Di laporkan bahawa Duli Yang Maha Mulia Sultan Ibrahim Iskandar, Sultan Johor telah bertitah bahawa baginda suka untuk melihat jambatan menggantikan tambak Johor. Demikian juga dititah oleh Al-Marhum Sultan Iskandar bahawa baginda hendak tambak Johor diganti dengan jambatan.

Saya tidak pernah dengar rakyat Johor kecuali seorang yang bersetuju kekalkan tambak dan kesesakan lalulintas di Johor Bahru kerananya. Demikian juga saya tidak dengar bantahan oleh rakyat Malaysia terhadap projek jambatan mengganti tambak Johor ini.

Terdapat juga surat daripada Perdana Menteri Singapura yang dahulu Goh Chok Tong yang disiarkan oleh Kerajaan Singapura dalam buku Water Talks - If Only It Could bahawa beliau tidak membantah pembinaan jambatan di perairan Malaysia jika itu dikehendaki oleh Kerajaan Malaysia.

Yang menolak pembinaan jambatan ini hanyalah Perdana Menteri Malaysia yang ke-5 yang mendakwa rakyat Johor tidak mahu jambatan ini walaupun 3 hari sebelum kenyataan ini dibuat Timbalan Perdana Menteri ketika itu, iaitu Perdana Menteri ketika ini, telah mengesahkan bahawa Jambatan berkenaan tetap akan dibina.

Soal yang ditanya oleh ramai kepada saya, dan saya yakin yang tertanya-tanya oleh majoriti rakyat ialah kenapakah Dato Seri Najib sebagai Perdana Menteri yang penuh berkuasa tidak sanggup meneruskan pembinaan jambatan ini? Apakah beliau terikat janji dengan PM ke-5? Apakah standing janji ini?

Dengan itu banyaklah tuduhan-tuduhan di buat yang mungkin akan memedihkan telinga pihak yang berkenaan.

Walaupun pemimpin Umno Johor telah ikrar mereka akan terus sokong BN tetapi di kalangan pengundi berbilang kaum ramai yang kurang percaya akan kewibawaan Kerajaan dan belum membuat keputusan berkenaan siapa pilihan mereka. Dan NGO-NGO Melayu di seluruh negara juga ber! pendiria n yang sama.

In this second of a array of interviews with former ISA detainees, The Nut Graph speaks with Mat Sah Mohd Satray as well as his wife, Norlaila Othman, about his arrest as well as apprehension underneath a ISA in Apr 2002. Mat Sah, a technician from Dewan Bahasa as well as Pustaka, was arrested together with 13 alternative suspects for allegedly being involved in militant organisations.

TNG: Mat Sah ditangkap pada 17 Apr 2002. Boleh ceritakan apa yang berlaku pada masa itu?

Mat Sah: Polis datang rumah pada pukul twelve malam, masa itu hanya ada saya, isteri, dan anak saya yang berumur lapan tahun dalam rumah. Saya belum tidur lagi, dengar ada bunyi depan, saya joke pergi tengok. Masa itu gelap, tetapi saya nampak ada seorang polis pakai uniform. Dia tanya saya, Boleh cakap dalam? Saya joke buka pintulah, lepas itu tujuh, lapan orang terus masuk dan gari tangan saya.

Saya tanya mengapa gari saya, dia cakap, Saya terima maklumat bahawa awak terlibat dalam aktiviti yang mengancam keselamatan negara. Dia tak cakap di bawah ISA atau tunjukkan waran pun.

Lepas itu?

Norlaila: Lepas itu mereka mula menggeledah rumah kami sampai pukul empat pagi, buka almari, buka laci, baju dalam joke mereka semak, bawah katil, bawah cadar sampai bilik ketiga. Kami letak banyak buku dalam bilik ketiga, mereka seronok jumpa banyak kertas, setiap buku mereka semak, lepas itu mereka jumpa artikel saya, dalam artikel itu ada gambar Saari Sungib, seorang pemimpin NGO (badan bukan kerajaan) yang ditahan di bawah ISA pada tahun 2001. Mereka nampak gambarnya, terus kata, Ini! Ada couple dengan Saari Sungib! dan terus ambil artikel saya. Artikel itu saya punya, tetapi yang kena tangkap suami saya.

Hakim jelas kenapa Tian Chua kekal sebagai MP........

Hakim Mahkamah Tinggi, Datuk Ghazali Cha menegaskan pada penghakiman bertulisnya bahawa denda RM2,000 yang dikenakan ke atas Tian Chua dari PKR tidak akan menyebabkan beliau kehilangan kerusi parlimen Batu.

Pada 17 June lalu, ketika menolak rayuan Chua tetapi mengurangkan hukumannya, Ghazali berkata keputusannya adalah berdasarkan penghakiman Mahkamah Agung 1993 kes Public Prosecutor lawan Leong Yin Ming yang hanya denda RM2,001 atau lebih yang akan meyebabkan perlucutan kerusi secara automatik.

Dalam penghakiman eighteen dokumennya, hakim itu memetik sebahagian penghakiman hakim Mahkamah agung, Tan Sri Gunn Chit Tuan yang berkata Tidak kurang dari seharusnya membawa maksud "lebih daripada".

Maka dengan berpegang kepada keputusan dalam kes Mahkamah Agung di atas, saya berpuas hati dan berpendapat bahawa denda RM2,000 itu tidak menjadikan perayu hilang kelayakan beliau secara automatik kerana denda untuk menjadikan beliau beliau hilang kelayakan adalah RM2,001 ke atas dan bukannya bermulka daripada RM2,000.

Keputusan Mahkamah Agung ini mengikat mahkamah rendah. Ia adalah autoriti kukuh yang boleh diguna-pakai oleh mahkamah ini, kata hakim Ghazali.

Oleh itu, saya berkeyakinan bahawa hukuman denda tersebut tidak akan memberi implikasi kepada satu pilihan raya kecil di kawasan Batu; maka niat saya yang ikhlas itu telah dizahirkan melalui hukuman denda tersebut, selain memberikan suatu amaran keras kepada perayu supaya tidak mengulangi perbuatan yang sama pada masa hadapan, katanya.

Keputusan hakim, Ghazali yang sebelum ini mengurangkan denda daripada RM3,000 dan enam bulan penjara kepada RM2,000 atau dua bulan penjara menimbulkan kontroversi sama ada ahli parlimen Batu itu telah hilang kelayakannya. Tian Chua didapati bersalah kerana mengiggit seorang konstabel polis ketika ditahan di sebuah protes di bangunan parlimen, tiga tahun lalu.
Kon troversi timbul berikutan tafsiran Artikel 48, Perlembagaan Persekutuan berhubung istilah denda tidak kurang RM2,000 dan penjara tidak kurang setahun. Peguam yang mewakili Tian Chua berhujah berdasarkan keputusan Mahkamah Agung pada 1993, tafsiran itu membawa maksud RM2001.

Bagaimanapun peguam kanan Karpal Singh, bersama bekas presiden Majlis Peguam Ambiga Sreenevasan dan bekas hakim Mahkamah Tinggi, Datuk Syed Ahmad Idid Syed Ahmad berpendapat tafsiran itu membawa maksud RM2,000.

Kenapa tidak hakim terus kurangkan denda kepada RM1000 saja? Dengan berbuat demikian sudah tentu Tian Chua akan kekal jadi MP. Sapa joke tak akan pening kepala!!

Sebaliknya hakim setelah mengurangkan denda cuba bagi alasan tujuan mengurangkannya adalah untuk elak daripada diadakan PRK. Penentuan sama ada PRK boleh diadakan atau tidak bukan tugas si hakim......

Hutang FELDA melambak setelah Najib pegang kuasa

FELDA Global Venture Holdings menggunakan tunai simpanan (cash reserves) dan berhutang secara besar-besaran, untuk menjalankan partnership dan akuisisi di luar negeri. Lebih-lebih lagi, pembelian perusahaan-perusahaan ini dijalankan dalam keadaan tidak bersedia, tanpa penelitian dan penyemakan peneroka FELDA tentang bagaimana dana ini digunakan, dan maklumat terperinci berhubung pelaburan ini.

Demikianlah perubahan yang membimbangkan dalam FELDA, setelah Najib Razak menyandang jawatan Perdana Menteri, menurut sumber dalaman FELDA. Beliau memberitahu MerdekaReview, FELDA memperlihatkan perkembangan yang membimbangkan, setelah Najib Razak menguasai FELDA sepenuhnya, terutamanya apabila FELDA Global Venture Holdings ditubuhkan pada tahun 2007.

"Sebelum Najib masuk, kami (FELDA) tidak pernah bertindak sebegitu pantas dalam pembelian perusahaan (merger dan akuisisi). Setelah beliau masuk, terutamanya selepas penubuhan FELDA Global Venture Holdings, pembelian perusahaan di luar negeri dijalankan dengan begitu giat sekali," kata sumber maklumat.

Malah, beliau menambah, keputusan pembelian perusahaan atau pelaburan ini bukannya hasil perbincangan dalam FELDA, tetapi arahan politik. Lebih-lebih lagi, dalam kebanyakan masa, hanya beberapa orang dari pihak atasan yang mengetahui maklumat terperincinya.

Beliau menambah, Najib menjalin hubungan yang erat dengan FELDA sejak beliau menyandang jawatan Timbalan Perdana Menteri. Kekerapan Najib muncul dalam mesyuarat FELDA bertambah dari purata dua bulan sekali, sehingga sebulan sekali sekarang, bahkan kadang-kala, dua minggu sekali.

Apa yang menarik, Najib telah mengalihkan FELDA ke bawah Jabatan Perdana Menteri setelah beliau dilantik sebagai TPM pada tahun 2004. FELDA diletakkan secara langsung di bawah bidang kuasa dirinya.

Strategi radikal dalam pembelian pe! rusahaan
Sumber maklumat ini meluahkan keresahan pihak dalaman FELDA, "Kami menganggap projek partnership dan akuisisi (yang dijalankan FELDA Global Venture Holdings) tidak harus dilakukan dengan tergesa-gesa, sekurang-kurangnya nilailah dahulu hasil projek pembelian perusahaan sebelum terus kepada projek yang selanjutnya... Bukannya asyik beli sahaja."

Lebih penting, pembelian ini dijalankan tanpa persediaan yang mencukupi dalam FELDA sendiri, iaitu tidak mengambil kira sama ada mereka mampu untuk menanganinya. Misalnya, FELDA Global Venture Holdings mengambil alih kilang pemprosesan minyak kelapa sawit di luar negeri, yang mana perusahaan utamanya adalah penghasilan produk yang mempunyai nilai tambahan, sementara bahan mentahnya (iaitu kelapa sawit) dibekalkan melalui projek peneroka FELDA. Pada hakikatnya, FELDA sendiri belum bersedia untuk memenuhi keperluan kilang pemprosesan yang semakin bertambah.

Pelaburan di luar negeri
FELDA Global Venture Holdings ditubuhkan pada Disember 2007, tetapi hanya diumumkan struktur organisasinya pada Julai tahun lalu. Tiga buah anak negeri di bawah FELDA Global Venture Holdings termasuklan Felda Global Ventures North Amerika Sdn. Bhd, Felda Global Ventures Indonesia Sdn. Bhd dan Felda Global Ventures Middle East Sdn. Bhd.

Setakat ini, pelaburan di luar negeri oleh FELDA Global Venture Holdings yang diumumkan termasuklah pembelian Syarikat Twin River Technologies di Amerika Syarikat. Selain itu, FELDA Global Venture Holdings turut mencari peluang pelaburan dalam bidang perladangan di Indonesia; di samping terlibat dalam pelaburan di Timur Tengah.

Sebagaimana yang diketahui, apa yang diumumkan ini hanyalah sebahagian daripada pelaburannya. Pada hakikatnya, syarikat ini telah menerokai pelaburan di Brazil, India dan Amerika Syarikat. Tetapi, pelaburan ini masih dalam keadaan menanggung kerugian.

Selain itu, FELDA telah menggunakan tunai simpanan (cash reserves) dan berhutang untuk menanggung pembelian perusahaan di luar negeri in! i. Lant aran daripada itu, tunai simpanan FELDA menunjukkan pola pengurangan, malah menanggung hutang yang besar.

"Pada awalnya, ketika FELDA mempunyai banyak tunai simpanan, sesetengah elit menuduh bahawa wang ini tidak dikendalikan dengan baik, dan seharusnya digunakan untuk melabur. Namun, pelaburan seharusnya mempunyai perancangan jangka panjang, bukannya melabur secara tergesa-gesa. Kini, tunai simpanan yang tinggal tidak seberapa, kerana telah digunakan untuk partnership dan akuisisi."

Sumber maklumat ini berkata, "Saya bersetuju dengan Tan Kee Kwong (bekas Timbalan Menteri Tanah dan Pembangunan Koperasi, gambar kiri), bahawa FELDA pada asalnya tidak berhutang, tetapi terlebih berhutang pada masa sekarang."

Baru-baru ini, kerajaan Najib mengakui bahawa tunai simpanan FELDA telah berkurang dari RM4.08 bilion pada tahun 2004 kepada RM1.35 bilion pada tahun 2009, dengan pengurangan pada kadar 67%. Selain itu, Tan Kee Kwong pernah mendedahkan bahawa FELDA memiliki aset bernilai RM7 bilion, dan tunai simpanan sejumlah RM4.5 bilion, malah tidak berhutang, sebelum Najib mengambil alih FELDA.

Sebelum ini, media melaporkan bahawa FELDA sedang merancang untuk menerbitkan bon yang bernilai RM6 bilion, sebagai sebahagian daripada penstrukturan semula FELDA. Angka ini sama dengan pengumuman FELDA Global Venture Holdings bahawa mereka merancang untuk melaburkan lebih RM6 bilion untuk memperluaskan perusahaannya.

Pembangkang mengkritik bahawa Najib dan Mohd Bakke Salleh yang bakal menjadi Ketua Pegawai Eksekutif Sime Darby, harus bertanggungjawab terhadap pengurangan tunai simpanan secara mendadak dalam FELDA. Sumber dalaman FELDA mengesahkan bahawa setelah FELDA melantik Mohd Bakke Salleh sebagai Ketua Pegawai Eksekutif FELDA Global Venture Holdings pada tahun 2008, partnership dan akuisisi mula dijalankan dengan giat di luar negeri.

Peneroka FELDA diketepikan
Di samping itu, sumber maklumat ini menyatakan bahawa beliau tidak bersetuju bahawa peneroka FELDA diketepikan k! etika ke putusan pelaburan ini dilakukan.

"FELDA memegang 100% saham FELDA Global Venture Holdings, tetapi peneroka FELDA tidak boleh turut serta, dan tiada hak untuk mengetahui dan mengundi dalam FELDA Global Venture Holdings. Jangan lupa, kilang pemprosesan kepala sawit yang dibeli FELDA Global Venture Holdings itu, kelapa sawitnya dibekalkan peneroka FELDA. Daripada 800 ribu hektar ladang yang dimiliki FELDA, 50% daripadanya dimiliki peneroka FELDA. Tindakan ini (mengetepikan peneroka FELDA) telah merampas hak yang seharusnya dimiliki mereka," katanya.

Menurut laporan media, kerajaan hanya memindahkan 49% saham FELDA yang dimiliki kerajaan ke FELDA Global Venture Holdings ketika ia ditubuhkan, sementara 51% saham yang dimiliki peneroka FELDA terus dikekalkan dalam FELDA. Peneroka FELDA memegang 51% saham melalui Koperasi Permodalan Felda, yang terdiri daripada 110 ribu orang peneroka FELDA dan twenty-two ribu orang pekerja.

Dengan kata lain, walaupun FELDA menguasai 100% saham FELDA Global Venture Holdings, namun peneroka FELDA yang merupakan pemegang saham besar (51%) telah diketepikan dalam proses membuat keputusan dalam FELDA Global Venture Holdings.

Menurut laporan The Malaysian Insider semalam, National Association of Felda Settlers Children telah menggesa agar Suruhanjaya Pencegah Rasuah Malaysia (SPRM) menyiasat sama ada dana FELDA telah disalahgunakan. Pengerusinya, Mazlan Aliman berkata, seandainya Timbalan Menteri Jabatan Perdana Menteri Ahmad Maslan enggan memberi penjelasan berikutan pengurangan tunai simpanan FELDA, maka pihaknya bersedia untuk membuat laporan kepada SPRM dan balai polis di setiap negeri pada bulan depan.

Minggu lalu, Ahmad Maslan menafikan bahawa pengurangan tunai simpanan FELDA disebabkan salah urus, malah menafikan bahawa wang ini disalahgunakan.
