Najib: Don't let racial issues destroy country

KUALA LUMPUR: Prime Minister Najib Tun Razak said the society should not allow the Malaysian way of life, which is based upon diversity and moderation, to be undermined by extreme attitudes which manifest themselves through racial and religious issues."Everything which we have achieved, everything which we have built, and things which are dear to us, will be destroyed.

"We should, therefore, value the prevailing peace, harmony and stability in the country," he said in his message in conjunction with the 53rd National Day tomorrow.

He also said that the time had come for the current generation to take the lead to propel the country to greater heights.

Saying that the real challenge for Malaysians today was to transform the country to become a developed and high-income nation by 2020, Najib added the government had put in place strong foundations in the form of the Government Transformation Plan and Economic Transformation Plan to achieve the objective.

Najib said the success achieved in transforming Malaysia from that of a low-income and agriculture-based country into a medium-income industrialised country was due to the commitment, planning and diligence of the government, along with the people, in holding fast to the philosophy of being constantly ahead of the curve of transformation and changes.

"Refusing to be contented with the status quo, and out of sheer determination, our forefathers took Malaysia from one success to another.

"Today, it is our turn to lead Malaysia to greater heights of progress and prosperity. The question is, are we courageous enough to break away from tradition and achieve the extraordinary?" said the prime minister.

Pillar of peace and stability

Looking back into the struggle of the country's past leaders, Najib said the nation's forefathers had never felt satisfied with what ! the coun try had at that time and had striven hard to overcome no matter how big the challenges were.

"They constantly seek and work to create a better future for the country and its people," he said.

The prime minister also said that each Malaysian citizen was crucial to the country's development and that he or she had the capability to contribute towards the nation's prosperity and well-being.

The time had also come for the country to fully utilise local talents, he added.

"It will be a huge loss to the country if the talents, whom we have painstakingly nurtured, migrate in search of a greener pasture just because of our failure to provide the conducive environment for them to contribute," he said.

He added that globalisation not only allowed for easy flow of capital and technology across the borders but also the flow of human capital.

Najib said that to create a better future, Malaysia should safeguard national unity, saying it had been the country's pillar of peace and stability.

It was for this reason, he said, that the basis of integration among the Malaysian people should be built upon shared values as spelled out in the national ideology or Rukun Negara and enshrined in the constitution.

Najib also said that the government was truly committed to defending the country's independence and sovereignty within the framework of legal instruments and based on its own strength to face threats either from within or outside the country.

"Please remember that Malaysia is our homeland; this is the place where we were born, the place where we grow up, where we find our livelihood, a place where we find happiness and where we shall be laid to rest," he said.

In conjunction with the National Day, he called on Malaysians to renew their commitment and strengthen their resolve to make Malaysia the best country.

"For the sake of our children's future, we must defend the survival of our country. Let us not break what is intact," he said.

The Mahathir prediction

The May 13 riot was not racial per se. It was sparked off by the poor Malays being told by Malay politicians that the rich Chinese caused them the economic suffering, and the poor Chinese being told by Chinese politicians that the powerful Malays in the government caused them their hardship.

Thomas Lee, Sin Chew

Tun Dr Mahathir Mohamad has predicted that racial tension would escalate if the New Economic Policy (NEP) type of policies is removed in favour of open policies which disregard the disparities between races in the interest of equity and merit.

The former prime minister has also warned that the time is not right for changes to be made to the existing pro-Bumiputera affirmative policies.

He said that the violent Communist revolution in Europe was caused by the disparity between rich and poor, and hinted that such a scenario could happen in Malaysia if the so-called economic gap between the Bumiputeras and the other races is not narrowed.

Hence, he suggested that the affirmative policies and programmes be continued infinitum, arguing that such a protection for the Bumiputera is still necessary and that a 20-year timeline is not enough for them to become economically on par with other races.

The NEP was launched in 1971 and technically ended in 1990, but most of its programmes are being continued.

Prime Minister Datuk Seri Najib Razak has announced that he would remove subsidies and many of the pro-Bumiputera quotas under his meritocracy-based economic reforms, but many Malay leaders, including Mahathir, want to retain the status quo.

Mahathir has become the leading voice of dissidence against the New Economic Model (NEM) initiated by Najib, insisting that the affirmative scheme must continue, or else the Bumiputeras would lose out.

Mahathirs doomsday prediction that the co! untry wo uld plunge into a violent revolutionary situation like that of the 18th and 19th Century Europe if the affirmative economic policies and programmes are scaled is certainly alarmist and scaremongering, to say the least, and a witticism of the highest illusionary degree.

Mahathir talks as if all non-Bumiputras are rich and only Bumiputeras are in dire economic suffering. Granted that there are many Bumiputras in the rural who are really poor and deserving of government financial aid, but there are also many non-Bumiputras who are in similar appalling economic condition.

I am not saying that there should not be any affirmative policies and programmes to help those who are poor and underprivileged, but they should be based on needs, not on race. There are more poor Bumiputras simply because they constitute a larger portion of the population, and they deserve all the assistance to live a better life and lifestyle. So, do the poor of other races. The government affirmative policies and programmes should focus on the need of the poor of all races, not on any particular race irrespective of their economic status. MP Tony Puas suggestion that those who can afford luxury houses costing more than half a million ringgit should not be given discount under the affirmative programme is not without merit. The discount money should rightly be channelled to help those who cannot afford a simple decent home.

If we are to take an honest look at the May 13 incident in 1969, which, incidentally, was the raison d'etat for the formulation and implementation of the NEP, we should realize that basically race was just the whipping boy for what I believe to be the explosion of intensive frustration of the economic hardship suffered by the poor of all races Malay, Chinese and Indians.

The May 13 riot was not racial per se. It was sparked off by the poor Malays being told by Malay politicians that the rich Chinese caused them the economic suffering, and the poor Chinese being to! ld by Ch inese politicians that the powerful Malays in the government caused them their hardship.

The riot was triggered off by the then massive suffering of many poor Malays and poor Chinese, both having reached the extreme intolerable level of economic and financial hardship. The intense manipulative racial stroking by irresponsible politicians of the already tense environment during the campaign for the May 10 general election detonated the already ticking economic time bomb, masquerading as packs of racial grenades all over the country..

The economic hardship was not confined to any particular race, and was fundamentally caused by an irresponsible corrupt government of the day. It was the demonic racist politicians who exploited the suffering poor and turn what was basically an economic deprivation problem into a racial bloodbath.

When I was doing a research paper on revolution for a course on history at the Flinders University in South Australia, I did a comparative study on the causes of revolutions in France (17891799), Russia (1917) and China (1911 and 1949). I found that there were five common factors that gave rise to the revolutions in these countries.

The first factor is that there was massive economic hardship among the general populace of the country. Many people were facing difficulties in even putting food on the table. Jobs were scarce. Children go to bed hungry. In such a situation, many became desperate, and couldn't care less about any consequence, even if they were to resort to violent means to survive. These people become fertile ground for the seed of revolution to take root and grow.

Secondly, while the majority of the population was suffering hardship, an elite class of economically powerful and corrupt officials and business people nonchalantly exploited the people. The people were heavily taxed, pieces of essentials keep rising, bribes were demanded for getting things done at government offices, the cops were trigger-happy, a! nd many innocent people were persecuted and prosecuted on the most unsubstantial and flimsiest charges.

Such a scenario gave rise to a massive resentment and revulsion among the people. The circumstance was certainly appropriate for mass action to get rid of the immoral and corrupt political parasites.

Thirdly, the major influence and impact of the increasingly powerful mass media, particularly the newspapers, contributed to educate the general populace of their fundamental human and civil rights.

The people began to realize that they have absolute rights to a decent life and lifestyle, and that they are the actual bosses of those in the government and its administration. They began to demand for justice, fairness, economic equality, political freedom, liberty in organizing and operating their own well-being, and the rights to freedom of expression, worship, jobs and education.

In other words, the people have got up from their innocent slumber and became enlightened to the fact they have fundamental birth rights which they should protect, preserve and prevent from exploitation by the abusive and dictatorial authorities.

Fourthly, the rise of some well-educated idealistic charismatic leaders led to the mobilization and organization of the people into collective powerful pressure groups which took the lead to fight against the establishment. A massive people movement began to make the clarion call to the masses to stand up and be court for the nation. The charismatic people rousers became the powerful attractive socio-political magnets attracting the masses to march for change.

Finally, like Mao Zedong said, a mere spark will cause fire to a whole plain. In the case of 18th century France, Emperor Louis XIV and his successor Emperor Louis XVI mismanaged the nation's finances that by 1789, the government was bankrupt. Louis XVI resorted to impose heavy taxes on the people. The people, who suffered from bad harvest, exploded in anger and attacked t! he Basti lle (prison for political prisoners). The Fall of Bastille started the French Revolution. It spread out to other parts of France.

The explosive pressure cooker blew its cover and all hell broke lose as the people took to the street to demand for accountability and change.

Nearer our time, we have seen how the dictator Ferdinand Marcos of the Philippines was ousted by the People Power Revolution in 1986. The massive protest was brewing since 1983, after the assassination of opposition politician Ninoy Aquino, followed by the deteriorating economy, with the government plunging deeper into debt. By the end of 1983, the country was bankrupt, and the economy had contracted by 6.8%. The pressure started to build up until 1986 when the time bomb exploded.

From my studies on revolutions, we can observe that what gave rise to the massive visible, vocal and even violent demonstration demanding for reformation and transformation is basically the mass dissatisfaction, disenchantment and disillusion with the governing establishment, sparked off by just an unjust act.

There will not be any violent revolution in Malaysia, if there is a competent, accountable, and transparent government in Malaysia, which promotes and practices truth, righteousness, justice, equality, fairness, and caring concern.

Happy Medeka. May God bless our nation real good!

Raja Petra LIED yet again and amazingly some people believe it!

Guys/gals, please listen. Raja Petra was NEVER invited nor was he ever scheduled to be interviewed by the BBC. It was all a LIE. None of the 5 current producers of BBC Hardtalk ever invited Petra before to be on the programme. Yes, Anwar's Pakistani boys did managed to persuade The Guardian to do a piece on Petra about a couple of weeks back but there has not been very much success with the other media (printed or electronic) in UK.

By Fatimah Zuhri

1. It always amazes me the amount of people that are so willingly allowed themselve be taken for a ride just because of their blind hatred towards the ruling Government.

2. I was about to upload a cool video about overcoming different types of negative addiction in Facebook when I received a call from a friend. Apparently the BBC News International has been flooded by hate mails accusing the BBC of all sort of things in regards to Raja Petra.

3. At first I was puzzled but when she mentioned the name Petra and Hardtalk I realized that I read somewhere (in twitter i think) that was someone saying about Petra being on Hardtalk. I have stop going to Petra's website for sometime now so I was unaware of his latest bullshit. Besides, I sincerely thought that after numerous expose on Petra's previous lies and innuendos, you would think Malaysian would "get it". Sadly that is not the case.

4. Guys/gals, please listen. Raja Petra was NEVER invited nor was he ever scheduled to be interviewed by the BBC. It was all a LIE. None of the 5 current producers of BBC Hardtalk ever invited Petra before to be on the programme. Yes, Anwar's Pakistani boys did managed to persuade The Guardian to do a piece on Petra about a couple of weeks back but there has not been very much success with the other media (printed or electronic) in UK.

http://www.bbc.co.uk/programmes/b006mg2m/episodes/upcoming?page=1

5. When I heard what my friend was saying, I reluctantly browse Raja P! etra's w ebsite and there was this notice stating that the "scheduled BBC Hardtalk with Raja Petra" was canceled basically because :

a) BBC received complaint from Malaysian Govt.

b) BBC lawyer's advise the production team to cancel it to avoid legal repercussion

7. Wow! This seems like a plot in Mario Puzo's mafia novel. Malaysian Government has managed to outmuscle the largest broadcasting organization in the world. Even China, a country which is much more important economically and militarily could not do what Malaysia is doing when BBC had the exiled Tibetan leaders or Chinese dissidents.

8. When I read the explanation given to the reason why it was cancelled, I told my hubby about it and we laughed but when we scrolled down we almost choked when we saw over 40 angry comments directing at BBC. Now, even TheMalaysianInsider is putting this on their website as "news".

9. Seriously, I am sitting and wondering, how many people out there really believed every words that is written by this proven liar ? It really baffles me. What further proof does a person need ?

10. Why would anyone sent hate email to BBC over this issue? Do you guys/gals know how dumb you all look at the moment? Was there any effort to at least do a bit of research first before sending those hate mails? If you have done your research, you would know :

a) Every Hardtalk programme have different producers. If it involves sports personality, it is Tama Muru (i.e. Sampras, Schumacher). If it involves leader of a nation, it is either Jamieson or Hancock (i.e. Mahathir, Prince Al-Waleed). If it involves controversial personalities/political dissidents (i.e. Geert Wilders, Hirsi Ali) it is Jessica Williams. If it involves social/religious personalities (i.e. 2005 Anwar was invited as a reformer of East-West rel lol) then the it would be Ms Osborne. If we look at the category, Raja Petra would suit the controversial/dissident list! The only reason why Ms Osborne name came up is because she was the ! producer who invited Anwar to Hardtalk in May 10th 2005.

Is this suprising? For me it is a big NO. Afterall these were the same group of people who used the Agong's name in their failed 16 Sept attempt. They would use ANYONE to get what they want.

c) The only information that stated Raja Petra is going to be interviewed by BBC on 1st September comes from RPK's own website. You would think that TheMalaysiaInsider, Sin Jew as well as The Star being a "news organization" would at least do their journalistic investigation first before publishing it on their website. I am not a journalist but shouldn't these journalist enquire regarding this matter with BBC first before publishing it? The title on TMI is just disgusting and another pathetic attempt to discredit the Government.

d) BBC HardTalk had conducted interviewes with :

i - Chinese dissidents - The Chinese Govt was extremely angry but BBC did not care

ii - Hamas leaders - The Israelis Govt was angry multiple times but even the influential pro-zionist NGOs fail to scare BBC

iii - Salamn Rushdie - Bomb threats were issued countless times but BBC did not care

iv - Anwar Ibrahim - The Malaysian Govt was displeased but BBC did not care

v - Russian critics - The Russian Govt was pissed but BBC was not scare

vi - Holocaust denier - Many people were angry but BBC still continue with the show

vii - Racist (i.e. Geert Wilder) - I was extremely pissed as did many others but BBC did not care, they even interviewed him twice in 1 month!

So why would BBC be scared of Malaysia? LOL It just does not make sense!

11. The bloke is a liar! Period. How long will people realise this? Seriously I do not know whether to cry or to laugh at this. I am going to be frank here. I am sure most of the people who sent hate emails to BBC are Malaysian Chinese students who are studying here. Listen here, Raja Petra is using your emotion to achieve what his paymaster is asking from him. He is a lonely ! bankrupt ed bloke (have you ever asked how he can live in UK ?). We all know why he created this lie. He wants to be seen as the figure whom the Govt cannot prosecute no matter whatever he does. He hopes to impress the rebellious young mind. This has been done before of course by Hishamudin Rais in the 70s and 80s. The difference is Petra is a wee bit smarter than Rais.

13. Yes, the things he wrote - fairness, equality, etc - all sounds like music to one's ear. But he does not mean a single word of it. Cant you see he is playing with your emotion? Look at the things he has written over the past 2 years. It is all aim to instill hatred to all the major institutions in this country. How long are you going to be manipulated by this liar and his lies?

14. MCA and GERAKAN need to really step up their effort in this. If I may, the first thing they need to do is to see Petra as their enemy. Too many times in UK and in Malaysia, I have seen many of their members go weak at the mention of Petra's name especially amongst their youth. It is sad because they really think Petra is fighting for them when in reality that is not the case.

No malpractice in buying house, says DAP rep

By Athi Shankar

GEORGE TOWN: Penang DAP chairman Chow Kon Yeow has brushed aside suggestion of malpractice in his purchase of a luxury home last year in Balik Pulau.

He dismissed suspicion raised by the press last week that he had bought the three-storey terrace house at RM590,000 from Kean Guan Development Sdn Bhd through corrupt means.

Neither did I receive any discounts nor favours from the seller, he said in a statement today.

Chow, a state executive councillor, had purchased the house on July 15, 2009

He explained that he had paid RM140,000 deposit out of his savings and gratuity received for his service as the Tanjung parliamentarian.

He said he had secured a loan from Public Bank Berhad for the remaining RM450,000, which he was obliged to repay RM2,759 monthly for next 19 years or until he reached 70.

I wish to say that I am adequately able to pay for the downpayment from my savings and gratuity.

I am also thankful to the bank for having the trust in my ability to service the loan for the next 19 years, Chow said.

He said he was aware that as a politician and government executive, he would be under heavy scrutiny.

Indeed I told my family that one day someone would want to question me on the purchase of the house.

All I have to add is that after staying in a 700sq ft apartment for 13 years, I was able to provide a better home for my family from honest means, said Chow, the Padang Kota assemblyman.

Chow, who is charge of the state housing, traffic management and local government, has just returned home from a official trip to Vladivostok, Russia.

Internal battle

Mobile text messages were circulated by unknown source, believed to be members of rival party camp, last week accusing three DAP elected representatives to purchase homes worth about RM600,000 each.

The SMSes raised suspicision that the three leaders, including Air Itam state assemblyman and exco for ! town and country planning Wong Hon Wai and Sungai Pinang state representative Koid Teng Guan have bought the houses by illegitimate means.

Wong has denied the allegations saying that he had purchased the house in a legitimate manner and has complied with all the necessary legal procedures when making payment for the house in July last year.

Koid on the other hand, denied he had ever bought the said house.

Indeed he said he was still searching for a home, and has not purchased nor completed the procedure of buying one yet.

It is believed that SMSes could have been disseminated from a rival camp challenging to capture the state leadership from Chow and company in the coming state party elections at yearend.

Its learnt several elected representatives, who were parachutists in the last general election, are planning carry out a coup via the party elections to take control the state machinery from long serving Penangites.

The bitter battle till the end has clearly been drawn now.

Mustapa: Anti-Malaysia protests not affecting trade

KOTA BARU: The anti-Malaysian protests in Jakarta have not affected trade between Malaysia and Indonesia, International Trade and Industry Minister Mustapa Mohamed said.He said only a handful of people were involved in the demonstrations and their actions did not reflect the aspiration of the majority of Indonesians and the republic's policy.

"We have cordial relations with Indonesia and I have discussions with my Indonesian counterpart every three months in the spirit of Asean.

"A number of Malaysian companies are investing in Malaysia and vice-versa and we hope this issue will not affect our relations," he told reporters after having sahur (meals before dawn) with about 60 orphans at Pusat Jagaan Rohaniah in Taman Uda Murni here today.

Mustapa said the perpetrators were taking advantage of a recent issue to sow seeds of discord between both countries and they would not succeed.

Brig-Gen Yasin acquitted, so MACC caught lying again!

Din Merican

This morning, the Kota Kinabalu Sesssions Judge Caroline Majanil acquitted Dato Mohamad Yasin Yahya (Rtd Brig-Gen), of all charges of perjury in the trial of Dato Ramli Yusuff, former Director Of Commercial Crimes PDRM. Dato Yasin was acquitted without his defence being called. DPP Ahmad Bache prosecuted while defence counsel acting for Dato Yasin was a prominent Sabah lawyer, Sugumar.

In 2007, Dato Ramli Yusuff was charged in Sabah for using a police cessna for his own personal use. That trumped up charge was brought about in order to discredit Dato Ramli as a corrupt senior police officer who had used police transport facilities for conducting an aerial survey of his private land and for bringing 2 civilians on board the aircraft.

The manner in which the case was brought against Dato Ramli showed unmistakably of a conspiracy between IGP Musa Hassan, AG Gani Patail and the MACC. The Sabah case was based on fabrications by MACC Supt Sok One a/l Esen who said that a Sabah Penghulu had named Dato Ramli in a confidential MACC report. When the Penghulu was called to court, he denied ever mentioning Dato Ramlis names. Instead, the Penghulu said that he was visited by Musa Hassans aide named ASP Chew Kam Soon to make various allegations against Dato Ramli, all of which were untrue.

The charge in the Sabah case was amended several times throughout the trial including dropping any mention of the two civilians on board the aircraft, as Brig-Gen Yasin was an authorised military personnel. Also, it was revealed in Dato Ramlis trial that he was in full uniform escorted by several policemen for an official crime prevention aerial survey of the coastal line of Sabah covering a police post known as Dent Haven. As such, Dato Ramli was acquitted by Judge Supang Lian in a very lengthy trial over 57 days which involved! 75 witn esses (longer than a murder trial).

Smugglers with friends in high places

From Sean Whyte, via e-mail

The pleasure of knowing a notorious wildlife smuggler has been caught red-handed is tinged only with the worry that his contacts within Perhilitan will see to it he will either escape without charges being brought or, charged and treated very leniently.

This same smuggler and his senior official friend in Perhilitan were both the subject of a National Geographic magazine investigative article last January.

If justice is to be done and seen to be done, we will all need to remain vigilant in monitoring this case.

Perhilitans track record to date for failing to prosecute those who trade in illegal wildlife is nothing less than shocking.

Suhakam chief: “We’re an independent entity”

By Gan Pei Ling | The Nut Graph,

TAN Sri Hasmy Agam was appointed the new Suhakam chief in June 2010. Previously, he was executive chairperson of the Institute of Diplomacy and Foreign Relations (IDFR), and secretary-general of the United Nations Association of Malaysia.

“I’m conscious of the fact that I’m no longer a civil servant. Now that I’m the chair[person] of Suhakam, I’ve to be neutral and independent,” says Hasmy during an interview on 11 Aug 2010 at his office in Kuala Lumpur.
The former diplomat acknowledges that he may have to make statements unfriendly to the government from time to time, as his job now is to highlight human rights violations. He also notes that the other six appointed commissioners all come from non-governmental organisation (NGO) backgrounds.
In this interview with The Nut Graph, Hasmy Agam talks about his plans for Suhakam in the next three years, what steps he will take to overcome its limitations, and on human rights issues in Malaysia.
TNG: As the new Suhakam chief, what do you hope to achieve with Suhakam during your term?
Hasmy Agam: We’ll continue to work on creating awareness about human rights among the public. Suhakam has generated greater awareness about human rights over the years. However, many Malaysians still don’t assert these rights.
We also plan to intensify our efforts in sensitising government agencies on human rights issues. They are [supposed to] protect human rights. But sometimes they may become overzealous, especially enforcement agencies like the police and immigration department.
They need to understand that they have to do their job with a sense of proportion, at both the subordinate and management level. Unless the people on top understand [that they need to ensure that human rights are not violated when carrying out their job], they will not be able to guide their subordinates. They say “tangkap”, their subordinates would just follow the order, like in the recent anti-ISA (Internal Security Act) candlelight vigil. Even [people they consider as] lawbreakers have rights, like the right to legal representation, and the enforcers need to respect that.
Another challenge is to follow up with the recommendations that Suhakam has made to the government in the past. We’ve had so many public inquiries and made several recommendations including to repeal the ISA, but many have yet to be implemented.
Nazri Aziz
Nazri Aziz
It’s also quite awkward that for 10 years [since Suhakam was established], none of its reports have been discussed in Parliament. I’ve started talking to Datuk Seri Nazri (Aziz), the minister in charge of parliamentary affairs. He has accepted in principle that there should be a session, one day or half a day, allocated to discuss Suhakam’s [annual] report.
There’s also a need to restructure Suhakam. There is currently quick turnover of staff because of the lack of upward mobility. Most of our staff are hired on contract. They’re quite passionate about human rights issues, but if there’s no upward mobility, there’s a limit to how long they would stay.
As you know, our term only [lasts for] three years. There are a lot of expectations [from different parties]. We will try to engage with [our stakeholders, including] parliamentarians, enforcement agencies, media, civil societies [etc].
But the challenges are great. Human rights cover a wide range of issues, starting from birth to death, [so] it’s difficult to cover all, especially since there are only the seven of us. We’re appointed on a part-time basis, but I’ve given up my other job [to focus on this]. I was previously the IDFR executive chair[person]. Other commissioners, except for those from Sabah and Sarawak, try to come here as often as possible, too.
What are some of the steps Suhakam is taking, or plans to take, to overcome its limitations?
We’re an advisory body; we don’t have enforcement powers. Past commissioners have expressed the need for Suhakam to be given more teeth. Unfortunately, that was not addressed [by the government].
But even within the limitations we’re facing, we can choose to be reactive or proactive. Reactive means we only look into an issue when someone lodges a complaint. In fact, we receive many complaints in a year.
However, we feel that we can also be proactive in some cases. Like in the recent candlelight vigil, we decided to monitor it. We received the organisers’ notification that they were holding the vigil about a week before it was held. As human rights defenders, we believe peaceful assembly is a human right we need to protect, so we felt in was incumbent upon Suhakam to monitor [the vigil].
When we told the police we wanted to monitor, though, the first reaction wasn’t good. They thought we wanted to join the protesters.
Why did the police think so?
I think many [among the police] don’t understand Suhakam’s basic function. They probably thought that since it was an illegal assembly, we had no right to observe it.
Police at the scene of the anti-ISA rally on 1 Aug 2010 in Petaling Jaya
There’s also this perception by some [government agencies] that Suhakam is an NGO. We’re not. [Ironically], civil societies consider us part of the government. We’re not. We’re an independent entity.
In the end, we managed to convince the police that it’s their job to [take care of] security, but it’s also our job to monitor [the vigil], and the protesters will do their job to make a point. Each of us has our own role to play.
Since [the police considered it] an illegal protest, they’re duty-bound to arrest the protesters under the Police Act, but they didn’t have to use force. When the lawyers wanted to represent the protesters, the police also wanted to record the lawyers’ statement as if they, too, were protesters. That was uncalled for. The lawyers were merely there to represent their clients. We’ve recorded what happened, and I think things [definitely] need to be improved.
What about the case with the migrant workers at the new Istana Negara who claimed that they were not paid their wages? Suhakam also had difficulties getting access to the site?
Unfortunately, we were only allowed to visit the site after two weeks. By the time we got there, we weren’t able to observe much. The employers denied the non-payment and alleged that it was fabricated by others.
Still, I think this case is just the tip of the iceberg. There is a lot of construction going on all over the country. The exploitation of migrant labour is a big issue. Our commissioners are now trying to look at the issue.
What about the Penan rape cases in Sarawak? Why did Sarawak Suhakam commissioner Detta Samen refuse to be the adviser for a proposed task force to investigate the sexual exploitation of Penan girls and women?
We’re concerned about this issue. I think because the commissioners are new, some of them may be more careful with what they say [and agree to do]. But we’re definitely concerned about issues concerning indigenous people. In fact, we’re thinking of setting up a national inquiry on indigenous people. We’re weighing between looking into indigenous people, women’s issues, and issues concerning our aging population.
What about the Islamisation of indigenous people? Has Suhakam looked into that?
Jannie Lasimbang (Source: iisd.ca)
Jannie Lasimbang (Source: iisd.ca)
I was told by Sabah commissioner Jannie Lasimbang that the problem arises during the reporting of the child’s birth. Sometimes the authorities add a “bin” or “binti” to the child’s name, not realising the religious connotation, so these children are later assumed to be Muslims.
What about the Islamisation of Orang Asli in Peninsular Malaysia? Both The Nut Graph and Al-Jazeera have reported on the issue this year. Did anyone lodge a report with Suhakam about these cases?
No. Otherwise we would have investigated.
Is Suhakam going to look into sexuality rights issues, especially concerning LGBT (lesbian, gay, bisexual, and transgender)s? These communities are often marginalised. They are denied employment opportunities, and are harassed by authorities and the media because of their sexual or gender identity.
This is a sensitive issue. We need to look at it with understanding. In fact, at the Asia Pacific Forum in Bali, I was the first to take the floor to discuss this issue. I [told the delegates] I had a personal dilemma dealing with these issues. We need to protect human rights, but at the same time, we live in a society that is not ready to embrace these communities.
Suhakam is not dismissing it, but we will need to look into the issues within our cultural and religious context. During our first press conference, some people also submitted a memorandum [highlighting the media's problematic representation of these communities].
We definitely need to treat these communities with respect and dignity. As a nation, we have to demonstrate more empathy. But [I've to admit] this issue is big and not something that is likely to be resolved within our term.
Does Suhakam plan to engage the government to convince it to ratify major international conventions, for example, the International Covenant on Civil and Political Rights and the CAT (Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment)?
When I was in the Foreign Ministry, I pushed for the government to come on board these international conventions. We’ve been talking about it for so many years but we’ve yet to ratify them.
The standard government position was that we could not ratify these conventions unless we could fully comply and implement its provisions [on the ground]. But Malaysia has ratified Cedaw (Convention on the Elimination of All Forms of Discrimination against Women) and the CRC (Convention on the Rights of the Child).
Personally, I’ve always felt it’s embarrassing that Malaysia has yet to ratify these conventions, especially the convention against torture. We cannot condone torture. It’s a long-haul fight. We will continue to engage with the government. I’ll be happy if the government is willing to come on board.

Merdekakan Namewee

Merdekakan Namewee

Bakat Namewee adalah ‘1 in 26 million’.

Salam Kemerdekaan

Why the fuck are they angry with Teo Nie Ching when Umno treats the surau even worse?

Long-term toll-free solution needed for Puchong

By Gobind Singh Deo - Free Malaysia Today

COMMENT I refer to the announcement by the Works Minister that Aug 31 will see a toll-free day for motorists using the LDP expressway between Puchong and Damansara.

This is a reflection that the authorities recognise that the people need to be “liberated” from the burden of having to pay toll, especially in Puchong where motorists pay RM1.60 per entry into and exit out of Puchong.

For a family with two cars which need to travel at least twice into and out of Puchong, one needs to fork out RM12.80 per day just on toll. This averages out to RM384 per month. Many make an average of 10 trips into and out of Puchong daily.

The report today also said that an average of 450,000 vehicles travel the route daily. That makes the daily collection some RM720,000 per day. This brings the collection to about RM22.32 million per month and about RM267.84 million a year.

These figures are merely a rough estimate of what is being made a year. The figure will increase dramatically over the months and years to come because Puchong is developing fast and naturally the flow of traffic into Puchong will likewise increase.

This doesn’t yet include the fact that the toll rate is set to increase over the years. The agreement has it increasing to RM2.10 and RM3.20 in the years to come.

The federal government is not doing enough to solve the problem.

The agreements which cover these routes were drafted many years ago. One may ask if these agreements projected the increased volumes in traffic and toll rates accurately. Is there not a cut-off point for profit margins after which the concessions would be returned to the government and the people?

Are the people completely helpless and without recourse because “agreements have been signed and are binding” as is always said in Parliament by the powers that be?

But we, the rakyat, did not sign these agreements. Why must we now be made to suffer these consequences?

And the fact of the matter is that the traffic problem in Puchong, especially on the LDP during peak hours, is simply terrible. What are motorists actually paying for when travel time is severely delayed because of the jam?

Ask anyone in Puchong and the toll and traffic issue finds itself at the top of the list of complaints. So why do we have to wait for years and suffer in silence when huge amounts of money pass collected from the people of Puchong?

The buying option

As MP for Puchong, I would like to ask the federal government whether it is true that profits on this route are expected to fall in the range of some RM13.8 billion between 2016 and 2029.

And what are the profits already made to date and which will be made from now to 2016 based on increased traffic volumes and toll prices?

Given these facts and figures, the Works Minister should state whether the option of buying the concession back would be better in terms of savings for the rakyat?

Does the agreement not provide for this and does it not also state the pricing mechanism for such an option?

It is my view that any agreement which can be shown to be unfair over a period of time, and one which is found to be oppressive to the rakyat, must surely be subject to review, especially in cases where the financial targets sought to be achieved have been achieved.

We cannot and must not just sit back and allow for the extras to be reaped in at the expense of the rakyat.

I think the federal government, under whose guidance the agreements were drafted and signed, must now take full responsibility. It should re-evaluate these contracts and act urgently.

Something is just not right here. The increase in traffic volume should work out to reduce toll rates and relieve the rakyat of the burden, not the other way around.

With the greatest of respect to the minister, a one-day discount or amnesty may be nice but it is certainly not enough to solve the problem.

What we need is a long-term solution for the people of Puchong. The federal government must act and act fast if it is truly committed to its “people first, performance now” slogan.

Oil royalty: Kelantan files suit against Petronas

By Rahmah Ghazali

FMT ALERT KUALA LUMPUR: PAS-led Kelantan government has filed a suit against the giant national oil and gas company Petronas over its refusal to pay oil royalty despite operating an oil platform off the state's shores.
The suit, which was filed by Kelantan Menteri Besar Nik Aziz Nik Mat through his lawyer Tommy Thomas at the Kuala Lumpur High Court this morning, however, did not state any amount the state government was claiming.

About 100 supporters have been waiting outside the court since 8am. The suit was filed at 9.25am.

Nik Aziz and other PAS leaders, including its deputy menteri besar Ahmad Yaakob, state exco Husam Musa, and PAS vice-president were present.

The leaders are currently at Masjid Wilayah for solat hajat.

The state government does not recognise the federal government's RM25 million "compassionate fund" in lieu of the oil royalty.

Nik Aziz: Prophet welcomed non-Muslims into mosques

By FMT Staff

KOTA BAHRU: Censuring Umno for stoking intolerance, PAS spiritual leader Nik Aziz Nik Mat declared that there is nothing wrong in non-Muslims entering a mosque and that it was definitely not against Islam. He said inviting non-believers into mosques was one of the ways Nabi Muhamad had used to spread Islamic teachings.

“If we return to history and Islamic civilisation, you will find that many of the Arab Quarasy citizens who were non-believers visited Nabi (Muhamad).

“Nabi (Muhamad) kept them in the mosque. They slept in the mosque, ate in the mosque and even urinated in the mosque!” he told newsmen.

Nik Aziz said this in response to the recent controversy involving Serdang MP Teo Nie Ching who had made an unofficial visit to the Al Huda surau in Kajang last Sunday.

He attributed such intolerance to poor understanding of Islam and the Islamic civilisation.

"This issue is polemic in society because it is tainted by political sentiments which have desecrated the purity of Islam,” he said.

He attributed such intolerance to poor understanding of Islam and the Islamic civilisation.

“Our relationship with Islam is getting further and further, there is no learning anymore, as such these issue continue to arise.

“Such polemics will only push non-Muslims further away from Islam. This is directly against Nabi Muhamad’s teachings.

“Non-Muslims can enter the mosque... They can ceramah or do whatever… there is no problem. Barring non-Muslims from entering the mosque is our culture certainly not taught by Nabi (Muhamad),” Nik Aziz said.

Three groups of people

According to Nik Aziz, people were classified into three groups – the new believers, the non believers but who are likely to embrace Islam and the those who do not believe in Islam but respect the religion.

“However knowing that there are three groups of people, we are only interested in one group.

"The other two we have chosen to abandon because our society is drifting further and further away from the non-Muslims,” he said.

On Saturday, Shah Alam MP Khalid Samad urged Muslims to be more discerning and to separate customs from religious laws, particularly involving punishment.

He also advised Muslims not to be tied down to traditional elements and practices and urged them instead to adhere to the Islamic civilisation which dated back to the time of Rasullullah.

IS ROSMAH AND THE AFFECTED PUTERI UMNO MEMBERS GOING TO BE ISSUED A 'WARNING'?

Is the Religious authorities going to issue a stern WARNING to Rosmah Mansor, wife of Prime Minister Datuk Seri Mohd Najib Tun Razak, and certain Puteri UMNO members, who are MUSLIM and who should knows its rules, for not covering themselves as required by Islam.

The pictures above clearly warrants a WARNING.

Why Najib talks like a PM, but walks and acts like Umno

Richard Loh

I did not want to blog these few days because I wanted to enjoy the Merdeka celebrations but it is not to be. The past weeks clearly show that the PM is no longer in control of running the country. He is simply wearing too many hats. In fact, the PM is wearing so many hats he has turned out to be the most ugly looking person.

One hat he wears represents him as the Prime Minister that can talk - but only all kinds of slogan and rhetoric containing little solid substance as it will all be blown away once he changes this hat.

Trying to balance his act, he will then immediately switch to his Umno President's hat to walk and act like Umno, totally forgetting what he had said when he was wearing the PM's hat.

When he wore the PM's hat, he talked about zero tolerance for racism but could not take any action against his own members, civil servants, the Umno-controlled media or Perkasa for openly stoking racial and religious sentiments.

But once he dons his Umno hat, he calls for investigation of Namewee's video that speaks out against racism albeit in a slight vulgar manner. He is followed hot on the heels by his Information Communication and Culture Minister warning of stern action against those who produce videos containing racial slurs.

But both PM and his minister conveniently leave out those Umno's degenerates who puke racial slurs to live audiences.

Then still with his Umno hat on, the PM is happy to see his Umno army attacking furiously all the non-issues of non-Muslims trying to harmonize with Muslims and creating issues out of nothing.

How can we still celebrate Merdeka when we are so troubled by race and religious conflicts that are created solely by Umno?

Can the PM look the public in the eye and tell truthfully that he is indeed a PM who can talk, walk and act impartially - just like any PM should? - Malaysia for All

If Mais charges Teo, it shd also summon Fatwa Council :Mahfuz

Malaysia Chronicle

PAS vice president Mahfuz Omar said if the Selangor religious council or Mais were to charge Serdang MP Teo Nie Ching for entering a surau or Muslim prayer hall, then it should also summon the National Fatwa Council.

“It is in direct contravention to a decision made by Fatwa working committee at the Muzakarah Jawatankuasa Fatwa Majlis Kebangsaan Bagi Hal Ehwal Ugama Islam Malaysia Kali Ke-90 which had convened on March 1, 2010,” Mahfuz told Malaysia Chronicle.

"It was decided then that non-Muslims should be allowed to enter mosques and suraus as this is one way we can propagate Islam. So if Mais thinks Nie Ching is wrong to enter the surau and want to give her a warning letter, then Mais should also send one to the National Fatwa Council.”

The PAS leader also slammed Umno for hatching the plot to roil the Pakatan Rakyat, saying that such a move ultimately hurt Islam the most as it scared off non-Muslims from the religion or even think about visiting Muslim places of worship.

“Now what Mais and Utusan has done has harmed Islam greatly. They have created the fear in non-Muslims of going to mosques and suraus. How do we spread Islam to them, how do we reach out to non-believers? I also dare to say Mais was manipulated by Umno and they deceived the Palace into thinking Nie Ching had given a political speech in the surau, which is totally false,” said Mahfuz.

PAS to sue Mais, Utusan

PAS has also asked its lawyers to look into suing Utusan and Mais for defaming their party over the surau visit.

“In its report Utusan wrote that Nie Ching gave aid to PAS members. This is not true at all. Nie Ching was handing over a cheque for a donation made by the Selangor government to the surau to help them repair a fence,” said Mahfuz.

“Secondly, Utusan said Nie Ching made a political speech which again is a lie. She only spoke after handing over the cheque and it was to explain the Selangor government’s education program. It was not a taksirah or a ceramah as it has been made out to be.”

Mahfuz said PAS would also offer legal assistance to the surau committee as Mais has threatened to take back the management of the prayer hall.

Meanwhile, Nie Ching has applied for an audience with the Selangor Sultan to explain her version of the incident. She is still waiting for a date.

Nik Aziz leads Kelantan in filing oil royalty suit against Petronas

Malaysia Chronicle

UPDATED Kelantan Mentri Besar Nik Aziz Nik Mat has filed a suit on behalf of the state government against national oil firm Petronas for breach of contract and contravention of the federal constitution.

This is a big moment for the Kelantan people, who have been very passionate about their oil rights. Despite petroleum wealth, the Nik Aziz-administration has lacked funds to fully modernize the state although it shines in many other areas such as being able to successfully forge a close-knit community, clean although old facilities, less bureaucracy and significantly less corruption.

Apart from Nik Aziz, his deputy Ahmad Yaakob, excecutive councilors Husam Musa and Takiyuddin Hassan were in Kuala Lumpur where the suit was filed by their lawyer Tommy Thomas.

Nik Aziz and team Kelantan at the KL court complex
The reliefs sought in the 47-page statement of claim include:

1. Specific performance of the Kelantan Petroleum agreement;
2. An account to be taken or an inquiry ordered requiring Petronas to make full and truthful disclosure of all relevant facts relating to cash payments payable to Kelantan include the period;
3. An order that all arrears of cash payments be paid to Kelantan within one month;
4. An order of all future cash payments be paid to Kelantan;
5. Damages; and
6. Interests and costs along with other relief and liberty to apply.

RM800 million a-year, not RM20 million

Husam Musa holds forth
Petronas is under the direct control of the Prime Minister of the day. The BN federal government has tried to convince the Kelantan people that the state is not entitled to oil royalty but it will still grant 'wang ehsan' or compassionate payment of RM20 million per year.

But Kelantan – backed by many oil and legal experts including Petronas founding chairman Tengku Razaleigh Hamzah - has rejected this argument. According to Husam, Kelantan is entitled to at least RM800 million annually.

"The worth of condensate or gas liquid comes to about US$8.5 billion per annum from the joint development offshore area with Thailand,” said Husam.

“Five per cent of that belongs to Malaysia, which is RM1.7 billion. Half of that belongs to Kelantan which is RM800 million. Petronas owes Kelantan RM800 million per annum since 2005,” he added.

The disputed payment is over production from the Cakerawala oil field, said to be located be 130 nautical miles off the Kelantan shore. It is closer than those off Terengganu, Sabah and Sarawak, which are being paid oil royalty by the federal government.

Tengku Razaleigh
A key witness in Tengku Razaleigh

Under agreements signed in the early 1970s with the individual states, Petronas had agreed to pay royalty of five per cent for petroleum produced within the each state’s territorial rights, including Kelantan, Terengganu, Sabah and Sarawak. This has been confirmed by Razaleigh, who was also the finance minister at that time. The Gua Musang MP has offered to testify for the Kelantan and Terengganu governments if necessary.

The clash over oil royalty began in 1999, when PAS took over Terengganu. Mahathir Mohamad, who was the prime minister then, changed tune and maintained that the state was not entitled to royalty as the oil and gas produced were beyond a three-nautical mile limit prescribed as territorial waters under Malaysia’s Emergency Ordinance (Essential Powers) No. 7, 1969.

The Terengganu state administration led by PAS president Hadi Awang took Mahathir and Petronas to court in 2000, but the case has been repeatedly delayed. Terengganu has in the meantime fallen back to the BN and the lawsuit no longer actively pursued.

Mahathir later devised a new scheme whereby the federal government paid a form of compassionate payment or ‘wang ehsan’. But not only did the federal government refuse to give proper accounts on how the payments were formulated, the wang ehsan was also transmitted directly to federal agencies in the state who then decided on which the projects to finance.

Sabah belongs to Sabahans

NEW It will be a fatal mistake if opposition politicians from the peninsula ride roughshod over the sensitivities of the people of Sabah. It is well known that the land below the wind (now the land of illegals) has long been seething with anger at the federal masters. Rich in natural resources, bigger than the peninsula, they should be enjoying the fruits of their natural wealth and holding the future in their hands. Instead, fate was unkind to them and today they live under the yoke of alien rule. For a brief spell, they had power but because of the machination of a devious dominant peninsular party, they lost their high seat. Though their politically emasculated Huguan Siou (paramount leader) now sits at the same table with the hated conquerors, life there does not seem to change for the better.

In PKR the people have found another promising platform to advance their cause. The party is open to all races and in Sabah it has made quite an impact. Its standard-bearer is a fighter for justice and fair play though his future is nebulous. By forging a link with one of the favourite sons of Sabah, the way ahead looks clear and bright. The partnership seems solid and PKR appears to have hit off well with the crowd. But to their dismay, PKR is behaving more like its peninsular foe. It wanted to impose its own brand of leadership on its partners. In short, it wanted peninsular politicians to run the show in Sabah. It met with stiff opposition.

Though the error was rectified with Sabah's favourite son in control of his state, the ceasefire did not last long. It was bound to happen: some disgruntled members got together to form a breakway party and fight their own battle. They nearly got away with it if not for the peace deal reached with PKR. But dirty politics intervened. Imperiously, PKR came down hard on the rebels with the recommendation that they be suspended. It acted tough and rough. The damage was done and another blunder committed. PKR had acted in a manner ! that rem inds its Sabah brothers of the treacherous peninsular politics.

Even if the recommended suspension is not acted upon, the undercurrent of distrust will persist. The dissidents have made their point and Sabahans, inside and outside the political arena, have taken note of the haughty yet fragile opposition party from the peninsula. If the rebels are shown the door in a display of extreme petulance, it would not sound the death knell for Sabahans. It would instead strengthen their resolve. If the PKR supremo in a magnanimous gesture brings them back to the fold, it would do nothing to calm the troubled waters. Whichever way the story is played out, the stark reality is that Sabahans, irrespective of their political leanings, simply do not want peninsular leaders talking down to them.

PKR must know that it cannot dictate terms to its Sabah partners. Dissidents, present and future, will rise up to challenge the party of justice. They are not acting alone. Behind them are the people, now living in misery, who are keen to support any parti that cinta Sabah. They are raring to toss outsiders, current and impending, into the sea. PKR must not misread the political undercurrents in Sabah, or worse still, underestimate the intelligence of the people. Political awareness there is intense. Hit a Sabahan politician and you take on an army behind him.

Sabah does not need to hold PKR hands to walk down the corridors of power when the current puppets are thrown out of office. The destiny of the state lies in its own hand. Peninsular style of politics is not its cup of tea. Sabah is not a wild cowboy country that must be tamed by the western gunslingers. There are sensible, intelligent, upright local-born leaders who can lead the state to fairer climes, calmer seas, clearer future. Let Sabah be Sabah.

With the greatest of respect to the mi! nister, a one-day discount or amnesty may be nice but it is certainly not enough to solve the problem.

What we need is a long-term solution for the people of Puchong. The federal government must act and act fast if it is truly committed to its people first, performance now slogan.

Gobind Singh Deo is DAP MP for Puchong.

UMNO Semakin Takut DAP Makin Rapat Dengan Orang Melayu/Islam

AJK MASJID HANYA MAHU MERAPATKAN!
