Legal Immunity: No One is Above or Below the Law (Apologies to Richard M. Nixon)

For years, I had to endure the ignorant insistence by Malaysians who argue that whoever is conferred a Tunship by the Agong, would enjoy legal immunity.

He is not above the Law

This gave rise to rumors that Mahathir Mohamad was in haste to secure this title in order to protect himself from legal actions over all the misdeeds committed during his premiership. Others maintained that once Samy Vellu was made a Tun, he too would be beyond the long arm of the law.

Not true. According to the Supreme Rulers website, while Tunship does accord the recipient with the privilege to use the VIP room at the KL International Airport, it says practically nothing about legal immunity.

Following the constitutional amendment in 1993 and we dont have to thank Mahathir for that it is now possible to bring proceedings against even the Agong or Sultan through special provisions and in the Special Court. Thus granting a Tun legal immunity would only imply that the recipient is above the royal rulers.

Many were still not convinced. But with the prosecution of Ling Liong Sik over the Port Klang Free Zone scandal, the myth is finally shattered. The next question: is Najib Abdul Razak trying to prove to the public that his government is now serious about fighting corruption root and branch?

If anything, the recent appearance of Ling in court in Putrajaya to face charges of cheating the government by misleading the cabinet on the land acquisition in Port Klang only reminds me of February 2004. In that month, Kasitah Gaddam became the first cabinet minister to be charged in court with corrupt practices and cheating.

Kasitahs arraignment came just two! days af ter Eric Chia, the former managing director of the now discredited Perwaja Steel Sdn Bhd, was brought to court over criminal breach of trust involving more than RM76 million.

These two high-profile prosecutions were giving the public high hopes that Abdullah Ahmad Badawi would eventually have a clean break with Mahathirs corrupt rule and that more big fish would be nabbed.

One month later, Abdullah went to the country, with the mainstream Chinese media portraying him as Mr Clean and a modern version of Justice Pao. He was rewarded with a huge victory that only made Mahathir quietly angry and jealous.

Uphill Battle

The rest is history. Not only that the much hyped-up anti-graft war under Abdullah ended as a flop with no more big guns under arrest, both Kasitah and Chia were also subsequently acquitted. Before he stepped down as prime minister, Abdullah could only lament that rooting out corruption was an uphill battle.

Of course it was. To eliminate Malaysias endemic culture of patronage, Abdullah ought to have explained in full how his son Kamaluddin had secured the position of a leading shareholder of Scomi Group, whose share price shot up by nearly 600 percent just a few months before Abdullah was scheduled to take over from Mahathir as prime minister.

Abdullahs mentor-turned-nemesis, Mahathir, would in the following years go around the country alleging that Scomi had bagged RM1 billion worth of government contracts since 2004, turning Kamaluddin into an overnight multi-millionaire.

Mr. Clean Inc

We must also not forget that Khairy Jamaluddins meteoric rise to become the nations most powerful young man took place during Abdullahs tenure! . By 200 6, Khairy the son-in-law too had made a fortune with the merger between ECM Libra Capital Bhd and the government-linked Avenue Capital Resources Bhd. And I do wonder if Kamaluddin and Khairy were both given discounts on their posh houses.

Father in high places

Strange, isnt it? It would seem that most of the brightest and the shrewdest in Malaysias business circle happen to have a father in high places. Mahathir reiterated time and again that his sons were successful businessmen in their own right, while Ling argued that Ling Hee Leong became a multi-billionaire by the age of 30 because his son was diligent and clever.

And I laughed my head off when Abdullah repeatedly said that both Kamaluddin and Khairy had never used his name for business purposes. The election results in 2008 proved that it was a defence in futility.

With history in mind, one can be forgiven for thinking that Lings sudden fall from grace is merely part of a sandiwara (drama) by Najib to shore up his support ahead of the 13th general election.

As Winston Churchill once famously said, in time of war, when truth is so precious, she must be attended to by a bodyguard of lies. I suppose Najib is now badly in need of a better bodyguard.

Why? Because having been fooled by Abdullah in 2004, people were so furious that they punished him with the so-called political tsunami four years later. Far smarter than his immediate predecessor, Najib would not be so nave to think he could regain two-thirds majority in Parliament simply by putting Ling in the dock, would he? He knows he has to do much better than that. Or perhaps Lings case is just a warning shot.

Back in 2003, an Austrian businessman by the name of Franz Christoph Heldwein came to Malaysia in an attempt to recover the losses incurred from business deals between him and Ling. What raised eyebrows was that a meeting was arranged by Soh Chee Wen, then Lings close associate who is now one of Anwar Ibrahims wise men, at! the Tra nsport Ministry. It was a sheer abuse of power and Ling escaped unscathed.

If Ling was unblemished then, why now?

Elegant silence

Two weeks ago, PJ Utara MP Tony Pua revealed that Muhyiddin Yassin, when agriculture minister, signed an endorsement letter for a government tuna port venture worth RM240 million in 2006. The bonds later defaulted, resulting in possible multiple lawsuits.

While Muhyiddin continues to maintain his elegant silence, all is not well between him and Najib, judging from recent developments in UMNO.

It is widely speculated that the politically insatiable deputy prime minister, who so brilliantly engineered the downfall of Abdullah in partnership with Mahathir, is now teamed up with the latter and also the hawks in the party such as Ibrahim Ali and Ahmad Ismail to ensure Najib becomes the shortest-lived prime minister.

So is Lings prosecution meant to be a stern warning by Najib to fidgety challengers in his own backyard?

In the cruel world of UMNO infighting, Ling is no sacrificial lamb but has been a vital partner in crime. No longer needed, he is now expendable, to the detriment of Chua Soi Lek , a faithful protg of Ling once caught in video with his pants down.

That the MCA leadership had been kept in the dark over the major move by the AGs Chambers yesterday only indicates that BN parties have lost their relevance, and it may not be too long before the subtle tussle between the rival camps in UMNO becomes visible to all.

But I am certain the public will not be satisfied with the netting of a rotten fish head; Malaysians want to see really big fish hauled up, and the more the merrier.

A swallow does not a summer make. Lets just sit back and watch as the sandiwara unfolds. Sorry Tun Ling, you aint worth my tears.

Khalid Samad: Support letters OK, but...

SHAH ALAM: A prominent Selangor-based opposition leader today voiced his qualified approval of support letters, saying they did little harm if the beneficiaries deserved them.

Khalid Samad, a member of the PAS central political bureau and MP for Shah Alam, said he too had issued such letters.

A lot of my constituents come to me for support letters, especially to help them claim zakat benefits and other welfare aid, he told reporters at his office today. Of course I cannot just turn them away.

In recent days, several DAP figures in Selangor have come under fire over the issuance of letters supporting bids for business contracts. The main casualty has been Klang municipal councillor Tee Boon Hock, whom the party sacked on Aug 1. Many are demanding a similar action against state executive councillor Ronnie Liu.

Khalid said that when he issued a support letter, he would normally ask the relevant body to consider the letter bearers application, but only if he already met the required criteria.

The most important point is the support letter should not overrule the basic requirements, he said.

In the previous (Selangor) administration, it was not like that. As long as the person was supported by an assemblyman or an MP, the organisation would just accept it without considering the qualifications.

He said this was part of a culture inherited from Barisan Nasional and it would take time to do away with it.

Bumiputera discount

Referring to Petaling Jaya Utara MP Tony Pua's suggestion that bumiputera discounts for luxury homes in Selangor be abolished, he said he agreed with him in principle.

! I sugge st we remove the seven percent discount for houses costing more than RM500,000, he said. The saved amount can then be channelled to needy bumiputeras.

On another matter, he said he was seeking an appointment with Home Minister Hishammuddin Hussein to ask him to explain why the police had not apologised for implying that police shooting victim Aminulrasyid Hamzah was a criminal.

He expressed disappointment that the culprits had not been charged.

When the shooting was big news, many leaders including (Selangor Umno leader) Noh Omar visited his mother. However all have disappeared now.

KUALA LUMPUR, Aug 5 Umno and the Communist Party of China (CPC) yesterday agreed to have youth leadership exchanges so that the youth leaders of both countries can have a better understanding of the economic and social development taking place in Malaysia and China.

Umno secretary-general Datuk Seri Tengku Adnan Tengku Mansor, who signed a memorandum of understanding (MOU) on behalf of Umno on co-operation between Umno and the CPC in Beijing yesterday, said this was all the more timely as China was now a major economic power.

Wang Jiarui, Head of the International Liaison Department of the CPC Central Committee, represented the CPC.

On their part, they are amazed with our achievements and racial harmony and would like to learn from us how we were able to attain this harmony without any bloodshed, Tengku Adnan said in a statement to Bernama.

He said as a follow-up to the MOU, both countries agreed to set up a permanent mechanism to enable the exchanges to take place beginning this year. Bernama

Judge rejects application to call Saiful, Farah to testify........

As expected, the High Court has rejected an application by Opposition Leader Anwar Ibrahim to call sodomy complainant Saiful Bukhari Alan and his alleged lover DPP Farah Azlina Latiff to take the stand and clarify their relationship, which could trigger a mistrial .

"Never before in the history of the country or in the Commonwealth has a DPP had an affair with the star witness," lead counsel Karpal Singh had told the court when it resumed on Monday to hear the striking-out application made by the defense.

Anwar had applied for the case to be struck out. There is concern that Saifuls closeness with Farah enabled him to get special information and tips on how to conduct his testimony so that he could triumph over Anwar. The defense also believes that Saifuls credibility as a witness has been irreparably damaged by the affair. They say this is not the first time that Saiful has lied to the public and the latest scrape rendered him an unreliable and flawed witness.

Nonetheless, Judge Mohd Zabidn Mohd Diah, who has a record of making decisions that favour the government, dismissed the defense's application. According to him, the evidence produced by the defense was insufficient and based on a sworn affidavit.

"Hence, it is not necessary to call DPP Farah and Saiful," ruled the Judge.

The prosecution had also fiercely fought off Karpal's attempts to haul the pair to the witness stand. It insisted that Farah did not have access to any confidential information such as the Investigation Papers as they were held by the Investigating Officer. Only 4 people had copies of the papers and these were Solicitor-General II Mohd Yusof Zainal Abiden, Hanafiah and DPPs Nordin Hassan and Noorin Badaruddin.

"The question at hand is whether Saiful had used Farah to get information," Sol! icitor-G eneral II Mohd Yusof had told the court. Anwar has also lodged police complaints against Saiful and Farah for allegedly breaching Section 8(1) and Section 8(2) of the Official Secrets Act 1972. The prosecution's Investigation Papers are deemed to be official secrets.

Did Farah coach Saiful

While the prosecution has denied they knew about the relationship, they have painstakingly avoided denying the existence of the affair.

"This is what worries us. Farah did not tell her bosses about the affair. She hid it from them and we are concerned that if she can sacrifice professional ethics just like that, she may have gone a step further to coach Saiful in the trial so that he can win," Anwar's lawyer Sivarasa Rasiah told Malaysia Chronicle. "It is also telling that the prosecution did not defend her integrity which they would surely have done if the affair was untrue. But they only said she was a junior staff and dropped her from the case."

Anwar, the 62-year-old PKR adviser, was accused of sodomizing Saiful at Unit 11-5-1 of the Desa Damansara Condominium in Jalan Setiakasih, Bukit Damansara, Kuala Lumpur, between 3.01pm and 4.30pm on June 26, 2008. He has denied the charges and accused Prime Minister Najib Razak and his wife Rosmah Mansor of collaborating with Saiful to frame him and derail his political comeback.

PAS leaders lambasted Umno for giving Islam a bad image, urging all Malaysians not to be confused by the BN shadow play and leave the ruling coalition before it destroys the country with its corruption, scare-mongering tactics, racial and religious politicking.

“This is what has been haunting our nation for decades since we achieved independence. Umno has been making use of the special position of the Malays as a weapon to cling to power and to rob the wealth of the nation under the guise of special rights for the Malays and Bumiputera,” PAS president Hadi Awang said in a statement.

Chua confused because of Umno

The Islamist party was dragged into the fray following comments by MCA president Chua Soi Lek last week that it was competition between Umno and PAS for the Malay vote that had undermined the economic potential of the country.

Chua went on to say that most Muslim nations tended to be backward, pointing at Somalia and Ethiopia as examples. He also took a swipe at PAS while praising the BN for its "moderate and pragmatic" policies. “Do not be too optimistic that once PAS rules the government, the country will be free from corruption and other problems. Bear in mind, some of the most corrupted countries are Muslim-majority countries,” said Chua.

The BN leader was immediately chastised by Penang Chief Minister Lim Guan Eng and Opposition Leader Anwar Ibrahim. He was even publicly called a "sex video actor" by Perkasa chief Ibrahim Ali for insulting Islam.

However, PAS deputy president Nasharuddin Mat Isa said it was Umno who should be blamed for Chua’s confusion. He took the Malay nationalist party to task for giving a false impression of Islam to the non-Mulsims because of the way it conducted itself and the country.

“The concerns that Chua raised are erroneous. The mismanagement in Malaysia has got nothing to do with Islam. It has got to do with Umno leaders who have been abusing their power and placing priority on chasing for corrupt deals. They have utterly failed to implement Islamic principles in the way they administer the country,” said Nasharuddin.

Even the Malays are being victimized

The PAS leaders also reiterated their commitment to forge a new policy where the rights of the minorities in the country would be defended and not allowed to be used to gain political mileage whenever it was expedient to do so.

They warned that even the Malays were not safe from Umno’s abuse of political power, pointing to Kelantan and Terengganu, where 95 percent of the populations were Muslim-Malays, but still ended up being victimized and deliberately kept poor and backward.

“Yet Umno has dared to confiscate the oil royalties belonging to the people in these two states,” said Hadi.

“To all Malays in the country who are still with Umno, now is the time to make the vital decision for the future of our children and the generations to come. Join PAS to effect change that is fair, that is in accordance with Islam for all.

“To all Malaysians, leave Umno-BN now and join us at PAS and Pakatan to effect together a transformation. Let us leave behind the politics of fear and work together to revamp our judiciary, install freedom of the media, a fair elections system, safety and security for the nation, restore justice and peace to Malaysia."

MCA is having a hard on with DAP

MCA finds cheap thrill in DAP woes

COMMENT DAP’s current troubles in Selangor must be as thrilling to MCA as a sex video is to a porn addict. Its publicity machine is probably working overtime to extract every dirty detail, real or imagined, from the feuding in DAP.

MCA does need some political breakthroughs to regain the ground it has been losing since the 2008 election debacle. Since its recent brainstorming retreat, its publicity bureau has been closely monitoring the ground for bad news in rival parties, like vultures circling in the sky sniffing for blood.

And was the smell strong when the blame game in Selangor DAP broke into the open! MCA’s publicity people wet ecstatic, churning out and disseminating widely all the anti-Pakatan propaganda they could spin, hoping to regain the party’s tarnished image.

Loh Seng Kok, the vice chairman of the MCA publicity bureau, accused DAP of hypocrisy in its handling of the feud between Ronnie Liu and Tee Boon Hock. It said the issue exposed DAP as a party that held double standards.

Liu and Tee, both state executive councillors, are embroiled in a quarrel over letters of support given to companies seeking business contracts.

Tee has since been sacked from DAP but can continue as municipal councillor for Klang. He is reputed to have strong grassroots support and was once Liu’s special assistant.

Liu will face the DAP disciplinary board on Aug 12. The board has also summoned Selangor assembly speaker Teng Chang Khim for twittering an objectionable remark about the squabbling.

In his eagerness to strike while the iron is hot, it does not seem to matter to Loh that he has not quite grasped the true meaning of DAP’s internal politicking on the issue.

“The action taken by DAP’s disciplinary board to sack Tee Boon Hock without trial went against the party’s principle to abolish the Internal Security Act,” said Loh, as spokesman for MCA.

Attacking DAP for dragging Teng to the disciplinary board over a Twitter message, he said: “DAP has made it to the record books in prosecuting its member for utilising technology like Twitter, a weapon well used by the party to spread its propaganda.

“The public has the right to know the truth and Teng has only done the right thing by voicing out” his disappointment that Tee, not Liu, had been sacked.

Teng’s twit was “OMG! Real culprit is freed.”

Facts are sacred


We cannot blame Loh for playing his role as deputy publicity chief, a post he deserves for his loyalty to his new political master, Dr Chua Soi Lek. However, he should not forget that although comments are free, facts are sacred.

Comparing a political party’s disciplinary action to the torture of ISA detainees is more than a bit too much. It is ludicrous.

Loh chose not to mention DAP’s internal inquiry and fact-finding efforts before the sacking.

The happenings in Selangor DAP are nothing compared to the kind of political sclerosis afflicting MCA, a party that breeds suspicion and distrust and goes through one crisis after another.

MCA’s former president, Dr Ling Liong Sik, was fond of quoting the proverb about fish starting to rot from the head. MCA’s history of leadership crises proves him right.

MCA has a distinguished history of abandoning democratic principles. It supported the passing of the ISA and continues to support its implementation. Opposition parties vehemently spoke against the legislation and continue to condemn it.

Both DAP strongmen Lim Kit Siang and Lim Guan Eng have suffered under the ISA for their political principles, for giving voice to their conscience.

Speaking of democratic principles, Loh must remember that in 2001, MCA suspended its youth wing over the infamous chair-throwing incident despite the fact that the youth leaders were democratically elected.

There were allegations that the fiasco was pre-planned. It included a bomb hoax, a fistfight and chair throwing. Ong Tee Keat, who was youth chief at that time, was supposedly found responsible for the fracas.

Despite the lodging of a police report, the truth has never surfaced. So, what type of transparency, accountability and responsibility is Loh talking about?


Pundits and party insiders speculate that the current problems are the result of a keen power struggle between supporters of Ronnie Liu and Ean Yong Hian Wah, successor to former Selangor DAP chairman Ong Chee Keong, who was ousted in 2007 for indiscipline.

Has the MCA practised what it is now preaching?

MCA members and the public have the right to know the truth about the 2001 incident.

It is doubtful that MCA can convince the public that its criticism of its archrival is sincere and came out of its commitment to principles.

Blossoming into a nightmare

The attacks merely remind the public that the party and its partners in Barisan Nasional have yet to show that they can practise what they preach.

MCA may be hoping that memories are short, but voters in Selangor remember the track records of previous menteri besar Muhammad Muhammad Taib and Dr Mohd Khir Toyo. One was caught trying to leave Australia without declaring millions of ringgit in cash, and the other is the target of suspicion for massive corruption.

A former prime minister in 1995 characterised DAP’s Kit Siang as “an absolute failure” as an opposition leader. It was in April that year that the opposition parties suffered heavy electoral losses.

DAP has struggled hard since then and you cannot easily question its credibility these days, although it still has some work to do to improve its delivery system to the citizens of states in which it is part of the ruling coalition. Supporters expect it not to gamble away the opportunities it has been given.

As for MCA, the passenger on the BN bus driven by Umno, there is scant ground for optimism regarding its future.

Nevertheless, there are pundits who do not discount the possibility of MCA rising from the ashes of defeat in Selangor. This could well happen if DAP continues to create its own crises.

Pundits and party insiders speculate that the current problems are the result of a keen power struggle between supporters of Ronnie Liu and Ean Yong Hian Wah, successor to former Selangor DAP chairman Ong Chee Keong, who was ousted in 2007 for indiscipline.

DAP’s impending election in November this year is also cited as the cause of the power struggle.

When self-interested politicians lock horns, there is always a danger of the fire spreading far and wide even though the original problem is localised.

The DAP leadership would be well advised to nip the problem in the bud before it gets the chance to blossom into a nightmare.

"Saham tanah ini tidak boleh diurusniaga melainkan kepada orang Melayu sahaja.
