I think, we can challenge the government to allow MMC-Gamuda to publish their feasibility studies so that we who have nothing to do can make an assessment. Really, theres nothing to be scared of I am sure the studies were done by brainboxes who can easily trounced our arguments.

Finally, there is one issue I need to answer. In my article about the MRT, there was a comment asking me to clarify whether it would be all right had Gamuda been a wholly-owned company by Malays. Its not all right is the answer. The correct interpretation would have been that was a criticism on the government for its implementation of policies regarding Bumiputera economic interests. The common perception by common Malays is that the policy of special Bumiputera interests has degenerated into a policy for special Malays. Umno must correct this perception.

The Chinese have played the part of project delivery partners for the special Malays. The term PDP would be appropriate in that circumstance. Do I hold back if that is how the policies thus evolved is perceived and do I hold back too if that is how the special Chinese business groups operate?

Sime to sue over RM2b losses by Dec 31

KUALA LUMPUR, Dec 20 Government conglomerate Sime Darby Bhd will file civil suits by December 31 against those responsible for losses in four projects although enforcement agencies are expected to charge several people for criminal misconduct.

The 100-year-old company suffered billions in losses over the Bulhanine and Maydan Mahzam project with Qatar Petroleum, the Maersk Oil Qatar project, the Bakun hydroelectric dam project, and the construction of vessels! for use in the Qatar project earlier this year.

The company expects to file civil actions before the end of this calendar year, Sime said in a statement today.

Upon filing of the suits, Sime Darby will, as announced earlier, publish the claim to be read by interested parties, in view of the wide public interest the matter has generated and consistent with its objective of being transparent, it added.

The Malaysian Anti-Corruption Commission (MACC) and Securities Commission (SC) said last Friday that it found possible breaches of the Penal Code and the Companies Act in Sime Darbys Energy and Utilities Division RM2.1 billion losses.

Both agencies said the police will be asked to file the charges while their investigations continue.

Sime said it will continue to co-operate with the authorities in the investigations.

To date, Sime Darby has voluntarily provided the authorities with all the reports on the findings from the investigations conducted by legal and financial experts appointed by the board of Sime Darby, it said, adding it had to balance its own policy of transparency and accountability against the interests of shareholders and regulations pertaining to such disclosures.

Furthermore, Sime Darby was concerned that revealing the findings of the investigations would jeopardise the potential cases against those found culpable.

Nevertheless, Sime Darby, as previously disclosed, is pursuing civil litigation against individuals with prima facie culpability in the four projects, the company said.

Many people have asked me in recent weeks what are the lessons to learn from the telecom scandal. Here's my quick take. A dumbo's guide? Perhaps.

  • There are no good guys left in politics. Most rob, loot, extort and steal. A few stand by and watch, doing nothing to stop them. If you have some favourite p! oliticia ns, and most of us don't, you can check out which category they fall in. The chances of them falling into either of these two are 100 per cent.
  • If you want to know the truth about any scam, keep digging. There's no limit to venality here. No man is a thief alone. All thieves have family, friends, associates, girlfriends, and, ofcourse, bosses. Every one of them makes money as they go along. That's what politics is all about: Joint Ventures.
  • There's nothing you can't get done here. Anything's possible at the right price, if you have hired the right broker. It doesn't really matter how you designate the broker: lobbyist, PR consultant, policy advocate, political secretary, secretary general of an association or a confederation, peon or pimp. They are the people who get your job done.
  • And when you can't get the right broker, make friends with top journalists. They can provide you all the access you want. Sometimes foolishly, out of some mistaken sense of self importance. Most times because the journalists themselves are in queue for some return favours from the person in office. They are the new part time brokers.
  • You may be the most brilliant guy around but becoming an entrepreneur in India is not easy. It's the same bunch of guys (and their cronies and benamis) who get all the licences and permits, and all the accolades in the media for successfully navigating their businesses through the turbulent waters of corruption and ineptitude. So catch on to a coat tail, guys.
  • We have left the Age of Immaculate Reputations way behind, be it in politics or in business. There are brilliant crooks. There are those who hang on to brilliant crooks. And there are those who hire brilliant crooks to get their dirty work done for them so that they can wring their hands in despair and bemoan the corruption all around.
  • You will always find enough c! lever pe ople to suggest that new laws and regulations should be framed to make businesses run by crooks legit. You will also find there are people around who can coin the right title for the business to sound legit as well. So a robber becomes a seeker of social justice and a pimp, a campaigner for alternative rights.
  • There's nothing wrong that some smart bureaucrat can't explain away as perfectly legal. In fact, most of our laws are constructed in a way such that what's wrong can always be proved right and what's right can always be proved wrong. The few laws that are not so ambivalent are being changed by the same clever bureaucrats to make them so.
  • There's nothing much you can do to punish a venal politician or a corrupt Government officer apart from removing them from their current lucrative jobs so that they can walk into the sunset, sip champagne on the French Riviera and live la dolce vita of the idle rich while new rascals grab their job to loot you and me all over again.
  • To run a stable Government, you must be deaf, dumb and blind, all at the same time. If you are not corrupt yourself, that's a plus for the job because then the media can always absolve you of any criminal intent and blame your colleagues instead. You too can occasionally join the blame game and point fingers at everyone around you. It's quite fun actually.
  • Even though the media may call you corrupt and blame you for all that's wrong with the world, remember it loves the bad. It's the bad that gets their TRPs soaring. So it's no use doing good stuff to change India, make it a better place for all of us because no media will ever report it. It took Mother Teresa fifty years to be famous. It took Dawood Ibrahim three. Raja was famous in a fortnight.
  • When in the Opposition, look stupid and keep screaming at such a loud pitch that no one can hear what you are saying. If they can, they will poin! t out th at you did much worse when you were in power yourself. So just be very noisy. Don't allow yourself to be deciphered. Old crimes will crawl out of the past and knock you off your moral perch.
  • There are no lessons learnt. Ever. No one has asked who taped these private phone chats, and with whose permission. Everyone's so busy settling political scores that they have missed the real point. That people in Government will one day tap into your conversations and listen to them is the scariest scenario writers like Orwell once dreamt of. Today it's an everyday reality.

Malaysia Airlines Multi-Billion Ringgit Losses: Social Care Foundations Robert Phang urges the Attorney-General to explain

by Leven Woon Zheng Yang@www.malaysiakini.com

Attorney-general (AG) Abdul Gani Patail has been called to explain allegations implicating him for the lack of action over Malaysia Airlines (MAS) multi-billion ringgit losses.

robert phang clarify on anwar allegation 080410 01Social Care Foundation chairperson Robert Phang Miow Sin (left) said records and pictures from a whistleblower website of Abdul Gani together with an individual said to be close to former MAS chairperson Tajuddin Ramli have added a different dimension to the controversy.

Phang, who is also a member of the Malaysian Anti-Corruption Commissions (MACC) consultative and advisory panel, said Abdul Gani may see adverse public speculation over his connection to the issue if he ignored the allegations.

Phang was responding to the emergence of photographs on news portalMalaysia! Today, showing Abdul Gani together with one Shahidan Shafie during their recent haj pilgrimage to Mecca.

Abdul Ganis relationship with Shahidan was a close one, Malaysia Todayalleged further, as reflected in the formers early exit from a Malaysia Day function last September to accompany Shahidan to the hospital when the latters child suffered an accident.

NONEThe website had in September and November also claimed that it was Shahidan, said to be an ex-police officer, who had convinced Abdul Gani not to press charges against Tajuddin.

Tajuddin, who was MAS executive chairperson from 1994 to 2001, has been blamed for the national carrier suffering losses amounting to more than RM8 billion.

MAS had also filed several reports against Tajuddin with the MACC, citing Tajuddins move to relocate MAS cargo operations in Amsterdam and Frankfurt to a single hub in Hahn, Germany, as the single biggest loss suffered under him.

The new hub operation reportedly incurred monthly losses of between RM10 million to RM16 million before it was terminated and the government took over control of MAS in 2001.

At a press conference in Kuala Lumpur, Phang said MACC is entitled to investigate the AG if there was a directive to do so by the Prime Ministers Department. Also the Minister in the Prime Ministers Department, Mohamed Nazri Aziz, can appoint a panel to oversee the MACCs investigations into the matter.

He hesitated, however, to say whether MACC would initiate its own probe. They (Home Ministry) must form the panel first, then MACC can investigate, said Phang.

Najib's durian diplomacy vs Singapore's braggadocio

Singapore's Lee gets to stand subsequent to Obama, Najib leftmostTunku Abdul Aziz

Four years ago, upon 18 Oct 2006, we wrote an perspective piece from my 30th building bureau in the UN Secretariat, New York, for the New Sunday Times. The title, Singapore is simply the next door next door next door next door neighbour as good far, we thought sincerely described my comment of the state of the family with neighbouring Singapore. It upset the great many Singaporeans; it also done many realise which whats salsa for the goose is salsa for the gander.

A Singaporean behaves as good many similar to an insecure lover, perpetually seeking assurance which she is the fairest of them all as good as which she is many admired as good as loved. The insatiable craving for regard as good as devotion would, in normal circumstances, indicate to the serious smirch in the inhabitant character. This many we recollect from the Child Psychology lectures we attended in college all those long years ago. How else can you insist their supercilious poise towards us, the Japanese as good as Indians, all descending in to the difficulty of stupid?

Singapore is not an different quantity to us in Malaysia. In the sense it is of us, but not partial of us. Forget the so-called chronological ties which have been ostensible to underpin the family since they volume to zero in practice.

To perspective them through rose-tinted spectacles as is the wouldnt would distort even serve the attribute which has never been known for the convergence of views upon even the many pedestrian of issues. Rather, it has regularly had all the makings as good as attributes of the potentially long as good as acrimonious future.

Singapore has no time for sentiments; emotion is aversion to the inhabitant make-up. So, do not use which tack since it simply! will no t wash with it. Singapore is brutally clinical as good as frequency takes prisoners in any rendezvous with it.

Being tiny is not regularly easy, especially when you have been perplexing to flex your muscles as good as punch upon top of your weight. To be constantly reminded which you have been zero some-more than the tiny red dot upon the face of the earth as President B.J. Habibi of Indonesia once did, rather insensitively, contingency touch the little raw nerves, especially for the nation which can justifiably claim the fibre of successes upon so many fronts.

Now, even the Minister Mentor has doubts if his origination is unequivocally the country. For the nation which has yet to establish an identity, Singapore is overbearingly obnoxious.

In the exchange with Singapore, you contingency never take it during face value. Let us disabuse ourselves quickly of the idea which sentiments as good as organization to help the poor will cut any ice with it. We have to adopt an similarly cold, clinical as good as legalistic approach, as it regularly does.

Think how often you have ended up drawing the proverbial reduced straw in the negotiations with Singapore? The many distinguished was undoubtedly the MSA (Malaysia-Singapore Airline) divorce from which you came away with hardly the shirt upon the back. Singapore has regularly done it transparent which it has no time for the arrange of nauseating nonsense you wallow in, as good as operates simply upon the basis of harsh limit advantage, the bruise of flesh, it can wangle out of any deal, no make the difference what.

Based upon past experience with it, as good as in order to equivocate unnecessary unpleasantness, such as being indicted of bullying the tiny next door next door next door next door neighbour as good as of alternative astray as good as malevolent behaviour, you should, as far as possible, leave Singapore to revelry alone in the stately splendour. In short, it is the next door next door next door next door neighbour as ! good far , with apologies to A Bridge Too Far.

It has become strong which it is simply not worth the bid to cultivate this uncultivable bad mouthing next door next door next door next door neighbour of ours. You cannot ever be right with it since it is never wrong. Winning the little as good as losing the little is not the thing which sits good with it. Winners take all, many similar to Mahathir, is the strategy which appears to be good confirmed as good as matched to the inhabitant psyche.

Our family with the next door next door next door next door neighbour such as Singapore, with the inclination for, as good as unseemly preoccupation with, scoring the debating indicate or dual during every turn, contingency be circumscribed by the many grave as good as correct poise upon the part.

While it is transparent which you cannot equivocate Singapore altogether as it is the next door next door next door next door neighbour after all, you should lead apart lives, receiving zero from it which is not ours, and, in turn, give it zero such as the KTM land which is not the due.

With the next door next door next door next door neighbour which has developed bad mouthing in to the excellent art form, the Foreign Minister has the benevolence to discuss it us not to take their condemnation of all things Malaysian out of context. Pray, what just is the context, Mr Yeoh?

Now which Najib the salesman of durian tact knows what his admirers across the narrow indolent current unequivocally consider of him, the perspective no disbelief shared by many in his own backyard, we consternation what alternative great skeleton he has in mind to rise with Singapore. They have even pragmatic which he is continuous with the help many foul. And what is more, he is low witted in their estimation. we do not indispensably remonstrate with them upon this score. Who says there is no freedom of debate in Singapore?

Yes Prime Minister, moderation is A HARAM WORD FOR YOUR UTUSAN

Datuk Seri Najib Razak today took his message of moderation to the media, urging them to take back the centre and reclaim the agenda for peace and pragmatism.

State news agency Bernama quoted the prime minister as saying the movement of the moderates could marginalise the extremists, and that the media had a significant role to play in this quest.

With collective determination, we can build a more rational, secure and equitable world.

As media messages about the majority who seek peace and moderation spread around the globe, this new world is indeed within our reach, he said at the opening of the 43rd International Convention of the World Chinese Language Press Institute in Penang.

Perhaps he should tell that to the Umno-owned media.

The ones who believe that Malaysians owe everything to Malays. That non-Malay Malaysians have to be thankful that they can be citizens of this country and the social contract must be followed at all costs.

Thats fine if the majority of Malaysians believe that and keep returning a government that believes in Malay supremacy. That Barisan Nasional (BN) is not an alliance of 13 parties but one supreme overlord with 12 handmaidens.

But the prime minister is not saying that. Clearly, he says that we can build a more rational, secure and equitable world that will lead to this new world is indeed within our reach.

Much of unpleasantness wrought out by ISLAMIC might have been wisely avoided. If only our Muslim brethern had gracefully responded to the clarion call of the GE13 at that time promptly without waiting for lengthy and delayed judicial process, the India of today would have been surprisingly different.'Divide and Rule was the policy of the British to sustain their imperialist designs Malaysia and elsewhere. DHAKA: A Muslim cleric has been arrested in northwest Bangladesh following the death of a woman who was publicly caned as punishment by an Islamic court for an extra-martial affair, police said Monday.
Sufia Begum, 50, was accused of having an affair with her stepson and was sentenced by a religious court in her village in Rajshahi district, the local police chief told AFP.
"Village elders tied 10 canes together and beat her legs," police chief Azizul Haq Sarker said. The woman who carried out the beating for the elders has also been arrested.
Begum was whipped 40 times on November 12, local media reported.
"She became seriously ill and was hospitalised after the caning, and she died last week," Sarker said, adding that police launched an investigation following a complaint from Begum's brother.
In conservative, rural parts of Muslim-majority Bangladesh, rights groups say it is common for women to be publicly whipped for "crimes" like adultery despite a High Court ban on such religious punishments.
In some documented cases, rape victims have been flogged for being a "participant" in their sexual assault.
In July, Bangladesh's High Court outlawed punishments handed down by religious edict, or fatwa, following a series of public interest litigation cases lodged by local human rights groups.
Some 90 percent of Bangladesh's 146 million people are Muslims and most live in rural areas.
Should we be concerned about the fate of Christian communities in the Arab world?

This burning issue hits the headlines time and again whenever a church is attacked in Iraq or Egyptian Copts are bullied. Most recently an appeal by a group of Arab intellectuals to rise above sectarian divisions was published in the French media following a gory attack against Ir! aqi Chri stians.

The media routinely characterise the disappearance or wholesale departure of Middle Eastern Christians as imminent or unavoidable. And the trend has been to explain the dangers facing the Christian community as a result of the rise of radical Islam. This explanation reinforces the idea that Christians are victims who must be saved from Islam.

This coverage also provides the opportunity for Arab governments to escape responsibility by blaming religion for any political or social unrest, thus renewing their lease on legitimacy on the cheap.

Conversely, some Western opinion leaders do not realise the impact of statements asserting, for instance, that the end of colonialism deprived Middle Eastern Christians of valuable support from Europeans, or calling Arab Christians Westernised Arabs". Such remarks ignore the importance of Christians ideological contributions to Middle Eastern societies, and the fact that in the mid-20th century it was Christian elites who imagined, conceived and carried the inspiring project of Arab unity.

The concept of Arab nationalism, conceived in part by Christian Arab intellectuals, such as Michel Aflaq, the Syrian founder of the socialist Baath party, was based on the idea of a social body where clan, tribal and religious divisions would be subsumed in the nation, or even in the Arab community. Arab unity was the avenue to a pan-Arab state bolstered by the values of reason, citizenship and modernity.

Despite efforts for pluralism, such as the UN coining 1999 the Year of the Dialogue of Civilisations, the international community seems to be blind to the real challenges of diversity in the world in the past decade.

Celebrating coexistence is not the only response. Dialogue between cultures at the international level can succeed only if it is paired with changes at the national level. How can cultural coexistence be promoted if, within national borders, the cult of the dominant faith, or indeed the one-party system, still exists? Gov! ernments in Arab countries should protect their Christian citizens instead of bringing to court men and women who have chosen a way other than that of the majority.

Multi-national organisations can also lend their support. The Organisation of the Islamic Conference (OIC) and the Islamic Educational, Scientific and Cultural Organization, in addition to defending Muslims living in the West, can also advocate against the abuse inflicted on Christians in the Middle East.

Some voices, including that of Saudi Prince Talal ibn Abd al-Aziz, the brother of King Abdullah, warn that the departure of Christians would be a threat to democracy and modernity in the Arab world. More such voices should speak up in order to initiate a long overdue debate about the living conditions and rights for religious minorities. A failure of democracy, in which citizens lack equal rights under the law and where there are few checks on leaders powers, is largely responsible for the current disaster.

To say that Christians should merely be "tolerated" in the Arab world is grossly unfair. Christians have always been an integral part of the land where they were born and raised, the land of their forbearers, the land of the Bible. They are not a recently imported religious minority that deserves our charity. They do not come from a foreign country. They are active citizens of their homeland where they should have the choice to remain.

If they leave, it will be the end of our history and the beginning of our downfall. The fate of Christians in the Middle East is linked to the fate of the Arab world as a whole.

MACC action on MAS, AG, Khir, WikiLeaks: Still not enough

Tan Sri Robert is upon a MACC advisory panelRobert Phang

There has been open bearing which En Shahidan Shafie is a substitute of former Malaysia Airlines Chairman, Tan Sri Tajudin Ramli. There is open bearing of A-G Tan Sri Gani Patails personal conduct in consorting with En Shahidan during a new Haj pilgrimage. The photographs as well as papers which have been in a open domain appear really convincing. The AGs silence is fuelling suspicion. The AG contingency answer or a Government of PM Najib will suffer. There will be all kinds of speculations especially with a new Wikileaks revelations of trusted comprehension documents.

I have just returned from an overseas outing as well as we am delighted to know which in my absence, a MACC has announced which they will right away examine a MAS Scandal involving Tan Sri Tajuddin Ramli. The MACC contingency be applauded for that.

It is additionally worthy which a Chairman of MACCs Operation Evaluation Panel, Tan Sri Hadenan Abdul Jalil, has come out to diffuse any open notion which MACC is reluctant to movement upon this case. This will reduce open fears as well as skepticisms which a MACC practices selective investigation or which a MACC is fearful to movement against a big fishes.

The finalise by a MACC Chief Commissioner, Dato Seri Abu Kassim Mohamed, to movement without fright or foster can already be seen in a charge of Tun Ling Liong Sik in a PKFZ Scandal. However, a MACC contingency do some-more as there were other names additionally mentioned in a PKFZ audit report.

Similarly, MACC contingency additionally be applauded when former MB Selangor Dato Seri Khir Toyo is eventually charged. However, open questioning still abounds as to why Khir Toyo was charged for a lesser crime underneath a Penal Code as well as not for a some-more serious offence underneath a MACC Act.

I am reminded which these devel! opments have been counts which we have lifted really recently. we am not unaware which we have been attacked as well as criticized for raising these matters. we would similar to to state which we lifted these counts not for any bulletin - personal, political or otherwise. we am not a politician. It is only people with unclean hearts as well as minds which will suspect my motivations for vocalization up for what we believe to be loyal as well as right.

I am a comparison citizen. we love my country. we have been entrusted to be an confidant in a MACC by a former Prime Minister YAB Tun Abdullah Bin Haji Ahmad Badawi. we contingency do probity to a appointment permitted by a Yang Di Pertuan Agong. we cannot just be a rubberstamp. Indeed nothing of a independent members of a assorted panels of a MACC have been rubberstamps. But when a matter has been in a open domain for quite a whilst as well as no movement appears to be taken, then it is incumbent which we contingency remind a powers which be of a open displeasure. To keep mum is to be of harm to a nation, a government, a public.

I believe which was a reason which Prime Minister Dato Seri Najib Tun Razak reminded a thirteen BN member parties of a 4 political diseases Delusion, Amnesia, Inertia as well as Arrogance.

In which regard, there has been open bearing which En Shahidan Shafie is a substitute of former Malaysia Airlines Chairman, Tan Sri Tajudin Ramli.

I call upon A-G Gani Patail to transparent a air once as well as for all. we call upon a MACC to additionally examine a truth or differently o! f these open disclosures. Act, lest this is interpreted by a open as Arrogance.

In a loyal suggestion of a Nativity Season, we pray for Gods Blessings upon all of us in this Beautiful Country Our Malaysia

Rosli Dahlan Acquitted

BREAKING NEWS: Lawyer Rosli Dahlan Acquitted

After 3 years (since 2007) of seeking justice against offences he did not commit, Lawyer Rosli Dahlan is a free man to resume his legal practice and rebuild his family life. Less than 1 hour ago, Judge Abu Bakar Khattar acquitted him without his defence being called.

Finally, we see justice done, although the pain, agony and humiliation that he and his family suffered as a result of the action of the Attorney-General and MACC cannot be erased. He has been a victim of selective prosecution.

Those of us who have been following his case on this blog must now wish Lawyer Rosli Dahlan and his family a good future from 2011 onwards. I congratulate his Defence Team led Dato Kumaraendran for a professional job well done. They put up an excellent fight to win Lawyer Roslis freedom.

What about DPP Kevin Morais?

One lingering question remains and that is of DPP Kevin Morais. He lied under oath and the Attorney-General should open a file and investigate DPP Morais on charges of perjury. This is a serious matter and must not be swept under the carpet. No one is above the Law or below it.Din Merican

Rosli Dahlan Acquitted

by Din Merican

This morning, I was in the Criminal Sessions Court No.10 as early as 9 am to witness the crowd building up to a packed gallery with friends and supporters of Lawyer Rosli Dahlan, amongst them Dato Ramli Yusuff and his partners including his bailor, Mr Andrew Chew. At 9.50 am Rosli walked in with his lovely wife, children and his family members. At 9.55 am, his counsels Dato C Vijaya Kumar, Dato Kumaraendran and Chetan Jethwani took their seats and Ro! sli walk ed into the accused person dock.

At 10 am sharp, Judge Abu Bakar Katar came out of his chambers to an already packed courtroom. The case number was called and the court interpreter asked Rosli to stand up. Rosli stood up and bowed to the Judge who smiled to acknowledge the respect which Rosli accorded the Court.

Without much ado, the Learned Judge delivered his judgment in a soft deliberate voice, almost inaudible, but clearly as follows:

1) That the Prosecution had no basis nor reasonable grounds to issue a Notice against Rosli under s. 32(1)(b) of the Anti-Corruption Act (ACA);
2) That the Prosecution had no basis to consider Rosli as an associate of Dato Ramli Yusuff;
3) That the Prosecution has failed to prove that Rosli did not comply with the Notice;
4) That the Notice was wrongful.

Rosli bowed to thank the Judge, and just as quickly as he came in, Judge Abu Bakar Katar immediately exited to his chambers.

There was a sudden stir, joy and laughter. From the dock, Rosli expressed his gratitude quite audibly Alhamdulillah! which means Praise be to God. There was an exclamation from one of Roslis lawyer friends This proved Kevin Morais is a Liar!. I also heard Dato Kumaraendran remarking that The court should come hard to denounce public officers who lie under oath!.

I saw reporters swarming DPPs Zulqarnain and Sophian who were ashen faced with this firm judgment which proved that Rosli was victimised and, despite his innocence, had to suffer 3 long years to vindicate himself. I overheard the DPPs trying to soften the impact of the judgment by giving some technical explanation. No doubt the mainstream media will do what needs to be done to deflect any negative consequence.

Rosli in his crowning glory!

I saw Roslis wife and children giving way for him to be hugged by Dato ! Ramli, h is counsels, supporters, friends and partners before they took their turn to give him their assuring hugs. I then heard Rosli addressing the media with a very humbling speech as follows:

Alhamdulillah, Praise be to The Lord, The Compassionate, The Merciful.

By His Grace, justice is done today. It has been a long wait for me to seek self vindication 3 long years to be exact. While some consider it as an irony of fate, I have no hesitation in saying that it is mans doing that I was charged first before the principal suspect was charged. And that I am only acquitted long after the principal suspect had been acquitted.

For that, I apologise to my wife and children for putting them through this period of deep shame and disgrace, for which they have never complained but stood steadfastly by me. It was agonizing for my immediate and extended family that the mainstream media had portrayed me as a dishonest lawyer who had hid assets belonging to a crooked senior police officer.

The mainstream media had been unfair to me by sensationalizing adverse unverified stories against me and then failing to report facts favorable to me. Their actions amounted to conspiratory conduct with, what I consider, rogue elements in the government. The mainstream media should realize that their survival depends on the credibility of the news they carry. Thus, they owe a duty for fair and accurate reporting and not to be a medium of propaganda for any agenda.

I thank the Learned Judge Tuan Abu Bakar Katar for delivering justice, as it should be, and in showing that the bench at the subordinate courts is anything but subordinate. Todays decision affirms the assurance by the Chief Justice that the Judiciary is independent, and it should remain so.

I thank my family, my close friends, the Mosque Committees of my neighborhood, the Ustazs and! the Ali ms who continuously made doa for me that gave me much solace during these difficult times.

I thank the Partners of my law firm for their full confidence that gave me the courage and dignity to stand by what I believe to be the right thing for me to do as a professional and ethical practitioner. And I thank them for posting my bail.

I thank all the supporters of justice out there who had tirelessly brought forth to the publics attention the injustice of the case made out against me. At some point I began to wonder if my case would be jeopardized because of the things that were written by the alternative media. But, since the intentions seemed sincere enough, I would like to acknowledge that.

On a personal level, I can now appreciate the publics perception of oppressive laws where those vested with authority over us flagrantly manipulate their powers to achieve a certain objective. I fully subscribe to the principles of the civil liberties movement that we, as Malaysians, must remain vigilant against elements that can turn this country from one governed by the Rule of Law to one that is enslaved by the Rule by Law.

I was struck by Roslis thank you speech which was very deep and meaningful. Even at a time of his victory, Rosli remained composed as to what all this actually meant. This is a man with a purpose. This is a man who we should put into Parliament!

Hadi: "Pakatan is only a gimmick" ?

Hadi acknowledges weakness in Pakatan

Pakatan 2nd Convention The weakness poses the biggest challenge to Pakatan's aim of undertaking a comprehensive transformation of Malaysia.

PAS president Abdul Hadi Awang has acknowledged that there is a weakness in the opposition pact, where several members of the component parties began to lose direction after being attacked from all angles by the BN leadership.

pakatan leaders pc in pakatan 2nd convention 191210 hadiHe said the weakness was the biggest challenge that must be faced, and urged party members to unite and not be easily diverted from the original objective to undertake a comprehensive transformation for the future generation.

There were also occasions when they had differences in opinion when resolving the various problems, said Abdul Hadi at Pakatan's second convention at the Dewan Millennium in Penang today.

The one-day convention was also attended by PKR president Dr Wan Azizah Wan Ismail, PKR advisor Anwar Ibrahim and DAP secretary-general Lim Guan Eng.

In addition, PAS conceded that it did not have much time to implement several policies drawn up by the opposition pact because the BN was always attempting to engineer the downfall of the states led by the opposition pact.

Abdul Hadi said the states led by the opposition pact would not be able to give a meaningful impact in the new politics of the country if they failed to show a better approach in administration than the BN.

We're ready for general elections

Meanwhile, Lim said the opposition pact was fully prepared to face the challenges in the coming 13th general election.

"It is something that is important and critical, and we are fully prepared for it," he said.

pakatan leaders pc in pakatan 2nd convention 191210 01Dr Wan Azizah said that the convention proved that the parties in the opposition pact were still strong and cooperating with one another.

She also denied that the component parties in the pact, namely PKR, PAS and the DAP were facing internal problems and were splitting up.

"The claim that the PR (opposition pact) is declining and facing internal problems to the extent that it was being dissolved is incorrect and we are, on the contrary, always united and this convention proves that the PR is still strong," she said at a press conference on the sidelines of the Pakatan Convention.

Wan Azizah said the second convention also brought the members of the pact closer together and she was confident that they were capable of planning the various agendas to strengthen the pact.

Pakatan 100-day reformasi taster on the plate

Pakatan 2nd Convention Guan Eng kicks off the convention by warning Umno against hijacking the constitution.

The message rang clear at Pakatan Rakyat's second convention today in Kepala Batas, Penang: there is no time left to waste in saving the country from the ravages of Umno, and giving the coalition the mandate to take over Putrajaya to restore justice and democracy in Malaysia.

pakatan 2nd convention 191210 04During their speeches, the three main leaders from Pakatan - DAP national secretary-general Lim Guan Eng, PKR president Dr Wan Azizah Wan Ismail and PAS president Abdul Hadi Awang spoke not only of doom under the present government, but hinted of policies that the nation would enjoy under Pakatan's rule.

Lim, who is Penang chief minister, kicked off the convention by announcing a 100-day programme for the people to enjoy a taste of real reformasi which is possible under Pakatan rule.

The programme is a ten-point resolution that outlined in detail how Pakatan will administer the country for the good of all Malaysians.

pakatan 2nd convention 191210 03Pakatan leaders will sign the document, which is expected to be used as the coalition's manifesto in the coming general election.

Earlier, Lim warned Umno against hijacking the federal constitution to further split and divide Malaysians.

He said that Umno often cites Article 153 of the federal constitution on the special position of the Malays as justification for their racist approach.

“However, Umno invariably fails to mention that Article 153 also states that the legitimate interests of other communities must also be protected,” he added.

'Article 153 protects all'

Lim, who is DAP national secretary, said it is the responsibility of the Agong to safeguard the special position of the Malays and the natives of Sabah and Sarawak as well as the legitimate interests of other communities in accordance with the provisions of the constitution.

About 1,800 people turned up at the one-day event, which is expected to end at about 6pm.

Others leaders present at the convention were Selangor Menteri Besar Khalid Ibrahim, Kedah Menteri Besar Azizan Abdul Razak and a representative of PAS spiritual leader and Kelantan Menteri Besar Nik Aziz Nik Mat.

pakatan convention eve ceramah 191210 anwar speech 02Last night, Anwar along with top Pakatan leaders held a ceramah in Balik Pulau, Penang, as a warm-up to the opposition coalition's second convention.

Before the convention, party leaders and delegates were entertained by several cultural shows like a silat performance, lion dance and a silamban (South Indian stickfighting).

The event also saw a montage on the performance of the Penang state government, that mesmorised delegates with its soundtrack, P Ramlee's hit 'Getaran Jiwa'.

Umno's relentless progapanda

During her speech, Wan Azizah warned of the continuous attacks on Pakatan by Umno-BN, saying it was clearly meant to create confusion among the people and supporters so that the coalition would collapse.

pkr announce new line up 181210 wan azizah“They whisper to the Malays that DAP will sell out the interests of the Malays, so that the Malays will be suspicious about the DAP... they whisper to the non-Malays that PAS is against them, so that they will be worried about PAS,” she said.

“They tell the whole of Malaysia that PKR and Anwar Ibrahim has problems with Pakatan so as to increase the people's suspicions,” she added.

Wan Azizah said Umno will never tire of its propaganda against Pakatan to split up the coalition. It is time, therefore, that announcements henceforth come from the leaders of the three parties as a sign of unity.

Meanwhile, Hadi said that PAS will continue to be the trustee of Islam as the official religion of the country, but stressed that other religions are to be allowed to practice peacefully.

pakatan leaders pc in pakatan 2nd convention 191210 hadiHe added that the confusion about Islam propagated by PAS is caused by inappropriate examples and wrong interpretations spread by Umno, a party he accuses of promoting leaders who are untrustworthy, and who obtain power through corruption and lies.

“In fact in the last convention (in 2008), we have answered all the accusations from our enemies that Pakatan does not understand the constitution and that we will sell out the rakyat,” he said.

“The truth is, it is they (Umno) who does not respect parliamentary democracy, especially when they arrogantly suspended our MPs... it is they who brought a bad name to the country in the eyes of the world”.

On the coming election, Hadi said Pakatan has yet had the chance to fully implement its policies effectively as the next general election is nigh and BN feels that the people's support has returned to the ruling alliance.

“We challenge BN to come to the ring in a trusted and sincere manner, instead of depending on government institutions and agencies; instead of riding on the mass media, and making false promises which eventually turn into corruption to the people,” he said.

"Lets enter the ring in a democratic manner, instead of clinging on to a democracy that has been destroyed," he added.

Hadi: Islamic State is not about Islam ...

PAS wants more time to explain Islamic state

December 20, 2010

KUALA LUMPUR, Dec 20 — PAS asked for more time today to explain its Islamic state concept after a DAP leader expressed worries yesterday that the issue would be used to sow discord in Pakatan Rakyat (PR).

PAS president Datuk Seri Abdul Hadi Awang also said he was ready to speak to DAP national chairman Karpal Singh about the issue.

Yesterday, Karpal said PR’s dilemma over the Islamic state issue needed to be settled immediately.

“Give time to PAS to explain this issue to the rakyat,” Hadi told The Malaysian Insider today.

“We are always open in explaining this issue (of the Islamic state). We are also ready to meet anyone, including Karpal. But we need time,” he said.

PAS and the DAP have long argued over the issue, with the DAP opposing the idea of transforming Malaysia into an Islamic state.

Recently, PAS has however renewed its push for the concept and proposed implementing it in stages should PR win federal power.

At the PR convention yesterday, Karpal said he was concerned that Barisan Nasional (BN) would use the issue to try and sow discord among PR leaders.

The Bukit Gelugor MP, however, expressed confidence that the PR component parties could reach a consensus over the issue.

He also pointed out that his remarks “over my dead body”, which were made in response to the Islamic state issue in 1990, had been taken out of context.

“What I said 20 years ago was taken out of context. Islam is the official religion but other religious communities also have their rights,” he said.

“Hence, it is not right to say that the Federal Constitution enables us to create an Islamic state. But this can be discussed. I do not want BN to exploit this issue... this can be discussed with (PAS spiritual leader) Tok Guru Datuk Nik Abdul Aziz (Nik Mat) and Datuk Seri Abdul Hadi,” said Karpal.

Today, Hadi claimed that an Islamic state was the best form of administration for Muslims and non-Muslims.

“PAS has a huge responsibility to explain this issue to all citizens. Give us an opportunity to explain this issue as we are confident that an Islamic state is the best, not just for Muslims but also for non-Muslims,” he said.

“We have already proven this in several states such as Kelantan, Kedah, Perak and Terengganu during our administration in the past,” added the Marang MP.

He noted, however, that merely proving the effectiveness of an Islamic state was insufficient as there were still many wrong practices being done in those states.

“To prove it in those states is not enough as many practices are not being done correctly,” said Hadi.

During the PR convention last year, Nik Aziz, who is also the Kelantan mentri besar, said Karpal would be open to the Islamic state concept.

Both Karpal and Nik Aziz had appeared on the same stage and sat beside each other during the convention.

Karpal has stressed many times that the DAP is opposed to an Islamic state despite working with PAS in the opposition pact.

PR's weaknesses and what should be done

by

I am a life member of a political party from PR coalition and after 3/08 my thoughts and dreams are to see that PR will become a formidable force to take on the very much hated umno/bn but instead my dreams are shuttered with each passing day.

Many PR MPs and Aduns are performing very well but this alone is just not good enough to take on umno/bn. We like to complain about UMNO's 'little Napoleons' but PR itself got a string of little kingdoms that are very damaging. Discipline and principle are not enshrined nor enforced to curb behaviors that are unwarranted and damaging to the coalition. Many of you share my dreams but there are as many hypocrites with self interest and own agenda.

UMNO/BN are well ahead in preparation for the coming 13th GE, they did not have to go on a campaigning trail but daily using the government sponsored programmes to reach out to the rakyat and they are making progress.

What do we have in PR, using the same old school of chanting, internal fighting, fighting for top leadership and calling whoever dares to criticise PR as "Trojan", "agent of UMNO" and whatnot, hence losing quite a number of good leaders and followers.

Claiming these as norm for any political party is just an excuse, it can be eradicated if the party wanted to. If this is the case it proves my point that there are hypocrite members with self interest and own agenda within.

3/08 is historic, breaking down the wall of BN, an occasion to be happy but also a sad affair seeing quite a number of PR leaders and members becoming arrogant and snobbish.

Clinging on to the 3/08 tsunami phenomenon without any new dimensions will be a disaster. You can still use it but should not be in the forefront while the "Anwar euphoria" is getting a little bit stale. The public must be shown and convince that without Anwar, PAS, DAP and PKR can still work together and not what UMNO/BN is telling that the bond are there because of Anwar and without him all hell will break loose. Yes, Anwar is the binding force for which credit must be given but PR must moved away from that notion without any disrespect for Anwar.

PR talks about 'Ketuanan Rakyat', transparency and accountability but to what extend are these being put into practice?

We still see argument among PR elected reps on policies base upon races, not satisfied with allocation of funds to different races, these are not complaints from the public mind you but from the elected reps themselves fighting for their own races. And not to mention the distasteful way of handling party elections.

Transparency and accountability must not just be a practice in governing but also in all PR coalition parties. It must be a practice right into the heart of PR and it cannot simply be claimed as "party matters". At present, what I observed is that only members that are closed to the party leaders have the say and right to run the party while others, not only the rakyat but also other members, are in the dark of what is going on.

When PR claim to be for 'Ketuanan Rakyat" it must be ready for scrutiny and the rakyat should have the right to know what is happening.

There can be no separation of party or public matters. It is a totally new political game play for Malaysians, they have tasted blood after 3/08 and they want more, and if PR cannot provide more fresh blood the voters will fall back to the lies of UMNO/BN.

It will be fatal for PR not to know that their support is faltering and to keep on pretending that all is fine and the 3/08 tsunami is still strong.

For those who wanted to open their mouth and accuse me of being 'Trojan' or 'BN agent', hold your tongue. I will prefer to die rather than be with UMNO/BN.

For over 50 years the rakyat's mind have been indoctrinated by UMNO/BN that only they can rule the country and without them Malaysia will collapse, a perception that PR must try to rid off. New catch phrases must be introduced to wipe out this perception from the rakyat minds. Eg: "Tiada Umno Tiada Masalah"; "Tiada BN Tiada Masalah".

Lastly, PR must realise by now it cannot conquer Putrajaya on its own, this I may be wrong but will it harm PR to join forces with others that are also fighting against BN?

PR must acknowledge that it does not have the complete line-up of credible candidates for the 13th GE or am I wrong here again? My suggestion is, sit down and discuss with MCLM or even KITA (I can see the mouth and eyes opening wide) to work out a win-win solution.

This email may be brushed off as another 'Trojan' trying to disrupt and destroy PR. Say and think what you like but if PR really wanted to at least maintain the seats and states that they won in 3/08, a lot of internal cleaning must be done, in addition to being humble to work with others, listening to the ground.

Anwar apologizes for defections, "untrustworthy" Zaid

from Malaysia Chronicle

PKR de-facto leader Anwar Ibrahim has taken responsibility for a string of high-profile defections which have battered his party's credibility.

“I apologise for my mistakes... It was true that in (the) 2008 (general election), it was really difficult to select candidates and there were many 'dangerous' seats,” said Anwar during his winding-up speech at the Pakatan Rakyat convention in Kepala Batas, Penang yesterday.

He was responding to an earlier speech by Karpal Singh who admonished Anwar over the series of high-profile defections from PKR.

Anwar said that he was open to criticism that from now onwards, the party will only field candidates who are not only of calibre, but must be of good character, disciplined and are not greedy for political positions.

“It's also true that this party (PKR) must get rid of those who are not disciplined, and who are greedy and selfish... there must be some (emphasis) on tarbiyah (education and upbringing)”.

Since February last year, four MPs and four state assemblypersons from PKR quit the party and declared themselves independent while Kulim Bandar Baru MP Zulkifli Noordin forced the hand of the party to sack him.

The four MPs are Wee Choo Keong (Wangsa Maju) Zahrain Mohd Hashim (Bayan Baru), Tan Tee Beng (Nibong Tebal) and Mohsin Fadzli Samsuri (Bagan Serai) while the four state assemblypersons are Mohd Osman Jailu (Changkat Jering), Jamaluddin Mohd Radzi (Behrang), Tan Wei Shu (Bakar Arang) and Badrul Hisham Abdullah (Port Klang).

Karpal: Zaid 'untrustworthy'

The eight defections and a protracted show of defiance by Zulkifli have dealt a major blow to PKR's credibility.

During his speech, Anwar also accepted Karpal's criticism on accepting former de facto law minister Zaid Ibrahim into the party.

After being welcomed into PKR with much fanfare last year, Zaid went on the warpath against the party leadership during the campaign for the party deputy presidency during the recently concluded internal elections.

Following this, he quit the party in a huff in order to take over Angkatan Kesejahteraan Insan Malaysia (Akim) and renaming it Kesejahteraan Insan Tanah Air (Kita).

Earlier, Karpal had told the 1,800 delegates present that he had advised Anwar to not accept Zaid into PKR's fold but his advice went unheeded.

He said that there was no way that Anwar could deny that he was advised that Zaid was “untrustworthy”.

“He may be the main leader of Pakatan, but sometimes, he makes mistakes,” said Karpal.

“This celaka (Zaid)... was a misjudgment on Anwar's part... I can say this because I say this from my heart... he (Zaid) can't be trusted based on his looks alone.”

Judicial crisis

He reminded the crowd that he had been practising law for about 40 years and considers Zaid, another prominent lawyer, to be the former premier Dr Mahathir Mohamad's 'hatchet boy'.

Karpal claims that Zaid had a hand in the sacking of former Lord President Salleh Abbas in 1988, which led to a serious constitutional crisis which was considered the worst black mark in the country's judiciary.

“I know this thing called Zaid... Salleh was a victim... At one point, he (Zaid) had joined the gangsters in Umno in trying to burn down the Bar Council building,” said Karpal.

Zaid, however, in March 2008, while he was law minister, had asked Mahathir to apologise for the debacle, which the latter refused, but instead asked the tribunal which called for Salleh's sacking do so.

Turning his attention to Zulkifli, Karpal said that the former was “useless”, but was still a glaring example of Anwar's series of misjudgments.

“But he (Anwar) can be forgiven... because at that time, there was a (political) tsunami... there was not enough candidates and many unsafe seats,” he said.

He then commended PAS for being a 'disciplined party' as none of its parliamentarians or state assemblypersons had defected to other parties.

“PAS is strong... there were even two defections in DAP but not PAS...,” he said jokingly, adding that his two sons - Puchong MP Gobind Singh Deo and Datuk Keramat state assemblyperson Jagdeep Singh Deo - cannot be bought over.

'Infighting over seats damaging Pakatan'

By FMT Staff

PENANG: Infighting over seat allocations within the Sarawak Pakatan Rakyat coalition must be resolved immediately if Pakatan's bid to capture Putrajaya is to materialise, according to Sarawak DAP treasurer Violet Yong.

The Pending assemblywoman said there was no time to bicker over the selection of constituencies and candidates.

"Everyone has differences in opinions, but we should unite. We owe it to not only to ourselves but to our future generations to put Malaysia in a place to be shared by all races," she said while in Penang for the Pakatan convention yesterday.

She said the general perception of people was that Pakatan was no different from Barisan Nasional and that Pakatan politicians were failing in their duty to the people.

"It is important that we regroup... all this internal fighting is not good. People perceive us as the same as the Barisan Nasional. The media has painted Pakatan as being no better than BN. The news reports have made us look more evil.

"The repeated lies by the media could become truth, especially to the simple folk in rural Sarawak.

"We should stop speculating about the outcome of the next polls and focus on working hard to prepare for the Sarawak polls," she said.

She also said the series of defections which had caused Pakatan to lose Perak to BN in a reverse takeover had dented the credibility of the coalition to a certain extent.

A lot to explain

Yong added that the recent suspension of the four Pakatan MPs from Parliament had also affected the coalition because of the irresponsible spinning by BN-controlled media which had labelled them as the “tyranny of the minority”.

She said there was a lot of explaining to do in Sarawak about what had hapenned in Peninsular Malaysia.

"There is a lot to explain and do in Sarawak ... of the 222 parliamentary seats, 31 will come from Sarawak. So far, we have only two MPs. We must work harder to dent BN's fix deposit in Sarawak.

"Sarawak is the fourth poorest state in the country... our infrstructure is 20 years behind the peninsula.

"Rural areas have no roads, no medical facilities, no electricity and no water supply. Many don't even have homes to live in.

"We must help these people. We cannot discriminate against them. They are Malaysian citizens as well," she said, adding that there were so many other issues affecting the natives and their rights in Sarawak.

“If we don't trigger a change this time, I worry that the Penans will continue to be neglected and the Malay and Melanau kampungs will continue to remain poor," she said.

Karpal: Pakatan must discuss Islamic state issue

He braved the taboo topic, surprisingly to warm reception from the largely Malay Muslim audience.

DAP national chairperson Karpal Singh said the issue of Islamic state should be urgently discussed by the Pakatan Rakyat as he does not want the BN to exploit the issue at the coming general election.

Karpal , who spoke during Pakatan's second convention wrap up session, said the DAP can discuss the issue with PKR de facto leader Anwar Ibrahim, PAS spiritual leader and Kelantan menteri besar Nik Aziz Nik Mat and PAS president Abdul Hadi Awang.

The Bukit Gelugor MP was the only Pakatan leader who raised the controversial issue at the convention.

However, the veteran lawyer, who advised PAS not to repeatedly say that the constitution allows for an Islamic state, found his suggestions well received by the mostly Malay Muslim audience at the convention.

“I would like to advise PAS to defend the non-Malays' right to freedom of religion just as PAS defends Islam as the official religion of the country under the constitution,” he said.

“Please give 'face' a bit to DAP,” said Karpal in jest, drawing laughter from the crowd.

During his speech, Karpal touched on various issues including Anwar's suspension from Parliament recently and the conduct of the judge in the latter's sodomy case.

The 1,800 crowd who were still glued to their seats at the end of the convention were very receptive towards Karpal's speech, clapping enthusiastically at his jokes and capping his speech with a standing ovation.

'Reject cruelty to other races'

Later, Pakatan leaders endorsed a document entitled 'Change Now, Save Malaysia' that outlined the many issues raised today, such as the crises, resolutions, 100-day programme, joint statement, declaration and Pakatan's policies, as the coalition prepares itself for its Putrajaya bid.

The 20-paged document to be distributed widely in the days ahead, will communicate to voters the coalition's plans on how it will rule the country if it takes over the federal government at the coming general election that is highly speculated to be held early next year.

Endorsed by Anwar (left), Hadi and DAP national advisor Lim Kit Siang, Pakatan delegates and members were told to internalise and spread the document far and wide immediately to ready the coalition for the challenges of the upcoming polls.

During his wrap up speech, Anwar noted that most of the discussions and debates during the convention focussed on the plight of the Malays and how BN and Umno had not kept their promise to uplift the status of the community.

However, he reminded the candidates that the strength of the Malays lies not in greed but in their culture, morals and integrity.

He said it was wrong for any community to defend cruelty, whether the act was done against its own race or to others.

“We should not be apologetic or be in a passive position, we should confront head-on, fight and demand that those who proclaim to champion the special position of Malays and Malay supremacists must first be rejected by the Malays,” he said.

“We do not have to show that we are more Malay than Umno; we are Malays because of our history and culture; we are great because of justice, our intelligence and our open attitude towards others,” he added.

PAS candidate for Tenang

Anwar then spoke at length about the recent Apco controversy that landed him a six-month suspension in Parliament.

He showed the agreement between the Israeli government, Apco and Malaysia, and challenged Prime Minister Najib Razak to answer allegations that 1Malaysia had emulated the 1Israel campaign.

As for the upcoming Tenang by-election, Anwar announced that Pakatan has agreed to send a PAS candidate to contest in the seat.

He also announced that Pakatan Menteri Besar Summit will hold another meeting in February next year, followed by an Economic Congress .

Meanwhile, Hadi said it was not right for anyone to love or defend their just their own community.

“It is not wrong for the Malays to love the Malays, the Chinese to love the Chnese and Indians to love the Indians...Islam after all ensures that communities maintain a good relationship with one another,” he said.

“It is wrong to be cruel even though if it is done due to a racial reason, and it is wrong to use your own race to act cruelly against another,” he added.

Jom ramai-ramai kita bunuh Dr Mujahid & bakar buku Menuju PAS Baru!

Setuju?
