The BN government does not want the Bersih rally to happen at all costs. It believes that a mass gathering seeking electoral reform will be a catalyst of an Arab-style uprising which saw dictatorships fall.A.SAMAD SAID
from MalaysiaKini
Preparing to be arrested as the dragnet for Bersih 2.0 supporters widens, national literary laureate A Samad Said urged intellectuals to stop being carma (cari makan) but dare to make a stand against cruelty and injustice.
Speaking at the launch of the latest collections of cartoons by political satirist Zunar at the Chinese Assembly Hall in Kuala Lumpur on Saturday night, Pak Samad said:
Writers seldom take a stand. Most of them are carma and are always prepared to not take a stand. This has caused all the evil to grow and spread tremendously.
Pak Samad, a former editor of the Berita Harian in the 1960s and 1970s, then directed his criticism against editors of mainstream media which have demonised the July 9 rally called by Bersih 2.0 in favour of free and fair elections.
For the mainstream media, Bersih is dirty. Im also surprised, why these experienced pressmen who have won awards here and there, can smear Bersih. I know they are from the carma group.
Fortunately there is still a small number of writers who dare to take a stand, who know that Bersih is pure, Samad (left) told the 250-strong audience who packed the Kuala Lumpur Selangor Chinese Assembly Hall auditorium under the watchful eyes of several plainclothes policemen.
The launch, which had Samad and Lembah Pantai MP cum PKR vice-president Nuruk Izzah Anwar as guests, was held few hours after police detained six Parti Sosialis Malaysia leaders without trial under Emergency Ordinance because of their involvement with foreign elements. They were also said to have subversive tendencies.

In effect, Malaysian politics under Mahathir was like a public toilet with no working flush mechanism. There's nothing more unpleasant than walking into the loo only find Unsinkable Floating Objects in the bowl. With no flush - and no bucket and pail to perform the job manually - we had no choice but resign ourselves to the less-than-delightful odor and the disgusting sight of public servants, fattened on sleazy lucre, who simply refused to resign or retire even when they had long overstayed their welcome.

Memorandum to the Election Commission on
Immediate Electoral Reforms in Malaysia
The Coalition for Clean and Fair Elections (BERSIH 2.0) believes that electoral reform in Malaysia is long overdue. A working democracy is built upon the foundation of clean, free and fair elections. Therefore, the role of the Election Commission (EC) in conducting elections with integrity and impartiality is crucial in the democratisation of the nation.
The recently concluded Sarawak State election was a clear indicator that election offences such as vote-buying and blatant misuse of state apparatus and powers continue unabated. Various parties including election observers have revealed evidence of election offences and irregularities but there is a deafening silence and lack of action from the EC. The Malaysian Anti-Corruption Agency (MACC) has also declined to act on vote-buying.
BERSIH 2.0 views the poor enforcement of the Election Offences Act by the EC during the previous by-elections, state election and general elections as an act of condoning wrong doing. The recent reports of the lack of integrity of the electoral roll, the involuntary movement of voters, and the alleged issuance of identity cards to foreigners are cause for concern.
As there are no marked efforts in instituting meaningful electoral reform, BERSIH 2.0 together with the rakyat are intensifying pressure to ensure that the upcoming 13th General Election will be free, clean and fair. The Perhimpunan BERSIH 2.0 held on this day in Kuala Lumpur seeks to peacefully gather Malaysians to further this noble cause for electoral reforms and upholding of democracy. The reforms sought are reasonable and wholly achievable if the will to uphold democratic ideals is present.
Immedia! te deman ds to the EC for Perhimpunan BERSIH 2.0:
1. Clean the electoral roll
The electoral roll must be immediately revised and updated to ensure existing irregularities such as impersonation and phantom voters are removed.
In the longer term, the EC should also establish an automated voter registration system that will automatically register voters upon eligibility. This system can be synchronised with the national registration database which would update any change of voters details such as addresses.
2. Reform postal ballot
The current system of postal ballot needs to be reformed to address ongoing disenfranchisement of voters. Disenfranchisement of absent voters can be solved by extending the option to vote by postal ballot or in advance to ALL voters if absent from their constituency on polling day, regardless of whether they are in Malaysia or abroad. In addition, police, military and civil servants must vote normally like other voters if not on duty on polling day.
Recent proposed changes to the use of postal ballot made by the EC do not adequately address these issues.
To ensure transparency of the postal voting process, party agents must be allowed to monitor the entire process of postal or advanced voting.
3. Use of indelible ink
Indelible ink must be used in all elections to prevent multiple voting. The EC had in fact made the decision to do this in 2007 and the rumour of sabotage that was used to justify its cancellation in the days leading up to the 12th General Elections has been proven to be completely baseless.
Indelible ink is a simple, inexpensive and effective solution to voter fraud used in other parts of the world to minimise voter fraud. There is no reason whatsoever not to implement this. Failure to do so will lead to the inevitable conclusion that there is every intention in allowing ! voter fr aud.
4. Minimum 21 days campaign period
The EC should stipulate a campaign period of not less than 21 days period. A longer campaign period would allow voters more time to gather information and deliberate on their choices. 21 days is not unreasonable as the British Colonial Government granted a campaign period twice as long, 42 days, in the first national elections in 1955. In the future, the EC should propose for the Elections Act to be amended to such effect.
5. Free and fair access to media
The EC should press for all media agencies especially state-funded media agencies such as Radio and Television Malaysia (RTM) and Bernama, to allocate proportionate and objective coverage for all political parties. Public debates between candidates should be encouraged.
6. Strengthen public institutions
The EC must perform its constitutional duty to act independently and impartially so as to enjoy public confidence. The EC must take independent and proactive measures to uphold the integrity of the electoral process and enforce the Election Offences Act 1954 as mandated by the Elections Act 1958. The ECs repeated mention that they have no power to act is neither accurate in law nor does it inspire the confidence of the people in their ability to fulfil their constitutional role.
Apart from the EC, the public demand that the institutions of this country such as the Judiciary, Attorney-General, Royal Malaysian Police and Malaysian Anti-Corruption Agency (MAC)) act independently, impartially and with integrity at all times in the execution of their duties and in accordance with the Federal Constitution.
7. Stop corruption
The EC must act to stop all forms of vote-buying during elections, including promises of financial allocations for development projects by Federal and State elected representatives holding admini! strative positions during the campaign period. The EC should monitor occurrences of vote-buying and take stern action against those who commit any form of vote-buying.
In relation to many other aspects of public life, corruption remains. According to the Transparency International Corruption Perception Index (TI CPI), Malaysia has continuously regressed in terms of corruption. We have fallen from the score of 5.28 in 1995 to the score of 4.4 in 2010.
Corruption is a scourge that infects every aspects of Malaysian life. The Malaysian public demands that serious action be taken in respect of corruption and not mere token efforts to appease public grouses.
8. Stop dirty politics
Malaysians are tired of dirty politics that has been the main feature of the Malaysian political arena. We demand for all political parties and politicians to put an end to gutter politics. As citizens and voters, we are not interested in gutter politics; we are interested in policies that affect the nation. We believe that the EC can play an effective role in encouraging election campaigns to be conducted in a clean and fair manner.
BERSIH 2.0 calls on the EC to realise its own potential and constitutional duty in bringing the state of democracy in Malaysia to a higher level. In order for the EC to enjoy public confidence, the EC must implement these demands and make sweeping changes towards an electoral system that ensures the will of the citizens asserted through the ballot box is accurately reflected and respected.
Today, on 9 July 2011, BERSIH 2.0 with the rakyat have united in a peaceful assembly to demand for the realisation of these demands towards electoral reform, upholding of democratic ideals and claiming the right to clean, free and fair elections for a better Malaysia.

STOP THE CAMPAIGN OF INTIMIDATION AND HARRASMENT
OF HUMAN RIGHTS DEFENDERS
SUARAM condemns the on-going campaign of intimidation and harassment of human rights defenders by United Malay National Organisation (UMNO) linked organisations and individuals. In the space of less than a week, more than 100 individuals have either been arrested or detained for questioning, peaceful gatherings have been dispersed, yellow t-shirts have been outlawed, and threats of violence have been uttered; all because the Coalition for Free and Fair Elections (Bersih 2.0) has called for a mass rally on 9 July to demand electoral reforms. This intimidation campaign appears to have the tacit approval of the ruling Barisan Nasional (BN) government, as seen in incidents where the Royal Malaysian Police (RMP) allowed thugs to intimidate and harass peaceful gatherings.
Collusion and Tacit Approval?
Several incidents over the past few days point to collusion between state institutions and UMNO to intimidate human rights defenders and the general public from participating in the Bersih 2.0 rally.
27 June
The media reported that UMNO youth members had gathered late at night and threatened to burn down the Parti Keadilan Rakyat (PKR) headquarters. 300 individuals wearing Patriot t-shirts and waving UMNO flags demanded that PKR withdraw its support for the Bersih 2.0 rally. Threats were also made against Anwar Ibrahim (PKRs de facto leader) and S. Ambiga (Bersih 2.0 steering committee member). No action was taken by the police despite there being a police station just a few doors down the road from the party headquarters.
28 June
About 40 Parti Sosialis Malaysia (PSM) supporters were subjected to taunts and verbal abuse from a group of 100 individuals outside the Kepala Batas police station in Pulau Pinang around 9pm.[1] The supporters included! familie s of PSM members who had been remanded for waging war against the Agong. The PSM members had been on a roadshow to expose the corruption of the BN government and also to drum up support for the Bersih 2.0 rally.
The 100-strong group identified themselves as residents of the area, but local eyewitnesses have identified them as UMNO members. Media reports indicate that the police did nothing to protect the PSM supporters, in addition to denying the families visitation rights. The PSM supporters were finally forced to seek shelter at a Parti Islam Se-Malaysia (PAS) markas when the situation became tense.
29 June
Bersih 2.0 Press Conference Disrupted
A Bersih 2.0 press conference conducted near the Pulau Pinang state police headquarters was interrupted by several members from the Suara Anak-Anak Mamak Pulau Pinang, led by its chief, Mohamed Ghani Abd Jiman.[2] The group hurled abuses at members of the civil society coalition, including former state executive councillor Dr Toh Kin Woon. Some of the abuses, as reported by the media were Go back to your country if you want to complain, Dont eat shit eat rice, You seem old and about to die, go home and We are here to protect the law and order, and sovereignty of the country. Police initially did nothing to defuse the situation until George Town police chief ACP Gan Kong Meng intervened much later and asked both parties to leave the area. Mohamed Ghani and his group continued to harass when Dr Toh tried to continue his press conference elsewhere. Earlier, Mohamed Ghanis group had scared off a Bersih 2.0 activist as she was distributing leaflets. She was forced to leave the area, fearing for her safety.
Bersih 2.0 Secretariat Office Raided
Police raided the offices of Persatuan Kesedaran Komuniti Selangor (Empower), seizing Bersih 2.0 related material, which included t-shirts and leaflets, and also arrested 7 individuals for their part in organising an illegal rally. As the raid was! conduct ed without a warrant, the Bersih 2.0 activists did not allow the police to enter the building. The activists finally allowed the police to enter after police officers threatened to force their way in. After being detained for 8 hours, all were eventually released on police bail and will have to report to the district police headquarters on 6 July.
SUARAM is appalled by the arrests and the on-going crackdown on freedom of expression, a fundamental right which is guaranteed under the Universal Declaration of Human Rights and the Federal Constitution of Malaysia.
SUARAM is also extremely disturbed by the lack of civil engagement on the part of the authorities. Very little has been said or done to address the core issue, which is the need for electoral reform to help provide a level playing field for all parties. Instead, the mass media and other government institutions are continually confusing civil society demands with a hidden opposition agenda. Ministers and supposedly independents institutions such as the Election Commission are going out of their way to paint Bersih 2.0 as troublemakers.
SUARAM is also appalled by the attitude shown by the Police in its practice of selective persecution, only targeting those who are in opposition to their political masters. This is unbecoming of a law enforcement agency that is supposed to serve all and protect all, without regard for political affiliations.
SUARAM demands that the government stop this campaign of intimidation against human rights defenders and allow them to continue to exercise their right to freedom of expression.

Dear Sir,
Re: STOP THE INTIMIDATION AND RESPECT CONSTITUTIONAL FREEDOMS
We are writing to you to express our outrage and our strongest condemnation over the on-going campaign of intimidation against human rights defenders and ordinary citizens who wish to exercise their rights to freedom of expression and assembly.
We are appalled by the polices latest actions in arresting and detaining anyone apparently supporting Bersih 2.0. We view this as yet another attempt to intimidate Malaysian citizens from exercising their freedom to express their views. We condemn the actions of the police, who are seemingly practising selective prosecution in the discharge of their duties.
We would like to remind you that freedom of expression and assembly is guaranteed in the Universal Declaration of Human Rights as well as the Federal Constitution of Malaysia.
Yours sincerely,

Deputy Inspector General of Police Khalid Abu Bakar said the six Parti Socialis Malaysia members detained under the Emergency Ordinance were suspected to be involved with foreign elements.
The six, which include Sungai Siput MP Dr Michael Jeyakumar Devaraj (right), have been re-arrested under Section 3 (1) of the Emergency Ordinance 1969. Under the section, a person can be held up to 60 days without trial.
They were re-arrested at 1.20pm today after their remand under section 122 of the Penal Code for allegedly attempting to wage war against the king expired today.
Khalid said based on preliminary information, all the six were suspected to be involved with foreign elements and had subversive tendencies.
Asked to elaborate, Khalid said: "That is why we re-arrested them, so that more investigations can be carried out... for now were are unable to reveal more information."
"Police re-arrested them to prevent any crimes of a violent nature from happening besides allowing us to do follow-up investigations," he told reporters at the federal police headquarters in Bukit Aman.
Extension of remand to 24 others
Khalid said police would also be applying to the court to extend the remand order on the remaining 24 people because some more investigations needed to be done.
He added that the number of people detained across the country in connection with illegal street demonstrations planned for July 9 now stood at 150.
Meanwhile, on the detention of Selangor state executive councillor Ronnie Liu at midnight yesterday, he said it was because Liu had allegedly incited people to join the July 9 illegal street demonstrations while speaking before a gathering in Hulu Selangor.
Khalid also said that as of yesterday, a total of 2,389 police rep! orts wer e lodged throughout the country by civil society groups and individuals in protest of the July 9 street demonstrations.

'Better to just lose one person than to lose a lot of lives.'
Malacca Chief Minister Ali Rustam has called on the federal government to strip Bersih 2.0 steering committee chairperson S Ambiga of her citizenship.
Speaking to reporters after chairing the Malaysian National Silat Federation (Pesaka) meeting, of which he is the president, Ali said that a person who is hell-bent on "causing chaos in the country" does not deserve to citizenship.
"Some of the members have asked for her citizenship to be revoked or to have her exiled.
"Better to just lose one person than to lose a lot of lives," he said, adding that it was merely a suggestion to the federal government to "take the harshest punishment against her".
"And now she wants to be a hero. If she thinks that we should have democracy by going on demonstrations like the way other countries do, then let her be the citizen of another country," said Ali, who is former Umno vice-president.
At the fiery press conference in Kelab Sultan Sulaiman, Kampung Baru this afternoon, another Pesaka member shouted that she was a traitor, drawing roars of approval from other members.
Pesaka is an umbrella body for the more than 300 silat bodies nationwide, claiming to represent four million silat exponents.
The mahaguru (grandmaster) of the Persatuan Seni Silat Lincah Malaysia, Omardin Mauju had previously announced that the silat exponents will be waging war with the Bersih activists come the massive rally on July 9.
'Ambiga has to bear all responsibility'
Also present at the function, Omardin said that Pesaka members will be marching in Umno Yo! uth's 'P atriot' rally timed with Bersih's, to "defend the Istana Negara".
"But if she doesn't proceed with the rally, then we won't go also," he said.
However, Ali said that they nor the public should not be blamed if chaos were to ensue.
"I am worried that a May 13 may reoccur. This is in our history, we have been through this before so it should not be taken lightly. Maybe the younger generation are not aware of this.
I worry that Pesaka will not be able to control the emotions of its members. In the meeting just now, I can see that our members are also on fire already. If anything happens to anyone, we should not be blamed. Ambiga has to bear all responsibility," he said.
However, Ali played down the earlier threats of "waging war", saying that they will only rally if the Bersih demonstration were to proceed.
Omardin chipped in, saying that they will not be the ones to strike the first blow.
"For us silat exponents, our instinct is to defend ourselves. If they don't kacau us, then we will leave them alone. If they were to provoke or harass us, then be prepared for us to fight back.
We just want to defend the Istana Negara since silat is about defending Islam and the Malay race," he said, adding that they would not be joining Malay rights NGO Perkasa in their rally on the same day.
July 9 will see three separate rallies by Bersih 2.0, Umno Youth and Perkasa.
While Bersih supporters are expected to march to Istana Negara to hand over a petition calling for electoral reforms, the other two bodies will be to protest their demonstration.
Also at the press conference were Umno Y! outh inf ormation chief Reezal Merican Naina Merican in the bright red 'Patriot' t-shirt.
During the one-and-a-half hour closed door meeting with 211 silat teachers, two policemen were seen milling around Kelab Sultan Sulaiman for several minutes before leaving.
The Registrar of Societies has declared Bersih - or The Coalition for Clean and Fair Elections - an unlawful organisation effective from Friday, said ROS director-general Abdul Rahman Othman.
Fears a people's uprising especially amongst the MalaysAli Baba in the Malaysian business world is a term normally used to describe main-contractors who grab contracts and then pass them down to other companies, normally after pocketing a nice profit without lifting a finger.
And Najib Razak is arguably the biggest Ali Baba practitioner in Malaysia.
It is not just the dirt flying high and low from the purchase of the Scorpene submarines, for which French authorities are now investigating kickbacks to his his friend Razak Bagindas Perimekar but the Ali Baba practice also extends to the way he governs Malaysia.
Right now, Najib Razak has sub-contracted the governing of Malaysia to his cousin, Hishamuddin Hussein, UMNO roughneck-groups such as Perkasa, and the Inspector-General of Police.
In Najibs ying-and-yang concept of reality, only good things should be associated with him. All the rest of the manure and faeces should be thrown over to the hired help.
More likely than not, Najib learnt this skill during his days of thunder in 1987-1989, when as UMNO Youth chief, he led an illegal assembly in Kampung Baru. And to his everlasting shame, it was there that he uttered the promise to bathe this Keris with Chinese blood.
Not the sort of press you would want when you are prime minister. And Najib has learnt through the years to hunger for the limelight. His ego, never small, has ballooned thanks to encouragement from his equally wants-to-be-loved spouse, Rosmah Mansor.
During the Sarawak Election of April 2011, whenever Najib was in town, the authorities went to great pains to maximise his airtime without Chief Minister Taib Mahmud in the picture. On most walk-abouts and BN rallies, Taib was intentionally left out so that Najib could be the peoples hero.
This preoccupation with maintaining a good image has hampered his inability to lead as a leader. Of course, there are those who say it is not just about good image but that it only shows Najib is a political coward and incapable of making decisio! ns.
< p>Be that as it may, Najib will only be seen making the good and right decisions. He can only be seen playing good guy and no viliian roles for him. Hence, the directive by the authorities to tar the Bersih march as an illegal rally.Wilder than Bigfoot
Bersih 2.0 can be credited for letting loose some of the wildest and most absurd stories imagNot even inable, even outshining the one-time idea that Bigfoot was running wild in the wilderness of Johor.
The nation has gone crazy under the weight of the UMNO spin and its media apparatus have released just about everything it has to demonize and paint the Bersih march black.
The Malaysian police have cooked up a story that Communist elements are making a comeback to mainstream politics in Malaysia. Cuba would be happy to hear this. It is also worth noting that China, which Najib now professes to admire, has just celebrated the 90th anniversary of its communist party. So what sort of mixed signals is Najib sending?
Really, it is waste of time figuring out because it is just an excuse. Who wants to be slowed down by being a Commie in this day and age? Only Cuba is still staunchly holding onto the idealism of Communism to the hilt. Even China has converted itself into a form of Capitalistic-Communism whereby they now have a growing number of filthy rich businessmen eager to take on the world economy. But really, that is not the point for Najib and the Malaysian authorities.
The fact is they really lack the grey matter that usually resides in the cranium. Penang police grabbed whatever excuse they could lay their hands on and to make it even more offensive, the court upheld their decision to save them embarrassment. Not a thought was spared to the 30 ethnic Indian activists who have to suffer the rotten conditions of the police lock-ups. Is this not institutionalised bullying and racism?
The real bad guys
Then, the questioning of national laureate A Samad Said by the police under S! ection 4 (1)(b) of the Sedition Act 1948 and Section 27(5) of the Police Act 1967, which relate to unlawful assembly. Such a move should be viewed as an attempt to gag all writers in Malaysia.
So far, the actions taken by Najib, his cousin Hishammuddin and the police mirror those by Communist forces in Russia, China and the Khmer Rouge, which went to great lengths to imprison and murder not just writers and poets. But also thinkers, political activists, dissidents and basically anyone who got in their way.
At a time when Malaysia is going through intellectual-bankruptcy, censorship will only backfire. It wont help in the efforts to build a knowledgeable and smart society. Instead, the Government of Malaysia has created an environment that repels intellectuals and induces fear in all artisans.
And a nation that stifles and kills its artisans is a nation without a soul.
A nation that confines its writers, poets and thinkers is a nation empty and void of any substance.
It is an empty shell of a society, without any sparkle of ingenuity or inspiration.
Tell us if we are wrong. Is it not then, the supporters of Bersih who are not acting like Communists but rather the police under instructions from a running-scared prime minister and UMNO-BN government.
Yoda from the Jedi Council and Harry Potters twin brother
UMNO-owned Utusan newspaper has found it convenient to blame Christians for supporting Bersih 2.0. After demonizing Bersih chief Ambiga Sreenevasan as anti-Islam, the UMNO-owned newspaper reported that the group calling for electoral reforms was being funded by foreigners such as the Konrad Adenauer Foundation from Germany and the Canadian Allied Foundation.
How Utusan made the connection between Christians and the Konrad Adenauer Foundation and the Canadian Allied Foundation is beyond reason. It is like saying Yoda from the Jedi Council in Star Wars was Harry Potters twin brother.
Yet, the Malaysian Strategic Research Centre too had str! ong ties with the Konrad Adenauer Foundation. The MSRC was formed by Razak Baginda, Najibs good friend and alleged proxy in the purchase of RM7 billion Scorpene submarines. He was also controversially acquitted of abetting in the murder of Altantuya Shaariibuu, a beautiful 28-year old translator who allegedly was also mistress to both the men.
Once again, Utusan and Najib have shot themselves in the foot. From stirring racial and religious tensions to spinning outright lie, both are now disgraced. At least Utusan is just a tool, a hireling. Whereas Najib is the the PM, the leader of the nation. Who should be responsible when the chips are tallied up.
The same goes for IGP Ismail Omar and Hisham too, despite the blood ties. For should there be tragedy or bloodshed, Malaysians wont allow anyone to get away anymore. So think carefully, do not blindly follow orders. And to those who issue, do not be too sure you wont be held be responsible just because you delegated the bad-guy role to your juniors.
Monsters in just 2 years
And while the nation crashes and burn under all the UMNO madness, where is Najib Razak the Prime Minister who spun the 1Malaysia slogan? Where is Najib Razak as the Prime Minister for all Malaysians?
Sad to say, he has disappeared amid the madness. The Najib administration has effectively removed all forms of civil rights belonging to the citizens of Malaysia as guaranteed under the Federal Constitution.
In his by-now twisted mind, Najib feels justified to take away these liberties in exchange for his stay in power. Power corrupts and absolute power corrupts absolutely. Imagine, it only took 2 years or so to create such monsters in Najib and Rosmah. What would happen if they were allowed to stay on?
