHAN:  Akta Universiti dan Kolej Universiti (Auku) perlu dipinda dengan memberi kebenaran kepada pelajar universiti untuk terlibat dalam kegiatan politik di luar kampus sahaja, kata Naib Yang Dipertua Majlis Perwakilan Pelajar (MPP) Universiti Malaysia Sarawak (Unimas) Hwong Yie Hahn.

Beliau berkata, sudah tiba masanya pelajar universiti di negara ini diberi kelonggaran berpolitik namun pada masa sama tidak menjejaskan peranan universiti sebagai pusat pengajian ilmu.

"Kerajaan patut meminda Seksyen 15 Auku untuk menghalang kemasukan unsur politik ke dalam kuliah dan kampus tetapi pada masa sama, memberi kelonggaran kepada pelajar universiti untuk berpolitik di luar kampus," katanya kepada Bernama di sini, hari ini.

Sambil memberi sokongan penuh pindaan Auku, Hwang berkata, majoriti pelajar universiti kini golongan muda yang layak mengundi dan perlu diberi peluang untuk bersuara dalam pentas politik.

"Kepercayaan patut diberi kepada pelajar universiti untuk mencari keseimbangan antara masa berpolitik dan masa belajar,'katanya sambil menambah pembangunan holistik pelajar juga diperlukan untuk mengeluarkan graduan yang berkualiti termasuk mempunyai pengetahuan dan pendapat mengenai isu-isu politik.

Hwang juga menolak tanggapan jika pelajar universiti dibenarkan berpolitik, ia bakal mengugat perpaduan di dalam universiti kerana undang-undang sedia ada boleh menangani masalah tersebut sekira ada cubaan untuk menimbulkan gangguan ketenteraman awam.

"Isu politik tidak semata-mata merangkumi politik parti sahaja, terdapat pelbagai isu-isu politik yang boleh disuarakan dan dibicarakan oleh pelajar sebagai golongan intelektual yang mampu menjadi pemangkin kemajuan kepada negara," katanya.

Dari segi kebebasan bersuara di Unimas, beliau berkata, setakat ini tiada sekatan kerana pelajar bebas untuk mengutarakan pelbagai isu kepada MPP Unimas untuk dibawa ke pihak pengurusan dan MPP Unimas juga bebas menganjurkan mesyuarat bersama pihak pengurusan Unimas untuk bersama-sama menyelesaikan isu kebajikan pelajar.

"Unimas mempunyai Fakulti Sains Sosial yang aktif dan pelajar tidak disekat daripada menyuarakan pendapat mengenai isu politik jika berada dalam konteks akademik dan berhubung dengan pengajian atau penyelidikan pelajar tersebut," katanya.

Beliau berkata, keterbukaan Unimas juga terbukti dengan mewujudkan sudut pidato namun ia tidak digunakan sepenuhnya oleh pelajar.

"Kami dalam proses untuk menghidupkan semula sudut pidato di Unimas melalui proses memperkasa bakat pidato di kalangan pelajar dan pada masa yang sama menggalakkan mahasiswa menyuarakan pendapat mereka secara terbuka di arena pidato," katanya.

Laporan media hari ini memetik dua MPP iaitu dari Universiti Sains Malaysia (USM) dan Universiti Putra Malaysia (UPM) tidak bersetuju pindaan Auku.

Presiden MPP USM Muhammad Idzuan Jamaluddin dipetik berkata, pindaan tersebut bakal menjejas pembelajaran di kampus manakala Presiden MPP UPM Iqbal Ismat Nordin menyatakan sokongan dengan memberi alasan yang sama.

Where’s the beef (Part VII)

  • On twitter, there is continuous spat on the issue of the NFC between our YB KJ and YB Wannabe RR. I watched, read on occasionally threw challenges and vital key points both gentleman based on information that I have which was shared with me by friends within MOA. In Dec 2009, I wrote among others in a post under the heading, "Where's the beef";  "Could it be that the Beef Valley project is just a front? A friendly party has been given RM250 mill dirt-cheap loan without collaterals. For the company, they don't have to make money from cattle business. They just need to spend 10% of the amount to show that some cattle business is taking place. The balance could be invested elsewhere. How would you have invested it?"

 

  • I had to write in the form of a question because I wanted to be risk averse and also raise the matter. Back then I had a lot of evidence about the whole project and how the monies were spent. I am glad someone highlight about the condo purchase. During the twitter sparing between KJ and RR, I gave them 2 other hints. The first is that the condo was not the only property bought and the second I asked them to study how RM181 mill was spent. Both have been silent since then. Hopefully they will spar again on Monday.

 

  • Over the weekend, a reader that I met at an engagement function told me that he was upset that I had defended Shahrizat in my previous writing and he felt like throwing his computer on the floor. I don't blame him as he had the wrong impression like many other commentators on my blog with regards to the issue. My contention is simple. First the business legally is not related to Shahrizat and second if the loan has been disbursed and terms of disbursement has been met than it is entirely up to company to spend in anyway they like it. In the end I expect them to pay back the whole sum with interest

 

  • The weakness in this whole affair lies with the government machinery that had poor foresight on agreeing to the proposal. The next weakness would be related to terms of disbursement and terms related to recovery as well as terms of repayment if objectives of the MOA are not met (28% self -sufficiency level for beef production by 2010).

 

  • I have been given the privilege to sight these terms and I can say that I am awed with what I read. Clearly what is wrong is here is the way the government does things. It is not far off from many other projects the government does in this country. It is simply embarrassing. Heads must roll and the responsible party must be made accountable. My question to MOA Inc is "Where's the beef" and I hope KJ and RR will analyze on how RM181 mill has been spent.

FBC Media's Italian branch concluded a contract with Gulnara Karimova, the notoriously grasping eldest daughter of the country's savage dictator, to boost her public image as she attempted to launch a global fashion and pop star career.

Younger generation – Gulnara likes to be known as an academic and a politician. However, this is how she promotes her singing career!
Gulnara is regarded as 'the most hated person in Uzbekistan', according to diplomatic cables released through WikiLeaks, because of her extraordinary raids on the country's wealth (which includes oil and gas) and her own flamboyant self-promotion.
She is also regarded as her father, President Islam Karimov's likely successor and the second most powerful person in the country.
When Gulnara divorced her husband, he was immediately stripped of his favoured monopoly over soft ! drinks i n the country (which was given to her). He took refuge in the United States, but 24 members of his family were then arrested and sent at gunpoint over the border into Afghanistan!
She poses in multiple roles as a billionaire business-woman, pop singer, diplomat, government minister, her country's permanent representative to the UN as well holding a position as a university academic and acting as patron of various organisations – all thanks to her father's patronage!

Above all Gulnara wants to be a famous fashion designer and has poured her country's resources into fashion shows in top locations so she can show-case her talents!
Indeed, Karimova, who has been dubbed 'The World's Worst Daughter', appears to combine plain greed with a burning desire to be considered sexy and artistic, as well as clever. As the pictures below would suggest, Gulnara's Daddy has provided her with everything, except an ability to see herself as others do!

Unfortunately, this ludicrous self-indulgence has come at the expense of her people, who are kept backward and poor, despite the rich resources of Uzbekistan.

It was a situation FBC Media were clear! ly happy to take advantage of. In 2009 they accepted 222,000 euros (about a million ringgit) to promote Uzbekistan's so-called 'Style US – Art Week", which mainly provided a platform for Gulnara.
FBC's duties included organising fashion shows and gourmet dinners and arranging for designers such as Oscar de la Renta and Valentino to appear at the event, along with stars like Sting and Rod Stewart!
The whole contract was eagerly signed by FBC Chairman, Alan Friedman, who was clearly aware that Gulnara's wealth could buy plenty more such self-promotion. , Gulnara is apparently notorious for demanding a slice of every successful business in the country, providing yet another parallel with Uzbekistan's model of government and the rapacious regime of the Taib family in Sarawak.

Possibly the most controversial aspect of the Uzbek regime is that it remains the only country in the world where the State formally exploits child slave labour. Around 2 million children as young as 7 years old are driven out of school every year and forced into weeks of back-breaking work to bring the cotton harvest, managed by the state.
Despicably, that slave-farmed cotton doubtless supplies much of the material that Gulnara uses for her 'fashion business', promoting 'Uzbek style' across! the wor ld's catwalks. Her association with such a terrible trade and further accusations by her ex-husband that she has also benefited from a trade in sex-trafficking women of her own country, has led to a series of protests and demonstrations outside her shows in the US and elsewhere.

With such a terrible reputation plastered all over newspapers and the web and such a desire to be loved and admired, it is no surprise that glamorous Gulnara, with all her millions was beating a track to the door of FBC Media and Alan Friedman's specialist PR services and crooked programme making.
FBC staff are reported to have been dismayed beyond belief that they were being bullied and cajoled by the aggressive Mr Friedman into presenting Gulanara on global factual TV programmes as if she was a benevolent woman seeking to help the less fortunate women in her country!
But the next contract forged with FBC's Italian branch did exactly that. No less than three features were contracted for CNBC's World Business, which FBCproduced to showcase Gulnara and her supposed efforts to help women in her country develop small businesses. None of the movies mentioned the shocking human rights record in the country, of course. FBC Reporter Graham Addicot concentrated on featuring Gulnara as a well-meaning progressive following in the footsteps of Barak Obama!
We can reveal that Gulnara's government office paid 28,000 euros (around RM 150,000) each for these three movies, making a total of over 80,000 euros (around half a million ringgit).

FBC were also willing to throw all their other contacts at Gulnara. They managed a gala of Style Uzbek at Milan Fashion week the following year at which Gulnara appeared on stage with her models, ! showing of her own creations!
Alan Friedman had himself photographed at the occasion and then went further in helping his extremely controversial client to meet up with the 'great and the good' of Italian business society by organising a 'Business Seminar' event.
Invited attendees included Letizia Morati, the Mayor of Milan, Andrea Goretti of Fininvest Group, top businessman Elio Cosimo Cantania and several other Italian movers and shakers who Gulnara was keen to get into her contacts book as she launched her global fashion plans!

Gulanara's ambitions went further still, as she clearly sought to promote herself as a world political and business leader as well.
So Friedman again put his carefully cultivated contacts at her disposal, by showcasing her at the World Economic Forum in Davos, where he has managed to acquire the status of a 'Media Leader'.
Naturally, Gulnara managed another appearance on CNBC's World Business, which FBC Media guaranteed to all its clients. But, Friedman went a step further in arranging a special private meeting between Gulnara and the highly regarded Chief of the WEF, Klaus Schwab! What great PR for the 'Worst Daughter' of Uzbekistan. No wonder FBC Media's clients were happy until the whole crooked set up was exposed.
Carefully photographed and then posted up on CNBC. Schwab's meeting with Gulnara – later it apparently continued into a private audience !
It seems extraordinary that such a prestigious world figure as Klaus Schwab, who by definition is knowledgeable about current affairs, allowed himself, like the Italian business leaders, to be introduced by FBC Media to such a person as Gulnara Karimova.
However, it cannot pass un-noticed that in the summer of 2009 Uzbekistan staged an event on the opening day of the summer World Economic Forum in China, featuring 'Dr Gulnara Karimova' at the head of an Uzbek Cultural Presentation. Such platforms do not come cheap at such a prestige event as the WEA.

Shall we dread or welcome the dragon?

The water dragon will rule in the Chinese year of 4709, which runs from Feb 4, 2012 to Feb 9, 2013. What do the energies of this fabulous creature have in store for humanity? The optimists would like to think that we are entering a period of civility, compassion and spiritual advancement, the kind of fairy tale world you see depicted in so many of those traditional Chinese paintings.

The realists, however, see little good news on the horizon. Recent reports about the world population exceeding seven billion, coupled with fears of extreme weather conditions, have raised new concerns about the future of humanity.

According to some astrologers, some of the energies brought by the dragon are similar to those brought by the dog in terms of their karmic effects on society. They say many natural disasters and manmade catastrophes have happened in dragon or dog years or even in months, days, hours or seconds in which one of these animals was on the ascendant.

The South Asia tsunami of Dec 26, 2004, for example, happened during the hour of either the dragon or the dog. The Sept 11, 2001, terrorist attack on New York happened in the hour of the dragon. The 2010 massacre of Hong Kong tourists in Manila took place in the hour of the dog.

However, not all is bleak in dragon years. In 1952, which was also a water dragon year, Elizabeth II was crowned Queen of England. The Mousetrap, a play based on an Agatha Christie story, opened in London and became the longest continuously running theatre production in history. And medical history was made with the first separation of Siamese twins at Mt Sinai Hospital in Cleveland, Ohio.

Many successful personalities were born in 1952, and they include people who have become CEOs of Coca Cola, Exxon, Mobile, Time Warner, Colgate and ITT.

Dragons, as characters in mythology and folklore, are not exclusive to Chinese tradition. They appear in Mesopotamian lore as well as many European myths. The English word "dragon" is derived from the Latin "draconern" for "huge serpent".

In Western myths, dragons are fearsome creatures. They destroy villages, abduct maidens and wreak all kinds of havoc on mankind. The Chinese, however, regard this creature with a respectful awe. Many emperors and dynasties adopted the image of the dragon as symbols of power and wealth.

To pessimists, the global scene in the 21st century will continue to be unpleasant, if not more so, regardless of astrological changes. They believe the powerful and influential are likely to go on seeking more power, fame and wealth and dominating this dog-eat-dog world.

Nobody has ever won any prizes for accurately predicting disasters and catastrophes, but Chinese astrologers were not too far off the mark when they predicted that the current Year of the Rabbit would be a year of social and political upheavals in some parts of the world.

The end

At present, one of the mostly hotly debated controversies is the end-of-the-world prediction of the Mayans. According to the calendar of that ancient civilisation, the end will come on Dec 21, 2012. It has been speculated that it will come about as a result of Earth colliding with some object from space, or a coronal mass ejection from the sun, or an explosion of a black hole.

Chinese astrologers, like Western scientists and religious teachers, have rejected the possibility that Armageddon is just about a year away. However, they have not excluded the probability of some natural disaster or catastrophe related to the "water" element sometime in late December. According to their analyses, the possibilities range from undersea volcanic eruptions to tsunamis, hurricanes and earthquakes. They have pointed out that serious earthquakes occurred in 1952, 1964, 1976, 1988 and 2000—all dragon years.

If any of these natural calamities does happen, we can only hope that Malaysia will somehow escape it.

But what about political, social and economic calamaties? Is the dragon, for us, a sign that the push for positive change will gather momentum and bring disaster only to a corrupt regime? Or will we become complacent? Will the fight be so tough that we will just throw in the towel and return to our materialistic pursuits? After all, according to a Chinese proverb, "with money, you're a dragon; without it, you're a worm".

Lynas: A colossal catastrophe waiting to happen —MN D’Cruz

NOV 13 — I am writing this as a concerned citizen, living in Kuantan for the past 60-odd years. My concern is not about my personal safety or health, as I am well into my eighties and the call may come anytime, sooner rather than later. May I also add that I have no political agenda in this matter and I am not a member of any political party, Barisan Nasional or Opposition.

But my real concern is about the safety and health of generations of our children to come, as well as the expanding population that has to work, live and perhaps die in the vicinity of the proposed plant. This vicinity includes Kuantan Town, Beserah, Batu Hitam, Jabor, Balok, Sungei Karang, Cherating and other settlements along the coast, right up to Kemaman and may be further on into the neighbouring state of Terengganu.

Most of these villages are well populated and growing. The proponents of this project and those in the authority of the state/federal governments now have a solemn duty to ensure the health and safety of the people in these regions for generations to come. But I am really concerned that whatever assurance they may give verbally or in writing may not hold good for ever. Nobody, except God, can predict natural disasters like volcanic eruptions, tsunamis, tidal waves and floods, which may strike anytime.

I am sure those who built the plants in the Three Mile Island in USA (1979), Chernobyl (1986) and Fukushima (2011) had taken utmost precautions to prevent disasters and yet they happened. Thousands of people died in these disasters and thousands more are still suffering the after-effects of these disasters. Do we want to have a similar situation in this country?

The biggest question is "Why do we want this plant in Gebeng or for that matter anywhere in Malaysia?"

Are we so hard-up for foreign direct investment that we are prepared to accept a backyard industry, rejected in its own country? Western Australia has all the required facilities, viz. less populated region, accessibility to seawater and port, good transport system and infrastructure.

So why do they want to come to Gebeng to do this job?

According to Datuk Seri Adnan Yaakob, "the state government did not approve the project and it had no power to stop it…"

"When Lynas first proposed the project, International Trade and Industry Ministry had given the project to Terengganu . However, due to delays (or rejection by Terengganu?) the Ministry asked us to consider having the plant in Gebeng" (Press report, 20 April 2011).

Does it mean the state government has no power to refuse permission for the plant to be built in Gebeng? Land usage is a state matter and the state should have the last say in such matters. So it is surprising to note the Ministry of International Trade and Industry has forced the Lynas Gebeng Project, down the state's throat.

"Atomic Board has limited jurisdiction" (press report).

Does it mean that in matters outside its jurisdiction, it can wash its hands and put the blame on other agencies like the Malaysian Nuclear Agency, the Department of Environment and even the State Development Corporation?

"A full operational licence will not be issued if Lynas does not meet the requirements that have been set" (press report, April 23, 2011).

So, if the requirements are not met with, will the RM700 million Lynas plant under construction now become a white elephant?

"Lynas, which hopes to begin operation in September 2011, expects to bring in RM8 billion a year from 2013 that too tax-free, based on current prices."

Who are the real beneficiaries of the RM8 billion a year income — the state government, Lynas Australia, the federal government, Lynas (M) Sdn Bhd?

I understand there is LYNAS (M) Sdn Bhd in existence.

Who are the directors, shareholders and stakeholders of this company?

It has been reported that a delegation of state exco reps visited the Lynas headquarters in Australia.

Who sponsored their visit? Did they see any plant in operation there? What technical or scientific expertise did the members of the delegation have to do an objective study of the pros and cons of operating such a plant? Who paid for their expenses? Lynas or the state government?

The raw-material is to be imported from Lynas Australia.

Why bring the raw materials from Australia, when it could safely be processed there? Is it because the 41 safety and health regulations by the Australian government are more stringent than whatever conditions we may impose in Malaysia?

According to some experts the public is already exposed to naturally occurring and ionising radiation. Do we need an extra dose of radiation?

The finished products will be taken back to Australia but the "tailings" will be "safely" left behind in Gebeng.

Why should we hold on to this toxic waste for many, many years, even if they are deposited underground?

Isn't it true that there is no 'safe' level of radiation, as far as its effects on the health of the people is concerned? (Letter to the Press by Mr David K C Quek dated May 27, 2011).

Do we want a repeat of Bukit Merah, Perak, where the Japanese Company which ran the rare-earth plant is spending RM300 million to do the clean-up and even after more than 25 years, they have not succeeded in cleaning up, leaving behind those with birth defects and eight leukaemia cases — seven have since died (New York Times, March 8, 2011)

"Chinese farmers in China pay the price for rare-earth addictive" (press report).

According to this report, peasant farmers living near the dumping ground for rare-earth waste in Dalahai have — "lost their teeth", "lost their hair", "eat contaminated food", and "destroyed their crops". Do we want any such disaster to strike us? Do we want our future generations to blame us for their sufferings?

"Lynas report will take time" (press report April 27, 2011).

"The Panel tasked with reviewing the health and safety aspects of Lynas (M) Sdn Bhd is expected to present its report within a year." (Datuk Fadillah Yusof, Deputy Science, Technology and Innovation Minister). In the same newspaper International Trade and Industry Minister Datuk Seri Mustapa Mohamed is reported to have stated "the Panel would complete the task in a month". Whom are we to believe?

In the same report it was stated "An EIA was approved by the Pahang Department of Environment on 15 February 2008 and was carried out according to the highest standard".

(i) Who were those experts involved in carrying out 'the assessment according to the highest standards';

(ii) If the EIA was approved in February 2008, why did the authorities keep it under wraps and only now (May 23, 2011) bring it out for public display at a few selected places?

That, too, after an article in the New York Times dated March 8, 2011 exposed the inherent toxic effects on the safety and health of the people living around this huge complex built over 50 ha of land. It is in the interest of the real stakeholders, viz. the ordinary citizens of Kuantan, that the authorities concerned provide truthful answers to points raised in this article.

As early as May 21, 2011, Lynas Ltd (Australia) issued a statement that all necessary safety measures had been undertaken.

Was it meant to pre-empt the findings of the then newly appointed international panel of experts?

Lynas review panel must be reformed (press report May 23 2011).

En SM Mohamed Idris and the organisations he represents — Consumers Association of Penang and Sahabat Alam Malaysia — are internationally known and well-respected entities. We can ill-afford to ignore his comments. The state and federal authorities should address his comments since the review involves environment, public health, radiation and safety issues... They are not independent as made out to be. Four (plus one) of the nine panel members are staff of the IAEA.

Lynas: It is safe to transport rare-earth (press report, May 23, 2011).

If rare-earth is so safe as claimed by Lynas, Australia, why bring it to Gebeng, where the people have no need for its final product or the tailings. Why not keep it in Australia and enjoy all the benefits it may bring? "Charity begins at home."

Petition signed by 52,000 residents protesting the building of the plant

It has been reported that a petition containing 52,000 signatures of the people expressing their concern and protesting against the Lynas Gebeng Plant, which the Kuantan Member of Parliament YB Fuziah Salleh tried to submit to the panel, was rejected on the grounds that it was "immaterial".

Local Agenda 21 clearly states that for any sustainable development to take place, people must be consulted and must participate in decision making that is related to the development. Yet the Panel blatantly refused even to accept it for its consideration/deliberation — (press report, May 31, 2011). No one knows why.

The demonstrations at Hotel Hyatt, Kuantan on two days

This could best be described as hooliganism by highly emotional and impressionable youths of a particular political party, with a political agenda orchestrated by interested parties, bent on getting the plant operated, at any cost. It is easy to identify the youths by their behaviour in blocking opposition members of parliament and state assembly members from entering the hotel.

An MCA youth was roughed up, camera crew from the press handled roughly and threateningly, while the security force available failed miserably to control the situation.

The Chairman of the Pro-Term Committee of "Save Malaysia, Stop Lynas" resigned because of outside pressure, which he felt was threatening his safety and that of his family. The Vice-Chairman decided to skip Lynas meetings because he too feared for his personal safely (press report June 1, 2011).

Suspending the construction in Gebeng

It is hoped the assurances given by the Minister of International Trade and Industry and also voiced by the panel is being translated at the ground level. It is hard to imagine how nearly 2,000 construction workers of all grades working feverishly could be laid-off temporarily for an indefinite period.

Site visit by Panel Members

It is remarkable for the panel members to have completed the site visit of the sprawling construction site in less than two hours. If their aim was to study the safety aspects of the factory being constructed, nothing much could have been achieved. Yet let us hope for the best.

The very fact even the press was denied entry to accompany the panel members raises further concern about the safety aspects of the plant. And once in operation, what's going on inside would be anyone's guess.

The input given to the panel by Lynas officials and government department representatives are certain to be biased towards the proponents of the project and therefore may not be objective.

Why should Lynas want the plant in Gebeng?

An article by Azmi Sharom (press report, June 2, 2011) highlighted various reasons as to why Lynas Australia wants the biggest rare-earth plant in the world (outside China) to be built in Gebeng and not in their own country. As the whole issue concerns the safety and health of thousands of people living in the vicinity of the plant, there should be full and open disclosure of all the facts regarding the safety and health of the people. Unfortunately, so far this has not been done.

Finally, I strongly feel it is the duty of every concerned citizen of Pahang, especially those living in Kuantan, irrespective of race, religion or political affiliation to join hands as a united force and struggle to stop Lynas from operating this rare-earth processing plant in Gebeng. We owe this to future generations of our children and grandchildren, whose health and safety are at risk.

It is also my fervent hope and prayer that politicians and political parties will not highjack the Lynas issue for their own political agenda.
