Hari Ini UMNO Sokong, Besok Hudud Terlaksana di Kelantan.

Mana bisa Karpal yang hanya seorang Ahli Parlimen menghalang perlaksanaan hukum jenayah shariah di Kelantan? Karpal tiada kuasa. Karpal tidak menguasai Parlimen, polis, tentera dan sebagainya.

Namun, yang menguasai kekuasaan di Malaysia adalah UMNO dan Barisan NAsional.

Apabila Enakmen hudud diluluskan di Dewan Undangan Negeri Kelantan selepas Pilihanraya 1990, gegak gempita UMNO menista serta memfitnah PAS.

Apa yang tidak dihambur pada PAS pada masa itu. PAS sesat lah, hudud PAS lah, menindas wanitalah.

Namun, apabila dijemput oleh Tok Guru NIk Aziz supaya UMNO sendiri menggubal "Akta Hudud" supaya boleh dilaksanakan di Kelantan, jemputan Tok GUru Nik Aziz itu membuat UMNO kecut perut dan senyap seribu bahasa.

Akhir sekali, mantan Perdana Menteri, Dr Mahathir Iskandar Kutty mengeluarkan kenyataan yang mengugut untuk melaksanakan MAGERAN di Kelantan sekiranya hukum tersebut dilaksanakan.

Juga, sepucuk surat amaran dihantar oleh PERDANA MENTERI MALAYSIA kepada Menteri Besar Kelantan memberi amaran keras terhadap perlaksanaan hukum Jinayah ISlam dari dilaksanakan di Kelantan.

Sehingga hari ini, surat tersebut tidak ditarik balik oleh mana2 Perdana Menteri Malaysia. Ia bererti surat tersebut masih SAH.

Seperti kata Tok Guru Nik Aziz:

Saya katakan, surat yang dihantar oleh beliau dulu atas sifatnya sebagai Perdana Menteri

Saya tidak pernah mendengar dasar bahawa mana-mana surat yang dihantar oleh Perdana Menteri akan tamat tempoh kuatkuasa apabila Perdana Menteri tersebut meletakkan jawatan

Adakah semua perkara akan tamat tempoh dan perlu diperbaharui apabila berlaku peralihan Perdana Menteri, soalnya dalam lam! an sosia l Twitter dan Facebook akaunnya pagi tadi.


PAS PERLU PINDA AKTA JENAYAH UNTUK LAKSANA HUDUD DI KELANTAN

Selain dari kebenaran MEnteri Dalam Negeri/PErdana Menteri, diperlukan juga pindaan terhadap Kanun Kesiksaan(Penal Code) bagi menjamin hudud terlaksana di Kelantan.

Untuk ini berlaku, perlu sokongan dari Ahli2 Parlimen dari UMNO dan PAS serta PKR. Kita tahu, Penasihat PKR telah memberi sokongan kepada perlaksanaan hudud di Kelantan.

Maka, yang diperlukan sekarang adalah sokongan dari Ahli2 Parlimen UMNO bagi meminda Kanun Kesiksaaan bagi membolehkan hudud terlaksana di Kelantan.

APA SALAHNYA BUKAN ISLAM TIDAK BERSETUJU DENGAN HUDUD?

Hebuh UMNO menjaja kenyataan pemimpin2 DAP menolak hudud dan Qisas. Tetapi, apa yang peliknya mereka yang bukan ISlam menolak hukum Islam.

SAmalah kalau orang Islam menolak "Canon Law". Mana mungkin orang ISlam boleh menerima undang-undang jenayah Agama Kristian.

Begitulah juga orang bukan Islam yang menolak hudud. Ia adalah kerana mereka itu BUKAN ISLAM dan mereka tidak beriman dengan hukum2 Islam.

Namun, yang harus ditanyakan adalah:

Pendakwaan Mat Sabu membuktikan reformasi politik Najib adalah janji kosong

Pendakwaan Mat Sabu membuktikan reformasi politik Najib adalah janji kosong

Kes Timbalan Presiden PAS Mohamad Sabu (Mat Sabu) yang didakwa memfitnah anggota polis yang terbunuh ketika serangan komunis ketika zaman British menunjukkan Kerajaan Barisan Nasional (BN) sekali lagi mempergunakan mahkamah sebagai saluran politik untuk menakut-nakutkan, membuli dan memenjarakan lawan politik mereka.

Sekiranya Mat Sabu didapati bersalah, beliau akan dihukum masuk penjara selama dua tahun dan didenda. Sekiranya ini berlaku, beliau boleh ditegah dari bertanding dan berkempen di dalam pilihanraya umum yang akan datang. Adakah ini taktik BN untuk mengelak dari menghadapi Mat Sabu di dalam pilihanraya yang akan datang memandangkan perbicaran beliau dijadualkan pada Disember 2011?

Pada Khamis lepas, Perdana Menteri Najib Razak telah mengumumkan reformasi politik di Malaysia dengan kata-kata manis seperti "mana-mana individu tidak akan ditahan semata-mata hanya kerana ideologi politik" dan "Malaysia menjadi lebih terbuka lagi dinamik demokrasinya."

Tidak sampai seminggu telah berlalu, lawan politik beliau Mat Sabu telah pun didakwa di mahkamah atas pendapat perbadinya mengenai sejarah. Kebebasan bersuara dan meluahkan pendapat tidak dipedulikan begitu sahaja. Perdana Menteri yang benar-benar berfikiran terbuka dan dinamik haruslah sedar bahawa perbezaan pendapat mengenai penterjemahan sejarah tidak sesuai dibahaskan di bilik mahkamah tetapi haruslah diselesaikan melalui dialog dan perbahasan di dalam ruang akademik.

Lebih-lebih lagi, kenyataan Mat Sabu tidak memfitnah sesiapa. Beliau juga tidak mengapi-apikan sebarang isu perkauman ataupun agama, berbeza sekali dengan Utusan Malaysia dan Perkasa yang telah berulang kali mengeluarkan kenyataan yang mengapi-apikan sentimen perkauman, rasa benci and berbohong tanpa dikenakan sebarang ! tindakan oleh kerajaan. Mereka dibiarkan menyemai benih-benih ketakutan dan kebencian secara bebas.

Pendakwaan Mat Sabu membuktikan kerajaan bersifat berat sebelah dan mengamalkan pendakwaan secara pilih kasih.

Saya mengutuk serangan bomb petrol ke atas kediaman Mat Sabu semalam. Saya juga mengutuk ugutan simbahan asid yang diterima oleh beliau melalui SMS sebelumnya. Ugutan sebegini terhadap beliau dan keluarga beliau adalah jenayah dan harus didakwa di mahkamah. Saya mengulang seruan saya kepada Polis DiRaja Malaysia untuk menyiasat kes ini, menangkap orang yang bertanggungjawab dan menyediakan pelindungan yang sewajarnya kepada beliau dan keluarga beliau.

Saya juga menggesa pemimpin Barisan Nasional supaya mengeluarkan kenyataan akhbar untuk mengutuk ugutan terhadap Mat Sabu agar menunjukkan pendirian mereka menentang keganasan di dalam bidang politik.

KL shares end sharply lower on selling pressure

KUALA LUMPUR: Bursa Malaysia closed sharply lower today on selling in heavyweights, which dragged the FTSE Bursa Malaysia KLCI (FBM KLCI) below 1,400 level, dealers said.

The bourse failed to sustain yesterdays gain with the benchmark index down 31.23 points, or 2.201 per cent, to close at 1,387.81, which was also the intra-day low.

The FBM KLCI earlier opened 5.99 points lower at 1,413.05.

According to the UOB Economic Treasury Research report, the markets remained unimpressed and was sceptical that further US Federal Reserve (Fed) action was of any help to revive the stalling US economy and labour market.

Yesterday, the US decided to extend the average maturity of its holdings of ecurities, or popularly known as Operation Twist.

One of the moves included the Feds decision to reinvest principal payments from its holdings of agency debt and agency mortgage-backed securities (MBS) back into agency MBS to support mortgage market conditions.

At the same time, it kept the policy rate range unchanged and maintained its promise to keep rates at exceptionally low levels at least through mid-2013, said the report.

The Finance Index lost 312.131 points to 12,877.52, Plantation Index dropped 135.91 points to 7,133.68 and the Industrial Index declined 47.21 points to 2,567.67.

The FBM Emas Index declined 249.61 points to 9,383.84, FBM70 Index fell 403.53 points to 9,835.68, FBMT100 dived 242.811 points to 9,222.63 and the FBM Ace went down 92.78 points to 3,614.57.

Decliners thumped advancers by 802 to 85 while 162 counters were unchanged, 440 untraded and 29 others were suspended.

Total market volume rose to 874.105 million units valued at RM1.71 billion from 708.059 million units valued at RM1.156 billion yesterday.

Volume! on the Main Market surged to 665.516 million shares valued at RM1.686 billion from 479.541 million shares valued at RM1.124 billion yesterday.

Turnover on the ACE Market dropped to 118.35 million units worth RM14.001million from 174.252 million units worth RM25.669 million previously.

Warrants rose to 79.798 million shares valued at RM4.058 million from 48.636 million shares valued at RM3.013 million yesterday.

Leading the losers were Hong Leong Bank and Dutch Lady Milk Industries which fell 62 sen each to RM9.98 and RM18.88, respectively, followed by Hong Leong Bank-Ord rights which dropped 58 sen to RM1.37.

In actives, Petronas Chemicals slipped 27 sen to RM5.54, Axiata Group declined six sen to RM4.63 and AirAsia was 26 sen lower at RM2.90.

As for heavyweights, Maybank declined 15 sen to RM8.40, CIMB dropped 18 sen to RM6.71, Sime Darby slipped 16 sen to RM8.08 and Maxis shed two sen to RM5.29.

Consumer products accounted for 33.293 million shares traded on the Main Market, industrial products 114.089 million, construction 53.431 million, trade and services 255.828 million, technology 12.708 million, infrastructure 16.251 million, finance 67.34 million, hotels 1.935 million, properties 84.992 million, plantation 20.723 million, mining 44,000, REITs 3.502 million and closed/fund 122,500.

Dr McDonald: Kes Anwar, kes tunggal di dunia...

Saksi pakar Molekular Genetesis dari Australia Dr Brian McDoland hari ini terus mempertahankan cadangan bahawa laporan bacaan degradasi profil DNA adalah kritikal.

Beliau yang masuk hari keempat memberi keterangan di kandang saksi kes fitnah liwat kedua Datuk Seri Anwar Ibrahim berpendirian bahawa sebarang laporan berkaitan degredasi akan menyumbang kepada faktor utama bagi mengesahkan kredibiliti bukti.


Beliau yang diperiksa balas oleh peguam Ram Karpal Singh hari ini mempertikaikan peranan pakar kimia Jabatan Kimia Malaysia (JKM) Dr Seah Lay Hong yang mengabaikan beberapa prosedur standard makmal.


Dalam keterangan Seah sebelum ini kepada mahkamah, beliau mengakui degredasi berlaku pada sampel yang diambil dari dubur pengadu Saiful Bukhari Azlan sekiranya ia terdedah pada persekitaran.

Namun beliau mengambil keputusan mengabaikan penemuan tersebut selain mempertahankan pendirian bahawa degredasi tidak penting selepas profil DNA ditemui.


Ram Karpal kemudian menyoal Brian sekiranya sel sperma boleh bertahan selama 113 jam di dalam rektum.


"Kemungkinan 99 peratus ianya tidak akan berlaku... 56 jam adalah yang paling lama pernah dilaporkan," jawab Brian.


Brian kemudian ditunjukkan semula artikel dalam bahasa Thai yang dikemukakan oleh pendakwa semalam namun beliau mengatakan tidak faham.


Timbalan pendawaraya Datuk Yusof Zainal Abiden semalam mengemukakan artikel kajian antarabangsa bersabit jangka hayat sel sperma mampu bertahan selepas terdedah kepada suhu normal.


Ram Karpal sebelum itu bertanya sekiranya pakar itu bersetuju catatan dalam bahasa I! nggeris pada artikel tersebut, namun Brian menyifatkan artikel tersebut tidak ada kredibiliti dan musykil bagaimana ianya boleh dijadikan rujukan mahkamah.


Brian tetap mempertahankan kredibiliti beliau sebagai pakar ujian DNA selain membacakan keterangan Mahkamah Rayuan Australia mengatakan beliau adalah seorang saksi yang benar.


Beliau kemudian menolak cadangan bahawa beliau berhasrat mengelirukan mahkamah berhubung ujian AP yang dilakukan Dr Seah dan menjelaskan sekiranya laporan dibuat, ianya dapat dibandingkan dengan kesasteraan perubatan.. -tvsnews


McDonald: Anwar's case the only such one in the world

The Australian DNA expert describes Anwar Ibrahim's case, where the chemist retrieved DNA after 56 hours in the rectum, and left it for another 48 hours in the open, as one of the longest documented discoveries in the world, if the results can be believed.

Dr Brian McDonald said it was extremely rare that one could find sperm after 113 hours in the rectum, in referring to a 1997 article shown to him two days ago by the prosecution.


That case, along with the 1982 case (which states that sperm can be retrieved after 65 hours), are the only two documented. In 99.9 percent (of the cases), you cannot find sperm at all after such long hours.


However, this (Anwar) case is the only one (that I know of) in the world where the sperm can be captured after 56 hours and given to the chemist two days later, where you can still find a good DNA sample, McDonald said.


He was responding to questions from Ramkarpal Singh during re-examination today.


McDonald had two days ago ! concurre d with suggestions by solicitor-general II Mohd Yusof Zainal Abiden, over the finding in the article titled 'Sexual Assault and Semen Persistence' written by GM Willot and JE Ellard.


Ellard was the scientist who made the 1982 discovery that the sperm can last for 65 hours.


McDonald said that to his knowledge and according to some journals, one could find a good DNA after the sample was retrieved from the rectum after eight hours.


Saiful was examined at the Hospital Kuala Lumpur between 9pm on June 28 and midnight on June 29, 2008, where the samples were retrieved.


Investigating officer Supt Jude Blacious Pereira admitted in court that he did not keep the samples in the refrigerator, but placed them in the drawer of his air-conditioned office. Jude gave the samples to chemist Dr Seah Lay Hong two days later.

McDonald said findings of sperm having lasted 113 hours in the rectum are not normal.


In my experience for the last 20 years, it (such a case) would give poor results.


He emphasised that degradation was an issue as the credibility of the sample was put at stake.


It is 56 hours in rectum and 48 hours outside and yet you find pristine nature in the findings.

Palestinians must register their claim for statehood

The last time I rechecked the United Nations did not belong to the United States, neither to those who had veto power like China, France, Russia, the United Kingdom.

In fact the UN is an international organisation whose stated aims are facilitating cooperation in international law, international security, economic development, social progress, human rights, and achievement of world peace.

It was founded in 1945 after World War II to replace the League of Nations, to stop wars between countries, and to provide a platform for dialogue. It contains multiple subsidiary organisations to carry out its missions.

So why is the US President Barack Obama telling the UN there was no short cut to Middle East peace and urging the Palestinians to stop trying to get statehood from the Security Council in their application this Friday.

That is not all, the Washington Hawks are furiously scrambling to head off a UN showdown when it is clear that the US is warning world leaders that trying to create a Palestinian nation by simple decree is unwise.

For that matter again, why amid frantic efforts to avert a diplomatic disaster, French President Nicolas Sarkozy is urging the UN to grant the Palestinians the status of observer state, like the Vatican, while outlining a one-year roadmap to peace?

The irony remains that both presidents, having major domestic problems and challengers to their presidency are offering different solutions to defuse the diplomatic crisis. Obama need not preach to us that peace will not come through statements and resolutions at the UN.

The world already knows that with the vulgar Jewish lobby, the presence of the Washington Hawks, the pressures of the US right wing and USs veto, this will not be possible as the US will do everything possible to protect the rights, interests and obsessions of that mischievous bully and misbehaved nation called Israel.
Im happy to learn from my! friends among the Palestinians that they will go ahead with their proposal and will not be intimidated by any quarter. Im also encouraged by the words of Palestinian senior aide Saeb Erekat who stated that the pursuit of full UN membership would not be slowed and that they will not allow any political manoeuvring on this issue.

This is important for President Abbas who has to save face and prevent an embarrassing defeat that might empower his Fatah partys rival faction, the alleged militant Islamic group Hamas, which is considered a terrorist group by Israel and the United States from gaining ultimate power.

We are all aware that at the 15-member Security Council, approval of a resolution requires nine yes votes and no veto by a permanent member i.e. the US, Russia, China, Britain and France. If the resolution gets fewer than nine votes, it would be defeated without the US aving to use its veto.

And that will be the worse case scenario for the US and President Barrack Obama in the wake of the Arab reawakening and Arab Spring. The Palestinians could also seek a lesser form of recognition by the larger UN General Assembly, where they have overwhelming support.

This is the least they could do after failed peace talks, bickering and sporadic outbreaks of violence, genocide, war crimes, and the imprisonment of a population robbed of their peace, land, statehood, independence, human dignity and life itself.

On the one hand, it is about a homeland, human dignity and the right to statehood for a community of people who have endured suffering, genocide, war crimes, theft of land and property and the other the awful reality of the Jewish lobby, Israels cannibalism, bullying and a powerful punishing US veto. Gosh, what a situation!


Hudud cracks in Pakatan

PETALING JAYA: Cracks are beginning to appear in Pakatan Rakyat over the Islamic law issue, with opposition supremo Anwar Ibrahim backing its implementation in the PAS-run state of Kelantan but DAP stalwart Lim Kit Siang shooting it down.

Political pundits noted that Barisan Nasional was bound to exploit this issue, especially with the general election being around the corner.

The controversy surrounding the Islamic law could be used to spook fear in the opposition-leaning Chinese electorate.

In a Twitter posting this evening, Lim said his partys stand on Hudud law and the Islamic state concept was consistent.

It is not suitable for Malaysia and it is not part of Pakatans common policies, he noted.

DAP had always been a fierce opponent of PAS theocratic ambitions, and the party pulled out of a loose opposition coalition named Barisan Alternatif in 2001 over this issue.

Lim also said that any such change required the agreement of all three Pakatan component parties PAS, DAP and PKR.

DAP national chairperson Karpal Singh had also voiced his opposition, describing the implementation of Islamic law as unconstitutional.

He pointed out that such an enactment would run contrary to the Federal Constitutions referrence of Malaysia as a secular state.

Anwar, on the other hand, today said he believes that in princple, Islamic law could be implemented in Kelantan.

Looking at specific areas, there is clear guarantee of an administration of justice and it does not in any way infringe on the rights of non-Muslims, he said, adding that it was his personal opinion.

The Islamic law controversy resurfaced after former prime minister Dr Mahathir Mohamad yesterday challenged PAS-ruled Kelantan to impose hudud laws.

Mahkamah tolak permohonan Peguam Negara tangguh perintah

KUALA LUMPUR: Mahkamah Tinggi di sini hari ini menolak permohonan Jabatan Peguam Negara untuk menangguhkan perintah membolehkan Anggota Parlimen Sungai Siput Dr Michael Jeyakumar mencabar penolakan permohonan mendapatkan dana projek di kawasan parlimennya.

Hakim Abang Iskandar Abang Hashim membuat keputusan itu di kamar.

Jeyakumar diwakili peguam B Mahaletchumi manakala Peguam Kanan Persekutuan Shamsul Bolhassan bertindak bagi pihak Jabatan Peguam Negara.

Shamsul memberitahu pemberita bahawa hakim mendapati tidak terdapat keadaan yang membenarkan penangguhan perintah berkenaan.

Pada 25 Feb lepas, Mahkamah Tinggi meluluskan permohonan Jeyakumar bagi mendapatkan semakan kehakiman untuk mencabar penolakan permohonan beliau mendapatkan dana kerajaan.

Mahkamah menetapkan 12 Okt ini untuk perbicaraan terhadap semakan kehakiman tersebut.

Dalam permohonannya, Jeyakumar daripada Parti Sosialis Malaysia, menamakan Ketua Pengarah Unit Pelaksanaan dan Penyelarasan Jabatan Perdana Menteri, Pengarah Jabatan Pembangunan Perak dan kerajaan sebagai responden.

Jabatan Peguam Negara mewakili pihak responden memfailkan permohonan mendapatkan penangguhan perintah diperoleh Jeyakumar itu sementara menunggu keputusan rayuan jabatan tersebut. Mahkamah Rayuan semalam menangguhkan keputusan penghakimannya setelah mendengar hujah kedua-dua pihak.

Anggota Parlimen berkenaan mengambil tindakan undang-undang selepas permohonannya mendapatkan dana untuk sumbangan kepada SMJK Shin Chung, SJK Methodist dan Rumah Anak Yatim Ihsan serta dana bagi projek kecil faedah Orang Asli, ditolak oleh pengarah berkenaan melalui sepucuk surat bertarikh 12 Okt tahun lepas.

Jeyakumar berkata permohonannya mendapatkan dana seharusnya diluluskan kerana pr! ojek-pro jek berkenaan sepatutnya menerima wang daripada peruntukan khas yang sememangnya untuk tujuan sedemikian.

Beliau mendakwa besar kemungkinan pihak responden menggunakan budi bicaranya meluluskan dana daripada peruntukan tersebut secara berat sebelah memihak kepada Anggota Parlimen daripada Barisan Nasional yang memerintah dan tidak kepada Anggota Parlimen pihak pembangkang.

Jeyakumar menuntut antara lain perisytiharan bahawa peruntukan khas itu diberi kepada semua Anggota Parlimen secara sama rata, mengikut Perkara 8 (1) Perlembagaan Persekutuan.

Beliau juga memohon perintah mandamus agar mahkamah mengarahkan supaya pihak responden menerangkan kuasa mereka dalam meluluskan dana daripada peruntukan khas itu dan menyatakan prosedur pemberian peruntukan sejak 2008.

SSABM mahu saman kerajaan salah ajar sejarah

KUALA LUMPUR: Suara Solidariti Anak Bangsa Malaysia (SSABM) tidak teragak-agak untuk mengemukakan tuntutan saman terhadap kerajaan kerana selama ini telah mendidik rakyat secara salah tentang sejarah pembentukan Malaysia pasca merdeka.

Jurucakap SSABM Aiman Athirah Al Jundi berkata, tindakan itu akan diambil jika kerajaan melalui Majlis Profesor Negara (MPN) masih berdegil enggan menarik balik dakwaan bahawa negara ini tidak pernah dijajah.

Kenyataan ini seolah-olah mencerminkan kerajaan Malaysia melalui Kementerian Pelajaran dan Kementerian Pendidikan Tinggi sejak dulu
hingga kini telah melakukan pengkhianatan, pembohongan dan salah didik kepada pelajar dalam subjek Sejarah kerana kita semua telah diajar selama ini bahawa negara kita telah mendapatkan kemerdekaan daripada penjajah British.

Rakyat seolah-olah ditipu selama 54 tahun apabila menyambut Hari Kebangsaan setiap tahun sebagai ulang tahun kemerdekaan negara dari
cengkaman penjajahan British, katanya dalam sidang media di Ibu Pejabat PAS pagi tadi.

Katanya, pendirian MPN juga dilihat sebagai satu penghinaan besar terhadap Raja-Raja Melayu yang digambarkan seolah-olah merestui British serta tidak berbuat apa-apa bagi menghalang kemasukan penjajah ke Tanah Melayu.

Justeru, beliau menuntut agar Pengerusi MPN Profesor Emiritus Datuk Dr Zakri Abdul Hamid serta Ketua Kluster Sejarah, Warisan dan Sosio
Budaya MPN Prof Datuk Dr Zainal Kling disiasat dan didakwa dibawah Seksyen 505 Kanun Keseksaan kerana mengeluarkan kenyataan yang menimbulkan kegusaran, kekeliruan dan mengganggu ketenteraman awam.

Kami percaya terdapat agenda tersembunyi yang dirancang pihak tertentu untuk kepentingan politik mereka sendiri! .

Sementara itu, Timbalan Ketua Penerangan Angkatan Muda Keadilan Rozan Azen Mat Rasip berkata Dr Zainal bersikap hipokrit kerana beliau sebelum ini pernah mengaku Tanah Melayu pernah dijajah melalui hasil kertas kerja yang pernah dibentangnya pada tahun 2003.

Najib, ISA and other emergency declarations

FMT LETTER: From Ravin Karunanidhi (ERA Consumer Malaysia), via e-mail

ERA Consumer will like to laud Najib Tun Razaks commendable decision to repeal the oppressive and draconian ISA and other emergency declarations that allows for detention without trial for a prolonged period.

The truth about the preventive laws mentioned above is that it goes against basic human rights as the right to liberty is granted under the Federal Constitution of Malaysia and Universal Declaration of Human Rights of which Malaysia is a signatory.

However, we are concerned about the other preventive laws that will be enacted to replace the current draconian laws. We hope that the new laws which will be mooted will not just be a cosmetic change to the current ones wherein only the name is changed but the substance is maintained.

ERA also commends the move wherein, under the new laws, detentions could only be extended by the court and not executive, unless it concerns terrorism. This clear seperation of powers is something that Malaysians and civil society organisations like ERA has been demanding for decades.

As such, we ask the government to release all ISA detainees or charge them in court as per international norms to portray the governments sincerity.

ERA Consumer also welcomes the decision to repeal the Banishment Act and to do away with the annual publishing permits under the Printing Press and Publications Act (PPPA). Once again, the right to freedom to information and freedom of speech is not something new.

This right is provided for in the Federal Constitution and UDHR but it was never adhered to. In fact, there has been a crackdown on freedom of speech and freedom of the press. With this amendment on PPPA, we hope that we will be able to promote a more ethical, fair and bipartisan journalism where people would no longer need to rely heavily on alternate media.

Finally, ERA commends the Prime Ministers political will to amend the Police Act ! which wo uld inevitably allow for freedom of assembly in accordance with international norms, the Federal Constitution and UDHR.

However, we note this amendment with disappointment as street protests will be deemed illegal. We humbly request the Prime Minister to look into this again and further liberalise his approach in regards to street protests.

We, the civil society and rakyat of Malaysia do not wish to see another mass arrest and brutal treatments by law enforcement officers in the wake of protest as was seen in Bersih 2.0 rally.

As we walk into a new dawn where the rakyat are better informed and matured on their human, political, civil and constitutional rights, it is only fitting if further liberlisation is accorded. Nevertheless, it is still a good beginning and we hope that this momentum would not be lost.

Malaysia to cooperate with Thailand on south issues

NEW YORK: Malaysia is willing to cooperate with Thailand to bring peace to the countrys southernmost provinces, Thai Foreign Minister Surapong Tovichakchaikul said Thursday.

The minister was speaking after meeting with his Malaysian counterpart; Datuk Anifah bin Haji Aman, on the sideline of the 66 th UN General Assembly in New York.

Surapong said he thanked the Malaysian government for its good cooperation with Thailand in handling the violence in the three southern provinces of Narathiwat, Pattani and Yala.

The Malaysian minister asserted that the problem was Thailands internal affair and that it did not want to intervene. Malaysia, however, stands ready to cooperate with Thailand to return peace to the border region as it neither wants to see the problem intensify nor that innocent people, whether Thai or Malaysian, to lose their lives.

The Thai foreign minister said he expressed condolences to the Malaysian minister that four Malaysians were killed in last weeks multiple bombings in Narathiwat.

The four Malaysian tourists were among five persons killed and more than one hundred wounded in the bombings in Sungai Kolok district in Narathiwat last Friday.

Surapong said he told his Malaysian counterpart that Thailand is ready to host the 12th Thai Malaysian Joint Cooperation and the 3rd ThailandMalaysia Committee on Joint Development Strategy for Border Areas (JDS) scheduled for later this year.

Both meetings would be the preparation for the 5th annual meeting of Thai and Malaysian leaders in which Malaysia would be the host.
In addition, Thai Prime Minister Yingluck Shinawatra is scheduled to visit Malaysia on Oct 3.

Datuk Seri Najib Tun Razak's knee is mending quite well following surgery more than a month ago. And he may get the chance to put it to the test in Penang this Sunday where he is scheduled to cycle with several hundred Penangites to raise funds in the name of charity.

If everything goes according to plan, the Prime Minister will be pedalling around the Tanjong Tokong area, once a quaint seaside suburb famous for its seafood but which is now more famous for traffic jams.

The event comes under Najib's 1Malaysia programmes and could be one of Najib's most major gestures to the Chinese community. The 1Malaysia Charity Ride for Education 2011, as the event is known, is to help raise funds for some 15 Chinese schools in Penang.

"The Prime Minister is showing that he is for all Malaysians by coming down to join us," said Datuk Ong Gim Huat, a Penang businessman and chairman of Kwong Wah Yit Poh, which is the organiser of the event.

Kwong Wah Yit Poh is the most widely-read Chinese newspaper in Penang and the northern parts and is quite influential in that sense. Ong's late father Datuk Ong Hoo Kim was a prominent philanthropist famed for his role in raising funds for Chinese education and the son is now following in his father's footsteps.

The paper started the charity ride last year to raise funds for a Chinese primary school in Penang's Perak Lane. As such, Ong is quite gratified to have the paper's baby expanded into something bigger, benefiting some 15 schools and with the Prime Minister lending his clout.

Private Chinese schools are always struggling for funds, be it to meet operating costs or for expansion, and they survive largely on contributions from the Chinese community and student fees.

The organisers are hoping that Najib's backing will help take the fund-raising effort to another level.

But Najib's presence in Penang is bound to be read as more than just raising money for Chinese schools.

Chinese schools are a pillar of the community and, as everyone knows, Najib has been reaching out directly to various interest and community groups.

In December 2009, not long after he took over as Prime Minister, he attended the 90th anniversary dinner of the Chong Hwa Independent High School, a premier private Chinese school in Kuala Lumpur. It was quite a big deal for the school because he was Education Minister when he last visited the school.

It is going to be more than just a bicycle ride this Sunday. His visit will be seen as yet another move to connect with the Chinese and also to raise the profile of his Barisan Nasional coalition in the state.

Najib's statement at the Barisan Hari Raya open house in Permatang Pauh last week was a move in that direction. He told the Penang people that they would not be neglected by the Federal Government and he was also sending out the message that his coalition is not afraid of Datuk Seri Anwar Ibrahim.

"He is stepping up the pressure on the Pakatan Government. I can see that he also wants to keep the DAP big guns in Penang busy on their own turf so that they won't get ideas and start moving to places like Johor," said Rita Sim of the Centre for Strategic Engagement.

The Penang Barisan had been like a man wandering in the wilderness in the first couple of years after the political tsunami. But it is beginning to recover its voice and find its footing.

Penang Gerakan chairman Datuk Teng Hock Nan is starting to speak out on local issues and to take on Chief Minister Lim Guan Eng.

Teng's queries about the development taking place in Penang and his remarks that Lim is inconsistent, that his public statements fluctuate and changes "from kopi-O to kopi susu" is the sort of role that people in the Barisan want out of their leaders.

The big boy in Penang is the DAP and any attempt to regain ground in Penang will have to involve taking on the DAP. Penang politics is not for faint-hearted politicians.

The conventional wisdom is that the Penang Chinese have made up their minds about the next general election and that the DAP-dominated Government is set to rule another term. But Barisan leaders know the Penang honeymoon with Lim cannot go on indefinitely, no matter how great the infatuation.

"Najib's problem is not him but his party. No one has any gripe about him. They see him as a liberal, someone who is open-minded. To them, he is a safe pair of hands for secular Malaysia. But they think that unlike his predecessor (Tun Dr Mahathir Mohamad), he is unable to put his foot down with the ring wing elements in his party.

"No other PM has gone as far as he has in terms of ideas and gesture, especially after his Malaysia Day announcements. He is the right man for the kind of Malaysia we want and if this were a presidential race, he would win hands down. But the Umno brand is still not selling," said social historian Dr Neil Khor.

But Najib is not a defeatist as evident in the by-election campaign in Hulu Selangor where he went into the Chinese villages to campaign even though he knew the mood was hostile and dead against the Barisan. Likewise, he is not giving up on the Chinese in Penang.

In fact, he cannot afford to give up on them because 65 per cent of the registered voters in Penang are Chinese.

Najib wants to keep the conversation going with the Chinese and he will continue to make his presence felt in Penang.

Palestinians aim for UN showdown despite warnings

NEW YORK: The Palestinians steered towards a clash with Washington over their UN statehood bid despite a stern warning from President Barack Obama that there was no short-cut to peace.

The hard-hitting speech by Obama and a personal meeting with Mahmud Abbas yesterday failed to sway the Palestinian leader from a vow to apply for membership tomorrow, as diplomats struggled to avert the showdown.

However, French Foreign Minister Alain Juppe said any UN Security Council vote on the Palestinian bid would take weeks, giving diplomats time to work on proposals to relaunch Israeli-Palestinian peace talks.

And Palestinian negotiator Nabil Shaath said Abbas will give some time to the Security Council to consider first our full membership request before heading to the General Assembly to seek enhanced observer status.

Frances President Nicolas Sarkozy meanwhile launched his own bid to ease tensions by calling for the Palestinians to be granted UN observer state membership as a prelude to new talks.

The United States has vowed to veto any request for Palestinian statehood at the Security Council, potentially sparking a new Middle East crisis. Tens of thousands of Palestinians took part in rallies to back Abbas yesterday.

Both Israel and the United States insist that only direct Israeli-Palestinian negotiations can set up a peace deal that could lead to the creation of a new state.

I am convinced that there is no short-cut to the end of a conflict that has endured for decades, Obama told the UN General Assembly.

He did not mention the US threat to veto the Security Council bid, but said: Peace will not come through statements and resolutions at the UN if it were that easy, it would have been accomplished by now.

Obama insisted Israelis and Palestinians must sit down to reach agreement on the issues that divide them: on borders and security; on refugees and Jerusalem.

For Obama, the confrontation is an embarrassment as 12 months ago ! he stood before the same assembly and called for Palestinian membership in the United Nations within a year.

Obama said he believed then and now that the Palestinian people deserve a state of their own. But he added Israel must have security guarantees because of the threat from neighbours that have waged repeated wars against it.

He later met with Israeli Prime Minister Benjamin Netanyahu, who said he deserved a badge of honour for his defence of the Jewish state. The meeting with Abbas brought no change in the position of either side, officials said.

Simple majority

Sarkozy told the General Assembly it was unrealistic for the Palestinians to expect immediate full UN membership. But he added that a US veto could risk setting off a cycle of violence in the Middle East.

He proposed UN observer state status for the Palestinians as an intermediate step toward full membership.

He also set out a timetable for new Israeli-Palestinian talks which said negotiations should resume within a month and there should be a definitive accord within a year.

The diplomatic Quartet the United States, Russia, the European Union and the United Nations has been pressing for a virtually identical plan.

Former British prime minister Tony Blair the Quartets special envoy is trying to get the groups members, as well as the Palestinians and Israelis, to agree on a statement to kick-start talks which have been frozen for the past 12 months, diplomats said.

The Palestinians have said that if there is a US veto at the Security Council, they will go to the UN General Assembly to seek an elevated observer status, similar to the one given to the Vatican.

If the Palestinian resolution does not get at least nine votes on the 15-member Security Council, the motion would fail and no veto would be necessary.

Five members Brazil, China, Lebanon, Russia and South Africa have expressed support for the move. Colombia has said it will abstain and the rem! aining m embers, except for the United States, are thus far undecided.

A General Assembly vote would only require a simple majority and could not be vetoed. Israel fears that even observer status would allow the Palestinians to join the International Criminal Court and file complaints against it.

The proposal outlined by Sarkozy calls on the Palestinians not to go to the court while talks are being held.

Moving away from strongman democracy

KUALA LUMPUR: Prime Minister Najib Tun Razaks vow to move away from Malaysias authoritarian past is an acknowledgement of growing public pressure for real democracy that many believe will now become irresistible.

Malaysia has been dominated for five decades by Umno, which has delivered strong growth and political stability but kept a tight lid on the volatile mix of races and religions.

In recent times though, impatience with Umno dominance, corruption, and 1970s-era policies that give preferential treatment to ethnic Malays and other indigenous groups, have put the government under pressure as never before.

Najib, who is expected to call snap elections within months, said last week he would replace a dreaded law allowing detention without trial, and other measures seen as tools of Umno oppression, to achieve a modern, mature democracy.

More openness is inevitable, said Karim Raslan, a Malaysian commentator on social and political issues, but the path ahead will be rocky with resistance from an entrenched old guard.

We are no longer a strongman democracy. However, were still feeling our way forward. We dont know either how far or how fast well be able to open up, he said.

Signs of change are everywhere. A once-insignificant opposition has gained in influence, making major inroads in 2008 national polls, and has designs on power.

The Internet is alive with popular news portals highly critical of the government print and broadcast media are Umno-controlled and Facebook and Twitter campaigns have had some success in blocking government moves.

Najibs unusually bold step was aimed at salvaging re-election hopes dented in part by the slow pace of political change and outrage over the crushing of a July rally in the capital Kuala Lumpur calling for electio! n reform .

But the premier gave few details, and far-reaching reform will be fought fiercely by Malay conservatives who have a major influence on the government which has been run by an Umno-led coalition since independence in 1957.

Abused by corrupt elite

You can change all the laws you want but if you dont change the institutions that execute them the police and the government structure what changes? said leading analyst Bridget Welsh from Singapore Management University.

Malaysias court system and police are widely considered in thrall to Umno, and losing control over them raises the spectre of impartial agencies probing alleged Umno wrongdoing.

A powerful security apparatus would also be loathe to loosen broad powers it sees as essential to ensure harmony among a population that includes majority Muslim Malays and Chinese and Indian minorities, and which has seen racial violence in the past.

Any threat to the legally enshrined privileges for Bumiputera or sons of the soil will be hotly contested.

They hand Malays and other indigenous people advantages in politics and the economy through a range of benefits including university slots, and government jobs and contracts.

But even growing numbers of Malays complain the system is abused by a corrupt elite seeking profit and increased power.

The forces in power need these things in order to survive. For those at the top, that is their gravy train. It is a predatory system fed by corruption and it is very endemic, said Welsh.

Najib will need to win over powerful hardliners in his party, a tough task given that his predecessor Abdullah Ahmad Badawi faced severe Umno blowback after he introduced anti-graft reforms.

The genie is out

But the opposition is already calling for further loosening gestures, and failure to deliver substantive change could see Najib and Umno severely punished by voters, said Ibrahim Suffian, director of the Me! rdeka Ce ntre, Malaysias leading polling firm.

He has opened the bottle and the genie will come out. If he decides to close the bottle or delay, there is going to be a backlash, he said.

But few believe that the winds of change that blew over regimes in the Arab Spring uprisings in fellow Muslim countries can be completely blocked here.

When it does happen, (Najibs reforms) will set in train a whole series of other changes a chain reaction that will inevitably make Malaysian society more open and dynamic, said Karim.

KUALA LUMPUR, Sept 22 Datuk Seri Anwar Ibrahim today threw his weight behind Kelantans longstanding plans to implement hudud, saying that the laws proposed by the PAS government protected the rights of non-Muslims.

The Pakatan Rakyat (PR) de facto leader stressed however that PR had not discussed the matter and this was only a personal opinion.

For now, in general, in principle, I believe this can be implemented. Looking at the specific areas, and there is clear guarantee that there is administration of justice.

It does not in any way infringe on the rights of non-Muslims, Anwar (picture) told reporters outside the Jalan Duta courthouse here.

He explained that Kelantans hudud law plans were specific and it covered two important aspects a fair administration according to Islamic law and ensuring that the rights of non-Muslims are protected.

It is a specific area that affects Muslims and does not impeach rights of non-Muslims. The proceeding makes sure that administration of justice is guaranteed, he said.

Kelantan Mentri Besar Datuk Nik Aziz Nik Mat has challenged Datuk Seri Najib Razak to withdraw any objections the federal government still had over Kelantans longstanding plans to implement hudud.

He dismissed as laughable suggestions that Kelantan could now go ahead to implement hudud in the state now that Tun Dr Mahathir Mohamad was no longer the prime minister.

Dr Mahathir, the former prime minister, had previously written to the Kelantan mentri besar to inform him that the state did not have a right to implement hudud, which prescribes stoning, whipping and amputation as punishment for criminal offences.

But i! n remark s released through his Facebook page today, Nik Aziz pointed out that the letter from Dr Mahathir remained valid.

Anwar also challenged Najib to state his stand on the matter





Govt cant use force to interpret history

PETALING JAYA: An international NGO promoting freedom of speech, Armed For the Quill (AFTQ), has jumped on the bandwagon in telling the government off for charging PAS deputy president Mohamad Sabu in court with criminal defamation.

The government cannot force its interpretation about any historical event on anybody.

This is because such action is denying the people freedom of thought and expression, AFTQs Southeast Asian regional head and Malaysian representative, Shaharul Anwar Shafie, said in a press statement yesterday.

The Oslo-based NGO sees the charge against the PAS leader as an attempt to deny the right of speech and expression on matters that have room for interpretation and dispute.

Popularly known as Mat Sabu, he was charged at the Butterworth Sessions Court yesterday with allegedly defaming several police personnel and their families, who defended themselves during a Communist attack led by Mat Indera on the Bukit Kepong police station, Muar, Johor, on Feb 23, 1950.

Mat Sabu is alleged to have committed the offence during a public speech at Tasek Gelugor, Penang, between 10pm and 12 midnight on Aug 21.

Mat Sabu was charged under Section 500 of the Penal Code with criminal defamation but pleaded not guilty and posted a RM15,000 bail.

Shaharul said that debates and historical facts must be welcomed because history evolves based on new study modes, information and observation.

He also said the issue, if handled properly, would be beneficial to the government as it would earn brownie points.

If the government can show some level of great wisdom and seriousness in dealing with democratic reforms, the Malaysian government will continue to be held in high esteem by its citizens.

Shaharul also said that the inconsistencies in governments actions only served to tarnish its reputation.

Unfortunately, in regard to the current issues, such inconsistent action will continue to give the government a bad name

The government has continued to upset the people for acting against the promises made.

Shaharul also shared the concerns of 47 local NGOs over the charge against Mat Sabu, saying it conflicts with Prime Minister Najib Tun Razaks Malaysia Day message of openness and transparency in democratic practices.

He agreed with the NGOs suggestion for a televised debate on the Bukit Kepong issue.

He also said that Section 500 of the Penal Code should be reviewed as it must not be seen by the people as a way for the government to only act in the interest of the party and not for country.

Shaharul added that the public is viewing the charge against Mat Sabu as a political action, revenge, and a violation of the rights guaranteed under the Federal Constitution.

Apabila sebut hudud di Malaysia, ramai yang akan mengingati hasrat Kelantan untuk melaksanakan undang-undang tersebut. Ada yang menyatakan hasrat tersebut sekadar mainan politik, padahal tuduhan itulah mainan politik. Saya bukan anak Kelantan, tidak juga aktivis parti di Kelantan. Saya orang luar Kelantan yang sering diberikan peluang oleh Kerajaan Kelantan untuk melihat pentadbiran dari dekat.

Saya yakin bahawa dalam isu hudud hasrat Kelantan bukan main-main. Ia adalah hasrat yang terbit dari perasaan tanggungjawab perintah muslim terhadap ayat-ayat Allah dalam al-Quran dan nas-nas Rasulullah s.a.w dalam sunnah baginda. Saya sendiri mendengar perkataan YAB Menteri Besar Kelantan ketika ditanya tentang hudud, beliau menjawab: Jika Allah tanya saya di akhirat, saya akan beritahu Kerajaan Pusat menghalang saya melaksanakannya.

Saya lihat wajahnya, saya rasai kejujuran dan kebimbangan beliau yang diamanahkan pemerintahan mengenai hukum Allah berkenaan. Apa tidaknya, Allah menegaskan dalam al-Quran: (maksudnya)

Ini ialah satu surah yang Kami turunkan, dan Kami wajibkan hukum-hukumnya, serta Kami turunkan padanya ayat-ayat keterangan yang nyata supaya kamu beringat. Perempuan Yang berzina dan lelaki yang berzina, hendaklah kamu sebat tiap-tiap seorang dari keduanya seratus kali sebat; dan janganlah kamu dipengaruhi oleh perasaan belas kasihan terhadap keduanya dalam menjalankan hukum ugama Allah, jika benar kamu beriman kepada Allah dan hari akhirat; dan hendaklah disaksikan hukuman seksa yang dikenakan kepada mereka itu oleh sekumpulan dari orang-orang yang beriman (Surah an-Nur: 1).

Dalam al-Quran ada disebutkan beberapa jenis hukuman terhadap jenayah-jenayah tertentu; jenayah curi (Surah al-Maidah: 38), jenayah hirabah (Surah al-Maidah: 33), jenayah zina (Surah an-Nur: 3), dan qazf (Surah an-Nur: 4). Dalam hadis pula disebutkan hukuman sebat bagi peminum arak, buang daerah bagi penzina dan rejam bagi penzina muhsan, juga bunuh bagi yang murtad. Hukuman ini secara umumnya dikategorikan sebagai hudud. Walaupun begitu, ada perbincangan dalam kalangan sarjana mengenai kedudukan hukuman murtad, buang daerah dan rejam; adakah itu hudud atau tazir (discretionary punishment). Jika ia hudud bererti ia tidak boleh dipinda atau ditukar ganti. Jika ia tazir bererti ia terdedah kepada perubahan dan penilaian semula pihak pemerintah. Saya akan bincangkan nanti dalam artikel yang lain.

Niat Buruk

Usaha menggambarkan negara Islam atau design negara yang mendaulat Islam sebagai negara hudud adalah gambaran yang tidak tepat. Pihak musuh berniat buruk. Hudud bukan asas kenegaraan dalam Islam. Hudud adalah hukum Islam yang menjadi makanisme dalam mencegah jenayah. Asas kenegaraan dalam Islam menegakkan keadilan dan maslahatan negara berasas prinsip-prinsip al-Quran dan as-Sunnah. Keadilan dan kemaslahatan rakyat itu luas maksudnya, dan luas juga cara mencapainya. Tugas kepimpinan negara melaksanakan yang makruf iaitu segala unsur kebaikan dan kemaslahatan untuk rakyat. Dalam masa yang sama mencegah yang mungkar iaitu segala unsur yang membawa kemudaratan dan kemerbahayaan kepada rakyat. Firman Allah: (maksudnya):

Iaitu mereka (umat Islam) yang jika Kami berikan mereka kekuasaan memerintah di bumi nescaya mereka mendirikan solat serta memberi zakat, dan mereka menyuruh berbuat kebaikan serta melarang dari melakukan kemungkaran. Dan (ingatlah) bagi Allah jualah kesudahan segala urusan. (S! urah al- Hajj: 41).

Penafsiran perkataan makruf dan munkar hendaklah diluaskan dalam konteks kehidupan muslim secara umum, dan kenegaraan secara khususnya. Maka dalam negara Islam; keadilan ditegakkan merentasi batasan keturunan, pangkat dan kaum. Tiada beza antara hukuman terhadap sultan atau raja dengan rakyat biasa. Tiada beza antara orang besar dan orang bawah. Kemakmuran negara juga dibahagi secara adil dalam kalangan rakyat. Tiada rasuah, tiada salah guna kuasa. Kepentingan setiap individu dalam negara dipelihara, kemaslahatan mereka dijaga. Kebajikan negara meliputi setiap lapisan rakyat.

Hukum Allah

Tiada seorang yang beriman pun yang akan berani membantah nas-nas qati (definitive texts) sama daripada al-Quran ataupun as-Sunnah. Mempersendakan teks al-Quran ataupun as-Sunnah seperti sendaan sesetengah pihak apabila Kelantan ingin melaksanakan hudud dengan menyatakan sesiapa yang ingin makan sup tangan sila ke Kelantan adalah melampaui batasan agama. Bahkan, jika pengucap sedar dan bermaksud menghina nas al-Quran dan as-Sunnah, maka dia terkeluar dari Islam.

Nas-nas yang qati (definitive texts) itu, sekalipun diyakini tanpa syak daripada Allah, namun para sarjana Islam sering berbeza pendapat dalam menafsirkan maksudnya, atau berbeza pendapat dalam memperincikannya. Ini disebut sebagai dalil yang zanni (speculative meaning).

Umpamanya, dalam hukuman memotong tangan pencuri, tiada siapa yang syak tentang kewajiban melaksanakan nas ini. Namun, para sarjana berbeza pendapat dalam menentukan syarat yang melayakkan seseorang dijatuhkan hukuman tersebut. Demikian juga dibincang suasana yang membolehkan hukuman itu dilaksanakan. Ini kerana terdapat nas-nas yang lain yang boleh menafsirkan hukuman ini. Membahaskan, ataupun meletakkan syarat-syarat yang layak sebelum perlaksanaan sesuatu hukum hudud itu, bukanlah bererti menolak hukum itu, sebaliknya memastikan perlaksanaan it! u memenu hi maksud sebenar dari titah perintah Allah dan rasulNya yang disebut sebagai Maqasid al-Syariah (The Higher Objectives of Islamic Law).

Ini kerana bukan tujuan Islam ingin memastikan tangan pencuri itu putus, tetapi yang hendak dicapai ialah maksud keadilan, pencegahan dan pemeliharaan harta masyarakat di sebalik hukuman tersebut. Kaedahnya ditetapkan iaitu potong tangan. Maka, pelaksana hukum tersebut hendaklah memastikan bahawa apabila hukuman tersebut dilaksanakan, maksudnya dapat dicapai. Jika dilaksanakan, sedangkan maksud itu tidak dicapai, ataupun berlaku sebaliknya, maka itu tidak menunai tanggungjawab nas. Sebaliknya, hanya menzahirkan ketidakadilan, atau kekejaman atas nama Islam.

Suasana Kondusif

Suasana kondusif ialah suasana di mana apabila hukuman hudud itu dilaksanakan akan mencapai matlamat hukum itu disyariatkan. Tertegak keadilan, pencegahan dan pemeliharaan masyarakat. Suasana yang tidak kondusif ialah suasana di mana pelaksanaan hukuman tersebut membawa kepada natijah yang negatif kepada prinsip keadilan dan masyarakat Islam itu sendiri.

Nabi s.a.w bersabda:

Jangan dipotong tangan (pencuri) ketika dalam peperangan. (Riwayat al-Tirmizi dan al-Darimi. Hadis dinilai sahih oleh al-Albani).

Al-Imam Tirmizi (297H) ketika meriwayat hadis ini menyebut:

Sebahagian ilmuwan berpegang dengan nas ini, antara mereka al-Auzai, mereka berpendapat tidak dilaksanakan hudud ketika peperangan, berhadapan dengan musuh kerana dibimbangi individu yang dihukum itu akan pergi menyertai musuh.

Dalam riwayat Abu Daud: Jangan dipotong tangan ketika pemusafiran (Riwayat Abu Daud. Dinilai sahih oleh al-Albani).

Hadis di atas menunjukkan bahawa Nabi s.a.w mengarahkan agar hukuman tidak dilaksanakan dalam keadaan peperangan ataupun musafir kerana bimbang kesan yang negatif terhadap perlaksanaan itu disebabkan suasana yang tidak kondusif. Dengan melihat kepada nas yang seperti in! i, maka persoalan persekitaran ketika hukuman hudud dilaksanakan perlu diambil kira.

Mewujudkan Suasana

Nabi s.a.w sebelum menegaskan tentang hudud, baginda mengujudkan suasana keadilan yang menyeluruh dalam masyarakat yang diperintah oleh baginda. Pemerintah dan rakyat sama setaraf di hadapan undang-undang. Tiada diskriminasi keturunan dan latar belakang. Suanana kebajikan; bantu membantu, tolong menolong antara masyarakat yang kukuh. Jaminan hak rakyat yang diberikan. Suasana halal yang mudah; mudah berkahwin, talak, fasakh, khuluk dan selainnya. Tiada alasan untuk lelaki ataupun wanita berzina. Sementara suasana haram yang diketatkan; sukar mendapat dan menebusi perkara haram.

Apabila suasana seperti ini wujud, maka tiada alasan rakyat memilih yang haram. Jika ada memilih yang haram juga, maka memang layak dihukum. Ini kerana pertama; dia telah mencemarkan suasana harmoni yang telah diwujudkan. Kedua; dia mempunyai penyakit jiwa yang berat yang condong memilih buruk sekalipun sukar dan menolak yang halal sekalipun mudah.

Perjuangan penting kita pada hari ini, ialah mengujudkan suasana yang kondusif ini sebelum sesuatu undang-undang ini dilaksanakan. Ini kerana, jika undang-undang hudud dilaksanakan; dihukum orang bawahan; dilepas orang atasan, dihukum penzina; diketatkan perkahwinan serta disusahkan talak dan fasakh, dihukum peminum arak, digalakkan gambaran arak, dihukum pencuri; dihalang hak rakyat serta dibiarkan rasuah dan salah guna harta negara dalam kalangan golongan atasan, dihukum pemberontak; dibiarkan kezaliman penguasa dan seterusnya, sudah pastilah hudud tidak dapat dilihat keindahannya.

Bahkan jika dilaksanakan hudud dalam suasana yang seperti itu, hanya membinasakan masyarakat. Rasulullah s.a.w menyebut:

Wahai manusia! Sesungguhnya binasa orang yang terdahulu daripada kamu kerana mereka itu apabila seorang bangsawan dalam kalangan mereka mencuri, dia dibiarkan. Apabila seorang yang lemah dalam kalangan mereka mencuri, dilaksanakan! hukum k e atasnya. Demi Allah! Jika Fatimah anak Muhammad (puteri Rasulullah) itu mencuri, nescaya ku potong tangannya (Riwayat al-Bukhari dan Muslim)

Di Kelantan suasana kondusif untuk hudud terikat bukan sahaja dengan persekitaran dalam negeri tetapi juga dengan pentadbiran pusat. Selagi Kelantan tidak mendapat kerjasama Pusat sepenuhnya, tidak mungkin suasana kondusif itu dapat diwujudkan. Selepas itu banyak lagi perkaitan lain yang mesti dilangsaikan sebelum dilaksanakan. Maka, bukan menjadi kesalahan Kelantan jika beberapa hukuman hudud tidak dilaksanakan disebabkan keterbatasannya.

Kelantan telah memainkan peranan mempromosi hukuman itu. Walaupun masih terbatas disebabkan banyak kekangan, namun apa yang penting hukuman itu dibahaskan, dibincangkan dan dipromosikan. Ijtihad-ijtihad baru juga perlu dilihat bagi mencapai maksud keadilan jika ia dilaksanakan. Saya akan bahaskan dalam artikel yang akan datang insyaAllah.


‘Govt can’t use force to interpret history’


Oslo-based Armed For the Quill says the charge against Mat Sabu violates the rights to freedom of thought.

(Free Malaysia Today) - An international NGO promoting freedom of speech, Armed For the Quill (AFTQ), has jumped on the bandwagon in telling the government off for charging PAS deputy president Mohamad Sabu in court with criminal defamation.

“The government cannot force its interpretation about any historical event on anybody.

“This is because such action is denying the people freedom of thought and expression,” AFTQ’s Southeast Asian regional head and Malaysian representative, Shaharul Anwar Shafie, said in a press statement yesterday.

The Oslo-based NGO sees the charge against the PAS leader as an attempt to deny the right of speech and expression on matters that have room for interpretation and dispute.

Popularly known as Mat Sabu, he was charged at the Butterworth Sessions Court yesterday with allegedly defaming several police personnel and their families, who defended themselves during a Communist attack led by Mat Indera on the Bukit Kepong police station, Muar, Johor, on Feb 23, 1950.

Mat Sabu is alleged to have committed the offence during a public speech at Tasek Gelugor, Penang, between 10pm and 12 midnight on Aug 21.

Mat Sabu was charged under Section 500 of the Penal Code with criminal defamation but pleaded not guilty and posted a RM15,000 bail.

Shaharul said that debates and historical facts must be welcomed because history evolves based on new study modes, information and observation.

He also said the issue, if handled properly, would be beneficial to the government as it would earn brownie points.

“If the government can show some level of great wisdom and seriousness in dealing with democratic reforms, the Malaysian government will continue to be held in high esteem by its citizens.”

Drop all anti-ISA court cases

PETALING JAYA: With the Internal Security Act (ISA) headed for a repeal, DAP has asked that anti-ISA protesters charged with illegal assembly be let off the hook.

Petaling Jaya Utara MP Tony Pua urged Attorney-General Abdul Gani Patail to drop cases where protesters were hauled up by the police for demonstrating against the Act.

In light of the Malaysia Day pronouncements by Prime Minister Najib Tun Razak last week, we call upon the AG to heed the spirit of the speech and drop all illegal assembly charges, he told reporters at a press conference at the PJ Sessions Court this morning.

On Sept 15, Najib said that the ISA along with other laws such as the Banishment Act 1959, would be abolished.

Accompanied by Puchong MP Gobind Singh Deo, Pua was among 21 people who were arrested on Nov 9, 2008 for attending an anti-ISA candlelight vigil in front of the PJ Civic Centre.

The vigil, which also fell on the anniversary of the 2007 Bersih protests, saw the arrests of Kampung Tunku and Pandamaran state assemblymen Lau Weng San and Selangor exco Ronnie Liu, as well as PJ City councillor Tiew Way Keng and Catholic priest Father Paulino Miranda.

DAP also revealed that the 21 people had been made to appear 26 times over the last 33 months in court, and called it a waste of time and money.

Today, would be their 27th appearance.

Speaking on the case, Gobind said: Its still going on, the case is still in the prosecution stage, and the defence has yet to be call! ed.

< p>He said that the 21 accused had been charged under Section 27(5a) and 27(4) of the Police Act 1967 for taking part in an unlawful assembly, and for failing to comply with orders to disperse.

If he (Najib) talks about the worlds greatest democracy, then people who gather in peaceful assemblies should have their charges withdrawn, he said, adding that the AG had the power to drop the charges against the 21.

Incidentally, Najibs Malaysia Day speech also covered a promise to review Section 27 of the Police Act 1967, especially where freedom of assembly was concerned.

Even so, the PM said that the Act would be reviewed with a principle that is strongly against street demonstration, and spoke of considering international norms.

Najib however, did not elaborate on what these principles or norms were.


Najib and Rosmah chicken out of Anwar's witness box

As expected, Prime Minister Najib Razak and wife Rosmah Mansor have decided against complying with a subpoena ordering them to take the witness stand in the sodomy trial against Opposition Leader Anwar Ibrahim.

This is the same tactic used by former premier Mahathir Mohamad, when he sacked and jailed Anwar on manifestly trumped-up sodomy charges in 1998. "It indicates guilt. What else is there? If they are a responsible couple with good morals and have nothing to hide, why not take the stand? What is there to be so uptight about?

Show Malaysians what civic mindedness and social responsibility is about," PKR vice president Tian Chua told Malaysia Chronicle.
Given Malaysia's skewed judiciary system, there is little doubt that the first couple will be granted their application, following which, they can be expected to launch another high-profile public relations exercise to 'clean' up their image. - Malaysia Chronicle.

Najib dan Rosmah tidak perlu takut kerana di mahkamah ada peguam, ada pendakwa dan juga ada hakim.

Rasanya hakim tidak mudah bengong untuk membuat keputusan.

Malicious/selective prosecution of Mat Sabu should dampen euphoria in certain quarters sparked by Najibs latest gambit to brand himself as reformer par excellence to make Malaysia best democracy in the world

The malicious and selective prosecution of PAS Deputy President Mat Sabu for criminal defamation should dampen the euphoria in certain quarters sparked by the Prime Minister Datuk Seri Najib Razaks latest gambit to brand himself as the reformer par excellence to make Malaysia the best democracy in the world.

The proposals to set up a parliamentary select committee on electoral reforms, to repeal the nefarious Internal Security Act (ISA) and to amend various laws such as Printing Presses and Publications Act (PPPA) have not been able to stand up to close scrutiny that they are intended to usher in a major democratisation of the country.

The proposed parliamentary select committee will only be meaningful if it results in changes to the electoral system to ensure free and fair elections as envisaged in the Eight Demands of Bersih 2, and most important of all, that such reforms are all effected before the dissolution of Parliament and the holding of the next general elections.

The very fact that the Prime Minister is not prepared to give an undertaking that Parliament would not be dissolved until the parliamentary select committee has made recommendations for a free and fair electoral system and their full implementation raises the question whether this is just a political ploy or a meaningful reform exercise.

The repeal of the ISA will be tested as to whether the two replacement laws for it would only result in spawning new ISA-like detention-without-trial laws without the term of ISA.

The PPPA amendment to do away with annual licensing for newspapers will not lead to free and responsible press so long as the government continues to exercise a media stranglehold through other measures as licensing of newspapers and political party ownership and control of newspapers.

At a time when Najibs bona fides for political reforms has come to the very national forefront, the malicious and selective prosecution of Mat Sabu for criminal defamation has com! e as a r eminder that if Malaysia is to make progress towards a more democratic society, upholding human rights and the rule of law, it is equally important to end the gross abuses of power so rampant in the present system as illustrated by the case of the malicious and selective prosecution of Mat Sabu for criminal defamation.

There are incidents galore in the past two years of reckless and irresponsible incitement of racial and religious hatred and tensions, as in the lies and falsehoods alleging a DAP conspiracy for a Christian Malaysia and and a Christian Prime Minister, but which enjoy utter immunity and impunity from prosecution.

There must not only be far-reaching reforms to abolish draconian and undemocratic laws but also a restoration of the independence, professionalism and integrity of key national institutions, whether the Judiciary, Attorney-Generals Chambers, Police, Election Commission or MACC, if Malaysia is to become a normal democratic country.


I only asked for a postponement

KOTA KINABALU: Kota Belud MP Abdul Rahman Dahlan has denied that he is backing out of a debate with DAP advisor Lim Kit Siang over the proposed Tambatuon Dam.

He said he had asked for his debate with Lim, which is scheduled for Sept 24, be postponed.

He said he had been unaware of an official Barisan Nasional engagement scheduled for the same day.

His request for a postponement, he said, should not be construed as him backing out of the challenge to debate with Lim.

Abdul Rahman said following his earlier acceptance of the Sept 24 debate challenge from Lims representative, his office had immediately made preparations including booking of Community Hall and notifying the relevant authorities such as the police and district office of the event.

Unfortunately, in early September, I received a letter from Upko to inform me that their congress would be held on Sept 24, which would be officiated by Deputy Prime Minister Muhyiddin Yassin who is also the deputy chairman of Barisan Nasional, he said.

Abdul Rahman said in view of the clashing dates, he would not be able to attend the debate with Lim.

He said as he was the Sabah BN secretary it was necessary for him to be present at the Upko congress.

I have informed DAP, through SMSes and calls, of the clash of date and asked for postponement.

There is no intention to cancel the debate at all.

What I requested was to postpone due to the visit by the Deputy Prime Minister and the Upkos congress.

Anyway, the issue of the proposed Tambatuon Dam will not run away even if the debate is held on different date. It would still be there when the new date is agreed, he said.

Half-truths and false facts

He sees the debate as a g! ood plat form to inform the public of the actual reasons and facts of the proposed Tambatuon Dam project.

There has been too many speculations circulating around and half-truths and false facts especially by the opposition with regards to the dam.

The debate will be a good platform to inform the public of the facts.

I hope DAP understands the situation and agree to a new date and do not politicise the issue of the postponement.

I have debated DAP MPs in parliament on so many national and state issues and there is no reason for me not to debate then on issue affecting my constituency, he said.


Kelemahan Firefly jejas industri pelancongan

KUCHING: Kementerian Pelancongan membuat teguran kepada pihak pengurusan Firefly berhubung kualiti dan tahap perkhidmatan syarikat penerbangan komuniti pertama di Malaysia itu yang tidak memuaskan, sejak kebelakangan ini.

Timbalan Menteri Pelancongan, Dato Dr. James Dawos Mamit berkata, kementerian menerima banyak aduan dan rungutan terutama dari agensi pelancongan dan orang ramai mengenai kelemahan yang berlaku membabitkan syarikat penerbangan tersebut.

Apa yang membimbangkan beliau sekiranya perkara itu terusan akan menjejaskan industri pelancongan di negeri ini serta kepercayaan pelanggan yang menggunakan kemudahan penerbangan mereka.

Agensi pelancongan di negeri ini membuat aduan mengenai kerugian dan masalah yang mereka alami apabila Firefly menghentikan perkhidmatan penerbangan ke beberapa destinasi tanpa membuat pengumuman awal.

Saya juga gagal hadir pada majlis acara Regata Sarawak pada Ahad lalu, disebabkan masalah perkhidmatan yang berlaku ketika menggunakan perkhidmatan Firefly, katanya ketika mengadakan sidang akhbar.

Justeru, kementerian akan mengadakan pertemuan dengan pihak pengurusan Firefly bagi mencari jalan penyelesaian segera memandangkan industri pelancongan negeri ini banyak bergantung dengan pengangkutan udara.

Sementara itu, Dawos menafi kenyataan pemimpin pembangkang Bandar Kuching yang mendakwa kementerian pelancongan cuai dalam ujian peperiksaan memilih calon pemandu pelancong.

Calon pemandu pelancong yang didakwa pembangkang ini gagal dalam peperiksaan bukan kerana kesalahan kementerian tetapi calon itu sendiri.

Calon itu menjawab soalan dalam Bahasa Inggeris sedangkan sebelum ini dia memilih untuk menjawab dalam Bahasa Mandarin, katanya sambil menambah, calon perlu memilih menjawab kertas peperiksaan sama ad! a dalam Bahasa Malaysia, Inggeris atau Mandarin.


Who will lead in Putrajaya post the 13th GE, and who will give us the reforms we demand?

Less than 6 months as Prime Minister, Pak Lah was able to persuade me to do what Mahathir could not in 22 years in the office of PM.

Yes, Pak Lahs promises of a slew of reforms persuaded me to vote for the first time for BN in the 2004 GE.

Until then, I had always voted for the opposition.

Looking at the huge mandate he got, it would seem that I was not the only one taken in by his promised reform agenda.

Maybe it was his seemingly squeeky clean image that persuaded so many of us that this man might just deliver on his promises of reforms.

Today, Pak Lah concedes that his reform agenda fell by the wayside due to resistance to the same from within his own party and his own government colleagues.

Perhaps when I was in office I should have been more forceful about it considering the resistance I was facing, , Malaysiakini reports Pak Lah as saying.

Pak Lah was also quoted in an earlier Malaysiakini report as saying that Najib, too, might face the same resistance from within to his proposed repeal of the ISA.

My take, though, on why Pak Lah failed to deliver on his reform promises is that, post the 2004 GE, he was preoccupied with consolidating his position in the party in the hope that he could lead the charge into the next GE and return for a second term as PM.

Delivering all his pre-election promises would make him popular with the rakyat gen! erally, but would earn him the ire and thee wrath of the UMNO warlords, most notably, Dr M himself.

It was common knowledge then that Pak Lah was facing a revolt from within the party, led by Dr M.

In the end, Pak Lah opted to renege on his pre-election promises to us so as to keep the peace with the UMNO warlords.

Today, Najib faces the same dilemma as his predecessor.

And like his predecessor, Najib does not have it in him to go against the UMNO warlords.

I will not hold my breath waiting for the repeal of the ISA to become a reality during his watch.

Firstly, it might simply not happen.

Secondly, it remains to be seen how draconian the proposed anti-terrorism laws that are intended to take the place of the ISA will be.

Finally, and, for me, most importantly, is that Najib, unlike Pak Lah, came into office weighed down with a litany of scandals.

Murder and corruption.

Najib is no reformist, in my books.

He cannot afford to be one.

Not with the kind of dark and seedy secrets he must continue to keep away from public scrutiny.

For these reasons, I say again that there can be no reforms post the 13th GE unless BN is replaced in Putrajaya.

Lets say we are able to kick BN out of Putrajaya post the 13th GE and replace them with a new non-BN regime.

Who will lead?

Such a person, man or woman, must be brave, must be focused on reforms rather than re-election for another term in office, and must be motivated, not by party needs, but the needs of the rakyat, most particularly those who have been marginalised for so long and who now live in impoverished conditions.

Who?

Anwar?

Many, including Anwar himself, expect that he will be convicted on the sodomy charges presently being tried, and imprisoned.

It must therefore be anticipated that Anwar might not be available to lead, even if he is seen as having the requisite qualities to lead and reform.

Hadi Awang?

Guan Eng?

Are we, as a natio! n desper ately in need for honest leadership, ready to take a chance with either of these two?

Kuli?

Is Kuli ready to turn his back on UMNO to focus on rehabilitating the nation.

Who?

We have the right to have answers to this burning issue even as we contemplate the make up of a non-BN coalition that we might confidently work to have installed in Putrajaya post the 13th GE.

Who will lead in Putrajaya post the 13th GE, and who will give us the reforms we now demand?

When you see news flash of least two former prime ministers of Malaysia lauding the current prime ministers move to abolish the Internal Security Act (ISA) and amending the Printing Presses and Publications Act, coupled with nice, glossy pieces crafted by experts in the mainstream media on the subject, one can easily validate the fact that the premier has earned his well-deserved brownie points with the rakyat. Congratulations, Najib!

Twenty years ago, when I studied Mass Communications in France, little did I think that public relations (PR) could get lucrative.

Never did it cross my mind that I could make mega bucks out of this specialisation as the path often taken was mostly accountancy, economics, engineering, law, and so on.

My mom still doesnt know what I do for a living, as PR is something vague and opaque and the best PR practitioners are those who deliberately stay behind the scenes, as our job is to profile others, not ourselves.

A year ago, when the news broke about some RM60 million fees being paid to a foreign PR agency to rebuild the countrys image, Malaysians finally woke up from their deep slumber.

A PR wake-up call rang out in Parliament, giving the opposition more ammunition to fire at the government.

While everyone was whining, bickering, and debating over this matter, I quietly celebrated in my corner as I blithely welcomed the arrival of the first PR ship on the shores of Tanah Melayu.

It was indeed a long wait, but still it was the dawn of a new era.

PR and PRO

As a student back in the early 1990s, the two subjects I thoroughly enjoyed included analysing Charlie Chaplins silent black-and-white movies and writing a thesis on disinformation a ter! minology stemming from the Iraq War in 1992.

We were trained to analyse, think and crack the codes of Western media, undress the veiled messages and hidden propaganda, and express and strategise just like the liberalised French; hence, obliterating completely my Malaysian culture, upbringing and thought process.

That was how I converted to a banana: yellow on the outside, white inside.

Coming back to Malaysia, aspiring to practise PR in the mid-1090s was almost like going up a creek without a peddle.

PR was bundled together and confused with PRO ( karaoke lounge girls or escorts a real disgrace ).

So, I decided to camouflage it as corporate communications branding, advertising, events, corporate socical responsbility (CSR) rather than zooming in on public relations per se.

Actually, in this country, the more popular term is media relations (as visibility/publicity in the mainstream media depends highly on relations as opposed to quality content ).

The tardy growth of PR in Malaysia started with firms hiring candidates who have a strong relationship with the media; management usually doesnt have a clue of what values PR can bring to the company as the focus is always on the bottom line.

Financial controllers are often the CEOs best friends, and the PR head is made to report to his second liner.

A short and precise definition of the CEOs PR is, I want to be in the papers and I must look good.

So, we, PR practitioners, would relentlessly try and persuade editors to flash out our CEOs, from time to time, and everyone was happy so that we could keep our jobs.

Change had to be dictated by strong personalities (AirAsias Tony Fernandes and Khazanah Nasionals Azman Mokthar come to mind).

Forward-thinking CEOs have understood the undeniable value of PR as it can affect the market sentiments of share prices overnight. It can also destroy a brand/personality within seconds upon announcement of an appalling scandal (like the Dominique Strauss-Khan and! Tiger W oods sex scandals).

Positive spin

Only recently has PR finally evolved from stories of hand-shake photo opportunities/mock-cheque presentation/MOU signing ceremonies to delivering key messages that could touch the hearts of people and affect the lives of every man on the street.

We are now driven to read more meaningful messages than just the headlines and subheads.

Najibs announcement to repeal the ISA last Thursday has won worldwide acclaim from the international media, which have pronounced him as Malaysias born-again liberal and a reforming prime minister.

For the first time ever, Malaysia, as a country, has successfully pierced the negative wall by a strong injection of positive vibes in the international PR arena.

Gaining unpaid positive airtime in the Western media is indeed an honourable achievement.

The country needs more meaningful messages to transmit ones which make a lot of sense to not only Malaysians, but also to the world. Then only could we stand up unanimously to proclaim that our journey of transformation has begun.

The Economic Transformation Plan (ETP) has just scored more points. Its not just hot air.

The writer will now fully embark on specialising in PR through and through, as she believes that the PR teenager will soon mature into a beautiful young adult, with less pimples on the face. It is time to rise with the occasion.

Kadar AIDS di Kelantan MENURUN sejak 2003

Utusan Meloya mewarwarkan kononnya kadar baru AIDS adalah tertinggi di Malaysia. Semalam, Dr Mahathir Muhammad Iskandar Kutty juga mengamok dalam TV kepada Tok Guru Nik Aziz. Marah betul Mahafiraun apabila beliau dipersalahkan kerana Kelantan tidak dapat melaksanakan hukum syariah Islam. Padahal, ada surat dari beliau kepada MB Kelantan mengugut Kelantan untuk tidak melaksanakan hukum syariah.

Mahafiraun menggunakan laporan Utusan Malaysia yang diatas. Masaalahnya, laporan2 ini tidak memberitahu bahawa trend pesakit AIDS di Kelantan sedang menurun. DAn. sekiranya UMNO yang memerintah Kelantan, sudah tentu trend ini akan MENAIK bukan menurun.

Kalau dibenarkan perlaksanaan hukuman hudud, nescaya kadar sakit AIDS di Kelantan adalah paling rendah di Malaysia.

Ni adalah masaalahnya seorang yang bodoh dan lemah fikiran menjadi bekas Perdana Menteri macam Dr Mahathir. Habis kekayaan negara kita dibelanjakan untuk perkara2 yang tidak berfaedah. Kalau lembu jadi PM, nescaya lembu itu lebih baik dari Mahafiraun.

Di bawah diberikan graf pesakit AIDS terbaru mengikut Kementrian Kesihatan. Lihat sendiri trend menurun pesakit AIDS baru. Barang diingat, Kelantan adalah bersebelahan dengan negeri Siam yang terkenal dengan industri pelacuran mereka. Masaalahnya adalah Kelantan tidak berkuasa ke atas penjagaan sempadan Kelantan-Siam.

Pihak kerajaan pusat sentiasa berpandukan kepada kebijaksanaan (al-Hikmah) yang telah ditunjukkan oleh baginda Rasulullah SAW. dan juga para sahabat baginda khususnya al-khulafa ar-Rasyidun dalam melaksanakan ajaran Islam lebih-lebih lagi yang berkaitan dengan hukum-hukum jenayah.

1. Jalan yang diambil oleh Kerajaan Pusat ini adalah juga berpandukan kapada kaedah yang terdapat dalam sistem pemerintahan Islam iaitu tindakan pemerintahan adalah sentiasa bergantung kapada kepentingan ramai (muslihat umum). Penguatkuasaan kanun jenayah yang digubal oleh Kerajaan PAS di Kelantan, menurut kajian sehingga setakat ini tidak menampakkan dan tidak menyakinkan pakar-pakar perundangan Islam yang tidak mempunyai sebarang kepentingan politik bahawa ia selari dengan ajaran dan kehendak Islam sebagaimana yang telah diuruskan dengan bijaksana oleh Rasulullah SAW. dan para sahabat.

2. Sepertimana yang Amat Berhormat sendiri sedia ketahui, KEADILAN adalah ASAS yang paling utama ditekankan oleh agama Islam apabila melaksanakan sesuatu perkara. Penekanan mengenai dengan keadilan adalah sangat terserlah dalam ajaran Islam lebih daripada penekanan yang terdapat dalam ajaran-ajaran yang lain dalam sejarah agama. Baginda Rasulullah SAW. sewaktu mengembangkan agama Islam ialah usaha menghapuskan ketidakadilan yang menjadi sebahagian daripada budaya dizaman itu.

3. Tidak perlu bagi saya menyatakan disini betapa banyaknya terdapat ayat-ayat Al-Quran yang menegaskan tentang pentingnya keadilan dan lebih banyak bagi ayat-ayat yang mencela sebarang jenis kezaliman. Disamping itu al-Quran juga sentiasa menggesa supaya dielak daripada terjadinya huru-hara dan Allah sendiri sangat tidak gemarkan kapada mereka yang menyebabkan huru-hara berlaku. Kita hanya bertindak balas terhadap ! sikap pe rmusuhan dan serangan yang dilakukan terhadap kita. Di Malaysia, orang bukan Islam bukan sahaja tidak memusuhi kita tetapi mereka memberi kerjasama bahkan membantu kita dalam urusan-urusan yang bersangkutan dengan kegiatan dan amalan ajaran Islam.

4. Khusus mengenai undang-undang jenayah PAS di Kelantan, kajian awal menunjukkan dengan jelas bahawa undang-undang itu yang disediakan menerusi perjuangan sebuah parti politik ternyata bukan sahaja menyebabkan ketidakadilan akan berlaku tetapi, sebaliknya ia akan membawa kezaliman. Kebenaran kenyataan ini adalah berdasarkan kapada keterangan berikut:

(i) Dakwaan bahawa undang-undang ini akan dikuatkuasakan hanya di kalangan orang Islam sahaja dan tidak digunapakai untuk orang bukan Islam akan menyebabkan ketidakadilan dan kezaliman yang ketara berlaku. Memang benar di zaman Nabi Muhammad SAW., orang Yahudi biasa dihukum di bawah undang-undang yang berada di dalam kitab Taurat mereka tetapi kitab Taurat mempunyai hukuman yang tidak berbedza dengan hukum-hukum dalam al Quran.

Mereka yang berzina umpamanya, akan dihukum rejam sama seperti hukuman terhadap jenayah yang sama bagi orang Islam. Justru itu tidak ada perbedzaan sama ada penjenayah dihukum di bawah undang-undang Islam atau Undang-undang Yahudi di zaman Nabi Muhammad SAW. Tetapi terdapat perbedzaan yang amat ketara di antara hukuman di bawah undang-undang yang ada sekarang dengan hukuman di bawah undang-undang jenayah yang dicadangkan oleh kerajaan PAS di Kelantan. Menghukum orang Islam dengan lebih berat tetapi orang bukan Islam dengan amat ringan untuk jenayah yang sama atau jenayah dilakukan bersama amatlah tidak adil dan merupakan satu kezaliman, sedangkan undang-undang PAS akan menyebabkan ketidakadilan dan kezaliman berlaku, maka undang-undang PAS tidak boleh diterima sebagai undang-undang Islam atau secucuk dengan undang-undang Islam ataupun selaras dengan ajaran Islam. Ia sebenarnya tertentangan dengan agama Islam.

(ii) Masaalah kesalahan merogol wanita, berdasarkan ka! pada und ang-undang PAS, jika seseorang wanita yang belum kahwin melahirkan anak maka ini adalah bukti ia telah berzina dan akan dihukum mengikut undang-undang PAS, sedangkan apa yang sebenarnya berlaku ialah wanita itu adalah mangsa rogol. Mengikut undang-undang PAS jika ia menuduh perogolnya, tuduhan hanya boleh diterima sah jika terdapat empat orang saksi (yang terdiri daripada orang-orang yang baik, yang tidak melakukan dosa besar) yang menyatakan bahawa telah melihat dengan terang dan jelas bahawa yang dituduh telah merogol wanita berkenaan.

Seperti kita ketahui, melainkan dalam keadaan perang seperti di Bosnia diwaktu mana orang Serb merogol beramai-ramai wanita Bosnia, tidak mungkin jenayah merogol dilakukan di hadapan saksi-saksi yang terdiri daripada orang-orang yang baik. Jika saksi ini melihat dan mereka tidak menolong wanita berkenaan, mereka boleh dianggap sebagai bersubahat seperti penjenayah-penjenayah Serb bersubahat dengan perogol daripada kaum mereka. Jika ada pun saksi, dan mereka tidak membuat apa-apa untuk menolong mereka tidak boleh dianggap sebagai terdiri daripada orang yang baik, tetapi disebaliknya dianggap sudah bersubahat. Dengan itu tuduhan mangsa rogol akan ditolak dan perogol akan terlepas.

Keadaan di mana mangsa rogol dihukum salah kerana melahirkan anak di luar nikah dan perogol dilepaskan sebagai tidak bersalah kerana tidak ada saksi adalah sama sekali tidak boleh diterima oleh sesiapa pun sebagai sesuatu yang adil, bahkan ia adalah satu kezaliman yang dahsyat.

5. Hukum Hudud Islam bertujuan untuk memberi keadilan kapada semua pihak. Ia bukanlah bertujuan untuk melakukan kezaliman. Undang-undang PAS jelas menunjukkan ketidakadilan dan kezaliman yang ketara akan berlaku. Justeru itu undang-undang yang disediakan oleh PAS bukanlah undang-undang yang menepati ajaran Islam. Ia hanyalah undang-undang ciptaan PAS yang bertentangan dengan penekanan oleh agama Islam yang menuntut supaya menghukum secara adil dan menolak sebarang kezaliman. Kerajaan Pusat akan sentias! a berpan du dan menerima ajaran-ajaran dan amalan Islam dari semua aspek tanpa diheret oleh kehendak organasasi politik yang mempunyai kepentingan yang lain daripada Islam dan kepentingannya .

6. Jika undang-undang PAS yang jelas mengandungi unsur-unsur ketidakadilan dikuatkuasakan dinegara ini, dan jika ia dikatakan itulah Hukum Hudud Islam maka umat Islam dan juga anggota masyarakat bukan Islam akan hilang kepercayaan Islam membawa keadilan untuk penganutnya. Ia juga memberi gambaran yang buruk terhadap agama yang suci ini dan menjejaskan imej orang-orang Islam di kalangan penganut agama-agama yang lain. Ia tetap akan menyebabkan penganut agama lain menjauhkan diri daripada agama Islam dan menyebabkan orang yang berminat memeluk Islam menolaknya.

7. Kerajaan Pusat tidak berhajat untuk bersubahat dengan PAS bagi melaksanakan ketidakadilan semata-mata untuk kepentingan politik dan sokongan oleh orang yang telah diabui matanya. Kerajaan Malaysia yang sentiasa dan terus mempertahankan ajaran dan nilai-nilai Islam tidak dapat membenarkan Kerajaan Pas menjalankan sesuatu yang bercangah dengan prinsip keadilan dalam Islam, maka Kerajaan Pusat akan mengambil tindakan yang sewajarnya terhadap Kerajaan PAS demi menjaga maruah dan ketinggian martabat Islam dan penganut-penganutnya.
