PI Bala: Razak Baginda is a scapegoat

LONDON, July 7 Private detective P. Balasubramaniam today dropped a bombshell by insisting that his former client Abdul Razak Baginda was not involved in the murder of Mongolian translator Altantuya Shariibuu.

Although Abdul Razak, a close associate of Prime Minister Datuk Seri Najib Razak, was acquitted of the crime, certain quarters, especially those in the opposition, continue to assert that he is culpable.

As far as I am concerned, Razak is a scapegoat. He has got nothing to do with the murder, said the former Special Branch detective of his then client.

Balasubramaniam, who has been living in India since releasing statutory declarations on the murder, reasoned that there was no reason for Abdul Razak, on the night of Oct 19, 2006, to hire him until Oct 26, 2006, if he knew that Shariibuu would be murdered that night.

Yes, he was financing her and he had a relationship with her, but as far as I am concerned, he is innocent. In fact, my testimony in court saved him, he added.

Balasubramaniam had first released a statutory declaration in 2008 that detailed various links to Najib including the three officers who were part of the then deputy prime ministers security detail having picked up Shariibuu on the night of her death two of whom, chief inspector Azilah Hadri and corporal Sirul Azhar Umar were sentenced to death for the crime.

Although, he then released a second declaration the next day removing all links to Najib, he has since gone on record stating that he did so under duress and was offered RM5 million to change his stance by Najibs brother, Datuk Mohamed Nazim Razak.

He has also identified another man who drove past Abdul Razaks house on the night of the murder as Datuk Nasir Safar, an aide of Najibs who has since been sacked after he made derogatory remarks about Malay! sian Chi nese and Indians in a public event.

In a press conference here today, Balasubramaniam and his lawyers expressed disappointment that an interview with the Malaysian Anti-Corruption Commission (MACC) scheduled for the past two days had been cancelled as they were eager to stress the conspiracy web that seemed to centre on Najib.

What we had intended, if MACC had turned up, was for Bala to highlight the series of events in that are a conspiracy web at the highest level to keep out references to Najib, said Manjeet Singh Dhillon.

Why did they miss a golden opportunity? Because it is dangerous to people who hold the reins of power, said Americk Sidhu.

They stressed that they have never stated that Balasubramaniam would not appear in court, so long as the right person was being tried. As such, the reason given by MACC, on the advice of the Attorney-Generals office, that a statement recorded overseas was not useful, was flimsy.

Never in theory nor practice, do you make that decision beforehand. You collect all statements and investigate and then you decide on witnesses, said Manjeet.

Balasubramaniam also confirmed that he would be recording his statement in Paris on Monday to French authorities who are investigating the possibility of unlawful practices with regards to commissions paid alleged to be RM500 million in the purchase of Scorpene submarines by the Malaysian government.

Shariibuus alleged involvement in the deal is as a translator, for which she demanded US$500,000 for her services.

Balasubramaniam also added that even though he has been given up to RM750,000 by Deepak Jaikrishnan, a carpet dealer who is said to be a close associate of Najibs wife, Datin Seri Rosmah Mansor, he has been surviving in India on his own funds.

I am from South India. My father left me and his two daughters property there after he passed away. I am self-sufficient, he said to dispel reports that he has been funded by opposition figures.

University autonomy is essential for the New Malaysian High Income Economy

Universities are now expected to contribute significantly to a high-income economy by producing highly competent graduates and commercialising their research output, writes Universiti Kebangsaan Malaysia s Vice Chancellor SHARIFAH HAPSAH SHAHABUDIN

THE universitys traditional functions of teaching, research, scholarship and innovation are increasingly being expanded to meet the wide-ranging needs of globally connected knowledge-societies.

Under the 10th Malaysia Plan, universities are expected to contribute significantly to a high-income economy by producing highly competent graduates and commercialising their research output.

In presenting the 10MP, Prime Minister Datuk Seri Najib Razak acknowledged the role of academicians in pushing the frontiers of knowledge, discovery and invention to create new value and contribute to economic growth.

More importantly, Najib explicitly linked the ability of universities to respond to societal expectations to the granting of greater autonomy. He signalled a trend away from direct state control towards the indirect steering or regulatory mechanisms, which include financial, quality assurance, performance and information measures.

He also said the government would grant gradual autonomy to universities to improve their performance, clearly underlining the conditions for accountability.

University autonomy is not only crucial to the achievement of the New Economic Model, but also to the achievement of educational excellence, innovation and internationalisation. The best universities, according to recent rankings, are very autonomous.

The European Union Commission in 2006 reaffirmed that universities would not be innovative and responsive to c! hange un less they are given real autonomy. History has shown that intellectual and social stagnation or decadence prevails whenever sovereigns curtail the autonomy of universities.

Autonomy relates to the ability of universities to devise and implement their own strategies without government over-regulation and micro-management. It is the decisive factor in universities being proactive, entrepreneurial and quick to adapt to changing external demands and diverse student profiles, attracting and retaining quality staff, and creating incentives for developing research strategies and portfolios.

Four elements identified in the Lisbon Declaration of the European University Association in 2007 are generally held to be necessary for autonomy. These are the ability of universities to decide on:

- academic and scientific matters;

- financial issues;

- organisational structures and institutional governance; and

- staffing or human resource matters

There is no ideal model of autonomy. The basic principles should operate in the context of the culture and traditions of a national higher education system, the legal framework and the ongoing higher education reforms that support universities on ever more complex missions.

In Malaysia, social factors such as unity and equity should also be considered. While autonomy is a necessary condition for excellence, universities do not attain excellence by the simple expedient of autonomy. Far from it. Autonomy requires the right balance of institutional accountability and commitment from pubic authorities.

The most important principle of institutional autonomy is that the governing authority bears ultimate responsibility for, and has ultimate authority over, all the activities of the institution it governs.

In the University and University Colleges Act (UUCA), two bodies are important university boards of directors (BOD), which are oriented towards management and long-term strategic decisions, and t! heir sen ates, which are responsible for academic matters.

Academic autonomy has begun with the granting of self-accreditation status to the four research universities which have satisfied the stringent performance standards of the Malaysian Qualifications Agency. The senates of these universities enjoy the highest degree of academic autonomy in introducing or terminating degree programmes, defining the structure, content and methods of teaching, conferring degrees, deciding on areas, scope, aims, and methods of research and establishing the extent of control over student admissions.

The Higher Education Ministry has established a task force to develop a code of good governance to enable the BOD to discharge their responsibilities accountably, transparently and ethically.

Good governance aids effectiveness. It does not inhibit enterprise or innovation. It provides the appropriate checks and balances in institutional decision-making and internal control for risk management, which safeguards the collective responsibility of the governing authority.

Within the code are governance arrangements enabling the BOD to define and decide on what governing bodies and academic and administrative structures to establish, the individuals in executive leadership such as the vice-chancellor and deputies, the head of administration and the faculty deans, and the selection method, division of tasks, and disclosures of interest and code of conduct of BOD members and employees.

Effective governance should also enable the BOD to function in a competitive international recruitment environment by being able to control salary levels, negotiate employment contracts and tenure, and devise incentives for attracting high-quality staff.

To attain financial sustainability and multiple income streams, the BOD have to negotiate with the relevant public authority, to put in place accountability requirements and financial reporting procedures that are not excessively burdensome.

These would involve removing procedural and bureaucratic impediments in public funding and procurement; facilitating the accumulation of reserves; keeping surpluses on state funding; and investing, borrowing and raising money from different sources, including business ventures and tuition fees.

Education and research offer a high collective return on investment, in addition to the individual return. Public authorities should ensure appropriate conditions for universities to fulfil their service to society. This requires reshaping attitudes and values, not only among university leaders, administrators and academics but also policymakers in the Higher Education Ministry, Public Service Department and the Finance Ministry.

University autonomy requires reforms in governance not only at institutional level but also among all public authorities involved in higher education.www.nst.com.my

PI Bala: Razak Baginda is innocent

Private investigator P Balasubramaniam now claims that defence analyst Abdul Razak Baginda was innocent in the gruesome murder of Mongolian national Altantuya Shaariibuu.

Balasubramaniam came to this conclusion because he was still employed by Abdul Razak until Oct 26, 2006 to keep Altantuya away from him even.

Altantuya went missing on Oct 19, 2006.

"He has nothing to do with this case... this guy is innocent as far as I'm concerned, Balasubramaniam told a press conference in London today.

Abdul Razak was acquitted of abetting two police personnel - Chief Inspector Azilah Hadri and Corporal Sirul Azhar Umar - in the murder of Altantuya on Oct 31, 2008. The two have been sentenced to death for the crime.

Abdul Razak was formerly the confidante to then deputy premier and defence minister Najib Abdul Razak.

Balasubramaniam's claims today is likely to put to rest swirling rumours that Abdul Razak was freed due to his strong political connections.

Bala to meet French authorities

The press conference today, which began at 11am (7pm Malaysia time), was initially planned as a platform to discuss issues raised by during a scheduled interview of Balasubramaniam by Malaysian Anti-Corruption Commission (MACC).

Although the interview was suddenly cancelled by the MACC, Balasubramaniam and his lawyers pressed on with the conference to state his role before and after Altantuya's disappearance.

Balasubramaniam also revealed that he would be meeting French authorities on July 12, who would be quizzing him on graft claims in Malaysia's procurement of two Scorpene submarines from a France's DCN.

Last month, French authorities began probing DCN over alleged commissions paid in several arms deal, which is illegal under French laws.

China executed on Wednesday former Chief Justice of Chongqing, Wen Qiang.


Wen Qiang was sentenced to death in April this year for protecting gangs, bribery, rape and "property scamming", according to state media, People's Daily.


Chongqing courts have sentenced dozens of people to death or long jail terms over the past several months as part of the crackdown in the sprawling city of more than 30 million.

The campaign was marked by graphic tales of murder and extortion committed by cops-turned-robbers, as citizens besieged government offices waving bloody photos and swords allegedly used by the gangs.

The trials were initially popular with the media and the public, who are fed up with police corruption and crime, but the rush to judgment has concerned some in the Chinese legal community.

Some citizens in Chongqing told Reuters last week that the campaign has gone a little too far, ensnaring small players with excessive punishment.

The deep ties between police and organised crime hark back to China's tumultuous years before the Communist Party won power in 1949, when local warlords and rich businessmen had close connections with the criminal underworld.

As part of a pilot initiative to curb corruption among law-keepers, Chongqing municipality's Party committee will direct all senior judges, prosecutors and police officers to reveal their assets. The Chongqing Municipality has 30 million residents.

The move follows the detention of more than 200 government officials, including judges, prosecutors and police, on charges of accepting bribes from organized gangs to protect them.

According to the local procurator! ate, 19 top departmental officials, such as governors of districts, have been implicated for protecting criminal gangs from January to September this year.

In addition, more than 200 officials from public security bureaus, courts and procuratorates, who failed to crack down on gangs and protected them instead, have been detained since June.

The accused include:
  • former director of Chongqing Justice Bureau, Wen Qiang, 56;

  • former deputy director of the municipal public security bureau, Peng Changjian, 46;

  • deputy chief justice of the Chongqing Higher People's Court, Zhang Tao; and

  • ex-director of the enforcement bureau of the municipal higher people's court, Wu Xiaoqing, 57, who committed suicide in a local detention house last weekend.Wu had allegedly received bribes amounting to 3.5 million yuan ($512,700) and HK$100,000 ($12,900) between 1998 and 2008. He was also unable to explain where he had obtained another 5.18 million yuan, a spokesman for the local government said.
  • Liu Xinyong, former deputy Party Secretary of Chongqing's Fengdu county, and another three local officials were also accused of accepting bribes worth more than 10 million yuan each.

    Chongqing citizens are in favor of the government's initiative to uproot corruption from officialdom, but also skeptical about the solution.

    KD Tunku Abdul Rahman still defective.........


    KD Tunku Abdul Rahman remains at the Teluk Sepanggar naval base in Sabah as problems have again resulted in the submarine being docked. The Malay Mail was informed by defence industry sources that the unspecified problems were detected after the submarine completed its tropical water trials last month. A routine maintenance check later revealed the problems. Since then, the submarine has remained at the naval base unfixed.
    It is learnt although the vessel obtained its Initial Operational Capability (IOC), it may take longer to be declared fully operational.
    However, the arrival of the second Perdana Menteri-class submarine, KD Tun Razak, on July 2, was a godsend for the crew of its sister ship, KD Tunku Abdul Rahman. The crew is expected to take over the second submarine during its mandatory tropical water trial. Sources said this was necessary as the KD Tunku Abdul Rahman crew may lose their submariners rating if they remained on land.
    In February, The Paper That Cares reported that KD Tunku Abdul Rahman suffered a technical defect that prevented it from diving for three months. The submarine started tropical water trials on Feb 20. KD Tunku Abdul Rahman was commissioned early last year after undergoing a two-year trial period in France.
    The Royal Malaysian Navy procured the two submarines for RM3.4 billion in 2002 from French/Spanish shipbuilders, DCNS and Navantia. - Marhalim Abas.

    French authorities confirm will record Bala's statement next week

    In another blow to embattled Prime Minister Najib Razak, French financial police have confirmed they will be recording a statement from private investigator P Balasubramaniam next week. This is in connection with a corruption probe into the sale of two Scorpene submarines to Malaysia in 2002.

    Big-name French politicians, including President Nicolai Sarkozy, may also figure in the investigation alongside the Malaysian leader,
    who had ordered the submarines from DCNS when he was still the defense minister.

    We have final confirmation that the French investigation team will meet Bala next week.We hope that Bala can help the French prosecutors move a step closer to binging the culprits to book," Cynthia Gabriel, director of civil rights group SUARAM.

    SUARAM had earlier this year lodged a complaint with the Parisian authorities after failing to get Najib to initiate an independent inquiry into the case, which is intertwined with a controversial murder. In a sworn legal statement issued in 2008, Bala had implicated the Malaysian PM, his wife Rosmah and their friend Razak Baginda in both the murder and corruption cases.

    In the eye of the storm
    Indeed, Bala is now very much the man in the eye of the storm. He is due to hold a press conference in London later today, where he has promised to clarify details he divulged two years ago.

    Bala had listed out what he knew about Mongolian translator Altantuya Shaariibuu, who had helped his boss Razak Baginda close Najib's RM6.7 billion submarines order. Bala was hired by Baginda to stop Altantuya from blackmailing him for her US$500,000 share of a RM570 million kickback allegedly paid by DCNS.

    However, according to French newspaper La Liberation, a jealous Rosmah refused to pay her a cent. Her body was later found in a jungle clearing in Mala! ysia. Fo rensics show she was shot in the head before military-grade explosives were strapped to her body and exploded to prevent identification. The hauntingly beautiful Altantuya had pleaded for her life, begging her killers to spare her because she was pregnant.

    Two former bodyguards of Najib's and Rosmahs have since been sentenced to hang for her murder, but her family and most Malaysians are not appeased by the court's verdict. They believe the two bodyguards were just order-takers and the real puppet-masters have yet to be apprehended.

    Anti-corruption clause
    Nevertheless, the French probe is expected to focus on the corruption in the submarines deal rather than the murder. The Malaysian Anti-Corruption Commission was also due to record a statement from Bala in London this week but at the last minute aborted the plan, prompting widespread criticism.

    "This is now the hottest topic in the French media. They are shocked by the brutality of the Altanutya murder and intrigued by the personalities involved. They are also bewildered that our MACC would want to withdraw from the London meeting with Bala. It is a complete contrast to the professionalism shown so far by their authorities," Batu MP Tian Chua told Malaysia Chronicle.

    "In the Altantuya murder, what is involved is justice for a life ruthlessly taken. In the submarines case, we are talking about money belonging to Malaysian taxpayers. As such, there is no justification for the MACC not to insist on trying to recover as much money as possible for the rakyat."

    It is believed that the contracts inked by the Malaysian defense ministry and DCNS contain anti-corruption clauses that prohibit payment of any form of kickbacks. If corruption is proven, DCNS may be liable to repay the relevant amount to Malaysian taxpayers.

Jadi usahlah kita kata Petra itu tidak boleh dipercayai, atau boleh percaya tetapi 40% sahaja. Sanggupkah Kerajaan mengadakan Siasatan Terbuka untuk menentukan betul atau salah Petra dan Bala ini? Dan sanggupkah Kerajaan memberi jaminan keselamatan ke atas mereka supaya mereka dapat pulang? Inilah yang sepatutnya menjadi persoalan dan perbincangan. Bukan mengapa saya jumpa Petra dan mengapa saya makan ais kacang dengan beliau.

    Lagipun PM Najib kena ingat, pilihan raya akan datang akan berkisar kepada soalan mengenaiwatak dan sifat pemimpin yang macam mana yang rakyat perlukan. Cara PM Najib cuba menutup Bala dan Petra tidak akan menguntungkan dia. Rakyat mahu pembangunan, itu betul. Rakyat mahu kemudahan asas, betul. Tetapi Rakyat juga mahu pemimpin yang tidak terlibat dengan kekejaman, yang tidak memperlihatkan ciri menyalahgunakan kuasa, danyang tidak mentadbir negara ala gestapo. Rakyat mahu Kerajaan dan pemimpin yang telus dan sederhana, dan yang tidak menakutkan mereka. Menteri Hishamuddin, cukuplah bermain wayang. Janganlah pula hendak menyalahkan Kerajaan Britain mengatakan ia tidak mahu bekerjasama. Di England ni, tangkapan hanya boleh dibuat kalau orang itu buat salah, bukan macam Malaysia. Kalau Britain tidak mahu extradite seperti yang Menteri kata, itu ertinya Raja Petra tidak melakukan apa-apa kesalahan. Janganlah pula kata Britain tidak memberi kerjasama.

    Justice Must Also Be Seen To Be Done

    My writing on what happened in the Trial of Rosli Dahlan has apparently awoken Malaysians to draw similarities to their own plights. I received a request from this Malaysian, Abdul Jabbar bin Mohammad, who insisted that he too has been victimised by the justice system of this country.

    I do not know the facts of Abdul Jabbars matter other than what he has written to me. I do not know if he is in the right or if he is in the wrong. I do not know if, in fact, the actions against him is due to his own wrongdoings. What I do know and believe in is that the dispensation of justice must be fair. For that, people must believe that justice has been delivered when they seek it. Otherwise, this saying would be devoid of meaning- Justice must not only be done, but Jutsice must also be seen to be done.

    As such I am reproducing in verbatim what Abdul Jabbar Mohamad wrote to me as follows:

    Assamualaikum En. Din Merican,

    In brief. I read your recent article with interest.

    Earlier I am not politically motivated but just an ordinary citizen who like Anwar Ibrahim and Rosli Dahlan has been charged by the government on a false charge. My mistake was I believed in the government system for justice. It is for abused of power with indirect interest under Section 15A by BPR. Our cases are not only similar, there is a trend.

    I was previously a Senior Officer in Petronas of 19 years and was identified to be a black sheep to hike prices for the purchase of Petrol Station Land during 2000. After 6 months! I make a U turn and report to my management and in August 2001 I was sacked.

    I now alleged the prices was hiked to be dispersed for very important VIP and interested individuals. I was informed by a Petronas dealer not to worry as BPR is on our side. I presumed they are from political parties.

    My grievances on police efficiency to Malaysiankini and Media Keadilan was met with a RM 1 (One) million defamation suit from Petronas in 2005 which never kicked off until today. Petronas has a court injunction against me.

    On 4/6/2006 I was arrested by BPR, however my 6 complaints to BPR was not investigated. The outcome of my last police report is still pending where Petronas individuals have deceived 4 police investigations.

    My industrial case is very funny where justice did not prevail. The judges were changed in the 11th hour. In the Industrial Court my subpoenas including my witnesses and documents was strike off by the new judge after being issued by the previous judge. My appeal in the Court was rejected by a new judge change in the 11th hour. My civil suit against Petronas was strike off because of the BPR case.

    Clearly the BPR case was used to tarnish my name in the industrial and civil courts. I can prove in Court that the actual criminals are the BPR I.O. and mala fide witnesses who are mostly from UMNO and Eonbank. BPR documents submitted have been change and tampered to build a case against me. I was threatened by the BPR PP in front of my solicitor and the Court administrator that if I proceed with the case I will be arrested. She said I should instruct my lawyer to submit an affidavit to throw out the case. I am very sad with the threat as I want the trial to proceed in order to clear my name.

    There are now 3 police reports made by me on perjury by 2 of their mala fide witnesses. I am now waiting for the BPR I.O. & Eonbank staffs to b! e in the witness stand.

    In this case my only mistake was giving friendly loans and other assistance to a bogus company under a Vendor Development Programme and trying to prevent a white collar from UMNO individuals. My BPR case will commence on 7-9/7/2010 on Wednesday in Criminal Session Court 7. My third lawyer cannot attend this time as he has to attend a High Court trial which was fixed much later then my trial. If on worse scenario I will present myself. It is so frustrating with the country system.

    Tomorrow (yesterday) I will be at Jalan Duta to distribute public documents for the alternative medias as my only hope to expose these irregularities. I have waited patiently since 2001 and have digested and dwell into the issues.

    I did not surface due to the court injunction and now have enough public documents to implicate that BPR can be used as a tools by invincible hands including the former BPR Ketua Pengarah (Zulkifli) who has 3 petrol stations and Timbalan Pengarah BPR Selangor who has one petrol station. Article from Salahudin Ayub and Gobind Deo in Harakah. So there is a lot truth from the Petronas dealer stated above.

    Zaid says RPK, Bala free due to Najib's fear

    KUALA LUMPUR, July 5 - Pakatan Rakyat (PR) secretariat chief Datuk Zaid
    Ibrahim today said the police are not interested in arresting fugitive
    blogger Raja Petra Kamarudin and private investigator P. Balasubramaniam
    because the prime minister is afraid of the duo.

    Both Raja Petra and Bala have linked the prime minister to the murder of
    Mongolian translator Altantuya Shaariibuu in late 2006. Najib has denied the
    allegation.

    "It's been 12 months since the prime minister gave his vote of confidence to
    the police force; however, we see no action from them," the former Umno
    minister said in a posting on his blog.

    He also agreed with Umno Youth leader Khairy Jamaluddin who has taunted the
    police force for not doing their best in arresting RPK who, he said, "is
    blatantly walking the streets of London unharassed".

    "Bala is leaving for Paris next week to meet French investigators. Why is
    our police team hesitating in meeting him?" Zaid asked.

    Zaid also alleged that the police have met Bala in Bangkok but are keeping
    mum about the meeting.

    The PKR supreme council member was responding to Home Minister Datuk Seri
    Hishammuddin Hussein, who had asked him to explain his relationship with
    Raja Petra, who is popularly known by the acronym RPK. Zaid had watched a
    football match with RPK last year which pro-Umno supporters say is proof
    that PKR is funding the fugitive writer.

    Raja Petra left the country and failed to attend court twice last year on
    sedition charges related to the prime minister's wife in the news portal
    Malaysia Today.

    Zaid said the people want to know the truth on why RPK and Bala have not
    been investigated and urged the government to conduct a proper investigation
    and expose RPK's and Bala's wrongdoings.

    "Guarantee them of their safety and I believe they will return to Malaysia
    to defend their statements," said Zaid, adding that the government must also
    ensure that RPK and Bala are not arrested under ISA upon their return.

    He added it was only right to punish the duo if they had really humiliated
    the country's leader by spinning lies.

    "A reformist leader will not use the police force and the media to defame an
    individual," he said.

    Kejadian Kg Memali: ‘Tidak kami sangka polis sanggup membunuh’ (1)

    Peristiwa Memali berlaku pada 19 November 1985 masih tersemat di dalam fikiran kebanyakan orang terutama masyarakat Baling dan lebih-lebih lagi ahli keluarga 14 orang yang korban.

    Menurut Kementerian Dalam Negeri melalui jawapan Dewan Negara pada April 26, 2010, spekulasi yang mendakwa Musa Hitam (tatkala itu timbalan perdana menteri) memberi arahan untuk menembak penduduk kampung semasa peristiwa berdarah Memali pada tahun 1985 adalah tidak benar.

    Menurut keterangan kementerian, pihak polis telah menjalankan operasi untuk menangkap Ibrahim Mahmud dan 35 orang pengikutnya di bawah Akta Keselamatan Dalam Negeri (ISA) kerana disyaki terlibat dalam kegiatan yang menggugat keselamatan negara.

    Semasa operasi tersebut, pihak polis telah diserang oleh pengikut-pengikut Ibrahim Mahmud dengan bersenjatakan senjata api, parang, pedang dan buluh runcing. Pihak polis telah menyeru kepada mereka supaya meletakkan senjata dan menyerah diri secara aman. Demi mempertahankan diri dan mematahkan serangan tersebut, pihak polis terpaksa menggunakan senjata api dan melepaskan tembakan, kata Kementerian Dalam Negeri dalam jawapannya.

    Peristiwa tersebut telah mengorbankan empat orang anggota polis dan 14 orang awam termasuk Ibrahim Mahmud manakala 23 anggota polis dan 14 orang awam mengalami kecederaan.

    Mengikut cerita seorang saksi

    Saya mengambil inisiatif untuk bertemu dan mewawancara dengan salah seorang penting di belakang peristiwa ini; Senator Yusof Husin di bangunan Parlimen pada April lalu bagi mengetahui sendiri (mengikut perspektif beliau) mengenai peristiwa tersebut.

    Yusof Husin, 56, dikenakan tahanan di bawah Akta Keselamatan Dalam Negeri pada Jun-Nov 1985 dan kemudiannya dari Oktober 1987 hingga awal 1989.

    Faisal: Boleh Pak Yusof terangkan sedikit dahulu secara umum perisitiwa Memali.

    Yusof: Peristiwa Baling adalah kerana ISA. Kerana kerajaan pada ketika itu untuk menangkap Ibrahim Libya (nama betul Ibrahim Mahmud) di bawah ISA.

    Sebelum itu biarlah saya jelaskan siapakah Ibrahim Libya.

    Ibrahim Libya ini merupakan seorang ulama tempatan yang sebelum itu belajar di sekolah rendah di sekolah pondok, di kawasan Baling, madrasah di Kepala Batas, Pulau Pinang. Selepas itu dia melanjutkan pelajaran ke Nilam Puri, Kelantan. Kemudian India dan selepas itu menyambung pelajaran ke Libya.

    Sebab itulah dia dikenali sebagai Ibrahim Libya, atas kursus dakwah yang diambilnya di sana.

    Dia kembali ke tanahair pada awal 1970an dan dia bekerja di Jabatan Perdana Menteri, di Pusat Islam. Sehinggalah akhir pada penghujung tahun 1976 dia meletakkan jawatan dan dia bekerja dengan kedutaan Libya sebagai seorang pendakwah. Dan disitulah dia mula dikenali sebagai pendakwah bebas.

    Pada tahun 1978, dia menyertai PAS dan menjadi calon di DUN Bayu dan selepas itulah dia aktif di dalam PAS menyampaikan ceramah di merata tempat dan ceramah-ceramahnya amat diminati. Ceramah-ceramahnya di sekitar Kedah dan di utara Perak pada ketika itu.

    Sehinggalah pada September 2, 1984, lebih kurang pada pukul 2 pagi, dia dikepung oleh lebih 100 orang anggota polis untuk menangkap beliau di bawah ISA.

    Dan pada ketika itu orang kampung keluar beramai-ramai menghalang pasukan polis daripada menahan beliau di bawah ISA.

    Percubaan pasukan polis untuk menangkap beliau pada hari itu menemui kegagalan.

    Kalau tak silap saya, pada tarikh yang masa, Haji Mat Sabu, Suhaimi Shaib dan ustaz Abu Bakar Chik berjaya ditahan di bawah ISA.

    Kejayaan dakwah Ibrahim Libya

    Anak murid ustaz Ibrahim Libya di Memali yang kebetulan merupakan tenaga pengajar utama mendidik masyarakat Memali yang sebelum itu masyarakat Memali amat terkenal dengan masyarakat yang tidak mempedulikan hal-ehwal keagamaan dan sebagainya.

    Dan apabila dididik oleh Ibrahim Libya ini maka masyarakat kembali taat setia sehinggakan kita mendapati 100 peratus penduduk Memali menyertai PAS.

    Apabila dia gagal ditangkap di bawah ISA, maka dia menyembunyikan diri suatu tempat di Baling dan kami sebagai anak muridnya ketika itu bermesyuarat apakah kesudahan bila seorang Tok Guru tidak dapat menyampaikan ilmu. Kami membuat keputusan untuk membawa balik ke Memali.

    Di mana kami meletakkan setiap masa mempunyai lebih kurang 5-20 orang untuk mengawal. Kegiatannya ialah kuliah subuh setiap pagi di rumahnya sendiri, dan kuliah maghrib di madrasah Memali dalam proses pembinaan.

    Semua secara sukarela. Kami mula menghidupkan kembali madrasah Memali.

    Pada 13 Oktober 1985, kami mula membuka madrasah Memali sebagai sebuah sekolah rendah dengan pengajian penuh dan pelajar pada ketika itu 23 orang sahaja.

    Jadi, dalam suasana berkawal itu ada berbagai-bagai cubaan yang dilakukan oleh pihak pemerintah untuk menahannya tetapi semuanya gagal.

    Pada 22 Oktober 1985, tamrin dan ceramah pada malamnya yang dihadiri oleh seorang tokoh dari Terengganu di mana pada malam itulah berlakunya suatu peristiwa. …. Apabila ceramah tersebut diadakan, sekatan jalan diadakan di jalan masuk dan keluar Memali. Maknanya dari Baling satu hala, dan dari Sik satu hala.

    Pihak polis mengadakan kedua-dua sekatan menyebabkan orang ramai di kampung yang kebanyakannya tidak mempunyai cukai jalan, insurans motosikal dan sebagainya tidak dapat hadir. Lalu kami menyediakan sebuah van untuk mengangkut peserta-peserta tamrin untuk hadir di ceramah tersebut.

    Di mana akhirnya van ditahan oleh pasukan polis di lokasi lebih kurang 2km dari Madrasah Memali jalan dari Sik….

    Ditahan maka riuhlah suasana di tempat program di Memali itu dia telah ditahan ditahan oleh polis. Dan pada ketika itu juga lalu sebuah kereta peronda polis yang mana kereta peronda polis itu di dalamnya terdapat Tuan OCPD Baling, Tunku Muzaffar.

    Di mana lebih kurang 200-300 orang mengepungi kereta polis itu dan ada yang bertindak meletakkan senjata di tengkuk ketua polis daerah Baling dan pada ketika itu saya muncul untuk menenangkan keadaan, dengan ringkasnya menyelamatkan ketua polis daerah Baling itu dan dialah orang yang saya bertemu kembali di Parlimen baru-baru ini.

    Terdapat tiga orang sahaja di dalam kereta peronda tersebut. Dia di depan, di belakang seorang, dan pemandu.

    Faisal: Tunku Muzaffar ada niat untuk membuat tangkapan?

    Yusof: Kebetulan dia lalu di situ. Suasana tegang berlaku ketika itu kerana keadaan jam hari ditahan.

    Sebahagian besarnya penuntut madrasah sedang mengikuti program. Tetapi kalau mahu dikira lebih kurang seribu orang.

    Jadi peristiwa malam itu selesai. Dan sejak itu, polis berbagai-bagai cubaan tetapi rundingan dengan kami secara langsung tidak ada tetapi cuma ada beberapa cubaan meminta supaya ustaz Ibrahim Libya menyerah diri kepada polis dan dia berkali-kali menegaskan bahawa dia tidak akan menyerah diri kerana dia hendak ditahan di bawah ISA.

    Akta yang zalim, yang menahan seseorang tanpa perbicaraan dan dia akan menentang dengan jiwa raganya.

    Adakah alasan dia sebagai pendakwah menjadi alasan dia dikehendaki oleh kerajaan?

    Selalunya ISA ini memberitahu alasan ditahan, sebab apa ditahan. Jadi, dia belum ditahan dia belum [tahu].

    Tetapi kita merasakan dia seorang yang lantang suaranya dalam menyampaikan ceramah-ceramah, mengkritik kerajaan dan sebagainya. Itu di antara sebabnya.

    Dia diberitahu untuk menyerahkan diri kerana didakwa mempunyai senapang patah kepunyaan dia sendiri. Saya sendiri dan adiknya, Allahyarham ustaz Ismail pergi serah ke balai polis Baling kepada OCPD Baling, Tunku Muzaffar. Saya sendiri pergi serahkan sendiri senjata-senjata itu.

    Keadaan agak panas dan kita tahu bahawa dalam Perhimpunan Agung Umno hujung tahun 1985, wakil Kedah yang berucap dalam persidangan agung meminta kerajaan terutamanya Menteri Dalam Negeri bertindak tegas untuk menangkap Ibrahim Libya yang kononnya di Memali itu sudah menjadi sarang subversif yang menghimpun senjata-senjata untuk menjatuhkan kerajaan secara kekerasan.

    Pembekalan ke penduduk kampung? Siapa yang membekal?

    Sebenarnya tiada. Dan apabila berlaku peristiwa itu, kami tidak menyangkakan bahawa pihak polis sampai ke peringkat pembunuhan, sehingga sanggup membunuh. Tetapi apabila berlaku peristiwa itu pada 19 September 1985, awal subuh, kami dimaklumkan lebih 4,000 anggota polis, dari polis hutannya, UTK, FRU dan semua unit polis yang dihantar seramai 4,000 yang dihantar untuk mengepung rumah ustaz Ibrahim Libya.

    Penduduk di situ, kalau kata ‘Kg Memali’ ingat lebih 500 orang. Dan itu pun, bukan semuanya yang terlibat.

    Pagi-pagi itu lebih kurang 8 pagi, pasukan yang lengkap kereta perisai membuat sekatan di kedua-dua hala untuk menyerah diri dan pada ketika itu saya sendiri, yang dilantik oleh penduduk, anak murid Ibrahim Libya sebagai wakil mereka.

    Jadi kita berunding dengan ustaz Ibrahim dan beliau memberitahu bahawa sudah sampai masanya dia membuktikan bahawa dia tidak akan tunduk kepada ISA iaitu penentangan kepada suatu akta yang dia tidak boleh terima sama sekali. Itu kenyataan yang dikeluarkan oleh Ibrahim Libya.

    Jadi, pihak polis pada ketika itu mula menembak gas pemedih mata pada jam 8 pagi ke kawasan rumahnya.

    Di kawasan rumahnya seramai 160 orang kami berkumpul. Apabila gas pemedih mata itu dilepaskan, dengan tidak diduga, salah satu daripada tiub terkena ketua Mujahiddin.

    Terdapat seorang kanak-kanak anak kepada Mat Jah Hassan yang jatuh dan pengsan. Pada ketika itu umurnya bawah 10 tahun. Pada ketika itu, salah seorang daripada kami, iaitu cikgu Shafie Abdullah apabila beliau melihat kanak-kanak itu jatuh, dia menyangkakan kanak-kanak tersebut sudah mati.

    Saya memberi arahan bahawa tidak ada seorang pun boleh keluar dari kawasan rumah. Pintu pagar kami ikat supaya tidak ada seorang pun boleh keluar masuk dari rumah.

    Ustaz Ibrahim tidak mahu kita yang menyerang pihak polis, biarlah kita di kawasan rumah kita dan kawasan rumah kita dan membiarkan takdir menentukan.

    Dan dia tidak mahu menyerah diri sama sekali.

    Dan apabila Cikgu Shafie melihat keadaan itu, maka dia keluar dari kawasan rumah dan meluru ke unit pasukan polis yang sedang melepaskan tembakan gas.

    Dia bergerak 50 meter dari tempat persembunyiannya lalu dia ditembak dan dia mati di situ juga. Bukan dia sahaja yang keluar tetapi terdapat 3-4 orang yang meluru keluar mengikutnya dengan tujuan untuk menahannya kepada pergi ke unit yang melepaskan tembakan.

    Dia membawa parang bersamanya lalu ditembak.

    Khairy takes on the question: “It’s not the amount of money that the government puts aside for the arts. It’s where it’s going. And I think that’s the problem. It’s not going to the right places. And it’s going to a lot of mainstream [stuff], basically, at the moment, which needs to change.”

    On creativity and innovation in politics

    Pua and Khairy speak concretely about the one creative and innovative thing their parties have done since 2008.

    Nurul Izzah says PKR’s most innovative act was her father Datuk Seri Anwar Ibrahim’s call for the New Economic Policy (NEP) to be revamped so that affirmative action is based on need. Pua agrees that Anwar took a political risk, and that his consistent call to revamp the NEP was what convinced him that Anwar could be an alternative prime minister. Khairy agrees that Anwar has been consistent on this point, but argues that Anwar has it easier than Najib in bringing about such a change.
