Chapter 9: Islam in Malay Life

Sharia in a Plural Society

The issue of the Islamic state is needlessly consuming the energy of many Malaysians, Muslims and non-Muslims alike. It is also the platform of the Islamic Party (PAS), its reason for being. Yet when challenged on the specifics, PAS is sorely unprepared. Surely after championing the issue for the past half a century, its leaders should have a pretty clear idea of their goals. If by Islamic state they mean one based on the ideals of justice and morality of the Quran, then all Muslims and many non-Muslims would agree. But if they want a state based on the Sharia (Islamic law) in its current form, many Muslims and certainly all non-Muslims would demur.

The Sharia took three centuries to formulate and consumed the best intellectual talent of the Muslim world at the time. Although based on the Quran and sunnah (ways of the prophet), the Sharia remains the creation of mortals and as such, carries all the imperfections implicit in such endeavors. For Muslims to ascribe to it the reverence and perfection reserved only for the Quran means that we ascribe those very same qualities to the mortals who crafted the Sharia.

Sharia literally means, the road to the watering hole, the right or straight path to be followed. To Muslims, Sharia refers to the body of Islamic laws that are perceived as being part and parcel of the faith. It thus assumes the same rightful place as the Quran and sunnah. To criticize the Sharia is to criticize the faith itself. And therein lies the problem.

There are over 6,000 verses in the Quran; of these less than 600 are concerned with the law. And most of those cover such matters as prayers and rituals. Only about 80 verses deal with such traditional legal matters as crime and punishment, contracts, and family law. Clearly the Quran is not a legal tome but a general guidance on how to build a moral and ethical society.

It is a magnificent tribute to the intellect o! f those early Muslim scholars that they were able to fashion out of the Quran and the sunnah a coherent and consistent body of laws that is the Sharia. In its time the Sharia represented a giant leap in intellectual, social, and legal achievements. Its treatment of women in particular was light years ahead of its time. The status of women accorded by the Sharia was of the order of magnitude a thousand times better than the prevailing practices. Then women were not even recognized as humans. Whereas women are granted a share of the inheritance in the Sharia, in the then prevailing culture, women were the inheritance. They were chattels and properties of their husband, to be passed on or traded accordingly. The Sharia represented a grand emancipation of women. In this regard Islam was centuries ahead of Western civilization. The codifying of divorces too was truly an inspiration, considering that the concept did not even exist then. Wives were not divorced then; they were simply discarded, traded, or handed over to their husbands heir. The Sharias treatment of criminal justice was similarly light years ahead of the prevailing ethos of an eye for an eye; likewise the treatment of slavery and indentured labor.

While the Sharia represented a quantum leap in achievement of early Islam, in its present form it is clearly incompatible with many of todays universally accepted norms, in particular with respect to human rights, criminal justice, public law, gender equality, and hosts of other areas.

I do not say this lightly seeing that to many Muslims, any criticism of the Sharia is blasphemous. But I cannot look at my daughter and tell her that she is worth only half that of my son, as the Sharia would have it. I love all my children equally and my inheritance to them should and will reflect that sentiment. Nor do I find such cruel and inhuman punishments as stoning to death a woman for adultery and the chopping of hands for thievery compatible with an All Compassionate and All Merciful Allah. S! imilarly I find the death penalty for apostasy as prescribed by the Sharia not only abhorrent but also incompatible with the Koranic admonition that there shall be no compulsion in matters of faith.

As a Muslim I take the Koran to be Allahs revelation. Its message is infallible and immutable, and for all mankind at all times. That is a matter of faith. Being Allahs words, the Koran takes precedence over everything else, including the Sharia and the sunnah.

That is a heavy statement. Having said it, a much-needed pause for clarification. Muslims consider the Koran and the sunnah as co-equal parts of the faith. One cannot separate the message (the Koran) from the messenger (the prophet pbuh); they both form an integral part of the faith. I agree wholeheartedly. The main issue I have is differentiating between the actual practices and sayings of the prophet (pbuh) and what scholars say they are. I will revisit this important differentiation a few pages hence. Meanwhile back to my original discussion.

Societies change, and so too must the laws. There is nothing in the Sharia that mandates we give it the reverence due only to the Quran. Thus the pertinent question, and one rarely asked, is not whether the Sharia should be applied to modern society, rather how can we adapt and modify it to meet current needs. A body of laws that was an enlightened piece of legislation for 7-10th Century Arabia is clearly not suitable for the present. When the Sharia was formulated, the Arabian society was just emerging from the Age of Jahiliyah (Ignorance), a period of rampant female infanticide, slavery, and tribalism. A millennium later, the problems are of a different order. The challenge today is to enhance the freedom and dignity of humans. That these freedoms and rights are emphasized by Western civilization is no reason for Muslims not to co-opt and adopt them.

Todays Muslims should emulate our illustrious predecessors. Had ancient Muslims been like their present-day counterparts and c! onsidere d everything originating outside of Islam as un-Islamic, Islam would not have expanded. Muslims today should be equally receptive to and be welcoming of new ideas and innovations regardless of where they originated. That Allah chose a Christian to reveal His secret on gravity, a Jew on the nature of the atom, a Confucian on the explosive power of gunpowder, and a Hindu on the concept of zero, is not for us to question. It is however, for us to appreciate that such wisdom and insights are for the benefit of all.

Same address, different constituencies......

Debates on the July 9 rally are still going on but the call for a fair electoral system should not only be the demand of the Bersih and the public. Instead, it should also be a common goal of all political parties who are not afraid of a fair election.

However, the debates should not only be in the form of war of words, but more practical examples should also be cited to urge the Election Commission (EC) to address and solve the problems.

We have been cleared about the electoral game of constituency demarcation over all these years. The huge gap between the number of voters in rural and urban areas has also been seen as a violation to the principle of one vote, one value.

The EC must explain clearly where the fairness principle lies in constituency demarcation. And should there be a more reasonable standard for the gap between the number of voters in rural and urban areas?

In addition to the so-called phantom voters, the problem of disappeared voters should also be concerned.

During general elections in the past, there were always voters who found their names disappeared from the electoral roll and lost their eligibility to vote. While some who were more lucky found their names on the electoral roll but have been moved to another constituency.

It does not seem rare to move a voter from one constituency to another one. At least two of my colleagues had personally experienced it.

Mo, from the advertising department, was from Labis. He had voted for five times so far. There were five eligible voters in his family, namely he himself, his parents and siblings. All of them voted in the same constituency for the first four times but strangely, he has! been de signed to vote in another constituency during the last general election, even without changing his address or making request for the constituency change, while his parents and siblings still voted in the initial constituency.

Meanwhile, Xiang, from the editorial department, lived in a rural area with his parents and siblings. They lived in the same house with exactly the same address on their MyKad. However, his parents and younger sister were designated to vote in constituency A while he and his younger brother voted in constituency B.

Would it be a computer error? Xiang tried to clear the cloud but received no answer so far. He joked: Perhaps its because my parents and younger sisters rooms are located at the front part of the house and thus, they belong to constituency A while my younger brother and I sleep at the back rooms and thus, we are voters of constituency B.


A fair electoral system does not tolerate the above mentioned errors. However, how many similar examples are there remain unknown? The EC should really launch an investigation on it.- Lim Mun Fah

Tapi pada PRU 2008, dia dan keluarganya tak dapat mengundi kerana nama mereka tiada dalam daftar pemilih bagi kawasan Parlimen Nibong Tebal.

Bila disemak,rupa2nya namanya serta ahli keluarganya telah dipindah ke Parliman Mersing, Johor. Bila ditanya,sama ada dia telah buat pemindahan tersebut? Jawabnya, dia sendiri tak tahu di mana letaknya! Mersing .

Pikiaq2 mai betapa bahlol punya kerja SPR....

Najib Is Getting His Ass Kicked Big-Time

I recently commented on how the Bersih 2.0 rally could have been hijacked by Najib by simply joining the march and promising reforms.

Malaysia is a nation of empty promises anyway, so Najib could have certainly gotten away with it.

Everyone would have ignored the rally and that small turn-out would have yielded next to no publicity at all.

The Wall Street Journal and Bloomberg both have blunt rebukes for Najib.

Crackdown 2.0 in Malaysia

Based on the evidence of this weekend's rally in Kuala Lumpur, Malaysians aspire for a more competitive political system than what they have. Also based on this weekend's evidence, Prime Minister Najib Razak isn't prepared to give it to them.

An estimated 20,000 or more people peacefully gathered in Kuala Lumpur Saturday to call for free and fair elections. Their complaints included vote-rigging and gerrymandering of constituencies to the ruling party's benefit. Bersih 2.0, as the rally was called, was the biggest event of its kind in four years. The original Bersih (the word means "clean" in Malay) called for electoral reforms in 2007.

As with the original rally, this one was met not by understanding from the government but by police deploying tear gas and water cannons. More than 1,600 attendees were detained and released late Sunday. One demonstrator died from a heart attack.

Bloomberg warns of economic consequences to this sort of over-the-top government thuggery.

Arab Spring, meet Malaysias summer of discontent.

That thought is surely on Prime Minister Najib Razaks mind as the dust settles from Saturdays botched demonstrations in Kuala Lumpur. By botched I mean the way Najib mishandled what should h! ave been a ho-hum political-reform rally of little note by the international news media.

Public-relations experts would have told Najib to let the Coalition for Clean and Fair Elections have their day in the capital. Let them wave signs and wear their yellow shirts. Instead, he tried to stop the rally, increasing its size. Then, he cracked down. Police fired tear gas and detained 1,697 people, turning the event into a top cable TV news story.


The over-the-top response did something worse: It enraged Malaysians who werent all that interested in rallying before Saturday. It also underlined the rise in political risk sweeping Asia, something that investors would be wise to track.

Cikgu Shida is a mime artist by hobby, and produces video mime performances using her laptop and a webcam. Her videos on YouTube have been viewed more than 600,000 times.

Karpal's objection over 'typo error' dismissed

The Attorney-Generals Chambers is appealing against the senior lawyers acquittal on a charge of sedition against the Perak sultan.


The Court of Appeal today sent a strong message to the Attorney-General's Chambers to stop making bumbling typographical errors when it cited a non-existing section in the Sedition Act.

Judge Md Apandi Ali, who was one of the three judges on the Court of Appeal panel, made the remark when the Notice of Appeal filed by the prosecution stated the section where lawyer Karpal Singh was charged for sedition, was under Section 41(1) of the Sedition Act.

However, the Sedition Act only has 11 sections as Karpal had pointed in the preliminary objection which he raised. This follows the prosecution's appeal of his acquittal last year.

Karpal said it cannot be this way as the notice, which cites a non-existing section, is a defect.

To make matters worse, he said the notice was signed by the solicitor-general Idrus Harun.

Following this, I apply that the appeal by the prosecution is dismissed as there is nothing before the court as the notice is erroneous, he said.

NONEDPP Noorin Badaruddin (right), leading the prosecution team, admitted the mistake and error on the prosecution's part.

Stating it was a typo error, Noorin said there should be a bracket after the number 4.

However, the error does not affect the case, and it can be amended as the trial which Karpal faced at the Kuala Lumpur High Court was under Section 4(1), she said.

I was out the whole day yesterday and was told of the error in the evening, said Noorin.

Justice Apandi asked Noorin who made the mistake, and she admitted it could have been one of the clerks.

This led to Apandi to warn her, You pass this message to the chambers, when you do your job you must do it correctly.

The other judges! hearing the appeal were Justice Ahmad Maarop, who was leading the panel, and Justice Clement Allan Skinner.

However, the panel unanimously dismissed the senior lawyer's preliminary objection, as Skinner pointed out amendments can be made orally.

The panel then ordered the hearing to continue.

Karpal had been acquitted

On June 11 last year, Karpal was acquitted by the Kuala Lumpur High Court on a charge of sedition against the Perak sultan, after the prosecution failed to prove a prima facie case.

Karpal was acquitted without his defence being called.

He was charged with sedition on the contents of his Feb 6, 2009, press conference, during which he said legal action could be instituted against the Perak sultan over his role in the state constitutional crisis.

He was charged under section 4(1)(b) of the Sedition Act 1948, which carries a maximum fine of RM5,000 or a jail term of three years, or both, if found guilty.

Justice Azman Abdullah, in acquitting Karpal, said the lawyer's action did not amount to sedition as it fell under an exception provided by law.

After scrutinising the statements to the press, I find that they fall within the exception in Section 3(2)(a) of the Sedition Act 1948, judge Azman ruled.

Today, Noorin submitted that a prima facie case should be called against Karpal as he was questioning the prerogative of the sultan under Article 16 (1) of the Perak constitution in appointing the menteri besar.

This has resulted in unrest where 103 police reports was filed against Karpal, he said.

Lawyer Jagdeep Singh Deo, who appeared with his father, said it does not fall within the ambit of sedition as the law says you can take action against the public authority which in this case is the sultan.

One cannot deny this as it is within the law, he said.

The hearing continues tomorrow with submissions from Jagdeep.


3,424-diamond bangles cost RM1.65 mil

KUALA LUMPUR: The pair of bangles with 3,424 diamond stones, allegedly owned by Rosmah Mansor, is worth RM1.65 million, according to fine jewellers Jacob & Co.
In an e-mail communique to FMT, the New-York based jewellers said the price for the pair of bangles is US$540,000 (RM1.65 million).
Jacob & Co said each 18k white gold bangle is fitted with 1,712 diamond stones and weighed 137.31 grams.
Each bangle is studded with 751 stones 30.00ct of black diamonds and 34.50ct 961 stones of fancy intense white diamonds, the company added.

Yesterday, a pro-Pakatan Rakyat blogger published a photograph of Rosmah sporting a pair of bangles which looked strikingly similar to Jacob & Cos Zebra Safari collection.
Prior to that, bloggers had claimed that Prime Minister Najib Tun Razaks wife had acquired a diamond ring from the same jewellers, worth a whopping RM73 million.
The bloggers identified the item as a Natural Fancy Blue Gray Cushion Cut Diamond Ring. It had supposedly passed through the Kuala Lumpur International Airport customs in April this year.
Screenshots of the alleged customs computer displays also revealed that the ring did not have import duties imposed on it.
Yesterday, a NGO filed a report with the Malaysian Anti-Corruption Commission (MACC) in Penang over the matter.

Pak Samad labels Najib's admin as 'cruel'

National laureate A Samad Said has called Prime Minister Najib Abdul Razak's administration 'cruel' for cracking down on last Saturday's Bersih 2.0 rally in Kuala Lumpur.

"If we see what happened (on that day), it's cruel, I have said on my Twitter and Facebook that we are heading towards a police state," he said.

The soft-spoken and usually low-profile septuagenarian was recalling his experience during the July 9 massive rally in which leaders and supporters of electoral reform were sprayed with tear gas and water cannons.

In an exclusive interview with Malaysiakini today, the distinguished 76-year old poet and novelist who is popularly known as Pak Samad said that despite the government's denial of police high-handedness during the four-hour long rally, the world was watching.

"They (the police) have said that there was no brutality inflicted on members of the public, but we can see (what happened) in YouTube, they cannot lie," said Samad.

Turned into an icon of sorts for the Bersih 2.0 movement after being probed for his 'seditious' poem recital at its launch on June 19, Samad wanted Najib to resign.

Citing the Facebook page carrying that demand, he said that the now rapidly-growing number in that petition mirrored the people's sentiment.

"That is enough to reflect what the people are feeling right now," he said.

Losing touch with reality

The page has seen more than 187,000 people backing the quit call to Najib since five days ogo when the rally was broken up by police with tear gas and water cannons. The page titled '100,000 People Request Najib Tun Razak Resignation' was set up last Saturday whe! n police picked up around 1,700 people during the mass protest.

The national laureate added that rule by families of elite in the country has resulted in leaders losing touch with the people.

"For 50 years this country has been ruled by elitist families. They live comfortable lives and the reports that reach them contain only nice things, they do not feel (the people's needs).

"Its time that the leadership came from the bottom and not from the top," Samad said.


He pointed out that with the exception of former prime minister Dr Mahathir Mohamad, all other prime ministers has been drawn from society's upper crust.

Najib is the son of the late prime minister Abdul Razak Hussein and nephew of former prime minister Hussein Onn.

"The leaders we have now are old, they cannot understand the aspirations of the young," he added.

BERSIH 2.0: Pengalaman Saya

Pengalaman saya bersama Perhimpunan BERSIH 2.0 bermula pada jam 11 pagi apabila saya dengan seorang teman dari PAS Shah Alam menuju ke Kuala Lumpur. Pada mulanya kami mencuba Lebuh Raya Persekutuan. Ianya sesak dari sebelum Tol Batu 3. Kami cuba pintas melalui Glenmarie. Trafik sesak di hadapan kilang pengedar kereta BMW. Kami memutuskan untuk berpusing balik d! an mencu ba pula melalui ELITE/PLUS menuju ke KLIA. Masuk di Batu 3, keluar di Tol USJ. Seterusnya menuju ke arah Puchong. Seterusnya kami menyusuri Jalan Gasing dan melalui kawasan Universiti Malaya sehingga keluar di Jalan Pantai. Dari situ terus menuju ke KL Sentral.

Sekatan jalan oleh polis di merata tempat. BN menyusahkan rakyat semata-mata kerana hendak menghalang program yang menegur mereka. Turut bersimpati dengan pihak polis, berpanas dan mendapat sumpahan rakyat berbakul-bakul semata-mata kerana UMNO/BN. Hanya pencuri dan BN yang bergembira dengan penggunaan polis secara sebegini. Tetapi, kalau difikirkan, memang terdapat persamaan di situ. Pencuri mencuri secara illegal, BN mencuri harta rakyat melalui cara legal.

Setibanya kami di jalan Brickfields, saya turun di tepi jalan dan berjalan kaki menuju ke KL Sentral. Terserempak dengan sahabat bermotosikal dan membonceng ke hadapan kawasan KL Sentral. Berjalan kaki pula menuju ke Hotel Hilton yang berada di sebelahnya. Saya berjalan berhampiran beberapa anggota polis tetapi mungkin oleh kerana saya bertegur sapa seorang pelancong dari Australia dan bersembang sambil berjalan dengan beliau, mereka tidak perasan akan saya. Mungkin juga saya dianggap sebagai pemandu pelancong ataupun tourist guide.

Saya masuk ke Hotel Hilton dan dari lobi, terus menuju ke atas untuk bersama pimpinan. DSAI telahpun berada di situ bersama Dato Ambiga dan Lim Kit Siang. Beberapa pimpinan PAS juga sudah di situ apabila saya sampai. TG Hj Abdul Hadi sampai pada jam 1 tengah hari. PC dibuat dan mereka menyatakan secara jelas apa itu BERSIH 2.0 dan matlamat yang ingin dicapai. PR juga menyatakan sokongannya terhadap BERSIH 2.0.

Selepas solat Zohor yang diimamkan TG Hj Abdul Hadi kami mula bergerak ke bawah. Sampai sahaja kami ke Lobi, pelanggan di restoran di kawasan Lobi hotel itu tiba-tiba berdiri dan menepuk tangan menunjukkan sokongan. Termasuk pelancong-pelancong yang mengikuti perkembangan Negara,! mereka semua faham apa yang kami inginkan akan membawa kebaikan untuk Negara. Hanya UMNO tidak mahu faham kerana mereka lebih pentingkan kebaikan diri mereka sendiri!
Ada dikalangan pelanggan, bangun untuk turut bersama. Sambil menunggu tadi, mereka minum di restoran hotel, membawa business juga pada hotel tersebut nampak gaya!

Kami keluar pintu utama Hotel dan terus tuju ke bangunan KL Sentral. Sambil keluar saya menoleh ke belakang dan mata saya mengesahkan, tiada meja yang diterbalikkan, tiada kerusi yang dicampak dan tiada bahagian yang dibakar di Hotel Hilton! Kami himpunan aman, bukan perusuh.

Sambil keluar saya melihat hari sedang hujan. Hujan rahmat yang akan mengurangkan kesan keperitan gas pemedih mata, terfikir saya. Bila tiba di salah satu pintu masuk KL Sentral, ada anggota polis yang cuba menghalang kami dari masuk, tetapi tidak berjaya. Kami masuk ke dalam dan tiba-tiba, orang ramai yang berada di dalam bersorak menyambut ketibaan kami. Jumlah yang asalnya hanya berpuluh, tiba-tiba disertai ramai yang telah berada di dalam, menjadi beratus! Kami terus mara dan keluar dari bangunan KL Sentral, dibawa melalui tangga besi ke tingkat bawah.

Yang menyertai kami di KL Sentral terdiri dari rakyat biasa yang menyokong kami. Mereka menunggu kami dan sambil menunggu, mereka membeli minuman dan makanan di kedai-kedai di KL Sentral. Semasa mereka bangun untuk menyertai kami, tiada kedai yang dibakar, kerusi yang dibaling atau meja yang dipecahkan. Kerana kami berhimpunan secara aman yang ingin menuntut pilihan raya yang adil dan bersih, bukan perusuh. Kami ingin lawan melalui pilihan raya, bukan melalui huru hara. Itu sebab pilihan raya perlu adil dan bersih.

Di tingkat bawah, kami berada di kawasan yang bagaikan sebuah terowong, kiri kanan berdinding. Mereka yang di depan membawa kami terus mara lagi menuju ke jalan keluar untuk ke Stadium Merdeka. Bila sampai di pintu terowong tiba-tiba kelihatan satu barisan an! ggota FR U menghalang jalan. Kami berada lebih kurang 20 meter dari mereka. Kami berhenti, pimpinan berada di saf hadapan. Saya di saf yang ketiga. Tiba-tiba berbunyi siren dari belakang. Landrover FRU menuju ke arah kami dari belakang, inginkan laluan untuk ke depan. Kami memberinya laluan tanpa apa-apa tindakan khianat dari pihak kami.

Setelah landrover tersebut berada di hadapan, saya menoleh ke belakang, ingin melihat sekiranya ada pasukan FRU yang sedang mara ke arah kami. Orang sudah ramai, beresak-esak, dalam keadaaan kebimbangan kerana kami terperangkap dalam terowong tanpa adanya jalan keluar. Di depan FRU dan di belakang pun sudah begitu. Kami datang bukan untuk berentap dengan FRU tetapi BN menghantar FRU untuk menyerang kami.

Tiba-tiba saya mendengar bunyi tembakan dan dengan serta-merta, cermin-mata saya terpelanting ke depan. Asap gas pemedih mata mula berkepul-kepul. Tembakan datang dari depan dan belakang. Pada saat itu saya terfikir saya perlu mencari cermin-mata kerana semua menjadi kabur tanpanya. Tetapi suasana kelam kabut menyedarkan saya bahawa itu tidak mungkin saya lakukan. Gas pemedih mata mula terhidu. Saya teringat beg plastik yang berada di dalam kocek seluar saya dan dengan segera membukanya sehingga dipenuhi udara serta bernafas melaluinya dengan menutup hidung dan mulut saya dengannya. Beg plastik itu adalah pembalut baju BERSIH 2.0 yang diberikan kepada saya semasa diatas.

Pada ketika itu saya tidak sedar bahawa kepala saya terkena kelonsong gas pemedih mata dan sudah mula berdarah. Saya bersama rakan saya dari Shah Alam, saudara Zainal, yang ditugaskan untuk menemani saya, bergegas ke belakang dan ternampak lubang di tepi dinding di sebelah kanan kami. Kami menuju ke lubang tersebut.

Sambil ke sana saya melihat A. Samad Said terduduk tersandar di tepi dinding. Beliau orang lama, pasti umurnya lebih 70 tahun. Dia tentu tidak mampu untuk beredar dari terowong yang semakin penuh dengan gas pemedih mata. T! urut kel ihatan beberapa pemuda yang duduk bersama beliau.

Semasa sidang akhbar sebentar tadi A. Samad Said turut bercakap. Beliau berkata, telah tiba masanya untuk sasterawan terlibat dalam pencorakan Negara kerana kerosakan yang semakin melanda. Saya kagum dengan beliau. Kebiasaannya, orang seperti dia akan berehat di rumah, bermain dengan anak cucu. Malangnya kebobrokan pemerintah memaksa beliau ke jalan raya, walaupun sudah cukup berusia. Mengapa? Kerana dia tidak ingin mewariskan kepada yang muda suatu negara yang hancur dan budaya politik yang muflis dari segi akhlak dan amanah! Celaka BN kerana merampas ketenangan zaman usia emas darinya!

Kelihatan juga beberapa wanita yang terduduk di atas jalan, tercungap-cungap kepedihan, hadiah dari BN yang ingin terus mempertahankan proses pilihan raya yang kotor. Mereka sedar akan risikonya tetapi mereka ingin juga melihat perubahan dan keadilan. Apa akan mereka warisi sekiranya kepincangan diteruskan dan kekayaan negara terus disalah-gunakan? Oleh itu mereka datang walaupun tahu kemungkinan mereka akan dilayani sebegitu rupa oleh BN.

Pada ketika itu saya tersedar bahawa beg plaktik yang saya bernafas melaluinya sudah mula basah, berisi dengan sesuatu cecair yang berwarna gelap. Sahabat saya lantas memberitahu saya bahawa saya telah terluka di bahagian kepala. Beg plastik dipenuhi darah!

Saudara Zainal membawa saya terus menuju ke lubang yang kelihatan tadi. Terpaksa kami melalui di bawah dua batang paip air untuk sampai ke lubang tersebut. Sebaik sahaja melalui lubang itu, kami dapati kami memasuki kawasan pembinaan. Ada beberapa pekerja di situ. Kami bertanya jalan keluar dan dengan segera mereka menunjukkan kami jalan untuk melepas diri.

Zainal meminta saya berhenti dan baju Bersih 2.0 yang saya pakai di atas baju T-shirt saya digunakan untuk membalut kepala saya untuk mengurangkan pendarahan. Pada masa itu kelihatan baju saya penuh dengan kesan darah. Saya duduk sa! mbil dia dan beberapa lagi rakan seperjuangan membalut kepala saya. Ada bersama pemuda dari kawasan Selayang. Ada juga pemuda dari Sarawak! Pemuda dari selayang memberikan saya tuala kecil yang sudah dibasahkan untuk membersihkan muka dari kesan darah.

Sambil itu semua dilakukan, dua orang lagi pemuda keluar dari kawasan pembinaan tersebut untuk mendapatkan teksi untuk saya. Bila ada teksi ditahan, maka mereka memanggil saya untuk menaiki teksi tersebut. Zainal menutup kepala saya dengan beg plastic kuning yang dia bawa bersama. Takut luka dibasahi hujan. Pemuda Sarawak memberi pula jaket hitamnya untuk menutup kepala saya juga, takut air hujan akan membasahi luka saya.

Saya dan Zainal menaiki teksi dan meminta pemandu membawa kami ke Hospital. Pemandu itu melihat pada saya dan terus menyedari saya salah seorang yang menyertai perhimpunan BERSIH. Dia nampak saya sedang cedera dan dengan segera dia membawa kami pergi. Sambil dalam perjalanan dia cukup berhati-hati, mengelak kawasan yang dijaga polis.

Setibanya kami di Hospital, di bahagian kecemasan, saya dibawa untuk bertemu doktor yang bertugas. Pembantu Hospital (HA) ramai bertanya akan keadaan di Kuala Lumpur sambil menunjukkan sokongan mereka terhadap apa yang diusahakan. Sambil berbincang saya dicucuk dengan cucukan anti-tetanus, tekanan darah dibaca dan keadaan jantung diperiksa melalui ECG. Orang biasa yang berada di hospital turut bertanya apa yang sedang berlaku. Sambil menunggu keluarga mereka yang dirawat, sokongan mereka terhadap apa yang dituntut oleh BERSIH jelas disuarakan.

Ada seorang peserta himpunan aman BERSIH yang cedera telah tiba di Hospital sebelum saya. Beliau lagi parah. Kelongsong gas pemedih mata terkena di dadanya dan melantun ke atas melanggar dagunya. Tulang dagunya patah menyebabkan dia tidak boleh bercakap dengan jelas.

Para doktor dan jururawat yang merawat saya begitu bersimpati dengan usaha kami. Sambil menjahit luka saya setelah! kepala di x-ray, ada yang bertanya kehairanan terhadap cara perhimpunan itu ditangani. Apa salahnya? Kenapa tidak dibenarkan sahaja? Apa yang diminta sememangnya patut kata salah seorang doktor sambil menjahit 6 jahitan dikepala saya. Kami sokong, tapi terpaksa menikus katanya lagi.

Itulah Malaysia, negara kesayangan kita semua. Bumi di mana golongan bijak pandai ditakut-takutkan. Kalau bersama himpunan BERSIH, tindakan akan diambil! Semua pegawai kerajaan diharamkan untuk berserta! Mahasiswa, mahasiswi, pensyarah, cikgu-cikgu, kalau terlibat, nahas kamu! kata-kata perangsang pemerintah yang memerintah melalui penindasan dan ugutan. Ya Malaysia, bukannya Myanmar ataupun Kampuchea di bawah Pol Pot. Kehebatan negara ini dan segala kelebihannya hancur di tangan pemerintah yang mementingkan diri.

Itulah sebabnya perubahan itu perlu. Perubahan demi membebaskan Malaysia dari barisan pemimpin yang sudah lupa diri, tenggelam dalam harta dan kemewahan yang dicuri dari rakyat. Ianya hanya dapat dilakukan sekiranya pilihan raya itu adil dan bersih. Itulah sebabnya mengapa usaha BERSIH perlu diteruskan.

Pada masa itu waktu sudah pukul empat petang. Saya menerima sms bahawa TG Hj. Abd Hadi telah ditahan. DSAI dihantar ke hospital kerana turut cedera. Lebih kurang 1,400 orang ditahan polis. Tetapi, LKS tidak mampu ditahan polis walaupun beliau separuh rabun kerana baru sahaja menjalani pembedahan mata! Sedangkan beliau bersama di saf hadapan. Adakah ini merupakan sebahagian dari tipu muslihat mereka? Ingin ditonjolkan kononnya bahawa hanya Melayu sahaja yang terlibat sambil mengelakkan kemarahan masyarakat Cina?

Namun demikian, maklumat seterusnya yang saya terima melalui SMS menyatakan, himpunan BERSIH 2.0 berjaya dihadiri berpuluh ribu rakyat berbilang kaum di beberapa tempat termasuk di Stadium Merdeka dan Pudu Raya! Sambil itu, perhimpunan turut diadakan di beberapa bandar utama di serata dunia!

Saya kembali ke rumah selep! as itu, walaupun perit gas pemedih mata masih terasa dan luka di kepala masih menyengit, tetapi hati tetap gembira dengan kejayaan perhimpunan tersebut. Saya kemudiannya dikunjungi beberapa sahabat yang kembali dari Kuala Lumpur. Mereka menceritakan pengalaman mereka sambil ingin tahu keadaan saya. Semua merasa bangga dengan kejayaan perhimpunan tersebut dan tiada sesiapa, termasuk saya, merasa kesal kerana telah bersama. Ini adalah kerana, kami telah turut menyertai suatu perhimpunan yang telah melakar sejarah dalam mencorak masa depan tahah air. InsyaAllah, angin perubahan kencang akan terus kekal bertiup di bumi Malaysia ini!

By the time they bid their goodbyes, the Prime Minister would have left an indelible mark at Castel Gandolfo, the scenic summer residence of the Pope.

Najib will arrive with a special message for the 265th Pope that Malaysia, after years of pondering, has made a firm decision to establish diplomatic relations with the Holy See.

There cannot be a better opportunity, and at a more appropriate juncture, for the Malaysian leader to highlight the country as one that embodies the principles of inter-religious harmony and respectful co-existence.

The Prime Minister and the pontiff, the worldwide leader of the Roman Catholic Church, will certainly underscore the need to promote collaboration and dialogue between various religious groups.

Najib will likely convey the Malaysian Governments desire to pursue constructive political dialogue with the Vatican, which maintains diplomatic relations with 178 countries.

The Holy See has permanent observer status with all the rights of a full member except for a vote in the UN General Assembly, and has the oldest active continuous diplomatic service in the world.

In its efforts to build bridges with the world, the Governments move to break new ground and establish relations with the Vatican is indeed a significant leap forward.
It is pertinent because the universal understanding of multi-religious facets is very important. Pertinent because Islam and the West is now a permanent topic for dialogue with issues seen through various keyholes.

The Vatican has also been wanting to engage with Malaysia which it recognises as a moderate Muslim nation made up of various ethnic groups, said a senior Malaysian diplomatic official involved in the behind-the-scenes work with the Vatican.
It will be an especially proud moment for the Catholic community in Malaysia that makes up the largest group of Christians in the country (about 9% of Malaysias 28 million people are Chris! tian, wi th Catholics numbering about 850,000), but the tie-up with the Vatican should be welcomed by all Malaysians as it will reinforce Malaysias image as a moderate Muslim nation in the international community.

Najib caught attention in New York last September when he called for the formation of a Global Move-ment of the Moderates, saying that it was important for moderates to take centre stage.

By venturing and forging that important link with the Vatican, the Prime Minister would have indeed matched words with deeds.

Perhimpunan BERSIH 2.0 on 9 July 2011

Background

The Coalition for Clean and Fair Elections or more popularly known as BERSIH 2.0, announced on 26 May 2011 that it would be organising a rally, Perhimpunan BERSIH 2.0, on 9 July 2011. The purpose of Perhimpunan BERSIH 2.0 is to promote democracy and to demand for electoral reform.

The Perhimpunan BERSIH 2.0 has 8 immediate demands, which are:

1. Clean the electoral roll

2. Reform postal ballot

3. Use of indelible ink

4. Minimum 21 days campaign period

5. Free and fair access to media

6. Strengthen public institutions

7. Stop corruption

8. Stop dirty politics

BERSIH 2.0 received many detractors and supporters during the month leading up to Perhimpunan BERSIH 2.0. However, the biggest detractor against BERSIH 2.0 turned out to be the government of Malaysia. In the lead up to Perhimpunan BERSIH 2.0, the government launched a systematic campaign of harassment and intimidation.

The police under the direction of the Home Ministry carried out a mass crackdown against BERSIH 2.0 supporters which started on 22nd June when one man from Sepang was arrested for selling BERSIH 2.0 t-shirts. According to documentation and monitoring conducted by SUARAM, between 22nd June and 8th July, at least 223 persons were arrested or called in for questioning by the police in connection to BERSIH 2.0. This figure includes the six PSM leaders who are currently detained without trial under the Emergency Ordinance.

BERSIH 2.0 nationwide road shows faced obstacles from the police including setting up road blocks at roads leading to the venues, sealing off the venues of the events, harassing local organisers and arresting person! s wearin g or selling BERSIH 2.0 shirts.

On 28th June, police raided the office of Empower, an NGO endorsee of BERSIH 2.0 which also functions as the BERSIH 2.0 Secretariat. The police did not produce a warrant nor inform the purpose of the raid and threatened to break into the office. Four laptops, one desktop computer, BERSIH 2.0 materials and various documents were seized in the raid. Six Empower staff and one volunteer were arrested during the raid. Following the raid, the police and mainstream media painted Empower as reviving communism based on a photo of Shamsiah Fakeh found during the raid. The photo was in fact part of Empowers exhibition tracing womens political participation in Malaysia, where kaum ibu, plantation workers, mui tsai and other women profiles were also presented.

On 1st July 2011, the Home Ministry gazetted BERSIH as an illegal organisation.

The mainstream media went out of their way to paint prominent members of BERSIH 2.0 as fronts for foreign powers, with very little credible evidence offered. Other accusations meted against Perhimpunan BERSIH 2.0 include instigating chaos, racial riot, violence, backed by Christian Jewish and communists, to name a few. The government owned television channel, Radio Television Malaysia (RTM) screened public service announcements denouncing the evils of demonstrations; and how protests are not part of Malaysian culture. No opportunities were given to BERSIH 2.0 to rebut these accusations nor allowed to speak on the electoral reforms that the Election Commission failed to do.

Many government institutions were called into play in this smear campaign, including the supposedly neutral Elections Commission (EC) who made statements against BERSIH 2.0. The Land Public Transport Commission took the step of freezing temporary bus permits for travelling into Kuala Lumpur on 8 and 9 July.

Even private corporations joined in on the act, with toll highway concessionaires flashing messages on their electronic billboards! warning people not to participate in any illegal assembly. Friday sermons too, joined in the chorus of vilification, calling BERSIH 2.0 Chairperson Ambiga Sreenevasan an enemy of Islam, echoing similar comments made by the Prime Minister, Najib Razak.

In the last few days before the rally, students received a circular, prohibiting them from attending any illegal rallies under threat of expulsion. Civil servants received a similar notice from their department heads, threatening disciplinary action and even sacking for any civil servant found to be participating in any illegal rally.

On 7 July, 91 individuals including key BERSIH 2.0 Steering Committee members and were served with restriction orders of questionable legality, barring them from certain parts of Kuala Lumpur on 9 July 2011. Any of the 91 individuals who breach these restriction orders would face arrest.

On the eve of Perhimpunan BERSIH 2.0, a lockdown of the city was carried out. Roadblocks were set up along major highways and roads leading into the city, as a precautionary measure necessary for public safety. Outstation buses suspected of carrying rally participants were turned away at entry points into Kuala Lumpur such as Gombak, Sungai Besi and Jalan Duta highway tolls. Public buses were diverted from entering the city. Police officers conducted room to room searches in various hotels in the city, looking for possible rally participants and ordering those suspected to be rally participants to leave the city.

Despite the extensive intimidation and obstacles set in place by the authorities, more than 50,000 Malaysians exercised their right to peaceful assembly and made their way peacefully to the heavily guarded Stadium Merdeka to demand for reform of the electoral system. This peaceful expression of opinion on 9 July successfully withstood the violence perpetuated by the police force, namely the teargas and water cannon attacks, arrests, abuse and harassment.

BERSIH 2.0 and SUARAM proposal to SUHAKAM:

1. Conduct an independent and open inquiry in use and abuse of police powers

With regards to the excessive use of force against participants of the 9 July 2011 peaceful assembly, the Coalition for Clean and Fair Elections (BERSIH 2.0) and Suara Rakyat Malaysia (SUARAM) calls on SUHAKAM to conduct an independent and open inquiry into the abuse of power by the police and the violence committed at the event.

We recommend for the independent and open inquiry to focus on the following key incidents:

1.1. The avoidable death of Allahyarham Baharuddin Ahmad

At Jalan Ampang, Allahyarham Baharuddin Ahmad was reported to have collapsed while running. Concerned citizens brought him into Avenue K shopping mall. Police officers in the area were asked to provide assistance but witnesses said that the police did not respond. Eyewitnesses also said that it took at least one hour for an ambulance to arrive at the scene.

The police have denied any involvement in the death of the deceased and claimed that the post mortem pointed to a prevailing heart condition and no external injuries. However, the family of Allahyarham Baharuddin claims that he did not have a history of heart condition and that Allahyarham Baharuddins body had sustained physical injuries such as broken bones in his chest and broken teeth.

1.2 Violent arrest of Muhammad Sabu

PAS Deputy President Muhammad Sabu was the pillion passenger on a motorbike en route to Masjid Negara when he was chased by three unmarked vehicles two Proton Waja cars and a four wheel drive vehicle. The chase ended when the four wheel drive collided head-on with Muhammad Sabus motorbike which caused him to be thrown off the motorbike. Muhammad Sabu was brought into the four wheel drive and to IPD Jinjang, upon which it was made clear to him that the persons who nabbed him were police officers and that he was under arrest. Muhammad Sabu sustained serious inju! ries to his leg due to this incident.

1.3 Unwarranted police attacks at the KL Sentral underpass

The police fired teargas and water cannon indiscriminately at the participants of the peaceful assembly. The excessive, dangerous and potentially fatal manner in which teargas was used against a group of around 100 persons, including key BERSIH 2.0 and supporting party leaders at KL Sentral, warrants serious attention.

The group was trapped at an underpass between two police teams armed with teargas guns. The police did not negotiate with the group but instead fired numerous rounds of teargas canisters into the underpass from various directions. The underpass was an enclosed space which created a dangerous situation for individuals trapped in the space as fumes from the multiple teargas canisters significantly clouded visibility and caused the people to suffocate.

In addition, two individuals were hit directly by teargas canisters shot into the underpass. MP Khalid Samad was hit by a canister at the back of his head and received six stitches while Fayyadh Afiq, bodyguard to MP Anwar Ibrahim, was hit on his face, which gave him a broken cheekbone. There exists video evidence that indicates a police officer ordered for the angle of the teargas guns to be lowered to target directly at the people (Ref: http://www.youtube.com/watch?v=nYPlTFwQfUY).

The role of teargas in this incident has exceeded beyond the intention of dispersing the crowd, and seemingly fired with the intention to cause harm.

1.4 Violent abuse by police

The police used unnecessary force against participants of the rally including those who were arrested. Many individuals have been beaten, kicked, punched, violently shoved and/or verbally abused by police officers. Police reports from these individuals are being compiled by BERSIH 2.0 and SUARAM.

Arrests of participants of the peacefu! l assemb ly were often made using unnecessary physical force. Arrested individuals were physically by police officers even though they are handcuffed. Some individuals were aggressively handcuffed although they did not resist the arrest. Individuals in the process of dispersing were also arrested by the police.

1.5 Indiscriminate shooting of water cannon and teargas into areas of essential services

The police aimed water cannon and teargas into areas of essential services such as Tung Shin Hospital on Jalan Pudu in an attempt to target participants of the peaceful assembly. Participants had sought shelter from teargas and water cannon attacks on the hospital grounds. The Health Minister and police have both denied that the Tung Shin Hospital compound was attacked despite the many accounts from eyewitnesses and photographic and video evidence.

Even in war situations, places of essential services such as hospitals are internationally accepted as no-attack zones. The police force, in its haste to disperse the crowd, had been indiscriminate, excessive and arbitrary in its use of water cannon and teargas. The protocols of usage of teargas and water cannon usage and the conduct of the police force must be investigated.

2.0 Reform the Penal Code and Police Act, 1967

Immediately pressure the government to review the Penal Code and Police Act 1967 and remove provisions which have the purpose of removing all restrictions on the constitutional and human right to peaceful assembly

Suruhanjaya Pencegahan Rasuah Malaysia (SPRM) didesak supaya menyiasat sumber kewangan isteri Perdana Menteri, Datin Seri Rosmah Mansor hingga beliau mampu untuk memiliki cincin dan gelang tangan bertatahkan berlian.Ahli Parlimen Pokok Sena, Dato Mahfuz Omar berkata, SPRM harus menjalankan siasatan segera bagaimana, Rosmah sebagai seorang suri rumah mampu memakai cincin dan gelang tangan berlian.

Selepas tersiar dalam laman-laman web mengenai cincin berlian milik Rosmah bernilai RM73 juta yang diimport dari Amerika Syarikat tanpa membayar cukai, tersebar pula gambar Rosmah juga memakai gelang tangan berlian seberat 65 karat bernilai RM1.65 juta.

SPRM mesti telus dalam siasatannya. Di mana Rosmah dapat wang, pada hal beliau hanya seorang suri rumah sahaja, kata Mahfuz ketika dihubungi FMT hari ini. Beliau yang juga Naib Presiden PAS menegaskan bahawa sudah tentu Rosmah tidak mampu. Begitu juga suaminya (Datuk Seri) Najib Tun Razak tidak akan mampu membelinya dengan gaji sebagai seorang perdana menteri.

Kita bimbang berlaku penyelewengan. Kemungkinan ada pihak-pihak yang berkepentingan yang memberi barang-barang mewah itu kepada Rosmah.

Maka kita pun nak tahu apa yang mereka dapat daripada Rosmah sehingga mereka sanggup menghadiahkan barang-barang yang sangat bernilai itu, terang beliau.

Mahfuz berkata,sekiranya Rosmah menggunakan wang dari orang ramai (taxpayers money) sepertimana yang didakwa oleh setengah- setengah pihak, siapa yang bertanggungjawab melulus dan mengeluarkan wang untuk Rosmah.

Memandangkan sudah ada pihak yang membuat laporan kepada SPRM, suruhanjaya itu harus menjalankan siasatan segera berhubung cincin dan gelang tanga! n itu, k atanya.
Presiden Solidariti Anak Muda Malaysia (SAMM), Badrul Hisham Shaharin telah membuat laporan di pejabat SPRM di Pulau Pinang kelmarin berhubung dengan cincin berlian ini.

Najib, Rosmah ada kepentingan

Beliau yakin Najib dan Rosmah ada kepentingan dalam perkara ini, lagi pun kedua-dua item ini tidak dikenakan cukai dari Jabatan Kastam.

Kita harus ingat bahawa Jabatan Kastam terletak di bawah Kementerian Kewangan dan Najib adalah juga Menteri Kewangan, tegas beliau.

Mahfuz berkata, kita harus mencari jalan bagaimana untuk mendesak supaya Najib mengambil cuti atau digantung tugasnya sebagai perdana menteri sementara siasatan dijalankan terhadap beliau dan Rosmah.

Memandangkan Yang DiPertuan Agong tidak mempunyai kuasa untuk memecat Perdana Menteri, maka kita harus mencari jalan supaya beliau (Najib) mengambil cuti atau jawatannya digantung buat sementara, terang beliau.

Kelmarin, beberapa blogger melaporkan bahawa cincin berlian berharga RM73 juta itu dibawa masuk ke negara ini melalui syarikat Jacob & Co, milik Jacob Arabo, seorang ahli perniagaan berbangsa Yahudi.

Sementara blogger lain, Semut and Papan Kekunci menyiarkan gambar Rosmah memakai gelang tangan berlian seberat 65 karat berharga RM1.65 juta.

Dalam perkembangan yang lain, Mahfuz memberitahu bahawa Najib akan mengimpot empat atau lima buah kereta mewah tidak lama lagi dan beliau pasti Najib tidak membanyar duti import yang mencecahkan jutaan ringgit itu.

Sebagai Menteri Kewangan di mana Jabatan Kastam terletak di bawah kawalseliaannya, saya yakin beliau tidak akan membayar cukai import, katanya.

Unspinner kena Spin masuk longkang dlm Isu Cincin RM24.4 juta

Blog UMNO bernama UNSPINNER telah berusaha untuk membela cincin tersebut. Antara hujjah mereka yang paling ampuh dan besar adalah kononnya jenis cincin tersebut *(natural fancy blue gray cushion cut) tidak wujud.

Sayang sejuta kali sayang. Baru langkah pertama dah kena bentes kaki. Majalah FORBES telah mengkonfirmasi bahawa cincin jenis ini wujud dan gambarnya adalah seperti berikut:

Lagipun skrg ni ada khidmat insuran. Apa2 jadi pada cincin, insuran bayar. Ada paham tak, UNSPINNER? Ke benda simple ni pun

AN INCONVENIENT TRUTH

We, the undersigned doctors, wish not to enter into the polemics of the Bersih 2.0 march on 9th July 2011 but would like to clarify the inconvenient truth.

We are outraged at the incidents, and the subsequent responses from the authorities, to the events where tear gas and chemical laced water were shot into the compounds of Tung Shin and Chinese Maternity Hospitals, two adjacent buildings along Jalan Pudu, Kuala Lumpur, with scant regard for the safety of patients, staff and the general public who were at the buildings that afternoon.

Hospitals are considered as safe sanctuaries for all, even during war times, but these consecrated places of refuge and protection were violated by the defence forces that afternoon.Police even entered the buildings in search of some of these peaceful marchers.What was most frightening and witnessed by many was the unprovoked violent assault within the hospital compoundsand apprehension of several protesters who had merely run into the hospitals to seek shelter from the tear gas and the water cannons!

It isrepulsive that the authorities entrusted with policing the nation and protecting the weak and needy, have shamelessly denied publicly, the occurrence of these incidents IN SPITE of countless photo/video and eye witness accounts of what was evident to all independent observers.

A few of the undersigned were actually visiting or working in the hospitals concerned at the time of the events and will gladly provide sworn affidavits, if required, as to veracity of the incidents

The Malaysian public expect holders of high public office to honour their positions accorded by the citizens, by discharging their duties with moral integrity, dignity and transparency.

Their failure to do so rai! ses the publics doubts in their competence and credibilty as much as it demeans those high offices.

PM Najib's tyranny draws focus on bribes, murder

Whom the gods wish to destroy they first make . . . Mad it was for Malaysian Prime Minister Najib Razak to prime the police into thinking days prior that last Saturdays opposition protest in Kuala Lumpur was illegal, and that seized firebomb stashes would have been used. Madder still, for him to have the 20,000 marchers tear-gassed and 1,667 arrested.

The rally was to call for electoral reforms, a domestic issue that attracted only the Malaysian press. But when riot squads aimed teargas canisters at opposition leader Anwar Ibrahims head, actually hitting his aides eye, and causing the fatal heart attack of one demonstrator, the event drew world attention. Now international groups are denouncing the mayhem as proof of Najibs disregard for human rights. Worse, theres sudden global interest in an imminent subpoena of Najib to a Paris trial on kickbacks in purchasing three French submarines in 2002, and the consequent murder of a Mongolian socialite in 2006.


Malaysias parliament will have no choice but to take up the brutal dispersal. Najibs home ministers claim has been debunked that police performed their duties with bravery, fairness and integrity. Narratives jibe that marchers were on their way to a downtown stadium from different parts of the capital when confronted with teargas and chemical-laced water cannons. Even if the storm does not affect next years setting of national polls, the fallout predictably will hurt Najib.


Najib allegedly has concocted sexcapades to bring down arch foe Anwar. Not only has the scheme backfired, Najib is now himself under fire for immorality. Trial is to begin of French arms giant DCN-Armaris for bribery in the 2002 submarine sale to Malaysia through then-defense minister Najib. Commissions supposedly came in three tranches: firsteuro 30 million upon contract signing, then euro 114 million subcontracted to an unknown firm owned by Najibs security adviser Razak Baginda, and last euro 2.5 million. From reports, Najib, Baginda, and their purported shared Mongolian girlfriend Altantuya Sharibu motored around France after sealing the deal. Najib and now London-based Baginda will be summoned to Paris as soon as a judge is assigned to the case this month or next.

The bribery worsened into kidnapping-murder when Altantuya raucously tried to collect her euro 350,000-share from Baginda in 2006. Najibs jealous wife Rosmah forbade the men from paying her a single cent, provoking Altantuya to picket their manor. Two Najib bodyguards abducted the pregnant Altantuya, shot her dead in the woods, and burned the corpse with military explosives. Party mates nevertheless made Najib prime minister in 2009. The bodyguards confessed and were convicted last year; Baginda was acquitted. Prosecutors, defense lawyers, and the judge were forbidden from mentioning the sleazy submarine deal during the trial. Still, Najib got an international black eye.

France has no power to compel the attendance of Najib or Baginda. But it can demand the truth from DCN-Armaris. A Malaysia news portalrecently quoted Kuala Lumpur politicians as saying that if Najib snubs the trial he would in effect tell the world that hes guilty as charged.

And the world will be watching, now that Najib has turned the spotlight on himself with last weekends tyrannical squashing of dissent.

Semua peserta demonstrasi dilayan baik ?

Najib (suami Rosmah), PM serta sepupunya, Hishamuddin, Menteri KDN dan PDRM berkali - kali menyatakan bahawa semua rakyat yang turun menuntut pilihanraya BERSIH dan adil pada 9 Julai 2011 yang lalu dilayan baik. Polis tidak kasar dan ganas.

Nah ini rakaman video bukti semua mereka menipu. Apa nak jadi negara ini dipimpin dengan orang yang selamba menipu. Mereka kata tak tembak hospital kita telah buktikan, ini pula ternyata polis pukul rakyat yang sudah diikat dengan kabel pengikat.

Malaysia semakin hancur dipimpin oleh dua sepupu yang penipu dibantu dengan ketua polis negara yang lemah dan diambil kesempatan oleh timbalan ketua polis negara yang sombong.

Semalam telah diserahkan beberapa bahan bukti yang telah disiarkan dan yang masih disimpan kepada SPRM berkaitan isu belian RM 24.4 juta ,elalui laporan yang telah dibuat di SPRM Pulau Pinang.

Sekarang SPRM harus tampil membuat siasatan dan menyatakan hasil siasatan.

Its too late, Najib

There is a Malay saying to the effect that you can profit from your regret only if you heed it before doing something to cause it. The wisdom of this saying should be hitting Najib and Co as they attempt to repair their battered image in the wake of mindlessly violent suppression of citizens right to peacefully assemble and express their dissatisfaction.

Damage control at this point is just too late. Even as Barisan Nasional called former prime minister Abdullah Ahmad Badawi out of retirement to spew propaganda on its behalf, visual images and eyewitness reports of harsh police action are already all over cyberspace, and condemnations by international organisations and in the foreign press have continued.

Indeed, the Jakarta Post has printed an editorial that supports Bersih 2.0s demands, as if spitting in the face of Foreign Minister Anifah Amin, who is on a damage control trip in Indonesia.

Even the United Nations has accused Malaysian authorities of undermining democracy.

Trying to justify suppression of human rights is hard enough for an administration that claims to be espousing democracy, but the police and members of Najib Tun Razaks cabinet are making it worse by continuing to vilify Bersih 2.0.

Their argument that Opposition Leader Anwar Ibrahim is behind Bersih does not hold water for at least two reasons. One, the steering committee does not include politically affiliated individuals, unlike in Bersih 1.0. Two, Bersih chief S Ambiga publicly told Anwar off after he said he would tell her to call off the rally.

Had Najib given the nod for Bersihs stadium request, he might have made it easier for himself or even boosted his ratings.

The best thing he and his administration can do now is to heal the wounds by working with Bersih and the Election Commi! ssion to wards reform of the electoral system. He may lose support among segments of Umno, especially the old guard, but he can make great long-term gains. He might even stand out as an accomplished statesman.


GANYANG UMNO/APCO DENGAN BERSIH 3.0 PULA?

UMNO/APCO masih tetap dengan sindron penafian mereka terhadap kebangkitan puluhan ribu orang pendemonstran pada 9 Julai 2011 yang lalu. Mereka tidak menganggapnya sebagai satu ancaman. Pihak polis yang sentiasa patuh kepada arahan UMNO/APCO juga tidak mahu mengaku kejahatan yang mereka telah lakukan pada hari itu. Tidak syak lagi bahawa kedegilan-kedegilan semua pihak itulah yang mengembangkan rasa benci rakyat kepada UMNO/APCO.

UMNO/APCO bukan sahaja perlu menerima desakan rakyat supaya menerima semua lapan tuntutan yang diutarakan oleh BERSIH 2.0 itu malahan juga berhenti menjadikan Suruhanjaya Pilihan Raya (SPR) sebagai instrumen kemenangan mereka dalam setiap kali pilihan raya umum. Rakyat mempercayai bahawa belum wujud pilihan raya bersih dan adil di Malaysia jika melihat bukti pelbagai kukuh yang gagal disanggah oleh SPR. Badan yang tidak bebas ini berusaha sehabis daya mengelak daripada memperkatakan isu-isu itu sebaliknya cuba mengalih perhatian rakyat kepada kekangan yang mereka hadapi. Jika demikian keadaannya, kerajaan pimpinan Najiblah yang perlu membuat perubahan kepada perkara-perkara yang dituntut itu. Namun, UMNO/APCO juga bersikap lepas tangan tentang perkara ini walaupun telah dibangkitkan sejak tahun 2007 yang lalu.

Jika keduaan ini berterusan tanpa sebarang perubahan, rakyat yang terdiri daripada segenap lapisan, yakni tua dan muda, tidak akan teragak-agak untuk melancarkan BERSIH 3.0 pula. Presiden PAS sudah mengeluarkan kenyataan bahawa perhimpunan BERSIH 2.0 itu cuma satu permulaan. Maknanya akan ada lagi tunjuk perasaan yang lebih hebat daripada itu. Kali ini PAS yang akan menggerakkannya.

Sebelum kedatangan BERSIH 3.0 rasanya perlulah rakyat Malaysia yang cintakan kedamaian dan keadilan memakai apa-apa saja yang berwarna kuning pada setiap Sabtu agar semangat BERSIH 2.0 sentiasa dilestarikan. Unggun Bersih yang diancam Peludah Warna perlu disemarakkan sehingga semua tuntutan berjaya direalisasikan. Ra! kyat per lu mengajar kerajaan yang nampaknya terus berdegil tidak mahu menghiraukan kemahuan mereka.

UMNO/APCO perlu menerima hakikat bahawa imej mereka tercalar teruk akibat keengganan membenarkan BERSIH 2.0 berdemo di Stadium Merdeka. Pada masa yang sama, pihak polis kini menjadi musuh rakyat. Mereka lebih rela menjadi hamba pemerintah yang tiada integriti daripada melindungi rakyat yang dizalimi. Ironinya, mereka pula yang bertukar menjadi penzalim tegar. Atas nama demokrasi, rakyat tidak akan membenarkan perkara ini berterusan.

Kebangkitan golongan muda dalam perhimpunan BERSIH 2.0 sepatutnya menjadi pengajaran kepada UMNO/APCO bahawa mereka kehilangan sokongan golongan tersebut walaupun Himpunan Sejuta Belia baharu sahaja disempurnakan. Harus diingat bahawa belia yang memenuhi jalan raya sekitar Kuala Lumpur pada 9 Julai lepas jauh melebihi jumlah yang hadir dalam majlis tajaan kerajaan itu. Janganlah memandang rendah tunjuk rasa mereka.

Pakatan Rakyat (PR) perlu memastikan sokongan yang berpihak kepada mereka ini sentiasa dilipatgandakan sehingga tibanya Pilihan Raua Umum Ke-13 (PRU 13). Hanya dengan cara itu Putrajaya dapat ditawan oleh PR. Hal itu tidak lagi mustahil jika benar-benar kena caranya. Komen-komen meraban daripada menteri-menteri UMNO/APCO sekarang ini menampakkan dengan jelas kerisauan yang bersarang dalam benak mereka. Kita perlu sedar bahawa UMNO/APCO tidak mendapat sokongan daripada semua kerabat mereka dalam hal ini. Telah berlaku keretakan hubungan yang ketara antara parti-parti dalam Barisan Nasional (BN) sekarang ini. MCA, MIC, Gerakan, PPP, PBB, PBS, PBRS, SPDP, PRS, LDP, UPCO, dan SUPP hanya membisu seribu bahasa. Peluang terbuka untuk PR mengganyang BN hingga mereka membaham tanah.

11Tung Shin doctors confirm tear gas attack...

Health Minister Dr Liow Tiong Lai's (right) claim that the police shot neither tear gas nor chemical-laced water cannon into the Tung Shin Hospital and the adjacent Maternity Hospital compound as some quarters have purported.

The police meted the same treatment to participants of the Bersih rally elsewhere in Kuala Lumpur last Saturday.

A group of senior medical officers have issued a statement condemning the authorities over the police' attack on participants in the Bersih 2.0 rally last Saturday that had violated universal recognition of hospitals as a place of sanctuary.

In a statement issued to the media late today, the doctors - among whom were a number who were on duty at the Tung Shin and Chinese Maternity hospitals on Jalan Pudu when these were set upon by the police - said they are ready to issue affidavits to back their assertions.

Saying hospitals should be "safe sanctuaries for all" and "consecrated places of refuge and protection" even during war times, the eleven doctors and surgeons also condemned the police for entering the hospital buildings in search of some protesters trying to escape from the police crackdown on the peaceful march.

"What was most frightening and witnessed by many was the unprovoked violent assault within the hospital compounds and apprehension of several protesters who had merely ran into the hospitals to seek shelter from the tear gas and the water cannons!" the doctors said in the jointly-issued statement.

This is the first public statement made by medical officers following the police denial that personnel had shot tear gas into hospital compounds on July 9.

Numerous photos, videos and eye-witness accounts, however, contradict Liow's statements and support reports that water cannon and tear gas canisters were, in fact, shot into the premises, acts that placed patients in the hospitals in danger.

Among the latest to vouch for the latter version of events was the Bar Council, which issued yesterday a report of the observations of its monitors during the rally on Saturday and confirmed the incident.

Signing the statement today were doctors Musa Nordin, Sheikh Johari Bux, Ng Kwee Boon, Ng Swee Choon, Ronald Macoy, David Quek, Mary Cardozo, Farouk Musa, Mazeni Alwi, Pixie Low and Steve Wong.

All of the doctors blasted the authorities for "shamelessly" denying the occurrence of these incidents in spite of photo, video and eye-witness accounts.

"It is repulsive that the authorities entrusted with policing the nation and protecting the weak and needy, have shamelessly denied publicly, the occurrence of these incidents in spite of countless photos, videos and eye-witness accounts of what was evident to all independent observers."

Saying they did not wish to join the polemics in the aftermath of the massive rally called by the electoral reforms group Bersih, the doctors, some of whom were actually visiting or working at the Tung Shin hospitals at the time of the events, said they are ready to provide sworn affidavits "if required, as to the veracity of the incidents."

They also ! also rem inded public office holders to discharge their duties with "moral integrity, dignity and transparency".

"Their failure to do so raises the public's doubt in their competence and credibility as much as it demeans those in the high offices."

KDN hauls up Chinese papers for Berish reports

Editors of Sin Chew, Nanyang Siang Pau and China Press were called to the Home Ministry on Tuesday, apparently about reports favourable to the Bersih 2.0 rally organisers, MalaysiaKini reports. The ministry eventually confirmed that the meeting was held, but brushed it off as a regular meeting.

We have meetings with (editors of) Chinese, Malay and English newspapers from time to time to point out uncomfortable reports, MalaysiaKini quotes Abdul Aziz Md Nor as saying. Aziz is head of the KDN press censorship board, officially called the Publications Control and Quranic text unit.

He had initially denied to MalaysiaKini that any such meeting had taken place, but owned up after KDN secretary-general Mahmood Adam confirmed it. Aziz said the unit had discussed various issues with the editors, refusing to confirm that the meeting was about the reporting on the Bersih 2.0 rally on Saturday.

He also said no verbal warnings had been issued. When pressed as to whether show-cause letters would be issued, he reiterated: I have told you, no warnings.
