Mufti Perak - Senaman poco-poco haram...


Mesyuarat Jawatankuasa Fatwa Negeri Perak yang bersidang pada 24-26 Januari 2011 lalu telah memperakukan supaya tarian atau senama poco-poco diharamkan. Ia dibuat atas asas ianya mempunyai kaitan dengan kepercayaan agama juga pemujaan roh berdasarkan kajian yang menyatakan ianya sering diamalkan di Jamaica serta bercirikan agama Kristian.

"Mesyuarat mengambil keputusan bahawa pengharaman ini akan diwartakan," kata Mufti Perak, Tan Sri Harussani Zakaria dalam satu suratnya.

Surat fatwa Mufti Perak itu dihantar kepada Pengerusi Persatuan Kakitangan Islam Malayan Banking (PKIMB) Perak.

Tak perlu buktikan ketulenan video lucah Anwar....

Yang mana lebih penting, membuktikan bahawa video lucah Anwar Ibrahim itu adalah tulen dan tidak disunting ataupun membuktikan bahawa pelakonnya adalah benar-benar Anwar Ibrahim?

Media arus perdana rata-rata memperdebatkan ketulenan video tersebut. Pada pendapat saya, mereka ini akan dapat membuktikan bahawa video tersebut tulen. Semalam saya membaca bahawa polis mungkin akan memanggil pengarah filem terkenal, Yusri KRU untuk membantu membuktikan video tersebut tulen. Memang tidak ada masalah dalam membuktikan ketulenan video tersebut tetapi ketulenan video tersebut tidak membuktikan bahawa Anwar Ibrahim bersalah. Ini ada kerana mereka hanya membuktikan bahawa video tersebut adalah original tetapi tidak dapat membuktikan bahawa pelakonnya adalah DS Anwar Ibrahim.

Kita semua menonton CSI dan macam-macam lagi fiksyen Barat di mana kita boleh melihat teknologi terkini digunakan untuk membuat topeng muka seperti juga yang dipakai oleh Erra Fazira dalam filem Cinta Kolestrol. Mencipta topeng muka getah yang boleh diacu dengan muka sesiapa pun bukan lagi sesuatu yang sukar, asal ada duit semua boleh jadi.

Berdasarkan kepada fakta-fata dibawah sepertimana yang di utara kan oleh mereka yang telah menonton video lucah tersebut saya 200% percaya video tersebut adalah tulen tetapi pelakonnya adalah palsu! Pelakonnya bukan Anwar Ibrahim! Tetapi biarkanlah mereka seronok dapat membuktikan bahawa video tersebut tulen kerana video lucah ini telah berjaya menyatukan semula penyokong-penyokong DS Anwar Ibrahim yang telah mula goyah oleh kes liwat yang berlangsung di mahkamah.

Ahli Parlimen Sungai Petani Ahli MPT KEADILAN, Datuk Johari Abdul berkeyakinan bahawa ! pelakon itu bukan Dato Seri Anwar Ibrahim berlandaskan faktor berikut:

1. Pada awal rakaman, terdapat seorang lelaki lain yang sedang menguruskan rakaman video pada ketika orang yang mirip Dato Seri Anwar Ibrahim masuk ke dalam bilik. Sewajarnya orang itu (yang mirip Dato Seri Anwar Ibrahim) sedar bahawa perlakuannya akan dirakam. Mustahil sesiapa yang waras akan melakukan adegan sedemikian kecuali dia diupah.

2. Tempoh masa rakaman yang menunjukkan muka si pelaku adalah terlalu pendek. Ditambah dengan rakaman yang dibuat di dalam hitam putih; menyukarkan untuk betul-betul mengesahkan identiti si pelaku.


3. Bahu si pelaku terlalu lebar dan tegap berbanding bahu Dato Seri Anwar Ibrahim.


4. Bahagian belakang si pelaku (punggong) juga berisi dan jelas berbeza dengan tubuh badan Dato Seri Anwar Ibrahim.

5. Di akhir adegan, si pelaku bangun dan tubuh badannya dirakam dengan jelas. Perutnya adalah buncit dan terlalu besar jika dibandingkan dengan perut Dato Seri Anwar Ibrahim.


6. Warna kulitnya adalah terlalu cerah dan hampir tidak dapat dibezakan dengan warna kulit wanita terlibat.

Nasihat saya, setiap apa yang anda baca di media arus perdana jangan diterima bulat-bulat sebaiknya buat carian maklumat di internet, bukannya susah google jer semua akan terpapar. Nilai berita tersebut daripada pandangnan kedua-dua belah pihak, kemudian tetapkan pendirian anda.

Kepada mereka yang telah menonton video lucah tersebut dan juga kepada mereka yang mencari-cari video tersebut lupakan sahaja niat untuk menonton kerana hukumnya haram di sisi Islam. Ikut jejak DS Wan Azizah yang yakin dan berpegang kepada ajaran Islam. Tak perlu ditonton kerana jika Datuk T itu seorang yang hina akhlaknya maka jika kita mengikut rentaknya dan menonton video lucah tersebut maka kita juga akan menjadi sama taraf dengannya.

80k Rakyat Selangor Dapat Tanah

80,000 rakyat Selangor dapat geran tanah

SHAH ALAM, 30 Mac:
Seramai 80,000 rakyat peneroka tanah di Selangor mendapat manfaat besar apabila kerajaan negeri memberikan geran sah milik kepada mereka setelah berpuluh tahun mendiaminya.

Proses ini dilakukan secara berkelompok kerana sebelum ini dibuat secara terpilih di mana didapati dalam 200 keluarga di sesuatu tempat itu, tidak sampai sepuluh peratus mendapat geran itupun mengikut kepentingan politik pihak tertentu.

Namun dasar tanah Kerajaan Negeri Pakatan Rakyat adalah untuk menyelesaikan keseluruhan tanpa mengambil kira fahaman politik mereka kerana sebagai rakyat Selangor mereka berhak mendapat geran tersebut.

Dewan Negeri Selangor diberitahu oleh Menteri Besar, Tan Sri Abdul Khalid Ibrahim (gambar) ketika menjawab soalan dalam sesi dewan kali ini.

Menurutnya, kelulusan geran tanah diberikan kepada peneroka yang telah nenggusahakan tanah berkenaan sejak 10 hinga 15 tahun lalu.

"Mereka akan diberikan geran tanah sah milik ini dengan syarat mereka sendiri usaha dan membina kediaman di atasnya dan bukan untuk perniagaan," tegasnya.

Abdul Khalid berkata demikian ketika menjawab Adun Sekinchan, Ng Swee Lim.

Dalam pada itu, Abdul Khalid juga memaklumkan pihak kerajaan negeri menolak permohonan peneroka profesional yang memohon untuk empat hingga lima kawasan tanah berasingan.

"Permohonan untuk tanah kosong yang masih belum diusahakan juga akan ditolak.

"Kerajaan j! uga tida k mengamalkan kelulusan terpilih di mana hanya sepuluh peratus sahaja diluluskan daripada jumlah 200 permohonan seperti amalan.

"Tiada unsur politik mempengaruhi semua pihak dalam melulus atau menolak permohonan ini kerana Kerajaan Negeri Pakatan Rakyat mengamalkan sikap telus.

"Semua yang dilakukan oleh kerajaan negeri ini adalah untuk menjaga kepentingan rakyat terbanyak dengan tidak menafikan hak rakyat yang lain," tegasnya.

Christians reject Putrajaya’s overture over Malay bibles

KUALA LUMPUR, March 30 — The Christian Federation of Malaysia (CFM) rejected today the federal government’s overture in the Alkitab row, saying it did not resolve the core issue which is the erosion of basic human rights protected by the Federal Constitution.

The umbrella body representing over 90 per cent of churches here was referring specifically to Putrajaya’s offer to mask the Home Ministry’s stamp and serial numbering of 35,100 copies of the Malay bibles shipped in from Indonesia last week, as laid down last week by its Christian minister, Datuk Seri Idris Jala, who is in charge of government and economic transformation.

Jala, in his statement on March 22, also said that certain Christian donors had also offered to fully replace, free of charge, the two marked cargoes at Port Klang and Kuching, which had been seized and detained by home ministry officials.

The CFM did not seem mollified by Jala’s attempts to placate the community, maintaining that the act — which had been carried out quietly and without the bible importers’ consent — amounted to a desecration of the Christian holy book and an outright show of disrespect, breaching the guarantees of this country’s highest law.

“Our position is that there should be no restrictions, proscriptions or prohibitions whatsoever on the bible or the use of the language of our choice in the practice of our religion, as it was in the days before and after the formation of Malaysia,” CFM said in a statement here today, adding that the Alkitab issue was not the only restriction.

It noted that there has been a “systematic and progressive pushing back” of Christian rights dating back to the 1980s — dating back to the 1980s — namely the right to practise, profess and express their faith.

It pointed to a series of restrictions imposed on Christians, such as the freedom to wear and openly display religious symbols, like the cross; the building of churches; and even what words can be used in a Christian religious context.

The Catholic Church and other Christian groups and individuals on both sides of the South China Sea have challenged the home minister for imposing those restrictions, which centre on the use of the Arabic word for God, “Allah”, but their cases have been stuck in queue in the courts since 2008 with no end in sight.

“In order to move forward, we call on the Government to commit itself once and for all to remove every impediment, whether legal or administrative, to the importation, publication, distribution and use of the Alkitab and indeed to protect and defend our right to use the Alkitab,” it said.

It demanded the federal government start by cancelling all orders made under the Internal Security Act (ISA) 1960, as well as the Printing Presses and Publications Act (PPPA) 1984, which categorised the Alkitab as a threat to national security and public order.

“Christians, like any other Malaysian, are not demanding for anything beyond our constitutional and fundamental human rights as enshrined in Article 11(1) of the Federal Constitution and Article 18 of the Universal Declaration of Human Rights,” said the group, led by its chairman, Anglican Bishop Ng Moon Hing.

CFM also said that it would leave the decision of what to do with the marked cargo to the affected importers, the Bible Society of Malaysia (BSM) and the Sarawak branch of global Christian group, The Gideons.

“We have left it to the two importers to decide whether or not to collect the Alkitab, based on their different specific circumstances and level of trust in the authorities and the processes in their local context,” it said.
With polls set to be called in Sarawak in just over two weeks, the controversy is expected to weigh on the minds of Christians who make up nearly close to half of the hornbill state’s total population.

KUALA LUMPUR, March 30 — PAS Youth chief Nasrudin Hassan at-Tantawi said today the Islamist party is willing to accept Perkasa’s Arman Azha Abu Hanifah if he fully quits the right-wing Malay organisation.

Yesterday, Arman Azha told a news conference here he was giving up his position as Perkasa Youth chief — which he had held since 2009 — to play a more active role in politics.

He is still a divisional leader in Umno, the ruling Barisan Nasional (BN) coalition’s Malay-based party.

While Perkasa has occupied a prominent position in defending Malay rights in public, it is not a political party and its president, Datuk Ibrahim Ali, has maintained the group has no plan to become one in the near future.

Arman Azha told reporters his decision to step down from his post in Perkasa had nothing to do with Ibrahim’s leadership, adding that he had received several offers to join the opposition Pakatan Rakyat (PR) pact.

Today, Nasrudin said he would welcome Arman Azha into PAS if the latter was willing to leave both Perkasa and Umno.

He added that he had tried to get in touch with Arman Azha and find out the real reason behind his decision to leave the Perkasa Youth chief post, but failed.

“I want to know if he plans to remain [in Umno] or he will join another party, that’s why we want to discuss with him and we are willing to invite him into PAS and Pakatan Rakyat,” he said.

Nasrudin denied that he had invited the Perkasa man to cross over, nor would he ever force Arman Azha to do so as the decision must be made voluntarily.

“I have never [invited], maybe another party, but it wasn’t me and I understand he attended our [Pakatan Rakyat] ceramah programme at Stadium Melawati [in Shah Alam] yesterday; maybe he has made his own evaluation,” Nasrudin said.

He added that his party’s slogan is “PAS for all” and it meant they are willing to accept anyone, including Arman Azha.

Hadi on sex scandal and spider webs


SEREMBAN: PAS president Abdul Hadi Awang slammed the sex-video scandal implicating Opposition Leader Anwar Ibrahim at a fund raising dinner yesterday.

The Islamic party leader said that Malaysia had “spider web” laws that could be altered to suit the needs of the government.

Commenting on the screening of the video to journalists by the “Datuk T” trio, Hadi called it a drama.

“Who was the cameraman, who was the producer? There is no law here,” he said to the crowd which responded with cries of “Allahu Akbar.”

The PAS leader also took a swipe at former PKR man S Nallakarupan over the latter’s wish to meet Hadi to reveal things about Anwar.

“Who is he? He is not a leader? Which party is he representing?” asked Hadi.

Meanwhile, PKR’s Teluk Kemang MP Kamarul Baharin Abbas told the crowd that former Malacca chief minister Rahim Thamby Chik, one of the three who exposed the video, had not turned up to screen the video for several PKR MPs as promised.

“We were told that Rahim was willing to let five of us watch the video. We informed Anwar that we were going to watch it, and he told us to go ahead.

“So we submitted the names of the MPs who wanted to watch. I think Rahim did not have the guts to face us,” he said.

According to Kamarul, the five MPs were supposed to meet Rahim at the Flamingo Hotel in Kuala Lumpur at 4pm.

“We were there at 3.30pm. We were told that Rahim was caught in the traffic jam, but the Risda headquarters (Rahim is the Risda chairman) is only walking distance away from the hotel.

“We waited until 5.30pm, Rahim didn’t show up, so we left the place,” he said.

Also present at the dinner were PAS secretary-general Mustafa Ali, Negeri Sembilan PAS commissioner Zulkefly Mohamed Omar, DAP’s Rasah MP Loke Siew Fook and PKR Port Dickson state assemblyman M Ravi.

Among the marginalized in Malaysia, there is a single group perhaps more marginalized than many. They are the people that Malaysia has forgotten. They are the Shiite Muslims. No one knows how many there are. They could be as few as 10,000 or as many as 40,000. The one thing that is certain, however, is that they face such oppression that it borders on cultural genocide. They are raided. Imprisoned. Denied the freedom to worship. Denied the freedom to participate in public life. Left only one choice: convert to Sunni Islam or remain persona non grata.

I first encountered him while producing a television programme on the lives of immigrants in New Zealand. Nazri reveals that he was once Sunni, but grew disaffected when the Sunni hadith failed to provide him answers to his own spiritual questions. His search led him towards the Shia denomination and he eventually converted. As a consequence, he and several others were subjected to a crackdown. Enforcement officers raided his home, arrested him and seized his personal religious material. Upon release, he was blacklisted and denied employment as well as the opportunity to further his studies. Nonetheless, Nazri believes he is fortunate in comparison with others. He has anecdotal accounts of Shiite acquaintances being tortured and then denied medical treatment as a way of pressuring them to renounce their faith.The schism between Sunni and Shia dates back to the 5th century. Following the death of Prophet Muhammad, the issue of who would succeed him as leader of the ummah polarized the community! . Sunnis , by way of popular vote, chose Abu Bakr to be the first caliph. Shiites, by contrast, preferred Ali, whom they believed the Prophet had chosen by way of divine mandate. This has given rise to two separate interpretations of Islam, with the Sunni tradition holding sway over 80% of Muslims in the world today, often at the expense of the Shiite minority, who are regularly labelled as heretics.The plight of the Shiites has been making the rounds on the international circuit via news agencies such as AFP, but has gained little political traction within Malaysia itself. DAP and Keadilans stance on the issue has so far been muted, and they are perhaps wary of alienating the Islamist PAS, whose Sunni hadith differs from UMNO only in the degree of application. The current constitution is also a potential minefieldarticle 11 is vague and offers the government the right to regulate Islam as they see fit. This leaves the doors wide open for persecution against sects and deviants that may challenge the general Sunni understanding of Islam.Whichever way the political landscape shifts, one thing is for certain. Malaysia will continue to be an uncomfortable place to be a Shiite. If you are one, you will either be driven further underground or you will have to leave the country.Buckling under the weight of surveillance, Nazri had chosen to seek asylum in the West, where he is free to worship and practice his faith. Dirty Tricks in Malaysia....

A sex tape appears just in time to hobble the opposition again.

The latest installment in a long saga of smears against Malaysian opposition leader Anwar Ibrahim is afoot, even as his second trial for alleged sodomy drags on. Three anonymous men calling themselves the "datuk trio," now exposed and under police investigation, showed a group of hand-picked journalists a video purporting to depict the former deputy prime minister having sex with a female prostitute a month earlier. The three said their motivation was to "show the truth." But as with past attacks on Mr. Anwar, the timing is politically significant: Snap elections are expected later this year.

The way in which the tape became public is also suspicious. Many of the invited journalists proceeded to impugn Mr. Anwar without revealing the identity and motivations of the tape's owners. Nor did they determine whether the tape was doctored, or other details of its provenance. Mr. Anwar's denials that he is the man on the tape, and his defense that he was busy posting on the Internet on the night in question, have been given short shrift by the country's mainstream media outlets, many of which are owned by the government and the parties in the ruling coalition.

Dirty-tricks campaigns like poison-pen letters are depressingly common in Malaysia. But public skepticism about the ever-lengthening list of allegations against Mr. Anwar suggests they may no longer have the power they once did to ruin political careers. Alternative sources of information are developing, and as Malaysians become better informed they are more independent-minded. If Mr. Anwar can convince Malaysians that he is not the man on the tape, this latest attack will only ma! ke him s tronger, since it will bolster the belief at home and abroad that he is the victim of politically motivated persecution.

That would spell bad news for the ruling United Malays National Organization, which says it has nothing to do with the sex tape. Its support has been slipping away in the Malay heartland, leaving the ruling coalition vulnerable. In the March 2008 general elections, the opposition substantially increased its seats and polled 46.8% of the popular vote. Mr. Anwar then came close to toppling the government by enticing MPs to defect from the government benches. Prime Minister Najib Razak has since managed to rally government forces, but this could be a temporary reprieve. UMNO is vulnerable to complaints that corruption scandals such as that over the funding of Port Klang are occurring on its watch.

The transfer of power might have happened much sooner but for Mr. Anwar's conviction for sodomy in 1998. He served six years in prison before the Supreme Court reversed a verdict that had become a stain on the country's body politicthe defendant was beaten in custody by the inspector general of police, evidence was inconsistent and witnesses were found to have been coerced. So it's understandable that many Malaysians regarded the latest case with skepticismespecially given irregularities in the investigation, such as the lack of medical evidence and delay in collecting DNA evidence.

Mr. Anwar has maintained his innocence, but the pressure has taken its toll. While even the Islamist PKS party dismissed the latest sodomy allegations and affirmed Mr. Anwar's leadership at first, the opposition coalition has been fracturing and losing by-elections in recent months.

Many Malaysians have had enough of dirty tricks. But Mr. Anwar still faces an uphill struggle to convince a majority that despite all the smears he is a worthy leader.

Since the inaugural launch of the MyConstitution Campaign on 13 November 2009, the Bar Council Constitutional Law Committee (BCCLC) has launched 8 out of the 9 phases of the campaign over the last 1.5 years. Each phase was on a specific theme of the Federal Constitution, and saw the launch of its own Rakyat Guides booklet and Rakyat Service Advertisement.

On 2 April 2011, the final (9th) phase of the MyConstitution Campaign will be launched at the "Rock 4 Rights" event at Fort Cornwallis, Penang. In addition to producing its 9th Rakyat Guides booklet and Rakyat Service Advertisement on "Elections and Democracy", the Committee has also produced a music album entitled Radio Demokratika.

Radio Demokratika contains 12 original songs written and performed by 12 local independent bands. Each song is a message on human rights, democracy and constitutionalism. Radio Demokratika is sold at all Rock Corner and Victoria Music Centre outlets in the Klang Valley for RM29.90 per CD.

"Rock 4 Rights" is a 12-hour non-stop concert and carnival organised by the BCCLC in partnership with Frinjan and Saya Anak Bangsa Malaysia (SABM) and supported by Yes. Malaysiakini is the online media sponsor for this event. The event is also endorsed by the Penang State Government. This one-of-a-kind initiative will start from 12pm until12am.

A total of 18 bands will perform; a combination of bands from the Radio Demokratika album, the Bangkit album (produced by SABM), Frinjan and others. There will be performance arts and film screening as well as a variety of food and beverage stalls, arts and crafts stalls, a counter for festival memorabilia, CDs by the performing artists and voter registration booths. Unregistered eligible voters are strongl! y encour aged to register at the voter registration booths.

"Rock 4 Rights" will be officiated by YB Prof. Dr. P. Ramasamy, Deputy Chief Minister of Penang at 8:00pm on 2 April 2011.This is what we hope to achieve through this event:

  • Better awareness amongst local artists and youths on the concept of elections and democracy;
  • Increased participation of youths in the Malaysian political process through the conduct of voter registration drives during the concert and related events; and
  • Greater media coverage and publicity on issues pertaining to the Federal Constitution.

British pathologist: Teoh was conscious when he fell

Disagreed with the theory of Thai pathologist Pornthip Rojanasunand that bruises found on the neck of the deceased were caused by strangulation.

March 29 (Bernama) - The Commission of Inquiry investigating the death of political aide Teoh Beng Hock heard today that Teoh's skull fracture might be due to a fall from a height and to excessive strain.

Prof Dr Peter Vanezis, who had participated in the investigation into the death of British royalty, Princess Diana, and is currently engaged by the Malaysian Anti-Corruption Commission (MACC), said the possibility of injury to the skull induced pressure on the flat surface.

Dr Vanezis said this same force caused injuries to the deceased's pelvis, and upper and lower limbs, including those areas of tissue damage.

Questioned by lawyer Christopher Leong from the Bar Council whether the skull fracture was caused by beatings with blunt objects, Dr Vanezis said:"There was no indication the deceased was injured by a blunt object."

Teoh, 30, the political aide of Selangor state exco member Ean Yong Hian Wah was found dead on the fifth floor corridor of Plaza Masalam in Shah Alam, Selangor, after giving his statement at the Selangor MACC office located on the 14th floor of the same building.

Dr Vanezis disagreed with the theory of Thai pathologist Pornthip Rojanasunand that bruises found on the neck of the deceased were caused by strangulation.

"There was no evidence that Teoh's neck had been compressed, as with strangulaton. The bruises on the neck region were part of the overall injury from the fall," he said.

Dr Vanezis, and Pornthip -- hired by the Selangor government -- had observed a second post-mortem on Teoh's exhumed remains in November 2009.

The British pathologist noted no effect or cracking finger around the neck and bleeding around the eyes that was common if the dead was strangled.

Replying to conducting officer Amerjeet Singh, Dr Vanezis, the 27th witnesses, said if there was prolonged neck lock, there would be signs of asphyxia which was not present here.

He also told the inquiry that the fracture in the bones showed the victim landed with his feet when falling, and this showed that the deceased was conscious when he fell.

Questioned by inquiry panel chairman, Federal Court judge Tan Sri James Foong Cheng Yuen whether there was possibility of the deceased slipping from the window, Dr Vanezis said: "I was told there were shoe marks in the window frame, where the deceased might have sat for a while before stepping out of the window."

Referring to the bruises on Teoh's chest area, he believed the bruises appeared due to pressure from his clothes.

The inquiry panel members also include former Federal Court judge Datuk Abdul Kadir Sulaiman, former Appeals Court judge Datuk T. Selventhiranathan, Penang Hospital's forensic pathologist Datuk Dr Bhupinder Singh and the dean of Cyberjaya University College of Medical Sciences, Prof Dr Mohamed Hatta Shaharom.

Prime Minister Datuk Seri Najib Tun Razak ordered the setting up of the commission of inquiry on Jan 25 this year to investigate into Teoh's death after the Coroner's Court returned an open verdict on the case.

The inquiry continues tomorrow.

Lawyer's theory "extremely unlikely", says Dr Vanezis

KUALA LUMPUR, March 29 (Bernama) -- A British forensic expert who testified before the Commission of Inquiry investigating the death of Teoh Beng Hock deemed a theory that someone applied cardiopulmonary resuscitation (CPR) before deciding to throw Teoh off the window as "extremely unlikely".

Prof Dr Peter Vanezis said counsel Christopher Leong, who represented the Bar Council, was also "taking it a bit too far" with that theory of his.

Leong suggested that Teoh could have possibly been restrained (the neck hold), which could have injured the carotid artery or the vagus nerve (both located at the neck region), rendering him unconscious.

He also suggested that the person or persons who were present did not know what had happened and applied CPR on Teoh.

He said as the person/s thought Teoh was gone (dead), they decided to throw him off the window but within that fall, he regained consciousness.

"Your theory is extremely unlikely and would take a great leap of faith to believe that Teoh was restrained by neck lock which rendered him unconscious, causing the officers to perform CPR. You are taking it a bit too far," he said.

Dr Vanezis also explained that injuries to the arms and wrists were due to the deceased toppling over a bit as he went down and his arms were not directly outstretched.

He said for an "incapacitated and restrained" person to get out of the window without a single mark was "quite an achievement" as there would be some struggle, and a person who was conscious and aware would leave some marks to a small window as he would be struggling if pushed out.

Dr Vanezis maintained his opinion that Teoh was fully conscious when he fell and had attempted to break his fall from a height.

Rais Yatim’s whitewash media council a load of disinformation

Rais Yatim, often a mouthpiece of disinformation, lived up to that tag on Monday when he explained to Parliament why a press council had yet to be set up.

He said there were “differences in opinion” in the press, but such a Malaysian Media Council — which has not been publicly discussed or debated — would be set up when the trade was unanimous on the idea.

He might have a long wait. The idea of a press council has been on the table since the mid-1970s. Various leading lights of the press have been involved, such as Dol Ramli, Mazlan Noordin, A Samad Ismail, Noordin Sopiee, Zainuddin Maidin, CC Liew and PC Shivadas.

It’s still on the table. And the press are not likely to reach unanimous agreement on the matter any time soon.

There’s more than just differences of opinion. There’s plain outright opposition, and for very good reasons.

A press council, from the outset, was mooted as a means for the public to hold the press accountable for what the press does, so that those aggrieved by unfair reporting or coverage can seek redress.

But that’s not the kind of press council Rais Yatim spoke about. His perverted idea of a media council is that of an industry lobby, where government and media, already cozy with each other, finally get into bed with each other.

The idea of a self-regulating press council, where the press answers to its peers and the public for what has been published, long ago foundered for fears of what it would become: another layer of government control.

In an already over-regulated profession, where politicians, bureaucrats and policemen can determine a journalist’s future and his livelihood — and lie about it — very few in the press wanted to see more politicians and their friends given more control.

No journalist or publisher would want to subject himself to a kangaroo court where he will be put on trial for political reasons.

Rais Yatim himself, explaining what the press council would do, showed why there is a lack of consensus in the trade. This is what he told Parliament:

The council would be a platform and forum to forge goodwill and relationship between the government and the media through formulated meetings three times a year. It would also be a medium for the government and the media to discuss and share ideas and plan the development and transformation of the media. “The setting up of the council is expected to comprise all the government industries involved or related to the media, including print, electronic, new media, internet, bloggers, media organizations and non-governmental organizations (NGOs).” [» Bernama]

Thanks, but no thanks, Rais Yatim, PhD (repudiated).

No, we journalists do not want your version of a media council. We are not a government department. We are not a Barisan Nasional bureau.

No, we do not need “formulated meetings” with the government. Politicians and bureaucrats love to work by “formulas”. We journalists don’t like to work by formulas, and even less do we want to work by government formulas. We’d like to report real stories, true stories, not work by “formulas”. Keep the “formulated” to yourself.

No, we do not want meetings “to forge goodwill and relationships with the government”. That’s just a politician’s code. What you really mean is: you politicians will tell us what you want done, and you expect us to come to these meetings to tell you how we’ll do that. No thanks. We already have “briefings” from KDN, and “meetings” where they bully us by threatening to withdraw our permits.

No, we don’t need more of such meetings. In fact, we want less of them. We don’t want to be told how to do our jobs, by people who don’t do what the public pays them to do, and who are never accountable to the public for what they do.

No, we want politicians and bureaucrats to get out of our way so that we can do our jobs. Our job is to uncover the truth. We want politicians and bureaucrats to speak the truth, to give us honest information, and not expect us to lie on your behalf, to make you look good, or to cover up for you. That’s how you earn goodwill from journalists.

No, we do not want government to “plan the development and transformation of the media”. We are not a government department. We in the press and broadcasting are quite capable of developing our media ourselves. In fact, we have done so without any government “planning”.

No, we do not want government involved in “transforming the media”. We want government out of the media business. We want government to get out of our hair and let us do our jobs. We want government to stick to what they should be doing: administering the country for the benefit of all, not for monopolies.

No, we want politicians to transform themselves first.

We want politicians to stop second-guessing how journalists should work. We want politicians to stick to doing their job, and doing it properly, and stop trying to tell us how to do ours. We want politicians to be accountable for what they say and do, and to stop blaming it on journalists.

We want government to transform itself first.

First get rid of the notion of an Information Minister being a Minister of the Media.

Get out of the press control business. Get rid of the KDN permit. Get rid of the KDN Publications Divison. Stop holding monthly meetings to “brief and consult editors”. Throw out bureaucrafts from the thought control business. Throw out mullahs from the thought control business. Throw out police and Special Branch from the thought control business. Throw out Umno hooligans from the thought control business. Throw out politicians from the thought control business.

Provide for freedom of information. Enact a new law setting out the public’s right to information. Government information does not belong to bureaucrats or politicians. They are public records that rightfully belong to the people. They have a right to information that they own.

Reform media law. Reform libel law. Reform the Sedition Act, the Official Secrets Act, the Printing Presses & Publications Act. Reform the Broadcasting Act, the Communications & Multimedia Act. Reform media ownership. End monopoly ownership of press and broadcasting — that means throw out Umno, MCA and MIC from television, radio, press and advertising ownership.

Free the press and broadcasting. Give Radio-Television Malaysia their independence. Let RTM become the independent public service broadcaster that it should always have been, not the government and Umno propaganda machine that it has become. Allow independent journalism, free of party control. Keep partisan journalism within the confines of party organs, not in the public press.

Close down the Information Ministry. Let the Information Department stand on its own, doing a proper, professional job of managing government information and providing real information to the public and the press. Throw out the party hacks and party propagandists who masquerade as Information officers.

Rais Yatim needs to show that he is a real Minister of Information and has the balls to reform the Information Department, RTM and Bernama, to become the fully professional agencies that they were set up to be.

He has no business telling the media how they can transform themselves. He has no business reporting to Parliament on the media. He is not, and the country does not need, a Minister of the Media.

And as his statement on the media council has shown, he is still very much a minister of disinformation.

Thomas Lee has been let go after 10 months as chief editor of MySinchew, the online English-language site of Sin Chew Daily.

Although the company’s stated reason was that MySinchew was being downsized, it is believed that Thomas’s departure was the result of subtle government pressure because of his outspoken commentaries, particularly on religion.

MySinchew itself only said the site was being reduced, with minimum staff, in anticipation of tougher economic conditions because of higher petroleum prices and the political unrest in the Middle East.

However, Thomas’s pointed commentaries on religion have not gone down well with the authorities. Thomas, a staunch and practising Christian, has been outspoken about the recent controversy over the impoundment of Bibles published in Malay, and the use of the word “Allah” by the Catholic weekly, The Herald, early this year, as well as on other political and religious issues.

Thomas said he had been told earlier in the year to “be more careful” in his writings; he was given to understand that KDN officials had made remarks about his columns at meetings with Sin Chew editors this year, particularly in January when the paper’s publishing licence was to be renewed.

Earlier this month, The Star was called in by KDN and issued a reprimand because of reports on the Bible issue, particularly a statement by the Evangelical Christian Fellowship which was contrary to the stand taken by the KDN.

Most newspapers have since toned down their coverage of the Bible issue, it is believed as the prompting of top political leaders and the KDN, in light of the Sarawak state elections to be held in April.

Sarawak has a large Christian population among the native communities.

Penang-born Thomas, 62, has been in journalism since 1975 after returning from Australia with a diploma in theology and a degree in history, economics and politics. He subsequently obtained master’s degrees in theology and journalism.

Thomas began as a reporter with The Star, and has since also worked with the New S traits Times, the now defunct National Echo, and The Sun; most of his career has been as a desk man in production editing. He retired from The Star as an assistant editor in the business section and was retained on contract until 2009.

He has been contributing political commentaries to Malaysia Today, Malaysian Insider, Malaysia Chronicle and Malaysian Mirror.

MySinchew was set up to broaden Sin Chew’s reach by publishing English-language translations of opinion columns and commentaries by senior Sin Chew journalists. Under its previous editor, Bob Teoh, MySinchew also came out with a commemorative publication, which was intended to be the first of a series of annuals. With the general election on the horizon, DPM Muhyiddin Yassin goes on a walkabout, presenting the BN case to voters.


Ruling coalition BN appears to be kicking off its campaign for the 13th general election early by using official government events as a platform to rally support.

An example of this was the walkabout in selected Selangor constituencies by Deputy Prime Minister Muhyiddin Yassin, which had the DPM clearly calling for support for BN to win over Selangor in the next polls.

At a town hall meeting in the Ampang parliamentary constituency, Muhyiddin said BN has always put the people first and as such, the obvious choice come elections is BN.

"The rakyat can choose whoever they see fit. In Selangor they have chosen the opposition... maybe they were mistaken.

"For almost 54 years BN has always provided allocations for the needy... and this is taken into consideration by the rakyat.

"During elections, the rakyat will think of which government has prioritised the wants of the rakyat and this government is none other than BN," he said to applause from about 500 people at a school hall in the Lembah Jaya state constituency.

As proof of the government's concern for the people, he said, Prime Minister Najib Abdul Razak would soon make an announcement on a new policy to help them cope with rising inflation.

Counting seats

More obvious was the speech by Agriculture Minister and BN Selangor liaison committee liaison deputy chairperson Noh Omar.

"We need at least 30 seats in the Selangor assembly to take over as state government (and) we have only 21 seats.

"Where will we find the nine more seats, on top of defending the 21? Ampang has two state seats, Lembah Jaya and Bukit Antarabangsa... can we win Lembah Jaya?" Noh asked, to affirmation from the crowd.

However, asked at a press conference later if it was appropriate to deliver political speeches in a school hall, Muhyiddin said that it is "biasa" (normal).

"It is not wrong. It is not an election campaign period, and my speech was about government policies, and the government of the day is BN.

"It is normal. I can't be asking people to support others," he said.

Nevertheless, Muhyiddin added that it was part of BN's strategy to wrest back power from Pakatan Rakyat in Selangor.

"We have identified areas that we believe we can win back... we know it's an uphill battle and Pakatan will not give in easily.

"That's why I advise my colleagues to go to the ground to rally support which, hopefully, will sustain until the next polls, and we will then have the chance to win.”

Muhyiddin, who is also education minister, began his day with breakfast in Kuala Langat - a constituency held by PKR - where he also visited several schools.

He is later scheduled to visit residential houses in Ampang, another area held by PKR, and will proceed to Pandan, a BN constituency, for a 1Malaysia dinner tonight.

Endorsement from experts

In his speech earlier, the deputy premier took a swipe at the opposition, labelling their Buku Jingga (100-day common policy manifesto) as an "irresponsible pipedream".

"Some people remind me that it is actually 'Buku Jing-gay'," he said, chuckling.

"But the government does not take it lightly and has reviewed it in detail to see if the policies can be implemented.”

He said that even economic experts have said that, if Buku Jingga is implemented, the country will go bankrupt.

"They say they will lower petrol and diesel prices, but how? Subsidies cost the government RM14 billion already and reducing prices further will require about RM30 billion.

"Do they have a magic lamp that can grant them the wish for RM30 billion? They are irresponsible in making these suggestions.”

As he did in Kuala Langat, Muhyiddin took potshots at DAP parliamentary leader Lim Kit Siang, who has derided the Government Transformation Programme (GTP) as mere rhetoric.

"Kit Siang says it's all lies and that it's a political ploy. But if he knew how to read (the GTP annual report), he would see the facts in black and white," he added.

'International experts' endorsed the GTP

At the press conference, Muhyiddin said the government had pre-empted Lim's criticism by presenting the programme to "international experts" for endorsement.

"We called experts from the World Bank, former presidents of (corruption watchdog) Transparency International to Putrajaya... and they have verified that the programme has credibility, (and) is a big achievement by the government.

"Our plans are not built on clouds but on solid ground... and if the rakyat terpedaya (falls into the trap) of Buku Jingga, then (the opposition) will be in power for five years but (the policy promises) cannot be implemented.”

Also present today were Rural Development Minister Shafie Apdal, Deputy Finance Minister Donald Lim, Deputy Foreign Minister A Kohilan Pillay and former transport minister Ong Tee Keat.

In the audience were members of Rela, NGOs, government agencies and Umno, as well as tok batin (Orang Asli village chiefs) and village security committee heads.

Azmin turns tables on cops, issues demands

The PKR deputy president has sent a legal letter to the home minister and two top cops, pursuing four demands within 48 hours.

Applying tit for tat, PKR deputy head Azmin Ali has sent a letter of demand to Home Minister Hishammuddin Hussein and two top police officers, demanding an open apology over the 'high-handed' disruption of a ceramah last Friday night.

NONEIn a letter dated March 28, 2011, lawyer N Surendran - who is acting for Azmin - claimed that the police had acted mala fide (with bad intention) and had violated the law.

“Their action in charging, disrupting and ending the political event without any valid reason is unlawful. It is estimated that 50 policemen including Federal Reserve Unit (personnel) raided the event,” said Surendran who is also PKR vice-president.

“Police used extreme force resulting in Azmin (being) pushed and (subsequently falling). There were several (arrests) by the police.”

Copies of the letter were also sent to Inspector-General of Police Ismail Omar and Ampang Jaya OCPD Amiruddin Jamaluddin.

Four demands

Surendran cited a list of “serious offences” by the police - trespassing, criminal intimidation, assault and disruption - and described the raid as “politically motivated”.

“We have been instructed to seek four demands within the next 48 hours,” he said.

The party wants the police to:

* supply the names and serial number of personnel who were involved in the raid;


* supply the names of the police officers leading the team and the person who gave the order;


* issue an open apology, according to terms set by Azmin; and


* give an undertaking they will not repeat such actions.

Surendran said that, if the police fail to comply within 48 hours, his client reserves the right to seek damages via legal action, including aggravated damages and other relief deemed fit.

The ceramah in Gombak, delivered by PKR de facto leader Anwar Ibrahim, was disrupted by the police who also arrested three people.

Azmin has been called in by the police to have his statement recorded, and is scheduled to do so tomorrow.

The relatives of an alleged police brutality victim in Kelantan refutes police version of events claiming he had died of a heart attack.

The family of an alleged smuggler, who died after a run-in with officers from the police's Anti-Smuggling Unit (UPP) in Kelantan, today presented a memorandum to the government, demanding that legal action be taken against the officers allegedly responsible for his death.

The family of Said Mat Hassan maintained their position that he was brutalised and killed by UPP officers in Tumpat on Feb 16, refuting the police version of events claiming that he had died of a heart attack.

They demanded that the police at the same time take responsibility for the action of one officer who had allegedly shot Said's nephew, Ahmad Nizamuddin Mohamad, at the Tumpat Hospital where Said's body was brought later on the same day.

The family also called on the government to pressure the Tumpat police station personnel to stop “covering up the truth” behind the incident.

The memorandum was presented to Minister in the Prime Minister's Department Nazri Aziz by Said's son, Nik Shamsuddin, and the deceased's nephews Sabramu Khairy and Ahmad Nizamuddin.

The group was accompanied by PAS' Tumpat MP Kamaruddin Jaafar and several other Pakatan MPs to meet with Nazri at his office in Parliament.

Said's family and the police have given conflicting accounts on the incident, with a Bernama report quoting Kelantan police chief Abdul Rahim Hanafi as saying that a post-mortem confirmed that the deceased had died of a heart attack.

The family however claimed that Ahmad Nizamuddin was an eyewitness when UPP officers had dragged Said out of his car and assaulted the deceased on the morning of Feb 16, the last time the former saw his uncle alive.

The family claimed further that the police had shot at and injured Ahmad Nizamuddin at the Tumpat Hospital before detaining him for several days on suspicion of inciting a riot.

PARLIAMENT Works Minister Shaziman Abu Mansor says the figure is just an estimate and still requires cabinet approval.

The government is expected to spend around RM24 million to refurbish the multi-purpose hall in the Parliament complex, said Works Minister Shaziman Abu Mansor.

He said the project was mooted after it was decided that the hall will be used for the tabling of the 2012 Budget, usually in the last session of Parliament for the year.

“The lives of all elected representatives are important, so we need to make sure the hall is safe for all of us to use,” he said to a supplementary question from Mahfuz Omar (PAS-Pokok Sena) during Question Time today.

Shaziman acknowledged that the project has been awarded to Trans Resource Corporation (TRC) Sdn Bhd via direct negotiations, but said the cost was pending cabinet approval.

He said the Public Works Department (PWD) was empowered to immediately appoint contractors for projects if it was an urgent matter of public interest.

However, Shaziman hgave his assurance that TRC's appointment was not without good reason, as the company was named the best performing company for major projects worth RM30 million and above by the PWD last year.

Parliament stays put

To an earlier supplementary question from Ismail Kasim (BN-Arau), Shaziman reiterated a cabinet decision, shooting down a proposal to relocate Parliament to Putrajaya.

Shaziman said the government has instead decided to continuously carry out maintenance work on physical facilities at the current premises in between meetings.

Ismail had asked the minister to clarify the government's position on the proposed move, stressing that "it is a matter of pride and history" that the current premises be maintained.

SNONEhaziman also said at least RM100 million has been spent to renovate and refurbish the Parliament building and its facilities since 2007.

The work included the RM91 million spent to upgrade the interior decorations and facilities, and RM9.5 million to install waterproof lining on the roof following the leak in 2007

The “mother of all moral scandals” perpetrated by titled politicians and so-called leaders

On Sunday, the Prime Minister Datuk Seri Najib Razak claimed success in its first annual report of the Government Transformation Programme (GTP) particularly in the six pillars or National Key Result Areas (NKRAs). All these NKRAs whether in fighting corruption or reducing crime can be challenged but one NKRA which the Najib administration has indisputably achieved is the plunge of Malaysian politics to the lowest and dirtiest gutter level in the nation’s history. The lowest and dirtiest gutter politics was reached in the shameful and despicable Carcosa Sri Negara sex videotape screening scandal which has been condemned by all right-thinking Malaysians. The Malaysian Consultative Council for Buddhism, Christianity, Hinduism, Sikhism and Taoism (MCCBCHST) has described it as the “mother of all moral scandals” perpetrated by titled personalities and so-called leaders.

The MCCBCHST statement said:
“Their aim in publicly humiliating the Opposition Leader of Parliament offends the sensitivities of decent people, no matter to what race or religion they belong.”
It said:
“Since the involvement of the trio has surfaced, the Malaysian public is once again feted with disgusting material that begs the question, ‘where is all this leading to?’ in spite of the many seasonal national slogans that challenge us to greater heights of achievement and harmony.”
MCCBCHST declared that the Carcosa scandal does not inspire the younger generation to trust in the political process or to observe cultural, religious, social and moral norms. The council called on the government to take swift and firm action against all those behind the scandal. It said;
“We further urge the government to distance itself from all forms of deceit and cunning and bring the perpetrators of this latest mischief to face the full extent of the law. “Furthermore, the government should employ every means to quell the rising anger, disquiet and dismay over this uncalled-for sordid and despicable attempt, by an unscrupulous few, to achieve their own personal disgusting agenda.”
I fully agree with Dr. Paul Tan Che Ing, the Catholic Bishop of the Melaka-Johore diocese and who is also the president of the Catholic Bishops Conference, who has issued a very stern warning about the far-reaching implications of the Sri Carcosa scandal. He said;
“If the authorities do not take action against those responsible when laws are flagrantly flouted, then we are engendering a situation where fair is foul and foul is fair. “This is a dangerous pass, one in which people, especially the young, will think that there is one set of rules for a privileged few and another set of rules for the rest.”
I am therefore utterly shocked that the Minister in the Prime Minister’s Department, Datuk Seri Nazri Aziz, has come to the defence of the criminals when he said that the “Datuk T” trio responsible for the shameful and despicable Carcosa scandal can be protected under the Witness Protection Act and Whistleblower Act. Even before the police have taken action against the “Datuk T” trio under various laws of the country, the Barisan Nasional government has come to their defence and even granting them immunity and impunity for their crimes! Under these circumstances, who can have confidence that current investigations into the Carcosa Sri Negara scandal will be fair, professional and in the full national interests. Even top police officials do not have such confidence. Yesterday, Datuk Mat Zain Ibrahim wrote an open letter to the Inspector-General of Police Tan Sri Ismail Omar expressing his total lack of confidence that justice will be done in the Carcosa Sri Negara sex videotape screening scandal. Mat Zain was the investigating officer in the notorious Anwar Ibrahim “black-eye” scandal but who was not allowed to complete his investigations because of interference from disclosing that it was the then Inspector-General of Police who was responsible for the assault until a Royal Commission of Inquiry was instituted several months later. In his Open Letter to the IGP yesterday on the Carcosa sex videotape scandal, Mat Zain wrote:
“Saya yakin sepenuhnya bahawa PDRM mampu menjalankan tanggung jawabnya menjalankan siasatan tersebut secara professional dan berkecuali dan tidak terpengaruh dengan tekanan mana-mana pihak sekalipun, lebih-lebih lagi dibawah pimpinan Tan Sri ketika ini. “Namun begitu kertas siasatan ini kelak akan diteliti dan diputuskan olih Gani Patail,Peguam Negara.Diperingkat inilah dijangka akan berlaku,putar belit,manipulasi,penipuan dan pemalsuan apabila sedar akan caramana Gani Patail dan Musa Hassan menangani penyiasatan kes-kes jenayah apabila melibatkan Anwar Ibrahim(Anwar) dan Rahim Thambi Chik (Rahim) dimasa lampau.’
As the Director of Criminal Investigations Division, Kuala Lumpur at the time, Mat Zain had been entrusted with investigations into four police reports lodged by Anwar Ibrahim from Sungei Buloh Prisons, one of which involved corruption of Rahim Thamby Cik as Malacca Chief Minister. Mat Zain wrote:
“7. Mengenai kes rasuah terhadap Rahim pula,BPR dan Jabatan Peguam Negara mengesahkan dalam laporan mereka bahawa terdapat keterangan yang mencukupi untuk membuktikan kes “prima facie” terhadap beliau.Malahan Jabatan Peguam Negara telah menyediakan empat (4)pertuduhan kesemuanya. Iaitu;3(tiga) pertuduhan dibawah Emergency(Essential Powers)Ordinance No:22 of 1970 dan satu pertuduhan kerana membuat Statutory Declaration (SD) palsu dibawah Sek.199 yang boleh dihukum dibawah Seksyen 193 Kanun Keseksaan. “7.1. Bagaimanapun Rahim tidak dituduh langsung,setelah Peguam Negara “indemnify” segala kesalahan jenayahnya setelah Rahim dipercayai bersetuju untuk melepaskan jawatan dalam Kerajaan,Badan-Badan Berkanun dan Parti Politik.Ini adalah apa yang terdapat didalam laporan yang disediakan oleh Jabatan Peguam Negara sendiri. “7.2. Tidak ada sebutan mengenai cara pelupusan harta berjumlah hampir RM40 juta yang Rahim perolehi secara rasuah itu..Tiada maklumat mengenai persetujuan yang dicapai oleh Rahim dan Peguam Negara berkaitan harta yang diperolehi sedemikian itu dalam bentuk:RM 5,439,796.40 sen dalam kawalan peribadi Rahim sendiri,RM14,487,420.50 sen simpanan tunai dalam beberapa buah bank dan RM19,855,555.70 sen harta Syarikat-Syarikat. “7.3. Persoalan yang tidak kurang pentingnya ialah adakah Peguam Negara mempunyai kuasa untuk “indemnify” kesalahan jenayah mana-mana orang berdasarkan pertimbangan Politik?. Adakah Peguam Negara berhak melepaskan wang Rakyat RM 40 juta sebegitu mudah untuk Rahim menikmatinya tanpa sebarang tindakan.Adakah ini sesuatu yang adil kepada Rakyat sedangkan Peguam Negara yang telah mengesahkan bahawa Rahim memperolehi harta sedemikian banyak menerusi salahguna kuasa dan rasuah.Apa yang jelas dalam kes Rahim ini, Peguam Negara juga telah menyalahgunakan kuasanya.”

Nurul Izzah lodges report over Anwar porn comic

KUALA LUMPUR, March 29 — PKR vice-president Nurul Izzah Anwar today lodged a police report over a comic featuring cartoon caricatures of Datuk Seri Anwar Ibrahim in various pornographic acts.

She said the 16-page comic titled “Kisah Juara Raja Lawak,” ridiculing her father and oppposition leader Anwar, was found in her parliamentary constituency of Lembah Pantai.

Nurul Izzah lodged the report at the Dang Wangi police headquarters at 2:40pm accompanied by four people including Lembah Pantai PKR Youth leader Izhar Abdullah Yusof.

“The comic sent via a post office in Shah Alam was received by a resident of Lembah Pantai,” she told reporters after lodging the police report.

She claimed that distribution of the comic was conceived to tarnish Anwar’s reputation and credibility and that of herself as the eldest sibling.

“I lodged the report so that police can investigate who published and distributed the comic,” she added. — Bernama

Karpal: It’s elementary but beyond Nazri’s comprehension

PETALING JAYA: Senior lawyer and DAP chairman Karpal Singh today said the authorities should not give special treatment to the Datuk T trio who had exposed a sex video involving a man resembling Opposition Leader Anwar Ibrahim.

He said that the trio – former Malacca chief minister Abdul Rahim Tamby Chik, businessman Shazryl Eskay Abdullah and Perkasa treasurer Shuib Lazim – should be arrested immediately for their alleged role in making the sex video public.

Karpal was especially peeved with Minister in the Prime Minister’s Department Mohd Nazri Abdul Aziz who had suggested yesterday that the trio will be protected under the Witness Protection Act and Whistleblower Act should the authorities feel they have a case.

“Nazri’s ill-advised comment that the messenger should not be shot clearly reflects the low level of the law this minister has encompassed during his time at law school. He needs a refresher course in law,” said Karpal in a statement.

He pointed out that the trio, having had publicly admitted of being responsible for keeping and screening the sex video to journalists last week, had in fact committed offences under Section 5 of the Film Censorship Act 2002 and Section 292 of the Penal Code.

These sections refer to having possession and displaying obscene material, and punishable by a maximum jail sentence of five years and/or a fine of RM50,000 under the Film Censorship Act and a maximum jail term of three years and a fine under the Penal Code.

“These are no petty offences. They are serious offences (which) were committed directly under the noses of the police in Bukit Aman which is only a stone’s throw away from Carcosa Seri Negara where the video clip was shown,” he said.

He said that the trio has defied the law and were still at large.

“I find it difficult to understand why they are being given special treatment by the authorities… the Witness Protection Act cannot apply to criminals, it only applies to witnesses,” he said.

“This is elementary but beyond the comprehension of Nazri, which is expected. He is the de facto law minister and much more is expected of him in that capacity,” added Karpal.

Anwar had denied being in the video and had lodged a police report.

"Saya dengan sengaja meninggalkan penerangan mengenai kenapa pesanan yang dipaparkan di laman Twitter adalah sejam lebih cepat berbanding di laman Facebook pada 21 Februari 2011 itu, untuk memberi peluang kepada Utusan Malaysia, media perdana dan blogger Umno mengkaji dengan lebih mendalam demi kebenaran.

"Saya menjangkakan mereka tidak akan berusaha memahami bagaimana laman Twitter dan Facebook berfungsi, sebaliknya akan terus memfitnah dan menggunakan perkara itu," katanya.

Berikut ringkasan hujah-hujah Mohd Rafizi:

1. Anwar membuat sembilan pesanan di akaun Twitter yang turut dipamerkan di laman Facebook bermula jam 10:38 malam, 21 Februari lalu. Pesanan itu menunjukkan mustahil pelaku dalam video yang didakwa.

NONE2. Pesanan yang dipaparkan di Twitter sejam lebih cepat berbanding di Facebook pada 21 Februari. Ia boleh diterangkan melalui konsep daylight time saving dan bagaimana kedua-dua laman itu berfungsi.

3. Facebook mempamerkan tempatan kerana iamengikut masa dalam komputer semasa akaun dibuka. Twitter mengikut masa dalam pelayannya di San Francisco, Amerika Syarikat. Masa setiap pesanan Twitter harus ditambah perbezaan masa mengikut zon masa dunia.

4. Penggunaan amalan perubahan jam mengikut daylight ! saving - yang perlu diubah setiap Mac dan November - memberi kesan kepada perbezaan masa antara zon-zon dunia. Apabila jam diubah di Amerika Syarikat; masa di pelayan laman Twitter juga berubah.

5. Pada musim sejuk (November hingga Mac), perbezaan masa antara San Francisco dan Malaysia adalah 16 jam. Setiap pesanan dalam tempoh itu,Twitter secara automatik mengira waktu di tempat asal berdasarkan perbezaan itu.

6. Sehubungan itu, pesanan yang dibuat pada jam 10:40 malam di Malaysia pada 21 Februari bersamaan 7:40 pagi di San Franciso (jam Malaysia tidak mengikut daylight saving). Pelayan Twitter akan menambah 16 jam, yang menyebabkan ia dipamer 11:40 malam (satu jam cepat).

7. Apabila jam diubah semula bermula hari Ahad kedua bulan Mac (mengikut daylight saving) perbezaan masa Malaysia dan San Francisco menjadi 15 jam. Maka, pesanan yang di Twitter mempamerkan masa yang seragam dengan masa tempatan.

8. Oleh itu, masa yang ditunjukkan oleh Facebook (yang menggunakan masa tempatan) adalah masa tepat dan tidak dipengaruhi oleh perubahan akibat daylight saving.
