Why let Tajuddin Ramli go scot-free...
Why let Tan Sri Tajuddin Ramli get off the hook by ordering all government-linked companies, including Malaysia Airlines and the national debt restructuring company Danaharta, to cease all civil suits against the one-time corporate high-flyer? Thats a question that Putrajaya has to answer. After all, Danaharta has a judgment against the one-time telecommunications, tourism and transport czar and as at December 31, 2005, the amount outstanding was RM589.14 million.
On May 11, 2006, which also happened to be the original Umnos 60th year, Danaharta and the subsidiaries commenced action to recover the money from the man trusted by Umno to helm Malaysias flag carrier.
So why this volte-face in Minister in the Prime Ministers Department Datuk Seri Nazri Azizs letter to the GLCs and Danaharta that the Finance Ministry will settle all outstanding civil suits against Tajuddin, a poster boy of Tun Dr Mahathir Mohamads plan to groom Bumiputera entrepreneurs.
This is to inform you that the government of Malaysia and the Finance Ministry have agreed to settle all civil claims against Tan Sri Dato Tajuddin Ramli and others to be withdrawn immediately in view of the fact that the government and the Finance Ministry have agreed that the said cases will be settled out of court.
For your information the government has given me the mandate to act for the government in this matter, Nazri said in the letter sighted by The Malaysian Insider.
To add the incredulous nature of this flip-flop, Nazris letter also directs the lawyers acting for the GLCs and Danaharta to hand over their cases to ! the firm of Hasfarizam Wan and Aisha Mubarak, a known Umno lawyer.
Why an Umno lawyer? Is there any more blatant show of the nexus between business and politics in Malaysia? Doesnt it raise further suspicions about how this country is managed?
MAS was a profitable company when it was flogged off to Tajuddin in 1994 but by the time he left at the end of 2001, the state airline was in debt for RM9.5 billion. It has never recovered since then, despite going through an asset-stripping exercise and two business turnaround plans.
Just this week, the men who engineered MASs wide asset unbundling (WAU) in 2002 had to finally resort to getting the men behind Asias largest budget carrier AirAsia to help steer the loss-making state airline back to profitability.
But those who presided over MASs decline from one of Asias best airlines to an also-ran are not brought to account for their deeds. Fact is, MAS has lodged a police report against Tajuddin. Is that report now considered false?
For those outside the corridors of power in Putrajaya, there must be a need for accountability. If the likes of Tajuddin can go scot-free, then the politicians who absolved him will have to be accountable. Perhaps, in the next general election.

Hindrafs lawsuit aims to correct historical and recent wrongs
FMT LETTER
From Dr Lim Teck Ghee, via e-mail
A UK-based solicitor and lawyer, appointed by Hindraf Makkal Sakthi, is scheduled to meet with members of the Malaysian public this Sunday (Aug 14). His fact-finding mission is to help him better understand the situation on the ground and interview those taking part in Hindrafs class action suit. This lawsuit against the British government seeks to correct historical injustices inflicted on Indians who were brought to the peninsula by the white colonialists.
The Hindraf move is almost certain to court a fresh storm of controversy and criticism from Umno, the party that will be most embarrassed when full details of the Indian marginalization emerge. The extent to which the local Indian community, particularly Hindus of Tamil stock, is excluded from the nations progress and wellbeing can only reflect badly on the Malaysian government.
Due to the stony deaf ears at home, Hindraf has had no choice but to petition abroad for redress, as outlandish as the amount of relief sought might sound. The case being heard in England will enable it coverage from the international press. The deliberate neglect of a minority that perceives itself as oppressed by a government acting in bad faith will soon be laid bare to the world.
Umnos extremist supporters such as Perkasa and Utusan Malaysia persist in denying allegations of discrimination against Indians although the plight of the communitys underclass is evident to all. Just look at who are the homeless people who sleep along five-footways in the derelict parts of town.
More thoughtful Malaysians, however, are aware that the Indian community has come down, and continued falling a long way, in their socio-economic development and life prospects.
Accusing the Indian-based organization Hindraf of disloyalty and worse is merely closing the stable door after the horse has bolted.
During the past 50 years since Independence, on! ly a sma ll minority of Indians have benefitted from the political and economic largesse handed out by the government. The majority have seen little or no improvement despite the fact that the much of the economic prosperity and development of the country was built, almost literally, on their back and their hard labour.
Disclosure of the exact socio-economic status of the community is hampered by a system in which there is a lack of transparency in the collection and release of data that may relate to the plight of non-Malays the apparent fudging excused on grounds of ethnic sensitivity but more likely due to other politically driven manipulation and agenda.
Although difficult to come by, all available data clearly point to the fact that the relative performance of the Indian community has deteriorated across a wide range of socio-economic indicators. The decline has been especially steep over the last four decades after 1970 with the commencement of the NEP.
Indian impoverishment can be traced to two major developments.
One is the displacement (and also the lack of replacement) of Indians in the civil service. In 1966, one third of all Indian workers were employed in government or quasi-government jobs. In 2006, only 2.8 percent of Malaysian Indians employed were still to be found working in the public sector.
The other development has been the displacement of Indian rural workers by the massive unchecked and officially sanctioned influx of over three million foreign workers, and the absence of any compensatory programmes, including access to state and federal land and rural development schemes.
The predominantly Muslim foreign workforce, largely from Indonesia, the Southern Philippines and Bangladesh, has displaced Indians from their traditional habitats and livelihoods so that Indians now form an urban and semi-rural underclass. The slums in which they live today are largely ignored by the government and racked by social and family breakdown and ! disorder .
Of course, ethnicity is not the only variable in determining access to social services, education, health benefits, land and other forms of development assistance provided by the government in Malaysia.
Politics, class, region, family background and other variables also come into play. But for many poor and lower middle-class Indians especially those from the younger generation the fact that they are not bumiputera or Muslim mark them out for special discrimination and marginalisation. Some will make it and escape poverty but the majority will remain severely disadvantaged unless there is a dramatic reversal in state policy.
Malaysians must raise their voices and oppose the state planned policy of exclusion and its unabashed execution by the authorities, all the way from national down to district level even if what amounts to a one-party state system has successfully managed to steamroll it through.
When the Hindraf class action suit is heard in London, then the morally repugnant practice of pushing the weakest segments of society to the brink will be made better known to all.
If we are to survive well as a nation and society, the government and this includes the state governments presently controlled by the opposition must not only pay attention to the needs of the politically dominant majority.
Those holding the reins of power (from whichever party) should ensure justice and fairness in the way they treat the minorities, especially the smaller non-Muslim minorities that lag behind the Malays and Chinese, and are lacking in political and economic clout.
How the government responds to the admirable campaign for inclusion, justice and equality for poor Indians will demonstrate to Malaysians whether 1Malaysia is all talk without any walk or whether the government may have finally found the political will and moral fibre to right this long-standing historical wrong.

How ignorant can DIGP Khalid Abu Bakar be....
Lembah Pantai MP Nurul Izzah Anwar hit out at deputy IGP Khalid Abu Bakar for saying that the Bersih electoral reform rally, if allowed to proceed unimpeded, will lead to the same rioting as now taking place on London streets. That statement only serves to showcase his ignorance, Nurul Izzah (left) told reporters when met outside the Petaling Jaya district police headquarters today.
In a posting on his Facebook page last night, Khalid Abu Bakar had said the ongoing riots in London and other major cities in Britain are evidence of the nightmares that can be prevented by avoiding street protests.
Alhamdullilah, we are able to avoid these scary and tragic scenes from erupting here in our beloved country.
Street protest should always be avoided as we will never know what it can turn into. Peace loving Malaysian will understand. The right to assemble must always be balanced with public order, read his post.
Nurul Izzah added that she cannot accept such statements from the senior police officer and asked him to check his facts first before opening his mouth next time.
She pointed out that the root cause of the London riots was discontent because of government budget cuts and high unemployment in the riot hit areas.
This, she claimed, is different from the mainly middle class Bersih supporters who were not as inclined to such excesses.
'Riots may be our future if we fail to reform'
However, the Lembah Pantai MP said one similarity between the situation in UK and Malaysia is the failure to reform an economic system that promotes the wealth gap between the rich and the poor.
While Malaysia is not as worse off as the U! K, she w arned that this is our future if we fail to reform.
Police had declared the July 9 Bersih 2.0 rally illegal and outlawed the electoral reform movement itself and cracked down hard on anyone even suspected of supporting or wanting to attend the rally.
Police claimed it was only keeping public order and did so to prevent chaos, though this was disputed by Bersih organisers who had pledged a peaceful march.
There was no recorded incident of looting or widespread property damage during the rally, with most damage seemingly resulting from tear gas and chemical laced water used by police.

Mana laporan KPI Menteri Kabinet ?
Memang kabinet kita besar.
Khazanah masih pegang 49 peratus saham MAS.
Najib hanya peduli imej
Seperti mana kebanyakan regim dihujung usia.
Anwar's prosecution is not part of a morals campaign. The GOM does not aggressively target non-heterosexual behavior; if it did so, a recent cabinet minister, senior staff associated with PM Najib and other prominent citizens linked to the government also would find themselves under investigation.
Bila untung Umno bising bila mereka diserang Umno diam...
Mengapa NGO2 Islam Tidak Mendengar Kedua-Dua Belah Pihak?

Berkata Kadi Syuraih: Katakanlah wahai Amirul Mukminin.
Berkata Saidina Ali: Ya.
Kadi Syuraih: Ada buktikah wahai Amirul Mukminin?
Saidina Ali: Ada.
Mystery shrouded deal to save AirAsia?
The boss of Khazanah Nasional says that the MAS-AirAsia deal is, among other things, not a bail-out of MAS.
Well, we have questions for him.
Firstly, why was this deal worked out in the first place? Why AirAsia? Isnt AirAsia operating at some 40 times its price earning (PE) ratio?
Looking at its numbers and the fundamentals, the high PE could mean that AirAsia stocks are overpriced.
That may mean some boys are cooking up the numbers to set up the market and make killings.
Former prime minister Dr Mahathir Mohamad said MAS can learn from AirAsia on ways to cut costs.
Does that mean all those damned exercise carried out by former MAS chief Idris Jala wasnt enough? Why dont we learn from Singapore Airlines or Qatar Airlines?
Oh we want to learn from our home-grown talent will be the likely answer.
Commissions, commissions
I know this is a BAD deal because Mahathir said so. Mahathir always says something when he actually means the reverse.
So what can we learn from AirAsia?
Lets look at the home-grown talents (AirAsia) records. As of the first quarter of 2011, AirAsia debts amounted to RM7.7 billion with cash balances amounting to RM1.7 billion.
This part doesnt require teaching for MAS. Its executives are renowned masters.
Lets see further. In August 2010, AirAsia announced a deferment of its proposed aircraft purchases but sometime in June 2011 it reversed its decision and proceeded to place an order for an additional 200 new aircraft at the Paris Air Show.
No big deal, we can order as many as we want.
Possibly the commissions earned from the purchases dwarfed the one earned from the Scorpene submarines.
AirAsias skyrocketing! debts strong>
As of March 31, 2011 (first quarter report), AirAsias capital commitments stood at RM19 billion.
With the latest announcement, an additional RM54 billion will be added as capital commitments. The proposed capital commitments of about RM74 billion will be spread over a 15-year period ending 2026.
In other words, AirAsia has to increase its earnings to an average of RM5 billion per annum to meet its future dues.
From 2006 to 2010, AirAsias revenue grew by ten-fold from RM110 million to roughly RM1.1 billion. This is an average growth of RM 200 million per annum.
Now how will it reach RM5 billion?
This, we will see in the coming months when AirAsia rationalises all its routes and what not.
AirAsias cash reserves rose six-fold from approximately RM300 million to RM1.7 billion. But its debts skyrocketed from RM1.05 billion in 2006 to RM7.7 billion in 2010, an increase of 700%.
Surely this looks like a debt burden that is spiralling out of control.
Scheming Fernandes
This AirAsia-MAS deal is signed, sealed and delivered at an onerous and ominous time.
The world economy, including Asias, will be heading into another maelstrom and air travel will invariably be hit.
So what can be done?
One, AirAsia can cancel orders but contract penalties will be onerous.
AirAsia wouldnt want to pay penalties, would it? The debt with Malaysia Airports Bhd (MAB) too, it dragged on for what seemed to be forever.
That option is no go. But then why would anyone want to forfeit commissions (from the purchase of new planes)?
Also, AirAsia chief Tony Fernandes is probably thinking along what economist John Keynes said: When you are a big borrower, the banks are scared of you.
So as a big borrower, Fernandes feels that size does matter after all!
He thinks it will shield him from foreclosure as banks will be wary of bearing heavy losses!
But also, a sizeable chunk of those loans a! re being held by Malaysian banks and in the worst-case scenario, the government and the taxpayers will have to pick the tab to avert a financial meltdown cascading down the AirAsia slope.
AirAsia bad debtor
Now lets take a look at MAS, currently the whipping boy but which is instrumental to further the game being played by Khazanah boss Azman Mokhtar and gang.
MAS has a paid-up capital of RM3.384 billion and has a fixed asset value of RM8.4 billion.
Its net asset is at RM 6.962 billion, where cash constitutes RM 2.086 billion.
Compare that to the position of AirAsia, which we have pointed out above. AirAsia has borrowings of up to RM7.7 billion and its cash position is RM1.7 billion.
In an earlier article, we pointed out that AirAsia has a record of being a bad debtor. It once owed MAB over RM65 million and whenever actions were taken against them, AirAsia would run to their chief counsel, former premier Abdullah Ahmad Badawi.
Now of course AirAsia has Mahathir on its side and also the abrasive and aggressive former International Trade and Industry Minister, Rafidah Aziz, who can be counted on to also be its enforcer.
MAS strenghts
MAS wealth is actually its network and position in the Tier-5 airline market. MAS annual operating turnover is RM12.98 billion versus AirAsias RM 3.948 billion.
MAS operating revenue from airline operation is at RM11.649 billion against AirAsias RM2.839 billion.
Whatever you name this MAS-AirAsia merger or coorperation it is a mystery-shrouded takeover with elements of manipulation and failure of disclosures.
Khazanah is giving away 20.5% of its holding in a company with a bigger network, acclaimed higher standard of service, much bigger operating revenue, stronger assets, lesser debts, more cash and better paymaster track record to another company with lesser track record.
AirAsias strength is that it excels in hyped-up marketing and showing it! can mak e a lot of net money in shorter time.

USAHLAH SOMBONG DAN TAKBUR
Harapan Komuniti breaks silence on Jais raid
It insists the 'thanksgiving' dinner raided by 30 Jais and police officers was for 'donors, friends and beneficiaries of Harapan'.
Harapan Komuniti has broken its silence on the multi-racial dinner at the Damansara Utama Methodist Church, which has become the centre of controversy after a raid by the Selangor Islamic Affairs Department (Jais) last week.
In a statement today, executive director Raymond Koh said the 'thanksgiving' dinner was attended by "donors, friends and beneficiaries of Harapan Komuniti" before it was raided by 30 Jais and police officers.
They proceeded into the hall and took photos and videos and even removed pamphlets from the various drawers and cabinets in the said hall, without any permission from us or the landlord of DUMC's premises.
He described the non-profit group as one that works with the poor and "downtrodden" and people living with HIV/AIDS.
This is the full statement:
Harapan Komuniti is a non-profit organisation, working to bring love, hope, peace and dignity to the needy, downtrodden, children, women and people living with HIV and AIDS. We help people, regardless of race, religion or creed.
Harapan Komuniti is a partner organisation of Malaysian AIDS Council.
On Aug 3, Harapan Komuniti held a thanksgiving/fundraising dinner at DUMC's (Damansara Utama Methodist Church) premises. That dinner was attended by donors, friends and beneficiaries of Harapan Komuniti.
About 120 people, from various backgrounds, attended the dinner and were treated with a meal catered by Muslims, followed by live performance, a 1Malaysia dance, a quiz, and reporting by individuals. Harapan Komuniti also offered a general prayer.
Around 9.30pm, about 30 officers from Jais (Jabatan Agama Islam Selangor) and the police, some were ! in unifo rms and others in plainclothes came into the said premise without any search warrant or permission.
Harapan Komuniti immediately requested the Jais officers if they had any warrant and despite repeated requests, Jais officers refused to hand to us any warrant to search or arrest.
They proceeded into the hall and took photos and videos and even removed pamphlets from the various drawers and cabinets in the said hall, without any permission from us or the landlord of DUMC's premises.
Harapan Komuniti's lawyer Annou Xavier stated that Malaysia should be fortunate to have non-profit organisations such as Harapan Komuniti that gives 'Harapan' or hope to the needy, afflicted, poor, marginalised and yet, on that fateful night, Jais decided to take the opportunity to raid the thanksgiving charity dinner on the assumption that conversion of religion was taking place.
Harapan Komuniti has helped many needy and downtrodden citizens of Malaysia, without regard to race, religion, creed, yet Jais took it upon themselves to disrupt a peaceful and harmonious charity event.
Annou further states that Harapan Komuniti is a '1Malaysia' organisation in its pure sense, in that its board members consist of a Malay, Mohd Rahim Ithnen, a Chinese, Raymond Koh and an Indian, Sri Ram KS Gopal to help all races, religion and creed, and not some parties that simply chant '1Malaysia' merely as a slogan.
He hopes that such an unwarranted raid would not take place in the future that would cause unnecessary anxiety and trauma to peace-loving Malaysians.

Khalid dodges Jais bullet
The MB avoids giving straight answers when asked if the state gov't has jurisdiction over Jais.
The Selangor government continued to avoid a clear stance on the Selangor Islamic Affairs Department (Jais) raid on a church, saying it wants to wait for the full report.
Menteri Besar Abdul Khalid Ibrahim (right) said it cannot be sure when the report will be ready, as Jais is facing legal obstacles in questioning the 12 Muslims said to be involved in alleged proselytisation activities during a dinner at the Damansara Utama Methodist Church (DUMC) last week.
He said the lawyers representing 10 of them had written to his office, explaining their position on the responsibilities of their clients and those of Jais in the matter.
"This is the legal view of the 10 people (identified for questioning).
"We have forwarded the letter to Jais' legal advisers... We do hope after (the Hari) Raya (celebrations), we can settle this issue," he told a press conference after chairing a state executive council meeting today.
When asked, Khalid explained that Jais operates as a department within the state administration, adding that Jais should come to the state first in whatever activity they intend to carry out.
The menteri besar however sidestepped questions when pressed specifically on whether or not the state has any authority over Jais, only saying that the religious department must conduct its activities based on provisions laid out in the state enactment.
Read the enactment, he said when pressed to clarify whether it meant the state government has jurisdiction over Jais or otherwise.
Khalid also avoided responding directly to criticism for stating his regret over the raid, despite ordering a gag order on all state executive councillors and state government staff on the ! issue pe nding completion of Jais' report.
Gag order remains
Describing the raid as pemeriksaan or an inspection, Khalid said the best policy the state government can adopt now is to allow Jais enough time to complete its report.
The state must be very professional and get the facts first. Right or wrong, let us see the report first, he said.
Khalid repeated however that the gag order still stands and applies to all state exco members and state government staff.
When asked if he has met the Sultan of Selangor over the Jais raid, he said that is also pending completion of Jais investigations and the full report.
Let's not be hasty in passing judgment. We have yet to get the full report from Jais, which is needed before I can give my views and ask for the views of the sultan, he said.
On Aug 3, Jais officials barged in on a multi-racial thanksgiving dinner function at DUMC, where they were said to have questioned participants and collected pamphlets and other documents found at the event.
PAS' state exco member in charge of religious affairs Hassan Ali added fuel to the controversy when he backed the raid, stating that there was evidence of proselytisation of Muslims at the dinner - held in honour of non-profit organisation Komuniti Harapan.

Semalam, Tulang Besi membuat sedikit "research".
Tulang Besi And here is the rest of it.
Quantitative Easing - Masturbating the Economy
Some of the guys down at the bar ask me what does QE2 means, well i told them that QE2 is not QueenElizabeththe 2nd but means "Quantitative Easing" and the 2 means "again" the second time. And this friend of mine who is an Engineer added "wtf is that" and the economy?
You see most people have heard this term from the financial papers or over the news especially with the recent Market Crash or more appropriately, It's a damn shit Meltdown! That means more of it to come on a much more prolonged period. A crash could be just a temporary reaction to an event but a Meltdown is a over a much more longer period due to some protracted long overdue inherent critical problem in the economy that remains unresolved.
Holy Cow! What 's wrong with these people???
Anwar can attend but cannot participate....
Anwar Ibrahim can be present during interviews of witnesses for the defence case in the sodomy trial, but he cannot participate by asking questions. Kuala Lumpur High Court judge Justice Mohamad Zabidin Mohd Diah made the ruling this morning after hearing submissions from the defence and prosecution. The prosecution in its submission objecting to Anwar Ibrahim's presence during the defence team's interviewing of the 15 witnesses it asked for in the Sodomy II trial said the opposition leader was capable of intimidating the witnesses. Further, the presence of the media might turn the matter into a circus, it cited as among the grounds for its objection to Anwar's presence during the interviews with the witnesses.
The submission was made by DPPs Mohd Hanafiah Zakaria and CK Wong in the chambers of Kuala Lumpur High Court judge Mohamad Zabidin Mohd Diah.
There is no necessity for the presence of media and reporters during this interview exercise. It is intimidating to the witnesses and the court is not there to protect the witnesses' interests.
More importantly, it smacks of a lack of bona fide on the part of the defence, the presecution submitted, adding that the interview exercise could be turned into a media circus.
Other grounds the prosecution stated in its objection were that Anwar was capable of asking witnesses to say what he wanted them to say during the interview, and that past events in court indicated that Anwar's counsel were not able to control him.
Justice Zabidin dismissed the objection.
The prosecution had objected to Anwar's presence yesterday, just as interviews were scheduled to be held with former police chief Musa Hassan and former Malacca police chief Mohd Rodhwan Mohd Yusof.
The defence will now be able to int! erview 1 0 witnesses today in Anwar's presence, at the Jalan Duta court complex in Kuala Lumpur.
However, the list for today does not include premier Najib Abdul Razak, his wife Rosmah Mansor or Musa.

What a bullshit!! In fact the prosecution is indeed becoming a circus by its own doing in this kangaroo court....
