Bersih 2.0 Press statement : Najib needs to protect human rights

The Prime Minister of Malaysia that his first and foremost duty is to protect the welfare and human rights of all Malaysians.

In light of this, Bersih 2.0 is deeply saddened and disappointed by YAB Najib Razaks declaration that supporters of the Bersih 2.0 rally are to be held responsible should chaos ensue on the 9th of July.

At every stage, Bersih 2.0 has continuously repeated its firm commitment to completely peaceful and principled activism. Bersih 2.0 has always renounced violence in any way, shape or form, and consistently called upon others to adhere to the same values. Civil society has never once been responsible for turning a peaceful gathering into anything more.

In gathering peacefully on the 9th of July, Malaysians from all ethnic, religious and political backgrounds are exercising their constitutional right to have their voices heard in a democratic, non-violent manner.

Guaranteeing the safety of these patriotic citizens is in fact the responsibility of the government that the Prime Minister himself leads. We are glad that the Prime Minister has finally broken his silence regarding the 9th of July, but are disappointed that instead of fulfilling his governments role as the protector of the constitutional rights and safety of peace loving Malaysians, he has chosen instead to misrepresent our intentions and wield the dark sceptre of unwarranted repressive consequences.

Bersih 2.0 is equally disappointed at the accusation that the purpose of Bersih 2.0 is to wrest back political momentum from the BN.

The Prime Minister must have either failed to have read and understood our stated goals, or is deliberately putting Bersih 2.0 in a misleading light. As a movement, we have no interest whatsoever in the political momen! tum of a ny political party our goal is to make the electoral system truly free and fair so that all political parties in Malaysia, bar none, can contest on a level playing field, where the rakyat can freely choose whoever they think is best to lead them.

We have time and time again invited Barisan Nasional to be part of this process as we truly value the support of any and all groups to help bring about a more just Malaysia for all. We invite the government of the day to reject any paranoia, which may lead to the view that this movement disadvantages them in any way and instead walk with us towards bring about the badly needed changes expressed in our 8 points.

Indeed, this is the perfect opportunity for the Prime Minister to demonstrate the progressive views he has espoused both at home and abroad. He can conclusively do so simply by allowing the July 9th rally to proceed unhindered and by directing all government agencies to cooperate fully with all involved to ensure that that each and every Malaysian wishing to exercise their constitutional right may do so without any fear of clashes or chaos.

We feel that this would be the best use of the energies and resources of the police, who have continued to thoroughly perplex observers both locally and abroad by arresting patriotic, peace-loving Bersih 2.0 supporters for waging war against the monarch. Surely this stark and alarming lack of logic and common sense will further tarnish our nations image and contradict the values championed by the Prime Minister and his government.

We agree with the sentiment informing the Prime Ministers statement that political power is in the hands of the people. However, it is our considered view that until comprehensive reforms are introduced into the electoral system to make it free and fair, political power will remain in the hands of a select few, and not Malaysians at large.

Bersih 2.0 is of the view that these two weeks will be a defining moment for the Prime Minister and his government. As ! the fina l authority in the government, any crackdown on civil society, refusal to guarantee the safety of Malaysians on July 9th, or rhetoric that unfairly demonises patriotic, peace loving citizens will be a tragic reflection of the failure of the Prime Minister to live up to their promises and the responsibilities entrusted to them by the Malaysian people.

Alternatively, for the Prime Minister to firstly, work together with Bersih 2.0 in pursuit of goals that are completely non-partisan and in accordance with the most basic of civil and human rights and secondly, guarantee a peaceful day free from violence of any sort on the 9th of July, will be the best possible demonstration of a firm commitment to the true spirit of 1Malaysia. We once again make an open, sincere and heartfelt call to the Prime Minister to walk with the rakyat, not against us.

Furious Hadi orders 1 million PAS members to attend Bersih


Corrupt Barisan Nasional : UMNO has had it easy for too long. So has the BN coalition it heads. Prime Minister Najib Razak has not been shy to bully his way through using the might of the government machinery and the institutions of authority to maintain his momentum.
But with the next general election on the way, the Pakatan Rakyat led by Opposition Leader Anwar Ibrahim is starting to show its long-held-back muscle. Leaders all three component parties PAS, PKR and DAP have declared their unreserved support for the Bersih 2.0 rally organised by 62 of the country's most established NGOs.
The rally is mean to be a citizens' march for democracy, culiminating with the delivery of a memorandum to the King, demanding free and fair elections. But Najib and his UMNO party believe that the march is a slap in the face to his leadership.

They have been accused of resorting to unsavory means that include, threatening ethnic cleansing against the Malaysian Chinese, "preventive arrests" and most lately, death threats were issued against Bersih organising chairman Ambiga Sreenevasan, the former head of the Bar Council and a receipent of the prestigious International Women of Courage Award.
That was the last straw.
1,000,000 members from PAS
In a rare show of silent fury, PAS president Hadi Awang ordered all one million of its members to join the Bersih 2.0 slated for July 9. So too will Opposition Leader Anwar Ibrahim order PKR members and it is expected that DAP will also encourage its supporters to join unrreservedly and without fear.
I call on all PAS members supporters to join the Bersih rally on July 9 to demand for cl! ean and fair elections, said PAS president Hadi Awang.
This is not the first time he has declared support for the rally. Earlier this month, the PAS central committee endorsed a motion by its newly-minted deputy president Mohamad Sabu to send 300,000 members.
Hadi reiterated the 8 reforms demanded by Bersih were noble and just, in line with social justice espoused in Islam.
Another famous cleric, Dr Asri Zainul Abidin, also said the same a day ago. Asri had also warned the authorities not to use underhanded means to disrupt the rally.
Stand up and speak up for yourselves
At a press conference earlier today, Anwar called on Malaysians to stand up to UMNO and the BN, urging them to reject the racial and gutter politicking practised by their leaders to cling to power.
"We are clearly disgusted. But what is worse, it is not only about the purveyors but the fact that this system seeks to condone, allow and publicise this. So, all the more reason why members of the public must take a position. Enough of this racist rhetoric and nonsense. We have to speak up, said Anwar.
DAP adviser Lim Kit Siang, who was also present, was just as fiery in his words. The veteran leader accused Najib of plunging Malaysia into its lowest ebb, where democracy and civil rights had the least space, racial polarization the most worst in 5 decades, while the economy faced bankruptcy by 2019 - as forecast by the government's own analysts.
"We see in the country this vile extremism rearing its ugly head. These were unheard of in the past, the open threat of assassination is now developing as the latest form of extremism, said Kit Siang.
If they had taken proper steps to ensure that moderates can have their rightful place in the country and clamp down on such extremism, Malaysia would not be in the sorry state that it is in today. Instead of the home minister, police, together with other political leaders making baseless t! hreats."
Appends below the 8 reforms drawn up and demanded on behalf of Malaysians by the the Bersih steering committee:
1. Clean the electoral roll
The electoral roll is marred with irregularities such as deceased persons and multiple persons registered under a single address or non-existent addresses. The electoral roll must be revised and updated to wipe out these phantom voters. The rakyat have a right to an electoral roll that is an accurate reflection of the voting population.
In the longer term, BERSIH 2.0 also calls for the EC to implement an automated voter registration system upon eligibility to reduce irregularities.
2. Reform postal ballot
The current postal ballot system must be reformed to ensure that all citizens of Malaysia are able to exercise their right to vote. Postal ballot should not only be open for all Malaysian citizens living abroad, but also for those within the country who cannot be physically present in their voting constituency on polling day. Police, military and civil servants too must vote normally like other voters if not on duty on polling day.
The postal ballot system must be transparent. Party agents should be allowed to monitor the entire process of postal voting.
3. Use of indelible ink
Indelible ink must be used in all elections. It is a simple, affordable and effective solution in preventing voter fraud. In 2007, the EC decided to implement the use of indelible ink. However, in the final days leading up to the 12th General Elections, the EC decided to withdraw the use of indelible ink citing legal reasons and rumours of sabotage.
BERSIH 2.0 demands for indelible ink to be used for all the upcoming elections. Failure to do so will lead to the inevitable conclusion that there is an intention to allow voter fraud.
4. Minimum 21 days campaign period
The EC should stipulate a campaign period of not less than 21! days. A longer campaign period would allow voters more time to gather information and deliberate on their choices. It will also allow candidates more time to disseminate information to rural areas. The first national elections in 1955 under the British Colonial Government had a campaign period of 42 days but the campaign period for 12th GE in 2008 was a mere 8 days.
5. Free and fair access to media
It is no secret that the Malaysian mainstream media fails to practice proportionate, fair and objective reporting for political parties of all divide. BERSIH 2.0 calls on the EC to press for all media agencies, especially state-funded media agencies such as Radio and Television Malaysia (RTM) and Bernama to allocate proportionate and objective coverage for all potlical parties.
6. Strengthen public institutions
Public institutions must act independently and impartially in upholding the rule of law and democracy. Public institutions such as the Judiciary, Attorney-General, Malaysian Anti-Corruption Agency (MACC), Police and the EC must be reformed to act independently, uphold laws and protect human rights.
In particular, the EC must perform its constitutional duty to act independently and impartially so as to enjoy public confidence. The EC cannot continue to claim that they have no power to act, as the law provides for sufficient powers to institute a credible electoral system.
7. Stop corruption
Corruption is a disease that has infected every aspect of Malaysian life. BERSIH 2.0 and the rakyat demand for an end to all forms of corruption. Current efforts to eradicate corruption are mere tokens to appease public grouses. We demand that serious action is taken against ALL allegations of corruption, including vote buying.
8. Stop dirty politics
Malaysians are tired of dirty politics that has been the main feature of the Malaysian political arena. We demand for all political parties and polit! icians t o put an end to gutter politics. As citizens and voters, we are not interested in gutter politics; we are interested in policies that affect the nation.

And of course, the name of Chin Peng will be all over. I must say the Najib administration and the police are quite imaginative. They have gone one step further than the dictators and autocrats in Algeria or Syria, reviving the bogey of communism.

This gambit is aimed directly at the Malay electorate, hoping that this story about waging war against a Malay Ruler and the spectre of communism will tarnish Bersih and perhaps create confusion among PAS supporters as well as convince Malays that they should steer clear of Bersih.

I mean so far the government has portrayed Ambiga Sreenivasan as anti-Islam and anti-Malay. Over the next few days, serious looking ministers will be quoted on the national security threat facing the country.

Of course, this is all wayang. The threat, if any, comes from the morally-bankrupt Umno. History is replete with dictators and autocrats using all sorts of bogeymen to stay in power. Zimbabwes Robert Mugabe is a master at this craft.

The biggest threat to our country comes from this collection of Umno politicians who want to cling to power. If innocent people ! need to be locked up, so be it. If people need to be fixed up, so be it. If fathers and mothers need to be detained, so be it.

This plot to revive communism is as plausible as the plan by Christians to take over Malaysia. (Also hatched by Umno). We are entering a dark period in Malaysian history but we should not despair.

BERSIH 2.0 & KOTOR Tactics Propaganda games!

  • Any living persons with brains and with fair ability to think can make the assessment on what BERSIH is all about. Civil liberties groups are demanding that the EC does their job professionally. Since the day I started voting, I have yet to see a fairly conducted election in Malaysia be it during the GE or the BE (By-elections). Despite the abuses, cheatings and vote rigging and the unprofessional conduct of election, PR managed to rule 5 states. The reality is if election is fair, BN has been booted out even when TDM was the PM.

  • Why doesnt BN want this rally? I believe the answer is obvious i.e. the loss of power. The rally will bring out the best in the people to think and to do the right thing. People will come out in droves to vote and the action of EC will be monitored at every polling station on minute by minute basis. For the record that is one of the many reasons that Selangor was lost during the last GE.

  • Over the last 2 weeks the MSM has started their propagandas. From a walk, it has been transformed to a movement to overthrow the government like in the Middle East. If people want to overthrow government, they would organize it discretely and gathering would appear without warning. The latest news that PSM members who were en-route to Penang were detained for waging war against the king.

  • The police said that they are probing an alleged attempt by some BERSIH activists to revive communism, and are investigating 30 Parti Sosialis Malaysia (PSM) members, including Sungai Siput MP Dr Michael Jayakumar for waging war against the Yang DiPertuan Agong. This is the most ridiculous allegation to-date especially when communism is failing all over the world! What is clear is that the propaganda has been escalated to th! e next l evel especially the people here have no compassion for communism. I have a strong feeling that in the next few days, ex-serviceman will be interviewed and soldiers will begin to condemn the walk.

  • To those that are walking on the 9th of July, may I suggest that you contribute in small way to the economy. Buy a stalk of rose or buy some can drinks or biscuits and give it to every policeman that you meet along the way. We must appreciate that the lower rank policeman are merely following orders. I think the SB of the RMP is losing their skills on psych war. They may have just to recall the 85 year old, Tan Sri Yuen Yuet Leng. Reviving communism! What a load of bull!


  • Kit Siang - Pakatan sasar 11 negeri....

    Pakatan Rakyat meletakkan sasaran untuk menguasai 11 negeri tambahan enam negeri pada pilihan raya umum ke-13, kata pemimpin veterannya Lim Kit Siang.

    Justeru Penasihat DAP itu berkata, perikatan tiga parti tersebut mahu mempertahankan Pulau Pinang, Kedah, Selangor, Kelantan dan menawan balik Perak. Lim juga berkata, Pakatan Rakyat meletakkan sasaran untuk menawan Negeri Sembilan, Johor, Melaka, Pahang, Terengganu dan Perlis daripada penguasaan Barisan Nasional (BN).
    Pakatan Rakyat ada tiga sasaran di peringkat negeri dalam pilihan raya umum akan datang, kata Ahli Parlimen ini.

    Pilihan raya umum ke-13 akan menjadi pertempuran abad ini memandangkan sasarannya bukan sahaja 11 negeri di Semenanjung, tetapi juga kuasa persekutuan di Putrajaya, kata Lim pada satu majlis di Teluk Intan, Perak malam tadi.

    Lim berkata Perdana Menteri Datuk Seri Najib Razak sedar tentang sasaran besar itu dalam pilihan raya umum akan datang dan oleh itu, presiden Umno tersebut mengingatkan ahli-ahlinya tentang tidak wujud istilah naib johan dalam arena politik.

    Lim berkata, Najib yang juga Pengerusi BN sedar sepenuhnya bahawa peralihan lima peratus undi dalam pilihan raya umum akan datang berbanding pilihan raya umum 2008 akan menyaksikan kemunculan kerajaan Pakatan Rakyat di Putrajaya.

    (Sebaliknya) Umno dan BN akan mengambil tempat di barisan pembangkang di Parlimen, katanya sambil berkata, keadaan yang sama terpakai di peringkat negeri.! < br>
    Pada pilihan raya umum ke-12 Mac 2008, BN kehilangan majoriti dua pertiga di Parlimen dan kerajaan di lima negeri pula diketuai oleh Pakatan Rakyat iaitu Selangor, Pulau Pinang, Kelantan, Kedah dan Perak.

    Pakatan Rakyat terdiri daripada PAS, PKR dan DAP. Bagaimanapun Perak diambil alih oleh BN selepas tiga wakil rakyat Pakatan Rakyat keluar parti awal 2009. Lim memberikan pandangan itu ketika Himpunan Bersih 2.0 dirancang untuk diadakan 9 Julai ini.

    Justeru Lim menambah, jika BN terus menggunakan pendekatan tidak demoktratik dan menekan rakyat termasuk ke atas Himpunan Bersih 2.0, maka mereka akan mewujudkan satu persekitaran di mana lima peratus undi menentang Umno dan BN dalam pilihan raya umum akan datang. Dalam ucapannya itu, Lim berkata beliau menolak kemungkinan pilihan raya umum ke-13 akan diadakan pada suku ketiga tahun ini.

    Saya fikir kita boleh menolak kemungkinan bahawa pilihan raya umum akan diadakan pada suku ketiga tahun ini. Pilihan raya umum akan datang akan diadakan sama ada akhir tahun ini atau tahun depan, katanya.

    Anwar Ibrahim has poured scorn over the prime minister's remark that 'finding the truth" was most important in determining whether the man in a sex video was indeed him.

    Since foreign experts had reportedly said the video - showing a couple on a sexual romp in a room - resembled Anwar 99.99 percent, Prime Minister Najib Abdul Razak had said that the people could judge for themselves as to the authenticity of the tape.


    Anwar said Najib and his spouse Rosmah Mansor are not fit to speak about morals, although he did not explain in detail why he made such a snide remark.

    "I have been challenged to reveal what I know about Port Dickson," said Anwar, at a ceramah in Pokok Sena last night.

    "But it is not my style to insult (cerca) or fitnah (slander) others just because I want to win," added the Permatang Pauh parliamentarian.

    "I want to win with good morals intact," he quipped in front of the 700-strong crowd. Najib was rumoured to have been caught in a hotel room with a celebrity in Port Dickson, Negeri Sembilan, many years ago. The incident has since become an urban legend.

    Anwar then lamented that the government under Najib has not responded properly to all the issues raised by the Opposition.

    These grievances include issues of bad governance like blatant corruption within the civil service, frequent price hikes of essential goods, subsidies to independent power producers (IPPs) and the mysterious disappearance of bumiputera shares amounting to RM52 billion. Rather than clarifying on these issues, he said, but BN resorts to throwing slander against the Opposition.

    "I am not defending myself. I am resigned (pasrah) to the fact that t! here is one after another slander thrown at me. They will not stop as long as I have not died," he said.

    "I have been stripped naked, beaten and imprisoned... bastards!," he decried, asking, what more were his detractors planning against him.

    He also condemned the outcome of the recent court case whereby the 'Datuk T' trio who exposed the video were charged and pleaded guilty for distributing porn.

    Businessman Shazryl Eskay Abdullah and former Perkasa treasurer Shuib Lazim were jointly charged with possession and distribution of pornography under Section 292(a) of the Penal Code, and fined RM3,000 and RM1,500 or three months jail respectively.

    Meanwhile, former Malacca chief minister Rahim Thamby Chik was charged with abetment under Section 109 of the Penal Code and fine RM1,000 or one month's jail.

    During the court session, counsel for Rahim, Muhammad Shafee Abdullah said that US video experts consulted by the Malaysian police had compared images of the man in the video with a photo of Anwar and confirmed that both were identical as much as 99.99 percent.

    The figure was not stated in the statement of facts, which was read out in open court. A copy of the statement of facts obtained by Malaysiakini also showed that the figure had been blanked out.

    "In court the other day, the defense lawyer (pembela) became the prosecutor (pendakwaraya). He was not defending the trio but instead he whacked me," said Anwar.

    "To plant doubt in the minds of people about me. So how do we deal with them? Do you think that since they have stripped me naked, I would do the same to them? No!" he exclaimed.

    "We would seek for change, and if we do tak! e over P utrajaya, we would change the name of the government of Malaysia to 'Government of the Malaysian People'," he promised. Anwar also expressed hopelessness in the mainstream media for their slant against the Opposition.

    Acording to him, a TV editor recently approached his wife, PKR president Dr Wan Azizah Wan Ismail, and himself at a mosque in Shah Alam, where the former tendered an apology.

    The editor, who Anwar declined to identify, had purportedly said to the duo "I know it is slander and sinful but I did it (put the news about Anwar on Tv). I have no choice, I have to survive".

    Anwar said he told the man to "Ask forgiveness from Allah, not from me".

    "But I am comforted by the fact that there are still people in the mainstream media who have a little conscience," he added.

    "Only a leader without morals will use a sex video to win over his opponents," he said.

    Intelligent politicians, please

    Wanted: some individuals with some modicum of intelligence and competence to lead Malaysia.

    Muhyiddin Yassin and Shafie Apdal (among Umnos best and brightest judging by fact that one is the second in line to govern the country and the other is the third in line) need not apply.

    The two senior ministers are evidence of how hollow the ranks of leaders in Umno are. Today, Shafie Apdal gave credence to the line that it is best to keep silent and keep up the illusion of competence rather than open your mouth and shatter it.

    Now everyone with primary education knows that the Bersih rally is about highligthing election fraud and forcing the government to play fair. This means that the current system is skewed and untrustworthy.

    Easy to understand? Not for Shafie Apdal. He says that instead of demonstrating Pakatan Rakyat state governments in Kelantan, Penang, Selangor and Kedah should dissolve the state assemblies and contest the polls.

    Now why would they do that when they dont have trust in the fairness of the election system. It is precisely because of election fraud that the Pakatan Rakyat state governments know that they are fighting with one hand tied behind their backs.

    So for Shafie to offer this pearl of wisdom only means that he either chooses not to understand what Bersih is about or he is just plain unintelligent. But he does not have to worry very much ab! out losi ng out to Muhyiddin. This politician is not the brightest spark in the room either.

    He says that the government knows that the Bersih rally is all about politics. Wow, this is really enlightening.

    And stuffing the ballot box, phantom voters and widening the base of postal voters is about what, exactly. Is it about keeping Muhyiddin, Shafie, Noh Omar, Hishammuddin Hussein, Khaled Nordin, Kong Chong Ha, Ng Yen Yen, Palanivel, Nazri Aziz employed?

    The fact that is shocking is that not only do we have to deal with corruption, abuse of power. But we are asked to suffer fools.

    We would not tolerate some of these people as our subordinates. Why are we letting them govern us?

    Heres proof that old editors never fade away, they only wait for the next editionPJ Joshua, editor of the Sunday Mail and Malay Mail in the early 1970s, giving a once-over to early proofs of New Straits Times pages on Friday and sharing a pointer or two with Theresa Manavalan, editor of the New Sunday Timess magazine section.

    PJ Joshua was among more than 30 former journalists of the Straits Times Malaysia and the New Straits Times who visited Balai Berita on Friday for a tea party hosted by the newspaper. They were welcomed by Nuraina Samad, managing editor, Zainul Ariffin, group editor in chief, and Anthony Bujang, the CEO.

    Nuraina is the daughter of NST and Berita Harian legend A Samad Ismail, who held the same position in the 1970s before he was detained under the Internal Security Act by the Hussein Onn government as part of a power struggle among Umno leaders, aided and abetted by Singaporean elements.

    Pak Samad was a mentor to many of those present at the tea party and one of those directly involved in the split of the Singapore-based Straits Times and the Umno takeover of its Malaysian half.

    The veterans are among more than 110 who will attend a reunion gathering and dinner in Petaling Jaya today. Many now live abroad: PJ Joshua has lived in Sydney since the 1970s after leaving the Malay Mail, and still works at a newspaper. He has since published a novel.

    Open Letter to IGP Tan Sri Ismail Omar

    Dear Tan Sri,

    I understand you are a very busy man to answer or rather reply your mails. But if you are to do your job properly that is befitting to your position: your first priority is to read, understand and to reply. My friends said you NO UNDERSTAND ENGLISH so you just throw everything that are English into the bin.

    To me you are typical Government Servant who NEVER reply full stop.

    But today is not about your tidak apa attitude but rather a disturbing fact that like the previous IGP you are BIASED.

    I have complaint several times to Bukit Aman about the gambling dens in Jalan Belangkas, Off Kg Pandan that belong to the Police and UMNO bastards. Even at the recent meeting with the Police and surau members in Taman Maluri, the issue of the growing number of gambling dens was brought up. Till today nothing has been done to curb or close down these gambling dens. At the end of the day, it is the Malay Youth in Desa Pandan, Taman Maluri, Ampang, Pandan Indah, Pandah Jaya, Cempaka and other neigbouring Taman that will turn to crime to maintain their living. The crime rate around these mentioned areas have increased. So what Hisham and your Department are claiming is just one BIG LIE.

    Yesterday I was lucky not arrested for wearing the Bersih T-shirt walking in Chow Kit, Brickfields and Puduraya. But some unfortunate friends are arrested. What is their crime may I ask?

    When Perkasa and other Brainless Malay Youth Gang go on rampage and stage Protest everywhere. That is okay and even given a helping hand by the Police Force. At no time was a POLICE PERMIT given or applied for.

    So Tan! Sri don t be a dog and remember that you will live to regret that your own flesh and blood will be involve in illegal activities in my area and some of them might live like caged animals being ill-treated by Perkasa and the Brainless Malay Youth Gang.

    Pakatans three targets for next GE

    Pakatan Rakyat has three targets for the states in the next general elections, viz:

    • To retain the four Pakatan Rakyat states of Penang, Kedah, Selangor and Kelantan;
    • To win back Perak state government which was illegally, unconstitutionally and undemocratically robbed from the people and the Pakatan Rakyat; and
    • To form the state government in the six states of Negri Sembilan, Johore, Malacca, Pahang, Terengganu and Perlis.

    The forthcoming 13th general election will be the battle of the century as at stake will not only be the state governments of all the 11 states in Peninsular Malaysia but federal power in Putrajaya as well.

    Prime Minister Najib Tun Razak is fully aware of the highest stakes involved in the next general election, which is why he is so indecisive on the dates for the national polls, setting off repeated speculations as to when the next general elections would be held.

    I think we can rule out the possibility of general election in the third quarter of this year. The next general election will be either at the end of this year or next year.

    The 13th general election will be unprecedented, as it will be the first general election in the nations history where the ruling coalition, Barisan Nasional under Umno hegemony, will be facing a life-and-death battle.

    In the last 12 general elections from 1959 to 2008, Umno and the ruling coalition had gone into the hustings with supreme confidence, not only about retaining power but doing so with a great margin of victory.

    In fact, there was not a single general election in the past five decades where Umno had not contested with supreme confidence that it would be able to win power with comfortable two-thirds ! parliame ntary majority.

    No pride in coming second

    Until the 308 political tsunami of the 2008 general election when Umno and Barisan Nasional suffered their worst electoral debacle, losing two-thirds parliamentary majority and clinging precariously to power thanks to the two fixed deposit states of Sabah and Sarawak.

    Umno and BN will be fighting a life-and-death battle in the 13th general election, not just about whether they can regain two-thirds parliamentary majority lost in 2008, but whether they could be returned to power or would have to occupy the opposition benches for the first time in their experience.

    This is why Najib reminded the Selayang Umno yesterday that in a general election there is no such term as runner-up like in other contests, as either Umno and BN retain power in Putrajaya or they are relegated to the opposition benches.

    This applies to the state elections and the state governments as well.

    This is probably the reason why the Umno and BN leaders are so panicky about the Bersih peaceful rally on July 9 for fair, free and clean elections for they fear that Bersih will be even more successful manifold than the first Bersih rally in 2007.

    Najib is fully aware that a 5% swing in votes in the next general election as compared to the 2008 general election will see a Pakatan Rakyat government in Putrajaya and Umno and Barisan Nasional taking their places in the parliamentary opposition benches. The same odds apply for the state elections as well.

    However, Najib and his election strategists should realise that if the BN government decides to resort to high-handed, repressive and undemocratic measures to use the police to crack down on the peaceful Berish rally for free, fair and clean general elections, they may be creating the very conditions which would ensure a 5% swing against Umno and BN in the next general election setting the stage for a change of federal power in Putrajaya for the first time in the nations his! tory.

    Kenapa UMNO Takut Kepada Pilihanraya yang BERSIH?

    Mengapa UMNO takut menghapuskan undi pos, sedangkan Malaysia bukan lagi di dalam peperangan?

    Mengapa UMNO mahu semua rakyat Malaysia menjadi penakut macam mereka?

    Jelasnya, UMNO penipu. Apabila rakyat mahu mendedahkan penipuan mereka, sudah tentulah mereka jadi takut.

    Rakyat Malaysia tiada jalan lain. Wajib semua turun ke jalan2 raya menuntut sistem pilihanraya yang bersih.

    Kalau tidak, kita akan terus diperintah oleh kerajaan yang korup dan penipu. Kerajaan yang dipilih dengan cara menipu tidak perlu takut dengan kehendak rakyat.

    Anwar the bogeyman that has been flogged to death....

    The Datuk T trio were charged in what is called a sham trial in a kangaroo court. Charges brought against them were for openly screening porn to a public audience, although their victim had pressed the authorities to prosecute them for blackmail and intimidation.

    Yet for such a serious offence - as the pornography they peddled resounded throughout the nation - the three were fined a mere total of RM5,500 or a total 6 months jail by the judge. Malaysians are shaking their heads in disgust at the trivial fines imposed on the Datuk T trio.

    Frankly, who will believe the reports are authentic. No one knows the background of these experts and what information or misinformation the police sent them. Even here, our pathologists can 'pakat' or collude with the police and give false autopsy reports. What more with unknown foreign experts!

    But most of all, if the reports were really true that it was Anwar, there would be a trial already scheduled. Datuk T would proudly plead not guilty!

    Shouldn't the Datuk T be punished all the more for leading the public in a smear campaign against Anwar? Shouldnt the police and the Government of Malaysia(GOM) issue Anwar a public apology? And for putting UMNO in a bad light, shouldnt these three UMNO members be sacked? Why is the GOM being put into such an embarrassing position by this shady Datuk T trio if UMNO is not involved? Why is the government and Perkasa cheering them on, if there is nothing shady about their inter-connections.

    At the end of the day, Anwar is a bogeyman that has been flogged to death. Come on, sex fiends out there! Who can ever believe it was Anwar in the tape? How can a man be so crazed, let a lone an! ambitou s wanna-be-next PM of Malaysia? Maybe this is why Pakatan Rakyat is less worried this tme around. They can smell the overkill but silly UMNO can't - even though their own overkill is now killing them!

    So, unless the government issues a public statement to completely disengage their involvement, the public will continue to believe that the GOM too is in cahoots with them. Again, Prime Minister Najib Razak has painted himself into his own corner. It is his own fault. Anyone with a half brain would be able to say STOP, this is the stupidest plot, 'don't even come near me with it!'

    But no, Najib even paid millions for this drama. And by doing so, he reaffirmed his seat on a long Scorpene ride out from Putrajaya. His wife Rosmah needs only to open her eyes and look at who's supporting this sex video. And the supporters are Utusan, Star, TV3, and all the government-controlled media. In UMNO, these are all the well-known bootlickers and the usual suspects, including Rais Yatim, Puad Zarkashi, Khairy Jamaluddin and so on. Not to mention the other UMNO faction, Mahathir Mohamad and son Mukhriz.

    The rest of the UMNO grassroots - if they trust you, they will answer, Gila! As for the Chinese, they will add on the word Babi! Not sure about the Indians though. I must check and make a report on this.

    Bullet proof

    You see, being charged is one thing. But being convicted in court is another. It is a public disgrace. From now on, the trio should be banned from holding public office for at least five years. Imagine, the three of them got together, and formed a Datuk T trio. Surely, this must rank as one of the greatest and most costly melodrama created by a PM who depends on even more foolish spinners to strategize for him.

    It is so silly that one of Rahims aide actually made a booking at Carcosa Seri Negara, while Shuaib paid the bill. They were sure they would be protected by the crooked arm of the BN governm! ent. And even after being found guilty by a court of law, they still say that they are doing it with 'sincerity' from the bottom of their hearts. It was their ultimate sacrifice for the sake of the country and national security.

    They had invited a group of reporters and others to watch the sex video. After failing to convince the Public that the man in the video was Anwar, they went to a mosque all dressed up bullet proof vests to swear on the Koran, hoping that the Malays will believe in their story.

    The Bullet Proof vests were to ensure that they would not be lynched in public by an angry crowd. And to further convince the public, one of them even made a feeble effort to say that he was actually at the scene of the video. If anyone thought that Ibrahim Ali was a clown, these three stooges actually beat Ibrahim Ali to the title of King of Clowns.

    Sympathy pours in for Anwar

    Such shameless characters are still walking around scot free, to plan and plot again, with the compliments of the BN government. Anwar meanwhile has alleged that the sex video by Datuk T Trio was a scandal hatched by Datuk Seri Najib and Rosmah.

    Whether or not he got it right, the verdict by the Magistrate's Court has not in any way convinced the Public that the three stooges were acting alone. Someone is steering the wheel, just as someone was steering Saiful's wheel and Azizan's wheel. Was it the same people who drove Altantuya to the ground?

    The Sex Video scandal is seen by many as a feeble campaign by the government to further discredit Anwar. In their desperation to cover their tracks with the Sodomy Trial starting to fall apart, many felt that the Sex Video scandal was conjured up to fini! sh off A nwar politically.

    You see, there are many conservative Malays, who cannot believe Anwar would sodomise a male. But they might believe he would have sex with a Chinese prostitute behind his wife's back. Yes, it is truly amazing how stupid and racist they think the Malays are. Even the prostitute, they took care to be sure came from the arch-enemy race - the Chinese.

    Funny though, Najib can have the likes of Ziana and Altantuya, while Khairy has had to deny links with Maya. But poor Anwar has to go a prostitute recommended by the Datuk T. And also allowed it to be filmed by 4 cameras! This is the multi-million ringgit shenanigan paid for by the Najib regime. So smart is our PM. If he had gone to Bollywood, Chennai, he could have got a similar script for 10 rupees! And saved Malaysian taxpayers millions of ringgit.

    BN is now forced to lick its wounds, as Anwar now has the advantage of public sympathy back on his side. The Opposition Leader has emerged stronger in the eyes of the Public. Sympathy is pouring in, especially from the 40 per cent fence-sitters who are still unsure of whom they should give their votes to.

    For these fence-sitters, this is their call - Vote for Anyone other than BN!!

    Something rotten at the Duta courts...

    Shakespeare wrote in the play 'Hamlet' that "something is rotten in the state of Denmark". Court of Appeal judge NH Chan had also made similar remarks when he wrote the Ayer Molek Rubber Co Bhd vs Insas Bhd judgment in 1995, where he described the case he was presiding over as being about an injustice perpetrated by a court of law.

    Can yesterday's conviction of the infamous 'Datuk T' trio be said a travesty of justice deserving the local version that goes "something is rotten in Duta courts" resulting in possibly another charge looming over Opposition Leader Anwar Ibrahim? Anwar had yesterday maintained the government's conspiracy in the matter saying how can one respect a government when its instruments are used politically.

    Let's back-track a bit before returning to the conviction. The video was screened on March 21 at the posh and historical Carcosa Seri Negara Hotel by the Datuk T for several invited editors and journalists in a room booked under the name of former Malacca chief minister Abdul Rahim Thamby Chik, who is also Risda chairperson.

    Rahim is part of the Datuk T trio that also comprised businessperson Shazryl Eskay Abdullah and former MP Shuib Lazim - all three later claimed responsibility for the event. The trio had called on Anwar to resign. This led to Anwar issuing a statement on the same day, March 21, denying that he was the one in the video and lodged a police report the next day.

    As a result, trio was called in and it was during this time Eskay said he had handed the only copy of the sex tape to the police. However, copies of the clip made their way online just before the Sarawak state elections, only to resurface last month, this time in full. It als! o made i ts way to the homes of village headmen and politicians via post.

    After a period of silence, Eskay took a religious oath at a Sentul mosque - complete with bullet-proof vest - to vow that Anwar was the man in the video. He repeated himself yesterday when the facts of the case were being read out in court, telling the court that the man in the video resembling Anwar, was indeed the politician.

    Then the trio pleaded guilty to be fined a total of RM5,500.

    Discrepancy before yesterday

    When Eskay told reporters on Wednesday that he would be charged on Friday, several parliament reporters claimed that they spotted Rahim apparently seeing Prime Minister Najib Abdul Razak in the august House. Eskay initially said he would be charged, but later confirmed it would include all three. While Najib denied the meeting took place, Anwar maintains it did indeed happen, suggesting that it would probably lead to the charge being reduced, thus adding muscle to his assertion of a conspiracy.

    The trio of Eskay, Rahim and Shuib were the main actors along with DPPs Kamaludin Md Said and Mohd Hanafiah Zakaria and respected lawyer Muhammad Shafee Abdullah, along with two other lawyers.

    Another bombshell dropped before the Datuk T trio were charged when Umno-owned Utusan Malaysia ran a story yesterday quoting Eskay as saying he was prepared for any outcome with the article aptly titled 'Kami sedia apa saja hukuman' (We are prepared to face any punishment). So Utusan had a scoop probably because they knew the high possibility of all three preparing to plead guilty and Eskay maintained there was nothing wrong with making the video public.

    The same story stated that the trio would be charged under Section 5 of the Film Censorship Act, for circulating, exhibiting, distributing, and displaying an obscene film, which is punishable by a fine of not less than RM10,000 and not more than RM50,000 or imprisonment for a term not exceeding five! years o r both. The Umno-owned daily got that charge wrong when prosecution filed a lesser charge against Datuk T. Anwar pounced on this to back his political conspiracy accusation.

    Proceedings in court

    Before the arrival of the accused, reporters somehow knew in advance that the case would be heard at magistrate's court three and rushed up there. Normally, a case would have to be registered first, only then will the courtroom be known. That is the normal procedure any lawyer will tell you to ensure that there is no fixing of judge or magistrate. It could not be determined if the case had been registered first when the counter opened at 8am and Eskay and co was told to arrive at that time, but they instead presented themselves sometime around 9.15am in court.

    According to reporters covering the trial, two widescreen televisions were already placed in court as a possible prelude to the video being screened. Some lawyers who were not watching the case but were in the huge court complex were heard murmuring that the protests outside the court in support of Datuk T and the charging were merely a sideshow - a show which may have entranced and held the whole nation captive as the three-and-a-half hour proceedings rolled on.

    Another point of oddity was when the charge was read out under section 292 of the Penal Code, all three had asked for a break to consult their counsel. When the case was recalled, they pleaded guilty and the facts of case had already been conveniently prepared.

    Normal proceedings in such cases in a magistrate's court is that when a person pleads guilty, the prosecutors would seek more time - usually a few hours or in the afternoon and sometimes the next day to prepare the statement.

    However, in this case, after a 45-minute interval the charge was read again and all three entered their plea with the statement of facts already prepared. The five-page fact sheet appeared to have been ! carefull y crafted to implicate Anwar in the video as his name was mentioned at least five times right from the first paragraph.

    Then came the real jolt when Shafee and not the prosecution told the magistrate that according to case laws, many such cases had been thrown out on appeal because the obscene material had not been screened.

    He then applied for the 20-minute sex-clip to be shown in court. The prosecution and other defence counsel raised no objections. The tape then appeared on the two big screens, which had been conveniently been placed there earlier. Then Shafee began his lengthy submission in mitigation representing the third defendant, Rahim. He stated the revelation of video was made in defence of the public good and his client's role was merely booking the hotel room. The other counsel then delivered their submissions.

    Merely coincidences or conspiracy

    Putting together all the incidents what is a sane person to assume, that they were merely coincidences or a meticulously crafted consipiracy as claimed by Anwar? This despite the foreign findings that the person performing the sex act resembled the opposition leader.

    The tape was shot before the crucial Sarawak election and the other point is that Anwar who is facing an on-going sodomy trial at that time was successful in blocking at the High Court, the admission of three crucial items retrieved in the police lock-up - the toothbrush, the mineral water bottle and white towel.

    The other point not mentioned earlier is that Eskay himself was embroiled in a legal battle involving a RM20 million suit he filed against Merong Mahawangsa Sdn Bhd and one of its directors, over the constructio! n of the Johor Baru crooked bridge. The High Court ruled against him.

    Is it strange that the sex-tape investigations took three months as a retired senior police officer said that in such cases the person caught would be charged within a week. The clip was also widely distributed after Eskay conveniently handed the only copy to the police. Were hidden hands at work when what was reportedly a charge under the Film Censorship Act as was highlighted in Utusan Malaysia was reduced to a lesser offence under the Penal Code?

    Is it a coincidence that big screen televisions were placed in court before the start of proceedings and the facts of case conveniently prepared.
    Anwar told reporters he had raised the issue of political conspiracy with Najib, Rahim, Eskay, Shuib, attorney-general Abdul Gani Patail and Shafee's involvement.

    As the facts presents themselves, the readers can decide whether something rotten really happened at the Duta Court yesterday.-Hafiz Yatim

    MAHKAMAH DENGAN POLIS SAMA SAHAJA

    Kenyataan peguam kepada bekas perogol gadis bawah umur, Noryati Binti Mohamad Yusop, lelaki dalam video seks itu adalah 99.99 peratus adalah Ketua Pembangkang, Anwar Ibrahim. Tidak menjadi persoalan siapa dalam video tersebut, walaupun 100% adalah Anwar. Yang menjadi persoalan sekarang ialah ke tiga-tiga ekur setan ini telah melanggar undang-undang Negara. Kalau mereka boleh, kenapa orang lain tidak dibenarkan menayang video kucah di khalayak umum. Manakala video lucah tulin Dr. Chua Soi Lek cepat-cepat pihak polis menyerbu,merampas dan menangkap sesiapa yang memiliki salinan video terbabit, malah tidak ada langsung upacara atau majlis penayangan percuma video seks Chua.

    Sampai berbulan-bulan barulah setan-setan laknatullah berwajahkan manusia ini didakwa di mahkamah. Peguam Negara berdolak-dalik (dua-tiga kali hantar balik kepada pihak polis untuk melengkapkan siasatan) untuk mendakwa setan-setan ini. Tetapi,apakan daya tidak ada ruang untuk manipulasi mengelaknya mendakwa dan akhirnya setan-setan ini terpaksa juga didakwa di mahkamah.

    Video ini mulai ditayang pada umum pada 21 Mac 2011 dan disebarkan secara meluas ke seluruh Negara (pihak polis tidak mengambil apa-apa tindakan untuk menghalangnya, mungkin menerima arahan daripada kuncu-kuncu Najib), 3 bulan 4 hari baharulah Abdul Ghani Pataail, Peguam Negara mengambil tindakan mendakwa mereka ini di mahkamah di bawah Seksyen 292 Kanun Keseksaan.

    Soalnya kenapa lambat bertindak mendakwa setan-setan 3 ekur ini?

    Jawapannya : Pendedahan dan penyebaran video ini adalah salah satu strategi Najib atas nasihat APCO yang khidmatnya dibayar dengan menggunakan duit rakyat untuk memusnahkan kerjaya politik Anwar Ibrahim. Sekiranya Anwar jatuh melalui penyebaran video seks ini (dan kes liwat II), maka Najib dan regimnya dapat mengekalkan kuasa kerana tiada lagi pencabar utama yang boleh mengerhanakan masa depan! politik nya.

    Sekiranya strategi ini berjaya, Najib dan regimnya dapat meneruskan pemerintahan tanpa halangan dan ia boleh melakukan apa sahaja kezaliman demi kezaliman ke atas rakyat. Regim Najib akan membelasah rakyat secukup-cukupnya melalui system pemerintahannya yang tidak mementingan kebajikan rakyat. Regim Najib-Rosmah akan menjadikan Malaysia sebagai harta pesaka mak-bapaknya dan rakyat akan terus dijadikan hamba abdi selama-lamanya. Oleh sebab itulah, Najib memerlukan tempoh yang lebih panjang (3 bulan 4 hari) untuk mengubah persepsi pemikiran rakyat terhadap kewibawaan Anwar Ibrahim melalui pengunaan sepenuhnya kempen media massa di bawah kawalannya supaya Anwar berundur kerana moralnya (moral Najib bagaiamana?).

    Sepanjang tempuh 3 bulan 4 hari itu, setan-setan ini dilayan penuh mesra dan istemewa. Kempen-kempen yang dijalankan secara agresif untuk memaksa Anwar berundur tidak tercapai seperti apa yang dihajatkan, malah sokongan terhadap Anwar semakin meningkat terutama dari golongan kaum Cina seperti yang ditunjukkan dalam PRN Serawak ke 10 lalu (kebetulan ia dilancarkan sempena PRN Serawak ke-10). Melihat sokongan terhadap Anwar Ibrahim tidak terjejas, maka Najib terpaksa akur dengan kehendak undang-undang dan 3 ekur setan-setan ini (akhlak dan moral mereka ini lebih teruk dari iblis) pun didakwa di mahkamah di bawah Seksyen 292 Kanun Keseksaan.

    Abdul Ghani Pataail tidak menambah pendakwaan di bawah seksyen Seksyen 5(1) Akta Penapisan Filem 2002, kerana menayang bahan lucah kepada awam serta Seksyen 503 Kanun Keseksaan kerana memeras ugut dan menakut-nakutkan Anwar Ibrahim dan isterinya, Dr Wan Azizah Wan Ismail disamping akta yang terkandung dalam SPRM berhubung pengakuan Rahim yang menjemput Ahli Parlimen Sungai Petani Johari Abdul dan didakwa cuba menawar sejumlah wang untuk melompat parti. Kenapa setan-setan ini tidak turut didakwa sama di bawah Seksyen-seksyen yang disebutkan itu kerana kejahatan yang mereka lakukan sangat jahat dan kejam. Lebih ! kejam da ri Yahudi.

    Satu persoalan lagi kenapa 3 setan-setan ini mengaku bersalah sebaik sahaja kes mereka dibaca. Mudah dibaca strategi yang mereka akan gunakan. Mengikut Seksyen 292 Kanun Keseksaan, mereka bakal menerima hukuman penjara sehingga tiga tahun atau denda atau kedua-duanya. Jangan lupa, sebelum 3 setan-setan ini di dakwa, mereka telah berjumpa dengan Najib Pandi Kutty dan sebaik sahaja mahkamah selesai membaca kes, mereka pun tanpa banyak soal mengaku bersalah. Bagi menunjuk keadilan, mahkamah menangguhkan keputusan dan mengarah mereka berbincang dengan peguam masing-masing. Tujuan pengakuan bersalah ini dibuat adalah untuk merayu kepada mahkamah supaya meringinkan hukuman terhadap mereka bertiga. Itu sahaja dalih mereka (tentunya dinasihati oleh peguam dan Najib).

    Perlu juga diingat di sini pada 10 Jun lalu, Seorang pemandu bas, P. Kanapathy, 38 dihukum penjara maksimum tiga tahun oleh Mahkamah Sesyen di Melaka selepas mengaku bersalah atas tuduhan menayangkan cakera padat video (VCD) lucah kepada seorang penumpang wanita warga Indonesia (tetapi setan-setan 3 ekur ini menayangkan video lucah kepada berpuluh orang terpilih dan berjuta manusia tua-muda di seluruh dunia) di dalam bas yang dipandunya.

    Kes ini berlaku pada pukul 8.15 malam, 6 Jun 2011 semasa dalam bas ekspres Melor Interline yang dipandu oleh P. Kanapathy antara Plaza Tol Sungai Besi dan Jalan Bemban, Jasin, Melaka. Dalam rayuan sebelum hukuman dijatuhkan, Kanapathy yang merupakan bapa kepada empat anak memohon hukuman ringan dengan alasan dia mempunyai tanggungan keluarga, tetapi mahkamah menolaknya dengan alasan kesalahan yang dilakukan tertuduh adalah serius (seorang pun serius, apatah lagi berjuta manusia telah menontonnya).

    Rakyat Malaysia pada umumnya hendak melihat bagaimana mahkamah hendak bersilat (bagi memenuhi arahan regim Najib) untuk meringankan hukuman terhadap 3 setan-setan ini. Sekiranya mahkamah akur untuk meringan hukuman ke atas 3 ekur setan-setan ini, maka be! rmakna m ahkamah di Malaysia telah gagal melaksanakan keadilan terhadap rakyat di Negara ini dan sahlah mahkamah di Malaysia adalah mahkamah kanggaro seperti persepsi rakyat selama ini. Hukuman berdasarkan pilih bulu (darjat dan keturunan), kuasa dan wang bukan berdasarkan konsep keadilan. Kita akan tenguk sejauh mana mahkamah ini bertindak untuk menegakkan keadilan. Saya merayu kepada pihak yang pakar dari segi undang-undang memerhati gelagat ini jangan sampai mahkamah meringan hukuman ke atas 3 ekur setan-setan ini. Apa bezanya Kanapathy dengan setan-setan ini. Kesalahan mereka adalah sama dan didakwa pun menggunakan Seksyen yang sama. Yang membezakan mereka hanyalah status dan kedudukan. Yang satu itu hidup susah, tetapi 3 ekur setan ini punya wang yang banyak dan berkuasa pula.

    Sekiranya ia berlaku juga, ia bukan satu perkara yang pelik di Malaysia ini. Ianya telah pun berlaku. Bekas Ketua Polis Negara (KPN), Abd Rahim Noor. Pada 22 April 1999, Rahim Noor telah dituduh di bawah Seksyen 325 Kanun Keseksaan yang boleh membawa hukuman penjara maksimum tujuh tahun dan denda. Timbalan Pendakwaraya ketika itu, Salehuddin Saidin telah memberitahu mahkamah bahawa kesalahan Rahim Noor sebagai seorang anggota polis tertinggi telah melakukan satu kesalahan yang amat serius dan tidak sepatutnya dipandang ringan. Salehuddin seterusnya berkata, sebagai seorang yang memegang jawatan tertinggi dalam perkhidmatan polis,masyarakat umum dan seluruh negara menaruh kepercayaan tinggi kepada Rahim untuk menjamin keselamatan rakyat serta memastikan undang-undang dilaksanakan dengan adil.

    Bagaimanapun katanya, Rahim telah menyalahgunaan kuasa melaksanakan undang-undang menurut kehendak hatinya sendiri dan mengambil kesempatan daripada kedudukannya sebagai pegawai tertinggi polis untuk melepaskan nafsu amarahnya terhadap seorang mangsa (Anwar Ibrahim) yang tidak boleh melakukan apa-apa elakan daripada serangan tertuduh. Berikutan itu, Abd Rahim Noor mengaku bersalah mencederakan Anwar di lo! kap Buki t Aman pada pukul 10.45 malam, 20 September 1998 seperti yang dilakukan oleh 3 ekur setan-setan ini pagi tadi.

    Tetapi pada 14 Mac 2000, tuduhan terhadap Rahim dipinda dari Seksyen 325 Kanun Keseksaan yang boleh membawa hukuman penjara maksimum tujuh tahun dan denda kepada Seksyen 323 yang lebih ringan iaitu sekadar membawa hukuman maksimum penjara setahun atau denda sehingga RM2,000 atau kedua-duanya. Pindaan pertuduhan ini dilakukan apabila peguam Rahim menghantar suatu representasi kepada Peguam Negara (Mokhtar Dogong) supaya mengurangkan pertuduhan dan mahkamah bersetuju untuk mengurangkan pertuduhan itu dengan mengambilkira sumbangan Rahim terhadap negara.

    Shaik Daud yang mengetuai panel tiga orang hakim (Datuk Mohd Saari Yusoff dan Datuk K C Vohrah ) di Mahkamah Rayuan merasa hairan kenapa pihak pendakwaraya tidak merayu agar hukuman ke atas Rahim ditambah kerana kesalahan yang dilakukan oleh Rahim adalah serius. Akhirnya, Rahim dihukum dua bulan penjara dan denda RM2,000.00 sahaja. Dan bagaimana pula kes Lim Guan End V Abdul Rahim Tamby Chik yang berakhir Lim Guan Eng dihantar ke penjara dua tahun dan kini kembali penuh bergaya sebagai KM Pulau Pinang dan setan-setan ini mulai merangkak ke alam kubur dan marilah sama-sama berdoa kehadrat Allah saw semoga setan-setan ini dihumban ke dalam penjara seperti yang dialami oleh Kanapathy.

    Marilah kita doakan juga semoga Allah swt laknatkan 3 ekur setan ini dari dunia sampailah ke akhirat kerana perbuatan mereka sangat kotor dan jahat mengaibkan seluruh keluarga Anwar. Dalam masa yang sama menyembunyikan keburukan moral dan akhlak Najib sebagai PM Malaysia yang sudah diketahui umum dan mendokong pemerintahan yang penuh dengan korupsi dan menyalahgunaan kuasa untuk kepentingan diri dan keluarga, bukan untuk rakyat yang semakin susah hidupnya.

    Pakar perlembagaan Abdul Aziz Bari berpendapat tindakan pihak polis malarang perhimpunan BERSIH pada 9 Julai depan bukan sahaya tidak sah, malah melanggar perlembagaan.

    "Mereka bertindak secara tidak sah apabila secara umum memaklumkan tidak akan mengeluarkan permit.

    NONE"Sebagai pihak berkuasa awam, mereka hanya boleh membuat keputusan apabila permohonan dibuat," kata pensyarah Universiti Islam Antarabangsa itu kepada Malaysiakini.

    Abdul Aziz (kanan) menjelaskan, bawah perlembagaan, polis perlu menimbangkan setiap permohonan permit dan tidak patut membuat sebarang pertimbangan tidak wajar.

    Beliau berhujah, polis membuat penghakiman awal berhubung perkara itu dan sekali gus menentang undang-undang.

    Paling teruk apabila ia bertentangan dengan hak yang dijamin dalam perlembagaan.

    Katanya, mengikut Perkara 10(1)(b) Perlembagaan Perskutuan, polis tiada sebarang hak melarang perhimpunan aman yang dijamin.

    "Hatta mahkamah juga tidak boleh melakukannya," kata pensyarah undang-undang itu.

    Anda boleh menilai sendiri situasi mahkamah dan undang-undang di negara kita sekarang ini. Fakta ini perlu disebarkan kepada seberapa ramai rakyat supaya mereka tidak terus-terusan diperbodohkan oleh UMNO/APCO yang hasratnya hanya untuk kekal berkuasa. Di samping itu, janganlah berputus asa untuk berdoa ke hadirat Allah Subhanahu wa Ta'ala supaya ajal UMNO/APCO disegerakan bagi mengelakkan lebih banyak kesengsaraan yang dialami rakyat.

    Bersih denies its anti-govt

    A Bersih 2.0 leader today sought to correct a misconception that the movement is anti-government.

    If the government stands for free and fair elections, then we are not anti-government, said Haris Ibrahim, who sits on the steering committee of Bersih 2.0.

    But if the government is going to stand in the way of free and fair elections, we are against anyone who is against free and fair elections.

    He made his remarks in an interview on FMT RAW, a half-hour online broadcast that made its debut at 3pm today.

    Deputy Prime Minister Muhyiddin Yassin recently accused Bersih of having a dirty political agenda in its plan to rally Malaysians for a Walk for Democracy on July 9.

    In the interview with FMT reporter Stephanie Sta Maria, Haris said the conduct of the recent Sarawak election underlined the need for electoral reform in Malaysia.

    He added that a post-mortem showed that it was corruption upon corruption upon corruption.

    Elaborating on Bersihs purpose, he said: We are just acting against anyone acting against the

    interest of the rakyat. We have eight simple demands. I think they are all legitimate demands.

    If the government is going to wake up to the need to clean up, and effect these reforms, why would anyone be against the government?

    We say again and again, Bersih is not pro-Pakatan Rakyat. Neither are we anti-Barisan Nasional. We are pro-reform.

    He said Bersih sent invitations to both sides of the political divide, but its not our fault if BN chooses to stay away.

    Pre-emptive arrests

    He renewed his invitation to all parties to participate in the rally. Join us, he said.

    Referring to plans by Perkasa and Umno Youth to hold their own rallies, Haris said he respected their right to peacefully assemble and I hope they respect ours.

    However, he accused the two organisations of attempting to taint Bersihs objectives with their racial rhetoric.

    Every time they get involved in something like this, they bring in the race issues.

    But he added: Malaysians are more mature, and are not so easily swayed by race rethoric, thank God.

    On the possibility of police action against the rally, Haris said Bersih was hoping that the police would realise that their function was to facilitate.

    Article 10 of the Federal Constitution guarantees the rakyat the right to peacefully assemble, he said. It supersedes the Police Act, which was enacted by Parliament.

    Yes we dont have a permit and we never intended to and we dont expect to get one.

    He speculated that pre-emptive arrests, as the Home Minister has threatened, would further spur people to participate in the rally.

    He expected more than 150,000, which would be more than twice the number in the first Bersih rally in 2007, when police attacked participants with teargas and water cannons.

    If you want to arrest us, take the whole bunch of us, he said. This has become bigger than the committee. This is a movement that belongs to the rakyat who want to take part in this call.

    In ending the interview, he urged all citizens to participate and to wear the colour yellow, which he called the new black, the bad colour.

    Come on, its just yellow, for Gods sake. Dont be afraid, claim your space. Do not allow the authorities to bully you.
