MACC backs off from alleged RM8bil Tajuddin Swindle

Mahathirs Response to the Tajuddin Ramli MAS Deal

PAS vice-president Salahuddin Ayub has trained his guns on the Malaysian Anti-Corruption Commission (MACC) in his crusade to uncover a purported RM8 billion scandal in national carrier Malaysian Airlines (MAS).

NONETwo MACC officers met him today to get his explanation on his claim that former MAS head honco Tajuddin Ramlis corrupt ways had caused the company to lose billions during his tenure as chairperson from 1994 to 2001.

However, according to the Salahuddin (right), who is the MP for Kubang Kerian, MACC claimed that it could not investigate further because the case has been taken up by Bukit Aman (the Federal Police Headquarters).

I am disappointed and not convinced by their answer, he said at a press conference in Parliament this afternoon.

Salahuddin had said that the MACC officers had told him that they could not take further action on the case since it has already been investigated by the polices Commercial Crimes Investigation Department.

If there is no further action by MACC or the attorney-general to bring (Tajuddin) to justice, I will then urge for a royal commission of inquiry to be formed to look into the issue, he said.

He had earlier met with the commissions director of investigation Mustafar Ali and the corporate communications chief Ahmad Khusairi Yahaya for 20 minutes in Parliament as well.

Will Najib protect Tajuddin as well?

Calling Tajuddin a criminal, Salahuddin also threw down the gauntlet at Prime Minister Najib Abdul Razak to take action against the fo! rmer MAS boss.

mahathir abdullah ahmad badawi pak lah raising tensionsThe two Tuns cannot even bring him to justice. I now challenge Najib. If he is serious about a government of transformation, it is time to drag (Tajuddin) to justice, he said, referring to the two former prime ministers Dr Mahathir Mohamad and Abdullah Ahmad Badawi.

He also said that former CCID director Ramli Yusoff had also met Abdullah personally with evidence of the alleged wrongdoing. And yet he was turned down. Salahuddin had previously reignited the issue earlier this week when he questioned why no action had been taken against Tajuddin.

He disclosed that two police reports have been lodged in 2002 and 2005 by the national airline over the matter and another report lodged with MACC in May 2009.

Salahuddin also claimed that as a result of investigations triggered by the police reports, a letter was sent by Ramli in 2007 which recommended to then premier Abdullah that Tajuddin and company officers Wan Aishah Wan Ahmad and Ralph Gotz be charged over the allegations.

According to the letter, Ramli had recommended that Tajuddin and Wan Aishah be charged under section 131(1) and 131(2) of the Companies Act for failing to disclose their interests and making false declarations.

It was alleged that Tajuddin acted inappropriately in the cargo handling contract between MAS and Advanced Cargo Logistics GmbH (ACL) in Germany.

According to the police report made available to reporters, Tajuddin actually controlled ACL through nominees and a close relationship with ACL directors, and used his position in MAS to secure the deal for ACL to the detriment of MAS.

Salahuddin, who also sits on the parliamentary select committee on corruption, had previously revealed a letter of complaint sent by MAS themselves to the MACC over the lack of act! ion agai nst Tajuddin.

Kerana guru..

  • Kerana gurulah, tuan menjadi doktor. Those words still buzzed in my ear from time to time. It was told to me by a recalcitrant teacher at a school in KL where I was the PIBG Chairman. Another teacher said cuit paha kanan, paha kiri pun sakit. I was reminded loudly during a PIBG Exco meeting several years ago when the Pengerusi Kelab Guru express his displeasure in a very rude manner in view of my actions of complaining about a headmistress which had abused her power to the highest office in the Education Ministry which led to her removal to pool desk in MOE before being given a transfer to another school in Pulapol area.

  • These are some of the kind of teachers that we have today. They fail to differentiate the profession and the individual in the profession. Some think that the moment they join the profession they will attain the nobleness that comes with the profession. They think it is their god given rights and have the pleasure of doing anything at their free will without any respect for the laws and regulations.

  • The crux of the problem I would say lies with the Ministry of Education officers. They tend to protect their own people. It is like a big clan where the chieftain protects the young against any outside forces. If any of their members do anything wrong against and outsider they will find ways to neutralize the outsider and protect their people. Personally, I have gone through hell when I was the PIBG Chairman.

  • Despite voluminous of documented evidence, over 200 witnesses, the HM was protected by the District, state and Ministry of Education officers. The matter finally with the threat of parents doing a demonstration at Putrajaya and the intervention of Dato Noh Omar who was the Deputy Education Officer which led to an executive decision by the Deputy to Minister to transfer the HM within 24 hours and my resignation. I recontested and won with a bigger majority by over 400 votes. Till! today, no proper justice has been taken again the HM, the KL Education Director and several of their department heads. In fact some when on a lateral transfer while others went on a promotion. Good and decent officers who acted within the law by pointing that I was right, was put in a cold.

  • When the news broke out about the racist HM in a school in Kulai and Alimuddin, the DG of Education said that it was a misunderstanding
and the teacher had apologised, I knew exactly what is happening. This is the typical trademark of the MOE. To them it is better to protect one of their own rather than the profession itself. They would rather retain and breed this kind of people without punishment than protect the quality and sanctity of the profession.

  • I had the first hand experience and the moment it happened, my gut feeling had predicted the course of actions. She would go on leave pending investigation. The department will negotiate with the police to take internal measures and drop any police actions. They will put her in some desk pool at state or the Ministry before reassigning her to another job. In her case, I believe she will be in transferred to a District or a State Education Office. Mind you, that would be the punishment!

  • Im glad that BN youth and DAP Chairman has demanded that action is to be taken. Unfortunately, when I read the statement by BN youth Chairman in his blog where he said If it is true, severe punishment must be meted out to. , I must say that I am shocked. After 17 police reports and scores of angry parents raising their voice, there is still an IF! Maybe this time it will happen. Who knows? Right now, I am waiting for National Union of Teaching Professionals (NUTP) to indicate their position in this matter. They have been very silent. I guess it is because she is a member of the Union. Good teachers must come out and de! fend the profession.

  • To defend the profession and the nobility of the profession, they must imposed strong internal control in the form of check and balance. People who are lazy, not performing and has disciplinary problems must be weeded out. If it is done by outsiders like me, it would be a bad thing. It would a right and a good thing if those inside the profession that does it.

  • Do we have anymore teachers who are willing to do the right thing? The last two that I know ends up in a very deep cold storage. As for the teacher who said that it is because a teacher I became I doctor, I replied to him that day Betul cikgu, tapi bukan cikgu macam you! Kalau cikgu saya macam you, saya mungkin jadi tukang kayu. This piece is dedicated to my teacher in SR Pengkalan Tentera Kem Batu 9, Kuantan, Mr Yew Kim Guan. I would love to meet him but not sure where he is now.

    Sarawak, the Dam-ed State

    By Leong ChowPong

A consideration regarding the inconsistency between the national energy policy and the building of 12 dams that in a mere 10 years will generate 600% more power than current demand.

Green Ink - LoyarBurok's environmental rights column

Green Ink - LoyarBurok's environmental rights column

Sarawak, the largest state in Malaysia, has a population of approximately 2.3million. In its aims to be a developed state along with the rest of Malaysia by 2020, has over the years embarked on several quests to economics initiatives to transform its agriculture based economy into a more industrialised one, while developing its commercial agriculture in tandem.

Supporting this transformation and its population growth, is a network of power generators located in the major city of the state. Combined, these generators have a capacity of 1300MW, which includes a comfortable reserve margin of 40% from the state?s peak demand of 900MW.

    Hydroelectric in the energy mix

Today, Sarawak generates 9% of its power by hydropower. By 2013, this figure poised to increase significantly through the completion of the controversial Bakun and Murum dams with a combined capacity of 3300MW, or 72% of the state?s energy mix.

With Bakun and Murum connected to the grid, Sarawak will have an alarming reserve margin of 410%. Lack of committed taker for the energy fuels are causing concerns of an imminent energy glut in the state.

    sarawak dams map

    (Source: ! < span>The Star)

Without a concrete plan to address the energy glut, the State energy producer sparked further controversy through a presentation entitled Chinese Power Plants in Malaysia ? Present and Future Development in October 2009 during the China-Asean Power Cooperation and Development Forum in Nanning, China.

In this presentation, Sarawak plans to build 12 additional dams to fulfil future, uncertain industrial demands. The planned dams will be built in Ulu Air, Metjawah, Belaga, Baleh, Belepeh, Lawas, Tutoh, Limbang (feasibility study commenced), Baram (pre-feasibility study commenced), Murum (construction starts 2011) and Linau rivers.

The plan will also include an extension to the existing Batang Ai dam (detailed study commenced). When all these dams are completed, they will push the total power capacity of Sarawak to 7000MW by 2020 a whopping 600% more than the current demand.

Questions that arise are, why has there not been any public engagement when the feasibility studies for some has commenced? And which economy in the world will grow by 600% in 10 years?

Another reason which concerns environmentalist is the presentation above was not made public, but was accidently published in a Chinese website. Implementing projects of such magnitude and socio-environmental impact without consulting the public does not go down well with the people, especially after the bad experience with Bakun.

    Proposed Dams and Social Impact

Without committed take-ups for the excess power, these dams seem poised to end up as white elephant projects at the most severe expense of the of the affected ecosystems and communities. These dams potentially displace thousands of people and submerge several Penan, Kelabit and Kenyah villages.

One of the said dam, Tutoh dam, may submerge part of the Mulu National Park, a ! UNESCO W orld Heritage Site.

    Mulu Tutoh River

    Mulu-Tutoh River (Source: www.tropicalisland.de)

The Sarawak government?s proposal to build the dams, and then start looking for users for the energy generated, reflects the inconsistencies in the countrys energy and environment policies. It also illustrates a planning strategy that is supply driven and therefore inconsistent with the principles of sustainable development.

While hydro power was controversially categorised as renewable energy, its adverse environmental and sociological impacts have also been identified during and after many reservoir constructions. Throughout the life cycle, whether hydro power ultimately is beneficial or detrimental has been debated since the 1960s.

The damming of a river creates a reservoir upstream where waters spill out into the surrounding environments, flooding the natural habitats that existed before the dam?s construction completely destroying and eliminating all lifeforms within the perimeter of the dam. These lifeforms include carbon rich plants and trees that upon death releases large amounts of carbon into the atmosphere.

There is also a school of thought claiming that the high amount of biomass converted into methane results in pollution potentially 3.5 times more than an oil-fired power plant would for the same generation capacity. This is because large amounts of carbon tied up in trees and other plants are released when the reservoir is initially flooded and the plants rot. Then after this first pulse of decay, plant matter settling on the reservoirs bottom decomposes without oxygen, resulting in a build-up of dissolved methane. This is released into the atmosphere when water passes through the dams turbines.

T! he impac t to global warming is significant because methanes effect on global warming is 21 times stronger than carbon dioxides.

    Sarawak, the Dam-ed State

As it stands today, when the 12 new dams complete according to the State?s plan, hydro will make up 85% of the total generation in Sarawak, making the state, a Dam-ed state.

Letter & Opinion From Joe Public

Nazri attacks Umno, MCA, even DPM but is he speaking for PM?

    Wong Choon Mei, Malaysia Chronicle

Outspoken Minister in the Prime Ministers Department Nazri Aziz raised eyebrows when he took to task several Cabinet colleagues more senior than himself over the Umno-MCA row but pundits said unless he was speaking for his biggest boss PM Najib Razak it was just more hot gas from a struggling BN coalition.

It is about time Najib broke his silence on this fight, which has become a bit personal especially the insults coming from from Perkasa, which everyone knows is a branch of Umnos, PKR vice president Sivarasa Rasiah told Malaysia Chronicle.

In particular, we are disappointed in the way Deputy Prime Minister Muhyiddin Yassin rushed to attack MCA for stepping on Malay rights but completely turns a blind eye when a school principal in Johor said the Indians were like dogs and the Chinese should go back to China.

What sort of message is BN trying to send

Of late, racial and religious rows have erupted with increasing frequency as Umno leaders searched for ways and means to contain their arch rivals from Pakatan Rakyat. Sweet overtures have been made over and over again to PAS and each time the Islamist party has flatly rejected any form of connection, dashing Umno's hopes for an easy solution to stay in power.

Ruthless methods were also used to roil PKR and DAP with defections and trumped-up corruption charges, but these have largely backfired, especially after over-zealous scheming resulted in the death of a Selangor political aide last year.

The latest Umno-MCA squabble over Bumiputera quotas has gotten so intense it sparked fears that Najib might launch another crackdown on the opposition, similar to the 1987 Operasi Lalang, where 117 dissidents were arrested and many opposition leaders jailed under the Internal Security Act.! Twenty- three years ago, Najib was the Umno Youth chief and he had played a key role in the swoop.

On Thursday, Nazri appeared to be offering an olive branch to a Malaysian public, fed up with the endless racial polemics that typify the BN parties especially Umno. Business leaders and academicians have even stepped out of their comfort zone to urge Najib to put an end to public slugfest between Muhyiddin, Perkasa and MCA president Chua Soi Lek.

I realise now why there is so little respect for politicians - because they say one thing and then they do another. I do not blame all of you if you have no respect for politicians. Sadly, I belong to this group, Nazri told a press conference on Thursday.

How are we going to convince the people that we stand together under the 1 Malaysia concept when we fight each other in public? I certainly do not condone this and I think it is not good for the BN. In public, you say we are 1Malaysia and then you say we are the BN and we have a spirit of our own and then later, you show that that you are quarrelling. What message are you giving to the public?

Everyday that Najib dithers is a day lost for Malaysia

1Malaysia is Najibs prized platform announced when he took power in April last year. According to the Government Transformation Programme approved by the Cabinet and published in December 2009, 1Malaysia is defined as a nation where, it is hoped, every Malaysian perceives himself or herself as Malaysian first, and by race, religion, geographical region or socio-economic background second.

Nonetheless, pundits say Najib will have to do better than passing messages through Nazri if he wants to be taken seriously by the public.

"Everyday that he dithers is a day lost for Malaysia. But I don't think he will be able to come out from his shell," a political analyst who asked not to be named told Malaysia Chronicle..

"His enemies - and I am talking about the ones in Umno not Pakatan - are just too powerful. All he can do is jus! t hold o n until the next general elections, and after that, depending on whether Mahathir is still around or not, God help Malaysia."

Explosive charge: Tourism D-G framed, minister implicated

A startling allegation has surfaced concerning the second corruption charge slapped on Tourism Malaysia director-general Mirza Mohammad Taiyab - he is being persecuted for being clean as a whistle.

According to a blogger, the charge could be related to a RM600 million contract he had declined to approve for a company linked to Tourism Minister Dr Ng Yen Yen's son.

Mirza is chairman of the Tender Board and strangely enough the closing date for the worldwide advertising tender was on Tuesday, the day after he was hauled to court.

Quoting sources, a posting on the Another Brick In The Wall blog claimed that Mirza had been a thorn on Ng's side since being reinstated to his former position as D-G after his first acquittal.

He had purportedly rejected projects and proposals (approved by the minister) which he had deemed a waste of funds and declined to sanction payments that reeked of corruption.

The clincher apparently was the recent Tourism Development Corporation (TDC) worldwide advertising tender for which he refused to consider awarding a company allegedly linked to Ngs son.

The blogger claimed that the minister and her son were aiming for a total sapu (sweep) and Mirza was getting in the way!

But this time round MACC (Malaysian Anti-Corruption Commission) better get it right .. they better not lose the second time to the same person because it will be not only be embarrassing to them but it will taint their reputation, he added.

In July 2009, Mirza was acquitted by the Sessions Court of a charge of accepting dental implant treatment worth RM13,860 in 2005 after the person who instructed the dentist not to collect payment from Mirza owned up.

Otherwise, he would have been victimised for being in the way of the then minister of tourism, Azalina Othman Said. Mirza is a ma! n with a clean reputation. No ministry staff has any complaint against him.

And neither is there any grumbling against him for corruption or abuse of power. He is known as a straight arrow to both staff and industry players, read the posting.

    Charged with CBT

On Monday, Mirza pleaded not guilty to a charge of criminal breach of trust (CBT) involving RM888,000.

He was jointly charged with former Pempena Sdn Bhd chief operations officer Mohammad Rosly Md Selamat, 56, who also claimed trial.

Pempena is a failed subsidiary of Tourism Malaysia.

Mirza and Rosly are charged with committing the offence at the Pempena office in the Putra World Trade Centre here on Feb 27, 2007.

They are accused of paying RM888,000 to LCL Interior LCL Dubai for a project to build a restaurant in Dubai even though the project did not fulfil the necessary requirements.

According to the blogger, back in 2007, Mirza was a member of the Pempena board by virtue of being the D-G. He was also an authorised cheque signatory for Pempena.

But things werent all good between Pempena and Mirza who disapproved Pempenas decision to finance the Dubai restaurant.

Despite his objections, the blogger said, the Pempena board of directors had approved the budget.

He unwillingly signed the disbursement cheque which was squandered away by the recipient company but did not deliver the assigned work. It is claimed that the company was connected to the then tourism minister, Leo Micheal Toyad, said the blogger.

The Auditor-Generals Report 2008 reported that Pempena did not generate any return on its investment after some RM41.7 million was pumped in the company.

What will they do about racism now?

By Kee Thuan Chye - Free Malaysia Today

COMMENT Let’s wait and see what action will be taken against Siti Inshah Mansor, the principal of Sekolah Menengah Kebangsaan Tunku Abdul Rahman Putra, Kulai, for the racist remarks she allegedly made at the Merdeka celebrations in her school.

The police will be concluding their investigations soon, under Section 504 of the Penal Code. If they have a case, Siti Inshah could be charged with provocation, which carries a maximum imprisonment of two years, a fine or both.

Meanwhile, DAP supremo Lim Kit Siang has called for her to be sacked. MCA president Chua Soi Lek calls for her to be transferred to a desk job and given counselling. How generous of Chua.

If she did what she is said to have done, she should instead be drawn and quartered, like in the good old days. Or have her head put in a cangue – you know, like in the Chinese movies, where the head and hands are locked up within a square wooden contraption.
Or she should be given the Japanese treatment – force-fed water while someone jumps on her bloated tummy, or hung from a tree by her thumbs, and displayed publicly for all to see that this is what happens to racists.

Of course, I’m being facetious, but this must surely be the fantasy of anyone who feels disgusted by any racist act. All the more so if it is committed by someone who is a principal of a school, who should be spreading the message of racial unity instead of – God forbid! – racial hatred.

Siti Inshah is alleged to have said that Chinese students are not needed in the school and can go back to China or Sekolah Foon Yew (a private Chinese school in Johor), and that the prayer strings Indian students wear on their neck and wrist make them look like dogs, and only dogs would be tied this way.

If the allegation is true, what could have possessed her to make her say such things? That is something that must be ascertained. Even if she had been provoked for some reason or other, it is still not her place to react this way to the students. She has a huge responsibility as a school principal to restrain her racist impulses.

Given the seriousness of the situation, if the allegation is true, how then can she be allowed to get away with it? If she were to be exonerated, imagine the damage she could further cause given her influential position.

If it is true that she behaved like a racist, her name should instead be remembered in the Hall of Shame.

    Racial slurs

So far, however, among the Barisan Nasional parties, only the MCA and the MIC have criticised the action. Has any Umno leader come out to say anything against it? And if so, why not?

If the people who are in charge of administering it are not up to it, if instead they are exposing the wound to even more bacteria, then we should be looking for an alternative cure.
Siti Inshah is also alleged to have called her non-Malay students penumpang (passengers or tenants) in this country. First, we had Umno politician Ahmad Ismail calling non-Malays pendatang, now there’s penumpang. What will they think up next?

These racial slurs are getting out of hand. And that’s worrisome. It’s symptomatic of the times. We are getting more divided along racial lines than perhaps ever before.

That’s what you get when you allow the mainstream newspapers to go to town scaring the Malays into believing that the non-Malays are a threat and will soon take over the country. When someone like Zaini Hassan can write irresponsibly and mischievously in Utusan Malaysia about a “large-scale war” breaking out that will be bigger than that of May 13, about an alternative constitution being written that will abolish the special position of the Malays and Islam. What rubbish!

That’s what you get when you allow newspapers and individuals to go around telling non-Malays they must be submissive, grateful and not speak up for their rights, or go home – to China or India.

That’s what you get when you allow organisations like Persatuan Pribumi Perkasa Malaysia (Perkasa) to go on their high horse and slam every reasoned argument made against their credo. So now, for every little thing they don’t like, they run to the police station to make a report.

That’s what you get when you give them so much face, to the extent of granting them a publishing permit virtually overnight; when you cut them so much slack by saying nothing when they challenge government policies that seek to address the nation’s fall from economic competitiveness.

And then no less than the Deputy Prime Minister invokes the ghost of May 13, pulling the perennial Umno stunt, to tick off Chua Soi Lek for asking for more non-Malay participation in the economy.

    Damoclean sword

Not only is Muhyiddin Yassin behind the times in that regard; he actually warns that this could anger the Malays and it could amount to a spark similar to that which set off May 13. Who is stoking the racial fire here? If a personage like the DPM says it will make the Malays angry, some people might be bound to take that seriously and really feel angered. If the DPM mentions May 13, that might put ideas in some fanatics’ heads.

Why must Muhyiddin say something potentially flammable like this? As the nation’s No 2 leader, he should instead avoid bringing up such a thing instead of brandishing it like a Damoclean sword.

But then, that’s what constitutes the central problem of this country. Politicians will make capital of anything without thinking of its consequences. They are short-term players looking for short-term gains. And this short-term playing has been extended for decades in the sick politicisation of race.

Do we have to keep reminding them of the dangers of this game and still see nothing done about it even when the cows have come home? By then, it will be too late. The wound caused by racial discord might have become so infected that it can no longer heal.

The treatment has to start now. And if the people who are in charge of administering it are not up to it, if instead they are exposing the wound to even more bacteria, then we should be looking for an alternative cure.

Pakatan leaders challenge DPM to to act against racist principal

    Wong Choon Mei, Malaysia Chronicle

Pakatan Rakyat leaders have condemned Deputy Prime Minister Muhyiddin Yassin for trying to sweep under the rug the latest outbreak of racism in the country involving a s school principal from his own Johor state who had derided Indians as dogs and said Chinese should go back to China.

“The behavior of the school principal is part of an overall problem not an isolated incident. Racism is rampant in Malaysia and racial polarization is even worse. If Muhyiddin fails to act, it not only shows his double standards but raises questions about himself,” PKR vice president Sivarasa Rasiah told Malaysia Chronicle.

“To a large extent, the root cause for such arrogant and ignorant behavior stems from the examples set by Umno leaders and sad to say Muhyiddin has been at the forefront of this sort of racial superiority policies rather than throwing his support behind 1Malaysia or some other unifying plan.”

    Differentiating himself from his boss

Indeed, in his haste to differentiate himself from his boss, Prime Minister Najib Razak, Muhyiddin has put himself on a slippery pole that could topple any time, leaving him disowned and staring at nothing but wasted opportunities.

In the past weeks, the Umno deputy president has been busy going after MCA for stepping on Malay rights. Together with ultra-Malay NGO Perkasa, he has hit the headlines issuing warning after warning against the Chinese party for a proposal it made to Najib suggesting that the 30 percent Bumiputera equity target be reduced and open tenders be conducted as a matter of norm.

Not only did Muhyiddin immediately torpedo the MCA proposal, he did not consider any of its positive aspects which included preferential pricing to help Bumi firms tide through the open tenders or the possibility that the endemic corruption currently hidden behind the 30 percent quota could be reduced.

“Muhyiddin is again proving to fail 1Malaysia with inept handling of the racist remarks by the principal of SMK Tunku Abdul Rahman Putra,” DAP information chief Tony Pua said in a statement.

“The 1Malaysia concept was further debased when Alimudin told the press yesterday that 'there is no change, the issue was only a misunderstanding and the problem has been solved between the principal and students', indicating also that the principal may not even be transferred as a punishment.”

Disdained even by his own Umno mates

Pua was referring to Education director-general Alimudin Dom for declaring the issue resolved after a cursory investigation to appease the public outcry that has erupted.

Even Muhyiddin’s own colleagues in Umno, including Youth chief Khairy Jamaluddin, have expressed disdain for the remarks made by Hajah Siti Inshah binti Mansor.

“We cannot drag our feet or prevaricate on things like this. Blatant racism. By a school principal no less. And if proven that she said those things, she must be sacked and charged appropriately. She shouldn’t be allowed back pending the result of the investigation, which shouldn’t have to take long,” Khairy had tweeted.

Last week, at a Merdeka celebration held in her school, Siti Inshah had allegedly said in a speech:

“Pelajar-pelajar Cina tidak diperlukan dan boleh balik ke China ataupun Sekolah Foon Yew. Bagi pelajar India, tali sembahyang yang diikat di pergelangan tangan dan leher pelajar nampak seakan anjing dan hanya anjing akan mengikat seperti itu.”

“Chinese students are not needed and can go back to China or Foon Yew School. As for the Indian students, the prayer strings that they wear around their wrists and necks make them look like dogs and only dogs are chained up like that.”

    Mahathir dan kebebasan akhbar

    Chang Teck Peng

Janji berbunyi "Malaysia will ensure no censorship of the Internet" ini hanya ditambah apabila Mahathir berucap di depan orang Amerika di Amerika Syarikat pada tahun 1997.

- Merdeka Review

Sodomy circus turns into a sex opera!

    by Martin Jalleh

It seems that for the past few days the Attorney General (AG)’s Chambers have become somewhat like a boiler room after being hit by one steamy story after another. The AG, Gani Patail, has been going bonkers, berserk and ballistic, as a result of an unexpected hard blow below the belt by Raja Petra Kamarudin (RPK).

The famous whistleblower, lid-blower and blogger had dropped a bombshell by alleging that the AG has been bonking the head of one of his divisions.Such news blew many away but RPK said their sexploits were nothing new. Many in the AG’s Chambers have chosen to turn a blind eye to their boss’ bonking.

The AG and partner have allegedly saved the nation’s taxpayers money, as they would blissfully bunk, bonk and bond in the same hotel room during their frequent trips abroad.

We should not be bogged down by who is bonking whom, but when such basic or base instincts are allegedly displayed by the nation’s top legal officer it becomes the rakyat’s business! This is especially so when the AG has been bonking from high moral ground of his Office whilst trying hard to banish Anwar Ibrahim into political oblivion with a bull-loaded sodomy charge.

    Bonking Binge

The sex opera began with RPK alleging that the prosecution’s star witness in Anwar's Sodomy II trial, Mohd Saiful Bukhar, was bonking Farah Azlina Latif, a deputy public prosecutor (DPP) involved in the case.

Was RPK bluffing? The AG begged not to comment but instead bundled Farah off to another division. Saiful and Farah bound themselves in silence, though Saiful could not stop babbling about the truth finally prevailing (and it really did!)

Anwar lodged a police report alleging that the “bonkers” had breached the law, especially the OSA. Karpal Singh, Anwar's lead lawyer, said the couple, if innocent, should be bold enough to verify what they have been accused of. The Court was duty bound to allow him to question them in Court.

Karpal also blasted the AG’s Chambers: "Never before in the history of the country or in the Commonwealth has a DPP had an affair with the star witness". The brave legal tiger forgot for a moment that he was in Bolehland, where everything is beyond human comprehension!

The AG betrayed himself when he passed the baby on to Solicitor-General (SG) II Mohd Yusof Zainal Abiden, who told the court that the prosecution was totally blur on the bonking. He accused Anwar of making “bare allegations” and insisted there was no miscarriage of justice!

Karpal countered that Anwar had “bare facts” and “hard evidence” that the two had bared and bonked. He urged the Court not to go soft on the prosecution. The naked truth they could stand no more -- is that their absolute lack of integrity has been exposed and credibility stripped to the very core!

The SG who was in the best position to respond to Anwar’s affidavit seeking the dismissal of the case, or require Saiful and Farah to file an affidavit, bewildered everyone by passing the buck to his subordinate DPP Hanafiah Zakaria and Investigating Officer (IO) Supt Jude Pereira.

As expected, the Court, which has been perceived by the general public as subserviently doing the bidding of the political masters, bowed and bent backwards, much to the pleasure of those in the AG’s Chambers.

Judge Zaibidin Diah found Anwar’s allegations of the Saiful-Farah’s sexual affair to be true but he ruled that the relationship did not compromise the case. He based this solely on the affidavits of the DPP and the IO. He rejected Anwar's application to strike out the sodomy charge.

We are asked by the Court to believe that Farah, a qualified lawyer, chosen to be on the high-powered prosecution team, to assist in such a high-profile case, was merely a note-taker and beyond reasonable doubt was not privy to crucial information on the case!

Further, surely the learned judge knows that great empires have fallen when forbidden secrets were released by a lover during pulsating and passionate bonking moments and pillow talk. From the charge sheet and on to the bed sheet surely much could have been spilled!

As for DPP Hanafiah, Karpal told the Court that the DPP’s very own credibility was in question, alleging that the latter had had a second marriage in Thailand, and had tried to “legalise his marriage in Kota Bahru” and is therefore “guilty of committing an offence under the Syariah law”!

The IO had said that all investigation papers were strictly under his control. But who can trust the police nowadays? Even the Kota Kinabalu Sessions Court had described Jude Pereira’s boss, IGP Musa Hassan, “an incredible witness whose evidence is not to be believed”!

    Monsters & Masterminds

The rakyat’s heart goes out to Janna Syariza, the fiancée of Saiful. Once when referring to the sodomy case, she had very bravely declared that she will stand by her man through the “monstrous battle that is looming ahead”, not realising that a “monster” was standing next to her.

RPK has also alleged in a blog posting “Just when you thought it is safe to go into the water”, that Saiful is also bonking Khairil Annas Jusoh, an aide of Najib. The man had proudly posed with the sodomy accuser outside the PM’s office when the latter went there “to apply for a scholarship”!

RPK revealed that after a one-month marriage, an on learning about the affair, Khairil’s wife left him and “divorce is certainly on the cards”. Will Janna Syariza, the fiancée of Saiful, be able to stomach and survive this third “storm”? She can be assured of the sympathies of many Malaysians.

One cannot but feel also for the fiancé of Farah who according to the Malaysian Chronicle is the assistant head of the prosecution unit in a northern state. They were engaged last year. Their marriage was due to take place on July 9.

A day before the marriage was due to be solemnized she asked for a cancellation, leaving her fiancé who had already sent out all the invitation cards stunned and heartbroken. Farah must have realized that she had gone too far!

Before we could even recover from the revelations of the shocking sex scandals of those who allow themselves to be used by the masterminds to destroy Anwar politically, RPK serves yet another sex sizzler and it involves the Attorney General himself!

Gani Patail must not remain silent. He must speak up and reveal whether it is just a spin (just like when almost everyone first thought that the Saiful-Farah sex liaison was one?). Not only his credibility and integrity is at stake, but also that of the Office of the Attorney General...and even the government!

Strangely enough the country’s self-appointed moralists and religious authorities have also been very silent on the sex fest that has taken place. There have been no screams or shouts of zina or khalwat or interviews and investigations to be conducted. Perhaps they have all grown up?

If such secret sex trysts are really going on amongst those in the Chambers of the AG what would be left of the public’s trust!

Ronnie Liu implicated in new support letter row

KLANG (Star) - The support letter fever in Selangor picked-up momentum Wednesday with the revelation that a new village headman had issued his own company a support letter, in his capacity as a headman, to get a job from the Klang Municipal Council (MPK).

Pandamaran New Village headman Yap Hock Siew had purportedly used the letter to try and get a contract from MPK to maintain and clean river floodgates.

The job was allegedly for his company First Team Enterprise.

Selangor exco and Pandamaran assemblyman Ronnie Liu had allegedly endorsed the support letter.

When contacted, Yap admitted he had issued the letter with Liu’s support and endorsement to get the contract from MPK.

“But that was before I became the village headman in April this year and the company is not a new one. I started it in 2008 and it has been dormant since,” he added.

He said he had used the company to get the job for his village development and safety committee (JKKK) in order to pay the utility bills for the village facilities.

“No one gives us the money for these things and it is my responsibility as village headman to ensure that bills are paid,” said Yap, who is the Pasar Pandamaran DAP branch chairman.

However, he added, the company did not get the contract with MPK.

Letter & Opinion From Joe Public

SAPP: We'll scrap unwanted mega projects

Maverick independent party Sabah Progressive Party (SAPP) has vowed to scrap three controversial federal projects "when we come to power" in Sabah come the next general election.

SAPP will fulfil this promise as the state government has the power to stop projects, declared party president Yong Teck Lee in one of the strongest indications of SAPP's plan to take over the state administration.

But until then, he said, SAPP would not let up pressure on the federal government, warning that the party would organise mass protests if the people's opposition to the projects were not heeded.

Yong (below) said the three projects - the coal-fired power plant in Sinakut, yong teck lee sabah sapp party pc 230409 02Lahad Datu, and two proposed dams at Kaiduan in Papar and Kg Tambatuon in Kota Belud - were "unnecessary, with inflated costs and do not benefit the people".

Opening a new branch of the party at Kg Nambazan in Moyog, Penampang, recently, he said, "SAPP's Youth wing has initiated a solidarity gathering on these three issues and if the government proceeds with the projects, there will be protests in the state."

The three projects together are estimated to cost well over RM2 billion.

The 300-megawatt coal-fired power plant, proposed to address power shortfall in Sabah's east coast, is in its third incarnation after strong objections from both Sabahans and the state government scuttled two earlier attempts to build the facility in different locations.

The two dams have been proposed as water catchment areas to provide irrigation to support the expansion of agricultural activities.

The dams have been facing continued protests from the local communities as they would cause the displacement of thousands of people from their ancestral lands.

    BN's successful divide-and-rule tactic

Yon! g, who p ulled his party out of the BN in 2008 to be the only independent party in Parliament, said the onus was now on each and every Sabahan to unite against oppression and exploitation by the BN-led federal government.

Singling out Umno, he said the ruling coalition has succeeded in exploiting Sabah through its divide and rule tactic that had been "successfully applied" from the time of Mustapha Harun and Usno in the 1960s to the Harris Salleh and Berjaya-led state government of the 1970s and the Joseph Pairin Kitingan-PBS era from the mid-1980s to mid-1990s.

The former Sabah chief minister claimed that BN was desperate to keep its hold on Sabah and Sarawak, having realised that the two states were the only reason it remained in power after losing its two-thirds majority in Parliament in the watershed March 8, 2008, general election.

"We are easily divided. Therefore we are easily ruled and this is still happening in Sabah today," Yong noted.

Lim Guan Eng kasi UMNO meroyan lagi......

    BN leaders wary of reforms

The current BN leaders are pre-occupied with self-fulfilment, hesitant in pushing for reforms for fear of losing power. Maybe they could learn a few things from our southern neighbour, suggests Christopher Barnabas.

I am sure we have come across propaganda from BN leaders to emulate successes of highly innovative and entrepreneurial countries. Mahathir's Look East policy in the 1980s comes to mind, while the recent obsession in meeting Obama points towards a westernised vision by the current Najib administration.

While Malaysia stands idle and directionless in a middle income syndrome unable to compete innovatively with advanced economies like Singapore, Taiwan, and Korea or as a low-cost manufacturing hub verses the likes of Thailand, Vietnam, or Indonesia, it is potentially time to consider some salient points. How has our southern neighbour been transformed from a small fishing village to a vibrant cosmopolitan and first world country? Singapore's leaders point to four key factors: capable leaders, a meritocracy, a level-playing field, and a command of English.

It is somewhat coincidental that I wrote an article last week entitled
When BN Leaders fail to lead, think alternative, touching on the very foundation of having capable leaders to lead the country out of this downward economic and racial spiral.

The current BN leaders are pre-occupied with self-fulfilment, hesitant in pushing for reforms for fear of losing power; thus they tread along racial lines depending on which demographic they are addressing. Across the causeway, however, Singapore attracts the best talents (many of whom are ex-Malaysians even at ministerial level) to form an exceptionally able government.

The issue of meritocracy is certainly hot since Na! jib step ped into office last year. His NEM pushed for market friendly, merit-based, transparent, and needs based policies, only to backtrack during a Perkasa gathering. Last weekend, his flip-flop agenda continued, this time describing his governments balancing act in satisfying the demands of the various ethnic communities in the country, implying that the NEP would remain mostly unchanged after 40 years. That's the same NEP that has enriched the elite few while the rakyats suffering continues.

    In a
recent speech by Singapores Berita Harian editor Guntor Sadali (in response to Mahathirs negative statement about Singapore Malays), he stated that Singapore Malays do not want the crutch mentality, as it will make them into the 2M community; the first M for manja (spoilt) while the second M for malas (lazy).

Meritocracy has proven to be good and fair, as it pushes us to work hard and be proud of our achievements. We may wear the same clothes, eat the same food, speak the same language, and practise the same culture (as Umno Malays I must add), however, the similarities end there, Sadali added.

For an economy to develop, the need for a level-playing field is crucial. Competition amongst the masses promotes innovation and entrepreneurship, the very core fundamentals required for sustainable development in a country. Umno leaders, on the other hand, falsely instil a negative pre-notion in the Malays, creating a mental trap that they will lose against the other races. Such negativity breeds generations of mediocrity for those that subscribe to this propaganda.

Lastly, while the command of English is surely vital in the business world, it is again the flip-flop mentality of our leaders on the education policies that never fails to confuse the masses. We marvel at such misguided policies and conclude that it may be their desperate attempt to restrain knowledge to the people so as to avoid questions on their weak governance. As Sudali noted, for Malays in Singapore, po! wer is n ot about wielding the
keris, but rather the knowledge that is gained by hard work and determination in a trusted education system. That is the real power.

It is time we educated these so-called leaders to wake up to the reality that despite the enormous natural and human resources available in the country, we trail shamelessly behind our southern neighbour in almost all aspects of economy and education. Try looking South for a change.

See What Barisan Nasional Gotta Say?

    Ketuanan Siam

    By John Doe

It hurts, when "fresh news" is exposed in the face of a government hell-bent on creating a delusional History of itself, under the guise of "Nation-Building". Let us start with Museum Negara, and the person who built it. Tunku Abdul Rahman, more affectionately called TAR was of Thai Origins. He went to school in Bangkok (ask any Tuk-tuk driver to take you) not too far from Hualamphong Train Station. In fact, most Thais are so proud that "one-of-their-own" was able to become the Prime Minister of Malaysia.

Being of Thai origin, he obviously used "symbols" of Thai unity to decorate Museum Negara. The 2 "X" decoratives flanking the roof of Museum Negara, thus, is a direct import of the symbol of Thai Unity. This is especially true in the north, around the Chiang Mai region. In fact, the Museum of Chiang Mai is decorated EXACTLY the same way. Hundreds of billboards in the north also have the "X" on it, to symbolize and remind Thais of this unity. Perhaps this is Tungku's succinct message to Malaysia?

And dear readers, please compare it with this:

One is of The Chiang Mai Museum, and the other is of Muzium Negara. The resemblance is stark. On the same note, all houses in the north of Thailand are identical to any "Malay House" on the Peninsular. Ever wondered why Tom Yum is such a favourite dish among the "Malays"?

Historically speaking, all of the Peninsular used to belong to Thailand anyway. It was controlled via Pattani, under Ayudthia. If "Sejarah Melayu" (Originally called Asal-Usul Raja-Raja) can be taken as truth, then it talks about how Parameswara murdered the village Chief of Temasik (Singapore), who was the Brother-in-Law of the Pattani King. Ayudthia then ordered his (Parameswara's) execution. He then ! ran away , and went to "Old Malacca" situated in Muar. Parameswara ran again when he was busy pirating ships which travelled along the Straits. This time, it was the Achenese who issued his (Parameswara's) execution.

The name Parameswara itself is of great interest. Many Posthumous-Names of Angkorian Kings carried the name "Parameswara" in it. Usually, it was spelt "Paramesvara" and a suffix, depending on which God he prayed to. You see, all Kings had a Birthname, then, a Coronation Name, and then, a Posthumous Name. For example, King Bhumipol, and Rama IX, the current names of the present King of Thailand. So, for Parameswara to choose a name which is already a "dead name" was an attempt to "Supercede" the living. After all, all kings were changed from Dharma Raja to Deva Raja, to symbolize their Ancestry of Gods. The God-King concept was thus accepted by simple agrarian folk as truly GOD, and thus made Tax-collection easier. It also meant total submission whenever soldiers were required to fight the neighbours; since who can argue against GOD?

And whenever GOD wanted a new wife, or concubine, it was dramatically easier to acquire a nubile of choice. Who doesn't want to have sex with GOD himself, and bear GOD children? The King of the Champa had 4 wives, even though he was a Hindu. Same for Jayavarman VII, even though he was a Buddhist. Both had uncountable concubines, all sent by willing and needy Villagers, in exchange for "special requests". There is no other logical justification of the concept of Kingship anyway, if the God-King concept is removed.

Back to the Thais, the DevaRaja, or the God-King concept, was the central theme to keeping the peasants under their control. The word"central" in the Thai Language is Klang. And no prizes for guessing where the name for the Malaysian Port-Town originated from. You will find tens of villages and townships in Thailand named Ban Klang. Ban, (or sometimes spelt Bann) simply means Village. It's thus no surprise, that "Central Hospital" in Bangkok ! is calle d "Klang Hospital". Klang Valley, thus, could be translated as Central Valley in Malaysia. Central to where? Between Bangkok, and Jakarta, or Central between Pattani, and Majapahit? Any decent map will show this almost equi-distance readily.

Many Kelantanese will claim that they are descedants of the mighty Champa Kingdom in central Vietnam. However, their King is from the Pattani "Royal Line". Ironic, but painfully true. (I refuse to comment about their internal family feud, or Manohara.) In fact, many of those killing and bombing innocent humans in the Yala, and Narithiwat Province just across the Border, have relatives in Kelantan. Crossing the Golok (known as Kolok in Thai) is a mere RM2, or 20Baht, no questions asked. Most in the South of Thailand will tell you that these Terrorists cross over to Malaysia whenever the Military organizes a sweep. Even more will tell you that they also hold dual-citizenships in both Thailand, as well as Malaysia. Isn't dual-Citizenships illegal in Malaysia? Are they brought in to vote to UMNO, so as to provide them with continued access to Malaysia whenever they risk arrest?

Many Kelantanese are also known to have illegitimate wives and children across the border. Same goes for Perlis. In fact, official Perlis Tourism Brochures announce that any Muslim may go there if they want to register their second, third, or fourth wives WITHOUT theconsent of the first wife. Musliim women, please take note of this. You may be sharing your "Darling Husband" with a few other women in Perlis, or across the Border. Do what you have to do.

To address Riduan Tee, he should be the first to board the boat to China, to set an example. He could, of course, also board the boat to Arab countries unless he thinks that Adam and Eve are Malay. Perhaps he is so obsessed with this particular Branch of an Arabic Religion. (There's many other Arabic Religions, both past and present, which includes Zorastarianism, and Hinduism, which were both started by the Iranians (read as I! ndo Arya ns) The Iranians brought the 3 original Vedas, and Sanskrit to Mohenjodaro, and Harrappa in the Indus Valley. The Mahabarratta, and the Ramayana were to be written at least 2,000 years later by Dravidic Indians. Hinduism, on the other hand, had already existed in Iran, 8,000 years ago.) And he can start, by telling the Shi'ites that they are wrong. Stop hiding under the skirt of Islam. Using religion to further one's own Agenda is no different from Suicide Bombers, of whom we haven't heard a whimper spoken out by Malaysia against such despicable acts ever.

Perhaps CIMB-Thailand on Sukhumvit Road next to the SIAM BTS station, was burnt beyond recognition by the Thais recently, was a clear message to Najib to wank his Ketuanan elsewhere? It is also interesting to note, that the 4 northern states of Perlis, Kedah, Kelantan, and Terengganu were given to Thailand during WWll, and these states had to fly both the Thai flag, as well as the Japanese flag. They rejoined Malaya only when the British returned in 1945 after the war.

Speaking of BTS, have you seen their logo, and how Hong Leong kind copied it wholesale, with impunity?

The above is the logo of the Thai Skytrain. Not one of a Bank in Malaysia.

And speaking of copying logos, the "Timbang" Logo of BNis seen in pretty much every street corner in Thailand, but instead of the blue background, is green. See below:

No prizes for guessing who copied who. No wonder the Thai's are so proud of Tunku !! He brought Thailand to Malaysia !!

Back to Riduan Tee, why not try using Pakistan as your "Ideal Muslim Country" as reference. No? Wanna talk about how the Talibans carved the 1st Buddha Statue in the world ever?

It was over 150feet tall, and was until recently bombed by the Taliban (watch The National Geographic Special on this). Or do you not know? If you don't, then perhaps you should "Shaddap", and leave the talking to us who do. Final parting words, "Why didn't anyone arrest Riduan Tee for creating inter-racial dissent?"

See What Barisan Nasional Gotta Say?

Apart from our parents, it is our teachers who help lay the

Apart from our parents, it is our teachers who help lay the first foundations in life so as to guide and improve ourselves, for whatever it is we aspire to be.

On 12 August, Hajah Siti Inshah Mansor, the principal of Sekolah Menengah Kebangsaan Tunku Abdul Rahman Putra in Kulai, allegedly described her students as penumpang (passengers), told her Chinese students to return to China and compared her Indian students with dogs.

Her remarks are unacceptable and a disgrace to her profession the teaching profession.

She should have done the right thing and tendered her resignation. But only after making a public apology and after writing a letter of apology to each of the students in the school.

So what is a letter to each of the 2,200 students? She has done much harm to young, vulnerable and impressionable minds. At the same time, a noble profession has been besmirched, and a nations fragile truce between the races, is threatened.

If she will not go willingly, then she ought to be sacked. I have worked in companies where racism is not tolerated and the punishment is instant dismissal.

The head teachers insensitive, racist and daft comments uttered at the school assembly, is an insult to the Merdeka day celebrations.

Does this woman know the significance of Merdeka? Is she too young to have studied history at school or too young to know about the struggle to achieve Merdeka? Is she a perfect example of our much maligned BTN system?

I come from a family of teachers. My paternal grandfather was a headmaster, a father-in-law was a teacher as was my aunt and mother who trained at the Malayan Teachers Training College at Kirkby.

Can anyone imagine the uproar and diplomatic scandal if the English teachers were to tell the Malayan teacher trainees that they looked stupid in their rags (sarongs) and to go back to the colonies where they came from, and to where they live in the trees, like monkeys?

You only have to sit with my grandfather to k! now of t he challenges he faced in Malaya, when schools, were a rarity. We have progressed far from those attap-school days.

As for my mother and her sister, the children they once taught in primary and secondary school, would keep in constant touch, decades later What is striking is how her Chinese ex-students would frequent our Raya open house yearly. There was nothing unnatural or affected by the gathering.

That is why it is wrong for this principal to remain in her profession. She is undermining the good work of the other teachers, including her religious and community leaders.

Prime Minister Najib may have championed his 1Malaysia message, but it is obvious that either his message is not filtering down to the population or that the extremist groups are more effective in creating disharmony.

Wasnt it a few days ago that DPM Muhyiddin Yassin warned the MCA to be sensitive to the needs of other races in the country? However, he forgot to inform his own people the Malays to do the same. Didnt he say, In Barisan, we always take a similar stand on issues affecting all races.?

Perhaps, Malays do not listen to their leaders any more. Maybe the extremists have successfully turned insecure Malays like this school-principal into arrogant creatures.

It would be interesting to know if any of the teachers made a police report. If none of them did, then it just shows how we have been conditioned by peer pressure and office politics, that we have forgotten our basic values.

A few minutes of berating and insulting the non-Malay students will now condemn this principal to a life of ignominy. Rather than being remembered for her guidance and teaching abilities, she will be known for her racist comments and the humiliation of being jeered at, during her attempts to apologise to the school assembly. Teenagers can be merciless when provoked.

Hajah Siti will come to realise the full meaning of insult in haste and repent at leisure. Her teaching career is in tatters as she will no l! onger be held in high regard by her students, their parents and her fellow teachers.

Instead of being an inspiration, she has disgraced her noble profession.

Pornthip sure Teoh's death not suicide, inquest deferred to Sept 1

    Malaysia Chronicle

FINAL UPDATE The Teoh Beng Inquest began with star witness Dr Pornthip Rojanasunand affirming her view that Beng Hock had suffered extensive injury prior to his fall and that she was sure his death was not suicide.

"I still believe it is not suicide," the Thai forensic expert told the court.

Under questioning by Malik Imtiaz Sarwar, the lawyer acting for the Selangor state government, she pointed to the injury on his neck where she said a blunt object had caused the wounds.

"Wounds caused by blunt object. Someone put something on Teoh's neck or pressed his head on something," she told the court.

She was sure it was a pre-fall injury with "more force and more weight" used than under manual strangulation. The Thai forensic expert also ruled out the possibility that the wound was caused by a fracturing of the spine upon impact with the ground.

    Disagrees with Vanezis

She disagreed with the findings of MACC expert witness Dr Peter Vanezis that the mark on Teoh's neck was due to a fracture of the chin. According to Pornthip, a chin fracture area was small, while in Beng Hock's case, the hemorrhage extended to the chest. She also pointed out there are no blood vessels on the chin to cause such an amount of bleeding.

Pornthip also disagreed with Vanezis that Teoh landed on his feet or that he was conscious when he fell. She reiterated that the first autopsy report showed cerebral edema. According to her, that indicated Teoh had experienced hypoxia, where brain does not receive oxygen, for at least 5 minutes. Dr Vanezis had said Teoh was probably alive when he hit the ground.

She also said there was no fracture to Beng Hock's wrist, which was not usual in fall cases as normally a person would instinctively reach out to break the fall. She pointed to the fracture and external wound above one ankle, but none at the base of the skull, which indicates it was highly unlikely that Teoh could have landed on his feet.

However, Pornthip retracted her previous view that the anal tear and injury to Beng Hock's buttocks was caused by aggravated beatings. She agreed with Vanezis and the other 4 federal-government appointed pathologists that the injury in the anal area was caused by the fall.

Malik had begun by referring to her past testimony where she had said there was 80 percent chance of homicide gauging from pictures taken of his corpse. This time, Pornthip declined to reiterate the odds but said she was sure it was not suicide.

Pornthip also confirmed that at the second post-mortem, she did not touch Beng Hock's body. However, she was able to form her conclusion as Sungai Buloh pathologist Dr Shahidan Md Noor had dissected on her behalf based on her instructions.

    Attorney-General's 'suicide' note

Under questioning by Gobind Singh Deo, the lawyer for Teoh's family, Pornthip said any notes found should be tested for DNA, fingerprints and palm prints immediately, and then be subjected to handwriting analysis.

"Protocol for a crime investigator to search for notes to find, search for it. To prove scientifically in a homicide case, DNA, handwriting can be done & tested. Crucial," Pornthip said, adding that such notes were often emotional and she preferred to rely on scientific evidence as proof of suicide.

Gobind was referring to a so-called 'suicide' note that the authorities had purportedly found in Beng Hock's sling bag in October 2009 but only earlier this month informed the court, Teoh's family and the public at large about its existence.

Malaysia's Attoney General Gani Patail has come under fire for suppressing evidence and speculation is rife the note was fabricated and produced at the 11th hour to discredit Pornthip ahead of her testimony, which is damaging for the MACC.

"I work for the rights of the dead, not the Selangor government"

Indeed, when MACC's head prosecutor Abdul Razak Musa began cross-examination, he started by tearing at her experience and academic qualifications. He tried to denigrate her professional training but a calm and composed Pornthip told him her university was among the top 5 in Asia.

"You have to understand. I work for the rights of the dead, not the Selangor government. My objective is to help the dead," said Pornthip, drawing applause from the courtroom.

Razak had suggested her testimony was biased because she had been hired by the Selangor government. He also attacked her for ruling out suicide and questioned why she insisted he was strangled when there were no witnesses. "I never said he was strangled," Pornthip told him. "I said pre-fall injury."

Razak also grilled her on what he said were discrepancies between Pornthip's first and second reports. But Pornthip was able to counter each of his questions and spent time explaining to him and the court.

"If you say blunt object, where is the weapon," a frustrated Razak said. To which the quick-witted Pornthip replied, "I want to ask if you are a lawyer?"

Pathologists are tasked to investigate the scientific findings in a death while it is the job of police to hunt down the culprits and weapons used in a crime.

Razak also reiterated several times to the court that all 4 federal-government appointed pathologists had said Beng Hock's neck injuries were caused by a fall. However, Malik objected, saying that "During cross-examination, Dr Shahidan had confirmed neck injuries were pre-fall."

    Brutal cross-examination

Apart from Pornthip, Vanezis,Dr Shahidan, Dr K Saravanan and Dr Khairul Azman Ibrahim from the Tengku Ampuan Rahimah Hospital in Klang, and Dr Prashanth Samberker from the Universiti Malaya Medical Centre had conducted the second autopsy.

In summarizing for the Attorney General, specially-appointed criminal lawyer Tan Hock Chuan clarified with Pornthip if she was ruling out strangulation as the cause of death, which she said she was.

However, she maintained her view that, contrary to Dr Shahidan's findings, Beng Hock's neck injuries were not caused by the fall. However, she agreed that his skull and anal injuries were the result of impact with the ground.

Coroner Azmil Muntapha Abas then grilled Pornthip on the her case studies, asking questions related to falls from height and the injuries that resulted.

He adjourned the hearing to September 1 at 2.30 pm after Gobind asked for time to study the 'suicide' note revealed by the Attorney General.

Beng Hock's death a symbol of injustice

Earlier, Dr Pornthip was greeted by loud cheering as she entered the packed courtroom. Many of Beng Hock’s supporters are attending the hearing, as to them, Pornthip’s testimony symbolizes the injustice of his death.

The 30-year old Selangor political officer, who was a former journalist, had died in mysterious and suspicious circumstances after overnight interrogation by the MACC. His body was found outside the MACC headquarters and it is believed he had fallen from its 14th floor office.

The MACC says Beng Hock committed suicide but his family and friends are adamant foul play was involved. They blame the MACC for torturing Beng Hock during interrogation and for causing his death. In court today were his parents and brother.

Federal-government pathologists, including Vanezis, say Beng Hock died from injuries due to a fall from a great height. Pornthip, who is acting on behalf of the Selangor government, has said there was an 80 percent chance of homicide. According to Vanezis, Beng Hock was conscious when he fell but the British expert declined to say it was suicide.

Beng Hock had been called in as a witness by the MACC in connection with a corruption probe against his boss Ean Yong and several other top DAP leaders. The probe is widely believed to have been part of a conspiracy plotted by Umno to topple the Pakatan Rakyat state government in Selangor.

Malaysia in the Era of Globalization #28

    Chapter 4: Modern Model States

    Dont Cry For Argentina (Contd)

Argentineans today must be wondering where they had gone wrong. How could they mess up such a wonderful country? With such promising attributes and rich resources, it would take a real effort to screw things up. The Argentineans did not accidentally stumble their way down; they must have deliberately taken that path of self-destruction.

I deliberately choose this Latin American country as a negative example, of how not to proceed; or how to mess things up royally. To see how far Argentina had fallen, a cursory review o f its history would suffice.

In the early 20th century Argentina enjoyed a standard of living much higher than that of Western Europe. Capital and labor poured in to tap the countrys wealth. United States too had a massive influx of European immigrants at that time. Unlike America however, Argentina did not have a dominant culture into which the immigrants wished to assimilate. Thus the Italians in Argentina pretty well maintained their own culture and value system, as did the Spaniards and other Europeans.

In contrast, America had the dominant Anglo-Saxon culture and ethos; all new immigrants were eager to join this cultural mainstream. They readily adopted Anglican ways, including changing their names to make them sound more English. They forced themselves and their children to learn English and to forget the old ways.

Today, America is a much more integrated society. Not so with Argentina. Argentina was spared the devastations of the two world wars. Thanks to its abundant food supply, it was also spared much of the horrors of the Great Depression. One would expect that with such a head start, it would have overtaken the world by now. Alas such is not the case.

Argentina may have been spared the devastation of wars but her series of military dictatorships created just as much destruction, if not more. At leas! t in a w ar there would be an end point when one side is exhausted or defeated, and the process of healing and rebuilding could begin.

The militarys intervention in the affairs of state began in 1930 with the overthrow of the civilian government. The military up to that time had prided itself on its professionalism and autonomy, or more accurately, lack of political ambitions. Promotions and recruitment were done entirely by the officers themselves, with no favoritism or manipulation from politicians. Merit became the operative criterion and as a result, the military attracted the best and brightest.

These professional and highly disciplined officers looked disdainfully at the incompetence of the politicians and decided to act. One can certainly sympathize with that sentiment! The politicians were indeed helpless to solve the deepening polarization, especially between workers and members of the oligarchy.

Although that early military rule lasted only for two years and the subsequent election held on time, that was only a procedural change. The generals merely changed into civilian suits, stuffed the ballot boxes, and were duly elected. This trick of course has been copied umpteen times by military officers all over the Third World. Argentina however, must surely hold the record. Between 1930 and 1983, the country had been through 26 successful military coups, and hundreds of unsuccessful ones!

The generals may have thought they had the solutions but in reality they merely succeeded in substituting themselves for the landowners and capitalists as the enemy of the working class. But one of these officers, one Colonel Juan Peron, did develop a populist streak. Peron used his position as Secretary of Labor, a minor position in the political hierarchy, to cultivate a following among the workers. Having suitably anointed himself as a hero of the working class with the help of an actress later to become his wife, Eva, he easily won the 1946 election.

Peron, enamored ! with the labor movement and ways of the left, proceeded to pursue socialistic policies. Apart from the obligatory Five Year Plans, he nationalized major sectors of the economy. Initially he did succeed in shifting wealth to the workers. His plans appeared to work, with workers now getting a fair shake in the economy. The GDP expanded at a steady clip and emboldened, the state became even more involved in the economy. Costly and inefficient industries were thus created, not so much to produce goods and services, rather to alleviate unemployment. In the end they became nothing more than subsidized public works programs.

Agriculture, the backbone of the nation, was heavily taxed and ignored to subsidize urban industries. Farm products were priced ridiculously low to appease urban consumers. The end results were, despite vast fertile grasslands, a substantial decline in agricultural and meat production. To aggravate matters, Argentineans continued to live beyond their means, encouraged and subsidized by the state. The government too, was equally profligate.

Buoyed by his populist success, Peron even took on the Catholic Church. In the end his populist appeasement came back to haunt him. You cannot please all the people all the time; eventually someone has to pay the bill. When that time came, Peron could not find ready volunteers. Perons rule ended, not surprisingly, with a military coup in 1955. Alas, the subsequent military leaders proved equally inept.

In 1982 the military took the country to a disastrous war with Britain over the Falklands. Humiliated, the generals ceded power, and 1983 saw the election of Raul Alfonsin. But uncontrolled inflation and declining production continued. Argentineans and their governments still lived beyond their means and borrowed heavily. There was no social consensus over budget cuts and other austerity measures. Hyperinflation set in with rates in the range of 400% per month. By the time he was succeeded in 1989 by the colorful and flamb! oyant Ca rlos Menem, Argentinas foreign debt was a staggering US $69 billion. (By 2002, it doubled to over US$140B.)

Menem immediately normalized relations with Britain and put the war behind. He committed himself and the nation to free enterprise by opening its markets and privatizing state industries. Tariffs, which hitherto covered over 90% of imports, were drastically dismantled.

The seminal restructuring event was the sale of its massive state telephone company, and Menem used the hard currency thus earned to pare down the debt. Most significantly, Menem made a radical move by fixing the pesos to the dollar, the convertibility plan. In so doing he not only tamed Argentinas hyperinflation but also facilitated trade with America, the worlds largest and most lucrative market. Argentina, which until then had experienced capital flight, began to get foreign investments again, including money its citizens had stashed abroad.

To give the proper credit, many of the economic initiatives of Menem were in reality the brainchild of his Economic Minister, the Harvard PhD Domingo Cavillo. He rightly targeted that the root of the Argentineans hyperinflation was not monetary (too much money chasing too few goods), rather the fiscal indiscipline of its political leaders. Cavillo knew that hyperinflation, in contrast to the garden-variety inflation, was more than a mere economic phenomenon; it represented the peoples utter and total lack of confidence in the government. Curing it meant going beyond taking simple economic measures.

Thus he dramatically curtailed the grandiose illusions and pretensions of the countrys leaders instead of just clamping on the money supply (the traditional remedy). Unbelievably, it worked! For Cavillo to rein in those wily Latin politicians must take some doing!

Menems first term was indeed a remarkable turnaround for Argentina. Constrained by law to succeed himself, he, like South Koreas Park, pushed through constitutional amendments to enable! him to run for a second term, which he won handily. In his second term he reverted to the stereotype Latin leader. It was marred by administrative sclerosis, increasing corruption, and high-profile financial scandals. Precluded by law from running for the third time, he was succeeded in 1999 by a man who was his exact opposite, Fernando de la Rua.

Among Ruas first moves was to sell the luxurious presidential jet, a Boeing 757, which had cost a fortune to maintain and operate. That luxurious jet epitomized the profligate ways of the government and its leaders. Cavillo was successful, but not completely!

Under the standard one rule fits all IMF tutelage, Rua increased taxes and cut social spending, which prompted a series of citizens protests and labor unrests. At the time of my writing, Argentina is again threatening to default on its massive foreign debt, a move that would send ugly repercussions worldwide. It is to be noted that a significant portion of that debt was not for investments but routine operating expenses, including the servicing of earlier loans.

Under Menems first term Argentina was the poster child of free market advocates. His reforms won plaudits, in particular from Washington, DC. But by the end of his second term, with the strengthening of the US dollar, Argentinas competitiveness vis a vis its neighbors declined considerably, hurting its exports. Convertibility, which was an economic lifesaver a decade earlier, is now a significant drag, with Brazil and other neighboring countries gaining significant competitive advantage with their devalued currencies. While only a few years earlier Argentina was talking bravely about dollarizing its economy, by 2001 Argentina was hedging its bets. But by January 2002 the dollar link was severed and the peso devalued. That was more than just a monetary decision; it shattered what little credibility the government had with its people and the financial markets.

With the economic crisis came widespread social d! isconten t and political upheaval. In early 2002, within the space of a few weeks Argentina changed presidents no less than five times. The publics faith in the government waned with widespread graft and breach of faith. Transparency Internationals Corruption Perception Index for example ranked the country at 52nd (highly corrupt). At the dawn of the 21st Century, Argentina is a far different country than it was a century earlier.
