A leader is a person who inspires, by her actions, her followers to dream and do the impossible. A leader is a person who makes extraordinary things happen. A leader is a person who is veryinfluential and has a high degree of influencing skills. A leader is inspiring by his thoughts, his deeds, his words, his actions. A leader by definition, makes things happen and does not stand by on the side while things h! appen.

Take any leader and you will see that this is so. If these things are not happening, then I would doubt very much if the said person is a leader.

The maid had been working for the politician for eight years when the alleged rape took place. She is married and has two kids with her Javanese husband. According to the report by the NGO, the husband knew of the incident but not the children.

They, however, refused to press charge in 2007 out of fear and shame.

Pakatan Rakyat has defended its proposal to provide a RM500 special monthly allowance for those in the education service in an effort to reform the education sector. In a statement today, PKR de facto leader Anwar Ibrahim said the formula to achieve this was by simply doing away with the BN administration's excesses.

"For example, the cost for the prime minister's international trips so far (RM8.7 million) could have paid for the special allowance for 1,450 teachers.

"Payments of RM77 million made to Apco Worldwide for 2009 can pay for the special allowance for 12,800 teaching personnel, equivalent to the total workforce entrusted to train our teachers.

"The recently disclosed cost of setting up and running Pemandu, involving a sum of RM131 million (including RM66 million paid to consultants) could have paid for the entire personnel managing our education service in the Education Ministry," Anwar said.

Other examples cited by Anwar included RM19 billion in gas subsidies for "crony companies", bailouts and leakages caused by corruption and dodgy procurement practices.

"Therefore, it is not about affordability. It is about political will and Umno and BN's (lack of) priority to restore the quality of education in the country," he said.

Anwar was responding to Deputy Prime Minister and Education Minister Muhyiddin Yassin's claim that Pakatan's proposal would bankrupt the country.

'We know our numbers'

He said that Pakatan had carefully studied the financial impact of its proposal and took note that there are currently 537,211 positions in the education services. This includes personnel in the ministry (24,153), education policy development (4,059), teachers and school operations level staff (493,399) and teacher training staff (! 10,610). The exercise to provide the RM500 special monthly allowance would then cost RM3.2 billion per annum.

"This amount is relatively small when compared with the excesses of Umno and BN in managing taxpayers' money," he said.

Anwar argued that Umno and BN had never treated education as a priority, pointing to the lack of concrete proposals to improve the education sector over the past decade.

"Pakatan's special allowance proposal is the first step towards promoting the teaching profession as a career of choice, at par with other professions such as doctors, engineers and accountants," he said.

'RM3.2b a good investment'

Anwar also chided Prime Minister Najib Abdul Razak for dragging his feet in the establishment of the special consultative body to resolve issues plaguing the teaching profession. He said this would not have come to fruition had Pakatan not made consistent pledges to reform the education sector.

"A competent government would not have managed the nation's education service in this manner. The responsibility to look after the welfare of the teachers is an inherent function of a government. "Thus, it should not wait for a cue from its political opponent before it decides to act for the betterment of the teachers," he said.

However, Anwar added, Pakatan was steadfast in its belief that the welfare of teachers was still central to efforts to improve the quality of education. "Therefore, the RM3.2 billion special allowance proposed will be a good investment for the country's future."

Pakatan's special allowance proposal were among a slew of promises for reforms that can be implemented within the first 100 days after capturing Putrajaya. The pledges were announced during the second Pakatan convention in Penang on Sunday.

Today's Star reported that the high-deck bus that crashed in Cameron Highlands and killed 27 people was illegally modified to carry more passengers. The bus was originally designed to carry 19 but was modified to accommodate 40 passengers!!! The story says that the bus had a permit for only 19 passengers. Now, if I am not mistaken there was an earlier story that said that Puspakom had inspected and approved the bus about a month ago. I think it is the duty and responsibility of Puspakom to come out and tell us and the families of the victims what happened at that inspection. Did they inspect and approve a 19-seater or 40-seater bus? The story even goes further to say that the crashed bus had been inspected by Puspakom regularly since the bus was registered in 2007. So what happened Puspakom?

Since 2003 there have been 122 people killed in bus accidents in Malaysia. And the reaction from the government is always the same. First express great shock and horror. Then point some fingers and look for scapegoats - badly maintained buses, poorly-skilled drivers etc. That will be followed by announcements of some study or other to be conducted by "independent panel of experts". This latest tragedy is no different. There will be another study. Okay. Fine. But first can we all know the results of all the other studies and what actions have been taken since? Please. Oh yes, and of course Chua Soi Lek has come out with a "holistic" approach to something or other. What the fuck that means I don't know. Do you? And Chua also suggested that buses install seat belts. Ho-hum, Chua Soi Lek. That's old hat. Some other YB made that noise long before you. But you won't be the last one lah.

And in Selangor, Ronnie Liu has come out with the big announcement that using the 1Malaysia logo on advertisements in the state is NOT allowed. That's great Ronnie. But why only now? 1Malaysia was announced by Najib months ago and has been used to further the Barisan Nasional/Umno spin all over the country. Now suddenly banned in Selangor. That's a bit slow isn't it? I know, I know. There's just been way too much on your plate. Do I want to understand and sympathise? No.

One parting thought. Is 1Malaysia a Najib original? Motor-mouth, Nazri has released 2 letters that are supposed to prove that it is. One from APCO denying that it was ever involved in the creation of the concept and the other a sworn statement by a political consultant who claimed credit for the One Israel concept. As a Malaysian citizen I really don't give a fuck! Why is that so important? It doesn't matter to me who created it. It is still CRAP! We need a principled political force

I was tempted to comment on the establishment of the Malaysian Civil Liberties Movement (MCLM) as soon as its establishment was announced. But I decided to wait until the closed-door briefing for invited NGOs on Sunday 19 December at the Kuala Lumpur and Selangor Chinese Assembly Hall before penning down my thoughts.

Luckily the wait was worth it because the many comments made earlier were based more on assumptions, and not on what MCLM actually intends to do.

The most common allegation levelled against MCLM is that they are a bunch of idealists who have lost faith in Anwar. The picture being painted is as if they are out there to hurt Pakatan Rakyat.

As an example, Baradan Kuppusamy, a fellow columnist in this newspaper, and one that I highly admire, concluded his column on 15 December 2010, by saying “in MCLM, we are witnessing the birth of a new and unique political venture by committed and passionate individuals who have lost faith in Anwar as the great reformer and want to stride out on their own, whatever the censure.”

Unfortunately there is one very big point that is being missed. MCLM is even more united, more focused and more committed to defeat Barisan Nasional than anything else.

In the closed-door briefing session last Sunday, MCLM made it very clear that their only interest is in helping make sure the reform agenda – currently symbolised by Pakatan Rakyat’s struggle – remains alive.

They even went to the extent of saying outright that they will only work with non-Barisan Nasional parties. Under their “Independent Candidates Initiative” they plan to identify, screen, and support candidates to run against Barisan Nasional in the next general elections. Their intention is to offer these candidates to Pakatan Rakyat component parties.

Thus, when commenting about MCLM, I think we must appreciate that they are first and foremost an anti-Barisan Nasional political force, at least for now. They are not out there to hurt Pakatan Rakyat, but to help them.

The thing that interests me the most about MCLM is their insistence on formulating a set of policy ideas which their candidates will then campaign for. This is quite new in the Malaysian political arena – we have been served with an ethnic-based politics for more than half a century. I am excited by the possibility of being offered a politics based on ideas.

MCLM should indeed work on the policy ideas they want to offer to the public. We desperately need a political force that talks about how to free the poor from poverty, improve our schools and hospitals, free the judiciary and parliament from executive interference, and liberate Malaysians from the shackles of ethnic and religious prejudices.

Once these policy ideas have been formulated, MCLM must stick to their principles and not waver. And it is here that I think MCLM still needs to think how they want to approach the political parties.

If MCLM were to be a principles-based political force, it would be wrong for them to declare outright from this stage that they only want to work with Pakatan Rakyat. For that would be making an assumption that no Barisan Nasional parties are interested in reform.

MCLM must realise that Barisan Nasional is made up of many component parties. And, within the component parties, take UMNO for example, there are factions too. And some of these parties or factions could be open to their reform agenda. I may be wrong, but the only way to find out is by talking to everyone first and deciding only after talking to them.

Chicken sellers feel slaughtered by town council

SEREMBAN: Vendors at the wet market here are crying foul over a decision by the Seremban Municipal Council (SMC) to privatise the slaughtering of fresh chicken.

From next year, they can no longer slaughter chickens themselves. They will have to buy slaughtered fowl from a company operating in Pedas, about 25km away. The slaughterer’s fee is 88 sen per chicken.

“We’ll have to pass the extra costs, including transportation, to the customer,” said Norli Othman, one of the nearly 30 chicken sellers at the market.

They will also have to dismiss some workers, according to another seller, Rosniza Mansor.

“I employ 12 people for various jobs, including transporting chickens from my pen to the market, slaughtering, and dressing,” she said. “All of them will lose their jobs. How will their families survive?”

PAS leader Mujahid Yusof Rawa visited the market today and afterwards told reporters that he would seek the intervention of the Minister of Trade and Consumer Affairs.

Mujahid, who is the MP for Parit Buntar, heads his party’s National Unity Bureau. He was in Seremban at the invitation of the Negeri Sembilan PAS Supporters Assembly.

He said SMC should abandon the privatisation plan for the sake of both sellers and buyers.

"Concern was raised by chicken sellers that most of their Muslim customers preferred to witness the slaughtering because they want to make sure that they are buying really halal meat,” he said.

“Even non-Muslim customers apparently prefer the freshness of chicken slaughtered on the spot.”

He said about 200 workers would lose their jobs if SMC went ahead with the new ruling.

According to vendors, SMC explained that it came up with the rule because the slaughter of chickens at the market was adding to the pollution of a nearby river.

Mujahid called it a lame excuse. “If that is their reason,” he said, “then what about the dressing of fish and other meats?”

He said the council should instead upgrade the infrastructure of the Seremban market.

Hindraf to help flog Borneo Agenda abroad

KOTA KINABALU: Hindraf Makkal Sakthi, the ad hoc apolitical human rights movement directed from London, will flog the Borneo Agenda at the British Parliament after the New Year holidays, at the United Nations in April and at a proposed forum in London.

Hindraf chairperson P Waytha Moorthy disclosed this in a telephone call last night.

“We have asked Jeffrey Kitingan’s United Borneo Front (UBF) to e-mail us a one-and-a-half page submission on its Borneo Agenda to place before the British Parliament’s special committee on Malaysia,” said Waytha. “The committee will take up the matter with the Foreign Office.”

Hindraf will also help organise a one-day Borneo Agenda forum together with the Human Rights Foundation (HRF) of the United Kingdom at the British Parliament.

Also on the horizon is a series of meetings at the United Nations in April next year, either in New York or in Geneva, on the Borneo Agenda. Again, Hindraf will help organise the meetings for UBF.

Waytha is confident that the Borneo Agenda, unveiled last Thursday here, at UBF’s launch by Jeffrey, was a good cause to bring to the attention of the international community.

“We need to settle whether the Federation of Malaysia ceased to exist when Singapore left in 1965,” said Waytha. “It appears that Sabah and Sarawak became independent at the same time as Singapore but were retained unawares in the Malayan Federation of 1957 which was quietly brought back in 1965 when the Malaysia partnership collapsed.”

The Hindraf chief opines that this anomaly is the reason why Putrajaya has been in non-compliance on the Malaysia Agreement of 1963. The agreement sees the federation, discounting Singapore, as one based on three territories – Malaya, Sabah and Sarawak – in a partnership based on equality. In addition, Sabah and Sarawak had autonomy within the 1963 federation.

International network

Asked why Hindraf was taking an interest in the Borneo Agenda, Waytha said that his movement was committed towards the third force – equidistant between BN and PR – led by Jeffrey. Besides, they don’t want to be accused of being concerned only about the Indians as a marginalised community.

“We don’t want to be continually accused of being racists,” said Waytha. “That’s why we want to help out other marginalised communities in Malaysia wherever we can. This will neutralise those seeking to tar and discredit us.”

He reckons that since Hindraf has established a good international network spanning the globe with activists, besides London, in New York, Brussels, Geneva, India, Australia and New York, it is well-placed to reach out to the other marginalised communities in Malaysia.

Besides the Indian underclass, Sabah and Sarawak, Waytha said the other marginalised communities are the Orang Asli and the Christians in Peninsular Malaysia, among others.

“The marginalised communities in Malaysia, across both sides of the South China Sea, must stand together as part of the third force,” said Waytha. “We can empower each other. Individually, we may be of no consequence but united we are a strong force in the agenda for change and reform.”

Waytha does not think that UBF, being an NGO like Hindraf, would be less effective than a political vehicle to take up the case of Malaysian Borneo.

“In fact, an NGO like UBP would be the best vehicle for the Borneo Agenda,” said Waytha. “A cause like this must not be politicised. Having a political vehicle will merely politicise the cause and lead to divisions.”

There must be total unity across the political divide, said Waytha, to make the Borneo Agenda a success.

He agrees with Jeffrey that the existing system – comprising political parties and the two national coalitions, that is, Barisan Nasional (BN) and Pakatan Rakyat – had failed the people of Sabah and Sarawak.

“The BN has failed Sabah and Sarawak for the last 47 years and will continue to fail,” said Waytha. “Where BN has failed, it’s not possible for Pakatan to succeed. We must be realistic. Otherwise, another half century will pass by with no results.”

Apolitical approach

Waytha remains confident that Jeffrey can bring all Malaysians in Sabah and Sarawak together in UBF to speak with one voice on the Borneo Agenda. He will succeed by taking an apolitical approach, he added, “He failed before because of politics.”

Drawing parallels with UBF, Waytha pointed out that Hindraf was also an NGO which was effective because it could avoid the kind of bickering that goes on in political parties. The NGOs, being dedicated to single causes, could focus on their raison de etre and not be bogged down by constant politicking, and the fight for posts and positions, said Waytha. “This was pointed out by Jeffrey last Thursday.”

Jeffrey, when contacted, disclosed that he had asked “UBF economist Zainal Ajamain to prepare the brief submission on the Borneo Agenda” for Hindraf’s submission to the Special Committee on Malaysia at the UK Parliament.

He said that he was not sure whether his presence was required at the Special Committee’s meeting since “it was such short notice”.

He will decide on taking part in the forum in London being arranged by the HRF and Hindraf once the details have been finalised.

Jeffrey certainly intends to be at the UN in April together with Hindraf, whether in New York or Geneva, to explain the Borneo Agenda for the benefit of the international community.

BA JAWI: The Penan community here is suing the Sarawak government and timber giant Samling Plywood for logging in 15,000 hectares of the government approved Penan Peace Park bordering Indonesia.

Ba Jawi village headman Lija Agan on behalf of his community, lodged a collective lawsuit against the defendents in order to protect their livelihood and the high-conservation-value tropical forest from being destroyed by logging.

Agan and three others are claiming that the Ba Jawi forests, which is in Sarawaks Upper Baram region, have been used since time immemorial by their ancestors and must be urgently protected.

About 200 years ago, our ancestors were living in and around Ba Jawi, exercising native customary rights over the land in Ba Jawi and its vicinity.

They hunted and gathered food from the forests and lived on sago (uvut) as their staple food. We are presently exercising these rights over that same land, said Agan in his statement of claim.

Agan said the community wants the logging licence issued to Samling Plywood, a subsidiary of the Malaysian Samling group of companies, to be rescinded.

His statement of claim notes that the license was issued by the Sarawak government to Samling Pywood in an unlawful, improper, unconstitutional manner and was therefore null and void.

Malaysia signed agreement

The Ba Jawi communitys lawsuit is the fifth such NCR case lodged against the state government by the Penan communities in Upper Baram since 1998.

The Ba Jawi area in the lawsuit is a key region of the Penan Peace Park, a self-administered conservation region covering 163,000 hectares which was proclaimed ! a nature reserve by 17 Penan communities in November last year. The area is twice the size of Singapore.

In Februray 2007, Malaysia, Indonesia and Brunei signed a tripartite agreement known as the Heart of Borneo Declaration in which they committed themselves to protecting the rainforests of central Borneo.

In fact in December last year Sarawaks director of Forests Len Taliff Salleh wantonly dismissed the declartion and condemned Penan Peace Park labelling it as an illegal project that tainted Sarawaks image.

In April this year, the Penans issued two written warnings against Samling subsidiary Jerinai to stop logging in the Ba Jawi but to no avail.

Instead the company had reportedly taken up helicopter logging within the communal boundaries of Long Ajeng in the Upper Baram region.

Samling, a Hong Kong-listed timber giant with its operational headquarters in Miri, Sarawak, has a track record of environmental destruction and illegal logging in a number of countries, including Cambodia, Guyana and Papua New Guinea.

BN MP submits evidence of Sabah IC scam to Home Ministry

KOTA KINABALU: The federal government has been given sufficient evidence to prove that foreigners in Sabah have gained Malaysian identification documents through dubious means, a Barisan Nasional MP said today.

Tuaran MP Wilfred Bumburing said he had submitted the evidence in a memorandum to Home Minister Hishammuddin Hussein recently.

One of the many cases he cited in the memorandum, was that of a Filipino who had a genuine Malaysian IC but who travelled to Mecca to perform the Haj using his Filipino passport.

Included also is a testimony of one of the National Registration Department (NRD) officers, who was once detained under the ISA, and who is prepared to provide evidence that the Sabah NRD was involved in the issuance of thousands of 'Project ICs' to illegal immigrants between 1991 and 1994.

Bumburing said that he had painstakingly gathered the evidence after being told in Parliament by the Home Minister on June 10 that no Malaysian ICs were issued to illegal immigrants in Sabah.

The minister, he said, confirmed the statement by the Director of Sabah NRD that no such ICs have been given to illegals in the state.

He said he had used Hishammuddin's reply that he welcomed evidence to the contrary to be submitted to him so that the government could take action to redress the situation as a challenge.

Starting in June this year, he said, he had collated all the evidence needed to prove that indeed ICs had been issued to foreigners.

I have finalised and compiled the evidences to prove my statement and have submitted it to the deputy home minister because the minister himself was not present during the Dewan sitting, he said.

100-page memorandum

The memorandum to revoke the ICs owned by illegal immigrants in Sabah, he said, is more than 100 pages and contains ! all the evidences that the ministry needs.

I hope that the ministry will now act accordingly to solve this 30-year-old problem, he said.

The federal government has no option but to revoke all ICs and MyKads dubiously issued to foreigners, said Bumburing, who is also deputy president of Upko.

He said the issuance of these documents to unqualified immigrants was tantamount to granting them citizenship and with all the benefits that entails at the expense of Malaysian taxpayers.

This, he said, contravened the federal constitution and violated the spirit of the formation of Malaysia of which Sabah and Sarawak were signatories.

Bumburing said he believed the issuance exercise was purely for political purposes.

In actual sense, these foreigners with genuine MyKads and registered as voters in Sabah are in fact the actual 'fixed deposit' as far as the people of Sabah are concerned, he said.

He was alluding to Prime Minister Najib Tun Razak's often enough boast that Sabah is the ruling coalition's power base.

He said that he and other MPs from Sabah have made several attempts to raise the issue in Parliament but have been stymied by the short period allocated to them to get a full reply.

North Borneo should have unfettered control over the movements of persons other than those in federal government employ from other parts of Malaysia into North Borneo.

Bumburing said the issue of 'dubious citizenships' is now openly discussed in coffee shops and debated widely in the Sabah state assembly meeting and in Parliament.

It has also reached the office of the Prime Minister and the national palace, he said adding that Sabahans regardless of political affiliations and religious beliefs have been protesting to the government and the King for years that their rights were being trampled.

This shows that the people are fed up with the empty promises made by the authorities in trying to solve the three decades old menace, he said.

Illegals a threat

Bumburing said the greatest challenge will come from children of these illegal immigrants (PTI) who are undocumented.

He said that if half a million illegal immigrant couples were to have five children each over a period of six years, in 15 years there would be almost three million adult population comprising children of illegal immigrants.

And what is to prevent them from petitioning for a United Nation-sponsored referendum to claim Sabah as their own? their loyalty to the nation is in doubt so, the time to act is now.

The home ministry and the Malaysian cabinet must consider and approve this memorandum in order to preserve the peace, securi! ty and s overeignty of Sabah, he said.

Bumburing sees the memorandum as a 'trust' given to him by the people of Sabah "to resolve in the wisest and most committed way" the problematic issue.

He warned that it was an issue that had to be resolved before the next general election.

Memang Perlembagaan Persekutuan diwujudkan oleh Suruhanjaya Reid atas permintaan Perikatan, tetapi tahukah yang kita yang permintaan orang-orang Melayu mahu memasukkan Islam sebagai agama persekutuan?

Sedangkan draf pertama tidak ada tentang Perkara itu. Islam dimasukkan hasil dari desakan berterusan orang-orang Melayu kerana persekutuan adalah gabungan negeri-negeri Melayu yang telahpun mempunyai kerajaan masing-masing dengan Islam sebagai agama negeri.

Adakah orang-orang Melayu hanya inginkan islam hanya sebagai ritual? Tidak. Berdasarkan sejarah, negeri-negeri Melayu seperti Terengganu contohnya yang telah memasukkan Islam sebagai agama negeri dan menjalankan pula undang-undang syariah yang digelar "Undang-Undang Bagi Diri Kerajaan Negeri Terengganu" oleh Sultan Zainal Abidin III pada! tahun 1 911.

Negeri Johor juga sejak 1885 telah memasukkan Islam sebagai agama negeri dan jajahan takluknya. Sudah tentulah hasrat orang-orang Melayu yang mendesak UMNO memasukkan Islam didalam perlembagaan mahukan agar Negara ini merupakan sebuah Negara Islam dan membenarkan orang-orang Islam melaksanakan hukum Islam termasukalh kes-kes jenayah. Apatah lagi permintaan orang Islam untuk melaksanakannya adalah untuk orang Islam sahaja.

Hanya Islam sahaja disebut sebagai agama persekutuan dengan tidak menghalang agama lain. Kelebihan kepada Islam juga terserlah dalam Perkara 11 (4) mengenai mengawal atau menyekat pengembangan apa-apa iktikad atau kepercayaan agama di antara orang yang menganuti agama Islam.

Selain itu tidak ada disebut bahawa negara ini adalah sebuah negara sekular seperti di India dan Turki.

Berdasarkan keadaan masa kini, pengisytiharan oleh Tun Mahathir dan Tun Abdullah Badawi , dan lihat juga lihat kes Kartika, dan orang lain yang disebat berdasarkan hukum Syariah negeri.

Satu pihak mengatakan ianya salah kerana Perlembagaan Persekutuan tidak membenarkan wanita disebat (seksyen 289(a) kanun acara jenayah), tetapi satu pihak lagi membenarkannya kerana Islam adalah hak negeri dan menurut hukum Islam sebenar seseorang itu boleh disebat sama ada wanita atau lelaki. Ini berdasarkan ayat al-Quran.

Surah An-Nur ayat 2 Allah berfirman "Perempuan yang berzina dan lelaki yang berzina, hendaklah kamu sebat tiap-tiap seorang dari keduanya seratus kali sebat".

Walau apapun tentangan terhadap hukuman ini oleh mereka yang dikatakan menurut perlembagaan, mereka lupa bahawa tindakan Perlembagaan Persekutuan yang tidak membenarkan wanita disebat itu sendiri bercanggah dengan Perlembagaan Persekutuan yang mengatakan tiada diskriminasi gender [Perkara 8 (2)].

Saya juga tidak bersetuju jika peruntukan untuk JAKIM dan lain-lain agensi Islam hanya bersifat sambilan dan bukan satu kewajipan kerajaan perseketuan. Saya yakin peruntukan itu dipenuhi berdasarkan Perkar! a 3 Perl embagaan Persekutuan dan Perkara 12(2) yang membenarkan wang yang disatukan digunakan untuk pembangunan dan perkembangan Islam.

Parlimen juga membuat undang-undang Islam di peringkat persekutuan untuk Wilayah Persekutuan dan memberi hak eksklusif berkenaan Islam kepada mahkamah Syariah melalui Perkara 121(1A) .

Maka berdasarkan itu jelaslah yang negara ini bukan sebuah Negara secular. Negara sekular ialah sebuah Negara yang memisahkan agama dari kerajaan. Tetapi negara adalah sebuah negara yang mempercayai tuhan (Rukun Negara - 1) dan mempunyai agama rasminya iaitu Islam.

Aston:

Sesuatu negara tidak boleh diisytiharkan sebagai satu negara Islam. Bagi menjadi satu negara Islam, satu pemindaan harus dibuat kepada Perkara 4 Perlembagaan Persekutuan bagi menyatakan bahawa Hukum Syariah adalah undang-undang utama.

Adalah jelas Tun M and Tun A. B. tidak mempunyai pengetahuan asas mengenai undang-undang ataupun teori-teori politik dan mengikut pandangan saya are people not fit to be called leaders of nation states.

Islam telah disebut di Perkara 3(1) oleh kerana sejarah agama Islam di negara ini. Tetapi, ianya hanyalah sebuah deklarasi tanpa sebarang kesan perundangan. Saudara Fyrol masih belum lagi memberikan pendapat saudara mengenai Perkara 3(4) yang dengan khususnya menyatakan apakah kesan Perkara 3(1).

Mengenai Perlembagaan India, harus juga diingat bahawa sehingga kira-kira 1976, tidak terdapat apa-apa pernyataan di dalam Perlembagaan India yang menyatakan bahawa ia merupakan satu negara sekular.

Perkataan "SEKULAR" telah dimasukkan melalui satu pindaan pada tahun 1976. Tetapi di antara tahun 1946 sehingga 1976, India masih merupakan satu negara sekular kerana cara undang-undang Negara digubal adalah melalui prinsip-prinsip demokrasi dan undian.

Saya percaya bahawa bahawa rujukan saudara kepada Undang-undang Syariah Islam sebelum kemerdekaan Malaysia telah dijelaskan oleh Tun Salleh Abbas di dalam kes Che Omar Che Soh. Dia telah berkata:

"The developme! nt of th e public aspect of Islam had left the religion as a mere adjunct to the rulers power and sovereignty. The ruler ceased to be regarded as Gods vicegerent on earth but regarded as a sovereign within his territory. The concept of sovereignty ascribed to humans is alien to Islamic religion because in Islam, sovereignty belongs to God alone. By ascribing sovereignty to the ruler, i.e. to a human, the divine source of legal validity is severed and thus the British turned the system into a secular institution. Thus all laws including administration of Islamic laws had to receive this validity through a secular fiat."

Mahkamah Rayuan di dalam negara ini pula saudara Fyrol telah memutuskan bahawa Undang-Undang Islam di negara ini boleh dipertikaikan atas asas tidak selaras dengan Perlembagaan Persekutuan.

Di dalam kes Zaina Abdin & Ors v Kerajaan Malaysia & Ors [2009] 6 CLJ 683, takrif bagi "orang Islam" sedang dicabar sebagai tidak selaras dengan Perlembagaan Persekutuan. Mahkamah Rayuan telah bergantung kepada beberapa kes-kes Mahkamah Persekutuan untuk sampai kepada keputusannya itu.

Mengenai kewajipan Kerajaan Persekutuan, saudara boleh membaca sendiri di Perkara 12(2), Perkara 74(2) dan Jadual Kesembilan Senarai II Item 1 di mana perkataan "may" digunakan dan bukannya "shall".

Negara ini memang mempercayai agama dan turut mempunyai agama rasmi. Tiada siapa yang mempertikaikan itu tetapi ini bukannya satu negara di mana undang-undang bersama hukuman digubal mengikut Al-Quran.

Saya percaya, apa pun undang-undang yang digubal haruslah tidak bertentangan dengan Hak-Hak Asasi Perlembagaan Persekutuan (Bahagian II Perlembagaan Persekutuan).

Artikel 121(1A) tidak mempunyai apa-apa kena-mengena dengan Undang-Undang Syariah, Artikel 121(1A) adalah berkait dengan bidang kuasa Mahkamah Syariah.

Soalnya sekarang, adakah Mahkamah Syariah mempunyai bidang kuasa untuk menafsirkan Perlembagaan Persekutuan?

Mengikut kes Mahkamah Persekutuan Latifa! h Mat Zi n [2007] 5 CLJ 253 dan kes Abdul Kahar [2008] 4 CLJ 309, Mahkamah Syariah tidak mempunyai kuasa untuk menafsirkan Perlembagaan Persekutuan.

Saya hanya boleh mengakhiri hujahan utama saya ini dengan satu renungan kepada ayat-ayat terakhir Tun Salleh Abbas, seorang hakim Muslim di dalam kes Che Omar Che Soh:

"However, we have to set aside our personal feelings because the law in this country is still what it is today, secular law, where morality not accepted by the law is not enjoying the status of law." [penekanan saya]

Penans sue to protect Borneo rainforest

BA JAWI: The Penan community here is suing the Sarawak government and timber giant Samling Plywood for logging in 15,000 hectares of the government approved Penan Peace Park bordering Indonesia.

Ba Jawi village headman Lija Agan on behalf of his community, lodged a collective lawsuit against the defendents in order to protect their livelihood and the ‘high-conservation-value’ tropical forest from being destroyed by logging.

Agan and three others are claiming that the Ba Jawi forests, which is in Sarawak’s Upper Baram region, have been used since time immemorial by their ancestors and must be urgently protected.

“About 200 years ago, our ancestors were living in and around Ba Jawi, exercising native customary rights over the land in Ba Jawi and its vicinity.

“They hunted and gathered food from the forests and lived on sago (uvut) as their staple food. We are presently exercising these rights over that same land,” said Agan in his statement of claim.

Agan said the community wants the logging licence issued to Samling Plywood, a subsidiary of the Malaysian Samling group of companies, to be rescinded.

His statement of claim notes that the license was issued by the Sarawak government to Samling Pywood in an “unlawful, improper, unconstitutional” manner and was therefore “null and void.”

Malaysia signed agreement

The Ba Jawi community’s lawsuit is the fifth such NCR case lodged against the state government by the Penan communities in Upper Baram since 1998.

The Ba Jawi area in the lawsuit is a key region of the Penan Peace Park, a self-administered conservation region covering 163,000 hectares which was proclaimed a nature reserve by 17 Penan communities in November last year. The area is twice the size of Singapore.

In Februray 2007, Malaysia, Indonesia and Brunei signed a tripartite agreement known as the “Heart of Borneo Declaration” in which they committed themselves to protecting the rainforests of central Borneo.

But the declarations has seen no protective engagement on the ground.

In fact in December last year Sarawak’s director of Forests Len Taliff Salleh wantonly dismissed the declartion and condemned Penan Peace Park labelling it as an “illegal” project that “tainted Sarawak’s image.”

In April this year, the Penans issued two written warnings against Samling subsidiary Jerinai to stop logging in the Ba Jawi but to no avail.

Instead the company had reportedly taken up “helicopter logging” within the communal boundaries of Long Ajeng in the Upper Baram region.

Samling, a Hong Kong-listed timber giant with its operational headquarters in Miri, Sarawak, has a track record of environmental destruction and illegal logging in a number of countries, including Cambodia, Guyana and Papua New Guinea.

Doing the right thing!


  1. Last night I spent a few hours at Selangor Assembly Hall listening to Haris Ibrahim and few other individuals. The event was well covered in the media that I don’t really need to regurgitate much about it. Suffice to say that Haris Ibrahim did a splendid job in giving his presentation about MCLM and also addressing the Q&A from the crowd. He deserves a bigger audience. I feel he deserved a primetime TV slot.

  2. Andrew of MOV and a young student local university leader Shazni Munir was well received by the crowd. If measures by level of applause he even beat the rest with his straight talk and idealistic proposition and why he support the MCLM. Malik Imtiaz certainly impressed me with his center approach which focus on the people and emphasized repeatedly that he is not into name calling. He made it clear that he supports whatever that his conscience says that is good for the people. I read it clearly that means that even if the proposition came from BN and it is good for the people he will support it. That is a sign of a responsible candidate.

  3. Despite what is being said and the noble intentions, the aspiring candidates and MCLM committee must accept and appreciate that the playing field in each constituency varies with demographic and the needs of the community. While the civil liberties are important in an educated segment in any constituency, we must accept that this is largely a minority group. The rest of the people judge the candidate based on what they hear about the candidate. The Malaysian public is so use to voting familiar logos. Independent candidate without logos will face a mountainous challenge.

  4. For e.g. loyal BN supporters despite agreeing to the need to have quality candidates will not vote someone that is considered as pro Anwar. A strong minded religious person may also not vote such candidates if they find some religious flaws with the candidate. Haris has addressed the issue when he mentioned about profiling and matching of candidates. Historical records shows that in Malaysian elections, all independent candidates lost their contest and I suspect they also lost their deposits. Will it be different this time around?

  5. In my view the independent candidates will require a lot of help. Haris mentioned that MCLM has good products which are available in the show room for the political parties to consider. Displaying good products in the showroom without applying marketing principles will not result in good sale. MCLM knows this. They need to engage the best Marketing Guru’s and apply the 4P principles in their approach to sell their candidates.

  6. On a personal side, MCLM has asked me to seriously consider being an election candidate. I told Haris I need time to think it through as it requires my family blessings. Whatever my decision will be, I can assure MCLM that they have my full 300% support either as a candidate or any other supporting role. I close with what Haris said, “The right minded people must take center stage for the sake of the nation.” He is absolutely right there. The question is in the size of the role that one play on the stage?

Soal saya kepada orang Melayu di Malaysia: Apa gunanya kita terus menyokong UMNO?

Fakta jelas mendedahkan siapa yang sebenarnya telah mengorban orang Melayu dan Islam di Rawang. Saya rasa mungkin lebih sesuai penduduk berhimpun di pejabat Umno dan MCA untuk membuat aduan mereka, kata beliau.

Di waktu mereka kuat pun, hak Melayu tergadai. Apa lagi kita hendak harapkan dengan parti yang reput, korup dan penuh pendustaan ini?

RAWANG, 20 Dis - Kerajaan Selangor akan memastikan penduduk di Kampung Melayu, Rawang, mempunyai kemudahan surau walaupun notis perobohan dan pemindahan (Surau Al Hidayah) telah dikeluarkan oleh syarikat pemaju bagi menjalankan projek pembangunan yang telah diluluskan lapan tahun lalu.

Kerajaan Selangor melalui Jabatan Agama Islam Selangor (JAIS) akan berusaha untuk menyelesaikan masalah ini agar penduduk di kampung itu dapat terus menjalankan ibadat seperti biasa.

Kerajaan Selangor tidak terlibat langsung dengan pelan pembangunan tapak sepertimana yang dituduh oleh mereka yang terlibat dalam demonstrasi semalam, yang diketuai beberapa pemimpin Umno, termasuk Datuk Zainal Abidin Sakom, kata Setiausaha Politik Menteri Besar, Faekah Husin.

Beliau menjelaskan, tanah yang terlibat dalam projek pembangunan tersebut dimiliki SAP Holdings Sdn Bhd yang akan menjalankan projek tersebut bersama satu lagi syarikat swasta Mahumas Sdn Bhd.

Zainal sepatutnya selidik dahulu sebelum membuat tuduhan liar. SAP Holdings bukan lagi anak syarikat Kerajaan Negeri Selangor.

Pada 2002, Kerajaan Negeri Umno-Barisan Nasional (BN) telah membenarkan Kumpulan ! Darul Eh san Berhad (KDEB) melepaskan saham kepada pihak swasta.

Beliau terlarang dari segi moral dan perundangan untuk menuduh kerajaan negeri sekarang kerana beliau adalah sebahagian daripada kerajaan yang bukan sahaja melepaskan saham dalam SAP Holdings, tetapi juga telah meluluskan projek tersebut, kata Faekah menerusi kenyataan akhbarnya hari ini.

Beliau berkata, kerajaan terdahulu telah meluluskan permohonan SAP Holdings dan Mahumas untuk menjalankan projek atas tanah tersebut, termasuk lot yang diwartakan untuk pembinaan surau.

Lembaga Pengarah SAP Holdings Berhad sekarang ialah Datuk Abu Bakar Mohd Amin, Norihan Mohd Bakri, Tan Kok Yee, Chong Fook Sin, chew Siew Ying dan Chew Ting Teck.

Fakta jelas mendedahkan siapa yang sebenarnya telah mengorban orang Melayu dan Islam di Rawang. Saya rasa mungkin lebih sesuai penduduk berhimpun di pejabat Umno dan MCA untuk membuat aduan mereka, kata beliau.

Berhubung status gerai-gerai tanpa lesen yang beroperasi di sekitar surau berkenaan, Faekah berkata, laporan awal yang diterima dari Pejabat Daerah Gombak mendedahkan gerai-gerai itu dibina secara haram tetapi sewa dikutip oleh bekas bekas ahli jawatankuasa surau, Bing Selamat Amir, bagi mengisi tabung surau itu.

Bagaimanapun, ahli jawatankuasa baharu surau berkenaan mendakwa kutipan itu tidak pernah disalurkan ke tabung surau.

Saya menyeru polis dan SPRM membuat siasatan lanjut berkenaan hal ini dan kerajaan Pakatan Rakyat (Pakatan) Selangor akan memberi kerjasama penuh, katanya.

UMNO rela terima pakai surat APCO dan akuan sumpah seorang Yahudi...

Kandungan surat yang dihantar oleh firma perhubungan awam, APCO Wolrdwide kepada Jawatankuasa Hak dan Kebebasan Parlimen dijadikan asas untuk menggantung Ketua Pembangkang Datuk Seri Anwar Ibrahim daripada menghadiri persidangan Dewan Rakyat selama enam bulan.

Menteri di Jabatan Perdana Menteri Datuk Seri Mohamed Nazri Abdul Aziz berkata, dalam surat bertarikh 19 Ogos itu, firma berkenaan dengan jelas menafikan pembabitannya dalam mencipta slogan 1Malaysia, sekaligus menafikan kenyataan Anwar yang mengaitkan slogan itu dengan firma berkenaan.

"Jadi jelaslah Anwar telah menipu di dalam Dewan, dan inilah bukti yang terpenting sekali untuk membuktikan Anwar menipu," katanya kepada pemberita di Lobi Parlimen hari ini.Baca seterusnya di sini.



1.Pada 22 April 2010 Nazri telah mengemukakan satu usul untuk merujuk Anwar ke Jawatankuasa Hak dan Kebebasan Parlimen

2.Surat APCO yang digunakan untuk menjustifikasikan agar Anwar digantung dari Parlimen bertarikh Ogos 19,2010.


3.Ketika Nazri terima surat akuan sumpah Robert Shrum,aku pasti Jawatankuasa Hak dan Kebebasan Parlimen belum lagi melihat atau membaca surat akuan sumpah tersebut,namun Nazri dan Jawatankuasa Hak dan Kebebasan Parlimen bertekad untuk rekomen Anwar digantung daripada Parlimen.


4.Hari ini tiba2 Nazri mengatakan di mempunyai bukti yang Anwar berbohong. Apa yang jelas ketika Nazri membawa usul untuk merujuk Anwar ke Jawatankuasa Hak dan Kebebasan Parlimen surat2 ini tak pernah ada padanya. Jadi selama 4 bulan sebelum surat APCO dikeluarkan Nazri dan Jawatankuasa Hak dan Kebebasan Parlimen telah sepakat mahu menghukum Anwar salah biar apa sek! ali terj adi.
Kalau Anwar tak akan berjaya dalam mahkamah kangaroo,Anwar juga tak akan berjaya dalam Dewan Rakyat dengan Speaker kangaroo. Speaker kangaroo suka sangat ubah tiang gol ikut rentak kehendak "master"nya di Putrajaya....

Seperkara lagi bolehkah kita pasti sama ada surat APCO dan akuan bersumpah Robert M Shrum,seorang banga Yahudi Amerika Syarikat itu sahih lagi benar? Bukankah Najib sanggup bayar RM77 juta kepada syarikat perunding maka sudah pasti APCO dan kuncu2nya akan mempertahankan reputasi mereka, jika tidak hanguslah RM77 juta yang diberikan daripada gomen Najib.


Nampaknya UMNO beria2 sanggup terima akuan bersumpah daripada perunding Yahudi APCO sebagai bahan bukti benar,sedangkan akuan sumpah Bala tentang pensabitan Najib dan kaum kroninya dalam pembunuhan Altantuya diketepikan....
Berbaloilah kalau kita katakan 1Malaysia=1Isreal...
