BERSIH: Penjelasan JPN tak boleh diterima

Datuk Ambiga Sreenevasan berkata BERSIH 2.0 turut menerima aduan sama tetapi ia tidak dibuktikan sebelum Malaysiakini membuat pendedahan berhubung status kerakyatan Mismah.

Penjelasan oleh Jabatan Pendaftaran Negara berhubung status kewarganegaraan seorang bakal pengundi yang dilaporkan sebelum ini tidak menyentuh mengenai kebimbangan orang ramai, kata pengerusi BERSIH 2.0, Datuk Ambiga Sreenevasan.

NONEOleh sebab itu, beliau menyokong seruan oleh ahli parlimen Pakatan Rakyat untuk mengadakan sidang tergempar parlimen pada bulan ini bagi mendapatkan penjelasan kepada persoalan yang ditimbulkan berhubung skandal berkenaan.

"Kita belum lagi mendapat jawapan bermakna... Perlu ada kebertanggungjawaban dalam isu ini," kata Ambiga dalam satu wawancara dengan Malaysiakini semalam.

Katanya lagi, jawapan yang diberikan kepada BERSIH 2.0 setakat ini sangat tidak boleh diterima.

Ketua pengarah JPN, Jariah Mohd Said dalam penjelasannya sebelum ini berkata, nama Mismah yang ditemui dalam draf daftar pemilih terbaru itu diberikan taraf penduduk tetap pada 17 Julai, 1982 dan kemudiannya diberikan taraf kerakyatan pada 31 Januari 2011.

NONEBagaimanapun, kenyataan itu tidak dapat menjelaskan bagaimana sistem pengesahan JPN mengkategorikan Mismah sebagai penduduk tetap pada pagi Selasa, tetapi status tersebut ditukar kepada taraf kerakyatan hanya empat jam selepas laporan Malaysiakini disiarkan.

Jariah juga tidak menjelaskan dakwaan yang dikemukakan oleh PAS bahawa terdapat sebanyak 1,587 kes seperti itu yang dikesan di seluruh negara.

Mengulas lanjut, Ambiga berkata BERSIH 2.0 turut menerima aduan sama tetapi ia tidak dibuktikan sebelum Malaysiakini mem buat pendedahan berkenaan.

The Malaysian Aids Council (MAC) today rose to Harapan Komuniti's support, saying that the NGO's dinner raided by the Selangor Islamic Department (Jais) on Wednesday was actually a fundraiser for HIV/AIDS support programmes.

This is despite Selangor state exco Hasan Ali claiming that Jais had found evidence of "proselytisation" during the event.

In a statement today, its president Mohd Zaman Khan said that the dinner was organised by the Damansara Utama Methodist Church (DUMC) to raise funds for the MAC partner organisation at its premises.

"It was intended to raise funds to support Harapan Komuniti, whose primary aim was to help Malaysians living with HIV, regardless of their ethnic and religious backgrounds.

The '1Malaysia Muhibbah Fundraising Dinner', said Mohd Zaman, the former federal CID chief, was meant to help provide financial assistance to the underprivileged and support for proper medication, treatment and care.

Harapan Komuniti is a partner organisation of MAC which also provides educational assistance to underprivileged children in Kuala Lumpur and Johor.

Saying that he is "disheartened" by the incident, Mohd Zaman sought an explanation from Jais, and called for precautionary steps to be taken to ensure that the integrity of Islam and interreligious harmony is not compromised.

Yesterday, Hasan Ali had said that Jais, which falls under his purview, "searched" the church after a tip off! that a breaking fast event would be taking place there.

His statement came shortly after Selangor Menteri Besar Khalid Ibrahim expressed regret over the incident and ordered a full report from the religious department.

PAS: Jais should have checked first

Meanwhile, PAS information chief Tuan Ibrahim Tuan Man said that Jais should have done preliminary investigations first before conducting the raid.

"Efforts must be taken to prevent sinful activities, but this does not mean that one should interfere in the affairs of other religions.

"In this case, Jais had acted on a tip-off, which is the right thing to do, but unfortunately, they did not first confirm the veracity of the information," he said in a statement.

He said that the religious department should have been more "cautious" due to the "political climate of the country".

"Don't be too quick to believe in slanderous statements and make ill-assumptions prior to investigations," he said.

Nevertheless, he said, the Muslims who had attended the fundraising dinner must "reflect on their actions to decide if they have unintentionally caused others to assume to worst about the dinner and the church.

"I hope that Jais can come forward to explain what happened and the result of their probe so that no more slanderous accusations would be made against the church, the Selangor government, Islam or the department itself during the holy month of Ramadan.

"If a mistake has been made, apologise," he said.



Bar: Probe 5 MACC officers for culpable homicide

In its submission to the RCI, it had recommended that the five be investigated under Section 304A of the Penal Code.
Unlike the royal commission of inquiry which found that political aide Teoh Beng Hock was driven to suicide, the Bar Council, which took an active role in the RCI, had recommended to the panel that five Malaysian Anti-Corruption Commission (MACC) officers be investigated for culpable homicide.

The five officers are former Selangor MACC deputy chief Hishamuddin Hashim, Selangor MACC investigations chief, Hairul Ilham Hamzah, investigating officer Mohd Anuar Ismail, interrogation officer Mohd Ashraf Mohd Yunus and Klang MACC assistant enforcement officer Zulkefly Aziz.

azlanThis is in contrast to the RCI finding which only implicates three officers namely Hishamuddin, Anuar and Ashraf. The Bar had recommended that the five be investigated under Section 304A of the Penal Code for causing the death of Teoh via negligence.

The Bar Council's recommendation is contained in the 337-page submission to the RCI panel which was finally released to the Malaysian Bar members today. This follows a meeting held last night to discuss the matter.

The submission added that Hairul and Anuar had admitted in hindsight, they would not have supervised the investigations in such a questionable manner as they had as the Selangor MACC investigations chief and the investigation officer in charge of the investigations, and that they were responsible for witness or suspects under their custody.

The Bar also want the authorities to investigate 10 MACC officers including the five mentioned for criminal conspiracy under section 120A of the Penal Code.

It also recommended that the 10 officers be investigated for abetment or attempting to abet in Teoh's death or a cover-up to the political aide's death.

Furthermo! re, they also proposed that the 10 officers be investigated for giving false evidence and fabricating evidence under section 191 and 192 of the Penal Code.

Teoh had died while being detained overnight at the Shah Alam MACC headquarters in Plaza Masalam on July 16, 2009.

The recommendations by the Bar for more MACC officers to be investigated is in contrast with what the RCI had recommended in its 124-page report.

FBC MEDIA SCANDAL GROWING QUESTIONS FOR CNNS JOHN DEFTERIOS

However, unlike the BBC and CNBC, who have both launched investigations and suspended FBC Media programmes, CNN has leapt to a fairly arrogant and unquestioning defence of itsBusiness Presenter, who for years has combined that role witha senior position and substantial shareholding in the crooked PR/ Productioncompany.

The problem is that John Defterioss programme guests were sometimes his own PR clients. They had paid millions of dollars to his company in return for positive publicity andplatforms in the global news media. IndeedFBCboasted in its promotional materialthat it was the only PR firm who could uniquelyguarantee access toblue chip, editorialshowson stations such as CNN, CNBC and the BBC. Anyone in the business knows that such guarantees could only be illegal.

FBCs clients are believed to have included the Government of Khazakhstan and the Government of Malaysia, whose leading members have been recently interviewed by Defterios a number of times on CNN.

So why are CNN refusing to review this embarrassing situation? The BBC have stated that they werenotaware of some of the informationabout FBC Medias business model, which combinesprogramme production with strategic PR and have therefore suspended their programmes. Likewise,CNBC have said that having examined FBCs business practices it has withdrawn their World Business show indefinitely.
CNN, however, are defiantly denying that there is a case to answer.
CNNs defence of John Defterios
In2001 John Defterios becamePresident of FBC Media and as late as last monththe companys website described him as a member of their Executive Committee in these terms:
Defterios.. serves as President of thegroup. In this capacity he oversees FBCs factualprogramming and media services work [FBC Website, July 25th 2011]
That media services work includedsigning up Abdul Taib Mahmud as a PR clientin January 2011 and then proceeding to place him, Sarawak and the oil palm businessin a positive light on shows aired across the world on global TV stations over subsequent months. These media services are spelt out in the companys power point presentations.


CNN seems not to be worried that they have been listed as one of FBC's guaranteed "media platforms" for their PR clients.

Yet CNN have stated to Sarawak Report that they are satisfied that allhas beenwell with their shows, because they claim that Defterios signed up as a full-timeemployee, as opposed to a contracted Presenter, in March. At this time, so the argument goes, Defterios severed all ties with FBC Media.
There are two problems with this argument. The first is that legally there is no difference between a member of staff or a contract worker when it comes to declaring sponsorship interests. The second is that there is no convincing evidence that Defterios did in fact sever his ties with FBC in March. To the contrary he continued to be advertised on their website as the President of the group and overseer of all operations and he continued to be registered as a Director and Shareholder of both FBC Media and the parent FBC Group in the UKs company register.
CNNs latest statement to Sarawak Report consisted of an astonishing decision to forward athreeparagraph email from FBC yesterday, which was apparently designed to confirm that Defterios had severed relations in March and that therefore there were no further questions to answer. It thus appears that,althoughwe now know FBC Media isan outfit that has been operatingillegally, CNNis prepared to rely on its word entirely in the matter!
The FBC statement, however, raises more questions than it answers:
To Whom it may concern: John Defterios resigned from FBC on 4th March 2011, he was subsequently removed from payroll in his capacity of President that month.
Also as agreed he has been removed from the Board of FBC which will be reflected in the financial statements under the Companies Act when FBC files its latest financial company return which is due in October 2011.
The website is undergoing changes and he has been removed as President and he was not the Managing Editor within FBC. Jess Panesar, Group Finance Director, FBC Media (4th August)
The immediate question raised by this email is why the removal from the Board has not been dated and when that further agreement was made? There is also a glaring failure to mention anything about John Defterioss substantial shareholding in FBC Media, which is the foundation for concerns about conflicts of interest over his role at CNN. The fact remains thatDefterios remained registered yesterdayboth as a Director and Shareholder of FBC Media and FBC Group.
Equally, the lame excuse about changes to the website being the explanation for it being pulled down the day journalists started asking questions a week ago cannot cover up for the factthat Defterios was still being described as the President of the group overseeing factual programming and its media services work on that very site just days ago on July 25th.

It would be unwise for CNN to deny the significance of this issue and its potential reflection on the integrity of its programming. The most dramatic and important political event in Malaysia in the past month was the Bersih march for Free and Fair Elections, which galvanised tens of thousands onto the streets in KL and was matched by sympathy demonstrations in countries across the world.

Najibs forces of law and order could have contained that march, but instead the peaceful demonstrators were brutally suppressed. They were sprayed bywater cannons laced with acid and beaten with batons. Nearly 2,000 were arrested and 6 of those were kept in jail for weeks.
The week after that march Najib came on a promotional tour to London, where he was greeted by outraged Malaysian protesters at every event. Under these circumstances CNN was the only TV news station who saw fit to conduct a full scale interview with Razak, focusing on the economic purpose of his visit.
The interviewer was John Defterios and at the time last monthseveral Malaysian commentators were sickened by his soft handling of the Prime Minister and his treatment of the Bersih movement. Now those same people are wondering if they have learnt why this was and whether the fact that Najib Razak is a RM28 million a year PRclient of FBC Media could have affected the way he was promoted on CNN?

AUG 5 — The recent Selangor Religious Department (Jais) raid of the Harapan Komuniti event held at the Damanasara Utama Methodist Centre should be condemned by all Malaysians.

This dinner, which was organised to commemorate and honour the work of this non-profit organisation as well as its supporters and beneficiaries, is demonstrative of how we are united in a common concern and care for those living on the margins of society and who are less fortunate than us, regardless of their ethnicity and religion.

The high handed and overzealous manner in which the raid was conducted by the Jais officers over an unspecified complaint, and the disrespect shown towards the sanctity of a house of worship speaks volumes of the tendency towards the lack of respect for other religions, unaccountability and a culture of impunity.

Let us be clear: The embarrassing actions of the Jais officers appear to be the acts of a bully. It was bad enough that the so-called complaint was not substantiated, but the officers were not even able to produce a copy of the actual complaint.

Refusing or being unable to produce a warrant, especially when entering private property and religious places, is unacceptable. Just as we ask that non-Muslims should respect the sanctity of our places of worship and the practices of our religion, we as Muslims must always do the same.

It is disappointing that Selangor executive councillor Datuk Dr Hasan Ali has defended the raid by saying that 12 Muslims had participated in the dinner event on the church premises, and that this was proof of proselytising.

So what if there were Muslims at the dinner? This is proof of nothing other than they were there to show their appreciation to Harapan Komuniti, an NGO that is involved in charitable community work.

I too have attended weddings, discussions sessions and dinners several times in churches, temples and mosques. The prime minister himself met the Pope in the Vatican. Is that proselytising?

We are reminded again of the 2006 incident where the spread of unsubstantiated wild rumours through SMS concerning the supposed conversion of Muslims in Perak, resulted in 1,000 angry protestors gathering outside a church in Ipoh. It was later revealed that the church was not converting Muslims but was instead holding its Holy Communion service for 98 Catholic children.

That incident, which implicated the state Mufti, as well as the behaviour of journalists from the Al-Islam magazine who desecrated a communion wafer in 2010, were due to the same paranoia and phobia that have been used to justify this raid: The conversion of Muslims.

These incidences are eggs on the faces of moderate Malaysians regardless of whether they are Muslim or not, especially when the self righteous actions are later proven to be based on wild and unsubstantiated allegations, paranoid delusions or simply irrational fear due to ignorance. We end up looking foolish and being terrified of bogeymen.

Incidences such as these could be read as harassment, bullying, intimidation or, worse, evidence of religious tyranny or the denial of the right to religion.

There is an urgent need to increase the quality of oversight and accountability of the state religious departments.

Who are the religious authorities accountable to? Where is their check and balance? We must begin to dispel the perception that the religious authorities are a law unto themselves.

I am glad that Mentri Besar Tan Sri Khalid Ibrahim has immediately expressed his regret over the incident. Indeed, the Selangor government must acknowledge that it is also responsible and take the relevant persons to task as religion is a state affair under the Federal Constitution.

There are many fears, false beliefs and misunderstandings that are born from the shallow and ignorant understanding of other religions.

The best way to begin to remedy this is to address the ignorance and make a serious effort to learn and educate each other. I suggest we start with ourselves and the Jais officers.

Bersih supporters take aim at police ‘weaponry’

KUALA LUMPUR, Aug 5 — Bersih 2.0 supporters have accused the police of “clear intent” to cause injury or even death during its July 9 rally given the “lethal” levels of tear gas and chemicals in the water cannons used to disperse tens of thousands who poured into the capital last month.

They told the Human Rights Commission (Suhakam) today that the inquiry into claims of police brutality must “investigate why the police is using such dangerous products that have a track record of causing death.”

“These canisters state clearly that they can cause serious injury and death. The US-based Federal Laboratories supplies the tear gas to the Israeli army and have been sued by Palestinians who lost family members,” Fadiah Nadwa Fikri from Lawyers for Liberty said today.

She also told The Malaysian Insider that tear gas produced by Federal Laboratories has been banned in several countries and this “raised questions over why the police are using such weaponry.”

Tenaganita chief Irene Fernandez also told the commission that “police knew exactly what they were doing as they already had the tear gas and chemicals ready. There was clear intent to cause harm; that is what is worrying.”

Opposition leaders and human rights activists have repeatedly claimed that police used excessive and brutal force in dealing with the July 9 rally for free and fair elections, arresting nearly 1,700 on the day, leaving scores injured and one ex-soldier dead.

PKR also previously claimed that police had fired tear gas canisters directly at Opposition Leader Datuk Seri Anwar Ibrahim, an act they want classified as attempted murder.

But police have formed six committees of their own to investigate whether the force had acted improperly after locking down the capital from the night before the rally.

The police recently released videos that appeared to absolve the force of blame and show that riot police were provoked by the demonstrators.

Suhakam was receiving testimonies today from the coalition of 62 non-governmental organisations ahead of a public inquiry that commissioner James Nayagam said would likely be held after Ramadan.

No law against Muslims in churches, says Bar Council

KUALA LUMPUR, Aug 5 — The Bar Council said there are no laws stopping Muslims from entering church premises, and accused the Selangor Islamic Religious Department (Jais) today of “disrespecting” the right to association by raiding a Petaling Jaya church this week.

Its president Lim Chee Wee also pointed out there is no law stating Muslims cannot be part of the audience at a thanksgiving event held in church premises, even if it contained religious elements like prayer and singing.

“By conducting such a raid... then taking down the particulars of Muslims found in attendance, treating them as though they had somehow broken the law, Jais has besmirched the good name and sullied the hard-earned reputation of Malaysia and her peoples for multi-racial, multi-cultural and multi-faith acceptance,” he said in a statement.

“Especially in this month of Ramadan, one would have hoped that the Islamic religious authorities in Selangor would have focused their attention on more constructive pursuits rather than the disruption of a community thanksgiving dinner that brought together people of various races and faiths in peace, harmony and unity.”

Lim said the raid — which followed “insensitive” public service announcements (PSA) by 8TV — did not bode well for racial and religious harmony in Malaysia as their actions suggested that moderation was increasingly giving way to “mindless orthodoxy”.

“If, after almost 54 years of independence in Peninsular Malaysia, a state Islamic authority and a national television company can still display a form of arrogant authoritarianism and callous condescension in their actions, then we must collectively ask ourselves where we have failed as a nation,” he said.

He added that he welcomed the statement of regret offered by Selangor Mentri Besar Tan Sri Khalid Ibrahim and urged that disciplinary action be taken against Jais officers responsible for the raid if they are found to have exceeded their authority.

“The civil authorities cannot allow the Islamic department to wantonly disrespect the fundamental rights and liberties of all citizens to gather and associate freely with one another,” Lim stressed.

Jais enforcement officers raided a dinner function at the Damansara Utama Methodist Church late Wednesday night without a warrant after receiving an unspecified complaint, bringing with them a team of policemen.

Between 100 and 120 people, including several Muslims, attended the non-religious event to celebrate non-profit outfit Harapan Komunity’s success in helping women, children, HIV/AIDS sufferers and victims of natural disasters.

Immediately after, Khalid called on Jais to furnish the state government with a full report on the purpose of the raid while assuring that the state government fully respects freedom of religion and rights of religious groups.

But state executive councillor Datuk Hasan Ali defended Jais’s actions, alleging that the words “Quran” and “pray” were used in the presence of 12 Muslims at the dinner and claimed this was proof Christians had been proselytising to Muslims there.

Hasan’s PAS colleague, Shah Alam MP Khalid Samad, then sought to distance the party’s state leadership from its former chief by saying it was “not Selangor PAS’s stance”, revealing a deep and continuing rift between the Islamist party’s liberal and more hardline factions in the state.

SHAH ALAM Aug 5 — Selangor PAS wants former chief Datuk Hasan Ali and the state Islamic Religious Department (Jais) to explain Wednesday’s controversial raid on a multi-racial dinner at a Petaling Jaya church, including a claim that Christians were attempting to convert Muslims.

The Islamist party is part of the state Pakatan Rakyat (PR) government where Hasan is state executive councillor in charge of Islamic affairs.

“We reserve final comment until we are able to get Jais’ report and meet with Hasan Ali to seek further clarification. We want to see what evidence Hasan has,” Selangor PAS deputy commissioner Khalid Samad told a press conference here.

Selangor has gagged all its exco members from talking about the raid after Hasan claimed there were efforts to convert Muslims when Jais and police raided the Damansara Utama Methodist Church (DUMC). The raiding party entered building without a warrant on the basis of preventing the conversion of Muslims.

The multiracial dinner was attended by about 100 people, including a dozen Muslims.

Khalid said only Hasan has associated the dinner — organised by charity association Harapan Komuniti — with the aim to convert Muslims.

“Previously, Jais gave grounds that there is evidence of (Christians) proselytising to Muslims. So far, only one party (claims this),” said the Shah Alam MP.

He also agreed with the state government in asking the religious department explain the reasons for the raid.

“Jais has to give an explanation; they have to present a report on how and why they decided to raid the church.

“Places of worship — regardless of religion — must be respected; this comes from the teachings of Prophet Mohammed (PBUH). Going into a place without a warrant or permission is something that must be avoided entirely, more so in a place of worship,” he said.

He pointed out that while the country’s official religion is Islam, non-Muslims must also feel safe and added: “For PAS, we want (Jais) to let them feel safe by showing utmost respect.”

On Hasan’s claim that the late-night enforcement raid was to prevent an attempt to convert Muslims, Khalid said, “It is not wise to make conclusions that Christians were proselytising to Muslims just because they were having dinner in a church. There must be more substantial evidence, more intelligence.”

“If it’s only dinner, then there is no reason (for the raid). There are lots of programmes with people of different faiths. Look at Ramadan, people of all races gather together to break fast. In fact, this is encouraged in Islam,” he added.

Khalid said in any operation, there are rules to be followed.

“It is very surprising for this to have occurred. It should not have (taken place). We will wait for the report to understand why it happened,” he said.

Khalid also said he hoped the allegation of Muslim conversions were not true.

“These are serious accusations. If true, it will have heavy implications... Proselytisation of a Muslim is against the constitution. However, I am confident that those involved are aware of this,” he said.

When asked if he was concerned PAS would lose non-Muslims votes during the upcoming general election, Khalid said PAS Selangor is not involved with Jais.

“We think raiding a place of worship is hard to accept. Even in an Islamic state, it does not mean (a religious department) can act out as (it) pleases. We want to know why Jais carried out the raid,” Khalid said.

Damansara Utama Methodist Church senior pastor Daniel Ho has called for action to be taken against religious enforcement officers, saying they had denied over 100 dinner guests their constitutional right to freedom of assembly in the raid.

The pastor said the enforcement officers swooped in on the dinner based on an unspecified complaint, bringing along a police team but without any warrant for the operation.

Dr Mahathir Mohamad. You either love him or hate him. In his latest blog, he taunted the western media for their self-righteousness and gloated over the telephone hacking scandal caused by the News of the World, one of Rupert Murdochs newspapers, which rocked the UK.

In his latest posting on Aug 2 entitled The telephone hacking scandal II, Mahathir described how western journalists freely condemned our failure to respect the rule of law, our injustices, our poor human rights record and our corruption.

He then said that the western media was equally contemptible and that they (the western press) would just as easily cheat, abuse the trust placed on them and would ignore human rights. They were guilty of the dirty things they allege we had committed.

Mahathir then relished relating how UK members of parliament were found to have used taxpayers money to fund their private lifestyles and that their governments would also sell titles.

As expected, Mahathir used the recent telephone hacking scandal to illustrate his contempt for the western media and all that they represented.

Mahathir seemed to enjoy detailing the bribes given to journalists so that they would downplay the indiscretions committed by powerful people.

Interestingly, Mahathir said that their politicians are just as afraid of the press as we are.

Unsurprisingly, Mahathir slammed the western press for misreporting about Malaysia, in essence, telling lies about the country. He further condemned the continual denigration of the Malaysian government, without the west checking the veracity of the facts.

He poured scorn on western reports about his cronyism, his manipulation of the judiciary and his treatment of Anwar Ibrahim, his one-time deputy.

Mahathir ended by saying that except fo! r a few notables, the western journalists are not the impartial purveyors of truth that people assume them to be.

The press baron

Before Mahathir can ridicule the western press even further, perhaps he should look at the man at the centre of the telephone hacking scandal the press baron, Rupert Murdoch.

In a special report commissioned by Reuters, it was reported that Murdoch micro-managed his media empire and would dispose of any editor who regularly takes a different stance from his own.

Murdoch would put pressure on his editors until their newspapers reflected his own political leanings.

How different is this from Mahathirs rule? We hear allegations that no one would dare oppose Mahathir and that he had a little red book which detailed peoples faults, which could be used against them, if they dared challenge him in the future.

Mahathir might also like to compare the different relationships between the press and the politicians, in Malaysia and the west.

Murdoch cosied up to several MPs in UK, and with his indirect influence and patronage, would control the politicians. Contrast this with the Malaysian press and politicians. Over here, politicians, principally leaders of Umno, control the press.

In the west, it was the dirty politicians who were desperate to win elections and who got into bed with Murdoch.

It was a sort of quid pro quo whereby they would get immediate, extended and positive coverage in the papers, and support in an election year, provided they gave Murdoch unhindered access to Downing Street. If they did not, they would be annihilated in the press.

Over in Malaysia, there is no question that Umnos leaders hold sway over what our mainstream media publishes.

So what is there to be proud of Mahathir? In the west, Murdoch controlled the politicians. Over here, Mahathir (when he was PM) and his successors dictate what should and should not be published in our media.

Links with FBC Me! dia

How does Mahathir explain the scandalous exposes on Prime Minister Najib Tun Razak and the Sarawak Chief Minister, Taib Mahmud, who manipulated the foreign press into giving glossy impressions about their personalities and governance?

FBC Media Ltd, a UK-based PR company, has now been taken off air by both CNN and the BBC.

Perhaps, Mahathir has conveniently ignored the recent revelations by the Sarawak Report (SR) website?

SR reported that Najib and Taib spent scores of millions of taxpayers money on self-publicity based on lies the same lies that Mahathir accused the western press of not attempting to verify the truth first? The FBC has tarnished CNN and the BBC with their biased reporting.

Mahathir mentioned that in the west, the Metropolitan Police Chief was not immune to being questioned by the Parliamentary Select Committee over his handling of the hacking and over his acceptance of a stay at a health spa paid for by a former News of the World editor. The police chief has since resigned to prevent his force from further bad publicity.

Contrast this with Malaysia. Last December, our Parliamentary Select Committee denied Opposition Leader Anwar Ibrahim the opportunity to present his case on the APCO allegations and its links with Najib.

Malaysias parliamentary committee decided to rely solely on a letter from public relation consultancy APCO and barred witnesses from being called. In the end, Anwar was suspended from parliament.

Perhaps the critical difference Mahathir should consider is that in the west, those who are guilty of crimes are brought to trial, and given a fair hearing before justice is meted out.

Over in Malaysia, it makes no difference if the judiciary, the police, the politicians and all those who are guilty of any crimes have been caught red-handed.

They will be let off or be subjected to a sham trial. At worst, especially if public opinion is bound to go against the government, there will be a cursory sentence.

Ma laysians, especially politicians and civil servants, do not know the meaning of accountability.

Iron grip

Finally, those who are critical of Murdoch claim that his personality, managerial style and the pressure he exerted on journalists, created a culture that encouraged the type of behaviour which accepts phone hacking to get sensational news stories. The end justifies the means.

Isnt this what we have seen with Mahathir? During his rule, many of our institutions were corrupted by his style of governance and leadership.

Corruption, nepotism, lack of accountability, abuse of power, money politics and race and religion being used to divide us, are some of the things we have inherited from Mahathir.

Bruce Guthrie, a former editor at Murdochs Herald Sun in Melbourne, described Murdoch to Reuters: He is not necessarily a bloke who wants to discuss ethics in journalism.

Perhaps we can say of Mahathir, He is not necessarily a bloke who wants to discuss ethics in politics.

Kelewatan terus melanda rundingan kerusi Pakatan

Walaupun ibupejabat Pakatan Rakyat telah mengarahkan kepimpinan di peringkat negeri menyerahkan senarai muktamad calon bagi pilihan raya umum akan datang, pada 31 Julai lalu.

Rundingan antara parti komponen Pakatan Rakyat di peringkat negeri mengenai agihan kerusi, dibelenggu kelewatan dan perbincangan masih berjalan.

Kelewatan itu berlaku walaupun ibupejabat Pakatan telah mengarahkan kepimpinan di peringkat negeri menyerahkan senarai muktamad calon bagi pilihan raya umum akan datang, pada 31 Julai lalu.

Sumber-sumber yang rapat dengan pakatan pembangkang itu memberitahu Malaysiakini bahawa sehingga kini, hanya satu negeri, iaitu Perlis, telah menyerahkan senarai calon mereka - lima hari selepas tarikh tutup.

mengesahkan, walaupun tarikh telah berlalu, rundingan masih berjalan, tetapi menegaskan bahawa perbincangan berjalan dengan "baik dan lancar".

Ditanya sama ada terdapat apa-apa isu-isu utama atau perubahan yang menyebabkan kelewatan tersebut, beliau berkata, ianya hanya membabitkan perkara-perkara kecil.

"Terdapat beberapa perubahan dalam peruntukan (agihan kerusi) ini, tetapi saya tidak nampak ada apa-apa masalah besar. Saya yakin kita akan mencapai kata sepakat yang baik," kata Loke.

Menurutnya, Pakatan Rakyat negeri itu yakin perkara itu akan dapat diselesaikan dalam tempoh dua minggu.

Satu lagi sumber di Selangor yang rapat dengan rundingan agihan kerusi itu, juga mengesahkan kelewatan yang sama berlaku di negeri tersebut.

UMNO latest propaganda against DAP

DAP cannot control and tell Chinese businesses to up their prices to make the citizens suffer.

It is true most business suppliers are Chinese mainly because they were the first to trade since Merdeka.

But it is the ruling Government which is the one raising the prices. Take for example fuel, gas, flour, rice and sugar. All this are monopolized by UMNO elite. The owners are Mahathir, Shahidan, Sultan of Perlis, Pak Lah, Daim, Najib and Rosmah. You see any Chinese.

Under the tukar programme which is 1Malaysia Kedai, this is for the mamak Muslim like Mydin. They are given free money ranges from RM20,000 - RM60,000.

I am in Business myself so I do understand the cost of rental, TNB bills which has double two fold beginning this year and water which I use less than RM10 but am still charge fix rate of RM36 no matter how I argue. How about phone bills? Though we use minimum, there are many hidden cost which again rises the amount. There are many other unexpected cost factor to be considered. Remember also we have to compete with Supermarkets like Tesco, Giant etc.........

Yes indeed 1Malaysia kedai concept is good but how long do you think this kind of business can last before another round of free donation is ask. The Government will continue to give till the 13th General Election. But after that what happens?

So to say DAP is to be blame. Then UMNO rather the ruling Government should step down and let DAP sit in Putrajaya. Then those bastards who have no brain can say "I told you so."


The rot within the Election Commission, NRD and Immigration Dept....

In the face of denials by the Election Commission and the National Registration Department on irregularities in voter registrations and the issuing of citizenship to illegals, one has to wonder; what would have happened if no-one had taken the time to check on the registration listings and the status of citizenship of certain people?

Would the irregularities have gone unnoticed? And if they have been irregular practices - how long have they been in place?

Does this not smell of the infamous Project IC of the 1990s?

Again, it began with UMNO

Project IC is the name used to describe the allegation of systematic granting of citizenship to immigrants (whether illegal or legal immigrants) by giving them identity documents known as IC (identity card), and subsequently, MyKad.

The project is a complex matter involving certain political parties as well as various government agencies including the Election Commission of Malaysia, the National Registration Department and the Immigration Department, which comes under the purview of the Ministry of Home Affairs. The suspicions and allegations on the existence of Project IC began around the mid-1990s.

The project, in its widespread and intensive form, is suspected to have begun in the early 1990s after the entry of United Malays National Organisation (UMNO) into Sabah politics.

Throughout the 1990s, several government officers were arrested under the Internal Security Act for their involvement in Project IC. A Parliamentary Select Committee on Integrity was set up to hear testimonies of some of the detainees in February 2007. The committee was chaired by Sabah Member of Parliament Bernard Dompok. On May 16, 2007, Dompok quit as chai! rman of the committee over disagreements on the function and scope of the committee, in particular, over the refusal of the National Registration Department to appear before the committee. Later on, the findings of the committee was never made public.

Has a rehashed Project IC been reborn and using the latest technology to aid it?

Some wait a lifetime, others need only 4 hours

In the case of the individual called Mismah, who had her PR status upgraded to Full Citizenship in the space of four hours, Election Commission head Abdul Aziz Yusof attributed the problem to technical negligence.

Elaborating on the issue, he said he had contacted the NRD and was told that its online database had not been updated alongside the Agency Link-Up System (ALIS).

"(It was only) when I called (them) that they realised they have not updated the names online," Abdul Aziz added.

The NRD online database - used by the public to verify their status and details - is different from ALIS, which is the reference point for the EC in registering voters, he said.

If the NRD only knew that their online databases were not updated when the EC chairman called them, what were their ICT staff doing the whole time before the phone call?

And the EC explanation does not explain how Mismah could have her status changes within the same day during a four hour span. The changes to Mismah status were made before the call by the EC chairman to NRD. Thus, the ICT team was updating its record before the call. Does this mean that the main database had already had the changes made, and thus, this database has different information as compared to the online databases?

How many more are there?

! An d how many more Mismahs do we have? The records held by the NRD are now a point of contention? How sure are we that the information contained within the NRD databases are credible and true?

And with the impending use of the biometric system by the EC, one still wonders; how sure are we that the biometric information is coming from the correct database and how correct will the data be?

The legalisation of immigrants also uses biometrics as a means of registration, and this database of immigrants may be far more complete than the NRD or EC databases. Yet, even this to is looked upon suspiciously. How sure are we that the records from the Immigration Departments databases will not make its way into the NRD databases?

Farce

Bear in mind, the EC still has to collect finger-print information of current and existing voters. The easiest method is to tap into the NRD database but not all those registered in the NRD database are registered voters.

Citizens still have to register to vote and a vetting process still has to be complied with. Thus, there will be a lot of activity to update and keep current the databases under the control of the EC, how sure are we that during this period of activity, manipulated information does not makes its way in?

The EC assertion that everything is transparent and clean is a farce. The EC must now convince the public that their right, as citizens of Malaysia, is not tainted nor super-ceded by the needs of a ruling government desperate to stay in power and willing to do anything to accomplish the task - even to the point of selling citizenships to illegals in order to buy votes.

Kalau Ada Bukti, Mengapa Tiada Tangkapan?

Di dalam mempertahankan pendirian JAIS, Dato Hasan Ali mengatakan ada bukti berlaku percubaan memurtadkan umat Islam.

Mengikut laporan Malaysian Insider:

KUALA LUMPUR, 4 Ogos Exco Kerajaan Negeri Selangor Datuk Dr Hasan Ali mempertahankan tindakan Jabatan Agama Islam Selangor (Jais) yang menyerbu majlis makan malam Gereja Methodist Damansara Utama semalam atas alasan ada bukti mahu memurtadkan umat Islam.

Hasan menegaskan maklumat yang diterima menunjukkan terdapat kehadiran orang Islam pada majlis berbuka puasa di gereja berkenaan malam tadi.

Tambah beliau, pada majlis itu juga pihaknya dimaklumkan perkataan Quran dan pray diselitkan pada ucapan di majlis itu.

Masaalahnya, kalau ada bukti, mengapa tiada tangkapan dibuat. Dikhabarkan pihak Polis pun terlibat dan tiada peserta yang dapat melarikan diri dari majlis itu.

Cuma yang hairannya, pada malam itu, tiada seorang peserta yang ditangkap. Kalau dirujuk kepada serbuan-serbuan jabatan agama sebelum ini, setiap kali serbuan pasti ada tangkapan.

Juga, kalau ada bukti nescaya JAIS mampu mendapatkan waran untuk menggeledah premis gereja tersebut. Atas sebab tiada buktilah maka JAIS tidak mendapat waran.

Hairan, sungguh hairan.

Mengapa boleh berlaku percanggahan antara tindakan JAIS dan kata-kata Hasan Ali yang mempertahankan JAIS?

Mengapa pula pihak Polis terlibat sama sedangkan Polis berada di bawah Hishamuddin Tun Hussein. Boleh pula Hishamuddin terlibat dalam usaha macam ni?

SABOTAJ KERAJAAN NEGERI dan PAS?

Jelas, serbuan tanpa waran dan tanpa bukti serta dengan penglibatan pihak Polis (yang berada di bawa! h Hisham uddin Tun Hussein) adalah satu usaha sabotaj.

Sokongan HAsan Ali kepada usaha JAIS ini juga tidak mengejutkan lantaran Hasan Ali adalah pemimpin kepada GENG PERPADUANG di dalam PAS. Sikap pro UMNO Hasan Ali ini terserlah dan sudah menjadi maklumat umum.

Dari analisa Tulang Besi, serbuan JAIS ini adalah untuk mencipta isu yang akan menguntungkan UMNO. Tujuan utama adalah untuk memalukan PAS.

Jikalau PAS dilihat menyokong serbuan JAIS, maka PAS akan dilihat sebagai belot kepada pengundi bukan Islam. Maka, hasilnya Pakatan Rakyat akan lemah.

Jikalau PAS dilihat menentang serbuan JAIS, maka PAS akan dilabel sebagai menggadaikan prinsip serta menyokong murtad.

Maka, tindakan JAIS adalah selaras dengan program propaganda UMNO dan Barisan Nasional. Tidak lebih dari itu.

Jangan kita semua tertipu dengan tipu daya JAIS ini.

Who bankrupt Felda and Malaysia?



Dear Najib,

Salam. I read with great interest today papers about your comments. In it you were quoted that those
who talk bad about Felda & called it bankrupt are to be regarded as traitors to the Nation. The sad truth is that after you took charge of Felda in 2005, you turned what was a very successful organisation into a financial nightmare. In fact you are the traitor who has stolen the poor peneroka's money. I am sure you know that for the next General Election, Felda schemes & their votes determine about 60 Federal Parliament Seats. From my feedback, many of the peneroka are boiling mad. They have been exploited & taken for a ride. If what you say is true & ALL the peneroka are so happy with the UMNO/BN government, why the sudden interest in the welfare of the peneroka, Why the many cash handouts?

Please explain the following.
1. In 2001, the cash reserves of Felda was RM4.5 billion with ZERO borrowing. Recently your Deputy Minister replied that the cash reserves has plunged to RM1.2 billion. This is despite the fact that for the past 3 years, the CPO price has been very high. If you have looked after Felda properly the cash reseves should now be at least RM8 billion.

2.
New Felda HQ in KLCC.
Said to cost RM662 million, explain how this 6 star b! uilding is going to help the poor Peneroka, many of whom only get nett RM500 per month. Why a huge deposit of RM235 million is paid even before construction started? Why was the decision made at a secret meeting in your DPM's office in Putrajaya without the knowledge or approval of the Felda board? Recently Ahmad Maslan siad this is a very good Investment as it has already made paper profit of RM300 million. Pray how did he come to this conclusion when the building is not even finished or sold??

3. Felda Global Ventures.
We know that Felda has invested at least RM3 billion on these projects. We also know that since day one it has been losing money, in fact it has lost RM300 million. Twin Rivers Project in USA , invested RM500 million. Cattle rearing project invested RM600 million, since you say we are traitors, tell us in detail what has happened . The peneroka in Felda Keratong near Segamat are laughing at the imported cattle for the cattle project which have to be housed in air conditioned room 24 hours a day!

4. Why the need to borrow from EPF?
Before you started on Felda Global Ventures. Felda never borrowed from EPF. Is this borrowing secure? To all the EPF contributors beware, your money is used to finance many of these dubious schemes which Najib started

5. Skim Tabung tanam semula
In August this year I visited a Felda scheme near Kemaman and talked to a peneroka who wants to sue Felda. He has been contributing to this fund for past 17 years & has accumulated RM17,000. However when he replanted his old palm oil trees, he did not use the fund but used his own money instead. It has been 3 years now he tried to get his OWN money back, but the Felda administration has refused so far. Wonder why, if Felda is so well run & cash rich why can't e! ven pay this poor peneroka a paltry sum?

6. Felda settlers to camp outside Felda HQ.
In October this year, there was a report that many settlers were not happy with Felda for refusing to settle their replanting payments. So this case I quoted above is widespread & happening in many schemes round the country.

7. Oil palm fruit sent to Mill
In Felda Kemahang, Kelantan. Felda lost the case as it was proven that Felda was not paying the proper amount sent to mill. It was a landmark case. On appeal Felda lost the Case. Soon after that, you visited a scheme near Bahau. Instead of respecting the court's decision you made a silly remark like Felda will engage the best lawyers & fight all the remaining cases in court. Good for you, you will make mare peneroka angry with U!

Kenapa JAIS Tak Tangkap Najib?



BAru-baru ini, JAIS telah menyerbu sebuah dewan yang di dalam kawasan gereja. Katanya, ada majlis yang diadakan yang didalamnya dihadiri oleh orang-orang Islam juga.

Soalan saya, mengapa JAIS tak tangkap Najib Tun Razak. Najib telah menziarahi Pope di Gereja Utama Katolik di Vatican City. Malahan, di Vatican City itu, kuasa mutlak pemerintahn terletak di tangan Pope.

Maka, saya pun hairan juga mengapa JAIS tiba-tiba bersikap begini?

Adakah kerana JAIS masih dikawal oleh UMNO melalui juak2 mereka yang menduduki kayangan?

TUlang Besi juga tak terkejut Hasan Ali menyokong tindakan JAIS yang terbaru ini. Bagi Tulang Besi, Hasan Ali dan JAIS seolah-olah mahu mensabotaj PAS dan Pakatan Rakyat. Tindakan terbaru ini ke arah membina imej tidak toleran PAS.

Tindakan Hasan Ali mengeluarkan kenyataan juga amat dikesali kerana seharusnya beliau merujuk kepada pihak Perhubungan PAS Negeri Selangor terlebih dahulu.

Amat tidak patut dan tidak berdisiplin bagi HAsan Ali menyokong tindakan JAIS tanpa merujuk kepada pihak parti terlebih dahulu.

Setuju sangat dengan kenyataan Khalid Samad bahawa pendirian Hasan Ali itu bukan pendirian PAS dan pendirian parti. Ia cuma pendirian pribadi beliau sahaja.

Tak habis-habis Hasan Ali buat kerja untuk memburukkan PAS. Eloklah kiranya Hasan Ali ini isytihar masuk UMNO cepat-cepat.

KUALA LUMPUR, Aug 5 Shah Alam MP Khalid Samad has distanced the Selangor PAS leadership from state executive councillor Datuk Hasan Alis statement yesterday that insisted Christians were attempting to convert Muslims during a church dinner held on Wednesday night.

Khalid stressed that Hasans views were not Selangor PASs stance when contacted by The Malaysian Insider, revealing a deep and continuing rift between the Islamic partys liberal and more hardline factions in the state.

Christians cant even use the words Quran and pray? This is not PASs stand. It is his own as the exco in charge of religious affairs.

Muslims attending a church event is not proof of proselytising. Datuk Seri Najib Razak went to see the Pope in the Vatican. Was that proselytising? the deputy state chief said, referring to the prime ministers recent diplomatic visit.

Hasan defended Wednesdays late-night state Islamic enforcement raid on a church in Petaling Jaya, alleging that the words Quran and pray were used in the presence of 12 Muslims at the dinner function.

He claimed this was evidence that Christians were proselytising to Muslims.

The PAS Gombak Setia assemblyman said this just hours after Selangor Mentri Besar Tan Sri Khalid Ibrahim moved to calm the uproar over the raid, ordering the Selangor Islamic Religious Department (Jais) to justify their incursion on the multiracial dinner.

Damansara Utama Methodist Church senior pastor Daniel Ho has called for action to be taken against religious enforcement officers who denied over 100 dinner guests their constitutional right to freedom of assembly.

The pastor said the enforcement officers swooped in on the dinner based on an unspecified complaint, bringing along a police team but without any warrant for the operation.

But Khalid said that irrespective of any law, Jais should show respect and get a proper warrant, not act like th! e Gestap o (Nazi secret police).

The PAS central political bureau member has repeatedly clashed with Hasan since Pakatan Rakyat (PR) took over Selangor in March 2008.

Then-state chief Hasan removed Khalid as one of his three deputies in November 2008. But after this years PAS party elections in June saw a shift towards more liberal leaders, Hasan was himself removed and Khalid reinstated.

Despite rumours of an executive council reshuffle, Hasan remains in the state government and the clash over Wednesdays church raid looks set to divide Selangor PAS further.

Alasan kononnya Teresa Kok menghalang azan di Puchong dan Kota Damansara tidak berjaya meyakinkan parti-parti komponen Barisan Nasional kerana mereka tahu alasan tersebut adalah satu penipuan.

Malahan, laporan Kedutaan Amerika di Kuala Lumpur menyatakan parti MCA hampir-hampir mengisytiharkan keluar dari Barisan Nasional sekiranya mereka yang ditangkap ISA tersebut tidak dilepaskan.

Pihak kedutaan Amerika sangat yakin penahanan Teresa Kok dan lain2 adalah untuk menakutkan lebih kurang 30 MP BN yang telah bercadang untuk melompat dan menjatuhkan Barisan Nasional. Itulah sahaja sebabnya digunakan ISA ke atas Teresa Kok.

TIada kena mengena dengan tuduhan kononnya Teresa Kok menghalang azan dsbnya. Yang jelasnya, Najib dan UMNO telah berada dalam keadaan kesempitan kerana kerajaan mereka hampir jatuh pada masa itu.

Yang jelasnya ISA sudah semakin tidak popular. Hanya UMNO dan PERKASA sahaja yang menyokong ISA kerana tanpanya UMNO akan runtuh.

Mereka memerlukan ISA untuk memastikan wakil-wakil rakyat mereka tidak melompat dan wakil2 parti komponen BN tidak memberontak.

1. (S) Summary: The Malaysian government's use of the Internal Security Act (ISA), which allows for detention without trial and is central to the GOM's intelligence-driven CT effort, has come under increasing political pressure over the past three months.

The GOM's employment of the ISA in September to carry out three politically-motivated ISA detentions unrelated to terrorism sparked unprecedented public criticism. At least eight component parties from the governing National Front (BN) coalition have since broken ranks with the leading United Malays National Organization (UMNO) and called for amending or abolishing the ISA.

The opposition party alliance led by Anwar Ibrahim has made the revocation of ISA one of its highest profile policy goals.

In November, a High Court judge delivered a legal blow to the GOM's wide discretion in using the ISA in a ruling that freed blogger Raja Petra, and the GOM is appealing the decision. Prime Minister Abdullah, his deputy and successor Najib and H! ome Mini ster Syed Hamid have defended the ISA as essential to national security, while Najib told the Ambassador privately ISA should be retained but used more judiciously.

The GOM released 17 ISA detainees, among them 10 previously linked to terrorist groups, including Yazid Sufaat, from November 5 to December 4.

2. (S) Comment: The ISA is the cornerstone of Malaysia's CT effort and has allowed Special Branch to take successful preemptive action against suspected terrorists and their supporters. Given the GOM's exclusive reliance on the ISA "crutch" and on Special Branch's role, police and prosecutors remain ill-prepared to investigate and bring to trial terrorist suspects (or prosecute other complex criminal conspiracies).

The ISA also is subject to misuse for political ends and is an important insurance policy for maintaining UMNO in power. For both CT and political reasons, the GOM will not readily give up the ISA. We doubt that the increased political pressure and seeming swing in public opinion against the ISA, due in part to its misuse in September, will result in the ISA's amendment or revocation in the near future, absent the Opposition coming to power.

These developments, however, reinforce the conclusion (ref H) that Malaysia cannot take for granted the availability of the ISA as a CT tool in the long run. It remains in the U.S. interest to encourage and assist Malaysia to develop an approach centered on prosecutions and convictions before an independent judiciary to combat terrorism.

3. (C) Comment continued: It is unclear to what extent outside political pressures played a direct role in the GOM's latest release of ISA detainees. The decisions may have more to do with Syed Hamid's personal exercise of authority as Home Minister. Syed Hamid has taken a more proactive role as Home Minister, compared to PM Abdullah who held the position through March 2008 and tended not to become involved in details. End Summary and Comment.

4. (C) The Malaysian go! vernment 's use of the Internal Security Act (ISA), central to the GOM's intelligence-driven counterterrorism efforts, has come under increasing political pressure since the September ISA arrests of three persons based on political rather security considerations.

The September 12 ISA detentions of an ethnic Chinese journalist, an ethnic Chinese Opposition MP (Teresa Kok), and a prominent blogger (Raja Petra Kamarudin) served the ruling UMNO party's immediate political purpose of sending a warning to opposition politicians and those considering defecting from BN, as some UMNO politicians have told us. This came at a time when Anwar Ibrahim was publicly threatening to bring down the BN government via parliamentary crossovers by September 16.

The arrests, however, also sparked unprecedented public criticism of the ISA, including from UMNO's ethnic minority partners within BN. The Malaysian Chinese Association (MCA), the key ethnic Chinese BN component party, reportedly threatened to leave BN unless the GOM released the Chinese journalist; the GOM complied within less than 24 hours (ref F). Authorities freed MP Teresa Kok after seven days. Home Minister Syed Hamid ordered a two-year ISA detention period for Raja Petra, who was freed on appeal in November in a surprise court ruling (see below).

5. (C) Comment: Unlike his predecessor Mahathir, PM Abdullah refrained from using the ISA for political purposes until December 2007 when police detained five leaders of the ethnic Indian activist group HINDRAF that organized large street protests. The public viewed the GOM's September 2008 ISA arrests as more transparently political, in part because of the lack of public order concerns. End Comment.

6. (C) Political pressure against the ISA did not dissipate following the release of the first two of the three recent ISA detainees. At least eight component parties from the governing BN coalition of 14 parties have since broken ranks with UMNO and called for amending or reviewing the groun! ds for t he ISA, while several have supported the law's abolition.

In late September MCA, BN's second largest party, called for "a comprehensive review of the ISA so that it will apply strictly to cases relating to terrorism and subversive elements," and also argued for the introduction of "checks and balances in the use of ISA."

The leader of the Gerakan party, Koh Tsu Koon, called on the GOM to "abolish the ISA once and for all," and rely on the judicial system instead.

The leader of the Peoples Progressive Party (PPP) also initially called for ISA to be abolished, and on December 1 said PPP would withdraw from BN unless if the ISA were not amended before the next election.

In response, Prime Minister Abdullah called PPP's bluff and said the small party, which holds no seats in Parliament, could leave BN if it wished.

BN MPs so far have not backed up their criticism of ISA with action. In response to a petition circulated in Parliament for the review or repeal of ISA, only one BN MP signed his name.

7. (C) The opposition party alliance (Pakatan Rakyat, or Pakatan) led by Anwar Ibrahim has vocally condemned ISA as undemocratic and unjust, and made the abolishment of ISA one of its highest profile policy goals. A number of senior officials from Pakatan's three parties, Anwar's Peoples Justice Party (PKR), the Democratic Action Party (DAP), and the Islamic Party of Malaysia (PAS) were detained under ISA during the era of former Prime Minister Mahathir.

Not surprisingly, the three parties have vowed to revoke ISA if they come to power.

"Abolish ISA" was the most prominent theme at PKR's annual party conference on November 29, which Polcouns observed. The keynote event concluded with a focus on ISA and featured large screens that scrolled through the list of all 60-plus ISA detainees with the several thousand attendees reciting the detainees' names as they appeared.

Well-known blogger Raja Petra, released from ISA detention only days before, mo! unted th e stage as the surprise guest of the grand finale.

8. (SBU) On November 7, a High Court judge delivered an unanticipated legal blow to the GOM's wide discretion in using the ISA in a habeas corpus ruling that freed blogger Raja Petra.

The Embassy obtained the full text of the judge's 22-page ruling. ISA Section 8.B states "there shall be no judicial review in any court" of the Home Minister's exercise of "discretionary powers in accordance with this Act," except for compliance with procedural requirements.

The judge ruled, however, that the Home Minister decisions could not be "unfettered and arbitrary," allowing for the court to consider whether the Minister's ISA detention order was "in accordance with the Act," and its focus on threats to national security, including the national economy; threats to maintenance of essential services; and threats to the public emanating from a "substantial body of persons" who intend to change the government through unlawful means. In the case of Raja Petra, the judge concluded that the grounds for his detention did not fall within the purview of the ISA.

The government has appealed the ruling and as of mid-December the appeal remains pending.

9. (C) Many civil society groups took the opportunity over the past three months to highlight their standing opposition to the ISA, as well as other emergency ordinances that allow for detention without trial. Both conservative and liberal Muslim NGOs called on the GOM to abolish the ISA, as did the inter-faith Consultative Forum that groups the leaders of all major religions except Islam.

The National Human Rights Commission (SUHAKAM) chairman Abu Talib restated the commission's existing position, namely "detention without trial is against human rights principles; that's why we advised the Government years ago to repeal the ISA."

10. (C) As questions over the ISA have mounted, Prime Minister Abdullah, his deputy and successor Najib, and other senior UMNO leaders defended t! he ISA a s essential to national security. In the wake of public criticism over the September ISA arrests, Home Minister Syed Hamid, who has authority under the ISA to approve detention orders, defended the Act as essential and stated clearly that "we have no plans to do away with ISA."

In early December, Syed Hamid waved off criticisms, arguing that the ISA "has never been abused or used for politics." He also commented that, "Malaysians sometimes don't know how lucky we are in that we have not experienced what is happening in Mumbai (the terrorist attack) and Bangkok (political unrest) now."

He said the fact that there have been no post 9/11 terrors attacks in Malaysia was in part due to the ISA. On December 15, Syed Hamid again publicly defended use of the ISA, stating, "More apt, faster and better to use the ISA... detention under the act is early action to prevent the security of the country from being adversely affected."

11. (C) DPM Najib, who is anticipated to become Prime Minister in late March 2009, told the Ambassador privately on November 11 that the government continued to need the ISA, "even though there are civil liberty concerns," but should reserve ISA only for those who pose "serious threats, like terrorists" (ref A). On December 8, PM Abdullah publicly rejected calls for amendments to the ISA.

12. (SBU) In early December, local and international press reported that the GOM had released 17 ISA detainees from November 5 through December 4. Of those released, 10 had been held for suspected links to Al Qaeda, Jemaah Islamiyah, and/or the Darul Islam terrorist groups.

The released terrorist suspects included Yazid Sufaat, who played an important role in Al Qaeda's anthrax development program, according to the 9/11 Commission. The remaining seven persons released consisted of suspected foreign agents (2 persons), southern Thailand separatists (2), document forgers (2), and prominent blogger Raja Petra, according to an NGO that consistently and accurately ! monitors ISA detentions.

In his public remarks, Syed Hamid said those recently released ISA detainees had been rehabilitated and no longer posed a security threat to Malaysia.

13. (S) Note: Authorities had detained the terrorist suspects for periods between two and (in the case of Yazid Sufaat) seven years, for an average detention period of four years for the ten individuals. Special Branch relies on a process for rehabilitating ISA detainees, and eventually releasing them under restricted and monitored conditions when judged necessary.

The GOM has never attempted to prosecute any terrorist suspects, including those held under the ISA. This is due in large part to the fact that the GOM pursues almost exclusively an intelligence approach to CT, as opposed to a law enforcement approach that would involve criminal investigations, collection of legally admissible evidence, and development of cases for prosecution in the courts.

In 2007, Malaysia amended anti-terrorism provisions in its penal code and criminal procedures code, but authorities have not yet utilized these provisions. Malaysia also has a poor track record of prosecuting other complex criminal conspiracies, including drug trafficking cases, preferring instead to utilize the ISA and other emergency ordinances to detain suspects without trial. 14. (S) A well-known journalist contacted us in early December and said that officers of the Police Special Branch had complained to him that Home Minister Syed Hamid had ordered the recent releases of terrorist suspects without adequate consultation and in some cases against the recommendation of Special Branch.

Australian and British diplomats, speaking with Polcouns December 16, stated that Syed Hamid, who is a lawyer by training, personally reviewed the dossiers of ISA detainees and was inclined to approve releases absent compelling justification from the Special Branch.

15. (C) The Thai embassy contacted Poloff on December 15 to express concer! n over t he release of two ISA detainees (Abdul Rahman bin Ahmad and Mat Tarmizi bin Shamsudin, who apparently are dual-citizens of Malaysia and Thailand) who had been held for their connection to the insurgency in southern Thailand.

The Thai diplomat said Bangkok considered Abdul Rahman in particular to be a major player in the insurgency. He noted that those released are required to remain in Malaysia and check in periodically with the police.

The Thai diplomat said he believed the GOM released the detainees in order to diffuse criticism of the ISA. We learned that the Thai embassy also has contacted other Western embassies (UK, France, Australia) to express concern over the recent ISA releases.

The US markets plunge more than 512.76 points or down 4.31%, Oil is down 6%, Gold fell by about 1%, Silver plunge by over 7%. The european markets all closed with heavy sell off by more than 3.00%.

Expect greater Turmoil when the Asian Markets open later.

Anonymous to attack 1Malaysia computers Oct 24

Warning of Red October attacks

The hacker collective Anonymous has issued a video warning that they will mount an attack on Oct 24 to bring down the Internet computer servers of Malaysian law enforcement agencies and others who support the 1Malaysia campaign of the Malaysian government.

Anonymous pinpointed the prime minister, Najib Tun Razak, as the prime target of the attack. Action against Malaysia would be conducted as long as the Murderer remains Prime Minister said the hacking group. This video is your only warning.

The video shows scenes of police in action at the Bersih rally last month, and makes reference to the deaths in custody of A Kugan and Teoh Beng Hock, and the murder of Altantuya Shaariibuu.

In June several Malaysia government web servers were hacked, for which Anonymous was blamed. The attacks caused little damage.
