Ukraine jails Tymoshenko for seven years

KIEV: A Ukrainian court today jailed former prime minister Yulia Tymoshenko for seven years over a 2009 gas deal with Russia, threatening its ambition to agree a first step to joining the European Union.

In acknowledgment of the potentially devastating consequences for Ukraine, President Viktor Yanukovych insisted that the decision was not final and that he understood the European Unions anxiety over the trial.

Amid emotional scenes in the packed court in central Kiev, judge Rodion Kireyev said Tymoshenko was guilty of exceeding her authority to force the state gas company to sign a 10-year contract for gas imports from Russia.

The court rules that YV Tymoshenko intentionally used her powers to criminal ends, Kireyev said in his judgment. The court finds her guilty and sentences her to seven years in prison.

Tymoshenko, her hair plaited intricately around her head and wearing an immaculate beige dress, defiantly shouted Glory to Ukraine! to her supporters in the court, who proclaimed Glory to the Heroes! in response.

We will fight and defend my good name in the European court. We have to be strong and defend Ukraine from this authoritarianism. Today the court showed that the justice system has been crushed. Fight, be together, be strong.

She was later driven in a prison van back to the Lukyanovsky detention centre, where she has been held since Aug 5, to begin serving her sentence.

The European Union swiftly warned that the trial had endangered the chances of signing an Association Agreement with Ukraine, a key goal of Yanukovych which would mark a first step towards membership.

The trial risks having pro! found im plications for the EU-Ukraine bilateral relationship, including for the conclusion of the Association Agreement, EU foreign policy chief Catherine Ashton said in a statement.

Since coming to power, Yanukovych had sought to confound critics who portrayed him as a pro-Kremlin relic from the USSR by setting EU integration as his main aim and snubbing an offer to join a customs union with Russia.

But Ashton warned that a full reassessment of the EUs ties with Kiev could be needed. The EU is deeply disappointed with the verdict. The EU will reflect on its policies towards Ukraine, she said.

EU officials have repeatedly expressed exasperation that Tymoshenko was being tried in a case where no corruption was implied which would not have been brought to court in a European state.

The Russian foreign ministry meanwhile complained that it saw a clear anti-Russian subtext to the case.

Not the final decision

But Yanukovych said that the court of appeal still lay ahead and also appeared to allude to moves to decriminalise the statute in the criminal code under which Tymoshenko was condemned.

It has made the European Union anxious and we understand why this is so, he told reporters. Today the court took its decision in the framework of the current criminal code. This is not the final decision, he said.

The former Orange Revolution leader was flanked by her husband Olexander and daughter Yevgenia, who comforted her clearly distressed mother as the verdict was given. Tymoshenko also stared gravely at material on her iPad.

The verdict was in line with the demand of prosecutors, who wanted a sentence of seven years. The judge also ruled that Tymoshenko would not be able to hold state posts for three years.

Kireyev said Tymoshenko sustained a loss to state gas firm Naftogaz of 1.5 billion hryvnia (US$190 million) by agreeing the 10 year contract at terms overly advantageous to Moscow and ordered her to pay back the money in full herse! lf.

< p>Only a dictatorship, where the rule of law does not apply, will convict a former premier for making a political decision, said leading Tymoshenko ally and former minister Grygoriy Nemyria.

Tymoshenko portrayed the trial as a historic fight to ensure Ukraines future at the heart of Europe and said the case is a vendetta pursued by Yanukovych to eliminate her from politics after their tight tussle in 2010 presidential elections.

Hundreds of Tymoshenko supporters gathered outside the court in central Kiev in a tense standoff with security forces as the verdict was read out.

Similar numbers of elite Berkut anti-riot police kept watch over the protestors and a dozen of her supporters and topless protesters from the FEMEN feminist group were arrested.

Tymoshenko was jailed in August for contempt of court after she incessantly mocked the boyish Kireyev on Twitter messages sent from her iPad in the courthouse and has been in custody ever since.

The dramatic trial saw witness appearances from figures including Prime Minister Mykola Azarov, one of her sworn enemies, and ex-president Viktor Yushchenko, her former ally in the Orange Revolution who became a rival.

Najib's trip to Kazakhstan cost over RM1mil...

NONEThe Foreign Ministry revealed in Parliament today that Prime Minister Najib Abdul Razak's trip to Kazakhstan in June cost more than RM1 million.

The total figure of RM1,072,213.22, was for the PM and his entourage to attend the World Islamic Economic Forum (WIEF).

"During the 7th WIEF, five agreements between Malaysia and Kazakhstan were signed," Foreign Minister Anifah Aman said in a written reply to Chua Tian Chang (PKR-Batu).

Najib visited the Central Asian country on June 5 and 6, during which he also met Kazakh government officials.

"The visit resulted in the signing of (another) three agreements between Malaysia and Kazakhstan," the minister added.

However, the visit stirred controversy when PAS parliamentarian Dzulkefly Ahmad alleged that the true purpose of the visit was for Najib's daughter's pre-engagement visit.

He also claimed that officials in Najib's service were harassed to accommodate this. The Foreign Ministry had earlier dismissed these claims as "totally unfounded"

Najibs daughter Noorhayana Najwa wasengaged to Daniyar Nazarbayev in a ceremony at Seri Perdana in Putrajaya on Jun 17. Daniyar is the son of Kazakh President Nursultan Nazarbayev.

Share prices stage rebound to end firmer

KUALA LUMPUR: Share prices on Bursa Malaysia staged a rebound today to end firmer, after beginning the week in the red, and against a mixed global equity market, dealers said.

World stocks which were on a rally today, slipped to mixed trading with players cautious, ahead of the European Unions bailout vote.

At 5pm, the FTSE Bursa Malaysia KLCI (FBM KLCI) rose 14.61 points to end at 1,411.65, after opening 9.95 points better at 1,406.99. It then stayed above the psychological 1,400-level.

The key index hovered between 1,414.74 and 1,406.99 throughout the day, lifted by Hong Leong Bank, Genting Bhd, Amway Holdings, Ibraco and Nestle counters.

Hong Leong Bank gained 48 sen to RM10.72, Genting Bhd increased 41 sen to RM9.50, Amway rose 32 sen to RM8.68, Ibraco added 31 sen to RM1.46 and Nestle advanced 30 sen to RM49.50.

Dealers said the local bourse steadily gained support together with key regional markets following Chinas move to buy bank shares, seen as a signal to boost the banking sector and Japanese equities, that rose after trade resumed following a holiday.

Bursa Malaysias Plantation Index added 119.91 points to 7,157.62 and the Industrial Index rose 19.3 points to 2,534.26 and the Finance Index surged 183.36 points to 12,988.54.

The FBM Emas Index was up 114.51 points to 9,573.56, the FBM Mid 70 Index earned 167.72 points to 10,203.95 and the FBM Ace Index added 7.91 points to 3,654.37.

Gainers thumped losers 593 to 171 while 248 counters were unchanged with 465 untraded and 23 others suspended.

A total of 1.06 billion shares, worth RM1.376 billion changed hands compared with the 584.909 million shares, worth RM632.688 million yesterday.

Among active counters, Dutal! and-WA a dded one sen to 12.5 sen, Time Dotcom advanced four sen to 51 sen, SAAG Consolidated was flat at 5.5 sen and Dutaland shed one sen to 64 sen.

Of the heavyweights, Maybank rose five sen to RM8.25, CIMB and Sime Darby each added 10 sen to RM7.25 and RM8.50 respectively, and Petronas Chemicals inched up nine sen to RM5.69.

The Main Market volume decreased to 525.504 million shares worth RM1.233 billion from 426.583 million shares, worth RM615.970 million yesterday.

Turnover on the ACE Market fell to 78.23 million shares valued at RM13.42 million from 118.437 million shares, valued at RM13.340 million.

Warrants declined to 44.28 million units worth RM4.34 million from todays 36.322 million units, worth RM2.717 million.

Consumer products accounted for 37.171 million shares traded on the Main Market, industrial products 138.352 million, construction 43.562 million, trade and services 224.628 million, technology 26.782 million, infrastructure 35.564 million, finance 115.187 million, hotels 724,000, properties 119.863 million, plantations 74.826 million, mining 0, REITs 38.947 million and closed/fund 115,500.

Wee defends MCA glam girls

KUALA LUMPUR: A rattled MCA Youth chief, Wee Ka Siong, has slammed PKR over lurid photos of several girls whose presence at the partys recent Youth AGM on Oct 2 had sparked a debate on whether they were brought in as eye-candy.

Labelled MCAs glam girls, photos of what appeared to be these girls were photo-shopped and posted on some blogs.

Wee told reporters today that lurid photos of five of the MCA glam girls had surfaced on pro-PKR blogs.

Slamming the party for engaging in such slanderous acts, he said: I am very saddened that the party has embarked on such unethical acts.

Pictures of these girls have been superimposed on naked bodies and posted on some blogs.

There has been numerous complaints from the Beliawanis (MCAs women youth wing) on this matter.

Wee claimed the matter had become a hot issue after PKR youth wing, AMK had picked it up.

He said MCA took such matters seriously and had already engaged lawyers to deal with the issue of the lurid photos.

They are contemplating taking the matter up with Malaysian Communications and Multimedia Commission (MCMC), he said.

Does occupation matter?

The presence of the 10 girls at partys convention had caused a stir, with some quarters asking if it was a publicity stunt arranged by the party to promote the its women youth wing.

Doubts were also raised if they were genuine MCA party members.

Wee, when asked if he was a! ware of the girls professions, answered in the negative.

Many people attended the partys ceramah it is impossible to know the occupation of every single attendee.

I knew the occupation of some of the girls. Some were property negotiators and some worked in banks.

Why does it matter what their occupations are if they have genuine interest in politics?, he asked.

He denied that the girls were eye-candy saying that they were all there as observers.

What is wrong in the girls attending the event to gain exposure about the political process? he asked and urged all parties to act gentlemanly and not engage in gutter politics.

Meanwhile in an immediate response to Wees accusation, PKR vice-president Tian Chua said that the party had nothing to do with it.

Sell FireFly to create healthy competition

KUALA LUMPUR: Pakatan Rakyat today urged the disposal of Malaysia Airlines (MAS) subsidiary Firefly to ensure continued competition following the national carriers share swap with AirAsia.

DAP publicity chief Tony Pua said there is a possibility of a collusive duopoly by the two companies to protect its profits after Tune Air Sdn Bhd swapped 10% of its shares in the low-cost airline for a 20.5% stake in Khazanah Nasional Bhd which owns MAS.

The key issue in the exercise is not the fact that our national interest in MAS has been compromised, the Petaling Jaya Utara MP told a press conference at Parliament lobby here.

The real concern for the rakyat is the fact that the public interest will not be protected with the share swap, he added.

Pua said sharp fuel price increases have not deterred the budget carrier from setting competitive prices for domestic and regional markets and this was due to the competition provided by MAS.

Oil price have increased five times since Tune Air took AirAsia from DRB-Hicom 10 years ago but passengers are still able to enjoy more than 50% reduction flight fees.

Since the swap is now a fait accompli, there is little or no likelihood of reversal (in prices), said Pua.

Najib backtracking on reform

Both sides of the political divide have blasted the share swap with the opposition claiming the move would create a price fixing cartel while BN leaders say the deal would benefit AirAsia more than it would MAS.

Under the deal called the Comprehensive Collaboration Framework, MASs budget carrier FireFly would focus on turbo-prop operations.

Industry analysts believe there will still be a market for domestic or regional premium flight services.

PAS ce ntral working committee member Dr Dzulkefly Ahmad, however, said unless Firefly was sold to the highest bidder, the deal would hamper Prime Minister Najib Tun Razaks aim to stimulating greater private sector involvement in businesses.

It is a case of one step forward, two steps back for Najib Tun Razaks liberalisation policy.

Critics believe the recent spate of takeover bids by government-linked companies has raised questions over Najibs commitment to freeing the market for private sector players.

The Kuala Selangor MP cited the takeover bid by Permodalan Nasional Berhad (PNB) of property development giant SP Setia after it increased its stake to over 33%.

There was also the controversial acquisition of 30% of property developer Eastern and Oriental (E&O) for RM766 million by Sime Derby Bhd.

The takeover bid had sparked concerns of insider trading and both counters were suspended this morning.


MACC urged to probe Ananda Krishnan

KUALA LUMPUR: A formal investigation by Indias Central Bureau of Investigation (CBI) against Maxis Communications Bhd tycoon T Ananda Krishnan and its director Ralph Marshall should spur its Malaysian counterpart to do the same, according to PKR.

Subang MP R Sivarasa said that there was no excuse for the Malaysian Anti-Corruption Commission (MACC) to claim ignorance over the matter.

It would be a bit difficult for the MACC to say that they dont know about this, he told reporters st the Parliament lobby here today.

Sivarasa said this while holding todays edition of the Sun newspaper, with the headline: India Probes Tycoon on its cover.

The paper was referring to a New Indian Express report an Indian newspaper that both Ananda and Marshall were being investigated on charges of criminal conspiracy under the Indian Penal Code and the Prevention of Corruption Act.

Indias telecom minister Dayanidhi Maran, his brother Kalanidhi as well as three companies (Astro, Maxis and Sun TV) were also implicated in the scandal.

Citing the MACC Act, Sivarasa said that Malaysians guilty of bribery or corruption out of the country could be charged in Malaysia.

The MACC should treat this report as a report to them. They should not wait for us to go to them and lodge a report, he said.

According to a PKR press statement, Section 66 of the MACC Act states that the MACC and the Malaysian courts have the jurisdiction to prosecute and convict citizen! s and pe rmanent residents who committ bribery and corruption in foreign countries.

Sivarasa also said that the MACC should take its own initiative to investigate the Maxis chiefs.

MACC should take that initiative. Even the police can act without a (police) report, he said, adding that the scandals publicity was enough for the government agency to take action.

We dont want continuous cases where corrupt acts of Malaysians are investigated and prosecuted in other countries when they get off scot-free in our country.

Batu MP Tian Chua suggested that with the ongoing scandal in India, the authorities here should investigate if there were similar cases taking place in Malaysia.

Myanmar to free thousands of prisoners

YANGON: Myanmar announced a mass prisoner amnesty Tuesday, raising hope for the imminent release of hundreds of political detainees in what would be a major sign of change in the authoritarian state.

More than 6,300 prisoners will be pardoned from Wednesday on humanitarian grounds, state television announced, without saying whether political prisoners would be among them.

The fate of the countrys estimated 2,000 political detainees, who include pro-democracy campaigners, journalists, monks and lawyers, has long been a top demand of Western nations that have imposed sanctions on Myanmar.

The announcement came just hours after a government-appointed human rights panel called for a pardon for the countrys prisoners of conscience.

The National Human Rights Commission said freeing detainees who do not pose a threat to the stability of state would allow them to participate in nation-building, according to an official English-language newspaper.

It noted that UN Secretary General Ban Ki-moon and foreign governments were calling for the release of what is referred to as prisoners of conscience, in a rare official acknowledgement of their existence.

On Monday a government official, speaking on condition of anonymity, told AFP that political prisoners were expected to be freed within days.

Their release would be arguably the clearest sign yet of change under a new leadership that has reached out to critics including opposition leader Aung San Suu Kyi, freed in November after seven straight years of detention.

President Thein Sein, a former general! and sen ior junta figure, has surprised critics by signalling a series of political reforms since taking power following a controversial election last November.

He has been applauded by international observers for holding direct talks with Suu Kyi, whose National League for Democracy (NLD) on Monday said it was expecting all political detainees to be released.

A top US official, Kurt Campbell, on Monday hailed recent developments in Myanmar, including what he described as very consequential dialogue between Suu Kyi and the leadership.

He hinted that concrete moves towards democracy by Myanmar could lead to an easing of sanctions.

We will match their steps with comparable steps, he said.

The new regime, which came to power after controversial elections held a few days before Suu Kyis release, appears keen to improve its image and in August held the first talks between her and Thein Sein, a former general.

Suu Kyi, whose party won 1990 election but was never allowed to take power, has said she believes Thein Sein genuinely wants to make reforms, but she cautioned it was too soon to say whether he would succeed.

The NLD boycotted last years ballot, largely because of rules that would have forced it to expel imprisoned members. As a result it was delisted as a political party by the regime.

Budget 2012: Is M'sia prepared for the global economic storm ahead?

KUALA LUMPUR: While it is undeniable that the goodies-packed and perceivably optimistic Budget 2012 has injected some feel-good factors into the lives of Malaysians, reality check has caused some quarters in the private sector to question the viability of the Government's fiscal deficit target and economic growth projections.

Malaysia's growth outlook seems to stand out comparatively in the region, Bank of America's (BoA) director of global research Dr Chua Hak Bin highlighted during a panel discussion at the 2012 Post-Budget Dialogue, which was jointly organised by the Malaysian Economic Association and Universiti Malaya's faculty of economics and administration.

The question is, are we prepared for the storm ahead? he said, citing worsening economic conditions in Europe and the United States as risks that could throw a damper on Malaysia's growth potential in the next two years.

The Government has maintained Malaysia's economy, as measured by the gr! oss dome stic product (GDP) or the total value of goods and services produced in the country, could grow between 5% and 5.5% this year, and between 5% and 6% in 2012.

The official projections are underpinned by domestic demand, which is expected to remain robust, driven by private investment and consumption as an effect of the accelerated roll-out of projects under the Economic Transformation Programme as well as the various infrastructure projects announced in the budget.

Chua said the BoA expected Malaysia's GDP to grow around 4% this year and 4.2% in 2012. His organisation's less-sanguine approach was shared by some leading local banks in view of the increasingly challenging external environment.

Maybank Investment Bank Bhd (MIB) said it expected Malaysia's GDP to slow to 4.5% this year and 3.5%-4% in 2012. CIMB Investment Bank Bhd had also forecast a GDP growth of 4.5% for 2011. It expected the country's economy to slow further to 3.8% in 2012.

Although the budget measures will help to support the domestic engine, they cannot take up all the slack left by weak exports, CIMB explained in its report.

With the country's economic growth potentially dragged down by the rising uncertainties in external environment, economists remained sceptical over the Government's ability to cut its fiscal deficit from 5.4% of GDP in 2011 to 4.7% in 2012.

For one thing, income tax collection, the main source of revenue for the Government, could fall in line with an economic slowdown.

We have a generous handout under Budget 2012. But tax revenue for the Government could potentially be affected by the volatility ahead of us which remains quite large, Chua said.

Economists at Nomura Group in their report even called the Government's fiscal-deficit target unrealistic, given the prospect of elections in the near term and the downside risks to growth.

Affin Investment Bank Bhd's chief economist, Alan Tan, in his report argued: There is risk that country's budgetary position could get larger than the deficit of RM45bil or 4.7% of GDP projected for 2012, due to possible shortfall in tax revenue receipts, especially from direct taxes, with external environment remaining uncertain.

If the Government were to spend its RM2bil contingencies reserve for development expenditure, barring any changes to revenue or operating expenditure, the Government's budget deficit could increase to 5% of GDP in 2012.

MIB's more conservative growth projection also put its Budget 2012 deficit forecast higher at 5.3% of GDP, compared with the Government's target that was based on a more optimistic official growth projection.

In addressing the private sector's doubt over the Government's fiscal-deficit target, Finance Ministry secretary-general Tan Sri Dr Wan Abdul Aziz Wan Abdullah said at the post-budget dialogue session: The Government has continued to be prudent in its spending to optimise the country's potential for the ultimate benefit of the rakyat.

In the event the global economic conditions turn worse, there's no doubt that our projections would have to change. One has to be mindful that the numbers are not cast in stone.

He maintained the Government would not compromise on the measures it had promised the people.

We have to make sure what we have promised will happen ... if things go bad, we have to bite the b! ullet an d still go for it, Abdul Aziz explained.

Dr Sundaran Annamalai, undersecretary at the economic and international division of the Finance Ministry, nevertheless, remained optimistic of Malaysia's growth potential in the year ahead.

While not denying that the problems faced by Western developed nations could affect Malaysia, Sundaran stressed that strong intra-regional trade could cushion the downside risks faced by the country.

Intra-regional trade constitutes more than 50% of our total trade now, and it is made up mainly of resource-based items. Therefore, our exports can still be sustained amid slowing electrical and electronic exports, he explained, noting that while commodity prices had eased, they were still at considerably high levels.

Private investments will also remain robust, largely because of the oil and gas projects, Sundaran added.

On the country's fiscal deficit, he maintained that Malaysia was on track to reducing it to around 3% by 2015.

Dr Marie-Aimee Tourres, senior research fellow at Universiti Malaya's faculty of economics and administra-tion, who was one of the panellists at the dialogue, said that she was concerned over the fact that some goodies would not bring sustainable economic development to the country.

The one-off cash payment of RM500 to each household with income of RM3,000 and below, for one, was deemed counter-productive.

Tourres was also concerned about the fact that the measures introduced in the budget did not contribute to tackling the country's deep-seated subsidy mentality. Coming from a French background, she took the European Union (EU) example of governments having difficulty in implementing austerity drive to cut their budget deficits, as the people protested.

That's an example of previous poor policy measures of some of the EU governments in the past from which sh! e hoped other countries could learn.

Abdul Aziz, however, stressed that Budget 2012 was an unprecedented budget, as there is something for everybody.

It is inclusive and expansionary, yet fiscally responsible, he said.


DESIDERATA: A lot of "noise" has been created by many commentators, especially vested-interest parties like BN component leaders, in proclaiming that Budget 2012 was a "transformational" one, with benefits for every Malaysian citizen. My first response to me humble self was :REALLY?


Then after a few days' reading, of views from leaders from both sides of the political divide, including the attendant bloggers -- creating lots of buzz repeating each other's adulation of their PM, wow! --who have recently become "very partisan", I am happy the Star ran the above report.


In its print edition -- which I paid for RM1.20 from my own pockets, NOT anticipating any RM500 handouts:( -- the headline read:

They question viability of deficil target and growth projectrions


I urge fellow Malaysians to see beyong the socalled "goodies handed out, especially to civil servants numbering 1.3million, and pensioners. Please remember, that RM500 one-off payment will only last you and family remember for one-month next JANUARY -- for a few special meals outside, fast food at the SOOO GOOOD KFC anywan? -- but then from February till end-year 2012, what is so good for the transient lift?


I think the BN government has been "irresponsible" for "MISLEADING THE AVERAGE" Malaysian that it is a TRANSFORMATIONAL BUDGET!


To me, a transformational budget is one that entrenches the benefits for the long term and not just for that one month when the handout arrives. Even then, many other Malaysians line private sector pensioners, don't get the goodies!


How about the BN government lowering the pum prices ! of our n ational resource -- petrol?


For the past five years during which I have been monitoring Petronas revenues and profits, I have witnessed increasing revenues and rising profits, but what happends. The pum prices have not gone down, but raised several times since Najib Razak took over the government's reins of power.


The BN excuse everytime the world prices went up, they had to raise subsidies, hence the pump price was raised, leading to yet another round of inflation. But I believe for RM1billion of increased suibsidy, Petronas gains a few billion dollars from the higher world oil prices. But there is only elegant silence from the PM and Finance Minister on this point!


But when the world prices plungeg/plunge -- like in recent weeks to about USD70-80 per barrel from highs of USD140-150 previously -- the BN government also maintained/maintains elegant silence. So, what giove, honourable PM Najib?



Pre-General Election 12 (ie before March 8, 2008, that landmark date:) Opposition Leader Anwar Ibrahim had pledged that if Pakatn Rakyat were elected uiinto office at the federal level, THE FIRST ACT OF THE PR GOVERNMENT WOULD BE TO LOWER PETROL AND GAS PRICES. Yes, I believe that can still be done, for MALYSIA IS A NET PRODUCER AND EXPORTER OF PETROLEUM, which is of a higher grade than the oil imports, and hence command a premium price.

I won't be surprised whatever "surpluses" the richest corporate entity in the country would see a decline in performance after his (Hassan"s) departure from the Twin Towers complex. I believe Malaysia's loss is Singapore's gain -- for I hear that Little Dot has yet acquited an outstanding Malaysian brain:)!. That s-mile is on my many Singaporean friends' behalf. Signs that Mynmar may release political prisoners

YANGON: A new official human rights body in Myanmar urged the president on Tuesday to release prisoners of conscience in an open letter in state media, the clearest sign yet that the reclusive state may free political prisoners within days.

The United States, Europe and Australia have made the release of an estimated 2,100 political prisoners a key condition before they would consider lifting sanctions imposed in response to human rights abuses, including a bloody army crackdown on a 1988 student uprising.

One lawmaker in Myanmars parliament, who attended a meeting on Friday in the capital, Naypyitaw, told Reuters the release of political prisoners could come in a few days. He said that was the message given by Shwe Mann, the Lower House speaker.

Prisoners who did not pose a threat to the stability of state and public tranquility should be released, Win Mra, chairman of Myanmar National Human Rights Commission, wrote in the open letter published on Tuesday.

The Myanmar National Human Rights Commission humbly requests the president, as a reflection of his magnanimity, to grant amnesty to those prisoners and release them from the prison, the letter ended.

The commission was formed last month by the president.

The statement is one of several recent signs of change since the army nominally handed over power in March to civilians after elections in November, a process ridiculed at the time as a sham to cement authoritarian rule behind a democratic facade.

Recent overtures by the government hint at deeper changes at work from calls for peace with ethnic minority guerrilla groups to some tolerance of criticism and more communication with Nobel Peace Prize laureate Aung San Suu Kyi, who was released last year from 15 years of house arrest.

Last week, the government suspended a controversial $3.6 billion, Chinese-led dam project, a victory for supporters of Suu Kyi and sign that the country was willing to yield to popular resentment over! Chinas growing influence.

These moves have stoked hopes the new parliament will slowly prise open the country of 50 million people that just over 50 years ago was one of Southeast Asias wealthiest as the worlds biggest rice exporter and a major energy producer.

The open letter marks a significant shift in the former British colony, also known as Burma, where authorities have long refused to recognize the existence of political prisoners, usually dismissing such detainees as common criminals.

KLSE drop, a sign that BN not prepared

KUALA LUMPUR: Malaysias performance at the stock exchange is an indication that it is ill-prepared for any economic challenge, according to opposition coalition Pakatan Rakyat.

DAP secretary-general Lim Guan Eng said this was seen through the FTSE Bursa Malaysia Kuala Lumpur Composite Index (FBM KLCI) dropping by 3.01 points or 0.21% on Monday.

Tying this in with the recent Budget 2012 announcement, Lim said: The Budget is supposed to stimulate the economy, but this shows that from a share point-of-view, we (Pakatan) are not confident.

We are not confident that the BN government can take on next years economic challenges.

Lim, who is also Penang Chief Minister, was equally pessimistic about the governments claim that the national deficit could be reduced from 5.2% to 4.7%.

This is not only too optimistic, but I think this is impossibleWe estimate that the deficit will not go down.

It will either stay the same or go up, he told reporters in Parliament today.

Lim, who is the Bagan MP, said that the governments claim to a projected RM186.9 billion revenue was unlikely, because both commodity and oil prices were expected to be on the decline.

Unwilling to combat corruption

The governments RM232 billion budget the biggest in the countrys history thus far- was also not going to cut down the countrys deficit, he added.

Lim also appeared disappointed with the governments apparent unwillingness to combat c! orruptio n.

He said combating corruption would have saved the country more than RM28 billion.

He was commenting on Prime Minister Najib Tun Razaks national budget for 2012 unveiled last Friday.

Laced with goodies and heavily targeted at civil servants, the budget has however drawn much criticism, with Najibs detractors calling it an election budget.

Alluding to this, Lim said that Pakatan gave away money to the people only when its budgets were experiencing a surplus. But BNs budget, he said, were suffering from deficits.

Adding to the mix, he said that the national debt had increased to RM456 billion in 2011, a RM49 billion increase from last year.

This also translated to a 53.8% federal government debt to gross domestic product (GDP) ratio.

The United States debt to its GDP, which is one of the main reasons of the global economic crisisis at 62%.

Malaysias may be less, but it (the ratio) is not that different, he said.


Ibrahim says Pemandu has hidden agenda

KUALA LUMPUR: The governments liberalisation efforts took another beating from influential Malay rights group Perkasa which warned today against opening up the economy to foreign ownership.

At the unveiling of Budget 2012, Prime Minister Najib Tun Razak announced the opening up 100 percent foreign ownership of 17 sub-sectors aimed at recapturing straying investments.

Perkasa president Ibrahim Ali, a staunch advocate of Mahathir-era protectionist policies, said the move would sideline Bumiputera businesses, adding that liberalisation is an opposition idea.

He also took a swipe at the Performance and Management Delivery Unit (Pemandu) for advocating the move to open the 17 sub-sectors.

Ibrahim, the independent Pasir Mas MP, in his speech during the Budget 2012 debate in the Dewan Rakyat, said Pemandu had a hidden agenda in promoting liberalisation.

Liberalisation is an idea promoted by the opposition the Malay Chamber of Commerce had even made a strong statement against it but it is not heeded.

I urge the government not to listen to Pemandu because if it implements liberalisation (as advocated by Pemandu), the latters hidden agenda would take place, he said.

Key sectors remain caged

Najib is trying to make liberalisation a key aspect of his New Economic Model (NEM) as he aims to resuscitate the countrys ailing economy.

Race-based affirmative action and Bumiputera protectionist policies have prompted capita! l flight and caused a deep drop in foreign investments, forcing Malaysia to play catch-up with its neighbours despite being Aseans economic powerhouse once.

But pressure from groups like Perkasa and hardliners within Umno has pushed Najibs economic reforms to take a backseat as the unelected premier needs stronger Malay support in the coming general election in a bid to consolidate his position in the party.

Najibs liberalisation policies are also said to have failed in stimulating the private sector as key industries like oil and gas and finance remain caged in protectionism.

Even if there is any real plan to free the lucrative oil and gas industry, Ibrahim has already warned of potential Malay backlash.

If the oil industry is liberalised, some 3,000 vendors under (national oil company) Petronas would be sidelined, so what will happen to them? Beware, do not listen to Pemandu, he said.

He has in the past described Pemandu as not Malay enough, accusing the body of trying to influence Najib to implement policies that would threatened the position of the countrys ethnic majority.


Bersih Inquiry: 'Police handled woman roughly'...


A public inquiry into the Bersih 2.0 rally has begun, with a witness testifying that he saw a woman being pushed roughly to the ground by the police in Jalan Tun Sambanthan, as several individuals were arrested.

Kenneth Steven Chan Wen Chin today told members of the Human Rights Commission (Suhakam) - which is conducting the inquiry - that he had taken the LRT from Kelana Jaya about 3pm on July 9.

"We wanted to get off at Pasar Seni but (the station) was closed. My girlfriend who works in the media was with me, and we walked along Jalan Pudu towards Maybank.

NONEThis was my first experience in being in a rally and I was wearing yellow. A group of people warned (us that) tear gas (was being fired).

We then headed to Jalan Tun Sambanthan where we heard police personnel shouting "Tangkap! Tangkap!" (Arrest! Arrest!). We saw them arresting a Malay woman very roughly, pushing her head down on the road."

The woman was released after she identified herself as a member of Selangor TV, he said.

Kenneth said his girlfriend took photos of the incident and that the police were also rough with her, pushing the camera against her face.

In addition, he saw several police personnel kicking a boy in Jalan Pudu, and that photos were also taken of this incident.

"The police warned us against taking pictures, saying they would break our camera. The boy was saying something about the police and they moved in on him."

Kenneth was the first witness to testify in the inquiry which has set itself these terms of reference:

  • To identify human rights vio! lations on or before July 9
  • To determine how the violations occurred, and to identify the process and agency involved
  • To make recommendations to prevent a recurrence

To a question from Wee, Kenneth said he had not seen teargas canisters being fired into Tung Shin Hospital, but that he had seen water cannon being directed at the compound.

The inquiry is headed by Suhakam vice-chairperson Khaw Lake Tee, alongside commissioners Mahmood Zuhdi Abdul Majid and Detta Samen.

KUALA LUMPUR: Penyanyi veteran Datuk Mohd Jais Ahmad atau lebih dikenali sebagai Ahmad Jais meninggal dunia di Pusat Perubatan Darul Ehsan (DEMC) kira-kira pukul 9.20 pagi ini dipercayai akibat masalah paru-paru.

Allahyarham Ahmad Jais berusia 75 tahun.

Menantunya, Amirul Izwan Razak, 28, berkata jenazah Allahyarham dimandi dan disembahyangkan di Masjid Negeri Shah Alam sebelum dikebumikan di Tanah Perkuburan Islam Seksyen 21 Shah Alam hari ini.

Penyanyi yang popular dengan lagu Selamat Hari Raya dan Budi Setahun Segunung Intan yang dinyanyikan bersama Kartina Dahari itu dimasukkan ke pusat perubatan itu sejak dua minggu lepas kerana kesukaran bernafas.

Allahyarham Ahmad Jais meninggalkan lima orang anak dan isterinya Mas Halilah Mas Nayeem telah meninggal dunia pada 22 Jun 2009.

Penyanyi yang mula berkecimpung dalam bidang muzik sekitar era 60-an mengadu penat selepas pulang dari membuat persembahan di Batu Pahat, Johor, pada 8 Sept lepas.

Tetapi sakitnya mula serius pada malam 20 Sept lepas sehingga terpaksa menggunakan alat bantuan pernafasan di Hospital Pakar KPJ Selangor, Seksyen 20 di sini. Allahyarham kemudian dipindahkan ke DEMC untuk rawatan lanjut.

Persembahan terakhir Allahyarham ialah pada majlis Rumah Terbuka Hari Raya Aidilfitri peringkat kebangsaan di Permatang Pauh, Pulau Pinang pada 11 Sept lepas yang turut dihadiri Perdana Menteri Datuk Seri Najib Tun Razak.

Pakatan sedia batal akta Kampung Baru jika menang Putrajaya

Sambil menyifatkan pengkhianatan kepada orang Melayu, Pakatan Rakyat berjanji Rang Undang-undang Perbadanan Pembangunan Kampung Baru 2011, yang diluluskan Dewan Rakyat minggu lalu di sebalik siri protes sejak tahun lalu, akan dibatal jika perikatan itu menawan Putrajaya pada pilihan raya umum ke-13.

Pilihan raya umum akan datang, insya-Allah kalau Pakatan Rakyat menang kita akan batalkan rang undang-undang ini, kata Ketua Umum Pakatan Rakyat Datuk Seri Anwar Ibrahim pada Majlis Penerangan Selamatkan Kampung Baru di Kelab Sultan Sulaiman di sini malam tadi.

Ketua Pembangkang itu berkata hanya itu sahaja pilihan yang ada pada pemilik dan pewaris tanah Kampung Baru untuk menyelamatkan kawasan penempatan eksklusif orang Melayu daripada menjadi mangsa pembangunan.

Siapa (Senator Datuk) Raja Nong Chik (Raja Zainal Abidin)? Raja Kampung Barukah? Orang Melayu di Kampung Baru tidak boleh dihina seperti ini... patut beri mesej dan ajar Raja Nong Chik (agar) hormat budaya orang Melayu.

Apa kepentingan kita di sini? PAS dan PKR, kita tiada kepentingan... ini sahaja kampung kawasan orang Melayu, biarlah ia dipertahankan. DAP pun tiada kata mahukan kawasan Kampung Baru, orang Cina pun tak mahu yang Melayu haprak ini nak mengapa? Kita Little India (di Brickfields), Little Cina (di Jalan Petaling) kita tak kacau tapi mengapa Little Melayu (Kampung Baru) ini jadi masalah? Kalau betul nak tolong bangunkan, beri pinjaman... tidak perlu nak buat perbadanan, katanya.

Sementara itu, Naib Presiden PAS Salahuddin Ayub melahirkan rasa kesal dan kecewa kerana gagal untuk menyekat pentadbiran Najib daripada meluluskan rang undang-undang itu.

Sekali lagi menyaksikan dengan kekuatan majoriti Bar! isan Nas ional (BN) dalam Parlimen rang undang-undang ini telah diluluskan pada 5 Oktober lalu, di mana kami bagi pihak Pakatan Rakyat telah mencuba dengan bersungguh-sungguh dan telah habis segala ikhtiar kami sebagai manusia biasa untuk halang ia daripada diluluskan.

Hasilnya selepas ini Dewan Negara yang akan bersidang pertengahan Disember dan ia akan diluluskan dan rang undang-undang akan digazetkan dan pemilik, pewaris dan tanah akan tertakluk masa depan dengan rang undang-undang, katanya.

Bagaimanapun tegas Ahli Parlimen Kubang Kerian ini, nasib dan masa depan Kampung Baru boleh diselamatkan sekiranya Pakatan Rakyat menerajui Putrajaya.

Kalau nak rang undang-undang ini ditarik balik jatuhkan BN pada pilihan raya umum ke-13 kerana dari segi amalan dan usaha kita dengan cara itu rang undang-undang ini boleh ditarik balik jika wakil rakyat mendapat mandat yang besar dalam Dewan Rakyat dan Dewan Negara, katanya.

Jelas Salahuddin, pemimpin Pakatan Rakyat tidak mempunyai sebarang kepentingan ke atas petempatan berusia 111 tahun itu dan segala bentuk pembangunan harus diputuskan pemilik dan pewaris tanah kawasan itu.

Apa pun yang kami bercakap sama ada di dalam atau luar Parlimen, kami tiada kepentingan apa-apa... kalau saya bercakap soal Kampung Baru, saya tiada apa-apa, kami tiada kepentingan, kami tiada saham dan kami tiada syarikat yang berkepentingan di Kampung Baru.

Apa yang kami buat pada hari ini sekadar tanggungjawab kami untuk melindungi dan mempertahankan hak pewaris Kampung Baru, itu sahaja, katanya.

Beliau juga berharap rang undang-undang baru yang menggantikan Rang Undang-undang Perbadanan Pembangunan Kampong Baru 2010 tidak akan menggadai hak pemilik dan pewaris tanah.

Rang undang-undang yang diluluskan ini boleh buat apa sahaja, saya hanya mampu berdoa dan berharap ia tidak jadi seperti pepatah orang tua-tua, kita menang sorak kampung tergadai, katanya.

Putrajaya menarik balik Rang Undan! g-undang Perbadanan Pembangunan Kampong Baru 2010 pada 3 Oktober lalu tetapi pada hari yang sama digantikan dengan Rang Undang-undang Perbadanan Pembangunan Kampong Baru 2011 sebelum diluluskan di peringkat Dewan Rakyat dua hari kemudian.

Bacaan kali kedua rang undang-undang itu telah tertangguh beberapa kali selepas dibawa ke Parlimen 14 Disember lalu ekoran protes.

Dalam pada itu, Naib Presiden PKR Tian Chua pula berkata, langkah Putrajaya meneruskan hasrat untuk membangunkan Kampung Baru tanpa mendapat izin pemilik dan pewaris tanah sebagai satu pengkhianatan kepada orang Melayu.

Ini adalah satu pengkhianatan apabila pemilik dan pewaris tanah hanya diberi peranan sebagai Majlis Penasihat sedangkan menteri diberi kuasa mutlak.

Kita perlu pastikan rang undang-undang ini tidak mengkhianati anak-anak dan generasi kita pada masa depan. Dalam pandangan menteri tanah ini akan bernilai jika ia dijual, katanya.

Organisors slam police, question PMs sincerity

KUANTAN: The protest against Lynas Corporation Ltds plans to open a rare earth processing plant here is rapidly gathering steam forcing another display of force by the authorities just months after the Bersih rally for clean and fair elections.

The organisors of the Himpunan Hijau 109 (Green Solidarity 109) gathering in Taman Gelora here hit out at Prime Minister Najib Tun Razak for allowing the police to intimidate the thousands who attended the peaceful meet on Oct 9.

We question the sincerity of our PM. Only less than a month ago, he said Malaysia should move towards a more open society and that peaceful assembly would be allowed but that was not reflected in Kuantan last week, they complained.

Police and the local town council took unnecessary actions to interrupt the event and intimidate the organizer and participants, said Wong Tack, chairman of the national steering committee formed to protest the construction of the plant.

The plant is currently under construction and protesters say the disposal of radioactive waste from its operations will be damaging.

On Sunday, protesters chanted long live the people whilst holding up umbrellas with an anti-nuclear sign and waved banners reading Lynas get out and were confronted by rows of police personnel.

According to Wong, permits from both the police and local council were withdrawn at the eleventh hour.

Temporary tents and stage that were already set up by the organizers at the event venue were dismantled in the middle of the night.

Uniformed armed personnels were at the site. Roadblocks were set up and parking ar! eas were sealed.

This is blatant abuse of power. The only reason given was instructions from above, said Wong, who added he had tried to find out who had given the order and believed the crackdown was orchestrated.

He stressed that the Himpunan Hijau 109 event was a peoples movement and organised by the local community.

It is a movement that transcends political boundaries, said Wong who was upset with how the government-controlled media distorted and misreported the event.

The national television (station) lied to the whole nation by saying that the event was a failure and was organized and backed by the opposition.

On the contrary the event marked a major victory of the people and they know this is not the climax of our struggle.

It is only the first wave hitting the shore. We assure you that if nothing changes we will bound to see the greatest tsunami.

We want everyone to know that we will walk the streets one way or another.

Either to celebrate victory or to express the strongest anger. The people have already decided.

Now its up to the authorities, he said.

Lynas denies risk

Local activist Tan Bun Teet was quoted in AFP as saying that the congregation was also protesting against land being taken away from native tribes and the use of toxic cyanide in gold mining.

Lynas has repeatedly confirmed to the Malaysian people and government that the processing plant posed no safety risks to the community.

It said any radioactive waste from the plant would be placed in reliable storage cells to avoid leaks.

The Lynas Advanced Materials Plant was scheduled to start processing rare ea! rths fro m Australia in the third quarter of this year.

In June the government said Lynas must first comply with safety recommendations by the International Atomic Energy Panel before starting production and the company has committed to meeting the guidelines.

Last month Australian MP Adele Carles called for a cessation of the transport of rare earths through Fremantle due to potential radioactivity.

Lynas refuted the claim saying that the ore was no more radioactive than the surrounding region and its transport had been approved by the Department of Environment.

Lynas has repeatedly confirmed to the Malaysian government that the processing plant posed no safety risks to the community.

It said any radioactive waste from the plant would be placed in reliable storage cells to avoid leaks.

Letter To Refugees

Dear Asian Refugees (presumably from Myanmar, Cambodia, Sri Lanka or Iran),

Congratulations for making that treacherous journey by boat to Australia! Unfortunately, that would have been the peak of your success and only the beginning of the consequences of making poor decisions.

When you landed safely on Australian shores, the first people you met were probably the Australian Customs and Border Protection Service. They probably glanced at you wearily and sent you off to some refugee holding centre.

While you were waiting in that centre, an agreement was made by the Australian government with its Malaysian counterparts. They wanted to exchange refugees.

If you could only read or hear of this news, you would be horrified. Malaysia is not a signatory to the UN refugee convention. It treats its refugees very badly. It abuses those who try to protect, help and speak out for refugees as well.

Like Irene Fernandez for example, who in 1995, published a report on the abuse of migrant workers, cataloguing the malnutrition, physical and sexual abuse and the appalling conditions and the detention camps where they end up and where many of them die. She was arrested at home and charged with maliciously publishing false news.

You may say that it happened long ago and that conditions have since improved. You would be very wrong. I recently met this person, who for some reason, has a heart for the downtrodden.

In Malaysia, "downtrodden" could refer to a number of groups, including the rural poor, urban poor, non-Muslims, but it is most significantly applied to the group of people called "refugees".

This acquaintance of mine chanced upon a number of detention camps for refugees and she thinks that Irene Fernandez was grossly understating the conditions. Most of these camps are under the watch of RELA.

RELA is a paramilitary organisation that can only be formed under an Emergen! cy. We a re currently under 4 emergency rules which have yet to be lifted. These rules are still being enforced so that it allows the UMNO government more leeway to do things within its discretion.

Unfortunately, there are no rules to govern what RELA can or cannot do, as they are an ad-hoc organisation. They know it, so they pretty much do as they please, including having their way with refugees.

My acquaintance told me that the refugees quake in fear when the RELA members as much as just walk past. If you are unaware of what I am trying to say, please watch the movie, 'The Kite Runner' about life in Afghanistan. It would be an eye-opener to you, though I wager most of you (and not just you, but most Malaysians as well) would come away traumatised.

This acquaintance of mine, if caught, can be charged with aiding and abetting because she brings along food to eat when she pays them a visit.

Don't get me wrong. I know that you refugees do not come about because you're bored. In a previous post, I once said, "Something drastic must have caused these people to flee their homeland. Often it is war. Sometimes it is the tyranny of the tin-pot dictators. People don't become refugees in search of a better lifestyle; they become refugees because they have no other choice."

Sometimes, I really wonder if you did have a choice, to begin with. Why didn't you fight the oppressors in your home country? The biggest group of refugees in Malaysia are the Myanmarese -- the Chins and Rohingyas -- why didn't you do something before you let your country get to that sorry state??

The rest of the world is fighting against their oppressors. In many instances, they are the men in white collars. In other countries, it is the men in military uniforms. The Americans have decided to stop taking it lying down! And consequently, we have the Wall Street Occupation, speaking out against the bullying and thieving done by the white collars.

We Malaysians have woken up as well. We refuse to let the select few rape and plunder.

But this exchange program between the Australian and Malaysian governments are for a reason. They want to naturalise you refugees and give you citizenship and voting rights in exchange for your votes. They say there is no such thing as a free lunch. They, whoever they are, are right indeed.

So for your rights to live and start your new life, you will be violating our rights to a free and democratic government. And frankly, that is what upsets us. It is not your presence here in this country. It is your political role.

And for that reason alone, we don't want you. Nothing personal.

Pemimpin Umno sepakat pilihan raya tahun depan

PETALING JAYA: Beberapa pemimpin Umno meramalkan Pilihan Raya Umum (PRU) ke 13 akan diadakan pada awal atau pertengahan tahun depan.

Setiausaha Umno Sabah, Datuk Abdul Rahman Dahalan berkata, beliau berkeyakinan PRU akan diadakan dalam tempoh enam bulan dari sekarang iaitu selepas Jawatankuasa Terpilih Parlimen (PSC) selesai membahaskan isu penambahbaikan dalam sistem piilihan raya di Malaysia.

Kalau dalam masa terdekat, saya rasa tidak, kata ahli parlimen Kota Belud itu ketika dihubungi hari ini.

PSC yang dianggotai oleh lima ahli parlimen dari Barisan Nasional (BN), tiga Pakatan Rakyat dan seorang bebas dijangka memulakan perbahasan akhir bulan ini.

Beliau berkata demikian ketika diminta mengulas ucapan Perdana Menteri Datuk Seri Najib Tun Razak di Majlis Penerangan Perdana BN Wilayah Persekutuan di Pusat Dagangan Dunia Putra (PWTC), Kuala Lumpur semalam bahawa PRU 13 sangat dekat.

Walaupun beliau tidak menyebut tarikhnya tetapi secara berseloroh berkata sehari dua lagi.

Manakala Ketua Penerangan Pemuda Umno, Datuk Reezal Merican Naina Merican berkata, isyarat pilihan raya sudah kelihatan sekarang.

Isyarat yang biasa menandakan pilihan raya semakin hampir ialah apabila ada ucapan dari perdana menteri ke arah itu dan gerakan jentera pilihan raya bermula. Jadi mengambil kira faktor-faktor itu, saya kira PRU ke 13 tidak lama lagi, katanya.

Sementara itu, bekas Menteri Besar Selangor, Datuk Seri Dr Mohd Khir Toyo berkata, Najib perlu membubarkan Parlimen selepas dapat mendaftarkan semua penerima bantuan RM500 kepada keluarga berpendapatan RM3,000 sebulan.

Jika janji ini dapat dilaksanakan tepat pada masanya maka sokongan kepada BN ! akan men ingkat secara mendadak. Tetapi, jika janji itu tidak dibuat, ia akan memberi kesan buruk kepada BN. Orang akan kata, janji Perdana Menteri tidak boleh dipercayai, katanya.


Mangroves: One of natures best friends

With all the respect that they command these days, it is easy to forget that mangroves were once the target of bum raps. For instance, in 1667, an anonymous traveller wrote: Wild boars and other savage beasts live in them The roots gave off a clicking sound and the odour was disgusting. We felt we were watching something horrible. No one likes mangroves.

Mangroves are a salt-tolerant group of plants that dominate tropical and subtropical coastlines. It has only been within the last decade that scientists have widely accepted their importance to the marine environment. Some of these same scientists had, earlier, even gone so far so as to describe them as freaks of nature and a form of wasteland.

Today, however, mangroves are recognised as contributing to the health of the natural environment in four ways: in soil formation and the stabilisation of coastlines, as filters for upland runoff, as habitats for many marine organisms, and as highly productive ecosystems.

In their leaves, mangroves store the energy of the sun and the nutrients in the silt carried by upland rivers. Mangroves shed and grow new leaves on a continual basis. The fallen leaves provide the foundation for nearby marine and terrestrial food chains.

With this huge supply of food, mangrove swamps are a nursery ground for most sport and commercial fish species. As a result, mangrove-based energy and nutrients are exported to surrounding coral reefs and grass beds.

< /a>Zoher Mustan, senior resident naturalist at Tanjung Rhu Resort in Langkawi, says that mangroves are sources of highly valued commercial products and fishery resources. The ecosystem provides a source of food, since they are breeding grounds and nurseries for many food fishes and shellfishes. They also attract wildlife of various kinds.

Much of the ecological service of mangroves lies in protecting the coast from the fury of tsunamis, floods, sea level rises, wave action and coastal erosion.

The 2004 tsunami helped spark appreciation for mangroves as coasts naked of mangroves were ravaged, Zoher said.

Mangrove swamps act as traps for the sediments and sink for the nutrients. Mangroves preserve water quality and reduce pollution by filtering suspended material and assimilating dissolved nutrients. The root systems of the plants keep the substrate firm and thus contribute to a lasting stability of the coast.

However, despite the mounting evidence of their ecological importance, many people still see mangrove forests as muddy swamps that are better off filled for economic development.

Tourism highlights

But the price of not conserving mangroves is high, according to Zoher.

For one, you lose tourism dollar, he said. Currently our mangroves are one of the tourism highlights. A visit to the mangroves is a must when visiting Langkawi.

Also, imagine the effect on the fisheries industry. On average, between 50 percent and 70 percent of fish and prawns caught depend on the mangroves to get them through their juvenile stages.

When the mangroves go, so, too, will our fishes.

Furthermore, many bird species make mangroves their home and migratory birds from as f! ar as Si beria stop here for resting annually.

The programme to conserve the Ayer Hangat mangroves around Tanjung Rhu started more than a decade ago. They cover an area larger than 1,3000 hectares.

Many mangrove areas in Malaysia have suffered from deforestation, but according to Zoher not much has changed in Langkawi, thanks to the locals understanding of the importance of conservation and thanks also to holiday resorts in the area for highlighting that importance.

Continuing with his explanation of the role that mangroves play in keeping eco-systems stable, Zoher described the tangled root systems as a nursery for shrimp and many species of fish that go on to live their adult lives in the open ocean.

Mangroves also help ensure the survival of coral reefs and seagrass beds.

Mangroves stabilise the land to help prevent coastal erosion, provide fodder for domestic as well as migratory animals and are a very good source of firewood, as in charcoal, Zoher said.

Its a unique system, the only species of tree in the world that can grow in swampy ground.

A tour in the mangrove forest will give you an unforgettable experience. Stop over for sightings of birds of prey such as white-bellied eagles and brahminy kites, take a look at local fishes that make mangroves their home and walk through a cave to see the bats.

So do not dismiss them as just a smelly mess of tangled branches and roots. At first sight, they may not seem pretty in the conventional sense. But try to understand the vital role they play in our lives, and you will soon see their beauty shining forth, as if from within.


Nothing civil about the service

The Malaysian Trade Union Congress (MTUC) is beaming from ear to ear, overjoyed that the wishes of the 1.3 million civil servants have been taken care of in Budget 2012.

If MTUC president Osman Omar is happy, the rakyat too is looking forward to an efficient service from the public sector, no longer having to put up with the antics of public servants least interested in their jobs.

But the rise in productivity remains to be seen, as is the decrease in corruption.

In detailing Budget 2012 on Oct 7, Prime Minister Najib Tun Razak announced the extension of retirement age for civil servants from 58 to 60. He also announced an annual increment of 7 percent to 13 percent for all civil servants.

Najib also announced a bonus of minimum RM500 for civil servants and government pensioners that would be paid in December. This excluded the RM500 that had already been paid in August.

It is comprehensive and meets the wishes of the civil servants. I would like to thank the prime minister and the government for heeding the civil servants wish list, Omar said.

He added that the bonuses, salary increments and salary adjustments would also increase productivity of the civil sector.

Previously, he said, there were dissenting voices but the civil service-focused budget is able to resolve dissenting voices as all the demands are met.

Sad, because it were those very dissenting voices that so often shortchanged the public through their couldnt-care-less approach to work when the latter approached them for assistance.

Wheres the pride in civil service?

While the goodies assured by Najib have pleased the civil service, more has to be done to make sure the rakyat is given the! best se rvice at all times. Gone should be the days when a member of the public is given the run-around by those in the civil sector.

Stories of people being pushed from one counter to the next or from one department to another have further blemished the image of the public service in this country.

So, while the monetary lure and an extension of retirement age might or might not do the trick to shape up the civil service, it is the attitude of the public servants that has to change. And change can only come through leadership by example.

The onus lies with the government of the day to set a benchmark in so far as quality service is concerned. There should be no more of such sights where instead of all five public counters, only one is in service as the rest are either off for their long tea breaks or are simply missing in action.

Will the enticement offered by Najib to the civil service act as the desperately needed paradigm shift in the civil service? Only time will tell.

Rakyat can only be hopeful

With the 13th general election not too far away, the rakyat has every reason to doubt the Najib governments generosity vis--vis Budget 2012. To try and fill the pockets of the civil servants under the pretext of Barisan Nasional cares might be Najibs way of securing support from these public servants.

But then having faced years of unsatisfactory service dished out by the public service, the rakyat has wisened up to the tricks and treats of the BN government.

In 2007, a survey carried out by the Hong Kong-based Political and Economic Rick Consultancy said foreign businessmen perceived Malaysias economy to be more corrupt in 2007 compared to 2006. The survey polled 1,476 expatriate business executives in 13 countries and territories across the region.

A few years back, Transparency International cautioned that corruption had reached a critical level in Malaysia, with the country falling in international rankings.

The UNs Asia-Pac! ific Hum an Development Report highlighted an International Country Risk Guide finding which saw Malaysia decline from a score of 4.00 in 1996 to 2.38 in 2006, with a lower score representing greater corruption.

It is worrying because it is a business index which reflects on our domestic investment, foreign direct investment and confidence in the economy, said Ramon Navaratnam, then head of graft watchdog Transparency International Malaysia.

Corruption is at a critical level here, he had warned.

Ramon said corruption in Malaysia was deeply entrenched in the negotiation of contracts, with bribes being paid to government officials to speed up trade licences, for police protection and for loan transactions.

Our economic structure, the way we do business here, needs to be reviewed, renewed and redesigned, Navaratnam had said.

He warned that Malaysia could lose its competitive edge if it remained complacent and inefficient.

Malaysia can do much better if there is stronger political will to fight corruption. Given the rapid pace of globalisation and increasing economic competition among Asian countries, its time to pull our socks up, Navaratnam was then quoted by Thomson Financial News as saying.

Speaking of political will, is Budget 2012 feel-good handouts to the civil service the BN-governments way of overhauling the performance of government servants, which at present leaves much to be desired? Only time will tell.

BN not sure whether Budget 2012 can help BN regain Penang...

Despite glowing feedback on Prime Minister Najib Abdul Razak Budget 2012 proposals, Penang BN leaders are not able to confirm if the goodies will help them reclaim the state in the 13th general election.

State BN working group committee chairperson Dr Teng Hock Nan said the budget is meant for everyone, whether a voter or not, denying claims that it is an election budget.


It is not for winning elections alone. It is meant for everybody, including those who are studying in primary or secondary schools, who do not vote yet, he told reporters at the coalitions headquarters in Bayan Baru today.


State MIC liason committee chairperson PK Subbaiyah said the budget is an answer to the rising cost of living for people who are feeling the pinch.


The budget is to help them reduce their hardship, said the BN-appointed senator.


State BN information chief Loga Bala Mohan said the budget had put the peoples interests first, and that winning the election is secondary.


The PM has promised that the people will enjoy the wealth of the country, and he has given his answers, said Loga Bala who is state PPP chairperson.


The budget alone cant win the election, there is still many things that we have to do."


Bukit Mertajam Umno chief Musa Sheikh Fadzir said the budget is for all, regardless of their voting status.


The Penang government, on the other hand, would ensure that those who benefit from the state coffers are actual voters, added the Umno-appointed senator.


Sweetener ahead of polls

Among other th! ings, th e budget has been described as a sweetener ahead of early polls, which could be called by early next year, although it is not due until 2013.

Pakatan Rakyat has denounced Budget 2012 as unrealistic, merely consisting of one-off handouts to the rakyat to buy votes.


Yesterday, Najib had asked the BN to gear up for the coming polls, warning coalition members to focus on winning, not fighting with one another.


Meanwhile, Teng, who is state Gerakan chief, said Penang BN is setting up a secretariat to address various questions raised by Penangites on the budget.


He said the budget has been well-received by the people, who want to know how they can obtain the benefits.


There are questions, for example, on who can qualify for the RM500 subsidy for those earning RM3,000 or less per household, said the former Penang state executive council member.


People are asking how this mechanism will work and how soon can they get the money."


Teng said state BN leaders are in the process of communicating with the relevant ministries on how to help the people get the benefits as soon as possible.


BN assemblypersons, coordinators and senators will be mobilised to inform the public on the matter.

ORANG CINA BELA PAS!!!


Berambuslah MCA: Warga internet Cina tampil bela PAS |

Memang sesuatu yang dijangka apabila MCA menggunakan "Hukum Hudud" untuk menyerang Pakatan Rakyat, ketika isu ini kembali semula ke persada politik menjelang PRU ke-13.

Namun, ia mungkin sesuatu di luar jangkaan apabila serangan MCA kali ini mengundang reaksi sebaliknya di ruang internet, menyaksikan bagaimana parti Cina ini dibidas sehabis-habisnya oleh warga internet.

Artikel berjudul "Orang Cina Malaysia wajib baca! MCA, Saya nak undi PAS!" ditulis oleh seorang penulis dengan nama samaran "yue" (maksud: bulan), disiarkan oleh seorang rakannya melalui laman sosial Facebook pada jam 2 petang, 4 Oktober 2011. Tulisan ini telah dikongsi oleh kira-kira 1,500 rakan Facebook, dalam masa 48 jam.

Meskipun diselit dengan kata-kata kesat yang mencaci MCA, namun tulisan ini sempat mengulas alasannya memperlekehkan MCA dan mengapa PAS dibela. MCA dibidas kerana tunduk dan bersekongkol dengan UMNO; sementera PAS disanjung kerana beberapa langkah yang memperlihatkan "keterbukaannya" terhadap golongan bukan muslim.

Bagaimanapun, penulis tidak menunjukkan pendirian untuk menyokong pelaksanaan Hukum Hudud, hanya menyebut ia sebagai matlamat tertinggi PAS, dan realiti politik hanya membenarkan pelaksanaan dasar bersama dalam "Buku Jingga", seandainya Pakatan Rakyat memerintah. Malah, menurut penulis, seandainya masyarakat Cina tidak suka jika Hukum Hudud dilaksanakan, maka tukarlah semula kepada Barisan Nasional dalam PRU ke-14 kelak.

Yang berikut adalah terjemahan dan suntingan tulisan berjudul "Orang Cina Malaysia wajib baca! MCA, Saya nak undi PAS!"

Saya, sebagai warga Malaysia kaum Cina, tiada Roket mahupun Keadilan bertanding di kawasan pengundian saya, hanya pertembungan terus antara UMNO dengan PAS. Sekarang, secara rasminya saya mengumumkan di sini, bahawa pada PRU yang akan datang, saya akan mengundi PAS!

Melihat kepada pemimpin MCA yang haprak berucap menyerang Hukum Hudud Islam dalam perhimpunan agung tahunannya, kononnya mempertahankan kepelbagaian budaya Malaysia, saya teringin nak berkata, MCA, pergi mampuslah!

XXX, saya sebagai orang Cina di Malaysia, sekarang saya ingin berkata kepada MCA, pada pilihan raya umum yang akan datang, saya pasti akan mengundi PAS! Malas saya nak layan kau!

Jangan kata kepada saya penubuhan Negara Islam, akan dipotong tangan dan dipotong kaki, XXX, Malaysia di bawah perintah kau dan UMNO - Teoh Beng Hock pun boleh jatuh dari bangunan! Polis boleh tembak sewenang-wenangnya! Tak kurang tahanan ya! ng mati dalam lokap! Belum sempat kami dipotong tangan dan kaki oleh PAS, mungkin dah mati kena aniaya unit penguatkuasa!

XXX, MCA, parti yang haprak, saban hari memfitnah PAS dalam akhbar. Tahukah kau, PAS memperuntukkan tanah untuk 'menyara' sekolah menengah Cina di Kelantan; di Perak, benda yang sama berlaku ketika pemimpin PAS menjadi Menteri Besar. XXX... Dah berapa tahun kau MCA menjadi kerajaan, tapi gagal menginstitusikan peruntukan kepada sekolah Cina, dan sekarang kau suruh kami jangan mengundi PAS, gila!

XXX, saya sebagai orang Cina di Malaysia, XXX, satu parti yang besar, dalam perhimpunan agungnya, boleh menggunakan sepenuh masa untuk mengecam idealisme Islam, pada masa yang sama akur secara senyap kepada perkauman sempit UMNO, parti apa yang haprak sebegini? Memang parti haprak yang tidak boleh diselamatkan!

Apabila UMNO menyerang, bahawa Cina adalah "pendatang", suruh kami balik ke Tiongsan, PAS yang tampil mempertahankan kita!

Apabila UMNO melarang bukan-muslim menggunakan kalimah Allah, PAS yang tampil mempertahankan hak bukan muslim!

Apabila UMNO melarang bukan-muslim ke dalam masjid/surau, PAS yang tampil membantah UMNO!

Apabila PERKASA yang pro-UMNO menyerang bahawa Pakatan Rakyat mengkhianati Melayu, PAS yang tampil menyanggah mereka!

XXX, apa yang kau MCA lakukan? Hanya mampu berkata UMNO tak harus begini, tak patut begitu, kalau betul ! kau heba t, takkan Cina masih menjadi rakyat kelas kedua? Kalau betul ada tulang belakang, keluarlah kau dari Barisan Nasional-lah, bodoh!"

Semakin meluap-luap kemarahan saya... Sekian lama kau MCA makan duit, satu projek PKFZ kau telan RM12.5 bilion, satu Facebook RM1.8 juta, dan wang kopi yang sikit-sikit tu? Kau yang telan wang rakyat! PAS? Pernahkah kau denganr PAS terima rasuah? PAS terkenal dengan bersih dan amanah, 20 tahun memerintah di Kelantan, tiada satu kes rasuah, Menteri Besar duduk dalam rumah kampung, makan nasi lemak! Kau orang senang saja kata kalau menang makan udang galah, masih nak kami undi kau?"

MCA, berambuslah kau! Apabila Perdana Menteri mengumumkan pemansuhan ISA kerana terdesak dengan tekanan rakyat, kau bagaikan anjing, segera bersetuju! XXX, untuk sekian lama kau menyokong akta yang mencabul hak asasi manusia, kini sikap kau berubah dalam sekelip mata? Kau ingat rakyat ni bodoh? Untuk sekian lama, PAS memimpin rakyat untuk berjuang, sama ada perhimpunan anti ISA, BERSIH 1.0 mahupun BERSIH 2.0, PAS berada di baris paling depan untuk menentang kezaliman - menahan gas pemedih mata, menghalang meriam air berkimia!

Ketika 9 Julai, UMNO mengecam kami kerana berarak di jalan raya. Pada saat yang paling genting, Unit Amal PAS membuka jalan, kemudian berkata, 'Bagi Cina semua keluar dulu, kita lindung mereka!' XXX, mana kau MCA? Di mana kau sorok ketika itu? Sekarang kau panggil kami jangan undi PAS, mampuslah kau!

XXX, dah sekian tahun menjadi kerajaan, Presiden ! video lu cah itu masih berada di atas pentas untuk menggesa agar kerajaan begini, supaya kerajaan begitu... Pernahkah kau anggap diri kau sebagai kerajaan? Kalau kau sendiri tak mampu, tak larat, tukarlah orang! Bodoh!

Apa yang paling hebat, Liow Tiong Lai, mencabar DAP untuk keluar dari Pakatan Rakyat. Ketika hukum Islam diluluskan di DUN Kelantan dan Terengganu, ADUN UMNO menyokong dengan mengangkat kedua-dua tangan mereka. Satu undi pun tidak pernah diluluskan DAP. Mengapa tidak kau memimpin MCA untuk keluar dari Barisan Nasional?

PAS ingin melaksanakan Hukum Hudud, ini matlamat tertinggi parti mereka. Ia bagaikan Parti Demokratik Progresif di Taiwan yang menuntut kemerdekaan, sudah pasti ia tak jadi, kerana tidak dibenarkan realiti politik. Apatah lagi PAS bersekutu dengan dua parti komponen Pakatan Rakyat, semestinya memerintah berdasarkan Buku Jingga apabila berkuasa - bukan matlamat tertinggi PAS mahupun DAP. Mungkin ada yang akan tanya, bagaimana pula di Kelantan?

Saya teringin nak tanya mereka, jikapun terlaksana di Kelantan, apa susahnya? Kau bukannya muslim, apa kena-mengena dengan kau? Lebih-lebih lagi, kau tunggulah sehingga Pakatan Rakyat memperolehi majoriti dua pertiga untuk meminda perlembagaan. Buat masa sekarang, kerajaan pun belum tukar. Kini bertimbun-timbun pengundi hantu, Pakatan Rakyat nak pertahan satu pertiga kerusi pun payah!

Ramai lagi Cina bertanya, matilah kalau Pakatan Rakyat memperolehi majoriti dua pertiga. Saya kata XXX, kepala otak kau, kalau Pakatan Rakyat memperolehi dua pertiga, sudah pasti DAP ada ! 50 kerus i dalamnya. Kalau DAP tidak mengundi untuk sokong, maka tak jadilah pindaan tu.

Kemudian lebih ramai Cina tanya, kalau DAP menjadi pengecut, menyokong pelaksanaan Hukum Hudud? Kalau kau tak suka, tukar balik Barisan Nasional-lah! Takkan tiada lagi pilihan raya selepas pertukaran kerajaan pada PRU akan datang? Kan pilihan raya memberi peluang kepada kita untuk tukar kerajaan apabila kita tidak setuju dengan dasar kerajaan yang sedia ada?

Sesetengah Cina bodoh betul, saya terus terang di sini. Seandainya pada PRU akan datang, kami menyokong satu kerajaan yang sudah lama korup dan mencabul hak asasi manusia, hanya kerana takut kepada Hukum Hudud yang langsung tak pernah wujud, maka saya perlu kata, benar orang Cina ni hina. Nasib orang Cina dan rakyat akan tergadai pada tangan sendiri!

Sedarlah orang Cina, jangan lagi ditipu MCA! Hanya apabila kami mengundi Roket, Keadilan dan Bulan, bersatu menukar kerajaan yang haprak ini untuk memperbaiki nasib orang Cina di tanahair ini. Seandainya kamu mencintai bangsa kau, seandainya kamu mencintai rakyat kau, seandainya kau mencintai negara kau, berkongsilah tulisan ini dengan setiap orang kawanmu. PRU yang akan datang, kami bernyanyi bersama "Bulan lambang hatiku" (lagu Cina terkenal)!

Bajet 2012 Barisan Nasional bukan sahaja indah khabar dari rupa, malah realitinya bakal membebankan rakyat untuk jangka masa yang panjang.

Setiausaha Publisiti DAP Tony Pua berkata, berbanding belanjawan oleh Pakatan Rakyat, Bajet 2012 BN hanyalah sekadar ubat penahan sakit, bukan berniat untuk mengubati dan menyembuhkan terus penyakit sebenar.


Jelasnya yang juga Ahli Parlimen Petaling Jaya Utara, bajet itu jelas tidak dapat melakukan transformasi sepenuhnya kepada ekonomi negara, apatah lagi mencapai matlamat menjadi negara berpendapatan tinggi menjelang 2020.


Sebaliknya Pua berkata, Pakatan lebih optomistik dengan bukan sahaja telah menyediakan ubat penahan sakit dan dapat menyembuhkan ekonomi, malah dapat melakukan belanjawan yang lebih baik dengan hanya menggunakan wang yang jauh lebih sedikit daripada BN.


Belanjawan Pakatan lebih ke arah kebajikan jangka panjang dengan dasar-dasar memperbetulkan kembali putar belit kerajaan selama ini, bagi mengurangkan tekanan inflasi dan kos sara hidup rakyat, katanya.


Dalam belanjawan alternatif Kesejahteraan Untuk Semua 2012, Pakatan menyeru untuk menghapuskan monopoli-monopoli syarikat yang selama ini menghalang persaingan pasaran yang sihat, jelasnya.


Beliau memberi contoh syarikat Bernas yang mengawal sepenuhnya penjualan dan pengedaran beras tempatan.


Tambah Pua, belanjawan Pakatan jelas memastikan pasaran benar-benar bebas dan dapat bersaing secara terbuka agar rakyat mendapat manfaat dengan harga yang lebih rendah.


Oleh itu menurut Pua, Pakatan juga berniat memperbetulkan kar! tel-kart el telekomunikasi, media, industri penerbangan, syarikat minyak dan gas serta industri-industri lain yang selama ini tidak kompetitif.


Sebagai contoh, di bawah Pakatan, semua Permit Import (AP) untuk mengimport kereta akan ditender secara terbuka, bukan untuk keuntungan kerajaan semata, tetapi bagi memastikan hanya ahli perniagaan yang benar-benar telus yang mendapatnya. Bukan kroni atau jenis mereka yang menjadi orang tengah, katanya.


Justeru Pua berkata, hanya dengan perubahan struktur yang dikemukakan Pakatan inilah bakal memastikan kos sara hidup lebih rendah untuk rakyat bagi jangka masa panjang.


Hanya dengan urus tadbir yang cekap dan telus serta political will sahaja yang dapat menstruktur semula ekonomi negara.


Kerajaan BN sepatutnya tidak perlu lagi mengenakan cukai kepada rakyat melalui Cukai Perkhidmatan (GST).


Justeru, inilah perbezaan asas antara belanjawan Pakatan dan BN. Yang satu itu hanya indah khabar dari rupa yang membuatkan rakyat berasa baik hanya untuk tempoh singkat, manakala belanjawan Pakatan bertujuan menyembuhkan terus kesakitan dan penyakit dengan menggunakan kos yang serendah mungkin, katanya.

Today we mourn the passing of a beloved old friend, Common Sense,
who has been with us for many years. No one knows for sure how old he
was, since his birth records were long ago lost in bureaucratic red tape. He will be remembered as having cultivated such valuable lessons as:
- Knowing when to come in out of the rain;
- Why the early bird gets the worm;
- Life isn't always fair;
- and maybe it was my fault.

Common Sense lived by simple, sound financial policies (don't spend
more than you can earn) and reliable strategies (adults, not children, are in charge).

His health began to deteriorate rapidly when well-intentioned but
overbearing regulations were set in place. Reports of a 6-year-old boy charged with sexual harassment for kissing a classmate; teens

suspended from school for using mouthwash after lunch; and a teacher
fired for reprimanding an unruly student, only worsened his condition.

Common Sense lost ground when parents attacked teachers for doing the job that they themselves had failed to do in disciplining their
unruly children.

It declined even further when schools were required to get parental
consent to administer sun lotion or an aspirin to a student; but could not inform parents when a student became pregnant and wanted to have an abortion.

Common Sense lost the will to live as the churches became businesses; and criminals received better treatment than their victims.

Common Sense took a beating when you couldn't defend yourself from a
burglar in your own home and the burglar could sue you for assault.

Common Sense finally gave up the will to live, after a woman failed
to realize that a steaming cup of coffee was hot. She spilled a little in her lap, and was promptly awarded a huge settlement.

Common Sense was preceded in death, by h! is paren ts, Truth and Trust,
by his wife, Discretion, by his daughter,

Responsibility, and by his
son, Reason.

He is survived by his 4 stepbrothers;
I Know My Rights
I Want It Now
Someone Else Is To Blame
I'm A Victim

Not many attended his funeral because so few realized he was gone. If
you still remember him, pass this on. If not, join the majority and do nothing.

Self praise is no praise. Yesterday I read that Najib is very pleased that people are rushing to meet him and take photographs. Many are in tears and refused to let go off his hands because of his people's budget. It is obvious those people do not know how to count and in another planet of bliss not able to understand that the rise in foods and utilities like TNB, Telcos, Tolls etc are the biggest dent to putting food on the table for most families.

So continue to shed tears and hold on to Najib's hand while your stomach goes hungry.
