Bersih open to biometric plan, but not convinced

EC says biometric voter system will eliminate multiple voting - but Ambiga has reservations.
Following the July 9 Bersih 2.0 rally, the embattled Election Commission (EC) proposed to introduce a biometric voter verification system in order to eliminate multiple voting and 'phantom voters' - but electoral reform group chief Ambiga Sreenevasan has her reservations.

NONEThe top concern, Ambiga (left) said at a forum with EC deputy chairperson Wan Ahmad Wan Omar in Shah Alam today, was whether the National Registration Department (NRD)'s datebase, on which the biometric system will be entirely dependent on, was of the highest integrity and tamper-proof.

"I'm very concerned that if the biometric system is linked to the NRD, because NRD can't even determine whether a person has died or not. I have a problem here," she said.

Wan Ahmad conceded while dead people were still on the electoral roll, which has been updated since 1959, it was because family members of the deceased failed to inform the NRD, and EC had no power to remove any name in the electoral roll without verification from the NRD.

'We want to know more'

"Every bit of it has to be transparent. The public will not trust it unless you do that," said Ambiga, adding that transparency was needed in every aspect of the new system, from open tender to the implementation.

"We are open minded, but we want to know more," she said.

NONEThe former Bar Council chairperson doubted that the new system could be implemented before the next general election because trial runs needed to be carried out before it was adopted nationwide.

She assumed that the biometric verification device would have to be i! nstalled in every room in every polling station, and this would involve a huge amount of technology, which could also be exposed to breakdowns and malfunction.

The two-and-half-hour forum, titled "What's next after July 9", was organised by Kumpulan Karangkraf, a media organisation that publishes the Malay language daily Sinar Harian and a score of popular magazines.

Nevertheless, Wan Ahmad defended the new system, describing it as "the best way to clean up the electoral roll" because it is impossible for more than one voter to have the same fingerprint.

He called on the people not to make assumptions before more information on the new system, which was now in its final stage of study, was announced.

We will not implement if we are not confident... don't reject it before you look into it, don't make assumptions," Wan Ahmad (right) told the roughly 600-strong audience that kept booing and heckling him throughout the forum.

To a question from the floor on whether the system needed an independent audit body to protect its credibility, he gave his assurance that the EC would do this.

The EC number two also defended the NRD system, putting the blame on those who did not not inform the department about the deaths of their family members, resulting in dead people remaining on the electoral roll.

"That's why we need to trust the NRD... if the families of the deceased do not inform NRD, how is the NRD going to update (their status)?"

The EC, Wan Ahmad stressed, could only operate within the current law, which made it compulsory for it to obtain verification from the NRD before a name could be erased from the electoral roll.

On Ambiga's argument that indelible ink is the cheapest and an effective way to eli! minate m ultiple voting, Wan Ahmad commented that the method is only used in countries with huge populations which lack a national registration system such as India, Indonesia and Bangladesh.

"But we only have 12 million voters and an advanced registration system," he argued.


Biometrik untuk pastikan BN menang PRU 13...

Pemuda PAS Malaysia menolak penggunaan sistem biometrik kerana masih boleh dimanipulasi untuk mempastikan kemenangan Umno BN dalam Pilihan Raya Umum ke-13 nanti.

Jabatan Pilihan raya Dewan Pemuda PAS Malaysia berpendirian tegas menolak penggunaan sistem biometrik ini yang pastinya masih boleh dimanipulasi oleh pihak-pihak yang tidak bertanggungjawab untuk mempastikan kemenangan Umno BN, kata Pengarah Jabatan Pilihan raya Dewan Pemuda PAS Malaysia, Mohd Sany Hamzan.

Ia juga, katanya akan membabitkan kos penyelenggaraan yang tinggi yang membabitkan duit rakyat berbanding penggunaan dakwat kekal yang lebih murah, mudah dan selamat.

Justeru, Pemuda PAS menolak kenyataan Pengerusi SPR, Tan Sri Abdul Aziz Mohd Yusof yang menyatakan bahawa pihak SPR akan memperkenalkan sistem biometrik untuk memantapkan lagi tahap keselamatan dalam proses pilihan raya di negara ini.

Abdul Aziz menyebut di dalam satu sidang media di Kuching bahawa perlaksanaan sistem itu diharap dapat mengatasi isu pengundi hantu yang sering dibangkitkan pihak pembangkang setiap kali menjelang musim pilihan raya umum atau kecil.

Keputusan itu diambil apabila pihak kerajaan bersetuju untuk memberikan sejumlah peruntukan kepada SPR untuk menggunakan sistem biometrik.

Jabatan Pilihan raya Dewan Pemuda PAS Malaysia juga bersetuju dengan pandangan Dr Dzulkefly Ahmad, Ahli Parlimen Kuala Selangor yang menyebut bahawa sistem biometrik ini tidak akan dapat menyelesaikan masalah isu pertindanan pemilih di dalam daftar pemilih, pemilih yang dipindah keluar dan masuk tanpa pengetahuan mereka, isu pengundi yang melebihi usia 100 tahun, isu lebih dari seorang pengundi di alamat yang sama, isu pengundian pos, isu tentera dan polis yang tel! ah bersa ra tetap mengundi sebagai pengundi pos dan lain-lain isu yang telah menyebabkan sistem pilihan raya di Malaysia ini nampak tempang.

Mohd Sany menambah, seperti mana pendedahan Badan Perhubungan PAS Negeri Selangor baru-baru ini dalam pertemuan dengan pihak SPR di Putrajaya, mereka telah menunjukkan sebahagian pembuktian pertindanan nama-nama pemilih di dalam daftar pemilih induk mengikut corak pengenalan diri (tarikh lahir/no kad pengenalan lama) dan corak nama hasil daripada gerak kerja mencari dan mengenal pasti pemilih-pemilih yang diragui yang telah dilaksanakan secara berterusan di seluruh kawasan.

Sehubungan itu, kata beliau pihaknya berharap semoga pihak SPR tidak meneruskan agenda mereka untuk menggunakan sistem biometrik ini yang belum pernah teruji keberkesanannya untuk memastikan sistem pilihan raya dapat dilaksanakan secara adil dan telus.

Beliau menambah, SPR tidak perlu berasa malu untuk menggunakan kaedah dakwat kekal seperti yang digunakan di Indonesia atau India tetapi hasilnya cukup memberangsangkan, tiada penipuan, tiada rusuhan dan sebagainya berbanding sistem biometrik yang tidak terjamin lagi ketelusannya.

Katanya lagi, Bersih 2.0 telah menunjukkan bahawa rakyat Malaysia kini telah bangkit untuk menolak sebarang penyelewengan dan penipuan, mereka juga memerhatikan dengan penuh minat bagaimana pihak SPR ingin mengendalikan pilihan raya umum ke 13 secara telus dan adil.

Adakah SPR akan menjadi pihak yang mempunyai integriti dalam melaksanakan tanggungjawabnya secara beramanah ataupun berterusan menjadi salah satu daripada parti komponen Barisan Nasional yang akan mengusahakan pelbagai kaedah dan cara yang akan mempastikan kemenangan Umno BN di dalam pilihan raya yang akan datang? soalnya.

PAS: Daftar pemilih SPR ada senarai senarai 'klon'

Naib presidennya Datuk Husam Musa berkata pendedahan akan dibuat secara berperingkat selepas penyerahan senarai 500 orang pertama kepada SPR.

PAS mendakwa daftar pemilih Suruhanjaya Pilihan Raya mempunyai senarai 'klon' dan ini melibatkan angka yang besar dan mengejutkan.

NONENaib presidennya Datuk Husam Musa berkata pendedahan akan dibuat secara berperingkat selepas penyerahan senarai 500 orang pertama kepada SPR baru-baru ini.

"Kita akan buat (seperti) persidangan. Kita pamer pada semua orang dan media boleh semak," katanya.

Diminta menjelaskan anggaran jumlah terbabit, Husam bagaimanapun enggan berbuat demikian buat masa ini.

Bagaimanapun, katanya pada sidang media selepas mesyuarat bulanan PAS selepas ini, pihak media akan dibekalkan dengan senarai berkenaan.

Sehubungan itu, Husam sekali lagi menegaskan bahawa PAS tetap menolak sistem biometrik yang mahu diperkenalkan kerajaan.

"Setakat biometrik, tekan (jari pada sistem), timbul (maklumat). Tekan di Bangi, timbul; tekan di Gombak, timbul. Itu saja," katanya sambil menegaskan sistem itu tidak mampu menangani pengundian bertindih.

"Kenapa hendak habiskan wang yang besar dan tidak gunakan dakwat kekal?"soalnya.


Clone voters: EC confessed so police must act

The discovery of several news cases of clone voters has compelled PAS to lodge a police report.

The police must investigate allegations of clone voters now that the Election Commission (EC) has confessed to its existence in the electoral rolls.

PAS Youth secretary Khairul Faizi Ahmad Kamil said the discovery of several new cases of clone voters is irrefutable proof that phantom voters existed on the ECs voter lists.

Khairul, who lodged a report at the Dang Wangi police headquarters today, said that since the EC itself had admitted to the existence of clones, the police must take immediate action.

This is serious. These cases seem to show that anyone in Malaysia can get two ICs and two different people can have a same IC number.

Malaysias democracy is now under threat because voting itself is being questioned, he said.

Khairuls report was a follow-through to the partys expose last week.

PAS Youths democratic rehabilitation and mobilisation committee chairperson Suhaizan Kaiat last week revealed that one of the main players in these clone voters cases was the National Registration Department (NRD).

Two big offences have been made by NRD and EC. One is that the NRD has issued old ICs to two identities.

Secondly, EC has allowed a voter the right to vote more than once, said Suhaizan, who is also Johor PAS Youth chief.

Suhaizan had previously revealed the existence of double registration of voters on the electoral rolls.

Double deals

The first case involved one Mariam Su, who was r! egistere d with two new registered identity cards (NRIC) 720616025472 and 720610025738.

This was despite her having only one old IC with the number A2278510.

A second case involved one S Murugan, who was registered with the same birth date, gender but was registered as a voter in both state and parliamentary constituencies.

Murugan had two NRICs that are nearly identical save for the last four digits.

Murugan, whose old IC number was A2909056, is currently registered under two NRICs, 731002025877 and 731002025201.

Today, Suhaizan also provided another two examples of double registration in the electoral roll.

He said two voters with different names are Low Kim Lian and Tom binti Din. Both were registered under the same old IC 1790975.

Both are voting in the same state and parliamentary constituency.

Another case is of one Baharom Abd Rahman. He has the same birth date, gender but is registered in a different voting locality.

He is registered under 550331025859/4774090 and RF65018 (believed to be identity for postal vote).

All these are proof of mistakes, and there are many more. How could there be such problems that NRD and EC did not verify in the first place?

Theres something wrong with their SOP (standard operating procedure), Suhaizan said.

EC U-turn

Suhaizan noted that despite proof of overlapping data in the electoral rolls, the EC has no right to strike out the compromised list unless someone goes through a lengthy court process.

He said this was because under Section 14 of the Election (Conduct of Elections) Regulations 1981, the electoral roll serves as evidence to determine whether a person is entitled to vote.

Suhaizan also said that EC is making a mistake in saying that it is confident in its election process.

The EC does not understand the problem: the biometric system can only be used when you have a complete and authentic electoral roll.

At this point in time and unti! l we hav e solved problems with the integrity of the electoral roll, this system is not suitable for Malaysia, he said.

On Sunday, The Star quoted EC deputy Wan Ahmad Wan Omar as saying that the EC needs the help of political parties and individuals to purge clones from the electoral rolls.

He admitted that there were clones, saying that the EC had never denied the existence of clones.

Wan Ahmads statement has been termed a U-turn by PAS, as the EC had previously denied the existence of phantom voters.

The rakyat is angry with all politicians, not just BN or the opposition.

We have had 54 years of Umno/BN rule and have things really got any better? The rich appear to get richer, whilst the numbers who make up the poor, are increasing.
The old class system was royalty versus the serfs. Then it was the colonialists against the Malayans. Now it looks like it is the Umnoputras versus the rest.
The Umnoputras are the new elite. Even royalty depends on the largesse of those who lead Umno/BN to get funding from the civil list.
When it suits them, BN will use emotional blackmail on the Malays to say that their heartland and their birthright is being threatened.
The British left us with a country that had enormous potential. Malaya had an abundance of wealth, from tin to timber, minerals to mining.
Singapore was only a trading port for all of Malaya's riches. Look at Singapore now.
Malaya was rich in natural resources and it was these riches that helped fund the British war effort in the First World War. However, one untapped resource then as it is now, are its people - the Malaysians - Orang Asli, Malays, Chinese, Indians, the East Malaysians, Eurasians and all the rest.
Over the years, all these people contributed towards the success that we now see in the country. It is not BN or Umno or the Opposition who are responsible. It is the hard work and fortitude of those Malaysians who love their country.
NONEHowever, the Umnoputras are the new royalty and they are siphoning away riches that should be shared with the rest of the rakyat. They take but they never give. They forget that all Malaysians deserve the same considerations and protections as other individuals working in the country.
Prime minister Najib Abdul Razak (right) was not elected to the post. He leads the country by default. He has shown very little ability to govern or to engage with the rakyat.
He only pays lip service to his speech to delegates of the 65th United Nations General Assembly; he said that extremists should not be allowed. At home, Malay extremists were permitted to express their insensitive racist and religious views without being punished.

Tighten belts

His administration tells us to tighten our belts but it appears he does not have to heed his own advice. He freely uses taxpayers' money on his personal comfort. How does he have the gall to spend RM63 million on renovations on Seri Perdana when some people do not have a decent roof over their heads?
Taxpayers' money is also used to fund his expenses abroad. One trip to the US was combined with his daughter's graduation ceremony. Another trip to Kazakhstan with a large entourage of officials coincided with his daughter's engagement ceremony. Quite a few regarded it as morally wrong.

Perhaps Najib is not at all bothered about emptying the public purse. In comparison, if we owed a government department one ringgit, we would be hounded like criminals.
Najib and his administration are devoid of morality. ! He need not go on about the opposition and their spending when people who have been found practising money politics to head government institutions.
How can he claim that other Muslim nations should follow Malaysia's lead, because Malaysia's system of governance is based on moderate Islam and has worked?
What about corruption, the abuse of power, the use of racial or religious sentiments to divide the public and the lack of credibility of the country's institutions?
Why can Najib not make decisions which will lead to monumental improvements in democracy in Malaysia?
Instead he wants to build monuments to his vanity like the proposed 100-storey Warisan Merdeka. These are mere phallic symbols for Umno/BN.

Intolerance increasing

In Najib's Malaysia, levels of aggression and intolerance by some Malays towards non-Malays or non-Muslims have increased. Malays who make racial and religious slurs go unchecked, despite Najib's promises to eradicate extremism.
Bersih, which called for free and fair elections, has been outlawed by Najib. Is he not interested in clean elections? Does he not wish to prove that Umno has won every election by fair means? Why is he afraid of free and fair elections?
Why is he afraid of allowing international observers to oversee the elections? Surely, international observers would scotch all of the opposition's claims that Umno tampers with the election results.
On the other hand, the recent deportation of French lawyer, William Bourdon, can only mean one thing. There is something to hide.

If all is above board the parties involved would surely want to clear their name. Or even prove that the Scorpene scandal has nothing to do with them.
The shame is that other Umno/BN members are aware of the truth and that Najib is an incapable leader. However, these people are not willing to help the country because they only want to save themselves. Perhaps, they are themselves implicated or maybe they fear for their own safety.
But we, the rakyat, are telling Najib that it is time he went.
If he is still unconvinced that he is not the man for the job (of leading the country), he should have known by now, that being PM is a poisoned chalice.

Malaysian graduates struggle to get good jobs, says Straits Times

Although overall Malaysian unemployment has shrunk, the number of jobless university graduates continues to rise due to low pay and keen competition for vacancies, the Singapore Straits Times reported today.According to government statistics, 71,000 people with diplomas or degrees remain on the job hunt, almost 20 per cent of total unemployed labour of 388,000.The Straits Times found the governments JobsMalaysia portals listed vacancies to be mostly in manufacturing, agriculture and construction sectors, showing that graduate-level jobs are few and far between.

Deputy Minister of Human Resources Datuk Maznah Mazlanrecently told Parliament 2,700 people have been placed in state agencies, and given training to be become entrepreneurs.

But the Straist Times wrote that it appears that the predicament many graduates find themselves in could stem from their own expectations.

The report cited a recent survey by top online recruitment firm Jobstreet.com, which found that most employers said that fresh graduates had unrealistic expectations of salaries.

This concurs with a 2008 government study which said jobless graduates were overlyfocused on pay and perks and rejected jobs they considered dirty, difficult or dangerous.

While previous surveys named poor English as the main cause of unemployment, bad attitude has now topped the list, Straits Time quoted chief operating officer Suresh Thiru as saying.

However, the Straits Times found that jobseekers said there were just not enough jobs and salaries for those living in Kuala Lumpur were too low to cope with the cost of living.

The London-based Economist Intelligence Unit said in a recent study that the cost of living in Kuala Lumpur has risen by nearly 25 per cent over the last two years, making it the 86th most expensive city in the world.

Others point to rising competition among their peers. Malaysia now has 20publicand 26 private universities, which send more than 180,000 graduates into the wo! rkforce each year. That is not counting the 120,000 also emerging from some 1,000 skills training institutes, the Straits Times wrote.

Terlebih dahulu, pohon kemaafan jika warkah ini terbuka. Saya harap ia dapat dibaca oleh semua. Jika ada kebaikan, ambillah darinya. Jika tidak, campaklah ia ke tepi dan lupakan sahaja. Ia hanya satu coretan dari seorang rakyat bawahan. Tanda cinta dan kasih kepada saudara yang saya lihat tercegat di segala penjuru negara atas tanggungjawab menjaga keamanan kita semua. Mata memandang, hati merintih dan berdoa agar tugasan saudara benar-benar diberikan pahala di sisi Tuhan dan diiktiraf di sisi rakyat.


Tugas Mulia

Saudaraku anggota polis,

Kerja polis adalah satu kerja yang mulia kerana menjaga keamanan dalam negara. Penat lelah anggota polis dalam memastikan negara kita aman dan adil adalah pahala yang amat besar di sisi Allah jika pengamalnya jujur dan ikhlas. Sepatutnya, tiada seorang pun rakyat yang cintakan keadilan dan keamanan akan membenci polis. Sebaliknya, perasaan fitrah; sayang dan menghargai akan tertanam dan mekar sebaik sahaja mendengar nama polis, melihat anggota atau apa sahaja perlambangan polis. Itulah perkara sewajarnya berlaku.

Saudaraku anggota polis,

Tugas seorang anggota polis -sebelum tugasan kenegaraan- sebenarnya adalah tugasan yang diperintahkan oleh Allah dan RasulNya iaitu Menyuruh Kebaikan, Mencegah Kemungkaran. Itu moto asal pasukan polis. Sekalipun, tumpuan terbanyaknya kepada bahagian kedua iaitu Mencegah Kemungkaran. Hakikatnya, polis berperanan menyelamatkan masyarakat dari kemur! kaan All ah dengan dipastikan setiap penzalim akan dihalang, dicegah dan dihukum. Jika itu tidak berlaku, masyarakat akan porak peranda dan menerima hukuman dari Allah. Allah berfirman: (maksudnya):

Telah dilaknat mereka yang kufur daripada Bani Israil melalui lidah Daud dan Isa bin Maryam. Yang demikian itu disebabkan mereka menderhaka dan selalu menceroboh. Mereka sentiasa tidak berlarang (sesama sendiri) perbuatan mungkar yang mereka kerjakan. Demi sesungguhnya amatlah buruknya apa yang mereka telah lakukan. (Surah al-Maidah, ayat 78-79).

Nabi s.a.w pula bersabda:

Sesungguhnya manusia apabila melihat orang zalim, namun tidak menghalang tangannya, hampir Allah akan meliputi mereka dengan hukumanNya (Riwayat Abu Daud, al-Tirmizi dan al-Nasai dengan sanad yang sahih).

Kami sebagai rakyat mengucapkan jutaan terima kasih kepada pihak polis yang telah menyelamatkan masyarakat dari kemurkaan Allah, kezaliman dan kerosakan.

Bahaya Kuasa

Saudaraku anggota polis,

Namun, dalam masa yang sama, bidang tugas dan kuasa saudara yang menghalang kezaliman itu jika disalahgunakan boleh memberikan kesan yang sebaliknya. Ia boleh bertukar dari melindungi yang tidak bersalah kepada menginayainya, menghalang yang zalim kepada memberi peluang kepadanya, memberi hak kepada yang berhak kepada merampas hak dari tuannya. Jika itu berlaku, rosaklah masyarakat, hilanglah neraca keadilan, bermegah si zalim, kesakitanlah yang ditindas. Lantas, kebencian akan merebak, kepercayaan akan hilang dan saudaraku polis yang sepatutnya disayangi menjadi pihak dimusuhi, dibenci dan diragui.

Saudaraku anggota polis,

Ingin saya sebut di sini suatu tazkirah yang harapnya boleh memberikan manfaat kepada semua, khususnya mereka yang berkuasa seperti saudara. Saudaraku, kezaliman itu adalah suatu racun. Ia bukan sahaja menyakitkan yang dizalimi, tetapi suatu hari akan membawa sengsara, bahkan mengorbankan si zalim itu sendiri. Pada hari ki! ta memuk ul orang yang tidak bersalah, melukai atau menfitnahnya, kita mungkin rasa selamat di balik peruntukan kuasa yang ada. Mungkin juga rasa selamat di balik pakaian lengkap kita yang mungkin gagal mangsa mengenali pelakunya.

Namun Tuhan tidak lupa. Akan ada harinya yang menanti kita di hadapan. Tangan yang memukul orang lain dan kaki yang menendang mangsa itu tidak akan terpadam catatannya sehingga kemaafan diberikan. Ketika saudara pulang ke rumah berjumpa keluarga, si mangsa mendongak ke langit mengadu kepada Tuhan Yang Maha Berkuasa. Dengarlah baik-baik apa yang yang disabdakan Nabi s.a.w:

Takutlah kamu doa orang yang dizalimi, sesungguh antaranya dengan Allah tiada sebarang hijab (penghalang) (Riwayat al-Bukhari dan Muslim).

Dalam riwayat Ahmad, baginda bersabda:

Takutlah kamu doa orang yang dizalimi, sekalipun dia seorang yang jahat. Kejahatannya itu bagi dirinya (hadis ini dinilai hasan oleh al-Albani).

Dalam riwayat Ahmad yang lain:

Takutlah kamu doa orang yang dizalimi, sekalipun dia seorang yang kafir kerana ia tidak ada hijab (penghalang untuk Allah menerimanya). (hadis ini dinilai hasan oleh al-Albani).

Allah Tidak Lupa

Saudaraku anggota polis,

Tiada siapa antara kita yang dapat menyelamatkan dirinya dari hukuman Tuhan. Seseorang mungkin telah melupai orang yang dizaliminya, atau si mangsa juga mungkin terlupa, atau pergi menemui Ilahi terlebih dahulu. Namun doanya tetap hidup. Akan ada waktu, ia tetap datang bertandang dalam kehidupan si zalim; meragut kebahagiaannya, ketenteraman hidupnya dan mencampakkan derita dalam pelbagai warna dan rupa. Dunia Sementara

Saudaraku anggota polis,

Dunia ini sementara. Setiap kita akan ada hari akhirnya. Akan berakhirlah s! ebuah ke hidupan dan bermulalah mahkamah keadilan Tuhan. Tiada kuasa yang dapat membela, tiada pembesar yang dapat berkata. Semua tunduk menunggu balasan. Firman Allah (maksudnya):

Dan janganlah kamu menyangka bahawa Allah lalai akan apa yang dilakukan oleh orang-orang yang zalim; sesungguhnya Dia hanya melambatkan balasan mereka hingga ke suatu hari yang ketika itu terbeliak kaku pemandangan mereka, (kerana gerun gementar), mereka terburu-buru (menyahut panggilan) sambil mendongakkan kepala mereka dengan mata yang tidak berkelip, dan hati mereka yang kosong (kerana bingung dan cemas). (Surah Ibrahim 42-43).

Sekali lagi pada hari itu si zalim akan bertemu dengan semua mereka yang telah dimangsakan, di hadapan mahkamah yang Maha Adil. Tiada bukti yang dapat disembunyikan, diputarbelit dan ditipu kepada masyarakat manusia yang berkumpul ketika itu. Tiada media yang boleh diperguna dan tiada kuasa kerajaan yang boleh melindunginya. Adil seadil-adilnya. Bak kata Nabi s.a.w:

Segala hak akan dibayar kepada empunya pada Hari Kiamat, sehinggakan akan dibalas untuk biri-biri yang bertanduk atas perbuatannya ke atas biri-biri yang tidak bertanduk (Riwayat Muslim).

Sabda baginda juga :

Sesiapa yang ada padanya kezaliman terhadap saudaranya (muslim yang lain); seperti terhadap maruah dan selainnya, mintalah halal pada hari ini sebelum tiba waktu yang tiada dinar dan dirham (tiada harta iaitu pada Hari Kiamat). Sekiranya baginya kebaikan (amalan soleh) maka akan diambil darinya dengan kadar kezalimannya. Jika tiada baginya kebaikan, maka akan diambil dosa orang yang dizalimi lalu ditanggung ke atasnya (Riwayat al-Bukhari).

Nasihati Hasan al-Basri

Saya tahu, kadang-kala ada keadaan yang sukar sebagai anggota polis yang terpaks! a melaks anakan arahan atasan. Maka, mungkin ada yang berkata kami hanya menjalankan tugas. Sudilah saudara mendengar nasihat tokoh Islam yang agung al-Imam Hasan al-Basri r.a. kepada Gabenor Iraq dan Khurasan iaitu Umar bin Hubairah. Ketika itu zaman pemerintahan Khalifah Yazid bin Abdul Malik. Kata Umar bin Hubairah:

Sesungguhnya khalifah Yazid bin Abdul Malik kadang-kala menyuruhku melaksanakan perkara yang aku rasa tidak puas hati dari segi keadilan. Apakah jika aku melaksanakannya menjadi sutu kesalahan di sisi agama? Kata Hasan al-Basri: Wahai Umar bin Hubairah! Takutlah Allah mengenai Yazid, jangan engkau takutkan Yazid mengenai Allah. Ketahuilah sesungguhnya Allah azza wajalla dapat menghalang Yazid daripada bertindak ke atasmu, tetapi Yazid tidak dapat menghalang Allah daripada bertindak ke atasmu.

Wahai Umar bin Hubairah! Sesungguhnya akan turun kepadamu malaikat yang bengis dan keras, dia tidak akan menderhakai apa yang Allah perintahkannya. Dia akan mengambil engkau dari tempat dudukmu ini, dan memindahkan engkau dari istanamu yang luas, ke kubur yang sempit. Di sana tiada Yazid, hanya yang ada amalanmu yang menyanggahi Tuhan Yazid.

Wahai Umar bin Hubairah! Sekiranya engkau bersama Allah dan ketaatan kepadaNya, ia boleh menghalangmu dari kejahatan Yazid di dunia dan akhirat. Jika engkau bersama Yazid dengan menderhakai Allah, sesungguhnya Allah akan menyerahkanmu kepada Yazid. Ketahuilah wahai Umar bin bin Hubairah! Kita boleh bertugas kepada sesiapa pun, tetapi jangan lupa tanggungjawab kita di hadapan Allah. Tiada cacatnya menjadi anggota polis. Saudara bukan musuh rakyat. Sebaliknya, saudara diperlukan rakyat. Apa yang cacat dan menimbulkan kebencian awam adalah tindakan kita sendiri jika menyalahi prinsip-prinsip keadilan dan keamanan. Jika itu tidak b! erlaku, sayang dan cinta rakyat tertumpah kepada saudara.

Ingatlah kata-kata Abu Bakar al-Siddiq: Benar adalah amanah, bohong adalah khianat. Jika saudara benar, rakyat sayang, Allah juga sayang. Kedamaian jiwa pun menjelang. Jika saudara bohong rakyat benci, Allah juga benci. Rezeki tidak halal, hidup tidak bahagia.

Inilah pandangan seorang rakyat marhaen awam seperti saya. Tiada kebencian antara rakyat dan saudara jika keadilan itu tertegak. Rakyat awam bukan sahaja mahukan keadilan yang ditafsirkan oleh pihak saudara, tetapi keadilan yang dapat difahami oleh semua. Bukan sahaja adil dari segi bicaranya, tetapi hendaklah kelihatannya juga adil. Semoga Allah merahmati saudara dan tugas saudara. Diberikan rezeki yang halal. Bebas dari kezaliman dan rasuah. Anwar applies to quiz Najib, Rosmah...

Anwar Ibrahim has filed an application to interview Prime Minister Najib Abdul Razak and his wife Rosmah Mansor before he takes his stand in his ongoing sodomy trial on August 8.

In the application filed this morning via Messrs Karpal Singh & Co, state news agency Bernama said Anwar named Najib, Rosmah and three others. The three others are Hasanuddin Abd Hamid, the owner of the condominium unit where the incident allegedly occurred, former inspector-general of police Musa Hassan and ex-Melaka police chief Mohd Rodwan Mohd Yusof.

Anwar stated that under the law, the onus is on the prosecution to facilitate witness interviews by the defence and that the costs will be paid by the prosecution.

In a supporting affidavit, Anwar said that his counsel SN Nair had received a letter from the Brickfields Criminal Investigation Department, dated July 18, stating that Mohd Rodwan, Najib, Rosmah and Musa had declined to be interviewed but agreed to be defence witnesses on condition that a subpoena is issued against them.

Hasanuddin had also declined to be interviewed unless it is done with the presence of his counsel, Anwar said in the affidavit.

According to Bernama, Anwar also added that if all the witnesses failed to turn up to be interviewed by his counsels, that would mean he would be denied of his right to a fair trial.

Out of the 25 people the defence plans to interview, only five have been interviewed so far.

They are Rosmah's close associate Mumtaz Jaafar, Dr Mohd Osman Abd Hamid formerly from the Pusrawi medical centre in Kuala Lumpur, Mohd Saiful Bukhari Azlan's youngest sister Saidaiti Azlan, a doctor from the Kuala Lumpur Hospital kno! wn as Dr Daniel and Khairil Anaz Yusof, a special assistant to Najib when he was the deputy prime minister.
On July 13, trial judge Mohamad Zabidin Mohd Diah set Aug 8-26 to hear the defence case.

On May 16, Justice Mohamad Zabidin ordered Anwar to enter his defence after ruling that Anwar's former aide Mohd Saiful Bukhari Azlan, the complainant in the case, was a truthful and credible witness.

At the close of their case, the prosecution offered 71 witnesses, of whom the defence chose to interview 25.

Anwar pleaded not guilty at the Sessions Court on Aug 7, 2008, to committing carnal intercourse against the order of nature at Kondominium Desa Damansara in Bukit Damansara between 3.10pm and 4.30pm on June 26 the same year.

Pakatan will revamp education in Sabah, Sarawak

If elected Pakatan Rakyat has pledged to return power to manage the education system to Sabah and Sarawak.

Promises are coming thick and fast from both the ruling Barisan Nasional (BN) and the opposition Pakatan Rakyat in an attempt to woo the electorate in Sabah and Sarawak ahead of the 13th general election.

While the BN has opted for tried and tested but threadbare coat of incentives that have failed to deliver the goods in either state after close to 50 years since independence, the opposition coalition is committing to real change in both states.

According to PKR vice-president Tian Chua, Sabah and Sarawak can look forward to a more liberalised and decentralised education system under a Pakatan-administered federal government.

Chua said Pakatan is aware of the complaints from Sabah leaders that the state education director has become redundant in the management of the education system as the federal government had taken control of the two East Malaysian states.

We in PKR and Pakatan recognize the unique position of Sabah and Sarawak vis-a-vis our national education system.

Unlike the ruling BN which has increasingly taken over power from the Sabah state education director, a federal government under PR (Pakatan) would reverse the BN approach from centralizing to decentralizing the management of the state education management, he said in statement issued here yesterday.

Chua, who is also MP for Batu, said Pakatan would also give more Borneo contents in the national school curriculum.

We believe the rights of Sabah and Sarawak as partners in the formation of Malaysia must never be overlooked.

It is dangerous to federalize everything to the point East Malaysians become restless over their roles, rights and privileges, he said.

Committed to the people

He said a Pakatan government would listen to state leaders view on how best to manage the education, which was once under a state jurisdiction in Sabah ! and Sara wak.

Chua was responding to complaints, including from Sabah state BN leaders, that Sabah education director Muhyidin Yusin was powerless to deal with many issues affecting schools which of late came directly under federal purview.

Thus far the most senior state BN leader who has complained about this is Sabah Minister of Tourism and Environment, Masidi Manjun, Masidi is also the minister in-charge of education in Sabah.

According to Chua, once in power, PKR would lead in taking the necessary steps to ensure Sabahans and Sarawakians are given priority first in the teachers training recruitment.

This is our commitment to the people here, he said.


Why does Sabah need a RM388m office?

Corrupt Barisan Nasional - KOTA KINABALU: In Sabah 65% of the roads are gravel tracks and clean drinking water and electricity are a luxury. Against this reality, is there a need for a RM388 million new administrative centre?
Questioning the logic behind the governments decision to build a new complex, activist lawyer Kong Hong Ming said: This money should be used to improve infrastructure and provide badly needed amenities to the people, especially those who are living in the rural areas.
Why is the Sabah Barisan Nasional government spending taxpayers money on grandiose projects and not providing basic infrastructure such as piped-water supply to villagers?
Kong said thousands of villagers in the state still do not have access to clean water.

Citing the case of Paitan in Beluran district, Kong, who is a Sabah PKR official, said here more than 12 villages were depending on rainwater for their daily water supply.
And Paitan is only four hours from Kota Kinabalu. People in Paitan have suffered long enough.
They badly need clean water and power supply which will require only a small fraction of the contract sum awarded for the recently announced Sabah administration centre costing some RM388 million to build, he said.
Kong, who was in Kampung Simpang in Paitan recently, said he was shocked to hear complaints from villages who had voted the BN in every general election.
He said it was an outrage that the BN-led government had failed in its duty to provide clean water and electricity to these villagers who are living in poverty-stricken conditions.



Catching rainwater
According to Kong, all the basic facilities in Sabah were in bad shape or completely lacking.
How is it po! ssible t hat after 48 years of nation-building there are still large groups of people in Sabah who are still without any clean water and electricity supply although the villages are residing at places which are only 20 to 30 minutes by road away from the present Paitan mini-secretariat.
The roads are almost unserviceable at times during rainy days and one bridge is on the verge of collapse.
The river is so polluted because of the plantation and logging activities upstream.
But the people in Paitan have no choice but to use the brownish water taken from the river for domestic purposes.
Villagers told me that for drinking purpose they rely solely on rain water and the clean water pool at the culvert outflow.
That (the outflow) has been reserved by the villagers for domestic use such as cooking and drinking water, especially when rainwater collected runs out, he said.
Encroaching on NCR land
On land issues, Kong, who was in Kampung Simpang to talk on native customary rights (NCR) over land, said the already poor people in Paitan had now also fallen prey to logging and plantation companies encroaching into their ancestral land.
He said logging was rampant in the area and clear felling was being practised by timber companies without checks by the authorities.
He wants the state and federal governments to immediately look into the plight of the villagers and stop alienating massive acreages of land to individuals, which will only drive the people deeper into poverty.
As for me, I had only a glimpse of their life as a visitor which humbled me.
But the poor people in Paitan have no choice but to live their life there everyday from the day they were born to the day they die.
The development carried out by the BN government using public fund such as the extravagant state administrative centre costing taxpayers some RM388 million meant nothing at all to the people, Kong said.!

Saya ingin menyokong permintaan keluarga Allahyarham Ahmad Sarbaini Mohamed agar dibentuk sebuah Suruhanjaya Siasatan Di Raja bagi menyiasat kematian beliau ketika disiasat oleh Suruhanjaya Pencegahan Rasuah Malaysia (SPRM).

Pendedahan Laporan Suruhanjaya Siasatan Di Raja bagi kematian mendiang Teoh Beng Hock ketika siasatan SPRM memperkuatkan lagi hujah agar siasatan bebas dan berwibawa dapat dibuat terhadap kematian Allahyharham Sarbaini.

Ini ditambah pula dengan pendedahan mendalam yang dibuat oleh Raja Petra Kamaruddin di dalam blognya.

Suruhanjaya Siasatan Di Raja Teoh Beng Hock telah mendapati pegawai-pegawai SPRM bertanggungjawab terhadap kematian mendiang.

Polis Di Raja Malaysia telah menolak sebarang tindakan terhadap tiga orang pegawai SPRM yang dinamakan di dalam Laporan Suruhanjaya Siasatan Di Raja Teoh Beng Hock, Hishamuddin Hashim, Mohamad Anuar Ismail and Mohd Ashraf Mohd Yunus memandangkan polis menganggap mereka tidak menyalahi sebarang undang-undang dan bergantung kepada siasatan dalaman SPRM. Pun begitu SPRM hanya menggantung ketiga-tiga individu tersebut.

Sebenarnya mereka boleh disiasat di bawah Seksyen 304 dan 304A Kanun Keseksaan iaitu homisid salah yang tidak terjumlah kepada kesalahan membunuh (culpable homicide not amounting to murder) dan boleh dipenjarakan sehingga 20 tahun.

Balu Allahyarham Sarbaini, Maziah Manap juga mengadu bahawa laporan polisnya mengenai kenyataan pegawai SPRM Abdul Ghani Ali yang mengatakan kakitangan SPRM yang bertanggungjawab dalam kematian Allahyarham tidak disiasat sehingga ke hari ini.

Bagaimanakah pengumuman penubuhan Jawatankuasa Eksekutif Transformasi SPRM dapat mengembalikan imej dan kewibawaan SPRM apabila jawatankuasa tersebut dipengerusikan oleh Ketua Pesuruhjaya SPRM sendiri? Memandangkan is! u ini is u serius yang sudah timbul berkali-kali, nyata sekali siasatan dalaman bukanlah penyelesaiannya. Seperti kata pepatah Inggeris, who will guard the guards?

Harus diingat permintaan untuk penubuhan Suruhanjaya Siasatan Di Raja Teoh Beng Hock juga memakan masa yang lama dan hanya selepas keputusan Koroner yang tidak muktamad dan tekanan politik barulah Perdana Menteri Datuk Seri Najib Tun Razak bersetuju dengan penubuhannya.

Saya juga berharap kerajaan dapat mengambil serius laporan-laporan Suruhanjaya-Suruhanjaya Di Raja yang ditubuhkan selama ini dan tidak menjadikannya hanya sebagai public relations exercise yang akhirnya tidak dihiraukan seperti Suruhanjaya Di Raja Video Klip Lingam, Reformasi Polis dan kecederaan Datuk Seri Anwar Ibrahim ketika dalam tahanan polis.

Justeru, hanya siasatan yang bebas, telus dan adil dapat membersihkan nama Allahyarham Sarbaini yang difitnah selama ini serta memastikan satu lagi tragedi malang seperti Teoh Beng Hock dan Sarbaini tidak berulang.


Catholic Church plugs for non-Muslim affairs ministry

The Roman Catholic Church here will lobby for a non-Islamic affairs ministry now that Malaysia has formalised ties with the Vatican, says Archbishop of Kuala Lumpur Tan Sri Murphy Pakiam.

The head of the national Catholic Bishops Conference has also resurrected the set-up of an interreligious council, among a slew of measures he believes will help peacefully end the current ethnic, cultural and religious conflict in Malaysia.

I had communicated to the Holy Father that we hope to see the establishment of an Inter-Religious Council [IRC] that would include key leaders and representatives from all religious groups; the establishment of a Ministry and the appointment of a full Minister to look into non-Islamic affairs, said Pakiam in an formal message to all Catholics today, after his return from accompanying the Malaysian government delegation to visit Pope Benedict XVI in Rome last week.

The idea for a non-Islamic affairs ministry was first raised by the Anglican bishop of Kuching, Datuk Bolly Lapok in March this year following the Home Ministrys seizure of 35,000 Malay bibles or Al-Kitab as they are locally called imported from Indonesia and meant for the Bumiputera Christian market here.

His call, aimed at pressuring the federal government to set up a special portfolio to take care of non-Muslim affairs, appears to have gained traction with the establishment of diplomatic relations with the head of the Catholic Church.

The Catholic archbishop said he had kept the pope informed of the hopes and aspirations of the local church through Archbishop Leopoldo Girelli who is at the moment still an apostolic delegate to Malaysia.

Pakiam added that the Church also hopes Putrajaya allows Catholic seminaries resume regional priest training here; promote Christian-Catholic education and teacher training courses; and set up bilateral links between Islamic institutions in Malaysia and the Pontifical Institute for Arabic and Islamic Studies among other steps.

I be lieve that these points, if they had not already been raised in the discussions between the Holy Father and the Prime Minister, will be raised in the future through diplomatic channels, he said.

Pakiam said diplomatic relations was beneficial for Catholics as it gave them a greater voice in Malaysian society in order to prophetically proclaim the values which it defends and safeguards.

Penang is the first state in the country to set up an executive council portfolio to handle non-Muslim religious issues in early February this year, in conjunction with the United Nations Interfaith Harmony Week.

The idea for the IRC was first mooted in the 1980s but was spiked early on following objections from Muslim groups such as the Islamic Development Department (Jakim).

The Najib administration formed its special committee to promote harmony and understanding among religious adherents in April last year but the interfaith panel appears to have stymied following the death of its coordinator, Datuk Ilani Isahak on February 24.

Her replacement has yet to be announced.


Muhyiddin re-starts GE-13 guessing game, talk of Umno power tussle

Deputy Prime Minister Muhyiddin Yassin has revived the general election guessing game when he said over the weekend there was not much time left, indicating that GE-13 was just months away.

It is evidence of his growing clout that many pundits pricked up their ears when they heard his comments. In the past months, many UMNO leaders including Prime Minister Najib Razak have hinted of snap general elections. Najib even once said polls might just be around the corner but after mismanaging a slew of issues most Malaysians have given up on him.

Even then, there were two contrasting stories of power play at UMNO, the party that dominates the ruling BN coalition. One view was that Najib and his wife Rosmah Mansor were just warming their seats and in no hurry at all to have snap polls. Instead it was Muhyiddin and former premier Mahathir Mohathir who wanted it early as Najibs incompetence was clear to them.

The other view was that it was Najib who wanted an early GE so that he could clinch his own mandate from the people, purge his foes and put in his own loyalists at UMNO. Leaders from various factions within the party slid in and out with ease with either theory, depending on which benefited them at that point in time.

But after the recent string of political upheavals, the most significant of which was the July 9 Bersih rally for free and fair elections, the smoke may be starting to clear.

I think it is very significant that Muhyiddin is signalling for GE-13 to be held soon. It is not surprising given that Najib has done a poor job. You can look at it two ways, Muhyiddin wants to save the country before Najib destroys it completely or Najib is now so unpopular that it is perfect timing for Muhyiddin and Mahathir to pull another Badawi this time on Najib, PKR vice president Chua Jui Meng toldMalaysia Chronic! le.

Najib to go through the same door as Badawi

Jui Meng, a former Health mninsiter, was referring to the 2008 general election, where 5th prime minister Abdullah Badawi was persuaded not to defend the UMNO presidency after leading the BN to its worst electoral performance in the 2008 national polls.

After intense horse-trading spearheaded by Muhyddin who together with Mahathir had backed Najib for the UMNO presidency, which also carries the coveted prime ministers post, Badawi stepped down in favour of Najib, who was then his deputy.

Muhyiddin and Mahathir are expected to pull a similarcoupagainst Najib at next years UMNO general assembly, regardless of the GE-13 results. To be fair, it is highly unlikely that Najib can repair his personal popularity, and the image he has reinforced for the BN of being a mere shell for UMNO, in time to improve on the 2008 GE results regardeless whether GE-13 took place this year, 2012 or 2013.

They believe they can still win the federal government even if not regain the two-thirds majority in Parliament. If they wait, the chances are high the cousins will fumble even more and lose the entire election to the Pakatan Rakyat. My hunch is the GE-13 is end of this year, during the long holidays, Bukit Gantang MP Nizar Jamaluddin toldMalaysia Chronicle.

Nizar was referring to Home Minister Hishammuddin Hussein, who together with Najib, had unleashed a series of crackdowns against the Bersih rally, ignoring at their own and BNs peril the enormous popularity Bersih enjoyed with the masses.

The Rosmah factor

Like Nizar, Jui Meng too reckons that GE-013 will be held after the Budget 2012, due to be unveiled on October 7. He said a shakeup at UMNO was inevitable and Rosmah was now the millstone around Najibs nec! k as Kha iry Jamaluddin had been to Badawi. Khairy is the UMNO Youth chief and Badawis son-in-law, who was much hated by the Mahathir faction for being greedy and grasping.

Among recent events that both Jui Meng and Nizar cited as unfavourable for Najib was the Bersih fiasco, the way it continued to be mishandled after it was over, the enormous international scorn the cousins drew for their role in villianising the Bersih rally.

They also pointed to acts of sabotage in the way certain scandals were leaked to the press, including Rosmahs alleged purchase of a RM24.4 million diamond ring, the RM100 million New York super-luxury penthouse allegedly bought on the first couples behalf by a well-known business associate of their sons Jho Low.

The Teoh Beng Hock Royal Commission of Inquiry findings was another death blow for the Najib campaign, they added. So too were the cracks in the economy that can no longer be hidden from the public eye as business growth slowed while prices of consumer essential rocketed.

Pre or post Budget

However, some believe there is still a chance that GE-13 can be held in September-October before the Budget presentation.

For me, I do agree there is something cooking in the UMNO oven. But I think the chances are higher for a pre-budget election soon after Hari Raya Puasa. To have it post-Budget may be too close to Hari Raya Haji and after that is the wet season, PKR vice president Tian Chua toldMalaysia Chronicle.

The pressure on the economy is also quite enormous and if they did the GE before the Budget 2012, then they can even include GST and other subsidy cuts rather wait until after the elections and rely on supplementary bills to get the additional allocations through. - Malaysia Chronicle


Bon voyage Bourdon, Najib strikes again

Soon after his return on July 22 from a three-nations trip, Prime Minister Najib Tun Razak boasted on national television that the elections in Malaysia are fair and clean.

Well, at least that is the impression he gave his United Kingdom counterpart David Cameron whom he met at No 10 Downing Street on July 21. Besides the United Kingdom, Najib also visited Turkmenistan and Italy, all in a span of eight days.

The idiot box however did not cooperate with Najib. The look on his face while relaying that bit of news was far from convincing. Maybe, just like the rakyat, Najib too knows the truth, which is that the Malaysian electoral system is fraught with manipulation and corruption and that accusations made by election watchdog Bersih 2.0 are not without basis.

Does Najibs claim that he told Cameron there is no hanky-panky at the polls of any good to anyone? Certainly not.

Cameron, on the contrary is convinced that something is seriously wrong with the way the things are managed in Malaysia, as seen from the way the people who turned up to support the Bersih 2.0 rally on July 9, 2011, were assaulted by the police.

Six dedicated activists are still being held in solitary confinement under allegation that they instigated people to participate in the rally, thus waging war against the monarchy.

As far as Cameron is concerned, he is worried about the very poor human rights record that Malaysia, a former British colony, holds. It would be no exaggeration to say that Cameron was furious with Najib for the brutality displayed against the rally supporters that the British premier lost all appetite to do lunch with his Malaysian counterpart.

Najib could not care less. He instructed the police to make public compromising video footages of the July 9 r! ally in an effort to quash accusations of police brutality, a move which has made the rakyat sick to their stomach. The peoples determination to see Najib check out of Putrajaya is growing stronger by the day.

In so far as Najib goes, did all that affect him? Yes, it surely did. But like his fellow Malaysian politicians, Najib too seeks refuge under the black heart and thick skinned cloak that these politicians find indisposable throughout their political career.

Crying out loud that the electoral system in Malaysia needs no clean-up was pathetic enough, but Najib who consistently fails to get his act in order once again faltered when he made sure French human rights lawyer William Bourdon was deported back to Paris, pronto. Why the rush, Najib?

Bourdon was in Malaysia to speak at events organised by human rights NGO Suaram regarding the controversial-ridden Scorpene submarine deal.

Najib was defense minister

The deal which which was inked in 2002 during Najibs tenure as defense minister was reported to have involved kickbacks worth RM500 million. Not only that, it was also linked to the murder of Mongolian national Altantuya Shaariibuu, whom Najib was alleged to have been involved with.

However, once Bourdons flight landed on July 22 at 11.40am at the Kuala Lumpur International Airport, the lawyer was escorted out of the plane by three immigration officials. He was held at the holding centre and questioned for four hours, after which he was ordered to leave Malaysia the very same day, although his return ticket to Paris was dated July 24.

Had Bourdon insisted on leaving Malaysia on July 24, he would according to the Malaysian police be held under detention until his departure date. Not wanting to put his wife at any risk, Bourdon decided to exit Malaysia on July 22, at his own cost.

The reason behind that order? Bourdon was deported for violating the terms of his social visit pass so was the excuse given by the Immigration Department! .

I hereby declare that I have acted as the lawyer for Suaram in full respect of my duties and rules and in perfect compliance with national and international laws. I consider that this deportation decision is a breach in the right to freely exercise my profession as a lawyer, Bourdon said in a statement.

A deal gone terribly wrong

Details of the Scorpene deal gone wrong go as follows: It all started in June 2002 when the Malaysian government signed an agreement with French DCNS and Spanish Navantia for the purchase of two Scorpene class submarines.

The agreement took place through direct negotiation with the manufacturing companies, with the service of Perimekar Sdn Bhd linked to Abdul Razak Baginda, a close aide of Najib.

Altantuya served as a translator for Perimekar. Four years after the submarines procurement, her remains were found in a secluded area in Puncak Alam, Shah Alam. Police investigation found that she was shot twice before her body was blown up using C-4 explosives.

Subsequently, Razak was charged for abetting in her murder in July 2008 but was acquitted about two months later. The prosecution team decided not to appeal against his acquittal. Najib, meanwhile ended up swearing on the Quran to clear his name.

In December 2009, Suaram filed a complaint with the French courts asking for access to information regarding government contracts signed with Perimekar and other information classified as official secrets in Malaysia.

In April 2010, the French courts accepted the request to investigate the claim of corruption for a payment amounting to 114 million euros from DCNS to Perimekar.

No end to abuse of power

Subang MP Sivarasa Rasiah and Batu MP Tian Chua who were at KLIA to meet Bourdon when he arrived from Penang were barred from doing so.

In a typical show of power, Malaysian authorities also failed to acknowledge the fact that Bourdon was Suarams lawyer on the submarine ! case and that his deportation would be a breach of his right to perform his duty as a lawyer.

Bourdons wife Lea Forestier was very shocked and upset over the arbitrariness of the situation.

The only other experience of William and I being denied entry was Tunisia under Ben Ali that was a banana republic! Forestier was reported to have said, according to tweets from local activists.

But does the bitter experience suffered by Bourdon and Forestier make any difference to the Malaysian government? It should, for as they say actions speak louder than words and those very actions of Najibs coupled with his high-handed manner in dealing with supporters of the July 9 rally have left the international community upset with him.

Needless to say, this show of power abuse and disrespect for an individuals fundamental rights by the Najib administration will cost the Barisan Nasional a heavy price at the polls.

Najib in trouble?

To PKR vice-president Nurul Izzah Anwar, there is just one truth behind Bourdons unceremonious deportation that he knows too much. Nurul claimed Bourdon may have access to important documents that could link Najib to the Scorpene purchases.

But the French court will provide public access to the investigation papers when the case goes on trial in September, claimed Nurul at the Ops Scorpene fund raising dinner in Petaling Jaya on July 22.

Will justice be served? Only time will tell. But for Altantuyas sake, one hopes that it does, for only then will her soul attain moksha (release). Altantuyas ashes, according to her father Dr Steve Shaariibu, still remain in a Malaysian court, as the case, in theory, remains unsolved.

(Bernama) - The Raja Muda of Perak, Raja Nazrin Shah, said today rulers should not be shielded from the truth and must be told the real story.

In addition, rulers should never be surrounded by people with personal interests who are willing to use them as tools.

"Rulers must have advisers who are sincere, sensitive to the people's needs and bold to state the truth," he said at 'Wacana Ilmu Universiti Teknologi Mara (UiTM) on the theme 'The role of Malay rulers in nurturing unity' in Shah Alam.

Raja Nazrin said rulers should be willing to accept the fact, no matter how bitter, as justice could not be uphold without the truth.

"Rulers can't play a meaningful role if they are given a rosy picture. The false impression is unfair as they will be denied the right to conduct their responsibilities fairly."

Raja Nazrin expressed fears that shielding rulers from the truth would separate them from the people, making it difficult to address integrity, statehood, loyalty and unity.

"Exploiting sentiments is easy as the people easily fall for promises. The prescription can only heal if the syndrome is identified.

"It is unwise if the nation and people choose to reject reality, blurring the vision on the real reasons that affect unity."

Raja Nazrin said stiff political competition had exploited sensitive religious and racial issues and dissatisfactions of the people.

"In all conflicts, no one party is right all the time and no one party is wrong all the time.

"The methods to achieve total victory by beating foes have cast aside good manners, customs, morals and religious elements."

He also feared that the rising political temperature would turn dreams of unity into a nightmare, adding that there should be a neutral, credible and acceptable institution to lower this.

It was important for rulers to not only be above political polemics but also have the trust and responsibility of ensuring peace and harmony.

"Rulers must use wisdom to calm situations, but they do not have a 'magic lamp' to keep unity, especially when the situation has become chaotic."

Raja Nazrin said the role of rulers was to give advice privately, so that this was not misinterpreted as directly interfering with the administration.

"The credibility of some national instruments require a recovery of perception and need improvements in line with the current world dynamics to restore confidence in the people."

Raja Nazrin said unity would not be achieved in an unstable and immature political climate post the 12th general election, with calls for reality checks and demands for change.

"Unity requires a willingness to sacrifice, accept defeat willingly and celebrate victory with humility," he added.

‘Anti-Islam bloggers in US on Najib/BN payroll’


Prime Minister Najib Tun Razak, who sees himself as the 'great protector of Islam' in Malaysia must explain link to anti-Islam promoters.

COMMENT
A team of American bloggers allegedly hired by Prime Minister Najib Tun Razak and Sarawak Chief Minister Abdul Taib Mahmud to improve their respective images, are in fact pro-Israel and known to publicly slander Islam.

One member of the team, Caleb Howe, indulged in a sustained, childish rant on his public Twitter page on April 23 last year, in which he said: “I drew a picture of Mohammed today. I showed him marrying a pre-tween. Might as well be historically correct right?”

Eighteen minutes later on the same twitter message, he posted: “Did I say marrying a pre-tween? Sorry.. that was my typo.I meant raping.” Caleb’s outburst against Islam is not an isolated incident (see image below).

He and his team have indulged in a number of such anti-Islamic rants on Twitter that are clearly designed to give extreme offence to Muslims.

Few would dream of engaging in such an unpleasant and offensive attack.

It thus comes as a surprise that Najib and Taib would hire Howe and his colleagues who sustain other blogs such as Red State, New Ledger, Sarawak Report(s), Malaysia Matters as their professional promoters.

It seems somewhat a misjudgement that Najib, who sees himself as the great protector of his own Muslim religion, continues to be associated with this team of Americans.
Pro-Israeli views

Howe [photo below] is closely linked to Josh Trevino, the right-wing blogger behind the American ‘Red State’ and ‘New Ledger’ blogs and also a PR company called Rogue Strategic Services.

Rogue Services have been in employ with Barisan Nasional since the days of former Prime Minister Abdullah Ahmad Badawi.

Now their portfolio includes Najib and Taib. They have been allegedly hired to create ‘positive publicity’ on their behalf.

This is achieved through a network of websites. These websites have been engaged by Najib and Taib to promote them by publishing favourable articles in their blogs in the US.

These reports are then carried in Malaysian blogs. Local media then quote these blogs, giving Malaysians the impression that Najib and Taib have positive international endorsement.

Howe, who is a regular contributor to Trevino’s flagship ‘Red State’ website, also curates a Twitter account called Malaysia Matters which is linked to the Malaysia Matters website, one of Trevino’s projects to promote BN leaders.

The Malaysia Matters website (which has just been re-launched) was started in 2008 by Trevino and a colleague Jerome Armstrong.

Armstrong, who is also a professional ‘blogger for hire’, has made no secret of the fact that the project was commissioned by the Malaysian government – he lists them as a client on the website of his company WebStrong.

Trevino himself has made no secret of his rabid pro-Israeli views – to the extent that he tweeted that fellow Americans who felt sorry for the Palestinians and took part in the mercy ship flotilla deserved to be shot dead.

1.2 million signatures for Najib a ‘farce’

KUALA LUMPUR: The once dormant Indian Muslim Congress of Malaysia (Kimma) has now become an active force in the political arena under the stewardship of its new president Syed Ibrahim Kader.

Recently, the party launched its “One Million Signatures” campaign to show support for Prime Minister Najib Tun Razak and to back his 1Malaysia programme.

According to Kimma officials, the campaign initiated together with the National Islamic Development Foundation (Yakin), also headed by Syed Ibrahim, took place at 212 locations nationwide.

Syed Ibrahim called the campaign a great success since 1.2 million signatures were collected.

However, a source claimed that there is a twist to the story.

“What happened at Masjid India where the campaign kicked off is far different from the statements made by Kimma leaders,” he said.

According to him, Kimma members hung a long white cloth along the street and allegedly told passers-by to ink their names without revealing the reason.

“Not only Malaysians but several hundred foreigners also signed their names on the cloth,” said the source, who was present during the launch.

He also urged Kimma to reveal all the other 211 places where the campaign took place.

“If it is true, please come forward and show the evidence, like photographs and videos,” he asked.

Targeted areas

Despite numerous attempts, Syed Ibrahim could not be reached for comment.

Previously, Syed Ibrahim was reported as saying that the campaign, launched on July 18, saw a positive start when 100,000 signatures were collected in a single day in Jalan Masjid India and the Bukit Jalil National Stadium.

He said more than 2,000 Kimma members were at shopping centres and bus terminals nationwide to collect the signatures.

“We targeted high traffic areas like shopping centres to collect the signatures. In the Federal Territory alone, there were 15 locations,” he had said.

The signatures were later handed to Najib when the premier returned home from his overseas visit on July 22.

Kimma has also unfurled a banner containing the signatures of “1.2 million Malaysians” at the airport to show their support for Najib.

GEORGE TOWN: A state executive councillor today hit out at Senator Syed Ibrahim Kader for spreading lies that the Penang state government had sidelined the Indian Muslim community from mainstream development programmes.

Abdul Malik Kassim chided the Kimma president for his continued ingratiation to his political masters as a gesture of gratitude for his recent appointment as a senator.

“Syed Ibrahim should not mortgage the principle of truth and dignity by disrupting the harmony and prosperity enjoyed by Indian Muslims in the state.

“Since 2008, the Pakatan Rakyat state government has taken care Indian Muslim affairs better than ever,” said Malik, the Batu Maung state representative.

He said the state government was committed to providing assistance and opportunities to all ethnic groups in the state, including Indian Muslims, in mainstream development.

He added the state government regularly engaged the Indian Muslim community pertaining to issues of religion, mosques and endowments properties.

Syed Ibrahim said today that Chief Minister Lim Guan Eng’s administration had sidelined and isolated Indian Muslims from mainstream state development.

‘Pakatan fair to all’

However, Malik said that being an Umno crony, Syed Ibrahim had attempted to portray a bleak gloomy picture just because he could not stomach Pakatan’s success story in Penang.

He claimed that apart from practicing competency, accountability and transparency (CAT), the state government had always been a people-orientated administration.

“The current government does not practice the cronyism and nepotism as was done by the previous Barisan Nasional government,” he said.

He pointed out that the Penang World Heritage celebrations showed that the state government had included the Indian Muslim community in its development programme.

The Penang Islamic Religious Council (MAINPP), he said, had also given extra attention to address the community’s issues.

He rebuked Syed Ibrahim as among a few, who want to become ‘Mamak’ heroes by harping on non-issues.

“Pakatan government has been fair and just to all regardless of their political, ethnic and religious backgrounds,” said Malik, a local PKR leader.

Cuba bayang. Proton Saga pertama yang keluar dari kilang dahulu harganya sekitar RM15000 sahaja. Selepas Mahathir melaksanakan cukai beliau, harga Proton naik kepada RM60 ribu. Harga kereta lain jangan ceritalah.

Sampai sekarang harga kereta di Malaysia antara termahal di dunia kerana kebodohan dan kebongkakan Dr. Mahathir Muhammad Iskandar Kutty.

Projek Proton hanya merugikan rakyat Malaysia dan merugikan negara. Yang untung hanya kroni sahaja. Kalau nak tengok kerugiannya, tanyalah mangsa-mangsa feri karam di Penang satu masa dahulu.

Semata-mata untuk menjaga Proton, Dr Mahathir membelanjankan ribuan juta untuk membina jalan dan jambatan m! enyebabk an perbelanjaan ke atas pengangkutan awam menjadi semakin kecil.

Rakyat Malaysia juga terpaksa membelanjakan 30% dari pendapatan mereka untuk membayar kos kereta serta yang berkaitan dengannya (repair, minyak dsbnya).

Dan, kerajaan di bawah Mahathir menghabiskan wang untuk membina jalan2 raya yang besar-besar (rakyat juga yang kena tol) menyebabkan perbelanjaan ke atas pengangkutan awam menjadi semakin mengecil.

Kalau Dr. Mahathir pandai mentadbir, sudah tentu beliau membina Sistem Aliran Ringan semenjak tahun 80'an lagi di waktu kos pembinaannya masih murah.

Namun, beliau mahukan Proton yang jelas telah gagal menyebabkan beliau terpaksa menaikkan harga kereta dengan begitu tidak masuk akal.

Dr. Mahathir hendak menyorok kebodohan beliau di dalam mentadbir negara. Sebab itulah dia buat kenyataan merapu ini.

Saya rasa kalau letak kambing sebagai Perdana Menteri pun, kambing tersebut lebih berkebolehan sebagai Perdana Menteri berbanding Dr. Mahathir.

Altantuya is back again !

Grisly find near Kajang road

KAJANG, July 25 — Residents at Taman Lingkungan Nur here stumbled upon partial human remains at midday today, which police say are a skull and part of a human leg.

Scouring the nearby area for the rest of the body, police also found a motorcycle stripped bare and some clothing. It is not clear if the items are related to the human parts discovered earlier.

The K9 Unit has since been dispatched to search for the rest of the body.

A police spokesman later revealed that the remains belonged to a teenager of indeterminate sex, and have been gnawed at by feral animals.

Police then urged those with relevant information to come forward.

Malaysia and Australia Sign Refugee Deal

Australia and Malaysia have signed a deal to send 800 asylum seekers in Australia to Malaysia in exchange for the resettlement of 4,000 refugees.

The 4,000 refugees are to be resettled in Australia over a four year period, with that country bearing the cost of their transfer and settlement.

Hishammuddin Hussein, Malaysia’s interior minister, and Chris Bowen, Australia’s immigration minister, formally signed the deal at a Kuala Lumpur hotel on Monday.

The 800 asylum seekers sent to Malaysia will be placed in a “holding centre” for six week before being allowed into the community, Hussein said.

From midnight on Monday, the next 800 asylum seekers arriving in Australia by boat will not be processed there, but will be transferred to Malaysia, Julia Gillard, the Australian prime minister said.

The government said they would receive no preferential treatment in the processing of their claims or arrangements for resettlement.

‘Dumping ground’

Ahead of the signing, Brendan O’Connor, Australian’s interior minister, said the deal represents “an historic and innovative approach” to undermining the people-smugglers’ business model.

“We want to treat people fairly,” he told ABC Television, but refused to confirm a report that those shipped to Malaysia would be allowed to work.

However, the deal has drawn criticism because Malaysia is not a signatory to the UN convention on refugees.

“Australia is using Malaysia as a dumping ground for boat people it does not want and in the process walking away from its commitments to follow the 1951 Refugees Convention,” Phil Robertson, the deputy director at the Asia division of Human Rights Watch, said.

“Human Rights Watch has publicly called on UNHCR to not endorse this agreement because this is a deal that would allow Australia, a country that has signed the Refugee Convention, to devolve its obligations to another country that has not signed the Refugee Convention.

“This would set the worst type of precedent and we’re concerned it could start a wider erosion of protection for refugees throughout the Asia-Pacific region.”

The UNHCR is not a signatory to the agreement, however appreciates that both governments consulted with the agency

“The UNHCR’s preference has always been an Arrangement which would enable all asylum-seekers arriving by boat into Australian territory to be processed in Australia. This would be consistent with general practice,” the agency said in a statement.

“The critical test of this Arrangement will now be in its implementation both in Australia and Malaysia, particularly the protection and vulnerability assessment procedures under which asylum seekers will be assessed in Australia prior to any transfer taking place.”

Chris Bowen, Australia’s immigration minister, told Al Jazeera: “The whole idea of this arrangment is to remove incentive to get on the boat and take the very dangerous journey between Malaysia and Indonesia and Australia to get to Australia claim asylum.

“We have taken a big step forward, in conjunction with the UNHCR, in terms of improving protection outcomes for the 800 and ensuring appropriate protections are built into place.

“We have indicated that we will cover costs, but this is an arrangement by which Malaysia has nothing to gain. we are assisting in monetary terms, but we are assisting Malaysia in the process of 4,000 extra genuine refugees who have been through the process of UNHCR mandate and who are waiting for resettlement.”

Protests against agreement

In Malaysia, demonstrators gathered outside the signing ceremony to protest against the country’s treatment of refugees and asylum seekers.

One demonstrator held up a placard that read, “Malaysia’s immigration laws still don’t recognise ‘refugees’ and ‘asylum seekers’ – where’s the guarantee for protection?”

The Australian government, which has a policy of mandatory detention for asylum seekers until their claim for refugee status is resolved, is facing rising tensions in some of its detention centres over the processing of claims.

The migrants are held for months at Christmas Island detention centre, about 1,500 miles from the Australian mainland, and in other detention facilities.

About 200 people protested against the impending agreement outside Sydney’s Villawood immigration detention centre on Sunday.

The immigration department said about 60 inmates were taking part in a peaceful protest at the Scherger detention centre in Queensland, with about 50 of these engaged in voluntary starvation.

Details of a third commission in the controversial purchase of Scorpene submarines, said to have been paid to a high-ranking Malaysian government officer, is set to be revealed when a corruption trial involving the French arms supplier begins in France this September.

Cynthia Gabriel of rights group Suaram, who is spearhering efforts to compile facts and bring the matter to French courts under its Ops Scorpene project, recently revealed new evidence that a third commission, allegedly bigger than the first two commissions paid to Perimekar Sdn Bhd at RM540 million, PKRs online organKeadilanDailyreported.

Perimekar is fully owned by Ombak Laut, a company owned by Abdul Razak Baginda, the aide to prime minister Najib Razak who was charged of abetting in the brutal murder of Mongolian Altantuya Shariibu.

Explosive details linking the murder to Najib had been given in a statutory declaration by Abdul Razaks private investigator P Balasubramaniam, saying the duo had both been romantically involved with Altantuya, who had assisted in the purchase negotiation of the submarines.

September trial

Cynthia said the identity of the third individual would be known in the trial.

The person was found to be with Abdul Razak and Altantuya on a flight in 2002 to Macau to attend a meeting related to the Scorpene purchase.

Through courts, we will be allowed to access documents belonging to the company which had done the transaction, Cynthia toldKeadilanDaily.

Cynthia said there had been increased public interes! t in the case following the Malaysia governments deportation of Suarams lawyer William Bourdon, who was detained upon his return from Penang at the Kuala Lumpur International Airport last Friday.

Saying Suaram was pondering on its next course of action following the deportation, Cynthia said Bourdons arrest showed the government was desperate to conceal some secrets.

Home minister Hishammuddin Hussein had explained that Bourdon had violated his visa conditions.

DUmno Code: Christians respect Islam, but may not respect Najib

Researchers at Hornbill Unleashed have discovered a secret code, the DUmno Code, for understanding news in Bernama, TV3, RTM, Berita Harian, the New Straits Times, UtusanMalaysia, the Borneo Post, the New Sarawak Tribune, and other propaganda organs of Umno and PBB.

The trick is to invert the news, so that everything they say means the direct opposite. Every denial they make confirms that whatever they are denying is true.

One example is when PM Najib Razak said on returning from the Vatican: We wish to tell our friends, the Malaysian Christiansthat is if they respect us, we will also respect them.

Who are us in this statement? Najib must have been using us as shorthand for those of us umno leaders who use religion and bigotry to hold on to power, in order to steal your money and buy diamonds as big as your head.

At any rate, using the DUmno Code, what he really meant was, Even if you respect us (umno leaders), we will never respect you. We will continue to ban the word Allah. We have cheated in every single election. So the Bersih rally was always about electoral reforms. Now we in Umno have painted Malaysia as though we are like the Arab spring governments in the Middle East. We want to keep hold of power we have seized from the people.

We have lied to British Prime Minister about what the July 9 rally was all about. We are committed to rigging elections. David Cameron should ignore the truth and listen to us.

The meeting was humiliating, as Cameron kept going on about human rights.

When the police took action, the Bersih supporters took photographs and posted them on Youtube, and showed the police brutality. We continued to lie that the police had no physical contact with them.

On claims that the Barisan Nasional had an unfair advantage when it came to campaigning during elections, we were not really prepared to debate or admit this. But it is true.

The Opposition held ceramah and campaigned everywhere and every day, under intimidation and police harassment, and without fair press coveragethat is still not fair.

On the visit to Rome, it was done to pretend that the government is inclusive, in the hopes of clinging on to power in the upcoming general election.
