The Federal Constitution is the rule-book or manual for Malaysia, and preserves the central pillars of democratic governance. It is the supreme law of the country. However, the Constitution in its current form is not user-friendly, and unlike many other nations with written constitutions, the Constitution does not form a comprehensive part of the education curriculum in Malaysia.

All Malaysians need to be informed in order to consider for themselves whether positions taken on the Constitution can be upheld and accepted. They must also be armed with an understanding of the rights and limits of the institutions of government and the rights and limits of every Malaysian. The Constitution belongs to every Malaysian, and every Malaysian is a beneficiary of its promise of constitutionalism and democratic governance.

One of the fundamental liberties enshrined and protected by the Constitution is our freedom of religion. Article 11 of the Federal Constitution guarantees every person ! has the right to profess or practise his/her religion and to propagate it. Yet are there limits to our freedom of religion? Can the State curtail freedom of religion for other interests? We see many examples of the restrictions placed on the practise of religion. Are these restrictions constitutional? How have the various pillars of governance Legislature, Executive and Judiciary upheld our religious freedom?

Finally, Najib and Rosmah in court complex for interview...

Prime Minister Najib Abdul Razak and his wife Rosmah Mansor were at the Jalan Duta court complex in Kuala Lumpur this afternoon to be interviewed by lawyers representing Anwar Ibrahim in his Sodomy II trial.

They arrived at 2.55pm through the basement of the sprawling building and took the lift up to the seventh floor.

In another sudden change of plans, former Malacca police chief Mohd Rodwan Mohd Yusof was also present to be interviewed.

Defence lawyers Karpal Singh, Sankara Nair and Param Cumaraswamy conducted the interviews.

Najib and Rosmah were to be quizzed on their meeting with complainant Mohd Saiful Bukhari Azlan at their official residence when Najib was DPM.

They met Saiful two days before the alleged sodomy incident.

Anwar has claimed political conspiracy following reports that the trio met before the alleged incident.

Najib and Rosmah arrived through the back passage of the massive court complex and left about half-an-hour later, together with their entourage.

Members of the press were caught by surprise by the attendance of Najib and Rosmah, as there had been no indication they would come today.

Najib was earlier seen at the National Mosque, during Friday prayers. He is scheduled to chair a BN supreme council meeting this afternoon.

Other witnesses who were interviewed included Desa Damansara condo unit owner Hasanuddin Abdul Hamid and his wife, Noor Sham Abd Hamid. The condo is where the alleged sodomy incident happened.

Anwar is charged with sodomising Saiful ! at the D esa Damansara condominium between 3.01pm and 4.30pm on June 26, 2008.

On Tuesday, High Court judge Mohamad Zabidin Mohd Diah brushed off an objection from the prosecution over Anwar's presence during the interviews.

After dismissing the objection and allowing Anwar's presence, seven witnesses were brought in to be interviewed.

This was followed with two yesterday and another five today, including Najib and Rosmah.

A total of 14 witnesses were interviewed this week, in addition to five others done earlier.

Kenyataan Media: Siri Penyelewengan SPR / EC Series of Untruths

BERSIH 2.0 sangat kecewa dengan cara Timbalan Pengerusi Suruhanjaya Pilihan Raya (SPR) Datuk Wira Wan Ahmad Wan Omar yang terus mengambil pendekatan perselisihan melampau dan hilang upaya ke arah mereformasikan pilihanraya.

Kami telah menyatakan berulang kali bahawa matlamat Bersih 2.0 adalah untuk mencapai satu sistem pilihan raya yang bersih dan adil untuk semua rakyat Malaysia, bukannya bertujuan memburukkan mana-mana institusi atau mempromosikan apa jua agenda politik.

Oleh itu, BERSIH 2.0 amat dukacita melihat SPR terus membuat ulasan yang memudarkan semangat muafakat bekerjasama ke arah pilihan raya yang lebih bersih. Sebaliknya SPR ternyata lebih beria-ia mempertahankan parti pemerintah daripada para pesaingnya.

BERSIH 2.0 hanya berminat untuk melihat hasil daripada pilihan raya yang bersih. Sekiranya Barisan Nasional atau mana-mana parti memenangi melalui pilihan raya yang bersih dan adil, maka matlamat kami telahpun tercapai.

Kami berpendapat bahawa SPR dan Datuk Wira Wan Ahmad mesti menumpukan perhatian mereka dengan melibatkan diri bersama-sama masyarakat madani bagi memperbaiki institusi-institusi awam dan bukannya terlibat dalam perang mulut dengan parti-parti politik. Ulasan terkini yang dibuatnya mengancam kewibawaan awam berkenaan sifat non-partisan SPR yang diperlukan untuk mengekalkan keyakinan orang ramai. Membuat kritikan politik merupakan tugas seorang Timbalan Pengerusi sebuah parti politik berbanding dengan tugas yang sepatutnya sebagai seorang Timbalan Pengerusi SPR.

BERSIH 2.0 berharap SPR menumpukan tenaganya untuk menyelesaikan masalah besar yang dihadapi daftar pemilih dalam penemuan baru-baru ini seperti Skandal Mismah yang telah mendedahkan perkembangan yang membimbangkan mengenai pemberian hak mengundi kepada seseorang yang diragukan kewarganegaraannya. Masalah-masalah daftar pemilih lain termasukkejadian pengundi bernama Kg Baru, penyelewengan yang serius berkenaan pengundi berganda serta alamat penuh sesa! k dan se bagainya. SPR sepatutnya memberi perhatian untuk membetulkan masalah ini dengan segera dan bukannya mempertahankan serta menjadikan perkara-perkara ini sebagai isu politik yang menjejaskan kewibawaan semua pihak.

Mengenai isu pengesahan biometrik, kami menganggap hal ini sebagai serius memandangkan laporan terkini bahawa pihak polis sedang menyiasat penyelewengan sistem biometrik yang digunakan untuk mendokumen para pekerja asing. Lebih tepat lagi, ianya merupakan kelemahan dan kesalahan yang akan membolehkan penipuan pilihanraya secara besar-besaran sekiraya hanya sistem biometrik sahaja yang digunakan untuk mencegah pengundi hantu. Kami masih belum mendengar hujah-hujah meyakinkan tentang kenapa kaedah dakwat kekal yang lebih murah, mudah dan lebih berkesan tidak patut dipakai.

Kenyataan Datuk Wira Wan Ahmad bahawa semua parti-parti politik mempunyai akses yang samarata kepada media dikeluarkan tanpa sebarang penelitian rapi. Perbandingan penerbitan parti yang sangat terhad edarannya dengan akhbar-akhbar nasional dan khidmat penyiaran kebangsaan yang dikawal parti pemerintah adalah amat mengelirukan. Kenyataan bahawa parti-parti pembangkang memiliki media baru juga tersasar daripada pokok permasalahannya. Malaysia yang kami hasratkan adalah di mana kesemua parti-parti politik daripada kedua-dua belah pihak memiliki hak yang sama terhadap kesemua jenis media, tanpa ada pengecualian. Bukan semata-mata hanya satu-satu parti politik saja yang berhak terhadap satu-satu jenis media.

Akhir sekali, BERSIH 2.0 sepenuhnya menolak apa sahaja perbandingan perhimpunan aman 9 Julai di Kuala Lumpur dengan rusuhan di UK. Meskipun dengan tindakan keras pihak polis, berbagai rakaman video dan pengakuan saksi yang tidak terkira ramainya telah membuktikan tanpa sebarang keraguan bahawa rakyat Malaysia benar-benar mampu untuk berhimpun secara aman selari dengan hak-hak perlembagaan kita untuk sama-sama menuntut sebuah negara yang lebih demokratik dan sihat.

BERSIH 2.0 sen! tiasa be rcita-cita agar dapat bekerjasama dengan semua institusi kerajaan dan pemimpin-pemimpin politik tanpa mengira wadah mereka untuk bersama-sama menubuhkan Malaysia yang lebih baik. Kami berharap pertengkaran kecil dan kedangkalan alasan sekarang ini dapat digantikan dengan sikap yang ikhlas, berfikiran terbuka dan bekerjasamadalam semangat cintakan tanah air.

BERSIH 2.0: SPR Series of Untruths

BERSIH 2.0 is disappointed in the manner in which Elections Commission (EC) Deputy Chairperson Datuk Wira Wan Ahmad Wan Omar continues to take an approach to electoral reform that is excessively confrontational and unproductive.

We have stated repeatedly that BERSIH 2.0s goal is to achieve a clean and fair electoral system for all Malaysians, not to demonise any institution or promote any political agenda whatsoever.

It is thus distressing that the EC continues to make comments that are less in the spirit of working together towards cleaner elections and more in the spirit of defending an incumbent party against contenders.

The only electoral result BERSIH 2.0 is interested in is a clean one. Should Barisan Nasional or any other party win a clean and fair election, then our goals will have been achieved.

We are of the view that Datuk Wira Wan Ahmad and the EC should thus focus their attention on engaging with civil society to improve public institutions instead of e! ngaging in a war of words with political parties. Recent comments that have been made threaten the public image of impartiality that the EC needs to have to maintain public confidence. It is more the job of the Deputy Chairman of a political party to make political criticisms than it is the Deputy Chairman of the EC.

We had hoped that the EC could instead direct its energies to solving the massive problems facing the electoral roll that have recently been uncovered. Mismah-gate has revealed an alarming trend regarding the granting of voting rights to individuals whose citizenship is suspect, as has incidences such as voters named Kg Baru, serious irregularities regarding duplicate voters as well as overcrowded addresses, and so on. Surely the EC could focus on fixing these problems promptly instead of being defensive and making these issues political when they in fact affect the integrity of all.

On the issue of biometric verification, we view with grave seriousness recent reports that the police are investigating the tampering of the biometric system used to document migrant workers. This is exactly the type of systematic irregularity and vulnerability that can lead to massive electoral fraud should a biometric system alone be used to protect against phantom voters. We have yet to hear convincing arguments as to why the cheaper, simpler and more effective method of indelible ink should not be adopted.

Datuk Wira Wan Ahmads statement that all political parties have equal access to the media also requires scrutiny. Comparing party publications that have extremely limited circulations to national dailies and national broadcast services that are controlled by the ruling party is entirely misleading. Statements that opposition parties have new media also completely miss the point. The Malaysia we want is not one where certain parties only have access to certain types of media and not others, but one where all political parties on both sides of the divide have equal access to al! l types of media, bar none.

Lastly, BERSIH 2.0 completely rejects any comparison of the July 9th peaceful gathering in Kuala Lumpur to the riots in the UK. Despite extremely heavy handed police action, multiple videos and innumerable eyewitness accounts from July 9th all proved beyond any doubt that Malaysians are completely capable of assembling peacefully in accordance with our constitutional rights to together call for a healthier, more democratic nation.

BERSIH 2.0 has always aspired to work with all government institutions and political leaders irrespective of their affiliations, to together build a better Malaysia. We hope that the current low brow, petty bickering will be replaced by a sincere, open minded attitude of patriotic cooperation.

Mismah found and her children are civil servants....

Mismah, who had her permanent resident status allegedly upgraded to citizenship in just four hours, was finally found by the media. She denied any irregularity in the granting of her Malaysian citizenship.

"I follow the rules, not like what others have alleged," she was quoted by Malay daily Sinar Harian as saying.

Mismah, who hailed from Bawaen, Indonesia, was upset over the accusation that her citizenship was obtained through the back door.

Last week, Mismah was found to have been categorised as a permanent resident on the National Registration Department (NRD) website, and yet she was listed in the Election Commission's electoral roll.

Hours after a report on the matter was published, Mismah was subseqeuntly 'upgraded' by the NRD to Malaysian citizen.

The NRD later clarified that Mismah was granted citizenship in January this year after having been a permanent resident for 29 years, but the agency did not explain the discrepancy on its website.

Pakatan Rakyat has claimed to have detected 1,597 such cases nationwide and demanded that Prime Minister Najib Abdul Razak call an emergency parliamentary sitting this month to debate the issue.

Granted PR status within months

"No, this is not true. I had been applying for Malaysian citizenship for years - not four hours, not four days and not four weeks," the soft-spoken woman told Sinar Harian when met at an undisclosed location in Kuala Lumpur.

According to the report, she was not aware of the controversy until she was informed by one of her children a few days ago. Fourty-seven-year-old Mismah said she came to Malaysia legally to work as a construction worker in 1982.

She first stayed at her grandmother's house in K! eramat, Kuala Lumpur for two months before moving to a squatter area in Kayu Ara, Petaling Jaya, after getting married. Mismah then proceeded to apply for permanent residency and was surprised to be granted the status a few months later.

"At that time, the process was simple, not like now," said Mismah in local Malay accent.

Three children are in civil service

But the application for citizenship took her 17 years - Mismah said she spent 12 years dealing with the authorities in Petaling Jaya and another five years with Immigration in Putrajaya.

Her four children and 70-year-old mother are all holders of blue MyKad, indicating that they are Malaysian citizens. Three of her children are civil servants while another has just completed his studies. Mismah, who is currently working as a janitor in a direct sales company, had since moved out of Kayu Ara and now owns a terrace house.

Sinar Harian said it tried looking for Mismah over the past one week and finally managed to do so after being tipped off by a reader. However, the Malay-language tabloid did not say where Mismah is now living, but according to the Election Commission, she is a registered voter in Ijok, Kuala Selangor.

When politicians plot, public gets shafted

The fly-by-night people in charge of MAS are no better than a posse of cowboys. Why do we continue to tolerate the wasteful antics of our politicians who indulge in a game of real-life Monopoly and who use taxpayers money to bail out ailing companies?

In a perverse reversal of the saying King Midas and his golden touch, it appears that whatever BN-Umno politicians touch will always turn to dust and ashes.

This deal that is struck with MAS and AirAsia is another smack in the face for the public. What sort of responsible government allows such a merger to take place? By agreeing to this merger, the government has neglected to address healthy competition which in essence should benefit the airline customers, companies and the Malaysian economy.

What about fair trading practices? Or conflict of interest? Or share prices? Maybe the Securities Commission should start probing both AirAsia and MAS about insider trading or any other irregularities. What about the jets each carrier uses, the agreements and maintenance contracts signed with Boeing and Airbus? Who honours what?

However, the most scandalous revelation is that all government-linked companies, have been instructed by Nazri Aziz, Minister in the Prime Ministers department, to cease all civil suits against Tajuddin Ramli, the former chairman of MAS and settle out of court.

Yet again, Tajuddin has been let off scot-free and the public, denied justice. Any court revelations now would not look good for Barisan Nasional, especially as the general election draws near.

With this latest defrauding of the public purse, how much of the taxpayers money has gone unaccounted for? This government is neither transparent nor accountable. It does not adhere to its own catch-phrase, People First, Performance Now. It! doesnt even match up to its own Key Performance Indicators.

In the late 1960s and 1970s, working for MAS was both a privilege and carried great prestige. Today, there is a different portrait of the MAS employees. Many are unhappy and morale is at an all-time low. Disaffection with MAS is felt by cabin, flight and ground crews including engineering and maintenance staff.

Jalas forte

When Singapore Airlines (SIA) and MAS emerged from the ashes of the now-defunct Malaysia-Singapore Airlines (MSA), SIA went from strength to strength while MAS was left in the doldrums.

When former prime minister Dr Mahathir Mohamad gave his blessing to Tajuddin to be installed as the chairman of MAS, the airline started to go downhill. Tajuddin received the support and protection from his influential patron, the former finance minister, Daim Zainuddin, which spelt further doom for MAS.

In these days of rising fuel costs and tight profit margins, the airline industry is more competitive than ever. However, the Malaysian Cabinet denies putting government officials in charge of a global brand.

These officials are clueless about most things and have no experience of running an airline. The first thing to effect a turnaround should have been to disband the senior management, all of whom are mere government puppets.

If there was one brief moment of respite for MAS staff, it was when Idris Jala took over and was praised for turning the company around. But even simpletons realise that selling your best assets just to make the books look good, is not financial wizardry. Many in MAS are still angry with Jala.

Asset stripping was Jalas forte. He also engaged in cost-cutting by reducing many of the privileges enjoyed by the staff without addressing the problems created by Umnoputras and BN politicians who treated the airline like it was their own private transport.

Jala, having collected his performance bonus, then entered the governments bloated political lite ! club via the back door and became a senator and Minister in the Prime Ministers Department.

So if Jala has turned MAS around, why is the MAS-AirAsia merger necessary? Was it to help MAS or AirAsia? No one really knows as this deal is shrouded in mystery.

Mahathir remarked that the MAS-AirAsia merger was a very good idea as AirAsia can learn about the experience of MAS and MAS can learn how to reduce costs as done by AirAsia.

How prophetic. Anyone with half a brain will know that MAS is run along government lines. You do as we say is the norm and the person who kowtows to the government will be rewarded with a title and other benefits. And if others want to haul you to the court for non-payment of debts, the government does a good service in whitewashing and proving your innocence.

Being held accountable

When will we have a head of MAS who is brave enough to say No to the government? MAS was a fine airline decades ago and many Malaysians were proud to fly with it. These days, MAS is overpriced and uncompetitive.

AirAsia is nothing to shout about. Customer service is non-existent and it is not cheap flying AirAsia on some long-haul flights. The merger will be another nail in the coffin with regard to competition.

Billions of ringgits of taxpayers money are unaccounted for. The scandals of Bumiputra Malaysia Finance, Bank Bumiputra Malaysia Berhad, Felda, Defence Ministry, Perwaja, PKFZ, Proton, Sime Bank/UMBC are a few from a long list.

Perhaps Islamic institutions like JAIS should start condemning and investigating these criminal acts against the rakyat rather than running around and meddling in charity dinners like a blue-arsed fly, in the recent allegation of proselytisation.

Tajuddin must be tried, and if found guilty, punished by the courts for his alleged corruption when he led MAS. His alleged accomplices ministers, former prime ministers and the current PM should also be held accountable.

Maybe pigs will fly before ! there is any sign of judicial retribution.

Jais: It was a check, not raid

SHAH ALAM: The Selangor Islamic Affairs Department (Jais) said it did not conduct a raid on the Damansara Utama Methodist Church, adding that it was only a check.

Jais director Marzuki Hussin said the check to look for Muslims was conducted together with the police at 9.45pm on Aug 3, adding that this was provided for under the Syariah Criminal Enactment (Selangor) 1995.

He said the department had received information that a buka puasa was to be held together with a thanksgiving dinner at the church.

Marzuki said discussions with the organisers was held outside the function hall of the church, which did not constitute a raid, adding that Jais had not acted aggressively or trespassed into the church.

In fact, Jais officials asked for permission to enter and were allowed into the hall where they waited. They conducted the check after the ceremony was over at 11pm, he said.

Stressing that Jais enforcement officers did not act aggressively that night, Marzuki said he was disappointed that Jais' action had been deemed unethical! , althou gh the officers were only performing their duties.

Only after the ceremony, which was attended by about 100 people, was over did we perform the check.

In less than 10 minutes, Jais enforcement officers and the police were directed to leave the hall by the organisers.

Although the act challenges the powers of Jais and the police in enforcing the law on Muslims, Jais and the police did not detain the organisers or make any arrest, he said.

He said 12 Muslims were present, adding that they only had their particulars recorded and were asked to attend a counselling session with Jais.


UMNO Halalkan Murtad di Wilayah Persekutuan

Saya melihat kempen2 anti murtad yang sedang dijalankan oleh Blogger2 UMNO di laman mereka. Antaranya adalah:

1.0 Salah seorang 12 itu telah murtad

2.0 Gereja tersebut dihalang untuk disita oleh Kerajaan Negeri

3.0 JAIS tak serbu, cuma periksa (tapi bawak polis dsbnya)

4.0 Kerajaan Negeri sekarang ini pro murtad

Soalnya sekarang, mengapa tidak tengok kepada UMNO sendiri? Rekod UMNO menyokong murtad bermula sejak zaman Natrah lagi. Apabila Natrah dimurtadkan oleh British pada 1950, UMNO cuma berpeluk tubuh dan berdiam diri.

Yang menganjurkan protes menentang permurtadan Natrah adalah mantan Presiden PAS, Dr Burhanuddin Helmi serta Karim Ghani. Tiada seorang pun pemimpin2 UMNO pada masa itu yang merengkok dalam penjara kerana memperjuangkan murtadnya Natrah.

Yang paling jelas adalah Akta Jenayah Syariah 1997 untuk Wilayah Persekutuan. Akta tersebut diluluskan oleh UMNO dan ditulis oleh UMNO> Akta tersebut TIDAK MENYATAKAN MURTAD SEBAGAI KESALAHAN JENAYAH DI WILAYAH PERSEKUTUAN.

Jelas, perjuangan menentang murtad oleh blogger2 UMNO ini satu sandiwara, drama dan lakonan. Mereka sendiri menjadi penyokong dan pendokong murtad nombor satu di Malaysia.

Deputy IGP: London riots proof against allowing street protests

KUALA LUMPUR, Aug 11 The ongoing riots in London and other major cities in Britain are evidence of the nightmares that can be prevented by avoiding street protests, said Deputy Inspector-General of Police Datuk Seri Khalid Abu Bakar

Despite chaotic scenes where tens of thousands were dispersed with tear gas and water cannons during the July 9 Bersih rally, Khalid (picture) said that we are able to avoid these scary and tragic scenes from erupting here in our beloved country.

These are the nightmares that we are fighting hard to avoid and prevent. Street protest should always be avoided as we will never know what it can turn into, he said on his Facebook page last night.

A few things that need to be taken into context here:

1. The British police were instructed to "stand and observe looting". This will never happen in Malaysia, because the cops are too anxious to get their hands on any unsuspecting citizen so they can show who's boss. The British cops on the other hand, display restrain.

2. In order not to provoke more anger, the police did not take any action against the rioters. Unfortunately, there were many out to take advantage of the situation by committing crimes. The police should have promptly arrested those.

3. The issue that the British government has failed to tackle here is the minority underclass. From several videos and images on the web, it is very evident that most of the perpetrators are of minority groups who probably hold a lot of resentment about their status.

Interestingly, there have been a few instances of massive riots in the US. And yet, the US still remains the world super-power. I expect the UK economy would not be unaffected by this either thoug! h they w ould do well to get to the root of this matter of random rioting.

That being said, while streets protests are enshrined in the constitution as a freedom of expression and public gathering, riots are never acceptable.

Expressing oneself is normal, infringing on someone else's property and personal rights is not.
